RESOLUTION NO. 76-5
RESOLUTION OF THE MAYORS' COUNCIL
OF TARRANT COUNTY ESTABLISHING A
UTILITY RATE STUDY COMMITTEE
WHEREAS, the Mayors of the undersigned cities of Tarrant County,
acting with the concurrence of the Tarrant County Commissioner's Court and
the full consent of our respective city councils and in behalf of the interests
of our respective citizens, do hereby jointly and severally agree to establish
a county-wide Utility Rate Study Committee; and
WHEREAS, the committee, functioning under the direct auspices of the
Mayors' Council of Tarrant County shall hereinafter be referred to as the Tarrant
County Utility Rate Study Committee; and,
WHEREAS, that the Tarrant County Utility Rate Study Committee shall be
empowered, on behalf of the undersigned cities, to consider requests for utility
rate increases of any and all descriptions in accordance with V.A.T.S. Article
1446c, Section 17a and Section 19a, from the vatious utility companies that
provide our respective cities with natural gas, synthetic natural gas, electric
power, and telephone service; and
FURTHER, that the Tarrant County Utility Rate Study Committee shall be
empowered in accordance with V.A.T.S. Article 1446c, Section 24, to select and
engage rate consultants, accountants, auditors, attorneys, engineers, or any
combination thereof, to conduct investigations on behalf of any or all of the
undersigned cities; and
FURTHER, the costs incurred jointly or severally by the participating
cities in the engagment of any of the aforementioned specialists shall be borne
by the individual utility company seeking an increase in rates; otherwise the
costs are to be assumed by the individual cities on the basis of an equitable
formula to be derermined by the Tarrant County Utility Rate Study Committee and
jointly and severally approved by the city councils of the member cities; and
FURTHER, with the concurrence of Tarrant County Commissioners' Court,
it is the desire of the Mayors' Council of Tarrant County that the cities of
Fort Worth, Arlington, and Grand Prairie, a portion of which lies within the
boundaries of Tarrant County, be invited to participate as associate members of
the Tarrant County Utility Rate Study Committee if they desire to do so.
BE IT FURTHER RESOLVED, that upon approval of this resolution by our
respective city councils, and city participating in the Tarrant County Utility
Rate Study Committee agrees to hereinafter refer all requests for utility (gas,
electric, and telephone) rate increases to the Tarrant County Utility Rate Study
Committee for consideration and validation and/or justification; and,
BE IT FURTHER RESOLVED, that authority for the final decision of
whether or not a specific rate request is approved o~ rejected shall continue
to reside with the respective city councils of the cities participating in
the Tarrant County Utility Rate Study Committee.
