Modifications to the Sign Ordinance based on recently passed legislation
Recently passed Texas House and Senate Bills concerning the regulation of signage will require
some revisions to our current Sign Ordinance. Attached are two proposed amendments from
City Attorney George Staples concerning political signs and nonconforming signs. The following
is a synopsis of these amendments.
Political Signs
· Current regulations for political signs located in "AG" Agricultural and all "R" Residential
Districts limit signs to no greater than six (6) square feet in size and three (3) feet in
height. In all other zoning districts signs are limited to no greater than fifty (50) square
feet in size and six (6) feet in height. The proposed amendment would eliminate these
restrictions.
· H.B.212 limits the ability of cities to regulate signs on private property to the size and
height stated by this amendment. First amendment protections restrict cities from more
stringently restricting political signs than the city restricts other signs. The city allows real
estate signs on the weekends on public right-of-way.
· Political signs placed in the public ROW are currently limited to less than three (3) square
feet in size and must have the permission of the abutting property owner. The proposed
amendment would permit signs in the ROW but limit them to less than three (3) feet in
height and six (6) square feet of sign face for each side. Signs may be placed no closer
than three (3) feet from the edge of the pavement. No permission of the abutting property
owner is required by this amendment.
Nonconforming Signs
· Abandoned, on-premise, commercial signs must now be removed (without compensation)
within thirty (30) days after the first anniversary (one year) of the date which the business
ceases to operate unless the premises where the sign is contained is leased, in which
case the sign shall be removed (without compensation) within thirty (30) days after the
second anniversary (two years) of the date that a tenant ceases to operate.
· On-premise signs identifying a business that ceases to operate shall not be altered to
advertise another business unless the alterations conform to the city's sign regulations.
Staff will discuss the impact of these amendments with the Council during the Pre-Council
session. Ordinance amendments will be placed on upcoming agenda for the Council's
consideration.

Political SiD Restrictions
6. Political Signs.
a. A political sign is a sign that contains primarily a political message, has an
effective area of 36 square feet or less, is no more than eight feet in height, is not illuminated,
and has no moving elements.
b. No permit shall be required for any political sign.
c. Political signs shall be allowed in all zoning districts on private property with the
consent of the property owner.
d. Political signs shall not be located on any utility, light, traffic signal or sign pole.
e. Political signs shall be allowed for a period of thirty (30) days prior to local or
county elections, sixty (60) days prior to a state election, and ninety (90) days prior to a national
election. All political signs shall be removed no later than seven (7) days after the election or
after the termination of candidacy, whichever comes first.
f. Signs with primarily political messages which do not meet the definition of (a)
above shall not be allowed unless within a residential zoning district with a permit, subject to
other sign requirements.
g. Political signs shall not be located so as to cause a safety or traffic hazard.
h. A political sign shall not be illuminated or projected.
i. Political signs shall not be placed on public property or within public right of
way, except that political signs less than three (3) feet in height and with no more than six (6)
square feet of sign face on any side may be placed in public right of way no closer than three (3)
feet from the edge of pavement. Political signs shall not encroach into sidewalks or streets.

AMENDMENT OF SECTION 10 TO ORDINANCE 2374 TO CONFORM
TO CHAPTER 216 OF THE TEXAS LOCAL GOVERNMENT CODE AS
AMENDED BY S.B. 656, 78TH LEGISLATURE
10.
Nonconfonning signs.
A. Definitions.
(1) "Sign" means an outdoor structure, sign, display, light device, figure,
painting, drawing, message, plaque, poster, billboard, or other thing that is
designed, intended, or used to advertise or inform.
(2) "On-premise sign" means a fteestanding sign
identifying or advertising a business, person, or activity, and installed and
maintained on the same premises as the business, person, or activity.
(3) "Off-premise sign" means a sign displaying
advertising copy that pertains to a business, person, organization, activity,
event, place, service, or product not principally located or primarily
manufactured or sold on the premises on which the sign is located.
B.
Signs erected in violation of law. Any sign erected or placed in violation of a city
ordinance or regulation applicable at the time of its erection shall be deemed to
constitute a violation of this ordinance and shall be removed upon notification to
the owner of the premises where it is located. Failure to remove such sign after
notice shall constitute a violation of this ordinance.
C. Destroyed signs. Signs which do not comply with current sign ordinances of the
city must, if damaged or destroyed, so that the cost of repairing such sign is more
than 60 percent of the cost of erecting a new sign of the same type at the same
location, be removed upon notice. Failure to remove such a sign shall constitute a
violation of this ordinance.
D. Abandoned On-Premise Signs.
(1) On-premise signs identifying or advertising a business shall be removed
within thirty days following the first anniversary of the date on which the
business, person or activity identified or advertised by such sign or sign
structure ceases to operate on the premises where the sign or sign structure
is located; provided, however, if the premises containing the sign is leased,

such removal shall be required within thirty days following the second
anniversary of the date the most recent tenant ceases to operate on the
premises. Failure to remove as required shall constitute a violation of this
ordinance.
(2)
On-premise signs or sign structures advertising or identifying a person,
activity or business which ceases to operate on the premises shall not be
altered to advertise another person, activity or business unless such sign as
altered shall conform to the city's sign regulations, including but not
limited to size, height, and location.
E. Other Non-Conforming Signs.
All other permanent signs which do not comply with current sign regulations shall
be entitled to remain unless required to be relocated, reconstructed or removed in
compliance with Subchapter A of Chapter 216 of the Texas Local Government
Code.

T Subject: Discuss Ad Hoc Committee for Chemical Toilet Amendment
Several home builders and Council want to review the Ordinance and Trinity Waste Contract
that requires that Trinity Waste be the sole provider of chemical toilets at residential
construction sites. Trinity Waste is hesitant to modify or eliminate this provision in their
contract as they say that their bid prices for garbage service to North Richland Hills was
partially based on their receiving revenues/profits from mandatory chemical toilets by their
company. On the other side, some home builders are saying they have no flexibility in
negotiating chemical toilet prices and they work in several cities and this causes problems for
them.
Since it seems that there are such differing views and this appears to be a matter of concern
to Council and these two groups, it is suggested that Council consider approving a Council
Ad Hoc Committee to review the chemical toilet issues discussed at the July 21 Council
meeting.
The Ad Hoc Committee would be charged with the responsibility of meeting with
representatives from Trinity Waste and representatives of the Greater Fort Worth Home
Builders Association to discuss chemical toilets and make recommendations to the Mayor
and Council.
It is recommended that the Ad Hoc Committee consist of three Council members. Per the
Council Rules, the Mayor will appoint members of such City Council committees, subject to
the approval of the Council. According to the Rules of Procedure, "any ad hoc committee so
created shall cease to exist upon the accomplishment of the special purpose for which they
were created, or when abolished by majority vote of the City Council. No ad hoc committee
so appointed shall have powers other than advisory to the City Councilor the City manager,
except as otherwise provided for in the City Charter"
This item is placed on the Pre-Council to seek direction and preference on establishing an ad
hoc Council committee for this purpose.

Agenda Item 13 - GN 2003-077 - Councilwoman Johnson questioned why chemical
toilets were included in the issue of removal of trash and debris from residential
construction sites. Mayor Trevino advised council that staff was directed to talk about
dumpsters and chemical toilets. During staff's discussion with Trinity they were
adamant that the chemical toilets be sustained because it was included in their figures
for the solid waste contract.
Agenda Item 6g - PW 2003-011 - Councilwoman Johnson questioned if the hole in the
street in front of the school would be repaired prior to school opening. Staff advised
that the hole would be repaired before school starts. The project will not be completed
before school starts, but staff is working with the school to facilitate the traffic flow.
2. IR 2003-079 Review Enhancements to Tommv and Sue Brown Park and Forrest
Glen Fire Station
Ms. Vickie Loftice, Assistant Parks Director, advised Council the Public Art Committee
has selected the sculpture. Eliseo S. Garcia, for the public art commission at Tommy
and Sue Brown Park and the Forest Glenn Fire Station. Ms. Loftice explained the
theme for the two sites and introduced Mr. Garcia. Mr. Garcia presented Council with
small scale sculpture pieces proposed for the two sites. Council consensus was to
move forward with both designs.

3. IR 2003-080 Review Athletic Field Ordinance
Ms. Vickie Loftice, Assistant Parks Director, advised of the need to adopt an ordinance
to protect and preserve the city's athletic game fields. Ms. Loftice explained the
problem of practice teams playing on city game fields and damaging the fields prior to
games and increasing maintenance costs. Ms. Loftice advised council that the Park
Board voted to forward the proposed ordinance to the Council for consideration. The
youth sports associations are also in support of the ordinance. Council agreed that an
ordinance was needed to enforce violations on the use of fields that are closed for
maintenance or field conditions. However, Council was concerned with referring users
to practice fields in the neighborhood parks. There was extensive discussion on
signage posted on athletic fields restricting the field for use with permit only and Council
did not want to discourage the use of fields by local residents. Council suggested
tabling the item and sending it back to the Park Board for further study. Attorney
Staples suggested that Council approve the ordinance with the removal of subsection b
and refer subsection b back to the Park Board for additional study. The Mayor
suggested approving the ordinance with the inclusion of the names of the athletic fields
in subsection a, removing b from the ordinance and sending back to the Parks Board
for another recommendation. Formal action taken during the regular council meeting.

request.
Mr. Gregory Dickens, GSWW, Inc., representing Marvin and Jill Smith, came forward to
present the request and answer questions from the council.

Mr. David Green, Zoning Administrator, summarized the case and presented Planning
& Zoning and Staff recommendations. Council was advised the applicant was
subdividing the existing lot into two lots in order to build two single-family residences.
The property is currently zoned R-1 residential. Because request is a change to an
existing residential plat, state law requires a public hearing by City Council. The
applicant has met all of Public Works requirements and the Planning & Zoning
Commission recommended approval at their June 19 meeting.
Mayor Trevino called for anyone wishing to speak in favor or against the request to
come forward.
There being no one wishing to speak Mayor Trevino closed the public hearing.
COUNCILMAN METTS MOVED TO APPROVE PS 2003..27. COUNCILMAN WHITSON SECONDED
THE MOTION.
Motion to approve carried 6-0.

GN 2003-081 PUBLIC HEARING TO CONSIDER AMENDMENTS TO ZONING
ORDINANCE NO. 1874 TO CONSIDER RESTRICTING GARAGES IN THE R-4-D

Mr. Dave Green, Zoning Administrator, advised earlier this year Council had directed
Staff to work with the Planning & Zoning Commission to review the duplex district
requirements. The Planning & Zoning Commission reviewed the requirements and
recommended on June 19 the approval of an amendment that will permit only side or
rear entry garages in duplex districts.
Councilwoman Johnson questioned if R-3 district should also be included in the
ordinance. Staff advised they will determine if R-3 needs to be included and if so, they
will bring it back to Council at a later date.
Mayor Trevino opened the public hearing and called for anyone wishing to speak to
come forward.
There being no one wishing to speak Mayor Trevino closed the public hearing.

GN 2003-088 2003 LOCAL LAW ENFORCEMENT BLOCK GRANT, APPOINTING
OFFICERS TO BOARD AND SETTING PUBLIC HEARING -
RESOLUTION NO. 2003-059

Police Chief Shockley advised the City is applying for the 2003 Local Law Enforcement
Block Grant. The $22,535 grant will require city matching funds of $2,504 and will be
used to purchase equipment for the Police Department. Chief Shockley advised of the
grant requirements to appoint an agent to act for the City, to appoint an Advisory Board

Mayor Pro Tem called for point of order and questioned if council needed to suspend
the rules to allow the individuals to speak.
Mayor Trevino asked Council if anyone had any objections to suspending the rules and
recognizing the individuals wishing to speak. Council had no objections to hearing from
the individuals.
Mr. Dave Green, Zoning Administrator, explained the reason for the proposed
ordinance and outlined the provisions of the ordinance. The amendment will prohibit an
individual from staining, painting or marking any public sidewalk or curb. Exceptions
are granted to public contractors or public utilities and it does not prohibit individuals
from painting property addresses on the curb. The coloring or texturing of new or
replacement sidewalks is also not prohibited.

Mr. Bill Thornton, Assistant Parks Director, presented the item to Council. Council
awarded the Cottonbelt construction agreement for the ISTEA grant funded project
jointly with the City of Colleyville. During a pre-construction meeting with
representatives from DART, TxDOT, FWWR, City of Colleyville and the contractor
ACC, FWWR advised that the Federal Railroad Administration had adopted new safety
regulations requiring certified flagmen to be present during the course of any
construction activities within 25 feet of the railroad tracks. Since the majority of the trail
within North Richland Hills requires flagmen to be present during construction, the
financial impact is at a cost of $400 per day for each day of construction at each
location construction is occurring. FWWR has to provide certification training to the
contractor's employees reducing the potential impact. The proposed change order
represents the costs for training, rental of radio equipment and the required personnel
to perform flagman duties. Staff was able to increase the grant by $100,000 through
NCTCOG's Strategic Program Initiative. The additional grant funding requires a
$21,000 match by the City. Staff's recommendation is to approve the change order in
the amount of $62,424 to the construction contract, approve a CIP budget amendment
allocating $21,000 to the Cottonbelt Project account and approve the resolution
authorizing the City Manager to execute the change order and supplemental
agreement.

Mayor Trevino asked Council if they would like to suspend the rules and hear from
those wishing to speak. There were no objections from the Council.
Ms. Karen Bostic advised item is in follow up to the July 14 Council meeting. Ms. Bostic
advised council that several residential homebuilders had concerns about Ordinance
No. 2688 that required homebuilders to use Trinity Waste for removal of trash and
debris from residential construction sites. The homebuilders in some cases haul their
own residential construction debris while others contract with third parties who clean the
construction sites, load the debris into containers, and haul off the containers of debris.
Other concerns of the homebuilders are the increase in cost and response time from
Trinity Waste. Staff met with representatives from Trinity Waste on several occasions
to discuss issues of the homebuilders. Staff and Trinity have come to a compromise
and City Attorney George Staples reviewed the contract to determine if allowing a "turn-
key" type of service would be a violation of the contract. The City Attorney does not
believe that allowing this type of service would be in violation of the contract with Trinity
Waste, especially since they do not provide this same level of service. Ms. Bostic
advised council that turn-key is defined as a package service provided by a company
whose primary business is involves placing their own containers (or using an approved
container), having their own employees clean up the construction site, depositing debris
in the containers and hauling off the debris. The fees associated to operate in North
Richland Hills are: $25.00 for builder to haul their own debris, $25.00 for providers that
haul debris by means other than a metal container and trash truck, and $100.00 per

year, plus an additional $15.00 per residential unit being serviced for those providers
that have their own metal containers and use trash tracks. Staff discussed with Trinity
Waste the concerns about chemical toilets. Trinity assured us that they are still in the
chemical toilet business and the bid for the solid waste contract included revenues for
chemical toilets. Staff reviewed this and it appears it may be a violation of the contract
to allow another vendor to provide chemical toilets. Ms. Bostic advised council that staff
reviewed the ordinance with one of the builders on Thursday and slight modifications
were made to the ordinance. The revised ordinance with modifications were handed
out to council this evening.
Mayor Trevino recognized Scott Sandlin.
Scott Sandlin, 5709 Moore Lake Court, Colleyville, Texas. Mr. Sandlin advised council
he represents himself as a business owner in North Richland Hills as well as
representing Greater Fort Worth Builders Association. Mr. Sandlin said that on behalf
of the Builders Association he would like to support Ordinance No. 2715, but asked that
section 11-14 (c) not include any fees or permits, because he feels that any fees placed
upon contractors is not appropriate. Mr. Sandlin said that he builds in four different
counties and thirteen cities and no city requires or mandates who he can use for
contractors. Mr. Sandlin said that the franchise contract says the City agrees to require
that sanitation services be provided at all residential construction sites. The contract
does not stipulate who will provide sanitation services. Mr. Sandlin has talked to the
Texas Association of Builders attorney, his attorney and Mr. Staples and they agree
that the contract can not be enforced that states Trinity must provide the services. Mr.
Sandlin asked council to direct staff to amend Ordinance No. 2688 to allow other
portable toilet companies to do business in North Richland Hills.
Mayor Trevino asked Mr. Cunningham if staff could revisit the portable toilet portion of
this ordinance at a later date.
Mr. Cunningham advised staff could revisit this issue at a later time. He believes that
staff will need to look very closely at the contract, because he thinks at this particular
time there is some concern that it could potentially be a violation of the contract.
Mayor Trevino asked council if they would like staff to revisit this item at a later date.
Council consensus was to revisit the ordinance as it pertains to portable toilets at a later
time.
Mayor Pro Tem Tolbert announced that Sandra McClaughlin wanted to record her
support for this ordinance.
Councilman Whitson asked if someone from staff could comment on section 11-14 (c).
Mr. Cunningham said one of the concerns is to make sure that the City has equity with
Trinity because they are the City's service provider for solid waste. Staff felt that
establishing the permit fee for the turn-key service would be equitable and comparable

to what Trinity would be paying in franchise fees for providing this service or similar
service. Therefore the City would not be jeopardizing any contractual relationship or be
unfair to individuals who were providing like service. The permit fee is a registration
process to ensure that the City does not have additional bandit operators.
Mayor Pro Tem Tolbert asked for clarification on fees.
Mr. Cunningham advised the $25.00 fee is for those individuals or companies who haul
from construction sites. The $100.00 fee pertains to companies or individuals whose
primary business is the clearing, cleaning and removal of residential construction debris
using metal containers. In addition to the $100.00 the company or individual must also
pay $15.00 for each residential unit they service.
Mayor Pro Tem Tolbert asked staff to consider $100.00 per year, but not require the
$15.00 per residential unit.
Mr. Cunningham said the primary concern is to provide equity. Staff could use the
same basis that is used in franchise (4% of their billing). Staff believed the permit fee
would be an easier process, but the city could charge the annual permit plus 4% of their
billing.
Councilman Tim Welch said the City has to protect both Trinity and the builders.
Councilman Welch suggested aIÍ application fee of $50.00 to track companies doing
business in the city. Councilman Tim Welch thinks the residential fee should be
eliminated and would like to see all fees eliminated except the $50.00 for application.
Councilman Metts does not believe that a builder who hauls his own debris should pay
a permit fee.

City Manager Cunningham explained the purpose of the work session and outlined what
staff would present.
Karen Bostic, Managing Director of Fiscal & Administrative Services, presented the
history of the city's group medical plan discussing the increasing costs, proactive
measures already taken to address the increasing costs and on-going issues and
challenges.
Patrick Hillis, Human Resources Director, reviewed the proposed changes to the group

answering questions regarding the utilization of in-network and out-of-network services,
the availability of generic drugs, and an explanation of preferred and non-preferred
medications. The impact of the proposed changes to the employees and the city was
reviewed and discussed. Council concurred with the recommendations presented by
Staff. There was discussion on the various cost increases to the employees. Council
was in agreement that the proposed changes were necessary to address the increasing
costs and the future of the plan. There was a brief discussion on the benefits of mail
order prescription service and for staff to consider that some other employers have
made it mandatory to use prescription mail order for maintenance medications and the
City may also want to consider such a requirement.
Mr. Hillis and Mr. Pomyka talked about future expectations briefly discussing consumer
driven health plans, city and employee partnerships, continued monitoring of the costs
and utilization, the importance of educating participants and future design changes to
the plan.
Council was in agreement with the proposed changes to the plan. The City Manager
will brief Councilmen Tolbert and Welch on the changes for their concurrence, and then
Staff will disseminate the proposed changes to the employees.

Comprehensive Plan:
The Comprehensive Plan was effectively changed to low density residential with the approval

Planning and Zoning Commission Recommendation:
The Planning and Zoning Commission at their meeting on, July 17, 2003, recommended

Dave Green, Zoning Administrator, summarized the case. This is a final plat for
a portion of Grace Meadows. The property is located west of Precinct Line Road
and north of Kirk Lane. The Commission saw this property as a preliminary plat
and rezoning case in March of 2003. On that plat and rezoning there was a
frontage area on Precinct Line Road, which was zoned for Commercial purpOses.
The zoning was changed to "R-2" for residential uses. The minimum lot size is
9000 square feet and the minimum house size is 2000 square feet. The
subdivision comes up off of Kirk Lane with a series of cul-de-sacs and 31 lots
total. A letter from Public Works states that all of City Staff issues have been
addressed and Staff recommends approval of this final plat.
Dick Blackard, Stinson Development, came forward. Mr. Blackard stated that he
is present if the Commission or Staff has any questions or concerns.
Mr. Schopper wondered who would maintain the open space on Lot 14. Mr.
Blackard answered that it was his understanding that the City will, as part of the
open space program.
Mr. Schopper asked Mr. Blackard if he was going to dedicate the lot or deed it to
the City. Mr. Blackard stated that it was automatically dedicated by the plat.
Anything that is for public use is automatically dedicated by the plat.
Chairman Bowen called for a motion.
Bill Schopper, seconded by Ted Nehring, motioned to approve PS 2003-34.

RESOLUTION NO. 2003-063
WHEAREAS, the City Council of the City of North Richland Hills, Texas, pursuant to
the authority granted in Sections 271.081 - 271.083 Local Government Code and Sections
304 of the General Services Act (Art. 6016, V.T.C.S.) desires to participate in described
purchasing programs of the Texas Building and Procurement Commission, and is of the
opinion that participation in these programs will be highly beneficial to taxpayers through
anticipated savings to be realized;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS, that:

The City Purchasing Agent be and is hereby authorized to request the Texas Building
and Procurement Commission to include the City's stated need on the Commission's term

Agenda Number: GN 2003-090
The sanitary sewer system required to serve the Royal Oaks Addition was designed with
an offsite system that extended from Spring Oak Drive east to Precinct Line Road. During
construction, the developer's engineer determined that it was possible to redesign the
offsite system so that it was not necessary to construct the system all the way to Precinct
Line Road.
Because of this change in the design, it became necessary to acquire an easement for the
new alignment (Exhibit "B") as well as abandon the two existing sanitary easements
(Exhibit "A") for the old alignment. The easement for the revised alignment has been
acquired from the property owner.
Recommendation: To approve Ordinance No. 2728.

AN ORDINANCE ABANDONING UNNEEDED SANITARY SEWER
EASEMENTS LOCATED IN THE CITY OF NORTH RICHLAND HILLS, IN
THE O. RUMFIELD SURVEY, ABSTRACT NO. 1365.
WHEREAS, due to redesign of the sanitary sewer system serving the Royal Oaks Addition
of the City of North Richland Hills, it has become unnecessary to construct as
extensive an offsite system as was originally contemplated, thus rendering two
easements previously acquired useless; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL, CITY OF NORTH RICHLAND HILLS,
TEXAS:
Section 1:
THAT the two sanitary sewer easements recorded in Volume 15220, Page 246,
and Volume 16561, Page 47, Deed Records, Tarrant County, Texas, are hereby
abandoned.
AND IT IS SO ORDAINED.

The agreed purchase price includes full accord, satisfaction and compensation for
all demands of the Seller, subject also to the following special conditions, if any:

connect to the sanitary sewer at no cost.

WHEREAS, notice of a hearing before the Planning and Zoning Commission was sent to real
property owners within 200 feet ofthe property herein described at least 10 days
before such hearing; and,
WHEREAS, notice of a public hearing before the City Council was published in a newspaper
of general circulation in the City at least 15 days before such hearing; and,
WHEREAS, public hearings to zone the property herein described were held before both the

described on Exhibit "A" hereto, from AG Agricultural to R-2 Residential
zomng.
Section 2:
Any person, finn or corporation violating any provision of the Comprehensive
Zoning Ordinance as amended hereby shall be deemed guilty of a misdemeanor
and upon final conviction thereof fined in an amount not to exceed Two
Thousand Dollars ($2,000.00). Each day any such violation shall be allowed to
continue shall constitute a separate violation and punishable hereunder.

Dave Green, Zoning Administrator, summarized the case. The first case (PZ
2003-15) and the second case (PS 2003-28) are connected. The property for
rezoning is located in the 8400-8500 block of North Tarrant Parkway. The area
directly to the south and across North Tarrant Parkway is Forest Glenn East
Subdivision. To the east and west are existing subdivisions as well. The
property in question is a small strip, 1.98 acres in size. The applicant is
requesting that the property be rezoned from "AG" Agricultural to "R-2"
Residential. The reason for the rezoning is the strip of land is connected to 8.00
acres of property, which is currently zoned "R-2" Residential. The applicant
would like to combine the two properties into a total of 10 acres for residential
development. This property would be known as Forest Glenn North Addition.
The Comprehensive Plan shows that all of this property and the surrounding
properties to be single-family, detached, low density residential. This rezoning is
consistent with the Comprehensive Plan.
Chairman Bowen opened the public hearing and asked if anyone would like to
speak in favor of this case.
Gloria Wood, 8400 Shady Oaks Drive, came forward. Mrs. Wood stated that she
is in favor of the project, but would like more information on the name of the
home builders that would be building in Forest Glenn North.
Chairman Bowen explained to Mrs. Wood, that she needs to contact the
developer of the project, because the developer would have the information she
is requesting.

Stan Key, 8413 Castle Creek Road, came forward. Mr. Key is concerned about
the drainage for Forest Glenn North. Forest Glenn North is lower than the
property Mr. Key resides at in the Shady Oaks Subdivision, Block 1, Lot 15. Mr.
Key wondered how drainage will be fixed to accommodate Forest Glenn North.
Mr. Key explained that he purchased his home two years ago with the
understanding that the property in question would not be developed due to a
flood zone, Mr. Key is also concerned with the location of utilities. Mr. Key
explained that he has an easement to the back of his property, but is unclear of
who owns it. Mr. Key wonders who is responsible for cleaning this easement
which is 7 % - feet to 10 - feet deep. Located in the easement is a large oak tree
that is more than 100 years old that shades Mr. Key's property from the west.

Mr. Key is concerned for the oak tree and what will happen to it. If possible Mr.
Key would like to enclose his fence around the easement with the oak tree and
maintain the property.
Chairman Bowen stated to Mr. Key that there is currently a drainage channel that
runs through the proposed subdivision and connects to another drainage channel
that runs along the northern portion of the property,
Lance Barton, Asst. Director of Public Works, stated that the natural drainage
pattern for this property is to drain toward the center into an existing drainage
channel. Based on Mr. Barton's knowledge of the site, the drainage will continue
in that general pattern. The lots that back up to the Shady Oaks Subdivision will
drain towards the cul-de-sac in Forest Glenn North. Mr. Barton stated that he
believes that drainage will not be a problem. Mr. Barton explained that in regards
to Mr. Key's easement, a 7 % - foot utility easement in the rear of the property is
a standard requirement on all subdivision lots. This easement is Mr. Key's
property and the property can be fenced in with Mr. Key's backyard, Mr. Barton
also addressed the concerns of this property being in a flood plain. Mr. Barton
explained that this property is in a flood plain, but the developer will be reclaiming
this land through the construction of the channel, bringing it out of the flood plain
in order for it to be developable. This process is ongoing, a letter of a map
revision and the associated flood studies has been sent to FEMA for review.
Public Works is expecting those results, which will allow this to happen. Mr.
. Barton stated that in this area, utilities are placed underground.
Mr. Key stated that he is worried about the trees. Mr. Barton explained that from
a developer's point of view, trees are very valuable to the land. Utility easements
are there for the use of the utility companies and there is always a possibility that
one of those companies may utilize it.
Mr. Davis stated that the utility easement could be routed around the large Oak
tree. Mr, Barton agreed that there are always options available, especially since
these are deep lots,
Chairman Bowen closed the public hearing and called for a motion.
Brenda Cole, seconded by Richard Davis, motioned to approve PZ 2003-15.

Mr. and Mrs. Cox have lived in a single family residence on this site for over 32 years.
Last Christmas morning, the house caught fire and was destroyed. In an effort to rebuild
their residence, the Cox's submitted for permits only to discover that the site was not in
conformance with current zoning and platting regulations. This request represents their
efforts to bring the site into zoning compliance so that permits for a new residential
structure may be issued.
Plat Status:
The applicants will be submitting preliminary and final plats shortly for staff review and
processing.

The site is mostly vacant and is characterized as being heavily wooded.
Thoroughfare Plan:

Dave Green, Zoning Administrator, summarized the case. This is a request to
rezone a tract of land from "AG" Agricultural to "R-1-S" Special Single Family
Residential. The property is located at 8601 Cardinal Lane, north of Mid-Cities
Boulevard. The reason for the rezoning is to rebuild a single-family home on the
site. Mr, and Mrs. Cox have lived in a single-family structure on this site for many
years. Last Christmas, Mr. and Mrs. Cox lost there home to a fire. The entire
house was destroyed. Mr. and Mrs. Cox have dealt with the insurance company
and those matters have been settled. However, Mr. and Mrs. Cox applied for the
appropriate building permits to rebuild their home only to find out this particular
property had never been platted and is currently not zoned for residential use.
Mr. and Mrs. Cox are requesting a rezoning of the tract for the purpose of
rebuilding their home. The platting of the property is something that will be
coming to Staff very soon and Staff intends to push the platting process forward
to the Planning and Zoning Commission followed by City Council as quickly as
possible.

Mr. Schopper asked Mr. Green if there was anything specific that needs to be
done to the Master Plan.
Mr. Green stated that the Comprehensive Plan shows Neighborhood Service
type uses from Mid-Cities Boulevard to the back edge of this property. Each time
an action is taken to recommend a rezoning of a piece of property from the
Planning and Zoning Commission that is different from the Comprehensive Plan,
the City Attorney always includes those languages on the ordinance that adopts
the change that "you hereby are changing the Comprehensive Plan". The
change is recognized in a formal matter by the time it gets to City Council.
Chairman Bowen opened the public hearing and asked if anyone would like to
speak in favor of this case.

Mr. Cox, 8601 Cardinal Lane, came forward. Mr. Cox stated that he and his wife
had lived on this property for 32 years and in North Richland Hills for 35 years.
Mr. Cox stated that on Christmas morning, his wife awoke to the house being on
fire and Mrs. Cox is recognized as a national hero for pulling her husband out of
the house as the house crumbled before them. It made local and national news.
Mr. Cox continued to state that they want to rebuild what they lost, maybe even a
little bit better, Mr, Cox was unaware of the land not being platted and of the
zoning situation. Mr. Cox assumed that he was grandfathered in this situation.
Mr. Cox stated that he does not have a problem with what needs to be done in
. order to have his home built. However, time is of the essence.
Chairman Bowen closed the public hearing.

And Crime Control and Prevention District Budgets
It is necessary for City Council to set public hearings on the proposed 2003-2004 City
Budget, proposed projects and operations of the Park and Recreation Facilities
Development Corporation, and the Crime Control and Prevention District budgets.
A published notice will be required for each public hearing as per the City Charter and
State law. The exact wording for each notice accompanies this cover sheet. Each hearing
is set for August 25, 2003 beginning at 6: 15 p.m. for the Crime Control and Prevention
District, 6:30 p.m. for the Park and Recreation Facilities Development Corporation, and
7:00 p.m. for the City Budget.
Because the proposed tax rate of 57¢ does not exceed 3% of the effective tax rate, we are
not required to hold a public hearing on the proposed tax rate as we have in the past. We
do however still have to publish the effective tax rate calculation in the Star Telegram.
In the past we have had to adopt the budget and tax rate the meeting following the one
where we held the public hearings. This is because by law we could not adopt the tax rate
any earlier than 3 days or later than 14 days after the public hearing. Since we are not
required to hold the tax rate public hearing this year, we can adopt the proposed operating
budgets on August 25, 2003, the same night the hearings are held.
Recommendation:
To set the date for the public hearings on the Crime Control and Prevention District at 6:15
p.m., the Park and Recreation Facilities Development Corporation at 6:30 p.m., and the
annual City Budget at 7:00 p.m. on August 25, 2003.

NOTICE IS HEREBY GIVEN that a public hearing is to be held by the Board of

NOTICE IS HEREBY GIVEN that a public hearing is to be held by the Board of
Directors of the North Richland Hills Park and Recreation Facilities Development
Corporation during a meeting to be held at 6:30 p.m. on August 25, 2003 at the
North Richland Hills City Hall City Council Chambers, 7301 N.E. Loop 820, North
Richland Hills, Texas, on the Corporation funding and undertaking of projects
involving improvements and renovations to neighborhood and community parks
(including, but not limited to, future park acquisition, the construction of baseball
and softball fields, neighborhood parks, senior citizen centers, building of hike
and bike trails, the operations of the tennis center and the expenditure of funds to
pay operating costs of City owned projects undertaken by the Corporation.) A

Newman Drive - Ordinance No. 2727
City staff is recommending to change the name of Ballpark Road (located in the Hometown
NRH West - Phase 2 Addition) to Newman Drive (see Exhibit "A"). The request was made
because the currently configured Ballpark Road is an extension on an existing section of
Newman Drive and the name change occurs between the two side streets.
The developer of Hometown NRH West - Phase 2 has agreed and has asked that we
proceed with the requested name change. Because this is a new street, no houses are on
it and therefore no residents will be required to change addresses.
Recommendation: To approve Ordinance No. 2727.

Last year the City Council took action on an Ordinance authorizing the City Manager to be
able to settle litigation below certain dollar levels with review by the City Council. Staff has
had a request regarding the possibility of a lien compromise on a piece of property and is
considering such. As a result of that request, we have researched the matter and found
that authority for settlements by the City Manager does not exist in the present City Code.
After discussion with City Attorney George Staples, he indicated that such authority should
be granted to certain limits.
The proposed ordinance before you authorizes the compromise and settlement of liens by
the City Manager in amounts not to exceed $15,000 upon the recommendation by the City
Attorney. Any action taken on excess amounts would be required to go before the City
Council.
Staff does not believe this would be a problem since these actions occur rarely and does
not believe it would be a matter that would place more on the Council Agenda or create an
undue workload at either level.
Recommendation:
To adopt Ordinance No. 2729.

AN ORDINANCE AMENDING CHAPTER 2 OF THE NORTH RlCHLAND
HILLS CODE OF ORDINANCES AUTHORIZING THE CITY MANAGER
TO EXECUTE RELEASES OF CERTAIN CITY LIENS.

WHEREAS, the City files various liens to secure its claims for weed mowing, property
clean-up and other similar activities in which the City Council generally is
not involved; and

WHEREAS, requests and proposals to compromise such liens are from time to time
presented to City Staff, many of which involve requests to waive part of
accumulated interest on such charges and which requests do not warrant the
expenditure of time and effort to seek Council action; NOW,
