HomeMy WebLinkAboutOrdinance 2143 ORDINANCE NO. 2143 AN ORDINANCE BY THE CITY OF NORTH RICHLAND HILLS, TEXAS, AMENDING ZONING ORDINANCE NUMBER 1874, THE COMPREHENSIVE ZONING ORDINANCE, TO AUTHORIZE SPECIAL USE PERMIT NUMBER THIRTY-THREE (33) FOR A CAR RENTAL AGENCY; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City has received a request for a Special Use Permit for a Car Rental Agency; and WHEREAS, after appropriate notice and public hearing, the Planning and Zoning Commission of the City of North Richland Hills, Texas, has forwarded a recommendation to the City Council for amendment of Ordinance No. 1874 by changing said Zoning Ordinance as set forth herein; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: 1. THAT, Special Use Permit Number Thirty-Three (33) be hereby authorized for a Car Rental Agency as set forth in Case Number PZ 96-17 on the property described as follows: Being a portion of a 0.919 acre tract of land situated in the City of North Richland Hills, Tarrant County, Texas, and being part of the John Van Dusen Survey, Abstract 1588, and being further described by metes and bounds as follows: COMMENCING at a Texas Highway concrete monument, being the southwest corner of a 0.537 acre right of way conveyed to the State of Texas by deed recorded in Volume 3734, Page 341, Deed Records, Tarrant County, Texas, said point also being the southwest intersection of the south line of right of way on Interstate 820 and the west line of Rufe Snow Drive; THENCE South 00 degrees 18 minutes West 150.0 feet along the West line of Rufe Snow Drive to an iron pin; THENCE South 89 degrees 48 minutes West 20.0 feet to the POINT OF BEGINNING of the tract herein described; THENCE South 00 degrees 18 minutes West 140.0 feet along the West line of Rufe Snow Drive, to an iron pin for corner; THENCE South 89 degrees 48 minutes West 286.0 feet to an iron pin for corner; THENCE North 00 degrees 18 minutes East 140.0 feet to an iron pin for corner; THENCE North 89 degrees 48 minutes East 286.0 feet to an iron pin for the POINT OF BEGINNING, and containing 0.919 acres of land, more or less. This property is generally located at 5033 Rufe Snow Drive. 2. THAT, the development regulations contained in the C-2 Commercial zoning district of Ordinance 1874 shall govern development on said property, except where amended below. The regulations contained herein shall prevail over any inconsistencies with the regulations contained in Ordinance 1874. a. Parking of Vehicles for Rent: The site plan, attached as Exhibit A, indicates the area allowed for the parking of vehicles for rent. The property shall maintain a minimum of 30 spaces on the lot for customer parking. b. Age of Vehicles for Rent: Vehicles available for rent shall not exceed five years of age. The age of the vehicle shall be determined by the calendar year at the time the determination is made, e.g., in 1996, cars shall not be older than 1991 models. a. Repair Work: Automobile repair work, as defined by Ordinance No. 1874, shall not be performed on premises. 3. THAT, all the regulations contained in the Zoning Ordinance No. 1874, as amended, which are not in conflict with the terms of this Special Use Permit, shall remain in full force and effect regarding this property. 4. SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the section, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section.
