In the planning of the new athletic and multi-purpose facility for the new high school at Precinct Line
Road and Mid-Cities Boulevard, the Birdville Independent School District had their architect prepare
concept plans for the possibility of a civic center in conjunction with those improvements. The
proposed civic center would include meeting rooms, banquet rooms and other related civic center
facilities and would be constructed utilizing space under the stadium and adjacent areas.
On February 25, 1997 BISD officials invited the five cities in their district to review concept plans for the
civic center and are requesting the cities to advise them by the end of March as to whether or not the
cities want to financially participate in the construction cost for such a civic center. Attached are
estimated costs for such a center, prepared by the architects of BISD, SHW Group, Inc. Page three
summarizes three possible options should the civic center be constructed.
Since the meeting on February 25 with the BISD officials was not posted for Council action, it is
requested that Council hold the meeting to take action to provide a response to BISD on this matter.
Recommendation:

ORDINANCE NO. 2182
Pursuant to the power granted by State Law and Charter of this City and in order
to preserve and protect the public welfare,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS, that:
1.
Before any person, firm or corporation may use the streets, alleys, public
easements, rights-of-way or thoroughfares, within the city limits, to furnish utility services
of any kind to property or persons within the City, that utility must apply for and receive a
franchise from this City. The utilities embraced in this Ordinance are electric utilities, gas
utilities, water and sewer utilities, telecommunication utilities and any other business which
is commonly classified as a utility.
2.
Before any utility company does any construction or installation work in, over or
under any public street, alley, thoroughfare, public easement or rights-of-way located in
this City, it must make application for and receive a permit for such project. The
information required in the application shall be determined by the franchise under which
the utility is operating.
3.
The terms of the franchise must address those matters authorized in the charter as
well as provisions for plans and locations of all operations within the City including any
wires, pipes, conducts, sewers, or flumes within all public rights-of-way. It shall require the
utility company which is the subject of each franchise to update and file with the City all
plans for installation within the City and within any public right-of-way. If the "as builts"
vary from the original plans, the "as builts" must be filed with the City. The plans,
specifications and "as builts" shall be maintained in the permanent records of the Public
Works Department of the City.
4.
The franchise fee, in each case, shall be determined by a majority vote of the City
Council, but shall not be confiscatory in nature.

The other terms of each franchise shall be determined by negotiation and
agreement of the parties thereto and be responsive to the needs of the public, the City and
the utility concerned.
6.
Violation of this ordinance shall be deemed a misdemeanor and each violation shall
be punished by a fine not in excess of $500.00. Each day of violation will be considered
a separate offense.
7.
If any portion of this ordinance is declared invalid for any reason, it shall not affect
the remaining valid portions.
8.
This ordinance shall be in full force and effect from date of passage and approval.
