Motion carried 6-0. e e e July 25, 1994 Page 6 *25. PW 94-28 AWARD OF BID FOR INTERCHANGE WATER AND SANITARY SEWER ADJUSTMENTS, PHASE I APPROVED 26. PRESENTATIONS REGARDING LOW INCOME HOUSING CREDITS HOUSING PROGRAM A. LASALLE EQUITY - ROBERT SHERMAN Mr. Sherman explained what they proposed to build at the site. Mr. Sherman presented a site plan and floor plan for the units and explained the tax credits. Mr. Sherman advised he would like to have a letter from the city in support of the units which would give them more points. B. FIRST WORTHING COMPANY - KELLER WEBSTER Mr. Webster advised one of the requirements was that the City be notified on this type of project. Mr. Webster presented the Council with a written report on the projects and asked for the city's support. 27. CITIZENS PRESENTATION Mr. Curt Brannan, 7800 Mockingbird Lane #73, and Louise Shultz, 7800 Mockingbird Lane #71, appeared before the Council. Mr. Brannan advised he was the crime watch coordinator for LaCasita Mobile Home Park. Mr. Brannan advised he wanted to make the Council aware of the excellent program that Fireman Dean Bray and Elvira Rose did for the trailer park. Mr. Brannan asked the Council to expand the fire safety program. Ms. Shultz expressed her appreciation and advised they did a wonderful job and would like to see the program extended. Mr. Robert Southern, 7905 Briley, appeared before the Council. Mr. Southern asked that the Council include the 6900 to 7100 blocks of Briley in the reconstruction of streets on the bond program. Mayor Brown advised that Briley had been included in the reconstruction bond issue. e e e July 25, 1994 Page 7 *COUNCILMAN SIBBET MOVED, SECONDED BY COUNCILMAN GARVIN, TO AMEND THE MOTION ON ITEM NO. 11 TO INCLUDE BRILEY ON THE CIP LIST. MOTION CARRIED 6-0. Ms. Myrtis Byrd, 7312 Hialeah, appeared before the Council. Ms. Byrd advised the Council that this City did not need any more apartments. Councilman Garvin advised the property was already zoned for apartments and the City could not stop them from building the apartments. Mr. F.P. Green, 7008 Briley, appeared before the Council and requested that Briley be included on the CIP list. 28. ADJOURNMENT Mayor Brown adjourned the meeting. CITY OF NORTH RICHLAND HILLS Department: Planning and Inspections Council Meeting Date: 8/8/94 Subject: PlIhlic Hearin~ to consider the request of Venture Stores to rezone Agenda Number: Lot 2R1, Richfield Place Commercial; a portion of Lot 2, Block 25, Clearview Addition, and Tract 13F, Wallace Survey, A-1606, from LR Local Retail, C-1 Commercial, R-7-MF Multi-Family Residential, and PD-II to C-2 Commercial. (Located at the intersection of Grapevine Highway and Davis Boulevard) PZ 94-11 Ordinance No. 1999 Venture Stores is under contract to purchase and develop several parcels ofland generally located at the V-intersection of Grapevine Highway and Davis Boulevard. The property is split between several zoning districts: LR Local Retail, C-1 Commercial, R-7-MF Multi-Family Residential, and Planned Development Number 11. There are three parcels of property involved: the Rich1and Village Shopping Center, the Royal Oaks Apartment complex, and a portion of North Hills Animal Clinic property. Each piece of land carries a separate zoning designation, and the developer would like to combine the zoning into a single C-2 district. The developer will submit a replat of the property to combine the several parcels into a single lot. Venture proposes to construct a large department store on the property. The Zoning Ordinance will require a masonry screening wall along the northern lot line where the proposed lot will abut a residentially-zoned area. The lot will also be subject to a landscaping requirement of 15% of the lot area. Also, this site is immediately adjacent to where two fly-over ramps from East Loop 820 and Highway 121 will exit onto Davis Boulevard. The ramps are part of the Loop 820/Highway 121 interchange reconstruction. The Planning and Zoning Commission considered this request at their July 28, 1994 meeting and recommended approval subject to a requirement that no automotive repair or tire installation use be allowed within 100-feet of the north property line. RECOMMENDATION: It is recommended that the City Council hold the required Public Hearing and consider the recommendation of the Planning and Zoning Commission. Source of Funds: Bonds (GO/Rev.) That it is hereby declared to be the intention of the City Council that the section, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. (Located in the 8900 block of Rumfield Road) PZ 94-12 Ordinance No. 1998 Mr. Howard Stiles is the owner of a I-acre portion of land located in the 8900 block of Rum field Road, just east of Eden Road. Mr. Stiles approached the City in March 1994 regarding constructing his house on the property. The I-acre portion is part of a larger 2.16 acre tract purchased by Mr. Stiles and his daughter. There are several development issues related to this particular I-acre tract. The property has frontage on a private gravel road, which will eventually become Rumfield Road as the road is extended to the east. The property is located over 300 feet from a sanitary sewer line. Mr. Stiles will also have to plat the property before construction of a house can begin. One of the major issues was the requirement that the lot front on a paved dedicated public right-of-way which is connected with an existing paved public r.o.w. This would require that Mr. Stiles pave approximately 400 feet of an existing gravel road. One of the purposes for a paved road is to provide an all-weather surface for emergency vehicle access. Mr. Stiles appeared before the City Council regarding the paving requirement in May 1994. It was the consent ofthe Council that Mr. Stiles could develop the property without being required to pave the roadway. Mr. Stiles was advised by staff that the next step would be to apply for a zoning change and subdivision plat, provided that he executed a hold hannless agreement to relieve the City of any liability in the future should an emergency vehicle be unable to access his property during inclement weather. Mr. Stiles originally requested a zoning change from AG Agriculture to R-3 Single Family Residential. However, after discussion with the Commission regarding future zoning in the area, the request was modified to R-2. The surrounding properties consist of homes with acreage lots. The properties are mostly zoned AG and are unplatted tracts. Mr. Stiles has also submitted a Short Fonn Final Plat of the property which is under review at this time. The Planning and Zoning Commission considered this request at their July 28, 1994 meeting and recommended approval, subject to a change to R-2 Single Family Residential zoning, with Mr. Stiles in concurrence. RECOMMENDATION: It is recommended that the City Council hold the required Public Hearing and consider the recommendation of the Planning and Zoning Commission. The City has obtained a Global Positioning System (GPS) Horizontal Control Survey. This survey was accomplished to create an accurate base map for the Geographical Information System. City policy requires that all new plats be tied by survey to the GPS. This will allow the City to keep the GIS up-to-date. The Public Works Department has written descriptions for all of the GPS Benchmarks located around the City. The final plat needs to include the NAD83 Texas State Plane Coordinates (in feet) for at least two property comers. The coordinates need to be determined by a survey tied to the City's GPS monuments. 2. The attached easement dedication needs to be incorporated into the closing paragraph after the metes and bounds description. 3. Hightower Drive is designated as a C4U on the Master Thoroughfare Plan. The utility relocations will be done prior to the Texas Department of Transportation (TxDOT) widening the first phase of Precinct Line Road from Grapevine Highway to the railroad crossing. Trinity River Authority (TRA) has one 24-inch water transmission main which crosses under Precinct Line Road to serve North Richland Hills. This main will need to be lowered to avoid conflict with the drainage and street improvements proposed by TxDOT. Since this is the only line relocation by TRA on this project and it serves North Richland Hills, TRA is requesting the City include the 24-inch water main relocation in our Precinct Line Road Utility Adjustments, Phase I project. TRA will reimburse the City 100% of the cost for relocating the water main within 30 days of a "final accounting of costs" being furnished TRA. The estimated cost for the relocation of the 24-inch water transmission main is $83,000. '. . . .. .. · TRINITY RIVER AUTHORITY OF TEXAS CITY OF NORTH RICHlAND HIllS CONSTRUCTION AGREEMENT STATE OF TEXAS COUNTY OF TARRANT THIS AGREEMENT is made and entered into as of the ~O?~ day of , 1994, by and between the TRINITY RIVER AUTHORITY OF TEXAS, a and reclamation district created by and functioning under Chapter 518, Acts of the 54th legislature of the State of Texas, Regular Session, 1955, as amended, pursuant to Article XVI, Section 59 of the Texas Constitution (hereinafter called "AUTHORITY"), and the CITY OF NORTH RICHlAND HIllS, TEXAS, a municipal corporation of the County of Tarrant, State of Texas, (hereinafter called "CITY"). · WITNESSETH: WHEREAS, the AUTHORITY owns and operates the Tarrant County Water Supply Project (hereinafter called "TCWSP") which supplies water to the Cities of Bedford, Colleyville, Euless and portions of North Richland Hills and Grapevine; and WHEREAS, the Water Transmission Main, Transfer Storage to Colleyville and North Richland Hills (hereinafter called "PROJECT") provides water service to the cities of Colleyville and North Richland Hills, and; WHEREAS, the Texas Department of Transportation (hereinafter called "TxDOT") has established the need to relocate a portion of this pipeline in conjunction with proposed roadway improvements on F.M. 3029; and WHEREAS, the CITY shall perform these necessary improvements to the PROJECT, consisting of the relocation of the existing water transmission main across F.M. 3209 in accordance with standard TxDOT specifications for construction; and WHEREAS, the AUTHORITY intends to reimburse the CITY'S cost for the · PROJECT relocation across F.M. 3209 which is necessary to connect to the 1 . . . existing main in the city and which the city will include in it's Precinct Line Road utility adjustments, Phase I project; and WHEREAS, the AUTHORITY and CITY desire to proceed with the construction of the modifications to the PROJECT, subject to the terms and conditions to follow. NOW, THEREFORE, in consideration of the mutual covenants and agreements herein contained, the CITY agrees to construct the improvements to the PROJECT in accordance with the AUTHORITY'S construction drawings and specifications, and AUTHORITY agrees to pay the CITY upon terms and conditions hereinafter set forth, to-wit: Section 1. DEFINITION OF TERMS. Terms and expressions as used in the Agreement, unless the context shows otherwise, shall have the following meanings: A. "Construction" means anyone or more of the following: (1) engineering, architectural, legal, title, fiscal, or economic investigations or studies, surveys, designs, plans, working drawings, specifications, acquisition costs of land, or other necessary action; including administrative overhead; (2) the expense of any condemnation or other legal proceeding including the satisfaction of any final judgment as a result thereof; (3) erecting, building, acquiring, altering, remodeling, improving or extending an interceptor, sanitary sewer or water supply project; and (4) the inspection or supervision of any items listed above. B. "PROJECT" means the Water Transmission Main, Transfer Storage to Colleyville and North Richland Hills. C. "PROJECT COSTS" means all costs and expenses incurred in relation to the construction of improvements to the PROJECT as are necessary including without limitation for construction costs, costs of machinery, equipment and other capital assets incidental and relating to the construction of the improvements of the PROJECT. Section 2. PROJECT SCOPE. For the convenience of the AUTHORITY, the CITY will enter into such Contracts or Change Orders as are necessary to provide for 2 · · · the administration, construction, and inspection of the improvements to the PROJECT and said Contract or Change Orders shall be executed as required by laws applicable to the CITY. Section 3. CONDITIONS PRECEDENT. The obligation on the part of the CITY shall be conditioned upon the following: A. Preparation of design plans and specifications by the AUTHORITY for the proposed relocation of the PROJECT across F.M. 3029. B. The CITY shall perform bid advertisement, contract award, necessary Change Orders, and construction in accordance with the relocation of the Project across F.M. 3029. C. The AUTHORITY shall obtain all easements necessary to construct the PROJECT relocation. D. The Authority shall reimburse 100% of the construction cost for the PROJECT relocation across F.M. 3029 which is necessary to connect the proposed relocated main to the existing main in the CITY limits. E. The Authority shall reimburse the CITY for the Authority's share of the cost of the PROJECT relocation in an amount estimated to be $83,000, but not to exceed $88,000. If the bid exceeds $88,000, the CITY will not accept the bid without prior approval of the AUTHORITY. F. The AUTHORITY shall design and the CITY shall perform construction of the PROJECT relocation across F.M. 3029 in accordance with TxDOT standard specifications. G. The CITY or its contractor is required to obtain all material, labor and equipment necessary for the administration and construction of the improvements to the PROJECT. The CITY shall perform inspection during construction and shall permit the AUTHORITY to perform inspection during construction, but all communications to the CITY'S contractor shall only be made by the CITY. H. The AUTHORITY'S review, approval or acceptance of, or payment for any of the services shall not be construed to operate as a waiver of any rights under this AGREEMENT or of any cause of action arising out of the performance of this AGREEMENT, and the CITY shall be and remain liable in accordance with applicable law for all damages to the AUTHORITY caused by 3 . . . the omissions or negligent performance of any of the services furnished under this AGREEMENT by the CITY or its Contractor. I. The AUTHORITY shall pay to the CITY all PROJECT COSTS as hereinafter specified. Section 4. FISCAL PROVISION. For services to be rendered to the AUTHORITY by the CITY hereunder, the AUTHORITY agrees to pay, at the time and in the manner herein provided, all PROJECT COSTS associated with the PROJECT. The AUTHORITY shall reimburse the CITY for the full amount of the actual construction contract and Change Orders for the PROJECT relocation costs, as stated in Section 3.0. Within thirty (30) days following completion of the improvements to the PROJECT and its acceptance, the CITY will conduct a final cost accounting of the PROJECT costs. The reimbursement due to the CITY shall be made within thirty (30) days of the completion of the final accounting. Section 5. FORCE MAJEURE. If by reason of force majeure either the AUTHORITY or the CITY shall be rendered unable wholly or in part to satisfy its obligations under this Agreement, then if either party shall give the other party notice and full particulars of such force majeure in writing within a reasonable time after occurrence of the event, the obligation, so far as it is affected by such force majeure, shall be suspended during the continuance of the inability then claimed, but for no longer period, and the party shall endeavor to remove or overcome such inability with all reasonable dispatch. The term "Force Majeure" as employed herein shall mean acts of God, strikes, lockouts, or other industrial disturbances, acts of public enemy, orders of any branch of the Government of the United States or the State of Texas or any civil or military authority, insurrection, riots, epidemics, landslides, lightning, earthquakes, fires, hurricanes, storms, floods, washouts, droughts, arrests, restraint of government and people, civil disturbances, explosions, breakage or accidents to machinery, pipelines or canals, or on account of any other causes not reasonably within the control of the AUTHORITY or the CITY. Section 6. TERM OF AGREEMENT; MODIFICATION; NOTICES. A. TERM OF AGREEMENT. This Agreement shall be effective upon execution hereof and shall continue in force and effect for a period of 4 . . . one (1) year or until the improvements to the PROJECT are completed and accepted by the AUTHORITY. B. MODIFICATION. No change or modification of this Agreement shall be made which will adversely affect the prompt payment when due of all moneys required to be paid by AUTHORITY under the terms of this Agreement or the work to be performed by the CITY. C. NOTICE. All notices or communications provided for herein shall be in writing and shall be either delivered to CITY or AUTHORITY, or if mailed, shall be sent by certified mail, postage prepaid, addressed to CITY or AUTHORITY at their respective addresses. The milling process removes approximately 3/4 inch to 1 inch of asphalt at the gutter edge. This allows the asphalt overlay to be laid down to meet the gutter grade instead of being 3/4 inch too high. This will provide a more stable edge for the overlay and will keep the edge from peeling off. The City of Hurst took public bids in July for their annual milling program. The low bidder was Dustrol, Inc. Their bid of $0.62 per linear foot is a resonable bid in staff's opinion. Last year's price was $0.75 per linear foot. We have received a quote from the same contractor, Dustrol, Inc. to do our 8,093 linear feet for the same unit price. The total estimated cost is $5,017.66. In order to expedite the process of bidding, staff has contracted with Dustrol, Inc., at the same unit price as the City of Hurst. Construction is estimated to begin the week of August I, 1994. The two (2) year period of maintenance begins on this date, and therefore, will terminate on July 28, 1996. The maintenance obligation includes repair of failures associated with concrete flatwork and other concrete structures.
