HomeMy WebLinkAboutOrdinance 2112 ORDINANCE NO. 2112 WHEREAS, the City Council finds that it is in the interest of protection of the health and general welfare of the City and its inhabitants to adopt procedures, pursuant to the Transportation Code of the State of Texas, for the abatement and removal from private or public property or a public right-of-way of a junked vehicle or part of a junked vehicle as a public nuisance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, that: 1. The procedures set forth in section 683.074 of the Transportation Code of the State of Texas are hereby adopted. 2. The procedures set forth in section 683.075 of the Transportation Code of the State of Texas are hereby adopted. 3. Any public hearing requested pursuant to subchapter E of chapter 683 of the Transportation Code of the State of Texas (sec. 683.076 et seq) shall be conducted by the City Manager or an Assistant City Manager designated by the City Manager and will be known as the hearing officer in each designated case. After hearing, said hearing officer shall have the power to adopt or modify any previous order issued by a building official or inspector and shall have the power and authority to issue all orders necessary for the abatement and removal from private or public property of a junked vehicle or part of a junked vehicle. 4. A person who claims to be aggrieved by an order of the hearing officer shall have the right to appeal said Order to a District Court of Tarrant County within 15 days of the date of such order. The trial in the District Court will be conducted under the substantial evidence rule. 5. Any order of abatement, issued by the hearing officer, may be enforced by the building inspection department or the police department of the City. 6. If the terms of any other ordinance of this City conflict with the terms of this ordinance or the Transportation Code of the State of Texas, then in such event the terms of the Transportation Code and this ordinance shall govern. 7. Any person failing to timely comply with an order of abatement issued by a building official or a hearing officer, when it becomes final, shall be deemed guilty of a misdemeanor and fined not in excess of $200.00 a day.
