(hereinafter called OWNER) finds that it is necessary and Draper to employ consulting engineers to furnish the professional engineering ass"istance essential for the proper planning of the City; for assistance and general consultation on day to day problems of the City; and for partial or complete engineering services on specific projects that may be undertaken or participated in by the CitY8 and; That t1e firm of ~~OWLTON-PATLIFF-ENGLISH of Fort Worth, Texas, (hereinafter called ENGINEER) be retained to furnish such profe$sional services to the . CITY OF NORTH RICrlLAND HILLS, TEXASr subject to the fo11O\.¡;ng conditions: 1. An advance retainer payment of ($1.00) dollar shall be paid to the Engineering Finn by the ~1unicipa11ty within ten (10) days: after date of this Resolution as a partial payment for the professional services required. 2. Additional payments shall become due or payable for Engineering Services furnished only as such services are specifically requested and authorized by appropriate notice from the· Mayor, the City Manager. or other representative of the Owner who is authorized by the City Council to give such notice to the Engineer. 3. Charges for slJch Engineering Services shall be determined in accordance with the current edition of the IIManual of Professional Practice" pUblished by the Texas Society of Professional Engineers. Day to day charges for miscellaneous projects and General Consultation 1 of 2 shall be computed by the per diem method. as described in Section 5~ 8 of the Manual. In the event a. project of substantial magnitude is under- taken. an additional detailed agreement shall be negotiated in accordance vdth the above mentioned Manual and of it form substantially pðtterned after the "Guide Form Agreement for Engineering Services". as published the Texas Construction Council. such form to be modified by Mutual ¡!\gree- ment of Owner and Engineer to suit the particular conditions of the project. 4. By this Resolution. the Engineer is authoriz2d to receive information and data on behalf of the Owner where such is essential or relevant to the best interests of the Û\<mer9 but the Resolution does not authorize the Engineer to contract for. or otherwise obligate or commit the OvJner i~ any way. The Engineer particularly is not authorized or obligated furnish advice. consultation or services to private citizens or third parties and all such contact with third parties shall handled through the Mayor. City Manager. or other City Officials designated by the City Council. 5. The Owner agrees to furnish the Engineer \'fith such data and records ê¡$ are in the Owneris files which will be of assistance to the Engineer and to take such actions as are recommended by the Engineer to be reasonable and proper for the accomplishment of any proposed projects that are approved by the Owner. The Qo,mer wi 11 not permit such proDoseò project to be constructed privately or by any other means unless the Engineer is employed and/or paid for his services. 6. The Engineering Services authorized by this Resolution may cancelled by p~yment to the Engineer the amount of the Engineering costs incurred on authorized work through the date that written notification of cancel1a~ tion is delivered to the office of the Engineer. Councilman Dodson moved that the Re501ution be adopted.
