Garbage Contract/Franchise
Recently, some of our City staff met with Bill Eisen, City Manager of Haltom City, regarding
Haltom City's decision to go out for bids for garbage collection services. Haltom City found
the bidding climate to be excellent. They benefitted from a changing marketplace which has
two relatively new companies (IESI and USA Waste) aggressively trying to establish
themselves in this area. These new companies, along with Laidlaw's efforts to mitigate any
further loss of market share, made taking bids particularly rewarding.
Haltom City had several areas of emphasis in bidding. Importantly, they were not willing to
grant any kind of contract that authorized an annual formula-based rate adjustment. Rate
adjustments must be approved by the City Council and are not allowed for the first 18 months
of the contract. Haltom City also asked for multiple pickup days in their RFP, and ended up
with six (6) pickup days per week in their final contract with IESI. The contract begins on
October 1, 1996 and is three years in length, with the option ~o renew.

It is important to note that Haltom City did not take bids for recycling, which was negotiated
last year and did not run concurrently with the term of the garbage contract. Interestingly,
Haltom City's recycling program is voluntary, and citizens may choose whether to participate
or not. Rates are based on the number of residents participating, and range from $2.14 for
75% - 100% participation to $5.10 for 0% - 34.99% participation. The contract is five (5) years
in length and expires in 1999.
The City of Hurst recently renegotiated its contract with Laidlaw. Hurst's renegotiated rate of
$6.63 for residential service is a 8.7% increase over the previous rate of $6.10. Other than
a new rate schedule, the only major change in the contract is that the City negotiated for
"take-all" collection service. The term of the new contract is 8 years.

Attached is a spreadsheet (attachment "A") which summarizes the bids received by Haltom
City and compares them to our current rates and the City of Hurst's renegotiated rates with
Laidlaw. All rates are adjusted to reflect NRH franchise and collection fee percentages, so
that we are comparing "apples to apples". The winning bid for Haltom City included
residential rates for curbside take all service of $6.24 compared to our current rate of $6.56.
Attachment "B" compares an actual months billing in North Richland Hills, and shows what
residents and businesses currently pay versus bids received by Haltom City ª-Ild. Hurst's
renegotiated rates. In summary, the winning bid received by Haltom City would equate to an
annual savings of approximately $100,000 for NRH residents and customers compared to our
current rates. Additionally, Hurst's renegotiated rates are approximately $40,000 higher than
our current rates and approximately $140,000 higher than the winning bid received by Haltom
City.

Pursuant to the current franchise agreement, Laidlaw may request a rate adjustment effective
February 1,1997. Should Laidlaw choose to make such a request, preliminary CPI numbers
indicate that the total amount paid by NRH citizens and customers could increase by
approximately 1.75%, which would be about $40,000 annually. This amount is conservatiye
and does not include potential increases in disposal costs, which are authorized in the
franchise to be passed along on a pro-rated basis in combination with the CPI adjustment.
In total, a $40,000 rate adjustment would make our rates approximately $140,000 more than
Haltom City. In addition, our adjusted rates would make the amount paid by our residents and
customers approximately the same as Hurst's renegotiated rates.
As we look to renegotiating or bidding garbage service next year, some additional issues that
we might want to consider are:
"Don't-Bag-It" Program for grass clippings
2, 4, or 6 day schedule for two day-a-week pickup
"Pay As You Throw" rate approach
Address how more aggressive commercial and apartment recycling efforts impact
collection rates.
Accept bids for collection/recycling together âD..d. take separate bids for collection
and recycling.
Staff requests the City Council's direction as to whether we should go out for bids or
renegotiate. Additionally, are there any specific items the Council wishes to address related
to garbage and recycling services, such as the items listed above?

Introduction of New Department Staff Member
The Parks and Recreation Department is proud to introduce a new staff member.
Charlotte Wylie has been selected as the Parks and Recreation Department's Tennis Center
Manager. Charlotte was Director of Tennis/Special Events for the City of Topeka, Kansas.
She is a graduate of the University of Bridgeport in Connecticut.
Charlotte was employed with Topeka Parks and Recreation for seven years. She built strong
tennis programs for Topeka where none existed prior to her employment. She has been
actively involved in tennis as a Director, Head Professional and coach for the past 14 years.
Charlotte was chosen the Missouri Valley Professional Tennis Association - Kansas
Professional of the Year in 1996. She is certified United States Professional Tennis
Association Certified - Professional Level 1. Charlotte began her position on August 31,
1996.
We welcome the expertise that she will bring to this new program and look forward to the
benefits OU( citizens will enjoy.

DISCUSSION
ASSIGNMENT
Mayor Brown stated he would like for the City
to join "Keep America Beautiful". He advised
that the funds were available in the Economic
Development fund. Consensus of the Council
was to join "Keep America Beautiful".
COURT Mr. Wilkins explained the legislation that allows JIM WILKINS
SECURITY FUND municipalities to establish a security fund for
municipal courts. Mr. Wilkins stated that if a
fund was established in North Richland Hills
the Court would like to use the fund to hire a
bailiff. Judge Oujesky explained to the Council
which court cases would be assessed the
$3.00 fee. After discussion by Council, the

ITEM DISCUSSION ASSIGNMENT
TEAKWOOD Mr. Mark Bradley updated the Council on the GREG DICKENS
COURT acquisition of easements for the Teakwood
DRAINAGE project. Mr. David Sperling, 7212 Plumwood,
IMPROVEMENTS, stated the homeowners would like to meet with
PHASE II; STATUS City officials to express their concerns. Mayor
REPORT Brown advised that the City Manager would
call to set up a meeting with them.

The City Manager proposed to the Council that they could accept the recommendation
of the Planning and Zoning Commission which would close access to the subdivision to
the south. The developer for the subdivision to the south could be allowed to replat
ingress/egress from Crane Road to the subdivision. The Council could allow the
subdivision to the south to remain under the grandfather clause allowing front entry
garages.
Ms. Janet Suedmeir, 6725 Rolling Hills, stated she would like for Council to stick to the
higher standards of side and rear entry garages.
Mr. John Zimmerman, Engineer for the applicant, appeared before the Council and
spoke in favor of the request.

Mr. Freddie Rogers, 9128 Nob Hill Drive, appeared before the Council. Mr. Rogers felt
if the development was grandfathered and front entry garages were allowed it would
devalue the surrounding property.
Mr. Ken Brauer, 6716 Rolling Hills Drive, appeared before the Council. Mr. Brauer felt
rear and side entry garages would improve the property values. He felt front entry
garages would devalue their property.
Mr. Scott Sandlin, the developer of the property to the south, appeared before the
Council. Mr. Sandlin advised he had no objections to the City Manager's proposal.

CALL TO ORDER
Ms. Pultz called the meeting to order August 20, 1996 at 7:07 p.m.

APPROVAL OF THE MINUTES
Mrs. Tucker made a motion, seconded by Ms. Ward to approve the minutes of the July 16,
1996 Beautification Commission meeting. Motion carried 6-0.
3.
DISCUSS LABELING OF STORM SEWER DRAINS FUND RAISER
Ms. Pultz met with Pam Burney, Environmental Services, on labeling storm sewer drains
as a fund raiser. Profit from this effort would be approximately $4.00 per drain and would
have to be completed by September 30, 1996. Council of Governments is to provide the
stencils and the Commission would only supply paint.
Discussion was held to recruit Boy Scouts, churches and volunteers to assist in labeling
of the drains. Ms. Dunkelberg indicated that there were approximately 2,600 drains and
assistance would definitely be needed.
Mr. Nerwin made a motion and was seconded by Ms. Ward to take on this project. Motion
carried 6 - O. Ms. Pultz suggested that the Commission discuss further.
4.
DISCUSS KTB/BEAUTIFICA TION FUND RAISER
Ms. Pultz received grant documentation from Ruthie Jackson, KTB Young People Projects,
to provide a giant gumball machine to keep one year. In order for the Commission to
receive one of these gumball machines, there will be a drawing on youth projects to make
youth aware of the environment. ,
The cost per gumball would be 25 cents a piece and profit received from this project would
be 90% with a freight fee of $40.00. Ms. Dunkelberg stated that one was on display at the
KTB Convention and inquired about the cost to replenish the gum. Commission members
were not aware of the cost or location where to place the machine and would have to
research.
Ms. Dunkelberg made a motion and was seconded by Ms. Lueck for the Commission to
pursue the gumball machine. Motion carried 6 - O.
5.
STAFF REPORT
Mr. Hightshoe provided a video tape of the Yard of the Month program for the Commission
to review whtch is being shown on Citicable. He ask the Commission to photograph the
yards for Yard of the Month and provide to Citicable. Ms. Pultz stated that with the
photographic equipment the Commission currently had, if at all possible, could Citicable
still continue to make all photographs. Mr. Nerwin inquired about a Video Intern from a
college or school to possibly assist in this effort.
Mr. Hightshoe informed the Commission that everything had been taken care of in
preparation for the presentation at Dan Echols Senior Center on September 5, 1996. Ms.
Pultz asked Mr. Nerwin to announce the guest speakers that night in her absence.
6.
DISCUSSION OF OTHER ITEMS/CITIZEN INPUT
Ms. Dunkelberg informed the Commission that Barnes and Noble would be at the
xeriscaping presentation on September 5th and Randy Weston would not be able to
attend. She said that flyer distribution had been made to Wolfe Nursery, Barnes and
Noble, the Recreation Center and City Hall as well as numerous other locations.

A Master Composting class starts with Pam Burney and if anyone is interested to take the
course to check with her office.
Mr. Nerwin inquired if the Commission was going to implement an annual Xeriscape Award
and careful consideration be given on scoring criteria. Ms. Ward would like to explore how
many would participate and Mr. Nerwin stated that if we placed on Citicable that a greater
response would be generated.
Mr. Nerwin expressed how well Green Valley looks and the coordination between Park
Staff has been to place flags around plants when mowing not to destroy any plant
. materials. He expressed his gratitude for this effort.
Mr. Nerwin told of efforts between Economic Development to tour the 1 DO-Acre park site
to promote the City and Citicable is to run an "Inland Sea Oats" video. He also informed
the Commission that True Value Hardware is going out of business and converting to an
organic plant store and to please refer citizens to them for future business.
Ms. Dunkelberg stated that another Adopt A Highway spot was inaugurated with between
42-62 bags of trash collected.
Ms. Pultz will be going to Austin for judging of the Keep Texas Beautiful Governor's
Achievement Awards September 4th and 5th.
Ms. Pultz presented a Keep America Beautiful packet for review to see if the Commission
wanted to pursue. The packet was given to Sandra Miller to reproduce and distribute to
Commission members.

Special Use Permit for a Car Rental Agency on Tract 1 E6, Van Dusen
Survey, Abstract 1588. (Located 5033 Rufe Snow Drive) Ordinance No. 2143
Mr. David Womack is the prospective tenant in a shopping center located at 5033 Rufe Snow Drive, just south of Loop 820.
Mr. Womack has applied for a Special Use Permit to operate a car rental agency on the property in the west end of the
building. A Jones-Blair Paint store occupies the east end of the building. The property is zoned C-2 Commercial, and the
Zoning Regulations require a Special Use Permit for this type of use at this location.
The following are the major items concerning this Special Use Permit request.
1. Location and Zoning This property is located at 5033 Rufe Snow Drive, between Loop 820 and Meadow Lakes
Drive. The property is zoned C-2 Commercial. A Special Use Permit is required for a car rental agency at this location
because the property is within 200 feet of a residential zoning district.
2. Site Improvements There is an existing 7,500 square foot building on the property, The applicant proposes to
occüpy the suite at the west end of the building. The attached site plan shows a highlighted area that will be used for
parking vehicles for rent.
3. Landscaping There is little landscaping on the property.
4. Parking and Traffic Circulation There are 73 parking spaces on the lot. Based on the size of the building, only 30
parking spaces are required on the lot. The property has frontage and drive entrances on Rufe Snow Drive. There is
also access to the property to the west via a public access easement.
5. Signs There is one existing pole sign located adjacent to Rufe Snow Drive, at the southeast corner of the property.
The sign is 84 square feet in area and is less than 25 feet tall. The Zoning Regulations will allow a 150 square foot sign
on this property, based on the frontage of the lot. However, an additional pole sign or roof sign will not be allowed.
The Planning and Zoning Commission conducted a Public Hearing and considered this Special Use Permit request at its
September 12, 1996, meeting and recommended approval subject to the age of the cars not exceeding five years, and that
no repair work is done on the premises,
RECOMMENDA TION:
It is recommended that the City Council conduct the required Public Hearing and consider the recommendation of the
Planning and Zoning Commission.

ZONING ORDINANCE NUMBER 1874, THE COMPREHENSIVE ZONING
ORDINANCE, TO AUTHORIZE SPECIAL USE PERMIT NUMBER THIRTY-THREE
(33) FOR A CAR RENTAL AGENCY; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City has received a request for a Special Use Permit for a Car Rental Agency; and
WHEREAS, after appropriate notice and public hearing, the Planning and Zoning Commission of the
City of North Richland Hills, Texas, has forwarded a recommendation to the City Council for
amendment of Ordinance No. 1874 by changing said Zoning Ordinance as set forth herein; now
therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS:

THAT, Special Use Permit Number Thirty-Three (33) be hereby authorized for a Car Rental Agency
as set forth in Case Number PZ 96-17 on the property described as follows:

Being a portion of a 0.919 acre tract of land situated in the City of North Richland Hills,
Tarrant County, Texas, and being part of the John Van Dusen Survey, Abstract 1588, and
being further described by metes and bounds as follows:
COMMENCING at a Texas Highway concrete monument, being the southwest corner of a
0.537 acre right of way conveyed to the State of Texas by deed recorded in Volume 3734,
Page 341, Deed Records, Tarrant County, Texas, said point also being the southwest
intersection of the south line of right of way on Interstate 820 and the west line of Rufe
Snow Drive;
THENCE South 00 degrees 18 minutes West 150.0 feet along the West line of Rufe Snow
Drive to an iron pin;
THENCE South 89 degrees 48 minutes West 20.0 feet to the POINT OF BEGINNING of
the tract herein described;

allowed for the parking of vehicles for Jent. The property shall maintain a minimum of 30
spaces on the lot for customer parking.
b. Age of Vehicles for Rent: Vehicles available for rent shall not exceed five years of
age. The age of the vehicle shall be determined by the calendar year at the time the
determination is made, e.g., in 1996, cars shall not be older than 1991 models.
a. Repair Work: Automobile repair work, as defined by Ordinance No. 1874, shall not be
performed on premises.
3.
THAT, all the regulations contained in the Zoning Ordinance No. 1874, as amended, which are not in
conflict with the terms of this Special Use Permit, shall remain in full force and effect regarding this
property.
4.
SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the
section, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or
unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity
or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs
or sections of this ordinance, since the same would have been enacted by the City Council without
the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence,
paragraph or section.

Drive and intends to use the space and a portion of our parking area for a automobile
rental agency. We agree with this use and would like for the City of North Richland

Subject: Public Hearing to consider the request of Bob Frank to rezone Agenda Number: PZ 96-18
Tracts 2B and 2F, Telitha Akers Survey, Abstract 19, from R-2 Single Family
Residential to a Planned Development for a Single Family Residential Gated
Community. (Located at the west end of Iron Horse Drive) Ordinance No. 2142
Mr. Bob Frank is the developer of a 16.434 acre tract of land located immediately west of the Meadow Lakes North
subdivision. The property is south of Browning Drive and abuts Iron Horse Golf Course. The developer has submitted a
zoning change application from R-2 Single Family Residential to a Planned Development for single family purposes. The
property is a part of the Meadow Lakes North Subdivision, and was preliminary platted as Phase Two in 1994. The developer
is seeking a planned development designation because the property is quite narrow and development options are limited.
The only street access is via an extension of Iron Horse Drive, Due to the shape of the property, it appears that a long cul-
de-sac street is the only option available to develop the property. The property is landlocked, abutting Iron Horse Golf Course
on one side and backing up to an older single family development in Haltom City on the other, Due to the unusual
characteristics of the property, the developer is requesting the zoning be changed from R-2 Single Family Residential to a
Planned Development. He is also requesting the subdivision be developed as a private gated community. The entrance to
the subqivision would have a security gate operated by a magnetic card access system.
If approved, the Planned Development Ordinance will allow construction of single family detached "Golf Course Villas," The
Golf Course Villas would consist of minimum 1,800 square foot homes constructed on lots slightly narrower than those of the
R-2 District, with narrower side yard set-backs. The development will allow front entry garages, as well as side and rear entry
garages. Front entry garages are being requested to allow the homes to maximize the rear yard exposure to the golf course,
There are no gated communities in North Richland Hills, and there are no adopted regulations pertaining to this type of
development. The attached ordinance contains regulations to provide the following: (1) to require private maintenance of the
streets by the homeowners association; (2) to provide for routine access by public utility, mail service and other public service
vehicles; and (3) to provide for emergency access by police and fire vehicles. The language in the ordinance is based on the
City of Keller's new regulations regarding gated communities.
Attached is a memorandum from the Police Department expressing its concerns and opposition to allowing gated
communities in the city. Fire Department representatives attended the Commission meeting and are satisfied with the
recommendations made by the Commission regarding emergency access to the development.
The Planning and Zoning Commission conducted a Public Hearing and considered this Planned Development request at its
September 12, 1996, meeting and recommended approval subject to the following requirements: the minimum dwelling unit
size be 1,800 square feet; 60% of the residences must have front-swing garages; and that an Opticom system with battery
backup be installed on the gate, per Fire Department standards,
RECOMMENDA TION:
It is recommended that the City Council conduct the required Public Hearing and consider the recommendation of the
Planning and Zoning Commission.

AN ORDINANCE OF THE CITY OF NORTH RICHLAND HILLS,
TEXAS, AMENDING THE ZONING REGULATIONS, ORDINANCE
NUMBER 1874, AS AMENDED, TO ESTABLISH PLANNED
DEVELOPMENT DISTRICT NUMBER 22; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, a portion of the Meadow Lakes North Addition consists of an unusually
shaped tract of undeveloped land which is situated adjacent to the Iron Horse Golf
Course; and
WHEREAS, the Planning and Zoning Commission has determined that the
development conditions of this tract of land do not provide adequate opportunities for
development under available zoning district regulations and that the existing zoning
classification is not appropriate fo(this area; and
WHEREAS, the developer has indicated an interest in establishing the proposed
development as a "Private Gated Subdivision;" and
WHEREAS, after appropriate notice and public hearing, the Planning and Zoning
Commission of the City of North Richland Hills, Texas, has forwarded a
recommendation to the City Council for amendment of Ordinance No. 1874 by
establishing PLANNED DEVELOPMENT DISTRICT NUMBER 22, by changing said
Zoning Ordinance as set forth herein; now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS:

THAT, Planned Development District Number 22 be hereby established in the Case
Number PZ -96-18, on the property described as follows:

1. Golf Course Villa - a single-family detached dwelling unit situated on its own lot
with side yard set backs which are considerably narrower than those of

maximize the rear yard exposure to a park, golf course or other open space
area.
2.
Private Street Residential Development - A residential subdivision consisting of
building lots which have no frontage on a publicly dedicated street right-of-way
and which are accessible only by way of a private street designated as an
access easement Such development may also limit public access to the lots by
use of a security gate or other security device.
3.
Front Swing Garage - A garage situated on the front street side of a residential
structure in which the garage door opening is perpendicular, or nearly
perpendicular, to the front street right-of-way.

That, Planned Development District Number 22 shall consist of a Private Street
Residential Development subject to the following criteria:
1. Prior to the issuance of any building permits, the developer shall submit a
subdivision plat and obtain approval of said plat from the City Council.
2.
The development shall contain water, sewer, drainage and street facilities which
are designed and constructed to the standards shown in the North Richland Hills
Design Manual for Public Works / Utilities, including the payment of any
applicable inspection fees.
3. All streets shall be designated on the plat as an access easement The access
easement shall also be designated as a utility and drainage easement
4. The entrance to the development shall be marked with a sign designating the
street as a private street An access control gate, guardhouse or other means of
restricting access must be fitted with equipment to accommodate government
and utility vehicles, U. S. Postal Service, residents, guests, and deliveries without
impeding traffic movement on public streets. All gates must comply with Fire
Department requirements for emergency access, including the installation of an
"Opticom" system compatible with that of the North Richland Hills Fire
Department and with a battery back-up. The developer must install all necessary
appurtenances for the access gate and provide to the City all equipment
necessary to operate the access control devices as determined by the City at no
cost to the City.

The subdivision plat and the property owners association documents shall reflect
the private status of the streets with no maintenance provided by the City.

6. The subdivision plat and the property owners association documents shall
contain statements that the association and the residents as the owner of the
streets agree to release, indemnify, defend and hold harmless the City, any
governmental entity or public utility for damages to the private streets occasioned
by the reasonable use of the private street by the City, governmental entity or
public utility; for damages or injury, including death, arising out of the condition of
said private street; for damages and injury, including death, arising out of the use
by the City, government entity or public utility of any restricted access gate or
entrance; and for damages and injury, including death, arising out of the use of
the subdivision by the City, governmental entity or public utility. Further, such
statements shall provide that all lot owners shall release the City, governmental
entities and public utilities for such damages and injuries. The indemnifications
contained in this paragraph apply regardless of whether or not such damages
and injury, including death, are caused by the negligent act of omission of the
City, governmental entity, or public utility, or their representative officers,
employees or agents. Those portions of the homeowners association's
documents pertaining to the subject matter contained in this paragraph shall not
be amended without prior written consent of the City.
7. The Private Street Residential Development shall not cross an existing or
proposed thoroughfare as shown on the City's Master Thoroughfare Plan, or an
existing street.
8. The Private Street Residential Development shall not cross or disrupt an existing
or proposed public pedestrian pathway, hike and bike trail or park as shown on
the City's Park Master Plan.
4.
That, the development regulations for Planned Development District Number 22 shall
be as follows:
1. Purpose: Planned Development District Number 22 is intended to provide for a
Private Street Residential Development which contains Golf Course Villas
constructed at an approximate density of ten (10) units per acre.
2. Permitted Uses: Golf Course Villas consisting of single family detached
residential dwelling units.

4. Fences: Only combination wrought-iron and masonry fences shall be allowed
along any common boundary line with Iron Horse Golf Course. Wooden

5. Parking: Off-street parking space shall be provided on the lots to accommodate
four cars for each dwelling unit. At least two of such spaces shall be covered;
however, no supporting member of any garage, carport or other automobile
storage structure shall be located within a required front, side or rear yard.
6. Accessory Buildings: As allowed by Article 6, Sections 600 F & G, Ordinance No.
1874, as amended.

Customary Home Occupations: As allowed by Article 6, Section 600 T,
Ordinance No. 1874, as amended.
8. Garage Entry Requirement: A minimum of sixty (60) percent of the housing units
shall be constructed using a front swing garage as defined herein.
9. Masonry Requirement: The exterior wall surface, as viewed from each primary
elevation, of all permanent structures constructed in Planned Development
Number 22 shall consist of at least seventy-five percent brick, stone, or if
approved by the City Council, other masonry or materials of equal
characteristics. For the purposes of this requirement, the exterior wall surface
shall be defined as the area between the wall corners extending from the top of
the foundation up to the door or window header height of the first floor,
whichever is greater. The area of door and window openings shall not be
included in the calculation of this requirement.

That, access easements shown on Final Plats situated within Planned Development
District Number 22 shall be considered as public right-or-way for purpose of enforcing
nuisance ordinances adopted by the City of North Richland Hills.

ordinance shall be declared invalid or unconstitutional by the valid judgment or decree
of any court of competent jurisdiction, such invalidity or unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this
ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such invalid or unconstitutional phrase, clause,
sentence, paragraph or section.

EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its
passage.

Upon review of J. Clayton Husband's memorandum regarding the "Proposed gated community"
adjacent to Browning Drive, the following areas of police concern arise:
· The Planning and Zoning Commission Cover Sheet ITom Barry LeBaron indicates
access to the gate will be accomplished through the use of magnetic cards. This will
be impractical for police purposes as I do not have faith that cards will always be in
the possession of officers when needed. Also, these cards, if left inside patrol
vehicles during Texas summers, will warp and render them potentially ineffective.
· The information we have been provided leaves one to assume these gates will always
be unattended. This is unacceptable due to the obvious security risks we face given
the aforementioned police access problem coupled with the impedance of speedy
police response in case of an emergency. Should there be a gate failure (mechanical
or sabotage) or should officers not have possession of the necessary cards, police
would be forced to enter potentially serious scenes afoot and with additional delay.
Time is of the essence in emergencies and both police and fire departments would
find this equally unacceptable.
· Magnetic cards can be stolen ftom vehicles of residents giving access to thieves who
wish to gain vehicular access. Just because a gate, or gates, are installed does not
negate entrance by criminals.
· The boundaries of this planned subdivision adjoin the city of Haltom City. This will
cause emergency responses to be limited to a single area of approach, access and
entry. The point here is that criminals will always know where the police are coming
ITom and can certainly be in tune with watching for those responses. Any delays in
our entering the site will only give them more time to cany out their crime and
subsequent escape through the golf course or into Haltom City where no North
Richland Hills police officers will be located.
· Streets and/or cul-de-sac areas inside the "planned community" will not be public
streets. Therefore, no enforcement of applicable public roadway traffic laws can be
accomplished. The Texas Transportation Code Traffic Laws will be moot pertaining
to any speeding, reckJess driving, parking or other violations we commonly respond
to in neighborhoods where the roadways are public and accessible. The same
limitations would apply to certain city ordinances that the City of North Richland
Hills commonly enforces regulating these areas of vehicular concern.

When the Police Department sent me to the FBI National Academy this year, I had an opportunity
to see some of the "planned communities" in the state of Virginia. I noticed that the communities
that had been in existence for awhile had gates but no control as to who entered or exited the
neighborhood. Over a period of time it appeared hardware was not maintained and in instances
where the intent had been to provide guards, the guards no longer were employed by the
neighborhood. Thus, the whole "secure neighborhood" scenario was a mere charade.
I requested that Captain Richard Kitchen contact the Tarrant COWlty District Attorney's Office for
their opinion regarding legal issues surrOWlding those areas of enforcement contained within this
document. The stated opinion obtained matches that which is expressed herein.
Based on the areas as briefly discussed above, it is my recommendation that the city not allow this
type of development within the city limits of North Richland Hills. This proposed
recommendation is based on concern for the safety and well-being of our citizenry and the attempt
to negate what I perceive as unnecessary additional obstacles that public safety must overcome.

Special Use Permit for an Indoor Go-Kart Race Track on Lot 3, Block 1,
Richland Terrace Addition. (Located at 7601 Grapevine Highway) Ordinance No. 2144
Indoor Grand Prix is the prospective purchaser and developer of the old Home Depot property located at 7601 Grapevine
Highway, The developer has submitted a Special Use Permit application to convert the building into an indoor go-kart racing
facility. Indoor Grand Prix has locations in Garland and Dallas,
The following are the major items concerning this Special Use Permit request.
1. Location and Zoning This property is located at 7601 Grapevine Highway, across from North Hills Mall. The
property is zoned C-2 Commercial. Due to the unique character of the use, staff advised the developer to apply for a
Special Use Permit.
2. Site Improvements The existing 78,000 square foot building is presently vacant. The developer proposes to
renovate the building to accommodate an indoor go-kart track, with some small retail areas, Portions of the building
would be available for sub-leasing to restaurant or retail uses. The entrance would be modified to include a glass
entränce with canopy. A general floor plan is attached.
3. Landscaping There is very little existing landscaping on the property. In April 1996, the Zoning Board of Adjustment
approved a variance request for the landscaping on the lot. The approved plans include ornamental trees adjacent to
the pole sign; landscaped islands with curbs at the end of the parking rows nearest the building; landscaped islands
around the light pole locations nearest the street; planting strips incorporated into the front sidewalk paving; and the
planting of trees along Road to the Mall. Landscaped areas near building will be maintained by exterior hose access as
an irrigation system was not required at the time the building was constructed.
4. Parking and Traffic Circulation There are 351 parking spaces on the property: 199 in the front and 152 in the rear.
The property has frontage and drive entrances on Grapevine Highway and Road to the Mall.
5. Signs There is one existing pole sign located adjacent to Grapevine Highway, The Zoning Board of Adjustment
approved a request in April 1996 for a pole sign 70 feet in overall height and 370 square feet in area. The Board also
restricted any sign on Road to the Mall to a monument sign or directional sign.
The Planning and Zoning Commission conducted a Public Hearing and considered this Special Use Permit request at its
September 12, 1996, meeting and recommended approval subject to the variances approved by the Board of Adjustment.
RECOMMENDATION:
It is recommended that the City Council conduct the required Public Hearing and consider the recommendation of the
Planning and Zoning Commission.

ZONING ORDINANCE NUMBER 1874, THE COMPREHENSIVE ZONING
ORDINANCE, TO AUTHORIZE SPECIAL USE PERMIT NUMBER THIRTY-FOUR (34)
FOR AN INDOOR GO-KART RACE TRACK; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City has received a request for a Special Use Permit for an Indoor Go-Kart Race
Track; and
WHEREAS, after appropriate notice and public hearing, the Planning and Zoning Commission of the
City of North Richland Hills, Texas, has forwarded a recommendation to the City Council for
amendment of Ordinance No. 1874 by changing said Zoning Ordinance as set forth herein; now
therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS:

THAT, Special Use Permit Number Thirty-Four (34) be hereby authorized for an Indoor Go-Kart Race
Track as set forth in Case Number PZ 96-20 on the property described as follows:
Being a 6.199 acre tract out of the W. W. Wallace Survey, Abstract 1606, and also being Lot 3,
Block 1, Richland Terrace Addition, an addition to the City of North Richland Hills, Tarrant County,
Texas, as recorded in Volume 388-168, Page 45, Plat Records, Tarrant County, Texas.
This property is generally located at 7601 Grapevine Highway.
2.
THAT, the development regulations contained in the C-2 Commercial zoning district of Ordinance
1874 shall govern development on said property, except where amended below. The regulations
contained herein shall prevail over any inconsistencies with the regulations contained in Ordinance
1874.

a. Landscaping: The landscaping on the lot shall be constructed and maintained as
follows:
(1) Landscaped islands with concrete curbs shall be constructed at the ends of the
parking rows nearest the building. The islands shall be planted with shrubs and other
low colorful plantings.
(2) Landscaped islands shall be constructed in the parking areas at the light pole
locations nearest to the street. The islands shall be planted with shade trees.
(3) One tree shall be planted for each eighty (80) feet of the frontage of the property
along Road to the Mall.
(4) All landscaped areas shall be adequately maintained by exterior hose access. All
landscaped area shall be otherwise maintained in accordance with Ordinance No.
1874, the Zoning Ordinance of the City of North Richland Hills.
b. Signs: The signs on the property shall be subject to the following regulations:
(1) The pole sign located on Grapevine Highway shall not exceed seventy (70) feet in
overall height.
(2) The pole sign located on Grapevine Highway shall not exceed three hundred
seventy (370) square feet in area.
(3) Signs located along Road to the Mall shall be restricted to monument or directional
signs, as described in Ordinance No. 1874, the Zoning Ordinance of the City of North

INTRODUCTION:
I~DOOR GRAND PRIX proposes to remodel the existing property
located at 7601 Grapevine High~ay, North Richland Hills, Texas,
for use as an Indoor Kart Racing facility and Family
Entertainment Center. This concept would include food services
and retail sales of racing equipment, apparel and merchandising.
We are also looking to attract one or two other major tenants
with complimentary Entertainment businessess.
The design of the new facility includes complete repainting of
the exterior to introduce a new striking visual identity.
BACKGROUND:
The property is 10cated in a Zone C-2, in an area of mixed retail
and re-development. The property has been vacant for 24 months.
It has been subject to vandalism and visually the building has
deteriorated in appearance. Street frontage is reduced in width
almost 50% by a Race Trac gas station out parcel. The exterior
parking areas are paved in concrete and include small grass areas
at both street frontages.

Brandonwood Estates. (Located at the northeast corner of Smithfield
Road and North Tarrant Parkway)
Keller Smithfield Road Ltd. is the owner of a 43.703 acre tract of land located at the northeast corner of Smithfield Road and
North Tarrant Parkway. The developer has submitted a Final Plat of the property for review and consideration by the City
Council. The plat would subdivide the property into 137 lots.
The following are the major items regarding this Final Plat. Other comments are included in the attached engineering
comments letter,
1. Zoning This property is zoned R-2 Single Family Residential. This district requires a minimum lot size of 9,000
square feet and a minimum dwelling unit size of 1,800 square feet. All houses constructed in this subdivision will require
a side or rear entry garage.
2. Thoroughfare Plan This property has frontage on North Tarrant Parkway and Smithfield Road. The owner is
dedicating an additional 28 feet of right of way along Smithfield Road. North Tarrant Parkway has a right of way width of
200 feet.
3. Screening Walls and Sidewalks A masonry screening wall is required along this property's frontage on North
Tarrant Parkway and Smithfield Road. The Subdivision Regulations require a screening wall along all residential lots that
have frontage on a C4U or larger street. Sidewalks are required along all streets in the subdivision, The developer is
requesting a waiver of the screening wall requirement on Lot 19, Block 6 since it will be used for a neighborhood
community center.
4. Street Intersection The intersection of Chaddington Court and Brandonwood Drive does not meet at a 90-degree
angle. However, the Planning & Zoning Commission recommended a waiver of that requirement for this intersection
since the deviation is very minor.
6. Access to Adjacent Property Brandonwood Drive has been stubbed out to the north to provide access to future
phases of the development. A preliminary plat was submitted on the property by a different developer several years ago,
but that plat has expired.
The developer has addressed all engineering comments. The Planning and Zoning Commission considered this Final Plat at
its September 12, 1996, meeting and recommended approval subject to engineering comments, and a waiver of the masonry
screening wall requirement on Lot 19, Block 6, if the lot is used for community improvements.
RECOMMENDATION:
It is recommended that the City Council consider the recommendation of the Planning and Zoning Commission.

We have reviewed the subject documents submitted to this office on May 22, 1996.
The following items are for your consideration. DUE TO THE SIGNIFICANCE OF THE
OUTSTANDING ITEMS, WE FEEL THAT THIS PLAT SHOULD NOT BE PLACED ON
THE AGENDA FOR P & Z CONSIDERATION.
1. The engineers had noted a CLOMR and LOMR will be obtained prior to
acceptance of the subdivision. The CLOMR will need to be submitted to Public
Works prior to P & Z considering the Final Plat. The LOMR will be required prior
to Public Works issuing a Final Approval letter. The LOMR must be approved
by FEMA prior to issuing Building Permits in the existing flood plain.
2. All offsite easements and exhibits need to be prepared and forwarded to the
Public Works Department for review prior to Final Plat being placed on the P & Z
agenda. The signed easements need to be transmitted to the Public Works
Department for filing with the approved Final Plat.
3. The appropriate signatures need to be added to the Owner's Acknowledgment
and Dedication. In addition the surveyor's seal and signature need to be added
to the plat prior to filing.
4. A 200 foot right-of- way has been shown for North Tarrant Parkway. An offset is
shown at the southeast corner of the plat adjacent to Lot 13, Block 1 Shady
Oaks Addition. The entire ROW was dedicated at one time. This offset needs
to be verified or corrected with the next submittal.

5. This plat fronts on both Smithfield Road and North Tarrant Parkway. There is an
existing curb and gutter along the west side of Smithfield Road. Smithfield Road
needs to be improved to provide curb and gutter along the east right-of-way as
well. The plans propose that 18 feet of a 48 foot street will be constructed of
concrete. If the existing street is asphalt, we recommend asphalt improvements
rather than concrete.
6. There is an existing water line under the proposed improvements for Smithfield
Road. Adequate depth for this water line will need to be field verified. If there is
not adequate coverage this water line may need to be lowered.
7. A sanitary sewer line easement needs to be added to the plat for the sewer line
at the south west corner of Havenwoood Drive and North Tarrant Parkway. Lot
19, Block 6 does not show a sewer service. If the service is connected to the
line in Brandonwood Drive, it may limit the location of the proposed structure. If
the service is connected to Line "J" in North Tarrant Parkway, a portion of this
line may be too deep and would require a parallel sewer line.
8. The Design Manual requires all street intersections to form a ninety (90) degree
angle. The intersection of Chaddington Drive and Brandonwood Drive will need
to be revised. The P & Z Commission waived this requirement for the
Preliminary Plat, however we feel it may need to be reconsidered.
9. The north end of Brandonwood Drive is shown to dead end. The Engineer
responded to this comment during the Preliminary Plat. They propose to tie
Brandonwood Drive into "Brandonwood Estates, Phase II" currently shown as
the Preliminary Plat of Shady Oaks, Fifth Filing. This will extend Brandonwood
Drive north to Shady Grove Road. The Shady Oaks Preliminary Plat has
expired and nothing else has been submitted for Brandonwood Estates.
10. The Owners of the Plat for Brandonwood Estates are listed as "Keller-Smithfield
Road, L TD and Northeast Tarrant Parkway, LLC and John Barfield, G.P."
There is a lot owned by Keller-Smithfield Road, L TD, zoned C-2, adjacent to the
Final Plat for Brandonwood Estates. If this lot is to be zoned Residential in the
future and is under the same ownership consideration should be made to include
this with the current Plat.
11. Inspection fees will be due prior to starting construction. The current rate is four
percent for water and sewer and three percent for streets and drainage.
12. Current EPA regulations require that an NPDES permit be obtained prior to
beginning construction. The owner and contractor are both responsible for
obtaining the permit. The Owner should therefor request information from the
EPA to determine the necessary steps for filing an application for an EPA-
NPDES Permit.

These comments are recorded on a set of blueline construction plans. These plans will
be returned to the Engineer for revision. The comments contained herein do not

On October 1 I 1996, the City is to receive $9.2 million for the sale of the Watauga portion
of the Water and Sewer System. North Richland Hills will use the proceeds from the sale
to defease a large portion of the Water and Sewer Revenue Bonds currently outstanding.
The defeasance, under Option A, would occur in early October 1996. After the defeasance,
debt service on the remaining bonds is estimated at approximately $575,000 to $600,000
per year as shown in Option A of the attachment. The total remaining debt service through
the year 2008 is estimated to be $6,975,865.
In addition to the defeasance, staff and representatives of First Southwest have been
discussing refunding the remaining Water and Sewer Revenue Bonds. The resulting debt
service for a combination defeasance and a refunding issue are shown in the attachment
as Option B. Because the City has used all the advance refundings available under current
tax law, the bonds can be refunded only on a current basis at the first call date of February
15, 1997. The City must wait to issue the refunding bonds until 90 days prior to the call
date. The average annual debt service under this option is estimated at approximately
$553,000. The total debt service on the refunding issue through the year 2008 is estimated
at $6,636;093. Estimated savings from a combined defeasance and a current refunding
issue are approximately $340,000.
Under Option B, the defeasance would be postponed until the proposed sale date of the
Bonds of November 25,1996. Savings in issuance costs of approximately $10,000 can be
realized using this option.
Representatives from First Southwest Company will be available at the Council Meeting to
present this item and answer any questions regarding this issue.
Recommendation:
It is recommended that City Council approve Option B, authorize staff to proceed with the
necessary action for the Water and Sewer Refunding issue, and postpone the defeasance
of existing Water and Sewer Revenue Bonds until the refunding sale in November 1996.

Dear Larry:
Pursuant to your request we have reviewed the feasibility of effecting a current refunding of the
City's Waterworks and Sewer System Revenue Bonds in conjunction with the defeasance of the
remainder of the City's Revenue Bonds (see attached). By refunding the remainder of the City's
Bonds, over and above the cash defeasance, we can reduce the total Debt Service to $6,636,092,
an additional savings of approximately $340,000.
In order to refund the City's outstanding Bonds we must however wait until 90 days before the
call date of February 15, 1997. This must be done in order to sell the Bonds on a tax-exempt
basis due to the fact the City has used all the advanced refundings available to them under
current tax-law. We must therefore refund the Bonds on a current basis at the first call date. By
postponing the defeasance until the proposed sale date of the Bonds on November 25, 1996 we
can save additional issuance costs of approximately $10,000.

The Capital Improvements Advisory Committee has worked closely with staff to revise and update
the previously approved Land Use Assumption Plan and to remove the City of Watauga from the
service area as required to revise the North Richland Hills water and wastewater impact fees. All
suggested modifications have been made and the revised plan is attached.
Staff requests the Mayor open the public hearing and allow interested parties the opportunity to
speak and then close the public hearing.
Recommendation:
Staff and the Capital Improvements ~dvisory Committee recommend Council approve the revised
Land Use Assumption Plan with any appropriate amendments as determined by Council.

WHEREAS, the Capital Improvements Advisory Committee has met and
approved the updated Land Use Assumptions (1996) of the Capital Improvements Plan
for Water and Wastewater Impact Fees; and
WHEREAS, said Advisory Committee has forwarded the 1996 updated Land
Use Assumptions for consideration and action by the City Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF NORTH RICH LAND HILLS, TEXAS that:
1.
The City Council finds that all legal requirements, both procedural and
substantive, have been met to adopt the updated Land Use Assumptions for 1996.
2.
After a public hearing on this date, the Council hereby adopts the updated 1996
_ Land Use Assumptions for the Water and Wastewater Impact Fee program.

compute the proposed revised water/wastewater impact fees which Council will be reviewing.

We have been advised that it is not a requirement of the Texas Local Government Code, Chapter
395 that the Commission take a formal vote on the Land Use Assumption Map. As Council

3. "Population Projection Tables" -- These tables contain land use areas (acres) and
population projections based on assumed population densities. The following is a brief
summary of the land areas and population data associated with the Land Use Assumption
Map:

miles).

b. Total existing developed area = 8,454.721 acres (13.21 square miles), which is
73.31 % of the total city area.
c. Area projected to develop in the next 10 years = 1,709.608 acres (2.67 square
miles), which is 14.82 percent of the total city area.
d. Current estimated population is about 52,000 people. Ultimate projected
residential population is about 71,500, based on the projected population densities
used in this study. Employment population is projected to be about 23,500 for a
total "equivalent population" of95,000 people, which is used in the water and
sanitary sewer system analysis and Capital Improvements needs study.
Notes on development of population projections:
e
The Land Use Assumptions Map is divided into Census Tracts and Blocks. Population data
obtained üom the Census Bureau is presented in Table No.1 (attached) for 1990, which was
furnished to us by Barry LeBaron. These population numbers for each Tract and Block were
adjusted for a total current estimated residential population of about 52,000. From the LUAP
Map, the land areas included in each Tract and Block for each of the Land Use Categories was
calculated üom the G.I.S. database. Current population densities were calculated (people per
acre) within each developed land use area to establish trends for future population projections.
Please note that current densities reflect current occupancy rates. The assumed future densities
are based on full-occupancy at ultimate build-out. We would further note that the residential
population projections are lower than estimates rrom previous Impact Fee Studies becuase of the
increase in the parks and open space areas (including the Little Bear Corridor area). The total
assumed residential land use area calculated in 1990 was about 7,940 acres. Based on the new
Land Use Assumptions Plan Map, the calculated residential area is about 7,570 acres (a decrease
of370 acres).
The following shows the average densities associated with the three residential land use areas at
build-out. If the Council wishes to adjust any of these numbers we will revise the population
projections accordingly.

As discussed at the Pre-Council meeting on September 9, 1996 the Municipal Court is asking the City
Council to consider adopting Ordinance No. 2148 allowing the collection of a $3.00 security fee for each
case handled by the Municipal Court and convicted in a trial. This fee will not be assessed on any
dismissals granted by law, or made possible by the prosecutor during any plea bargain agreements.
This fee will be dedicated for measures to enhance the security of the court for its patrons and its
employees, by the addition of a licensed peace officer to serve as Bailiff. The funds collected by the court
will pay the salary of this position and will not result in any General Fund expenditures for this position.
Providing a Bailiff is one of the designated expenditures allowed by State Law for any municipality collecting
the security fund. Any additional revenues produced by this fund, above the expenditures for a Bailiff, will
be utilized for additional court security measures as allowed by law. All fund expenditures from this account
must be approved by the City Council individually or as a part of the normal budget process.

fees for services rendered to any person: (1) CIVIL COURT ACTIONS

ORDINANCE NO. 2148
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF NORTH RICHLAND HILLS, TEXAS that:
1.
Pursuant to powers granted by Section 2 of Article 102.017 of the Code of Criminal
Procedure, a Municipal Court Building Security Fund is hereby established for the City of
North Richland Hills, Texas.
2.
The said Fund shall be funded by a $3.00 charge on each person convicted in
trial for a misdemeanor offense in the Municipal Court of North Richland Hills. The
$3.00 fee shall be taxed as costs of court on each conviction of a misdemeanor
offense. Conviction shall include payment of a fine, imposition of community service,
imposition of probation, suspension or deferred adjudication.
3.
The Clerk of the Court will collect the costs and pay them to the office of the
City Finance Director for deposit in a fund to be known as the Municipal Court Building
Security Fund. This fund may be used only to finance the security services for the
municipal court building that are listed in subsections (1) through (9) of said Article
102.017 (d) of the Code of Criminal Procedure.
4.
The fund created herein shall be administered under the direction of the City
Council of the City of North Richland Hills.
5.
This Ordinance shall be in full force and effect from and after October 1, 1996.

North Hills Alliance Church is located at the corner of Grapevine Highway and Strummer Drive
(see attached map). The City acquired right-of-way from this property for the Strummer Drive
Widening Project on October 8, 1993.
The original entrance into the church parking lot from Grapevine Highway was removed to make
way for the new Strummer Drive alignment. The plans initially showed a new entrance being built
into the church lot from farther northeast along Grapevine Highway. However, drivers are now
entering the church lot from the old section of Strummer still in use and driving across the lot and
bar ditch onto Grapevine Highway in order to avoid the new intersection.
The church is requesting the following from the City rather than having the new access built from
Grapevine Highway: -
1. The City would install sixteen (16) concrete curb stops in front of parking spaces in the
church parking lot.
2. The City would deed, at no cost, a triangular-shaped remainder lot to the church. This
remainder is a remnant of Lot 3R, Block F, Richland Oaks Addition and is adjacent to the
church property. Lot 3R was purchased by the City for the Strummer Widening Project on
6-16-93. The Attorney for the City advises that because this remainder lot is too small to
have any value "standing alone", advertising and taking bids is not necessary.
3. The City would waive permit fees required for the church to erect two (2) signs on their
property.
The cost of the concrete curb stops is $320.00 (16 @ $20.00/each). The remainder lot is
approximately 4,550 square feet and is estimated to be worth no more than $1,500.00. The
permit fees for the proposed signs should be no more than a total of $200.00. The total cost to
the City for these proposals is therefore $2,020.00. The cost to build the new drive approach
from Grapevine Highway into the church lot would have been $8,355.00.
Recommendation: Staff recommends Council approve Resolution No. 96-60, authorizing the
Mayor to sign a Quit-Claim Deed and approve the proposal as shown above.

Dear Mr. Shiflet;
I am submitting this letter in response to the phone conversation I had with Mark
Bradley last week. He informed me that you needed a letter from us to present to the
City Council next week.
~ince the construction of Strummer, we have had a continuing problem of drivers using
our parking lot to turn around or to drive across our lawn to access Grapevine or
Strummer. This is dangerous in numerous ways. The City of North Richland Hills
promised us that they would construct a driveway that would connect our parking lot to
Grapevine Highway. Our Governing Board felt that if we constructed the promised
driveway, the problem with the errant drivers would increase to unmanageable portions.
We presented to the Mike Curtis a proposal that would benefit both us and the City.
After several conversations and visits with Mike Curtis and Mark Bradley, we propose
that the NRH not construct the driveway. This would save the city thousands of dollars.
In return, we ask that:
1. The North Hills Alliance Church be deeded the small triangular shaped piece
of property described as the Triangular Remainder of Lot 3 R. Block F, of the
Richland Oaks Development.
2. The city provide for us 16 concrete curb stops to prevent drivers from driving
over our lawn to access Strummer and Grapevine.
3. NRH waive the sign fees required to erect two signs one on the small
triangular piece of property mentioned in item 1, and one on the side of our
building. The design and content of the signs will be submitted later.
We wish to thank Mike Curtis and Mark Bradley for being very helpful as we discussed
our situation. We also thank you in advance for your time and assistance.

RESOLUTION NO. 96-60
WHEREAS, the City of North Richland Hills, Texas, originally acquired Lot 3R, Block F,
Richland Oaks Addition for Strummer Drive right-of-way; and
WHEREAS, a portion of said Lot 3R, Block F, was never used or dedicated as right-of-
way; and
WHEREAS, that portion of Lot 3R, Block F, which was not used, is a 4,550 square foot
triangular shaped tract adjacent to Lot 1A, Block F; and
WHEREAS, the City has no use for said 4,550 square foot triangular tract, and the owner
of Lot 1 A has a need for said tract;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF NORTH RICHLAND HILLS, TEXAS,
that
1.
The Mayor be, and is hereby, authorized to execute a quit-claim deed from the City to
North Hills Alliance Church (owner of Lot 1A) conveying that certain 4,550 square foot (more or
less) triangular tract to said North Hills Alliance Church.
2.
The Mayor be and is hereby authorized to execute a Quit-Claim Deed from the City to
North Hills Alliance Church, retaining a drainage and utility easement along the entire above-
described vacated property.

The sand traps at Iron Horse Golf Course are in need of reconstruction. They no longer drain properly,
consequently they hold water which is an aggravation to the players. The most frequent complaint that
we receive at our golf course is about the condition of these traps. Reconstruction is a major expense
that has not been budgeted for. At the present time we have approximately $600,000. in our reserve
fund for Iron Horse. We would recommend that $75,000. of this balance be appropriated and added to
next years budget to accomplish the reconstruction of the traps. The total project will cost
approximately $125,000. We have already budgeted $50,000. in next years budget for this
reconstruction.
Recommendation:
It is recommended that the City Council appropriate $75,000. from the Iron Horse Golf Course Fund
balance to fund sand trap reconstruction.

Councilman Sibbet has requested staff bring this item to the Council for consideration.
In 1992, the City of Fort Worth requested all 'Nholesale water customers adopt a water
conservation plan like their's in accordance with the Texas Water Development Board (TWDB)
requirements (see attached letter from Richard Sawey). The Wholesale Customer Water System
Advisory Committee to the City of Fort Worth appointed a subcommittee to review the TWDB's
requirements and develop a model plan in ordinance form. This was done and the following 14

Previously, Rodger Line had approved the plan to be submitted to the Council, but Fort Worth
never responded to our request for their approval. Fort Worth has finally realized this and has
just recently requested we adopt the plan.
A copy of the plan is attached for your review. Some of the major plan requirements the City
would have to adopt by ordinance are listed below.
· Program goal of 5 percent reduction in per capita water consumption (see last
paragraph, page 1).
· Distribute education materials from state and federal agencies/associations by making
them available as handouts at City Hall (see text beside the black bar on pages 2 and 3).
· Submit annual report to City of Fort Worth (see "Annual Reporting" paragraph, page 4).
· Adopt trigger conditions and implementation measures for the EWDMP (see pages 5,6
and 7). -

THE ELEMENTS OF A WATER CONSERVATION AND EMERGENCY WATER DEMAND
MANAGEMENT PLAN
that:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS
SECTION 1: The City of North Richland Hills, Texas hereby adopts a Water Conservation and
Emergency Water Demand Management Plan attached hereto.
SECTION 2: The Emergency Water Demand Management Plan establishes certain drought
trigger conditions and actions to be taken by the citizens of the City of North Richland Hills during the
periods of defined drought conditions.
SECTION 3: This ordinance authorizes the Mayor, or the Mayor's duly appointed representative,
to define the trigger condition as detailed in the adopted Emergency Water Demand Management Plan,
to upgrade or downgrade the condition, to initiate the appropriate actions as detailed in the adopted
Emergency Water Demand Management Plan, and to terminate the condition when the emergency has
ended.
SECTION 4: The Mayor, or the Mayor's duly appointed representative, shall have the authority
to enact and promulgate any or all of the prescribed procedures, and to adopt and promulgate rules and
· regulations if necessary to protect health and safety in case of system failure.
SECTION 5: The prescribed procedures to protect the health and safety of the citizens shall be
promulgated by posting in three pubic places within the City and the procedures shall be binding upon
all water customers of the North Richland Hills Water System. Any customer violating any posted
procedure, limitation or ban shall be deemed guilty of a misdemeanor and fined not in excess of $200.00.
Each day of violation shall be a separate offense.
SECTION 6: This authority established by this ordinance will remain in effect until the ordinance
has been repealed or amended by the North Richland Hills City Council.

CHAPTER 1 - INTRODUCTION
This report outlines the City of North Richland Hills' (City) Water Conservation and
Emergency Water Demand Management Plan. The objective of the conservation program
is to reduce the quantity required for each water using activity, insofar as is practical,
through the implementation of efficient water use practices. The Emergency Water
Demand Management Plan provides procedures for voluntary and mandatory actions to
be put into effect to temporarily reduce the demand placed upon the City's water supply
system during a water shortage emergency. Emergency water demand management
procedures include conservation, but may also include prohibition of certain uses. Both
programs are tools that the City will have available to operate effectively in all situations.
Planning Area and Project Description
The planning area is the total ärea within the city limits of North Richland Hills and
Watauga, which is approximately 22.5 square miles. The project is the total water system
owned and operated by the City of North Richland Hills which distributes potable water to
all its customers within the planning area. Currently, the population of this service area
is approximately 72,000 people.
Utility Evaluation Data
A detailed summary of utility evaluation data is included in Appendix A. Appendix A will
be updated annually and submitted to the Fort Worth Water Department in October for the
prior one-year period, October 1 through September 30.
Program Goal
The objective of a water conservation plan is to reduce the per capita consumption of
water, a finite resource. Many communities throughout the United States have used
conservation measures to successfully cope with various water and wastewater problems.
Reductions in water use of as much as 25 percent have been achieved, but the normal
range is from 5 to 15 percent. As a result of reduced water use, wastewater flows have
also been reduced by 5 or 10 percent. It is anticipated that implementation of this Plan will
result in a reduction in per capita water consumption. It is the goal of this Water
Conservation Plan to reduce per capita water consumption by 5 percent.

CHAPTER 2 - WATER CONSERVATION PLAN
Plan Elements
The principal water conservation methods to be considered in preparing this water
conservation plan are:

· Periodic Review and Annual Reporting
Education and Information
The City recognizes that water conservation significantly benefits individuals and
communities in terms of long-term availability and costs. The most readily available and
lowest cost method of promoting water conservation is to inform the retail water users
about ways to save water in homes and businesses, in landscaping and lawn uses, and
in recreational uses. The City will provide the information to retail customers in the
following manner.
1. Initial Year Program
a. The public education program during the initial year shall include all
activities outlined in the Long-Term Program (below).
b. Distribution of educational material in the form of a handout or information
added to the water bill.

2. Long-Term Program
a. Distribution of educational materials from the American Water Works
Association, Texas Water Development Board, and others will be made
available as handouts.
b. New retail customers will be provided with water conservation literature,
such as Appendix B, when applying for service.
Water Rate Structure
The City will periodically review respective retail water rate structures to ensure that the
prevailing rates encourage water conservation while covering the total cost of service and
minimizing adverse impacts.
Metering and Meter Repair/Replacement
All water users including retail, City and other public facilities are metered. Water provided
to the system is measured by master meters.
· A regularly scheduled maintenance program of meter testing, repair, and replacement
should be established in accordance with the following schedule:
·
1. Production (master) meters - test once a year.
2. Meters larger than 1-1/2" - test every 5 years.
3. Meters 1-1/2" or smaller - test every 10 years.
Water Audits and Leak Detection
The City will continue their ongoing leak detection, location, and repair programs.
Waterline leaks are detected by utility personnel while reading meters, maintaining their
water and wastewater systems, and while performing other routine surveillance programs.
Additionally, water audits shall be utilized to determine if leaks exist which have gone
undetected. The City shall conduct an in-house water audit at least once each year to
compare water produced versus water sold.
Implementation and Enforcement
The Mayor of North Richland Hills or the Mayor's duly appointed representative will act as
the Administrator of the Water Conservation and Emergency Water Demand Management

Plan in North Richland Hills and the Mayor of Watauga or Mayor's duly appointed
representative will act as the Administrator of the Water Conservation and Emergency
Water Demand Management Plan in Watauga. The Administrators will oversee the
execution and implementation of all elements of the plan. The Administrators will also be
responsible to oversee the keeping of adequate records for program verification.
Annual Reporting
The City of North Richland Hills will be responsible for the submission of an annual report
to the City of Fort Worth. Such a report will be due to the Water Department Director by
April 1 of each year for inclusion in the City of Fort Worth's report to the Texas Water
Development Board. The report will include a description of the implementation, status
and quantitative effectiveness of the water conservation program. The report will be
submitted on a form provided by the City of Fort Worth.
CHAPTER 3 - EMERGENCY WATER DEMAND MANAGEMENT
Drought or a number of other uncontrollable circumstances c~n disrupt normal availability
of the City's water supply. Even though the City may have an adequate water supply, the
supply could become contaminated, or a disaster could destroy the supply.
This chapter summarizes the City's Emergency Water Demand Management (EWDM)
Plan. EWDM planning is not the same as conservation planning. While water
conversation involves implementing permanent water use efficiency or reuse practices, the
EWDM plan will establish temporary methods or techniques designed to be used only as
long as an emergency exists.
The City's EWDM plan will include the following six elements:
· Trigger conditions signaling the start of an emergency period.
· EWDM measures.
· Education and information.
· Initiation procedures.
· Termination notification actions.
· Means of implementation.

Trigger Conditions
The City receives a portion of its water from the City of Fort Worth (CFW) and will work
with the CFW to establish water restrictions during drought conditions. The establishment
of drought trigger conditions for the water supply are to be determined by the Tarrant
County Water Control and Improvement District No.1, initially. Trigger conditions will be
conveyed by CFW to the City. The City will be notified by telephone and a follow-up letter
or facsimile transmission as each drought trigger condition is reached. The notification will
include the steps the customer must take.
The City may need to implement an emergency water demand management program in
lieu of notification by the City of Fort Worth. In such cases, the trigger conditions will be
as follows:
1. Mild Conditions - Daily water demand reaches 80% of the production capacity of
the system for 3 consecutive days.
2. Moderate Conditions - Daily water demand reaches 90% of the production
capacity of the system for 3 consecutive days.
3.
Severe Conditions - Daily water demand reaches 100% of the production capacity
of the system for 3 consecutive days; or the imminent or actual failure of a major
component of the system is experienced which can cause an immediate health or
safety hazard; or a significant reduction in the production capacity of the system is
experienced.
Emergency Water Demand Management Measures
The City will implement the following measures for each level of severity as required by
the CFW or as implemented under its own emergency water demand management
program. The measures for each level of severity include the relevant requirements
imposed in the preceding level.

radio/television broadcasts. Throughout the period of a trigger condition, regular articles
and/or broadcasts will be used to inform the public of the current condition and
conservation measures for that condition.

Initiation Procedures
When a trigger condition has been reached and the CFW informs the City that EWDM
measures may be necessary, or the City initiates EWDM measures on its own accord, the
Mayor or the Mayor's duly appointed representative will order the initiation of a public
notification process. The public notification process will include a NOTICE OF DROUGHT
CONDITION to be posted at the North Richland Hills City Hall and at least two other public
places.
Termination Notification
Termination of the EWDM measures will take place when the trigger conditions which
initiated the contingency measures have subsided and/or the CFW informs the City that
drought contingency measures are no longer necessary. The public will be informed of
the termination in the same manner that they were informed of the initiation of the
measures through order of the Mayor or duly appointed representative.
Means of Implementation
The Mayor or duly appointed representative will be authorized by the City Council to order
the initiation of EWDM measures when a drought trigger condition occurs and/or the CFW
indicates that such measures are necessary.

APPENDIX B
WATER SAVING METHODS THAT CAN BE
PRACTICED BY THE INDIVIDUAL WATER USER
In-home water use accounts for an average of 65 percent of total residential use, while
the remaining 35 percent is used for exterior residential purposes such as lawn
watering and car washing. Average residential in-home water use data indicates that
about 40 percent is used for toilet flushing, 35 percent for bathing, 11 percent for
kitchen uses, and 14 percent for clothes washing. Water saving methods that can be
practiced by the individual water user are listed below.
Bathroom
1. Take a shower instead of filling the tub and taking a bath. Showers usually use
less water than tub baths.
2. Install a low-flow shower head which restricts the quantity of flow at 60 psi to no
more than 3.0 gallons per minute.
3. Take short showers and install a cutoff valve or turn the water off while soaping
and back on again only to rinse.
4. Do not use hot water when cold will do. Water and energy can be saved by
washing hands with soap and cold water; hot water should only be added when
hands are especially dirty.
5.
Reduce the level of the water being used in a bathtub by one or two inches if a
shower is not available.
6.
Turn water off when brushing teeth until it is time to rinse.
7.
Do not let the water run when washing hands. Instead, hands should be wet, and
water should be turned off while soaping and scrubbing and turned on again to
rinse. A cutoff valve may also be installed on the faucet.
8.
Shampoo hair in the shower. Shampooing in the shower takes only a little more
water than is used to shampoo hair during a bath and much less than shampooing
and bathing separately.
9.
Hold hot water in the basin when shaving instead of letting the faucet continue to
run.

10. Test toitetsfor leaks. To test for a leak, a few drops of food coloring can be
added to the water in the tank. The toilet should not be flushed. The customer
can then watch to see if the coloring appears in the bowl within a few minutes. If it
does, the fixture needs adjustment or repair.
11. Use a toilet tank displacement devise. A one-gallon plastic milk bottle can be
filled with stones or with water, recapped, and placed in the toilet tank. This will
reduce the amount of water in the tank but still provide enough for flushing.'
(Bricks which some people use for this purpose are not recommended since they
crumble eventually and could damage the working mechanism, necessitating a
call to the plumber.) Displacement devices should never be used with new low-
volume flush toilets.
12. Install faucet aerators to reduce water consumption.
13. Never use the toilet to dispose of cleansing tissues, cigarette butts, or other trash.
This can waste a great deal "of water and also places an unnecessary load on the
sewage treatment plant or septic tank.
14. Install a new low-volume flush toilet that uses 3.5 gallons or less per flush when
building a new home or remodeling a bathroom.
Kitchen
I. Use a pan of water (or place a stopper in the sink) for rinsing pots and pans and
cooking implements when cooking rather than turning on the water faucet each
time a rinse is needed.
2. Never run the dishwasher without a full load. In addition to saving water,
expensive detergent will last longer and a significant energy saving will appear on
the utility bill.
3. Use the sink disposal sparingly, and never use it for just a few scraps.
4. Keep a container of drinking water in the refrigerator. Running water from the tap
until it is cool is wasteful. Better still, both water and energy can be saved by
keeping cold water in a picnic jug on a kitchen counter to avoid opening the
refrigerator door frequently.
5. Use a small pan of cold water when cleaning vegetables rather than letting the faucet
run.
6. Use only a little water in the pot and put a lid on it for cooking most food. Not only

does this method save water, but food is more nutritious since vitamins and
minerals are not poured down the drain with the extra cooking water.

Use a pan of water for rinsing when hand washing dishes rather than running the
faucet.

Always keep water conservation in mind, and think of other ways to save in the
kitchen. Small kitchen savings from not making too much coffee or letting ice
cubes melt in a sink can add up in a year's time.
Laundry
1. Wash only a full load when using an automatic washing machine (32 to 59 gallons
are required per load.)
2. Use the lowest water level setting on the washing machine for light loads
whenever possible.
3. Use cold water as often as possible to save energy and to conserve the hot water
for uses which cold water cannot serve. (This is also better for clothing made of
to day's synthetic fabrics.)
Appliances and Plumbing
1.
Check water requirements of various models and brands when considering
purchasing any new appliance that uses water. Some use less water than others.
2.
Check all water line connections and faucets for leaks. If the cost of water is
$1.00 per 1,000 gallons, one could be paying a large bill for water that simply
goes down the drain because of leakage. A slow drip can waste as much as 170
gallons of water EACH DAY, or 5,000 gallons per month, and can add as much as
$5.00 per month to the water bill.

Learn to replace faucet washers so that drips can be corrected promptly. It is
easy to do, costs very little, and can represent a substantial amount saved in
plumbing and water bills.
4.
Check for water leakage that the customer may be entirely unaware of, such as a
leak between the water motor and the house. To check, all indoor and outdoor
faucets should be turned off, and the water meter should be chocked. If it
continues to run or turn, a leak probably exists and needs to be located.

1. Water lawns early in the morning during the hotter summer months. Much of the
water used on the lawn can simply evaporate between the sprinkler and the grass.
2. Use a sprinkler that produces large drops of water, rather than a fine mist, to avoid
evaporation.

Turn soaker hoses so the holes are on the bottom to avoid evaporation.
Water slowly for better absorption, and never water in high winds.
Forget about watering the streets or walks or driveways. They will never grow a
thing.
Condition the soil with compost before planting grass or flower beds so that water will

7. Fertilize lawns at least twice a year for root stimulation. Grass with a good root
system makes better use of less water.
8. Learn to know when grass needs watering. If it has turned a dull grey-green or if
footprints remain visible, it is time to water.
9. Do not water too frequently. Too much water can overload the soil so that air cannot
get to the roots and can encourage plant diseases.
10. Do not over-water. Soil can absorb only so much moisture and the rest simply runs
off. A timer will help, and either a kitchen timer or an alarm clock will do. An inch
and one-half of water applied once a week will keep most Texas grasses &Iive and
healthy.
11. Operate automatic sprinkler systems only when the demand on the town's water
supply is lowest. Set the system to operate between four and six a.m.

· 12. Do not -scalp laWns when mowing during hot weather. Taller grass holds moisture
better. Rather, grass should be cut fairly often, so that only 1/2 to 3/4 inches is
trimmed off. A better looking lawn will result.
13. Use a watering can or hand water with the hose in small areas of the lawn that need
more frequent watering (those near walks or driveways or in especially hot, sunny
spots).
14. Learn what types of grass, shrubbery, and plants do best in the area and in which
parts of the lawn, and then plant accordingly. If one has a heavily shaded yard, no
amount of water will make roses bloom. In especially dry sections of the state,
attractive arrangements of plants that are adapted to arid or semi-arid climates
should be chosen.
15. Consider decorating areas of the lawn with rocks, gravel, wood chips, or other
materials now available that require no water at all.
16. Do not 'sweep' walks and driveways with the hose. Use a broom or rake instead.
17. Use a bucket of soapy water and use the hose only for rinsing when washing the car.

WHEREAS, an easement was dedicated to the City (public) in the approved plat
of Lots 3R and 4R of Block 2, Walker Branch Addition to the City of North Richland
Hills, Tarrant County, Texas on January 8, 1996 which is filed in Cabinet A, Slide 2941,
Plat Records of Tarrant County, Texas; and
WHEREAS, the variable width utility easement shown on said plat does not
coincide with the actual placement of the existing water line across said tract; and
WHEREAS, the City Council of the City of North Richland Hills has been asked
to vacate the dedication of the said utility easement in said plat of January 8, 1996, in
exchange for newly executed easement showing the actual location of the City water
line which was intended to occupy said easement; and
WHEREAS, the owner of the said Lots 3R and 4R have executed a new
easement to replace the easement vacated herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
'OF NORTH RICHLAND HILLS, TEXAS, THAT:
1.
The dedication of the easement in the plat approved by the City Council on
January 8. 1996, which is described by metes and bounds on Exhibit "A" and "B",
attached hereto and made a part hereof, be and is hereby vacated in favor of the
owners of Lots 3R and 4R, Block 2 of Walker Branch Addition to the City of North
Richland Hills, Texas.

The utility easement signed by Robert A. McCauley II, Vicki L. Thornton
McCauley, and Power Play In-Line Hockey, L.P. dated September 23, 1996, be, and is
hereby accepted as a substitute for the easement vacated herein.

This remodel is required in order to accommodate the additional staff needed as a result of
the Crime Control District. Phase II of this project will be bid and submitted to Council for
approval at a later date.
KB. Alexander & Company met all the specifications and general conditions of the bid and
can complete the project within 20 days.
Recommendation: It is recommended City Council award the bid for the Police
Department Remodel, Phase I to KB. Alexander & Company in the amount of $17,158.

Thermoplastic Application System to be used by the Street division of the Public Works

This system consists of two therm~plastic pre-melters, one operator propelled applicator
and a transport trailer. The system will be used for the application of road markings instead
of using paint. This process will be more cost effective because it will not have to be done
as often.

deliver the equipment in six weeks.
Recommendation: It is recommended City Council award the bid for a Thermoplastic
Application System to Centerline Supply, Inc. in the amount of $32,377.

The bid submitted by San Antonio Ambulance Sales did not meet the minimum
specifications as requested. Southeastern Emergency Equipment met all the specifications
and general conditions of the bid and can deliver the gurneys in two weeks.
Recommendation: It is recommended City Council award the bid for ambulance gurneys to
Southeastern Emergency Equipment in the amount of $6,510.

Participation In Digital Orthophotography

Digital Orthophotography is a process of taking aerial photographs and converting the image to a
computer file. The resulting file is used as a background to all other GIS files. This process is
sufficiently accurate to update the existing basemap with new building locations.
Public Works initially discussed this concept with the City Council in January 1994 (IR 94-05).
The project was organized by the North Texas GIS Consortium. At that time, City Council was in
favor of participating in the project, with an initial cost not to exceed $5,000. This was a one time
purchase and did not commit the City to participate in future orthophotography. The aerial
photographs were subsequently taken and the computer tape was delivered in 1995.
The Consortium has completed the il}itial project and is now offering a "Maintenance Agreement"
to all original participants. The agreement would provide the City with updates as they occur.
The current work plan for the consortium includes new photographs and street centerlines every
two years. This is subject to change depending on the amount of development in any given area.
The annual fee has been established at $100 per map tile ($1,800 for North Richland Hills), with
additional areas available upon request.
Public Works and Information Services have discussed this and agree it is still the most cost
effective means of updating the GIS. Funding could be established as an Information Services
operating budget item and paid on an annual basis to the Consortium. Participation can be
terminated in the future if a better value becomes available.
Funding Source:
Sufficient funds are available in account #16-01-06-3445.
Recommendation:
Staff recommends Council authorize the Mayor to sign the maintenance agreement.
