PRESENTATIONS REGARDING LOW INCOME
HOUSING CREDITS HOUSING PROGRAM
A. LASALLE EQUITY - ROBERT SHERMAN
Mr. Sherman explained what they proposed to build at the site. Mr. Sherman presented
a site plan and floor plan for the units and explained the tax credits. Mr. Sherman
advised he would like to have a letter from the city in support of the units which would
give them more points.
B. FIRST WORTHING COMPANY - KELLER WEBSTER
Mr. Webster advised one of the requirements was that the City be notified on this type
of project. Mr. Webster presented the Council with a written report on the projects and
asked for the city's support.
27.
CITIZENS PRESENTATION
Mr. Curt Brannan, 7800 Mockingbird Lane #73, and Louise Shultz, 7800 Mockingbird
Lane #71, appeared before the Council.
Mr. Brannan advised he was the crime watch coordinator for LaCasita Mobile Home
Park. Mr. Brannan advised he wanted to make the Council aware of the excellent
program that Fireman Dean Bray and Elvira Rose did for the trailer park. Mr. Brannan
asked the Council to expand the fire safety program. Ms. Shultz expressed her
appreciation and advised they did a wonderful job and would like to see the program
extended.
Mr. Robert Southern, 7905 Briley, appeared before the Council. Mr. Southern asked
that the Council include the 6900 to 7100 blocks of Briley in the reconstruction of
streets on the bond program.
Mayor Brown advised that Briley had been included in the reconstruction bond issue.

AMEND THE MOTION ON ITEM NO. 11 TO INCLUDE BRILEY ON THE CIP LIST.
MOTION CARRIED 6-0.
Ms. Myrtis Byrd, 7312 Hialeah, appeared before the Council. Ms. Byrd advised the
Council that this City did not need any more apartments.
Councilman Garvin advised the property was already zoned for apartments and the City
could not stop them from building the apartments.
Mr. F.P. Green, 7008 Briley, appeared before the Council and requested that Briley be
included on the CIP list.

Ordinance No. 1999
Venture Stores is under contract to purchase and develop several parcels ofland generally located at the V-intersection of Grapevine
Highway and Davis Boulevard. The property is split between several zoning districts: LR Local Retail, C-1 Commercial, R-7-MF
Multi-Family Residential, and Planned Development Number 11. There are three parcels of property involved: the Rich1and Village
Shopping Center, the Royal Oaks Apartment complex, and a portion of North Hills Animal Clinic property. Each piece of land
carries a separate zoning designation, and the developer would like to combine the zoning into a single C-2 district. The developer
will submit a replat of the property to combine the several parcels into a single lot. Venture proposes to construct a large department
store on the property.
The Zoning Ordinance will require a masonry screening wall along the northern lot line where the proposed lot will abut a
residentially-zoned area. The lot will also be subject to a landscaping requirement of 15% of the lot area. Also, this site is
immediately adjacent to where two fly-over ramps from East Loop 820 and Highway 121 will exit onto Davis Boulevard. The ramps
are part of the Loop 820/Highway 121 interchange reconstruction.
The Planning and Zoning Commission considered this request at their July 28, 1994 meeting and recommended approval subject to a
requirement that no automotive repair or tire installation use be allowed within 100-feet of the north property line.
RECOMMENDATION:
It is recommended that the City Council hold the required Public Hearing and consider the recommendation of the Planning and
Zoning Commission.

AN ORDINANCE REZONING PROPERTY IN ACCORDANCE WITH ARTICLE 2, SECTION 200, OF
ZONING ORDINANCE NUMBER 1874, PASSED, APPROVED AND ADOPTED BY THE CITY
COUNCIL ON MARCH 22, 1993; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS
CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, after appropriate notice and public hearing, the following recommendation is submitted to the City Council of the City
of North Richland Hills, Texas, by the Planning and Zoning Commission; and
WHEREAS, the Planning and Zoning Commission of the City of North Richland Hills, Texas, has forwarded a recommendation to
the City Council for amendment of Ordinance No. 1874 and the Official Zoning Map by rezoning certain property; now therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS:

THAT, on Case Number PZ 94-11, the following property shall be rezoned from LR Local Retail, C-1 Commercial, R-7-MF Multi-
Family Residential, and a portion of Planned Development Number 11 to C-2 Commercial:
BEING a tract ofland in the W.W. Wallace Survey, Abstract Number 1606, Tarrant County, Texas, and being part of Block 2-R,
Richfield Place Commercial Addition, an Addition to the City of North Richland Hills as evidenced by plat recorded in Volume 388-
150, Page 39, Plat Records, Tarrant County, Texas; and being part of Lot 2, Block 25, Clearview Addition, an addition to the City of
North Richland Hills as evidenced by plat recorded in Volume 388-143, Page 59, Plat Records, Tarrant County, Texas; and being part

SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the section, paragraphs,
sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this

Ordinance No. 1998
Mr. Howard Stiles is the owner of a I-acre portion of land located in the 8900 block of Rum field Road, just east of Eden Road. Mr.
Stiles approached the City in March 1994 regarding constructing his house on the property. The I-acre portion is part of a larger 2.16
acre tract purchased by Mr. Stiles and his daughter.
There are several development issues related to this particular I-acre tract. The property has frontage on a private gravel road, which
will eventually become Rumfield Road as the road is extended to the east. The property is located over 300 feet from a sanitary sewer
line. Mr. Stiles will also have to plat the property before construction of a house can begin.
One of the major issues was the requirement that the lot front on a paved dedicated public right-of-way which is connected with an
existing paved public r.o.w. This would require that Mr. Stiles pave approximately 400 feet of an existing gravel road. One of the
purposes for a paved road is to provide an all-weather surface for emergency vehicle access. Mr. Stiles appeared before the City
Council regarding the paving requirement in May 1994. It was the consent ofthe Council that Mr. Stiles could develop the property
without being required to pave the roadway. Mr. Stiles was advised by staff that the next step would be to apply for a zoning change
and subdivision plat, provided that he executed a hold hannless agreement to relieve the City of any liability in the future should an
emergency vehicle be unable to access his property during inclement weather.
Mr. Stiles originally requested a zoning change from AG Agriculture to R-3 Single Family Residential. However, after discussion
with the Commission regarding future zoning in the area, the request was modified to R-2. The surrounding properties consist of
homes with acreage lots. The properties are mostly zoned AG and are unplatted tracts. Mr. Stiles has also submitted a Short Fonn
Final Plat of the property which is under review at this time.
The Planning and Zoning Commission considered this request at their July 28, 1994 meeting and recommended approval, subject to a
change to R-2 Single Family Residential zoning, with Mr. Stiles in concurrence.
RECOMMENDATION:
It is recommended that the City Council hold the required Public Hearing and consider the recommendation of the Planning and
Zoning Commission.

WHEREAS, after appropriate notice and public hearing, the following recommendation is submitted to the City Council of the City
of North Richland Hills, Texas, by the Planning and Zoning Commission; and
WHEREAS, the Planning and Zoning Commission of the City of North Richland Hills, Texas, has forwarded a recommendation to
the City Council for amendment of Ordinance No. 1874 and the Official Zoning Map by rezoning certain property; now therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS:

described by metes and bounds as follows:
COMMENCING at an iron rod in the South R.O. W. line of County Road No. 3050 (Kirk Road), said point being North 89 degrees 59
minutes West 960.9 varas, and North 00 degrees 08 minutes West 635 feet.2 feet from the Southeast comer of the S. Richardson
Survey;

My name is Howard D. Stiles, I h~ve lived in Irving, Texas since
1960. My wife and Iown a homp ;~. Irving that is paid for. I pastor
The Christ Gospel Church in ~urst:. Texas. I have served in this
capacity since 1980.
For some time my wife and I have desired to live in an area closer
to the church. We are in our late 50s and hope to, at least,semi-
retire in the next few years.
In~January this year our daughter, son in law, and their five children
purchased property located at 8916 Kirk Ln. in N.R. Hills. This property
was made up of a house, double garage, on 2.16ac of land. My daughter
and son in law purchased the house, and double garage, along with 1.16ac.
My wife and I purchased the remaining 1.0ac.
I sincerely petition the Ci':y of N.R. Hills and eacj official involved
in the building permit process to grant us a building permit to erect
4iÞ modest house of approximatel¥ 2,000 sq. fee; , on the 1.0 ac.
Weunderstand and appreciate the need for regulations and building codes.
I am sure they are implemented to promote a postive situation both for
the individual and City.
We ask you to please cnnsider our limited funds, as for as building or
paving a road. We: would like to dedicate our part that will be used
when Rumfield Rd. is eventually extended. Also when i+ is extended we
will pay our share for the footage that passes our property.
In addition~tothe exhibits I am sending to you, maybe I can also explain
~o some degree our situation. The black-top ends at the intersection
of Eden Rd. and Rumfield Rd..Humfield Rd. then continues p.as~ as a
gravel road passing our property approximately 45Cft~ from where the
black--top e~ds, I have use~ this road for several weeks.. The man that
lives at the end of the road, just east of our property has used the
gravel road for several years. Due to many years of use this gravel
road is very stable. I have seen everything from bicycles to heavy trucks
travel over it.
My son in law and daughter have agreed to give us an easement off Kirk Ln.,
should we need it.

and support the City in its endeavors to grow and enhance the tranquillity

for The Christ Gospel Church , located in Hurst, Texas since
1980.
For some time my wife and I have desired to live in an area closer
to the church. ~e are in our late 50s and hope to, at least semi-
~etire in ~he next few years.
!n January this year our daughter and family purchased property,
located at 8916 Kirk Ln. in N.R. Hills. This property originally
contained 2.16 Acres. My wife and I purchased 1.0 Acre of this
property.
I sincerly petition the City of N.R. Hills and each officiai .
involved in the building permit process to grant us a buildi~.g
permit to erect a modest house of approximately 2,000 sq. ft.
on the 1.0 Acre.
This letter realates specifically to conversationslhave had with
Mr. Greg Dickens and others, by telephone and personal visits.
6ur 1.0 Acre of land is located approximately 450ft. east of
Eden and Rurnfield Rd. intersection. The blacktop ends at this
intersection. Then Rumfield Rd. continues east as an old established
gravel road.
Irecieved a letter from Mr. Greg ~ickens dated March 9, 1994. listing
7 steps I would have to consider in order to platt the property.
I am enclosing my letter to Mr. 0ickens and also his reply to me.
After receving Mr. Dickens letter, Icame to visit with him personally
and we discussed the 7 steps. We agreed at this point, that the only
major obstacle to proceeding with the process, would be us having to
blacktop the road to my property. This is a major obstacle to us
because of limited finances.
Considering the cost of re-zoning approx. Three Hundred Dollars, water
service connection fees approx. One Thousand Dollars, percolation ~es~
approx. One Hundred Dollars, septic system approx. Two Thousand Dollars,
plus fees for other utitities. it puts us in a place fin~iall~. where
we are not able to ceme up with any,or at the very best, very little
toward expenses for the black·~o~.

I can appreciate your position as described in your letter dated March 2, 1994. Please
understand that I have not been given the authority to deviate from the City's ordinances. The
City Council is the only body that can authorize this type of deviation from the normal platting
process.
Listed below are the s~s and co~~ide!!tions you would have to make to plat the property.
The items with an asterisk are the considerations you do not meet and would have to expend
considerable money in order to comply.
1. The property would need to be rezoned.
2. The property would have to be platted and all required public right-of-way and
easements dedicated.
*3. All platted property must have a minimum of 50 feet of frontage on a dedicated public
right-of-way (ROW) which is connected to a public ROW with an existing public paved
street.

*4. A minimum of a 20 foot wide all-weather (asphalt or concrete) surface street must exist
or be installed in the ROW the property is adjacent to.
5. An 8-inch waterline exists on Kirk Lane adjacent to the north end of the referenced
tract and a 16-inch waterline exists adjacent to the south side of the tract. Water
service could be provided the proposed lot from either line after appropriate fees are
paid.
6. Public sanitary sewer lines exist further than 300 feet away, therefore if the lot size
platted is one acre or larger and the following requirements are met, a septic tank and
lateral field could be allowed with Council approval.
a. An adequate number of soil percolation tests would have to be conducted by a
qualified registered professional engineer. A copy of these test results would be
submitted to the Director of Public Works for review and approval prior to the
Planning & Zoning Commission's consideration of the plat.
b. The design and construction of the septic tank and lateral field would be in
accordance with the pertinent Tarrant County regulations. Plans sealed by a
registered professional engineer for the septic tank and lateral field would be
submitted to the Director of Public Works for review and approval.
7. Covenants concerning future cost participation for public street, sidewalk, masonry
wall, and sanitary sewer improvements would need to be signed prior to the Planning
& Zoning Commission's consideration of the plat. The covenants would grant the City
the right to file a lien on the property at the time the Council awards a contract for
construction of said improvements.
If after you have read this letter you still wish to pursue the possible platting of this property,
please contact me or Barry leBaron, Director of Planning & Inspection Services, to set up a
meeting. We can both meet with you and discuss in detail the procedure you would have to
follow to get this considered by the Council.

Billy and Rosaline Mitchell are the owners of a parcel ofland located in the 6700 block of Precinct Line Road. The owners have
submitted a Final Plat of the property for review by the City Council. The property is zoned R-2 Single Family Residential and will
contain 16 lots.
The following are the issues regarding this Final Plat:
I. This property is adjacent to Precinct Line Road, classified as a P6D Principal Arterial on the Master Thoroughfare Plan. The
Subdivision Regulations require a masonry screening wall along any residential lot adjacent to a C4U or larger roadway.
The developer will construct a masonry screening wall as required.
2. Sidewalks are required on each lot as the individual lot develops. The sidewalk adjacent to the masonry screening wall must
be installed at the time the wall is constructed by the developer.
3. A drainage and utility easement is located between Lots 7 and 8 to provide for stonn water runoff from this subdivision. An
overland concrete flume is included as part of the easement and will be constructed by the developer.
4. The Planning and Zoning Commission expressed concern over the proposed street name of' South Ridge Court', and the
possible confusion with a street by the same name in Hurst. In Hurst, 'South Ridge Court' is located on the south side of
Bedford-Euless Road, two blocks east of Precinct Line Road. The Commission recommended that the street name be
changed to Glenhaven Court. The owner has agreed to the name change.
The developer has responded to all engineering comments. The Planning and Zoning Commission considered this request at their
July 28, 1994 meeting and recommended approval subject to engineering comments and changing the name of the street to Glenhaven
Court.
RECOMMENDATION:
It is recommended that the City Council approve the recommendation of the Planning and Zoning Commission.

I have reviewed the subject documents submitted to this office on June 1, 1994, and offer the
following comments.
1. A section of the proposed 12-inch waterline adjacent to Precinct Line Road will need to
be located inside a 15-foot waterline easement. The waterline easement will need to be
filed by separate document. The easements with exhibits will need to be forwarded to
the Public Works Department for review and approval.
2. Street lighting is required by Section 1-06 of the Design Manual. Street lights which
may be required based on current ordinances need to be coordinated with Public Works
and TU Electric. The cost for installation of any additional street lights will be paid by
the developer directly to TU Electric.
3. The 15-foot drainage and utility easement between Lots 7 and 8 approved for the
preliminary plat needs to be increased to a 20-foot easement. The increase in easement
width is due to the addition of a concrete flume inside the easement.
4. There are comments regarding the engineering and construction recorded on a set of
blueline construction plans. The plans have been returned to the engineer for revision.
The comments contained herein do not purport to relinquish the design engineer of his
responsibility to provide adequate, accurate and buildable construction plans. The

Gehan Homes is the owner of two lots in the Coventry Place Estates subdivision. The lots are situated at the northeast comer of
Coventry Court and the proposed extension of Hightower Drive. The owner has submitted a Replat of the lots to combine them into
one single lot for the purpose of constructing a house.
The following are the issues regarding this Replat:
I. This property is adjacent to a future extension of Hightower Drive, classified as a C4U Major Collector on the Master
Thoroughfare Plan. The Subdivision Regulations require a masonry screening wall along any residential lot adjacent to a
C4U or larger roadway. The Public Works Department recommends a waiver of this requirement for this Replat. Hightower
Drive does not physically exist in the area, and there are no other masonry fences along this portion of the subdivision.
2. This property is zoned R-2 Single Family Residential. The Zoning Regulations require side or rear entry garages for any
new residential subdivision plat zoned R-I or R-2. The owner of the lot is requesting a waiver of this requirement so the
future house will match the existing houses in the area. Most of the houses in Coventry Place Estates have front-entry
garages.
3. Sidewalks are required on this lot as the lot develops.
The Planning and Zoning Commission previously conducted the Public Hearing required by Section 212.015 of the Texas Local
Government Code. The owner has responded to all engineering comments. This Replat is ready for the City Council's consideration.
The Planning and Zoning Commission considered this request at their July 28, 1994 meeting and recommended approval subject to a
waiver of the screening wall along future Hightower Drive, no access to this lot from future Hightower Drive, a covenant for
sidewalks along future Hightower Drive, and a waiver of the side or rear entry garage requirement. There was considerable
discussion regarding the side or rear entry garage requirement. The waiver was approved by a 4-2 vote.
RECOMMENDATION:
It is recommended that the City Council approve the recommendation of the Planning and Zoning Commission.

I have reviewed the subject documents submitted to this office on June 6, 1994, and offer the
following comments.
.
1.
The City has obtained a Global Positioning System (GPS) Horizontal Control Survey.
This survey was accomplished to create an accurate base map for the Geographical
Information System. City policy requires that all new plats be tied by survey to the GPS.
This will allow the City to keep the GIS up-to-date. The Public Works Department has
written descriptions for all of the GPS Benchmarks located around the City. The final plat
needs to include the NAD83 Texas State Plane Coordinates (in feet) for at least two
property comers. The coordinates need to be determined by a survey tied to the City's
GPS monuments.
2. The attached easement dedication needs to be incorporated into the closing paragraph after
the metes and bounds description.
3. Hightower Drive is designated as a C4U on the Master Thoroughfare Plan. This
designation requires a 68 foot ultimate right-of-way. Before it can be determined if
additional right-of-way will need to be dedicated, iron pins on both sides of Hightower will
need to be located and shown on the plat.

4. The Zoning Ordinance requires sidewalks adjacent to all public streets. The sidewalks
may be constructed with the improvement of each individual lot.
5. The plat will need to include the note shown on the review plat under the heading "plat
notes" .
6. A topographical drawing is required by the Subdivision Ordinance. This drawing needs
to be submitted with the replat. The drawing needs to include all permanent above ground
features as required by the Subdivision Ordinance. The drawing needs to include but not
limited to pavement, buildings, poles, sidewalks and contours. The drawing also needs
to indicate all existing underground utilities and services. If water and sewer service is not
currently provided, the services will need to come from Coventry Court.
7. The Subdivision Ordinance Regulations require masonry screening walls for plats adjacent
to C4U's or larger. Due to the location of the lot and adjacent building, Public Works
would recommend a variance for this lot.
8. There are comments regarding the plat recorded on a blueline copy of the plat. The
review plat has been returned to the engineer for revision. A written response will be
required for each comment.

I have reviewed your letter of June 24th, 1994 and respond to each item as follows:
1) We have tied into your GPS system and show data as required on the plat as resubmitted.
2) Language on plat as resubmitted.

3) Recorded information shows, as do we on our plat, that the right-of-way width for
Hightower is 68 feet. 38 feet of which is from our south property line to the centerline,
therefore regardless of future requirements we do not feel that any additional right-of-way
should be taken from our property.

Dear Mr. Husband:
The original plat for the above referenced subdivision had a statement that required the
referenced lot to have side or rear entry garages. We request a variance to allow front
entry for this replatted lot.
We are changing the orientation so that the house will now front on Coventry Circle rather
than Hightower Drive. It will also allow the house style to be consistent with the other
houses in the subdivision that are front entry. It will also be consistent with the houses
built on Lots 14R1, 15R1, and 16R1.
Enclosed with this letter are copies of the water and sanitary sewer layouts to assist the
Engineering Department in their review of the referenced replat.

To properly maintain safety, staff feels the section of Browning Drive, from it I S intersection with Rufe
Snow Drive west to its intersection with Industrial Park Boulevard, should be made a "No Parking" zone.
The daycare center located in the 6500 block of Browning Drive has expressed concerned for the safety of
people picking up or dropping off children. Several large trucks are periodically parked along this
section of Browning Drive, creating a traffic hazard to people pulling in or out at the daycare center. The
Police Department has reviewed the situation and agrees that a no parking zone is needed.
It is requested this be designated as a "No Parking Anytime" on both sides of the street.

In order to protect the health and safety of the City and its inhabitants, IT IS ORDAINED BY THE
CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, that:

It shall hereafter be unlawful for any person to park or leave unattended any motor vehicle at anytime
upon the public streets or portions thereof set out as follows:
a. Along the north and south sides of the 6500 through 6600 Blocks of Browning Drive from its
intersection with Rufe Snow Drive west to its intersection with Industrial Park Boulevard.
2.
It is ordered that appropriate NO PARKING ANY TIME signs are authorized and directed to be
installed upon the right-of-way of the above public street giving the public notice of these parking regulations.
3.
Any person violating any portion of this ordinance shall be deemed guilty of misdemeanor and fined

4.
This ordinance shall be in full force and effect from and after its passage and publication as provided
by law.

WHEREAS, the City Council has heretofore found that it is a public necessity to increase
the size of the City Hall building at 7301 N.E. Loop 820 which finding the Council here ratifies;
and
WHEREAS, it is a public necessity to procure four properties east of the present City Hall
in order to meet building and expansion plans for the City Hall; and
WHEREAS, the City has already been able to purchase two of the needed properties but
has been unable to purchase two of the properties need for expansion.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of North Richland
Hills, Texas, that:
1.
The Council declares that there is a public need to acquire two additional tracts of land for
expansion of the City Hall, to wit:
1. 4905 Marilyn Street - Lot 7, Block 32, Richland Terrace Addition
to the City of North Richland Hills, Texas
2.
5017 Cummings Drive - Lot 5, Block 32, Richland Terrace Addition
to the City of North Richland Hills, Texas

The Attorney for the City and the Director of Public Works is authorized to go forward

On October 11, 1993 the City Council approved an agreement for professional services with
Municipal Services Bureau for collection of outstanding warrants. As a part of the original
agreement, Municipal Setvices Bureau would receive 40% of the amount collected on warrants more
than 120 days old.
On August 1, 1994 the Court Clerk was able to negotiate a reduction in the amount collected by
Municipal Setvices Bureau. The attached letter from Municipal Services Bureau confirms that they
have agreed to a 25% fee on all warrants collected regardless of age. It is anticipated that this will
increase the revenues paid to the city as a result of this change.
RECOMMENDATION: It is recommended that the City Council approve this proposed
modification to the professional services agreement with Municipal Services Bureau.

Our consulting engineer is currently designing the relocation of Precinct Line Road water and sewer lines
for the City. The utility relocations will be done prior to the Texas Department of Transportation
(TxDOT) widening the first phase of Precinct Line Road from Grapevine Highway to the railroad
crossing. Trinity River Authority (TRA) has one 24-inch water transmission main which crosses under
Precinct Line Road to serve North Richland Hills. This main will need to be lowered to avoid conflict
with the drainage and street improvements proposed by TxDOT.
Since this is the only line relocation by TRA on this project and it serves North Richland Hills, TRA is
requesting the City include the 24-inch water main relocation in our Precinct Line Road Utility
Adjustments, Phase I project. TRA will reimburse the City 100% of the cost for relocating the water
main within 30 days of a "final accounting of costs" being furnished TRA.
The estimated cost for the relocation of the 24-inch water transmission main is $83,000.

Sufficient funds were budgeted for the Precinct Line Road Utility Adjustment project by Council in GN
89-04 on January 9, 1989. This amount will be adequate to cover the City fronting the $83,000 for the
TRA line adjustment.

CONSTRUCTION AGREEMENT

COUNTY OF TARRANT
THIS AGREEMENT is made and entered into as of the ~O?~ day of
, 1994, by and between the TRINITY RIVER AUTHORITY OF TEXAS, a
and reclamation district created by and functioning under Chapter
518, Acts of the 54th legislature of the State of Texas, Regular Session, 1955,
as amended, pursuant to Article XVI, Section 59 of the Texas Constitution
(hereinafter called "AUTHORITY"), and the CITY OF NORTH RICHlAND HIllS, TEXAS, a
municipal corporation of the County of Tarrant, State of Texas, (hereinafter
called "CITY").

WITNESSETH:
WHEREAS, the AUTHORITY owns and operates the Tarrant County Water Supply
Project (hereinafter called "TCWSP") which supplies water to the Cities of
Bedford, Colleyville, Euless and portions of North Richland Hills and Grapevine;
and
WHEREAS, the Water Transmission Main, Transfer Storage to Colleyville and
North Richland Hills (hereinafter called "PROJECT") provides water service to
the cities of Colleyville and North Richland Hills, and;
WHEREAS, the Texas Department of Transportation (hereinafter called
"TxDOT") has established the need to relocate a portion of this pipeline in
conjunction with proposed roadway improvements on F.M. 3029; and
WHEREAS, the CITY shall perform these necessary improvements to the
PROJECT, consisting of the relocation of the existing water transmission main
across F.M. 3209 in accordance with standard TxDOT specifications for
construction; and
WHEREAS, the AUTHORITY intends to reimburse the CITY'S cost for the
· PROJECT relocation across F.M. 3209 which is necessary to connect to the

existing main in the city and which the city will include in it's Precinct Line
Road utility adjustments, Phase I project; and
WHEREAS, the AUTHORITY and CITY desire to proceed with the construction of
the modifications to the PROJECT, subject to the terms and conditions to follow.
NOW, THEREFORE, in consideration of the mutual covenants and agreements
herein contained, the CITY agrees to construct the improvements to the PROJECT
in accordance with the AUTHORITY'S construction drawings and specifications, and
AUTHORITY agrees to pay the CITY upon terms and conditions hereinafter set
forth, to-wit:
Section 1. DEFINITION OF TERMS. Terms and expressions as used in the
Agreement, unless the context shows otherwise, shall have the following
meanings:
A.
"Construction" means anyone or more of the following:
(1) engineering, architectural, legal, title, fiscal, or economic
investigations or studies, surveys, designs, plans, working
drawings, specifications, acquisition costs of land, or other
necessary action; including administrative overhead;
(2) the expense of any condemnation or other legal proceeding
including the satisfaction of any final judgment as a result
thereof;
(3) erecting, building, acquiring, altering, remodeling, improving
or extending an interceptor, sanitary sewer or water supply project;
and
(4) the inspection or supervision of any items listed above.
B. "PROJECT" means the Water Transmission Main, Transfer Storage to
Colleyville and North Richland Hills.
C. "PROJECT COSTS" means all costs and expenses incurred in relation to
the construction of improvements to the PROJECT as are necessary
including without limitation for construction costs, costs of
machinery, equipment and other capital assets incidental and
relating to the construction of the improvements of the PROJECT.
Section 2. PROJECT SCOPE. For the convenience of the AUTHORITY, the CITY
will enter into such Contracts or Change Orders as are necessary to provide for

the administration, construction, and inspection of the improvements to the
PROJECT and said Contract or Change Orders shall be executed as required by laws
applicable to the CITY.
Section 3. CONDITIONS PRECEDENT. The obligation on the part of the CITY
shall be conditioned upon the following:
A. Preparation of design plans and specifications by the AUTHORITY for
the proposed relocation of the PROJECT across F.M. 3029.
B. The CITY shall perform bid advertisement, contract award, necessary
Change Orders, and construction in accordance with the relocation of the
Project across F.M. 3029.
C. The AUTHORITY shall obtain all easements necessary to construct the
PROJECT relocation.
D. The Authority shall reimburse 100% of the construction cost for the
PROJECT relocation across F.M. 3029 which is necessary to connect the
proposed relocated main to the existing main in the CITY limits.
E. The Authority shall reimburse the CITY for the Authority's share of
the cost of the PROJECT relocation in an amount estimated to be $83,000,
but not to exceed $88,000. If the bid exceeds $88,000, the CITY will not
accept the bid without prior approval of the AUTHORITY.
F. The AUTHORITY shall design and the CITY shall perform construction
of the PROJECT relocation across F.M. 3029 in accordance with TxDOT
standard specifications.
G. The CITY or its contractor is required to obtain all material, labor
and equipment necessary for the administration and construction of the
improvements to the PROJECT. The CITY shall perform inspection during
construction and shall permit the AUTHORITY to perform inspection during
construction, but all communications to the CITY'S contractor shall only
be made by the CITY.
H. The AUTHORITY'S review, approval or acceptance of, or payment for
any of the services shall not be construed to operate as a waiver of any
rights under this AGREEMENT or of any cause of action arising out of the
performance of this AGREEMENT, and the CITY shall be and remain liable in
accordance with applicable law for all damages to the AUTHORITY caused by

the omissions or negligent performance of any of the services furnished
under this AGREEMENT by the CITY or its Contractor.
I. The AUTHORITY shall pay to the CITY all PROJECT COSTS as hereinafter
specified.
Section 4. FISCAL PROVISION. For services to be rendered to the
AUTHORITY by the CITY hereunder, the AUTHORITY agrees to pay, at the time and
in the manner herein provided, all PROJECT COSTS associated with the PROJECT.
The AUTHORITY shall reimburse the CITY for the full amount of the actual
construction contract and Change Orders for the PROJECT relocation costs, as
stated in Section 3.0. Within thirty (30) days following completion of the
improvements to the PROJECT and its acceptance, the CITY will conduct a final
cost accounting of the PROJECT costs. The reimbursement due to the CITY shall
be made within thirty (30) days of the completion of the final accounting.
Section 5. FORCE MAJEURE. If by reason of force majeure either the
AUTHORITY or the CITY shall be rendered unable wholly or in part to satisfy its
obligations under this Agreement, then if either party shall give the other
party notice and full particulars of such force majeure in writing within a
reasonable time after occurrence of the event, the obligation, so far as it is
affected by such force majeure, shall be suspended during the continuance of the
inability then claimed, but for no longer period, and the party shall endeavor
to remove or overcome such inability with all reasonable dispatch. The term
"Force Majeure" as employed herein shall mean acts of God, strikes, lockouts, or
other industrial disturbances, acts of public enemy, orders of any branch of the
Government of the United States or the State of Texas or any civil or military
authority, insurrection, riots, epidemics, landslides, lightning, earthquakes,
fires, hurricanes, storms, floods, washouts, droughts, arrests, restraint of
government and people, civil disturbances, explosions, breakage or accidents to
machinery, pipelines or canals, or on account of any other causes not reasonably
within the control of the AUTHORITY or the CITY.
Section 6. TERM OF AGREEMENT; MODIFICATION; NOTICES.
A. TERM OF AGREEMENT. This Agreement shall be effective upon
execution hereof and shall continue in force and effect for a period of

one (1) year or until the improvements to the PROJECT are completed and
accepted by the AUTHORITY.
B. MODIFICATION. No change or modification of this Agreement shall be
made which will adversely affect the prompt payment when due of all moneys
required to be paid by AUTHORITY under the terms of this Agreement or the
work to be performed by the CITY.
C. NOTICE. All notices or communications provided for herein shall be
in writing and shall be either delivered to CITY or AUTHORITY, or if
mailed, shall be sent by certified mail, postage prepaid, addressed to
CITY or AUTHORITY at their respective addresses. For the purposes of
notice, the addresses of the parties shall until changed by written
notice, be as follows:

Ratify Contract for Asphalt Mi11ing

On streets included in the City's annual asphalt overlay program, the Public Works Department wants to
mill the first six feet of pavement adjacent to the lip of the gutter on both sides of the street. The milling
process removes approximately 3/4 inch to 1 inch of asphalt at the gutter edge. This allows the asphalt
overlay to be laid down to meet the gutter grade instead of being 3/4 inch too high. This will provide a
more stable edge for the overlay and will keep the edge from peeling off.
The City of Hurst took public bids in July for their annual milling program. The low bidder was Dustrol,
Inc. Their bid of $0.62 per linear foot is a resonable bid in staff's opinion. Last year's price was $0.75
per linear foot. We have received a quote from the same contractor, Dustrol, Inc. to do our 8,093 linear
feet for the same unit price. The total estimated cost is $5,017.66.
In order to expedite the process of bidding, staff has contracted with Dustrol, Inc., at the same unit price
as the City of Hurst. Construction is estimated to begin the week of August I, 1994.

Enclosed is one copy of Contractor's Partial Pay Estimate No.3 and Final, dated July 22,
1994 made payable to Jeske Construction Co., Inc. in the amount of $6,976.60, for
materials furnished and work performed on the referenced project as of July 20, 1994.
The quantities and condition of the project have been verified on··site by your representative,
Mr. Ken Matheson, as indicated by his signature on the estimate dated July 21, 1994, and we
have checked the item extensions and additions.
The original contract amount was $71.970.00, and Contractor earnings total $69,766.00
based on as-built quantities and contract unit prices. Contractor ,earnings are, therefore,
$2,204.00 under the Contract Amount. The savings results primarily from as-built concrete
channel liner quantities in the amount of 11.5 cubic yards under the original estimated
quantity of 320 cubic yards. The Contract Completion date was June 28, 1994, based on a
50 Calendar Day completion time, but the contractor was substantially complete on June 22,
1994, which is within the required contract period.
The two (2) year period of maintenance begins on this date, and therefore, will terminate on
July 28, 1996. The maintenance obligation includes repair of failures associated with
concrete flatwork and other concrete structures. In the absence (If any negative reports
concerning the condition of the project, and after the Contractor Ihas signed an Affidavit
stating that all bills and subcontractors have been paid, we recommend that this final
payment, in the amount of $6,976.60. be made to Jeske Construction Co., Inc. at P. O. Box
59025, Dallas, Texas 75229.
We will be present at the August 8, 1994, meeting to answer que:stions which the Council
may have concerning this project. Meanwhile, please call if we can be of further assistance.
