Subject: Implementation of a Test Period for Police Motorcycles
With the City Manager's approval, the Police Department will begin a test period
regarding the use of marked, Police Motorcycles for traffic enforcement/control.
This test will begin on Friday, April 23,1993 and will overlap the current
budget process. Due to this overlap, no Decision Package will be submitted to
the Council since results of the test will not be available in time to report to
the City Manager so he may consider it for the budget cycle.
At the budget retreat, sufficient information should have been collated to
permit the Mayor and Council to determine if this program is to be funded for
the upcoming fiscal year.
The increased number of traffic complaints throughout the city, as well as an
inability to maneuver full sized cars on our congested streets, has led us to
believe that the need for this type of enforcement/control tactic is needed.
The test period will allow us to measure its success.
The Personnel Director has approved the' addition of the motorcycles to our
insurance during the course of the test period.
The only expense to the City will be reimbursement at our current rate for
m; 1 eage to the offi cers who own the motorcycl es and the insurance exposure
mentioned above.

SUBJECT: Implementation of Police Motorcycles (Interim Approach)
On March 30, 1993, Sgt. N. W. Craven and I had a conversation involving the use of
motorcycles in our traffic enforcement duties. We currently have several traffic related projects
that cause us great difficulty without the use of motorcycles in our plan. Various 5K and 10K
runs are scheduled for the next few months which will necessitate our implementing a plan of
"floating perimeter" so the runners will be assured some measure of safety. The use of patrol
cars in this scenario is difficult due to the number of cars that would have to be utilized. The
motorcycles can "float" from position to position easily due to their high maneuverability.
In addition to the runs mentioned above, we are receiving many complaints of various traffic
related problems in areas of the City where the maneuverability of a patrol car makes it
impractical and/or dangerous to provide enforcement.
Sgt. Craven was given approval to approach you, in my absence, on Wednesday, March 31,
1993, and attempt to obtain your approval to implement motorcycles on an "as needed" basis. I
concur with Sgt. Craven's concerns and his attempt to begin the program on an interim basis
pending the outcome of the budget process for fiscal 1993-94. The Department of
Transportation STEP grant for "Occupant Protection" (Seat Belts) gives us the opportunity to
provide the proper fonnat for introduction of the motorcycles into our enforcement scheme.
It should be noted that the use of the motorcycles is also in tune with my plans regarding the use
of these vehicles for enforcement. When you assigned me to the Unifonned Services Division, I
spoke with you and Assistant Chief R. C. Shiflet about my finn belief that we were 1 to 2 years
away from the use of motorcycles, depending on the continued growth of the city, the increase in
traffic problems and the rate \vhich our road\vays were to begin reconstruction.
If we can get coverage on the City's insurance to cover the motorcycles, I would like to begin
utilizing them immediately. The only cost that I am personally concerned about, on behalf of the
officers involved, is that of the fuel to operate the cycles. Based on Sgt. Craven's input, I believe
the gasoline costs to operate the motorcycles will be approximately $20.00 per week. I realize
that Sgt. Craven and Officer Pratt are willing to donate the use of the motorcycles to begin this
program, but I would appreciate your consideration on the fuel aspect if it is possible. If not, we
can begin the program and the officers have stated they are willing to donate the fuel as well.
I appreciate your consideration in this matter and will await your final decision.

I request that, based on the attached memorandum, Sergeant N. R. Craven
and Officer J. R. Pratt be provided insurance on both motorcycles
(through our self insurance plan) and that I be permitted to have them
use their motorcycles "on-duty" at a rate in compliance with our
personal - vehicle use policy. This is an interim measure only, that
will terminate on 10-1-93 unless our Council chooses to specifically
authorize police motorcycles for the upcoming fiscal year.
If you wish more information than is provided in this and Captain
Shockley's memo please advise, we'll be glad to provide it.

Bursey Road Senior Adult Center Parking Lot
On April 12, 1993 Council approved the acquisition of approximately
one acre of land for the parking lot project at the Bursey Road
Senior Adult Center. Staff has requested the 18th Year CDBG Funds
be used for the acquisition costs of this parcel of land since it
appears that there will be a significant increase in our 19th Year
allocation. The increased amount could provide adequate, or near
adequate, funding for both the land acquisition and the parking lot
construction. (Land acquisition was not originally submitted in the
18th Year CDBG Project application -- the City's contribution was to
be the cost of land acquisition.) However, in order to change our
project submittal at this point requires a waiver from HUD in
Washington. We have also requested that HUD allow us to combine the
18th and 19th Year funds for this parking lot project and bid as a
single project to save construction costs and administrative
overhead and are waiting for their response.
HUD's policy requires that we purchase the property now and request
reimbursement from the 18th Year CDBG funds upon approval of the
requested waiver. Funds are available within the park land
acquisition account of the Parks and Recreation Facility Development
Capital Improvement Program Budget. If Council approves of this
funding source, Staff will move forward and complete this
acquisition in the amount of $29,000 as previously approved at the
April 12, 1993 meeting.

The Meadowlakes and Skylark Community Improvement Association recently
requested that the City of North Richland Hills pay for the cost of
irrigation water and maintain the battery operated controllers within
a portion of the landscaped median of Meadowlakes Drive within their
subdivision.
The developer of the subdivision installed the landscape material and
irrigation within this median several years after the subdivision was
developed, as a marketing tool for selling lots. The homeowners
association was created to maintain the lakes, medians and open space
within the subdivision. The Association, in the absence of the
developer, began paying the water costs for these medians and rights-
of-way along Meadowlakes Drive in October, 1992.
The approximate cost for this irrigation water is $1,550 annually.
The estimated cost of battery maintenance for the controllers is $200
annually.
Currently there are ten active homeowner associations in North
Richland Hills maintaining approximately 7.52 acres (excluding the
lakes of Meadowlakes) of entry ways or rights-af-way which beautify
their subdivisions. Of the ten associations, six are maintaining
irrigated areas. Based on previous water billing records, the
estimated water cost for irrigating these areas is $8,110, including
the Meadowlakes Homeowners Association water costs.
The existing 7.52 acres of homeowner association maintained medians,
entry ways, and rights-of-way consists primarily of intensely
landscaped areas. The estimated cost to maintain these areas, if city
crews were used, is $36,347 annually.

The attached sheet summarizes the homeowner association maintained
acreage and water costs. The annual water costs are calculated from
the previous year's billing record. The maintenance costs are based
on the per acre cost to maintain type "A" landscaping on public
building grounds. The levels of maintenance required for the
homeowner association maintained areas is equivalent to that required
for the high visibility, intensely landscaped areas maintained by the
public grounds division.

The City has received a petition requesting that Meandering Drive be
closed at the intersection of Precinct Line Road. The petition also
requests that the parking be eliminated on the south side of
Meandering.
The Attorney for the City felt the Council would like to discuss this
matter prior to placing it on a formal agenda for action.
If Council decides to take formal action, a public hearing must be held
and all residents on Meandering should be notified.

Attached is the original petition which represents the
desire of Oak Hills Subdivislon to close the intersection of
Precinct Line Road and Meandering Drive. Our purpose for this
proposal 15 to curtail the high-speed~ high-volume traffic on
Meandering Drive~ which is a dangerous thoroughfare caused by
those cutting through from Amundson to Glade Road. Closing the
intersection is our last resort since speed limits~ stop signs,
nor speed bumps seem to be an option. We also feel that the
e:<pansion of Precinct Line Road to seven lanes will also increase
the volume of traffic through our subdivision although Amundson
is the actual designated thoroughfare.

The supporters whose names have been crossed-off the
petition are still in favor of havinq the intersection clQsed~
however due to the threats Df a lawsuit from Mr. John Duck~ some
have chosen not to be formal Iv stated as such.

With regard to the Oak Hills petition for closure of an
intersection (Meandering Drive and Precinct Line Road), please
allow me to clarify and expand on the information supplied to you
by Ms. Richardson.
As you a1 ready know, it is not Meandering Way in question, as
stated in Ms. Richardson's recent letter to you, but Meandering
Drive.
I t is obvi OUB . tha t Ms. Ri chardson did not inform you, or the
petitioners of my intention to bring legal suit if this
intersection is closed. Please consider this letter as written
advisemen't that if the intersection in question is closed, I will
be bringing suit against the city of North Richland Hills and each
of the persons whose signatures appear· on the petition. In a
telephone conversation several weeks ago with Hs. Richardson, I
advised her of my intentions, but it seems she did not inform the
people who will be most affected.
In fact, each petitioner may wish to '-re-access their position
relative to this entire issue, as Ms. Richardson has not completely
addressed the situation at hand. Quite simply put, the experts
tell us that Meandering Drive, as a through street, increases the
property value of each home in Oak Hills. In addition, protection
by law enforcement and the fire department would be seriously
affected if this intersection is closed.
I would like to invite Ms. Richardson to re-evaluate her own
position on this matter. The issues of high volume traffic, cars
parked and children playing, existed before (and as) she purchased
a home in Oak Hills, but apparently she failed to take them into
consideration, just as she seems to be ignoring the big picture
now.

After reviewing the petition from the Oak Hills Subdivision, the
Fire Department has no reason to oppose the closing of the
Meandering Drive and Precinct Line Road intersection.
The only concern would be a slight increase in response time from
the Hurst Fire Department responding to a call under our Automatic
Aid Agreement. This delay should be minimal.
Should the City decide to close the intersection, we will make the
proper notifications. If you have any questions, please feel free
to contact me.

Petition regarding closing of Meandering Way
I recently drove along Meandering Way to experience the cut-through traftic problems being reported by
citizens living in the area. When I approached Meandering Way from Precinct Line Road, there were
two cars on Meandering Way waiting at the intersection for the traffic on Precinct Line Road to clear. I
was unable to deterll1ine if thèse two cars were residents of the ()ak Hills subdivision or contributors to
the cut-through traffic problc111.
It appears that the traffic uses Mcandeling Way to gain access to Precinct Line Road when the destination
points are north on Precinct Line Road or to gain easier access to Glade Road in the City of Hurst. Glade
Road serves as an east-west Collector Street between Precinct Line Road and State Hwy. 26 (Grapevine
Hwy.). The advantage gained for the north bound traffic is it gives better visibility for entering Precinct
Line Road. The visibility for cars stopped on AlTIUndson l{oad at the intersection of Precinct Line Road
and waiting to turn north is very poor due to a hill located on Precinct Line Road just north of the
All1undson Road intersection. This hill and visihility problenls may disappear when the Precinct Line
Road widening project is c()Jnplcted and thereby 111ake this a saf~r intersection.
There may be some related difficulties in closing Meandering Way at its intersection with Precinct Line
Road due to the lil11ited amount of street right-or-way (5() feet). This would not be sufficient to construct
a proper cuI-dc-sac having the typical radius. '-[he corner lots at the Meandering Way/ Precinct Line
Road do not provide for adequate set-back to accommodate a cul-de-sac at this location. However, the
citizensnlay be satisfied with a Sill1ple 111etal harricade .
From a traffic planning perspective, closing Meandering Way \vould not appear to have any adverse
effect on neighborhood circulation. 1'here are other streets serving the neighborhood which provide
adequate access into and out off the neighhorhood.

REPORT OF LIBRARY MANAGER - Wvnette Schwalm
** Recently met with Rosemary Herod's brother, who is a lighting consul-
tant, and discussed the present lighting of the public services areas of
the library. Recommendations for options to improve the lighting
situation will be included in this years's budget proposal.
** The 1993/94 budget process has begun. Prioritized items to be budgeted
through other city departments have been submitted. Included are upgrade
of library computer system, improved heating/air conditioning/lighting,
restructuring ,the book drop, and computer equipment.
** Following discùssion of February statistics, Wynette will review
February figures and .report next month.
REPORT OF LIBRARY ACTIVITIES
Mignon Morse reported on the excellent Texas Library Association Conference in
San Antonio that she, Children's Coordinator Liz Logan, and Assistant Manager
Betty Russell attended earlier in March. Betty chaired the very successful
"New Technology Showcase" exhibit for the second year.
FUTURE PROGRAMS
Mignon Morse - The second program in the American Culture Series is scheduled
for March 25. Mignon noted that the first review was superbly presented by
English Professor Virginia Reedy of TCJC. She reminded the Board that the
books to be reviewed are available for check out and invited board to attend
upcoming programs.
The Earth Day celebration is scheduled for Saturday, April 17, from 10:30 -
11:30. First 50 participants to arrive will receive a coupon for a free tree
from the NRH Parks Division.
Kay Schmidt - The Library will host Battle of the Books to be held April 22 in
the NRH Recreation Center. BISD and Irving ISD middle schools will compete
from prepared questions on selected books.
LIBRARY PLAN OF SERVICE FOR 1993-1998
Following discussion on each of the updated goals and objectives included in
the 5-year plan, Mary Shilcutt moved, Polly Brinkley seconded, and the motion
carried to accept as presented the Library Plan of Service for 1993-1998.
Next meeting was scheduled for April 15.

** City Manager Rodger Line is recuperating following by-pass surgery.
** The 1993/94 line item budget submitted on April 1S includes an approxi-
mate 4% increase over last year's request. The largest increase was for
materials from $99,000 to $116,000. Decision package items will be
submitted in May.
** Assistant Manager of Public Services Mignon Morse has resigned effective
June 1 to pursue other employment. Adult Services Librarian Barbara
Thede has retired; Children's Librarian Deb Liptak has moved from
children's to reference. Circulation Clerk Eric Fairfield has left to
pursue a career in sports medicine; Donna Gooch has accepted this
circulation position. Margaret Massey has joined the circulation staff.
** Jim Browne has hired a consultant to plan the best way to utilize the
available funding for lighting upgrades for the public services area.
** NRHPL has 1.8 materials per capita compared with the Texas average of
2.17 and the national average of 3.5. These comparisions are with
cities in the same population range.
REPORT OF LIBRARY ACTIVITIES
Shirley Goolsby and Betty Russell reviewed the Texas Library Association
Annual Conference in San Antonio in which they both participated in March.
Betty Russell reported that the NTRLS committees recommendations will be on
the North Texas Library system meeting agenda for the April 22 meeting in
Weatherford.

staff recommendation to discontinue this service. The Library's Information
Services Policy (LIB-OOOS) was revised to include this information.
UPDATE ON LAST MONTH'S STATISTICAL REPORT - Wvnette Schwalm
February statistics were corrected. In future, volunteer statistics will be
separated for library volunteers and the adult learning center volunteers.
Next meeting was scheduled for May 20. Meeting adjourned at 8:00 p.m.

Red River Farmer's Market for a Special Use Permit
to operate a Farmer's Market on Tract A,

The Red River Farmer's Market Association is interested in operating a farmer's market on the parking lot of the
Richland Plaza Mall at the northeast corner of the site. Mr. Danny Russell, who represents Red River Farmer's
Market Association, has worked out an agreement with the property owner and is applying for a Special Use
Permit to allow the farmer's market. The property is currently zoned 1-2 Medium Industrial.
The Red River Association is a non-profit organization, and is certified by the Texas Department of Agriculture
(TDA). TDA certified markets are qualified to accept food stamps for food purchases if they have a contract with
the State. The Red River Association will have a Women, Infant and Children (WIC) contract in 1993 through the
Food and Nutrition division of the Texas Department of Human Services. The market hopes to serve the
approximate 4,500 clients of the WIC program in the immediate area, in addition to the general public (see
attached letter from Mr. Russell for more details).
The Association is proposing to install eight stalls, approximately 110 square feet each, in the northeast parking
lot of Richland Plaza Mall. The season roughly runs from mid-May to November 1 st. Similar markets are run in
Fort Worth, Benbrook, Euless, Grapevine, and Addison.
The attached site plan shows the general location of the stalls for the market. A proposed ordinance i,s included
in this packet. The Planning and Zoning Commission considered this request at their April 8th meeting and has
recommended approval of the Special Use Permit with the condition that it be re-reviewed at the end of an
eighteen month period.

AN ORDINANCE BY THE CITY OF NORTH RICH LAND HillS, TEXAS, AMENDING ORDINANCE NO. 1874, THE
COMPREHENSIVE ZONING ORDINANCE, TO AUTHORIZE SPECIAL USE PERMIT NUMBER THIRTEEN FOR A
FARMERIS MARKET; ESTABLISHING CERTAIN DEVELOPMENT REGULATIONS; PROVIDING A
SEVERABiliTY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission of the City of North Richland Hills, Texas, has forwarded a
recommendation to the City Council for amendment of Ordinance No. 1874 by authorizing Special Use Permit
Number Twelve, by changing the said Zoning Ordinance as set forth herein.
BE IT ORDAINED BY THE CITY COUNCil OF THE CITY OF NORTH RICHlAND HillS, TEXAS:

THAT, Special Use Permit Number 13 be hereby authorized for a Farmer1s Market as set forth in Case Number
PZ 93-04 on the property more particularly described as follows:
BEING Commercial Tract A, Richland Plaza Addition, an addition to the City of North Richland Hills, Tarrant
County, Texas, as recorded in Volume 388-22, Page 77, Deed Records, Tarrant County, Texas..
This property is located at 6557 Grapevine Highway.
II.
THAT, the development regulations contained in the 1-2 MEDIUM INDUSTRIAL Zoning District shall govern
development on said property, except where amended below:
1. The precise location of the Farmer1s Market shall be contained within the area shown on the Site Plan,
attached as IIExhibit All.
2. That the Special Use Permit shall be automatically re-reviewed by the Planning and Zoning Commission,
without additional fee, after completion of an eighteen month period from the date of approval by the City
Council.
3. Hours of operation shall be limited to opening not earlier than thirty minutes before sunrise and closing not
later than thirty minutes after sunset.
4. All equipment shall be removed from the premises at the end of the growing season.
5. All produce sold shall be limited to that grown by the members of the Red River Farmer1s Market Association.
III.
THAT all the regulations contained in the Zoning Ordinance No. 1874, as amended, which are not in conflict with
the terms of this Special Use Permit, shall remain in full force and effect regarding this property.
IV.
SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the section,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any
of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would
have been enacted by the City Council without the incorporation in this ordinance of any such invalid or
unconstitutional phrase, clause, sentence, paragraph or section.

Mr. Barfield made the motion to approve the minutes as written. The
motion was seconded by Mr. Baxter, and the motion carried 4-0.
Mr. Lueck made the motion to approve the minutes as written. The
motion was seconded by Mr. Wilson, and the motion carried 5-0.
Public Hearing to consider the request of Red River FarmerJs Market for
a Special Use Permit to operate a FarmerJs Market on Tract A, Richland
Plaza Addition. This property is located at 6557 Grapevine Highway.
Chairman Brock opened the PubHc Hearing and called for those wishing
to speak in favor of the request to come forward at this thne.
Mr. John Doak, of Bowie, Texas, came forward to speak. He stated he
is vice-president of the Red River Farmer's Market Association. He
stated they wanted to operate a farmer's market in the city. Mr. Doak
stated they would sell fresh fruits and vegetables. He stated it is difficult
for the small producers to get into the wholesale market.
Chairman Brock asked if they operate farmer's markets in other areas.
Mr. Doak stated yes, they have markets in Benbrook, Euless, Addison,
and Grapevine.
Chairman Brock asked what type of structure goes on the lot.
Mr. Doak stated they use a metal frame about 100 square feet in area.
He stated they put a tarp up over it during the day when they are there to
shade them.
Chairman Brock asked how many trucks would be involved in the
operation.

Mr. Doak stated around ten, sometimes less.
Chairman Brock asked what the normal hours of business were.
Mr. Doak stated about 8:00 a.m. to whenever. He stated they are
usually sold out by noon.
Mr. Barfield asked what type of signs they put up.
Mr. Doak stated they put up portable signs. He stated they might have
signs on the pickups.
Mr. Wilson asked if they would require any electricity or water.
Mr. Doak stated they would only need restroom facilities, which would be
available in the WIC office or the Montgomery Wards store.
Mr. Wilson asked how many families in the WIC program would this
market help.
Mr. Doak stated about 400. He stated they will sell to anyone, and the
WIC program is just a part of it. He stated they hope to market to the
older retired population.
Mr. Lueck asked how long the selling season was.
Mr. Doak stated from about mid-May to either October or November.
Mr. Lueck asked what happens to the equipment after the season is
over.
Mr. Doak stated they take it down and remove it from the property.
Mr. Lueck asked if they could describe the area on the property a little
better.
Mr. Doak stated they would draw up a plan showing the area.
Chairman Brock stated that they could get with Mr. LeBaron and work
out a description of the area. He stated as long as it is ready by the time
it goes to City Council.
Mr. Baxter asked if there were plans to sell anything other than fruits and
vegetables.
Mr. Doak stated no, just what is grown by the farmer who brings it in.
Mr. Barfield asked what they do with the items that do not sell.
Mr. Doak stated they clean the area each day when they are finished.
He stated they do not dump into dumpsters.
Mr. James Walker came forward to speak. He stated he sells produce at
these markets, and it is a major portion of his income each year. He
stated he works with the Agricultural Extension Service. He stated they
are looking for locations in the area.

Mr. Baxter if there were any other markets in Tarrant,County.
Mr. Walker stated there are markets in Benbrook, Grapevine, and
Euless. He stated they also have one on East Rosedale in Fort Worth
every week. He stated that at the Benbrook market, any leftovers would
usually be donated to local food banks. He stated that the area is left
clean every night.
There being no one else wishing to speak, Chairman Brock closed the
Public Hearing.
Mr. Wilson stated that some time limit should be put into place since this
type of activity has not come to the city before. He stated he would be in
favor of reviewing the permit in 18 months.
Mr. Barfield stated that most of the requirements in Article 5 should be
waived since they do not apply to this use. He stated they should retain
the ones relating to hours of operation, signs, noise, fire protection and
other items.
Mr. Lueck made the motion to approve PZ 93-04 with the following
stipulations: the Special Use Permit have an 18 month duration, the
Association work out a description of the area with City staff, the hours of
operation be 30 minutes before sunrise to 30 minutes after sunset, the
duration Special Use Permit be limited to two growing seasons, that at
the end of the season all equipment be removed from the premises, that
the products sold be limited to the produce grown by the farmers, and
that the remaining non-related items in Article 5 be waived. The motion
was seconded by Mr. Wilson, and the motion carried 7-0.
Chairman Brock stated they should contact City staff to find out when
this case will go before City Council.

at the southwest corner of Grapevine Highway and Richland Plaza Drive, north of
Broadway Avenue.

ALLOWED USE: Farmer's Market allowed by Special Use Permit only
SITE CHARACTERISTICS The Richland Plaza site is currently developed with several
buildings and a paved parking lot. The proposed site for the Farmer's Market is in the
parking lot at the northeast corner of the site. (see attached site plan map)
ADJACENT ZONING/LAND USES
North R-7-MF: existing multi-family structures
South City of Haltom City: Birdville ISD facilities
East City of Richland Hills: existing single family homes
West R-2: existing single family homes (Diamond Oaks South)
DRAINAGE According to the Drainage Master Plan for the City, the Farmer's Market
site lies within the limits of the 1 aD-year flood plain. It specifically lies within the North
and South Diversions of Mackey Creek which consist of the spillover of the 1 DO-year
storm that cannot be carried through the 72-inch storm drains that run under the
northeast corner of Richland Plaza.
THOROUGHFARE PLAN Access to this property is from Grapevine Highway, classified
as a P6D thoroughfare (Principal Arterial, 6-lane, divided roadway). Access to this
property also comes from Richland Plaza Drive, an R2U Residential street.
LAND USE MASTER PLAN The Land Use Master Plan calls for commercial activity in this
area. This request is consistent with the Plan.

ZONING HISTORY
This property was originally zoned LR Local Retail in 1967. It remained Local Retail until
1974, when the zoning was changed to C Commercial to accommodate a trade '
school. A request for a change to I Industrial in 1980 was approved as the tenants
changed from a retail base to more of a manufacturing and warehousing clientele.
The current zoning of 1-2 Medium Industrial was initiated in the 1984 rewrite of the
Zoning Ordinance and map.
PLATTING HISTORY
The Richland Plaza area was platted in 1960, and included residential and
commercial lots.

TO: Members of the North Richland Hills City Council;
Nine years ago" the Texas Department of Agriculture (TDA) began
meetings with farmers across the state to organi2e farmer groups" to
de y e lop farmers mark.ets in cities that did not pre y ious ly ha v e markets..
and promote direct se 11in9 to consumers. The idea was then.. and is now"
to increase farmers profits through retai1 sales.
Through the guidance of TDA" market organi2ation"s were formed
throughout the state. We.. members of the Red Ri v er Farmers Market
Association.. were part of the original organizers and Board of Directors
of the Fort Worth Area Farmers Mark.et Association.
The Fort Worth organization's purpose was to deve10p a farmers market
in Ft. worth.. promote direct marketing.. and to provide a service to the
public that had not existed for several years.
The design of the Ft. Worth association was to: 1) de y e lop a non profit
association operated by an elected board of directors.. who were active
farmers and members" 2) invite farmers from a 150 mile radius of Ft.
Worth to become members.. 3) to create a selling market for farmers to
sell their products.. 4) to promote Texas Agricu1ture to the general pub1ic..
and" 5) to de v e lop an information education system to assist farmers and
grower" s in impro v in9 farming techniques.
Non-profit organi2ation"s are formed through the establishment and
ratification of a constitution and by-laws and the election of a board of
directors. The next process is a series of paper work... forms and
applications made to the IRS for' tax .. and 501 (c) recognition. The Red
River association on June of 1992 ratified it"s constitution, elected it"s
Board of Directors.. has received it"s tax ID .." and the non-profit status
is being processed by the IRS.

Membership in the association is encouraged through persona) contacts..
letters and word of mouth. County agents are informed of the
organization and given copies of the membership app1ication.. constitution
and by-laws" to distribute to interested farmers. Membership is limited
to farmers/grower/producer"s. Non-producer"s are exc1uded from
participation - that is person"s who purchase and re-se11 agriculture
products.
The association is non-profit in design. It"s purpose is to provide or
create the selling environment that assist it"s members in profitabi1ity.
The association continuously searches the best viable locations to operate
at.
The association has in the past promoted it"s products through special
events.. garden shows, melon shows.. peach festiva1s.. through advertising
in local papers.. special news artic1es.. radio programs! a customer news
letter and week ly drawings for free produce.
The association works with TDA and the extension ser v ice for
information on growing tips! preventative methods in curbing plant
disease.. insect control and selling ideas through membership news1etters~
month ly board meetings and annua 1 membership meetings.
In 1967 TDA began a certification process to certify markets throughout
the state. Certified markets qualify.. through USDA approval! to accept
food stamps for food purchases. In 1988 a pi10t program was developed
with the Food and Nutrition di y ision of the Department of Human Ser v ices
called the Women with infant children (WIC) program. This program issues
purchase coupons to clients to purchase certain products. In this
program.. a coupon was designated for purchases at certified markets.
On ly certified markets qua 1ify.. howe v er.. each market must ha v e a
contract with the Department of Human Ser v ices to be authorized to
accept the WIC coupon and not a 11 markets in Texas ha y e contracts. In
1992" President Bush signed this program into law" making it a permanent
part of the USDA budget. Currently.. funding wi11 remain at the present
leve1.
The Red Ri v er association wi11 ha v e a WIC contract in 1993. WIC coupons
wil1 be 1ssued in Ft. Worth and T arrant county for approximate ly
$140,,000. This is coupon"s the very poor of our society use to purchase

fresh fruits and vegetables from farmers.
In the North Richland Hills/Haltom City area there are approximately 4500
clients who will receive the WIC program. That is equal to $45000 in
coupons.
Farmers use these revenues for farm improvements and purchases made
in your community.
In 1969 TDA assisted the certified markets in forming a state wide
organization. The main purpose of the Texas Certified Farmers Market
Association was to provide blanket 1iability insurance to the certified
markets. The Red River association is a TDA certified market.. a member
of the state association" and participates in the insurance program. The
policy covers a one million do11ar general liability" product liability"
personal and advertising injury.. fire damage (50,000) and emergency
medical treatment (5,000).
It is the Red River"s desire to operate a farmers mark.et in your
community. We desire to set up eight selling sta11s (but may need to
increase the stall number)" 10 1/2 )( 10 1/2 feet in the parking lot of the
Richland Hills Pla2a Shopping Center at 6357 Grapevine Highway in North
Richland Hills.. Texas 76180. The sta11s are constructed of 3/4 inch top
railing from chain length fence material. The frame is set in 50"
concrete blocks which contain a 1 1/2 inch piece of square tubing
approximate ly 6 inches in length. The square tubing is set in the center of
the b lock. The top railing (for the sides of the sta 11" which are 7 feet in
height) is set on and inside the 5 inch length tubing. The frame is bolted
together (the corners are made of the square tubing materia 1.. which are
welded in the proper angle to make a corner and the rai1ing inserted
inside the tubing and bolted to the angle). Each farmer wi11 provide a 10
X 10 foot grey can vass c 10th for shade co v er. We desire to lea v e the
frame work up for the duration of the season.. however the shade cloth
will be in place only on selling days. The selling season usually runs from
mid May to November first. Selling days are determined by supply and
demand.. howe ver wi11 not be less than two days and not more than six.
It is our hope and wish that you wil1 see that we are pro v iding a
valuable service to your community and wi11 respond positively to a
special use permit.

A1though the Red River farmers market association has just formed, as
stated earlier, we ha v e been a part, and I must say a very acti v e part,
with the Fort Worth association (now re named the North Central Texas
Farmers Market Association ) and ha v e a pro v en track record with the
city of Fort Worth. Benbrook.. Euless.. Grapevine and Addison.
All ha v e supported and appro ved our market concept in their
communities.
I hope you can see that we are a we 11 organi2ed and a we 11 p 1anned
operation and mean a positive relationship in your community.

A. Purpose A Special Use Permit is intended to provide flexibility by allowing certain types of uses in areas
where special conditions may need to be considered to reduce adverse effects on adjacent or surrounding
properties. A Special Use Permit may be authorized for a specific site for an additional land use when such
use is determined to not have adverse effect on surrounding properties and, when such use is consistent with
the purpose of the zoning district.
B. General Provisions A Special Use Permit shall constitute an amendment to the Zoning Ordinance and
shall be processed according to the procedures established for all amendments to the Zoning Ordinance.
Special Use Permits will be issued to the site being considered and be subject to any time limitations imposed
by the City Council during the approval process.
c. Procedures
1. Application Procedure - The applicant requesting a Special Use Permit shall submit a written application
and furnish plans and data concerning the operation, location, function and characteristics of any use of the
land or building being proposed. The Planning and Zoning Commission may consider an application for a
Special Use Permit for a parcel of land in those districts established in the Table of Permitted Uses,
contained in Section 310. All applications for a Special Use Permit shall be treated in the same manner as an
amendment to this Ordinance as prescribed in Section 200, Amendments.
2. Special Site Plan Requirements - A site plan shall accompany every application for a Special Use Permit.
Such site plan shall include all the contents established for Site Plans contained in Section 510, and such
plan, when approved, shall be made a part of the amending ordinance.
3. Public Hearing - After a public hearing conducted by the Planning and Zoning Commission and after
receiving a recommendation from the Planning and Zoning Commission, the City Council shall conduct a
public hearing to obtain citizen input.
4. Conditions Related to Approval - Each Special Use Permit application shall be evaluated by the Planning
and Zoning Commission and City Council as to its probable effect on the adjacent property and the
community welfare and may be approved or denied as the findings indicate appropriate.
In considering an application for a Special Use Permit, the Planning and Zoning Commission shall review the
following conditions associated with the proposed operation:
a. Setbacks for buildings or structures
b. Public street access
c. Drainage
d. Vehicular traffic, circulation, parking lots or spaces
8. Screening or buffer zones
f. Hours of operation
g. Activities and uses permitted on the property
h. Building or structure heights
i. Landscaping
j. Maximum allowable lot coverage
k. Pedestrian circulation
I. Signs
m. Mitigation of noise, fumes, odors, vibration, or airborne particles
n. Exterior lighting

The Planning and Zoning Commission may recommend safeguards or conditions of approval to reduce the
effect on adjacent or surrounding properties. The City Council may, in the public welfare and to assure
compliance with the intent of this Ordinance, require such development standards and safeguards as
recommended by the Planning and Zoning Commission. Applicants shall comply with the terms and
conditions of the Special Use Permit for the duration of the Certificate of Occupancy; noncompliance shall be
considered a violation of this Ordinance.
5. Building Permit Compliance - No building permit for any structure shall be issued, nor shall a Certificate of
Occupancy be issued on any existing structure, until such development plans are consistent with the
approved site plan and the conditions established for the Special Use Permit. Building permits must be
consistent with the site plan and must comply with design standards, policies, and any design criteria deemed
necessary to the safety, health, and welfare of the City.
6. Grievances and Appeals: An aggrieved party may appeal the decision of the Building Official to the
Zoning Board of Adjustment in accordance with the provisions of this Ordinance.
7. Recording Site Plans: The Building Official shall maintain a record of all site plans approved for a Special
Use Permit. A list of all approved Special Use Permits shall be listed in the Appendix.
8. Special Use Permit Amendments - Changes to any Special Use Permit or to its approved site plan shall
be processed in the same manner as the original approved request. Changes of detail within a site plan
which do not qlter the basic physical relationship of the property to adjacent property; do not alter the uses
permitted: do not increase the density, floor area, height, or reduce the yards provided at the boundary of the
site as indicated on the approved site pian, may be authorized by the Building Official.

On May 14, 1990, the City Council approved case number PS 90-03, a replat of lot 1 , Block 3, J.l. Autrey
Addition. The replat contains a condition which denies access to Rita Beth Street. The property owner is
interested in having this condition removed from the plat. The discussion regarding the denial of access from Rita
Beth actually dates back to the time when the property was being rezoned on November 14, 1988. The City
Council approved the rezoning of the property from R-3 to C-2, but stated that the access issue was a platting
issue rather than a zoning issue.
The owner will prepare an Amended Plat for consideration by the City Council at a later date, contingent upon the
outcome of the public hearing at the April 26th City Council meeting. Property owners along Rita Beth Street
have been notified of the public hearing.
RECOMMENDA TION:
It is recommended that the City Council conduct a public hearing and consider removing the plat condition which
denies access from Rita Beth Street on this property.

The North Richland Hills Police Department has, since 1985, functioned with four major
subdivisions each headed by a Police Captain, and since 1991 has had one Assistant Chief of
Police. In the interest of overall efficiency a minor reorganization of functions is submitted for
your consideration.
The Technical, Administrative, Investigative and Uniformed Services Divisions are to be
consolidated into two major bureaus (Operations and Services) each headed by an Assistant Chief
of Police. The position of Captain in the Administrative Services Division is to be deleted
following the promotion of the second Assistant Chief of Police. This leaves three Captains to
head the remaining three subdivisions. Organizational Charts, both current and proposed, are
attached for clarification of our intent (see Attachments # 1 and #2).
In order to pennit the Police organization to continue to function in an efficient manner it is also
proposed that one of the ten Public Safety Technicians in Police Records be upgraded to Police
Records Supervisor, a previously approved but currently vacant position. This \\rill free the
Sergeant, currently managing Police Records and four other Sections, to concentrate his talent in
the area of Internal Investigations, In service Training and Personnel Intake. We have named this
newly designated area "Professional Standards." The proposed Police Records Supervisor will
function as a "working supervisor" not in an exclusively managerial role.
This reclassification and/or reorganization of these functions/provisions can be accomplished with
no change in the funding allocation in this fiscal year. The net impact anticipated for FY 1993-94
is $3,353.00. This was made possible by the deletion of a car allowance for both Assistant Police
Chiefs and the newly promoted Captain.

Trophy Tree Ordinance - Ordinance No. 1877

The Beautification Commission, at their January 19, 1993 meeting, voted
unanimously to request the City Council to approve the proposed Trophy Tree
Ordinance.
The Trophy Tree Ordinance establishes a policy for identifying,
recognizing, and designating locally significant trees and encouraging
owners to conserve these trees for the 'enjoyment and benefit of all the
residents of North Richland Hills.
According to the proposed ordinance, "Trophy trees" will be designated by
issuance of a certificate, placement of a plaque at the base of each trophy
tree, city council proclamation, and an optional $50 city tax rebate to
encourage preservation of the trophy tree. The $50 tax rebate could be
offered in the form of a certificate from a local nursery for fertilizer or
other tree maintenance supplies.
Nominations for trophy trees will be annually reviewed and evaluated by the
Beautification Commission. All recommendations will be approved by the
city council on an annual basis. One of each tree species is eligible for
trophy tree status. It is estimated that approximately 100 tree species
~ist within North Richland Hills which' could be nominated as a trophy
~ee. If the ordinance were approved with the tax rebate option, the
potential fiscal impact to ,the city, through the Beautification Commission,
is as follows:
100 plaques and certificates at $120 each, $12,000 (one time cost)
100 tax rebates at $50 each, $ 5,000 (annual tax rebates)
Upon adoption of the ordinance, the Trophy Tree Program will be initiated
and nominations will be accepted by the Beautification Commission for
evaluation and consideration at their annual Trophy Tree Program Review
each September. Prior to preparation of the following year's fiscal
budget, the nominations received throughout the year will be reviewed and
an estimate prepared for the number of plaques, certificates, and tax
rebates for inclusion in the budget. Although the estimated total
potential impact for the Trophy Tree Program is based on 100 tree species
being designated, only 50-75 dominant species are anticipated to be

INVENTORY, MAPPING, PUBLIC RECOGNITION, AND DESIGNATION OF LOCALLY
SIGNIFICANT TREES, PROVIDING FOR SEVERABILITY.
WHEREAS, trees greatly enhance the environmental and aesthetic
quality of the City; and
WHEREAS, the city Council has adopted a Parks and Recreation Master
Plan placing special emphasis on the conservation of the
City's natural and open space resources of which trees are
an important element; and
WHEREAS, the citizens of North Richland Hills recognize that trees
are a natural resource worthy of conservation.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS AS FOLLOWS:
section 1:
THAT a program to identify, map, publicly recognize
and conserve locally significant trees within the City
of North Richland Hills is hereby placed in effect;
section 2:
THAT this program is titled The Trophv Tree Proqram of
North Richland Hills;
section 3:
THAT The Trophv Tree Proqram of North Richland Hills
will contain the following:
A. DEFINITIONS
Trophy Tree: Any outdoor tree or group of trees living in the
ground within the city limits of North Richland Hills, Texas
which is determined to be the best representative of its given
species (largest, in good health, and best form) within the city
limits.
B. STATEMENT OF POLICY
It is the policy of the City of North Richland Hills that
locally significant trees be identified, recognized, designated
and that the owners of the trees be encouraged to conserve said
trees for the common benefit and enjoyment of all of the
citizens and enrichment of the city.
C.
ADMINISTRATION
The Trophy Tree Program shall be administered by the Director of
community Services under the direction of the North Richland
Hills Beautification Commission.

All eligible nominees who have given written permission for
inclusion in the Trophy Tree Program shall be presented by the
Beautification Commission to the City Council for final
approval.
DESIGNATION AND RECOGNITION
Each Trophy Tree shall be designated as such by:
1) Issuance of a Trophy Tree certificate jointly by the City
Council and the Beautification Commission to the property
owner¡
2) Placement of a cast medallion set in concrete near the base
of the tree(s)¡ and
3) A proclamation by the city Council that this tree(s) is a
valued environmental asset to the City and shall be
cultivated, protected and designated as the best example of
a tree of its species within the city.

PROTECTION AND MAINTENANCE
Each year for as long as the tree is recognized as a Trophy Tree
and is maintained in good health as a superior example of its
species, the City will grant to the owner, as an encouragement
and an aid to maintaining the tree a discount in city fees or
taxes of $50.00 per Trophy Tree per year.
In the event that the tree should die of natural causes the
discount will be discontinued and forgiven.
In the event that the tree should die by deliberate or malicious
man-made causes, which the owner could have prevented, as
determined in a public meeting between the owner and the
Beautification Commission, the discounted fees which had been
granted in all previous years shall immediately be due. The
City will file a lien on the owner's property for the repayment
of total plus penalty interest of all abated fees until they
have been paid.

ANNUAL REVIEW
Each year, once per year, the Beautification Commission shall
meet to review the Trophy Tree Program. At that time, the
Commission shall review new nominees, the status of current
Trophy Trees, declassification of Trophy Trees, and other issues
relating to the program. Any recommended changes in the
classification or designation and/or applicable fee or tax
abatement shall then be approved by the City Council and shall
take effect in the next fiscal year'.
All determinations of Trophy Tree classification shall be
decided by the Beautification Commission.

The Internal Service Fund (Vehicle Maintenance) was
instituted in 1986. KPMG Peat Marwick performed the initial
study to develop the policies, procedures and proposed
monetary allocations to establish this Fund. In light of the
recent policy changes regarding car allowances and the
reduction of the City Fleet it is necessary to update the cost
allocation for departmental budgeting, accounting for
expenses, and replacement polices for existing vehicles.
We requested KPMG Peat Marwick to provide a cost estimate
to assist us in updating the information and indirect costs.
It would be best to conduct this study in conjunction with the
current indirect cost allocation study of the Water & Sewer
Fund and Park projects. The cost will be $5,250.00. These
funds are available in the capital savings account in the
Management Services Fund.
Recommendation:
It is recommended City Council authorize the expenditure of
$5,250.00 from the capital savings account in the Management
Services Fund to fund the Vehicle Maintenance study.

Replacements
The CIP project was awarded by Council on July 13, 1992 for $267,817.00 to Circle "C"
Construction. The total contract amount after change orders was $335,587,00, Final payment to
the contractor will make his total earnings on the project $281,603.50.
The contractor substantially completed this project on January 20, 1993. The contract completion
date was February 5, 1993, The project is now totally complete with all final adjustments having
been made.
Upon final payment, the property owners served by the Hewitt Street Sewer should be sent the
notice to pay their voluntary assessments per agreements with the City, These payment
arrangements will be handled in the same manner the City handles involuntary assessments, The
assessments will total $12,376.75.
Fundina Source:
Sufficient funds of $350,000 were budgeted for this project by PW 92-16 on June 22, 1992 as well
as an additional remaining fund amount of $72,545 in Valley Park Estates Water Main Replacements.
Valley Park Estates Water Main Replacements was added to this miscellaneous project and all work is
now complete.
Recommendation:
Staff recommends approval of final payment to Circle "C" Construction Company in the amount of
$36, 111 .40.

Dear Greg:
We are in receipt of Contractor's Estimate No. Five (5) and
Final for the subject project for our review. We have made a
final inspection with you, Larry Jones, and the Contractor, and
we concur with the final quantities reported in this estimate
which has been executed by the City's Inspector, Larry Jones.
Therefore, we are prepared to recommend payment of this
estimate in the amount of $ 36,111.40. Payment should be made
directly to Circle "Cft Construction Company, P.O. Box 40328,
Fort Worth, Texas 76140.
Based on the contract, the Maintenance Bond for this project
will go into effect as of the date of final acceptance of the
project by the Ci ty of North Richland Hi lIs. Assuming an
acceptance date by the Counci 1 of Apri 1 26, 1993, the
Maintenance Bond would be in effect until April 26, 1995.

ELIGIBILITY
Any individual tree or group of native or introduced, outdoor
trees which has been growing in its present location within the
city limits of North Richland Hills, Texas is eligible for
nomination as a Trophy Tree under this program, especially those
individual species of trees previously recognized by the Texas
Forest Service through it Big Tree Program; and, further:
Although anyone may nominate a tree to be considered as a Trophy
Tree, only the actual owner may grant permission for the tree to
be so designated by the city.
The tree must have existed in its present location a minimum of
five (5) years.
E.
REQUIREMENT FOR INVENTORY
An official written log of all successfully designated Trophy
Trees, as well as those nominated, shall be maintained by the
Director of Community services or by his/her designee. Co-
existent with the Trophy Tree Log shall be the preparation of a
map designating the locations of all designated Trophy Trees.
The log and accompanying map shall be updated on an annual
basis. Each tree shall be inspected annually to verify its
health and vigor. Every ten (10) years all Trophy Trees shall
be measured to document their growth. Copies of the Trophy Tree
log and map shall be forwarded to the City Director of Planning
and Development and also be made available for public display
and review.

NOMINATION PROCESS
Nominations for Trophy Tree designations may be submitted by any
citizen of North Richland Hills. Nominations must be made by
completing and signing the Trophy Tree Program Nomination Form.
These forms shall be maintained and made available far pick up
by the public at the community services Department's
Administrative Offices. The nomination must be received by the
North Richland Hills Beautification Commission. Upon receipt of
the nomination the Beautification Commission shall send a
representative (either city staff or volunteer) to the site to
verify the size, condition, species and character of the
nominated tree. If said tree is found to be the most
representative (largest, in good health, and best form) of its
given species within the city limits it shall be designated as a
Trophy Tree. Once the tree has been qualified as a Trophy Tree,
the landowner shall be notified in writing by the Beautification
Commission. If the landowner chooses to participate in the
Trophy Tree Program and receive the rights, privileges, and
recognition of the Program, he/she shall grant permission by
signing a written acknowledgement and submit it to the
Beautification commission.

J. DECLASSIFICATION
A living Trophy Tree may be declassified by majority vote of the
Beautification Commission only upon request by the landowner at
the Annual Review Meeting. The recommendation to declassify
shall then be approved by majority vote of the City Council.
If any provision, section, sentence or clause or phrase, of this
ordinance, or the application of same to any person or set of
circumstances, is for any reason held to be unconstitutional,
void, invalid, or, for any reason, unenforceable, the validity
of the remaining portions of this ordinance or its application
or other person or sets of circumstances shall not be affected
thereby, it being the intent of the City Council of the City of
North Richland Hills in adopting this ordinance that no portion
hereof nor provision or regulation contained herein become
inoperative of fail by reason of any unconstitutionality or
invalidity or any other portion or regulation.
