Mr. Phillip Pfeffer, representing Brown and Root, appeared before the Council in favor of the request. Council questioned the type of fence being proposed and if there were security reasons for the fence. Mayor Brown called for anyone wishing to speak in opposition to come forward. There being no one else wishing to speak Mayor Brown closed the Public Hearing. Councilman Oujesky moved, seconded by Mayor Pro Tem Johnson, to approve Ordinance No. 2060 with the stipulation that a chain-link fence or one of similar nature be required and the expiration date of the permit be May 31, 1996. GN 95-95 AMENDMENTS TO BUILDING CODE REGARDING FINISHED FLOOR ELEVATIONS FOR RESIDENTIAL PROPERTIES - ORDINANCE NO. 2053 APPROVED Councilman Wood moved, seconded by Councilman Garvin, to approve Ordinance No. 2053 with the following amendment: Section I, B1. first sentence changed to read "The grade away from a foundation wall on all sides except the front shall fall a minimum of six inches (6") within the first ten feet (10'). Where restricted...." Mr. Matt Speight, 5137 Davis Boulevard, appeared before the Council to voice several concerns about the proposed ordinance. July 24, 1995 Page 5 After discussion by the Council, Councilman Wood amended his motion and Councilman Garvin amended his second, to also state that exceptions to this policy would be handled on a case-by-case basis by the City Manager. Motion carried 7-0. 17. GN 95-96 APPROVAL OF CITICABLE CHARGES FOR SERVICE APPROVED Councilwoman Sansoucie moved, seconded by Councilman Sibbet, to approve GN 95- 96 with the addition that the policy be reviewed in six months and a cost comparison be made for the non-profit groups and that the last sentence in the second paragraph be deleted. Mayor Pro Tern Johnson thanked the Cable TV Board for their good work. Motion carried 7-0. 18. GN 95-97 PUBLIC HEARING - COMMUNITY DEVELOPMENT BLOCK GRANT - RESOLUTION NO. 95-39 APPROVED Ms. Monica Walsh, Assistant Parks and Recreation Director, presented the recommendations for the 21 st Year CDBG entitlement: the Bursey Road Senior Adult Center and a totally accessible playground for a neighborhood park on Glenview Road. Mayor Brown opened the Public Hearing and called for anyone wishing to speak to come forward. There being no one wishing to speak Mayor Brown closed the Public Hearing. CITIZENS PRESENTATION Mr. Cliff Stevens, 9201 Kirk Lane, appeared before the Council. Mr. Stevens introduced his daughter, Ms. Judy Simmons, who spoke on his behalf. Ms. Judy Simmons, Route 1, Box 535, Ponder, Texas, appeared before the Council. Ms. Simmons read a letter to the Council that expressed their concerns about potential flooding along Little Bear Creek due to the channeling of water into Little Bear Creek and the inadequate bridge at Kirk Lane. Mr. Glen Phillips, 8613 Terrell Drive, appeared before the Council. Mr. Phillips expressed his concern about the drainage of storm water in his area. Mr. Abel Lajoie, 7909 Precinct Line Road, appeared before the Council. Mr. Lajoie was concerned with the drainage of water into Little Bear Creek. Agenda Number: PZ 95-17 for a Special Use Permit for a Temporary Concrete Batching Plant on a portion of Tract 11, TK Martin Survey, Abstract 1055. (Located 300-feet east of the end of Pearl Street along the extension of Watauga Road.) Ordinance No. 2064 Duininck Bros. is the utility contractor for the Texas Department of Transportation's Watauga Road project. Duininck Bros. has applied for a Special Use Permit to allow a temporary concrete batching plant to be set up on the site for use in this project. The property is zoned 1-1 Light Industrial, and a Special Use Permit is required for this activity. The batching plant would occupy a site of approximately 40,000 square foot site on the property. The plant site,would be approximately 300-feet east of a single-family residential subdivision (Sunny Meadows). The purpose of the plant is to provide paving material for the extension of Watauga Road from Davis Boulevard to Precinct Line Road. The plant site is only accessible from the construction site as it does not abut any existing roadway. The surrounding residential subdivisions may see some minor impact in the form of dust, but the actual road construction project would most likely be the major source of airborne particles. ',-- The contractor has not stated a definite time period for the use of the plant. An expiration date for the special use permit should be included in the adopting ordinance. The Planning and Zoning Commission will consider this request at its August 10, 1995 meeting. The Commission's recommendation will be faxed to the Council on Friday, August 11. The plant will be located on the south side of the extension of Watauga Road. SITE CHARACTERISTICS: Vacant property. Some trees and bushes, but most of the property has been cleared for the road extension. PROPOSED USE: Temporary Concrete Batching Plant ALLOWED USE: Temporary Concrete Batching Plant allowed by Special Use Permit ADJACENT ZONING/LAND USES North South East West 1-1: vacant property 1-1: vacant property 1-1: vacant property, site of old Mangham airport 1-1: vacant property DRAINAGE According to Flood Insurance Rate Maps, this property does not lie within the 1 OO-year or 500- year flood plains. THOROUGHFARE PLAN Primary access to this property is from the future extension of Watauga Road, classified as a P6D Principal Arterial. LAND USE MASTER PLAN- The Comprehensive Land Use Master Plan calls for single family residential development in this area. This request is not consistent with the Plan, but the proposed use is tempo,rary in nature. ZONING HISTORY This property was initially zoned I Industrial in 1967. The zoning has remained the same since, but the designation became 1-1 Light Industrial when the new districts were created in 1984. ORDINANCE NO. 2064 AN ORDINANCE BY THE CITY OF NORTH RICHLAND HILLS, TEXAS, AMENDING ZONING ORDINANCE NUMBER 1874, THE COMPREHENSIVE ZONING ORDINANCE, TO AUTHORIZE SPECIAL USE PERMIT NUMBER TWENTY-FIVE FOR A TEMPORARY CONCRETE BATCHING PLANT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, after appropriate notice and public hearing, the following recommendation is submitted to the City Council of the City of North Richland Hills, Texas, by the Planning and Zoning Commission; and WHEREAS, the Planning and Zoning Commission of the City of North Richland Hills, Texas, has forwarded a recommendation to the City Council for amendment of Ordinance No. 1874 by authorizing Special Use Permit Number Twenty-Five, by changing said Zoning Ordinance as set forth herein; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: 1. THAT, Special Use Permit Number Twenty-Five (25) be hereby authorized for a Temporary Concrete Batching Plant as set forth in Case Number PZ 95-17 on the property described as follows: Being a 20,000 square foot portion of Tract 11, TK Martin Survey, Abstract 1055, North Richland Hills, Texas, at a site approximately 300-feet east of the end of Pearl Street, and being on the south side of the future extension of Watauga Road between Davis Boulevard and Precinct Line Road. 2. THAT, the development regulations contained in the 1-1 Light Industrial zoning district of Ordinance 1874 shall govern development on said property, except where amended below: 1. Building Localjons: Th~ quilding locations shall be in accordance with the site plan attached as Exhibit A. 2. Fence Required: A chain-link type security fence shall be provided around the bat~hing plant area. 3. THAT, all the regulations contained in the Zoning Ordinance No. 1874, as amended, which are not in conflict with the terms of this Special Use Permit, shall remain in full force and effect regarding this property. 4. EXPIRATION DATE This Special Use Permit Number Twenty-Five, for a Temporary Concrete Batching Plant, shall expire *****. All equipment and materials associated with this use shall be removed from the property by the expiration date. 5. SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the section, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. 6. Due to the significance of the outstanding items, we feel that this plat should not be placed on agenda for P & Z consideration. The following items are for your consideration: 1. The address and telephone numbers for the Owner, Engineer and Surveyor need to be added to the plat. 2. The appropriate signatures need to be added to the Owner's Acknowledgment and Dedication. 3. The City has obtained a Global Positioning System (GPS) Horizontal Control Survey. This survey was accomplished to maintain an accurate base map for the Geographical Information System. City policy requires that all new plats be tied by survey to the Texas State Plane Coordinates. This will allow the City to keep the GIS up-to-date. Item No.1 The Global PositiofÚng System, I understand your desire to have coordinates on all new sudivions in the City, although to do so on my lot I will have to nm a traverse over a Mile to meet this requirement. I feel that this distance is to far away for the size of this Replat of just one lot, in which I want to build my home. Item No.2 The C4U Thoroughfare plan. The 4 foot additional Right-of-Way. Indicated on the plat is more than adequate to meet your requirements without taking it out of only one lot. Item No.3. The Sidewalk ordinance. My lot is the only lot on the south side of the street that fronts Hightower Drive. I don't feel that this sidewalk would serve as a pedestrian walk~ay. Item No.4. The minimwn lot \Vidth Requirement. We recommended at that time that the plat be withheld from the P & Z Commission due to several significant items. There were 12 items listed in PWM 95-047. I subsequently met with the applicant to discuss the items in my letter. I explained that items such as sidewalks, fire hydrant coverage, right-of-way, and lot width could only be waived by City Council. On June 2, I received the applicants letter dated May 17, 1995 and a revised plat. The only apparent revisions made to the plat were regarding Items 4, 6 and a portion of 7. Those items corrected the Metes and Bounds description, added the building setbacks and added the zoning for Lots 14 through 16. The zoning shown is inaccurate. The zoning is actually R-3-1600. The surrounding lots are zoned R-2. Of the remaining items in PWM 95-047, Public Works is not opposed to waiving the request for GPS (Item 3) coordinates. This type of drainage has caused flooding problems in other parts of North Richland Hills. A grading plan with swales to drain the water to Hightower needs to be implemented prior to pouring a foundation. There may be existing water and sewer services to Lot 15 which should be capped and vacated with this plat. There may also be a need for the installation of new services. GIS indicates the closest fire hydrant to be approximately 200 feet west- northwest of Lot 14R. This fire hydrant is on the north side of Hightower and does not qualify as adequate fire protection. This is a statement of fact. Public Works would recommend that Lot 16 be denied future building permits until the lot is replatted to incorporate the remaining portion of Lot 15. Recommendations: 1. This plat should not be submitted to the Planning & Zoning Commission until Items 1 5 and 7 are revised. 2. If the remainder of Lots 9R and 10R have the same owner as the proposed 9R-2, then all of 9R and 10R need to be replatted at this time. The proposed lot should be labeled 10R-1 since 1 OR will have the least remaining area. 2. The appropriate signatures need to be added to the Owner's Acknowledgment and Dedication prior to filing. The City has obtained a Global Positioning System (GPS) Horizontal Control Survey. This survey was accomplished to create an accurate base map for the Geographical Information System. Department: Finance '- Subject: Consider Tax Rate for 1995/96 Fiscal Year Agenda Number: 8/14/95 GN 95-101 Council Meeting Date: In follow-up to the 1995/96 Budget Retreat, it is necessary to begin the procedures to establish a tax rate and approve the budget for the next fiscal year in accordance to the City's Charter and State law. The State "Truth and Taxation" laws require the City Council to vote on its intent to set the tax rate above 3% of the effective tax rate, and to record the vote of the Council on the intent to raise the tax rate. The Council consensus at the retreat was to set the tax rate for next fiscal year at 57¢, which is above the 3% notice requirement in the State law. Tberefore, it is necessary to obtain Council action of the intent to set the rate at 57 ¢. The 57¢ tax rate would be divided as follows: Debt Service 27.8234¢ 29.1766¢ Maintenance and Operations In addition to the Council voting on its intent to set the tax rate at 57¢, it is also necessary to have a separate public hearing on the tax rate itself since the 57¢ is more than 3% above the effective tax rate. A publication in the newspaper on the notice of the public hearing on the tax rate will be made in '.Ompliance with the state law on "Truth and Taxation" which requires specified sizes of publication notices, ''-'so you will possibly see these notices in the Fort Worth Star Telegram. It is suggested that the public hearing on the tax rate be on August 28, 1995. The formal adoption of an ordinance and tax rate for next year will be done at a later Council meeting after a public hearing is conducted on the budget itself. Recommendation: It is recommended that City Council take action to approve a proposed tax rate of 57¢ and to set a public hearing on the tax rate at 7:30 p.m. August 28, 1995. A publication notice will also be required for the public hearing on the budget as per the City Charter requirements and State law. This is a notice in the legal section of the newspaper. The proposed hearing for the budget is suggested for September 11, 1995. Page 1 of CITY OF NORTH RICHLAND HILLS '-.-- Department: Parks and Recreation Department Council Meeting Date: 8-14-95 Subject: Approving the ISTEA Enhancement Grant Agreement with Agenda Number: GN 95-,103 TxDOT For the Little Bear Creek Multi-Use Bike Trail Project Resolution No. 95-37 The City of North Richland Hills has been awarded a $2.4 million grant for development of the Little Bear Creek Multi-Use Bike Trail, along Little Bear Creek from the Northwest City Limit to Precinct Line Road. The City's share is $504,000. The Texas Department of Transportation is ready to proceed with the project. TxDOT will administer the grant application in accordance with the terms and conditions of the Grant Agreement. Upon adoption of the resolution approving the agreement, TxDOT requires 2% of the City's share, $10,080, to be deposited in an escrow account in order to begin work on the project. In the recently submitted Parks and Recreation Facility Development CIP, funding for the execution of the Grant Agreement is shown in the revised FY 94/95. Once the Grant Agreement is executed, a consultant will be selected in accordance with TxDOT policies and guidelines. Upon completion of the plans and specifications, the remainder of the City's share, $493,920, will be required by TxDOT. TxDOT will then bid the project and '.,.~- administer the construction contract. RECOMMENDATION: It is recommended that Council adopt Resolution No. 95-37 authorizing the execution of the Grant Agreement with the Texas Department of Transportation for the Little Bear Creek Multi-Use Bike Trail Project. The council suspended those rates for 90 days from May 25, 1995, in order to study the schedule. The City of Fort Worth has hired Bill McMorries, a rate consultant, to analyze the filing. His complete study was made available to us on July 14, 1995. We have coordinated our study efforts with the Public Utilities Supervisor in Fort Worth. However, the Fort Worth City Council has not acted upon McMorries' recommendation, so the City Council needs additional time to study the filing. Resolution No. 95-46 suspends the rates until August 29, 1995. We have a council meeting on August 28th. The possibility of placing a Crime Control and Prevention District before the voters has been brought to the forefront. Assistant City Manager R. C. Shiflet is, at the direction of the City Council, negotiating with Dr. Larry Hoover of Sam Houston State University to conduct this evaluation. Dr. Hoover heads the criminal justice programs for this university and is a recognized leader in criminal justice programs. We are proposing that he assemble a team of experts from his staff to conduct a full evaluation of the North Richland Hills Police Department programs, and prepare a written document outlining the needs of the police department during the life span of a Crime Control and Prevention District. Since an actual dollar amount for this study has not been confirmed staff is requesting authorization to enter into an agreement for this evaluation in an amount not to exceed $20,000. Upon completion of the evaluation, Dr. Hoover and his associates will deliver a report and a two year budget for a Crime Control District for the North Richland Hills Police Department to present to the voters. A letter of agreement will be executed between the City of North Richland Hills and Dr. Hoover outlining specific areas to be evaluated in a time period for the study to be completed. Upon completion of the evaluation Dr. Hoover will be available to present his findings to the City Council. The bids requested Vendors to quote on in-stock vehicles in six different colors. The results are outlined below. Five Star Ford $102,394 $103,312 Classic Chevrolet The vehicles quoted by Five Star Ford do not meet the minimum specifications in four areas; less horsepower, anti-lock brakes, tire size, vehicle color. The six vehicles offered by Ford are all the same color red. Because of the manner in which these vehicles will be used, it is important to have cars different in appearance. Also, the Equipment Services shop does not stock parts for Ford vehicles. The vehicles quoted by Classic Chevrolet are five different colors and all meet or exceed the minimum specifications. Each of the above described portions of sanitary sewer in the City of North Richland Hills, Texas, shall be improved by laying sanitary sewer main and laying sanitary sewer service line stubouts on proper grade and line, and setting manholes where same are not already so constructed, together with any necessary incidentals and appurtenances; all of said improvements to be constructed as and where shown on the plans in strict accordance with the plans and specifications therefore. V. After bids have been advertised as required by law, and the bid found to be the lowest and best bid for the construction of said improvements, the work of constructing said improvements and contract therefore shall be awarded for the prices stated in the proposal of said company as recorded and recommended by the City's Engineer, which said report and recommendation shall be on file with the City, the Mayor and City Secretary are hereby directed to execute the said contract in the name of the City of North Richland Hills, Texas, and to impress the corporate seal of the City thereon, the said contract embracing, among other things the prices for the work. VI. To provide for the payment of the indebtedness incurred by the City of North Richland Hills, Texas, by said contract, there is hereby appropriated out of available funds and current revenues of the City, an amount sufficient to pay said indebtedness so incurred. VII. The cost of said improvements as herein defined shall be paid for as follows, to wit: (a) Green Valley Drive from 730 feet east of Smithfield Road approximately 700 fe_et east towards Davis Boulevard in the City of North Richland Hills, Texas, the property abutting on that portion of the street to receive sanitary sewer improvements and the real and true owners thereof shall pay for these improvements at the appropriate rate of (see attached charts) linear front foot for all property fronting on said portion of street which in no way exceeds nine-tenths (9/10ths) of the estimated cost of the sanitary sewer improvements. (b) The City of North Richland Hills shall pay all of the remainder of the cost of said improvements after deducting the amounts herein specified to be paid by the abutting properties and the real and true owners thereof as set out above in subsection (a). Ordinance No. 2062 Page Three The amounts payable by the abutting properties and the real and true owners thereof shall be assessed against such properties and the real and true owners thereof shall constitute a first and prior lien upon such properties and a personal liability of the real and true owners thereof, and shall be payable as follows, to wit: When the improvements are completed and accepted by the City on a particular unit, the same assessed against property abutting upon such completed and accepted unit shall be and become payable in five (5) equal installments, due respectively on or before thirty (30) days, one (1), two (2), three (3), and four (4) years from the date of such completion and acceptance, and the assessments against the property abutting upon the remaining units shall be and become due and payable in installments after the date of completion and acceptance of such respective unit. The entire amount assessed against the particular parcels of property shall bear interest from the date of such completion and acceptance of the improvements on the unit upon which the particular property abuts at the rate of eight percent (8 %) per annum, payable annually except as to interest on the first installment, which shall be due and payable on the date said installment matures, provided that any owner shall have the right to pay any and all such installments at any time before maturity by paying principal, with interest accrued to the date of payment, and further provided if default be made in the payment of any installment promptly as the same matures, then at the option of the City of North Richland Hills or its assigns, the entire amount of the assessment upon which default is made shall be and become immediately due and payable; but it is specifically provided that no assessment shall in any case be made against any property or any owner thereof in excess of the special benefits to property in the enhanced value thereof by means of said improvements in the unit upon which the particular property abuts, as ascertained at the hearing provided by law in force in the City, nor shall any assessment be made in any case until after notice and hearing as provided by law. Said assessments against the respective lots and parcels of property and owners thereof shall be evidenced by certificates of special assessment which shall be executed in the name of the City of North Richland Hills, provided, however, that the City of North Richland Hills retains the right to authorize payment of the sums assessed against property abutting upon such completed and accepted unit in a period of not more than four (4) years in equal regular installments or not ress than TEN AND NO/100 DOLLARS each, the first of such installments to become due and payable not more than thirty (30) days after the completion and acceptance by the City of the particular unit, PROVIDED FURTHER, that such method of payments shall be authorized only in instances where the owner or owners of property abutting upon such completed and accepted unit shall have executed and delivered to the City of North Richland Hills, a lawful, valid and binding note and mechanic's and materialman's contract upon forms supplied by the City granting a mechanic's lien upon and conveying the said owner or owners according to the terms thereof of the sums assessed against such property. Ordinance No. 2062 Page Four VIII. The assessments against the respective lots and parcels of property and the owners thereof may be evidence by certificates of special assessment, which shall be executed in the name of the City by the Mayor of said City, and the City Secretary shall attest the same and impress the corporate seal of the City thereon, and which may have attached thereto coupons in evidence of the several installments, which the assessment is payable, which certificates shall be issued to the City of North Richland Hills, shall recite the terms and time of payment, the amount of assessment, the description of the property, and the name of the owners, as far as known, and shall contain such other recitals as may be pertinent thereto, and shall further recite substantially that all proceedings with reference to the making of such improvements have been regularly had in compliance with the law, and the prerequisites to the fixing of the assessment lien against the property described in said certificates and the personal liability of the owners thereof, have been regularly had, done and performed, and such recitals shall be prima facie evidence of the matters so recited, and no further proof thereof shall be required in court, and the certificates shall provide substantially that if default be made in the payment of any installment promptly as the same matures, then, at the option of the City of North Richland Hills, or its assigns, the entire amount of the assessment shall be and become immediately due and payable, together with reasonable attorney's fees and costs of collection, if incurred, all of which, as well as the principal and interest on the assessment, shall be first and prior lien against the property, superior to all other liens and claims except State, County, School District, and City ad valorem taxes. No error or mistake in naming any owner or in describing any property or any other matter or thing, shall invalidate any assessment or any certificate issued in evidence thereof, and the omission of improvements on any particular unit or in front of any property except by law from the lien of special assessment for sanitary sewer improvements shall not invalidate any assessment levied. The certificates referred to need not contain recitals in exactly the words above provided for, the substance thereof shall suffice, and they may contain other additional recitals pertinent thereto. IX. Thë City Engineer of the City of North Richland Hills, Texas, be and he is hereby ordered and directed to file with the City Council estimate of cost of such improvements in each unit. X. The City Secretary is directed to prepare, sign and file with the County Clerk of Tarrant County, Texas, a notice in accordance with the provisions of Texas Local Government Code, Title 13, Chapter 402, Subchapter D and amendments thereto. XI. The improvements provided for herein shall be made and constructed, notice give, hearing held and assessments levied and all proceedings taken and had in accordance with and under the terms of the powers and provisions of an Act passed at the First Called Ordinance No. 2062 Page Five Sessions of the Seventieth and Seventy-first legislature of the State of Texas, and knows as Chapters 149 and 1 , respectively, of the Acts of said Sessions, now being shown as Title 13, Chapter 402, Subchapter D, of the Texas Local Government Code, and under which law these proceedings are taken and had. XII. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council and by filing the complete Ordinance in the appropriate Ordinance Records of the City. The muni~ipal sewer extension project is estimated to begin mid summer of 1995 and is estimated to be completed within 9 to 12 months. The proposed sewer line will be located in Green Valley Drive. In order to estimate if the subject parcels will be enhanced after the extension of municipal sewer, the foll~wing data was considered. 1.) The first consideration was to locate an area within the city limits with sales of properties before and after municipal sewer was extended and compare these properties to determine if any enhancement is warranted. 2.) Locate a property that sold prior to and directly after municipal sewer was extended to that property to determine if municipal sewer adds any increment of value or not. Said hearing, be and the same is hereby, closed and the said protests and objections, and any and all other protests and objections, whether herein enumerated or not, be and the same are hereby, overruled. Ordinance No. 2063 Page Two II. The City Council, from the evidence, finds that the assessments herein levied should be made and levied against the respective parcels of property abutting upon the said portions of and public places and against the owners of such property, and that such assessments and charges are right and proper and are substantially in proportion to the benefits to the respective parcels of property by means of the improvements in the unit for which such assessments are levied, and establish substantial justice and equality and uniformity between the respective owners of the respective properties, and between all parties concerned, considering the benefits received and burdens imposed, and further finds that in each case the abutting property assessed is specifically benefitted in enhanced value to the said property by means of the said improvements in the unit upon which the particular property abuts and for which assessment is levied and charge made, in a sum in excess of the said assessment and charge made against the same by this ordinance and further finds that the apportionment of the cost of the improvements is in accordance with the law in force in this City, and the proceedings of the City heretofore had with reference to said improvements, and is in all respects valid and regular. III. There shall be, and is hereby, levied and assessed against the parcels of property hereinbelow mentioned, and against the real and true owners thereof (whether such owner be correctly named herein or not), the sums of money itemized below opposite the description of the respective parcels of property and the several amounts assessed against the same, and the owners thereof, as far as such owners are known, being as follows: See attached Exhibits. The actual assessment is shown on Exhibit "C". IV. Where more than one person, firm or corporation owns an interest in any property above described, each said person, firm or corporation shall be personally liable only for its, his or hers-pro rata õ(the total assessment against such property in proportion as its, his or her respective interest bears to the total ownership of such property, and its, his or her respective interest in such property may be released from the assessment lien upon payment of such proportionate sum. V. The several sums above mentioned and assessed against the said parcels of property, and the owners thereof, and interest thereon at the rate of eight percent (8%) per annum, together with reasonable attorney's fees and costs of collector, if incurred are hereby declared to be and are made a lien upon the respective parcels of property against which the same are assessed, and a personal liability and charge against the real and true owners of such owners be correctly named herein or not, and the said liens shall be and constitute the first enforceable lien and claim against the property on which such assessments are levied, and shall be a first and paramount lien thereon, superior to all other liens and claims, except State and County, School District and City valorem taxes. Ordinance No. 2063 Page Three The sums so assessed against the abutting property and the owners thereof shall be and become due and payable as follows, to wit: in five (5) equal installments, due respectively on or before thirty days (30), one (1), two (2), three (3), and four (4) years from the date of completion and acceptance of the improvements in the respective unit, and the assessments against the property abutting upon the remaining units shall be and become due and payable in such installments after the date of the completion and acceptance of such respective units, and shall bear interest from said date at the rate of eight percent (8%) per annum, payable annually with each installment except as to the first installment, which shall be due and payable at the maturity thereof, so that upon the completion and acceptance of the improvements in a particular unit, assessments against the property abutting upon such completed and accepted unit shall be and become due and payable in such installments, and with interest from the date of such completion and acceptance. Provided, however, that any owner shall have the right to pay the entire assessment, or any installment thereof, before maturity by payment of principal and accrued interest, and provided further that if default shall be made in the payment of any installment or principal or interest promptly as the same matures, then the entire amount of the assessment upon which such default is made shall, at the option of said City of North Richland Hills, or its assigns be and become immediately due and payable, and shall be collectible, together with reasonable attorney's fees and costs of collection incurred, PROVIDED, however, that the City of North Richland Hills retains the right to authorize payment of the sums assessed against property abutting upon such completed and accepted unity over a period of not more than four years in equal regular installments or not less than TEN AND NO/100 DOLLARS ($10.00) each, the first year installments to become due and payable not more than thirty days (30) after the completion and acceptance by the City of the particular unit, and PROVIDED FURTHER that such method of payment shall be authorized only in instances where the owner or owners of property abutting upon such completed and accepted unit shall have executed and delivered to the City of North Richland Hills granting a mechanic's lien upon and conveying to the said abutting property in trust to secure the payment of said owner or owners according to the terms thereof of the sums assessed against such property. VI. If default shall be made in the payment of any assessment, collection thereof shall be enforced either by the sale of the property by the City of North Richland Hills as near as possible in the manner provided for the sale of property for the nonpayment of ad valorem taxes, or at the option of the City of North Richland Hills, or its assigns, payment said sums shall be enforced by suit in any court of competent jurisdiction or as provided in any mechanic's or materialman's contract as foresaid, and said City shall exercise all of its lawful powers to aid in the enforcement and collection of said assessments. VII. The total amount assessed against the respective parcels of abutting property, and the owners thereof, is in accordance with proceedings of the City relating to said improvements and assessments therefore, and is less than the proportion of the cost allowed and permitted by the law in force in the City. Ordinance No. 2063 Page Four VIII. Although the aforementioned charges have been fixed, levied and assessed in the respective amounts hereinabove stated, the City Council does hereby reserve unto itself the right to reduce the aforementioned assessments by allowing credits to certain property owners where they are currently served by the public sanitary sewer system. Notwithstanding the City Council has herein reserved the right to issue credits as hereinabove provided, it shall not be required to issue such credits, and will not do so, if same would result in any inequity and/or unjust discrimination. The principal amount of each of the several assessment certificates to be issued the City of North Richland Hills, Texas, as hereinafter provided, shall be fixed and determined by deducting from the amount of any assessment, hereinabove levied such amount or amounts, if any, as may hereafter be allowed by the City Council as a credit against the respective assessments. IX. For the purpose of evidencing the several sums assessed against the respective parcels of abutting property and the owners thereof, and the time and terms of payment to aid in the enforcement and collection thereof, assignable certificates in the principal amount of the respective assessments less the amount of any respective credit allowed thereon, shall be issued by the City of North Richland Hills, Texas, upon completion and acceptance by the City of the improvements in each unit of improvement as the work in such units is completed and accepted, which certificates shall be executed by the Mayor in the name of the City and attested by the City Secretary, with the corporate seal of the City of North Richland Hills, or its assigns, and shall declare the said amounts, time and term of payment, rate of interest, and the date of completion and acceptance of the improvements abutting upon such property for which the certificate is issued, and shall contain the name of the owners, if known, description of the property by lot and block number, or front feet thereof, or such other descriptions as may otherwise identify the same; and if said property shall be owned by ãn estate: then the description of same as so owned shall be sufficient and no error or mistake in describing any property, or in giving the name of the owner, shall invalidate or in anyway impair such certificate, or the assessments levied. The certificates shall provide substantially that if same shall not be paid promptly upon maturity, then they shall be collectible, with reasonable attorney's fees and costs of collection, if incurred and shall provide substantially that the amounts evidenced thereby shall be paid to the City Secretary of the City of North Richland Hills, Texas, who shall issue his receipt therefore, which shall be evidence of such payment on any demand for the same, and the City Secretary shall deposit the sums so received in a separate fund, and when any payment shall be made to the City Secretary, upon such certificate shall, upon presentation to him of the certificate by the holder thereof, endorse said payment thereon. If such certificate be assigned then the holder thereof shall be entitled to receive Ordinance No. 2063 Page Five from the City Secretary the amount paid upon presentation to him of such certificate so endorsed and credited; and such endorsement and credit shall be the Secretary's Warrant for making such payment. Such payment by the Secretary shall be receipted for by the holder of such certificate in writing and by surrender thereof when the principal, together with accrued interest and all costs of collection and reasonable attorney's fees if incurred have been paid in full. Said certificate shall further recite substantially that the proceedings with reference to making the improvements have been regularly had in compliance with the law, and that all prerequisites to the fixing of the assessment lien against the property described in such certificate and the personal liability of the owners thereof have been performed, and such recitals shall be prima facie evidence of all the matters receipted in such certificates, and no further proof thereof shall be required in any court. Said certificates may have coupons attached thereto in evidence of each or any of the several installments thereof, or may have coupons for each of the first four installments, leaving the main certificate to serve for the fifth installment, which coupons may be payable to the City of North Richland Hills, or its assigns may be signed with the facsimile signatures of the Mayor and City Secretary. Said certificates shall further recite that the City of North Richland Hills, Texas, shall exercise all of its lawful powers, when requested to do so, to aid in the enforcement and collection thereof, and may contain recitals substantially in accordance with the above and other additional recitals pertinent or appropriate thereto; and it shall not be necessary that the recitals be in the exact form set forth, but the substance thereof shall be sufficient. The fact that such improvements my be omitted on any portion of any of said units adjacent to any premises except from the lien of such assessments shall not in anywise invalidate, affect or impair the lien of such assessment upon other premises. X. Full-power tõ make and levy assessments and to correct mistakes, errors, invalidities or irregularities, either in the assessments or in the certificates issued in evidence thereof,.is in accordance with the law in force of this City, vested in the City. XI. All assessments levied are a personal liability and charge against the real and true owners of the premises described, notwithstanding such owners may not be named, or may be incorrectly named. XII. The assessments so levied are for the improvements in the particular unit upon which the property described abuts, and the assessments for the improvements in any units are in no way affected by the improvements or assessments in any other unit and in Ordinance No. 2063 Page Six making assessments and in holding said hearing, the amounts assessed for improvements in anyone unit have been in nowise connected with the improvements or the assessments therefore in any other unit. XIII. The assessments levied are made and levied under and by virtue of the terms, powers and provisions of an Act passed at the First Called Session of the Seventieth and Seventy-first Legislature of the State of Texas, and known as Chapters 149 and 1, respectively, of the Acts of said Sessions, now being shown as Title 13, Chapter 402, Subchapter D, of the Texas Local Government Code. XIV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of North Richland Hills, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. The proposed fees have increased overall approximately 1 % to 2% on the average. The rates are still very reasonable. The funding source for this testing has been included in the Utility Operating Budget for 1995/96. STATEMENT OF SERVICES TO BE PÉRFORMED In order to discharge the responsibilities associated with the enforcement of Federal. State. and City regulations. the Receiving Agency requires services of a laboratory qualified to perform water and wastewater analysis. and of personnel to conduct industrial inspection and/or sampling services. such services detailed in Section A. Subsection(s) 1.2 & 3 . below. A. PERFORMANCE OF SERVICES 1. Industrial InsDection Services In keeping with the foregoing. the Receiving Agency employs the Performing Agency and the Performing Agency agrees to perform industrial inspection services within the parameters listed on the attached schedule sheet. The Performing Agency (Trinity River Authority of Texas) shall perform all Industrial Pretreatment Inspections. review permit applications and prepare for submittal Permits to DischarGe Industrial Wastes to the Sanitary Sewer in accordance with procedures established by the Trinity River Authority of Texas in accordance with 40 CFR Part 403.8. Industrial Pretreatment Inspections. Application reviews and Permit preparations and submittals shall be in compliance with the Receiving Agency's Industrial Waste Ordinances. Sewer Ordinances Numbers 1773 & 381 . and EPA General Pretreatment Regulations for Existing and New Sources. Records of Inspections. Applications and Permits shall be maintained as required by EPA General Pretreatment Regulations. 40 CFR Part 403.12. 2. Industrial SamDlinG Services In keeping with the foregoing. the Receiving Agency employs the Performing Agency and the Performing Agency agrees to perform industrial sampling services within the parameters listed on the attached schedule sheet and in accordance with the Receiving Agency's Industrial Waste Ordinances and Sewer Ordinances Numbers 1773 & 381 . The Performing Agency (Trinity River Authority of Texas) shall perform all sample collectlons. sample preservation. and maintenance of chain-of-custody records in accordance to the approved procedures set forth in Test Methods for EvaluatinG Solid Waste. EPA Manual SW-846. Methods for Chemical Analysis of Water and Wastes. EPA Manual EPA-600/ 4-79-020. and the Handbook for SamDlinG and SamDle Preservation of Water and Wastewater. EPA Manual EPA-600/4-82-029. The samples shall be properly collected. preserved and delivered by the Performing Agency to the Performing Agency's laboratory located at 6500 West Singleton Blvd.. Grand Prairie. Texas. When feasible flow or time composited sampling will be conducted. When composited sampling is not feasible. grab sampling will be appropriate. 3. Analytical Services In keeping with the foregoing. the Receiving Agency employs the Performing Agency and the Performing Agency agrees to perform analytical services within the parameters listed on the attached schedule sheet. The Receiving Agency estimates an average of 85 samples per month will be collected and delivered to the laboratory for analysis. It is understood that these samples will be properly collected and preserved in accordance with applicable sections of A Practical Guide to Water Quality Studies of Streams. Federal Water Pollution Control Administration publication and Methods for Chemical Analysis for Water and Wastes. EPA manual. as well as the latest edition of Standard Methods for the Examination of Water and Wastewater. A chain-of- custody procedure shall be maintained in the field and the laboratory in accordance with procedures to be established by the Receiving Agency. The Receiving Agency will furnish chain-of-custody tags. The Performing Agency (Trinity River Authority of Texas) will perform all analyses according to the approved procedures set forth in Standard Methods for the Examination of Water and Wastewater. current edition or the latest edition of Methods for Chemical Analysis of Water and Wastes. EPA-manual. Samples will be analyzed by these methods on the production basis. to include appropriate analytical quality assurance procedures. Records will be kept for documentation of the Performing Agency's quality assurance program and copies will be available to the Receiving Agency upon request. Unusual interferences and problems will be reported to the Receiving Agency at its authorized address noted above. Research into specific techniques to overcome these difficulties will be undertaken when practical. and by mutual agreement. The sample information sheet submitted with each sample will designate the particular analysis or analyses to be made of each sample submitted. The laboratories will be operated in such a manner as to insure the legal sufficiency of the sample handling; analytical and reporting procedures; and to remedy effects in the procedures should such be discovered. The various laboratory personnel shall be directed upon receipt of written notice from the Receiving Agency 72 hours in advance. to appear and testify in enforcement actions. In such event. travel and per diem expenses for such employees shall be paid by the Receiving Agency. Travel and per diem for court appearances hereunder shall be based on current State laws. Receiving Agency may deliver to Performing Agency samples for analysis separate and apart from those samples collected by the Performing Agency. When the Receiving Agency delivers samples to the Performing Agency for analysis. the Receiving Agency shall indicate the nature and extent of the analyses it desires to be conducted. Performing Agency shall not be responsible for the manner of collection or chain-of-custody tags or sheets which are matters entirely outside Performing Agency's control. Performing Agency shall receive. log and perform such analyses of samples in accordance with that part of the chain-of-custody procedures identified as Transfer of Custody and ShiDment attached hereto. Samples analyzed to maintain the normal quality assurance program which the Performing Agency presently maintains in its laboratory will be charged to the Receiving Agency at the same rate as submitted samp ìes . B. TERMINATION Either party to this Contract may terminate the Contract by giving the other party thirty (30) days notice in writing at their authorized address as noted previously. Upon delivery of such notice by either party to the other and before expiration of the thirty (30) day period. the Performing Agency will proceed promptly to cancel all existing orders. contracts. and obligations which are chargeable to this Contract. As soon as practicable after notice of termination is given. the Performing Agency will submit a voucher for work performed under this Contract through its termination. The Receiving Agency will pay the Performing Agency for the work performed less all prior payments. Copies of all completed or partially completed reports. documents. and studies prepared under this Contract will be delivered by the Performing Agency to the Receiving Agency when and if this Contract is terminated prior to the completion of the prescribed work. C. AMENDING THE CONTRACT The parties hereto without invalidating this Contract may alter or amend this Contract upon advance written agreement of both parties to exclude work being performed or to include additional work to be performed and to adjust the consideration to be paid hereunder by virtue of alterations or amendments. III. BASIS FOR CALCULATING REIMBURSABLE COSTS The financial basis for calculating reimbursable costs shall be as stated in Attachment A. The expenditures by the Trinity River Authority of Texas of funds paid to it under this Contract shall be subject to such State or Federal audit procedures as may be required by law and-by accepted practices of the State or Federal auditor. or both. if requested. The Trinity River Authority of Texas shall be responsible for maintaining books of account that clearly. accurately and currently reflect financial transactions. The financial records must include all documents supporting entries on the account records which substantiate costs. The Trinity River Authority of Texas must keep the records readily available for examination for a period of three (3) years after the close of the last expenditure. Reimbursement for the inspection. sampling. and/or analytical costs. and cost for any travel and per diem expenses shall not exceed Fifteen Thousand dollars ($ 15,000.00 ) for the period of this Contract. IV. CONTRACT AMOUNT The total amount of this Contract shall not exceed Fifteen Thousand dollars ($ 15,000.00 ) nor be less than One Hundred dollars ($ 100.00 ). V. PAYMENT FOR SERVICES The Performing Agency shall bill the Receiving Agency monthly for services performed. Charges for these services shall be based on the attached cost schedules. The Receiving Agency shall pay the monthly billings of the Performing Agency within thirty (30) days of their receipt. VI. Stream and effluent samples should be obtained using standard field sampling techniques and preservation procedures. 3. Material Sampled. and Method of Preservation must be completed by the field personnel collecting the sample. In completing the Chain-of-Custody tag or sheet. care should be utilized to insure that all necessary information is correctly and legibly entered onto the form. A black ballpoint with water proof ink should be used at all times. Transfer of Custody and Shioment 1. All samples should be handled by the minimum possible number of persons. 2. All incoming samples shall be received by the custodian. or his alternate. and logged into a record book (log book). Information to be entered into the Log Book shall include the sample number. date received. source. time(s) sampled. date(s) sampled. and analyses requested. 3. Promptly after logging. the custodian will distribute the sample to an analyst or place the sample in the sample room. which will be locked at all times except when samples are removed or replaced by analysts. 4. The custodian shall ensure that heat-sensitive samples. or other sample materials having unusual physical characteristics. or requiring special handling. are properly stored and maintained. 5. Samples shall be kept in the sample storage security area at all times when not actually being used by analysts. such as during overnight absences. 6. The analysis sheet will be signed and dated by the person performing the tests and retained as a permanent record in the laboratory. . 7. Bradley: Tlús proposal is based on the understanding that the interest to be acquired for the right-of-way of the above referenced project consists of the fee simple interest in eleven (11) parcels ofland, along 'With the associated temporary construction easements and also securing two (2) temporary construction easements. This bid is made upon the acceptance of the following conditions: 1. The City of North Richland Hills will provide for the necessary surveying, engineering, and legal support to prepare the legal documents for the proposed right-of-way acquisition whether by negotiation or conderrmation. 2. The_City will b~ responsible for all required coordination with the title company or title attorney, and for the title investigation necessary to provide K. H. Flower with the names and addresses of the parties whose signatures are required for conveyance of the interest which- the City requires. 3. The City will provide a copy of a current title commitment to K. H. Flower. The City will also perform the necessary work and coordination with the engineers or those necessary to detennine whether existing easements affect the title to be acquired and to take whatever action may be necessary to extinguish these easements whenever appropriate. 4. The City will be responsible for title curative work and for providing this curative information to the title company or title attorney. 5. The City will be responsible for engaging the services of a qualified appraiser and providing K. H. Contact each land owner or their authorized representative, a minimum of three (3) times to negotiate the purchase of each parcel. 2. Prepare the necessary correspondence to confinn personal negotiations, secure the signatures of the parties identified by the City, obtain tenant releases as required, and submit this information to the City, title company, or title attorney for the closing of the transaction. 3. Obtain a partial release from all lienholders, of record, on a fonn prepared by the City's attorney or legal representative. 4. Upon failing to satisfactorily negotiate to a successful conclusion on any parceL I will prepare and mail a "[mal offer" letter, at the direction of the City, to the lando~'Iler(s) in order to initiate condemnation proceedings. All the above services will be performed and documented in a professional manner for a fee of $4,875.00 total (see attached Exhibit A). This fee does not include any costs paid for the property acquired, title expenses, condemnation support services, attorney expenses, court costs, or any cost of services to be performed by the City of North Riclùand Hills. The attached interlocal agreement covers the coordination and the reimbursement by North Richland Hills to Watauga within a 20-day period. Estimated cost of the water main is $45,000. Funding Source: The City of Watauga does not plan to reconstruct the street and water main until sometime in calendar year 1996. NOW THEREFORE, the parties agree as follows: 1. The attached proposal from Dustrol, Inc. covers this service. The cost is $1.20 per linear foot for 8,000 estimated feet. The price is more than the previous unit price Dustrol, Inc. charged for the work done in June 1995, but this is due to a smaller amount of milling work and the contractor trying to recover move-in cost. This is an emergency approval request due to the time limitations involved. Funding Source: Sufficient funds were budgeted in the Overlay Program for 1995 (PW 95-06). North Richland Hills Public Works personnel were contacted and repaired the leak. The street pavement removed to fix the leak was replaced by North Richland Hills. Shortly after this the City of Watauga tried to contact Public Works concerning further pavement repair being necessary due to the leak. Prior to making contact, Watauga's Public Works Director was forced to repair the street. The total cost for repair was $17,118.00. We have since met and discussed the situation. It was agreed that North Richland Hills should consider paying $8,929.69 for the materials used. Funding Source: Sufficient funds are available in the operating budget, account #02-11-01-3080. Under an agreement between the contractor and the City Manager, the contractor quickly moved in and repaired the channel liner and made some minor additions to help protect against this damage happening again. The contractor provided the equipment and labor and we agreed to pay for the materials. The estimated cost was $40,000. The final invoice from Orval Hall Excavating Co. only totaled $9,294.80. It was paid in July 1995. Funding Source: Cost was charged to account #01-60-04-3080, along with other storm damage repair costs. Recommendation: Staff recommends Council ratify final payment of $9,294.80 to Orval Hall Excavating Co. for concrete channel liner repair on the Calloway Branch west bank, north of Lola Drive. Construction began in October, 1994 and was substantially complete in time for the scheduled June 1, 1995 opening. The City Council awarded the contract to Craig, Sheffield and Austin, Inc. In the amount of $6,903,000. Six change orders have been executed to date bringing.the revised contract amount to $6,654,078. The contractor is requesting final payment in the amount of $182,324. This includes their retainage and a final change order for additional work necessary to complete the expansion of Highway 26 required by TxDOT, additional sod and mulch needed to eliminate soil erosion and run-off into the Endless River, additional slide tower lighting as previously approved, and the Dr. Pepper Picnic area outside the park grounds (funded by Dr. Pepper). Additional work was based on unit prices bid as a part of the construction contract. This final change order is $61,046. Total change orders to the project represent 1.8% of the total project cost. RECOMMENDATION: It is recommended that the City Council approve the final change order payment to Craig, Sheffield and Austin, Inc.
