ORDINANCE NO. 2149
WHEREAS, an easement was dedicated to the City (public) in the approved plat
of Lots 3R and 4R of Block 2, Walker Branch Addition to the City of North Richland
Hills, Tarrant County, Texas on January 8, 1996 which is filed in Cabinet A, Slide 2941,
Plat Records of Tarrant County, Texas; and
WHEREAS, the variable width utility easement shown on said plat does not
coincide with the actual placement of the existing water line across said tract; and
WHEREAS, the City Council of the City of North Richland Hills has been asked
to vacate the dedication of the said utility easement in said plat of January 8, 1996, in
exchange for newly executed easement showing the actual location of the City water
line which was intended to occupy said easement; and
WHEREAS, the owner of the said Lots 3R and 4R have executed a new
easement to replace the easement vacated herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF NORTH RICHLAND HILLS, TEXAS, THAT:
1.
The dedication of the easement in the plat approved by the City Council on
January 8, 1996, which is described by metes and bounds on Exhibit "A" and "B",
attached hereto and made a part hereof, be and is hereby vacated in favor of the
owners of Lots 3R and 4R, Block 2 of Walker Branch Addition to the City of North
Richland Hills, Texas.
2.
The utility easement signed by Robert A. McCauley II, Vicki L. Thornton
McCauley, and Power Play In-Line Hockey, L.P. dated September 23,1996, be, and is
hereby accepted as a substitute for the easement vacated herein.
PASSED AND APPROVED this the 23rd day of September, 1996.

ABANDONMENT DESCRIPTION
VARIABLE WIDTH UTILITY EASEMENT
LOT 4R, BLOCK 2, WALKER BRANCH ADDITION,
NORTH RICHLAND HILLS, TARRANT COUNTY, TEXAS.
ALL of that certain tract or parcel of land situated in and
embracing the variable width Utility Easement shown on the
plat of Lots 3R and 4R, Block 2, Walker Branch Addition, an
Addition to the City of North Richland Hills, Tarrant County,
Texas as recorded in Cabinet A, Slide 2941 of the Plat
Records, Tarrant County, Texas and being more particularly
described by metes and bounds as follows:
COMMENCING at a 1/2 inch capped steel rod stamped "Moak Surv.
Inc." for the northwest corner of said Lot 4R; Thence North
89 degrees 56 minutes 10 seconds East with the northerly
boundary line of said Lot 4R a distance of 7.52 feet; Thence
South 04 degrees 34 minutes 27 seconds East with the Easterly
line of an existing 7.5 Ft. wide Utility Easement 49.00 feet
to the Northeasterly line of said variable width Utility
Easement for the PLACE OF BEGINNING;
THENCE South 50 degrees 59 minutes 07 seconds East with said
Northeasterly easement line 535.46 feet to the Northwesterly
line of an existing 7.5 Ft. wide Utility Easement;
THENCE South 41 degrees 45 minutes 58 seconds West with said
Northwesterly easement line 7.51 feet;
THENCE with the Southwesterly line of said variable width
utility easement the following calls:
North 50 degrees 59 minutes 07 seconds West, 35.61 feet;
South 41 degrees 45 minutes 21 seconds West, 37.69 feet;
North 50 degrees 59 minutes 07 seconds West, 210.44
feet;
North 39 degrees 00 minutes 53 seconds East, 22.00 feet;

Easterly line of existing easement 20.71 feet to the place of
beginning and containing 0.3381 acres of land, more or less
as surveyed by David C. Moak Surveyors, Inc. dur ing the
month of August, 1996.
