2. The Council reserves the right to retire into executive session concerning any of the items
listed on this Agenda, whenever it is considered necessary and legally justified under the Open
Meetings Act.

The attached resolution canvasses the votes cast at the Special Election held September
11, 2004. The resolution approves the canvass, and declares that the senior tax freeze
measure was approved by the voters of the City.

RESOLUTION CANVASSING VOTES OF SPECIAL ELECTION

WHEREAS, the City Council of the City of North Richland Hills ordered an election on the
issue of limiting tax increases on homesteads ofthose who are 65 or older or
who are disabled; and

WHEREAS, such election was held on September 11, 2004; the votes have been canvassed
and it has been determined that there were 3,698 votes cast in favor of such
issue, and 1691 votes cast against it; NOW, THEREFORE

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS:

Section 1:
THAT the foregoing canvass is hereby approved.

Section 2:
It is hereby ordered and declared that the measùre submitted has been approved
by the voters of the City.

Subject: Adoption of Over 65 and Disabled Tax Freeze

Since the majority of residents that voted in the September 11, 2004 special .election
support freezing taxes forthose 65 years of age or older or who are disabled, it is now
necessary to adopt an ordinance to implement the property tax freeze.
The freeze will take effect for qualified residents with the 2005 property tax bills.
Homeowners who already receive the City's senior/disabled exemption will automatically
benefit from the senior/disabled freeze. Residents that. currently qualify for the freeze will
not pay more in City taxes than they did with their 2004 tax bills. Those that will qualify in
the future will not pay more in City taxes than they did in the tax year that they became
eligible for the freeze.
On June 29, 2004, Council tabled ordinance #2789 which was to adopt the freeze. It will
be necessary for Council to motion to remove Ordinance #2789 from being tabled. Once
this is done, a motion may be made to adopt the ordinance.
Recommendation:
To make a motion to remove Ordinance #2789 from being tabled and then to make a
motion to approve Ordinance #2789 to implement the senior/disabled property tax freeze.

AN ORDINANCE AMENDING CHAPTER 22 OF THE CITY OF NORTH
RICHLAND HILLS, TEXAS, CODE OF ORDINANCES ENACTING A
LIMITATION ON THE TAXES OF HOMESTEADS OF PERSONS WHO ARE
DISABLED OR SIXTY FIVE OR MORE YEARS OF AGE.

WHEREAS, Article 8, Section I-b(h) of the Texas Constitution authorizes the governing body
of governmental entities to permanently freeze the taxes on the homesteads of
persons who are disabled or sixty five (65) years of age or older; NOW,
THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS:

Section 1:
THAT Chapter 22 of the Code of Ordinances of the City ofN orth Richland Hills
is hereby amended by adding a new Section 22-7 which shall read as follows:

"Section 22-7. ELIMINATION OF INCREASES IN TAXES ON HOMESTEADS OF
DISABLED PERSONS AND THOSE AGE 65 OR OLDER.

Taxes on a residence owned by a person who receives a residence homestead exemption
for such residence and who is either disabled or is sixty five (65) years of age or older
may not be increased while it remains the residence homestead of that person or that
person's spouse who is disabled or is sixty five (65) years of age and receives a residence
homestead exemption on the homestead. Upon the death of a person with such residence
homestead exemption, the taxes shall not be increased while it remains the residence
homestead of the decedent's surviving spouse ifthe spouse is fifty five (55) years of age
or older at the time of the death of the person who was receiving such homestead
exemption, subject to any exceptions provided by general law. Taxes may be increased
to the extent the value of the homestead is increased by improvements other than repairs
and improvements required to comply with governmental requirements, and except as
may be consistent with the transfer of a tax limitation under a law authorized by Article
8, Section I-b(h), of the Texas Constitution."
