ORDINANCE NO. 2194
AN ORDINANCE VACATING AND ABANDONING THE DEDICATION OF 3 FEET X 65 FEET OF A
7.5 FOOT UTILITY EASEMENT IN SHADY OAKS ADDITION.
WHEREAS, the plat of Shady Oaks Addition, which is recorded in Plat Cabinet A, Slide 697 of Plat
Records of Tarrant County, Texas, shows and identifies the dedication of a 7.5 foot utility easement along
the north property line of Lot 47, Block 2, of said addition; and
WHEREAS, the owner of Lot 47, Block 2, Shady Oaks Addition, wishes to install a wall, pool and
pool deck, which would encroach into a portion of the 7.5 foot utility easement; and
WHEREAS, Lone Star Gas Company, Southwestern Bell Telephone Systems, Marcus Cable
Systems, TU Electric, and North Richland Hills Public \Norks have no utilities within the above described 3' x
65' portion of the 7.5' utility easement;
NOW, THEREFORE, be it ordained by the City Council of the City of North Richland Hills, Texas,
that:

The southwest 3' x 65' corner of a 7,5 foot utility easement, as described above and on the attached
plat, is hereby vacated in favor of the owner of said Lot 47, Block 2, Shady Oaks Addition, City of North
Richland Hills, Texas, Tarrant County, Texas.

The City Council finds that any right-of-user established by prescription in favor of the public has now
been abandoned and that the ownership and use of the portion of the easement in question should revert to
the owner of Lot 47, Block 2, Shady Oaks Addition, free and clear of any prescriptive claims or other rights in
the public and it is so ordered.
PASSED AND APPROVED this the 28th day of April, 1997.

As previously discussed, I am planning to have 3 swimming pool constructed on my lot (Shady Oaks
Addition, Lot 47, Blk 2). In order to accomplish this I need to have a portion of the 7'12' utility
