RESOLUTION NO. 76-2
WHEREAS, the Public Utility Regulatory Act, Article 1446c, V.A.C.S.,
provides in part that the geverning body of each municipality shall have exclusive
original jurisdiction for the regulation of the rates and services of all public
utilities providing service within the city limits, with the exception of
telecommunications utilities, and has defined each municipality as the Regulatory
Authority for the purpose of exercising such jurisdiction; and
WHEREAS, Section 34 of the Public Utility Regulatory Act provides that
the Regulatory Authority shall prescribe regulations governing communications by
public utilities, their affiliates and their representatives, with the Regulatory
Authority or any member or employee of the Regulatory Authority; and
WHEREAS, the City Council proposes to adopt a set of rules to be known
as the "Public Utility Communications Rules", for the purpose of complying with
Section 34 of the Public Utility Regulatory Act, and for the purpose of governing
the conduct of all communications, verbal or written, between public utilities,
their affiliates and representatives with Regulatory Authority, its members and
employees; and
WHEREAS, although the Public Utility Regulatory Act became effective
on September 1, 1975, the jurisdiction of the Regulatory Authority pursuant to
the provisions of the Act becomes effective on January 1, 1976; Now, Therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS:
SECTION 1. That the Public Utility Communications Rules, attached hereto and
identified as Exhibit HAil, be and are hereby adopted as the Public Utility
Communications Rules of the City of North Richland Hills, pursuant to the provisions
of Section 34 of the Public Utility Regulatory Act.
SECTION 2. That the Public Utility Communications Rules hereby adopted shall
become effective immediately and shall thereafter govern the conduct of all
communications, verbal or written, between public utilities, their affiliates
and representatives with the Regulatory Authority or any member or employees of
the Regulatory Authority.
SECTION 3. That this Resolution shall become effective from and after its
passage in accordance with the provisions of the Charter of the City of North
Richland Hills and it is accordingly so resolved.
