ORDINANCE NO. 2109
AN ORDINANCE BY THE CITY OF NORTH RICHLAND HILLS, TEXAS, AMENDING ORDINANCE
NUMBER 1874, THE COMPREHENSIVE ZONING ORDINANCE, TO ESTABLISH SCREENING
REQUIREMENTS FOR OUTDOOR STORAGE AREAS FOR CONTRACTOR SHOP AND I OR YARDS;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission has determined Contractor Shop and / or Yards
located within the City which regularly store equipment and construction materials outdoors has a
negative and detrimental effect on the property value of adjacent properties, and
WHEREAS, after appropriate notice and public hearing, the Planning and Zoning Commission of
the City of North Richland Hills, Texas, has forwarded a recommendation to the City Council for
amendment of Ordinance No. 1874 by establishing screening requirements for contractor shop and
/ or yards, by changing said Zoning Ordinance as set forth herein; now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS,
TEXAS:
1.
THAT, Section 310.H, Table of Permitted Uses, for Contractor Shop and lor Yard be hereby
amended to insert the following:
Contractor's Office (w/shop and Garage (17)
(17) Screening of Outdoor Storage Areas - Except as otherwise specifically authorized by
this code, the outdoor storage of equipment and materials shall only be allowed as an
incidential use and when located behind all building lines and screened according to the Special
Screening Requirements contained in Section 930. Openings for access to the outside storage
or outside use area shall be equipped with gates capable of screening the activities and user
from view when closed. In no case shall any materials be stored higher than the screening
provided.

THAT, Article 9, Landscaping, Buffering, and Screening Regulations be hereby amended to insert
the following Section 930:
Section 930 Special Screening Requirements:
1. Applicability: These regulations shall apply to those land uses listed in Section 310, Table of
Permitted Uses which are designated as having Special Screening Requirements. Such

screening regulations shall become applicable upon any change of use, occupancy or at such
time as a building permit is applied for except as otherwise specified by this code.
2. Types of Screening: General. Where required, a screening fence shall be erected to a height
not less than six feet (6') and provide a visual barrier from adjacent properties and streets.
Such screening shall be permanently and adequately maintained by the owner of the property
on which the screening is required. Except for the landscape buffer, no screening fence or wall
shall have more than forty (40) square inches of openings over anyone (1) square foot of fence
or wall surface. Only the following types of screening shall qualify as meeting the requirements
of this Code.
A. Landscaped Buffer: This screening shall consist of a landscaped strip of not less than five
feet (5') in width and shall include hedge-like shrubbery of evergreen planting material
capable of obtaining a minimum height of six feet (6') within the first three years of initial
planting. Such evergreen planting material shall be planted not to exceed four feet (4') on
centers and be a minimum height of two and a half feet (2 1/2') at initial planting. An
automatic underground drip irrigation or sprinkler system shall be provided for all required
landscaped buffer screens. Any landscape buffer required by this code shall be maintained
in a healthy, thriving condition.
B. Screening Fence: Fencing may consist of a solid wood panel or a galvanized metal chain
link fence with all-weather slats interwoven into the metal fabric. Such fencing shall be
constructed on metal posts and placed in concrete footings with bracing.
C. Ribbed Metal Panel Fence: Fencing may consist of a ribbed metal panel which shall be
suitably finished to blend with the primary structure and shall be erected on a structurally
sound metal frame set in concrete. Galvanized I corrugated metal panels shall not be
allowed.
D. Masonry Wall: A masonry screening fence shall be constructed to comply with the
minimum requirements for masonry screening walls approved by the City of North Richland
Hills.
3.
SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that
the section, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if
any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or
unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs or sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase,
clause, sentence, paragraph or section.
4.
SAVINGS CLAUSE. That Ordinance Number 1874, the Comprehensive Zoning Ordinance of the
City of North Richland Hills, Texas, as amended, shall remain in full force and effect, save and
except as amended by this ordinance.

5.
EFFECTIVE DATE. This ordinance shall be in full force from and after its passage.
