The Expo will include a business fair, craft show and carnival. Businesses and crafters are paying $30 per booth and will be allowed to keep all sales. The Expo will be held in the old Wal Mart building. Wal Mart has donated the building to North Richland Hills for that week in June. The Cities of North Richland Hills and Hurst will be having a city auction on Friday, June 18th. Adventure World will have the building on June 19th. In order to get an accurate estimate of cost, we are having a company give us a cost for two, three, four and five speed humps. We are also considering having our crews construct one speed hump to give us an accurate in-house cost. I'm not sure Meandering Drive would qualify for speed humps using the Dallas guidelines. V.A.C.S. art. l085b. 2081 I Ie I I I I I I I Ie I I I I I I Ie I I INFORMAL REPORT TO MAYOR AND CITY COUNCIL NO.1R 93-070 ~1c1 x ~~ Date: May 24, 1993 Subject: Davis Boulevard Assessments Two areas of Davis Boulevard have come to the attention of the staff as possibly needing reconsideration concerning the assessments for the improvements when Davis Boulevard was widened. The first area is a parcel of property owned by Mr. Ross G. Gutierrez in the 7200 block of Davis Boulevard. Mr. Gutierrez purchased the property in 1980 or 1981 with the intent of constructing a home. Shortly thereafter, he learned that the right-of-way required for the proposed extension of Hightower Drive would reduce the width of his property from one hundred and two feet (102') to sixty-seven feet (67'). The Zoning Ordinance requires a minimum lot width of seventy- five feet (75') for a residence. Mr. Gutierrez was unable to obtain a building permit and has been unable to develop the property. Hightower Drive may need to be curved north on Mr. Gutierrez property, prior to its intersection with Davis Boulevard, in order to line up with the existing Hightower Drive, east of Davis Boulevard. This would reduce the sixty-seven foot width and possibly split the property into two parcels. Mr. Gutierrez has requested a waiver of .. street assessment" through city staff. Staff believes that the Davis Boulevard project did not enhance the value. Attachment "A" is a map of the property and the route of the projected Hightower Drive. The other area is the east side of 7300 - 7400 Davis Boulevard and the lack of visitor parking at the duplexes (Attachment B). "No Parking" signs were erected in front of these duplexes as part of the widening project on Davis Boulevard. Parking for these duplexes is limited to a two car carport per half duplex with entry through the rear of the residence. Staff has reviewed a number of options to provide parking relief to the residents. The Texas Department of Transportation has indicated that, at the City's request, they would consider modifying the parking restrictions ~:l £¡:-ont of lûost of -the duplexes. Thi5 could allow parking during certain times and prohibit parking during other periods, such as midnight to 6:00 a.m. This is the only section of Davis Boulevard that has "No Parking" signs. Other sections of Davis Boulevard have parking on the improved shoulder without creating problems. At Council's request, Attachment "C" list the assessments and other information for these duplexes. TRAPS has a "Young Professional" Award program that represents the entire state of Texas. The award is given annually to the one professional who best meets the following criteria: * Must have been responsible for exemplary advancement of the recreation and parks professional in his or her locale, or within the state. * Must be 35 years of age or younger. * Must have been actively involved in TRAPS. * Must have made an outstanding contribution to the profession not included in the above. I I I I I I I Ie I INFORMAL REPORT TO MAYOR AND CITY COUNCIL No. I R 93-66 Date: May 24, 1993 Subject: Texas Forest Service "Urban Forestry Award" The Texas Forest Service recently announced that the City of North Richland Hills has won the Local Government-Urban Forestry Award for our "Tree Awareness Program". This highly successful program is a joint effort between the City of North Richland Hills Community services Department and the Birdville Independent School District. The Community services Department, along with school officials from North Ridge Elementary School, developed a "living laboratory" tree farm and implemented the "Tree Awareness Program" complete with guest lecturers to educate and enlighten children on the care and importance of trees. This award recognizes the efforts of the city of North Richland Hills Community Services Department, Birdville Independent School District, parents, volunteers, and students, resulting in significant enhancement of the urban forest in our city. The Community Services Department is excited to receive recognition for a program that further strengthens the City/School Cooperative Agreement and promotes environmental responsibility among the children of our community. Special recognition and appreciation should be afforded to Tim Hightshoe and his Public Grounds Crew. This project idea, coordination, organization, and implementation are the result of his creativity and willingness to contribute time and energy above and beyond his job responsibilities. This property is located at 7117 Douglas Lane. Agenda Number: PZ 93-06 Ordinance #1889 Ms. Diane Cooper is the owner of a house and property located at 7117 Douglas Lane. Ms. Cooper applied for a building permit in March to construct a horse barn· on the property. The permit was denied because the property is zoned R-1 Single Family Residential which only allows single family homes. Therefore, she is seeking a zoning change to R-1-S Special Single Family to allow the construction of the barn and the keeping of horses on the property. During the public hearing on Ms. Cooper1s request, several of the neighbors expressed the desire to have similar zoning for their properties. It is their contention that the properties along this street have always been permitted to have horses in the past and they were not aware that the zoning had been changed in 1984 to prohibit the keeping of horses. The Planning and Zoning Commission agreed to consider the rezoning of this entire neighborhood to the R-1-S Zoning District at a meeting in June when it can be placed on their agenda. As a result of their discussion, the Planning and Zoning Commission agreed to also recommend refunding Ms. Cooper1s zoning application fee. The Planning and Zoning Commission reviewed Ms. Cooper1s request at their meeting on May 18, 1993 and has recommended approval. Ordinance # 1890 Mr. Art West is under contract to lease a lot located at 7820 NE Loop 820, which formerly housed the North Hills Lincoln-Mercury auto dealership. Mr. West would like to operate a Used Vehicle Sales Lot on the property, and is applying for a Special Use Permit to allow the use. This particular lot is unusually shaped. Right-of-way along the front of the lot was recently purchased by the Texas Department of Transportation for the Loop 820/121 interchange widening and the primary building was demolished to accommodate the highway expansion. The balance of the lot is mostly paved, devoid of any trees or landscaping and contains a small building which was the location of the former used car sales office. The eastern most portion of the lot is presently unpaved and covered with dirt. A copy of the site plan for this property is attached. Mr. West intends to keep the existing building for use as an office, and plans to construct an additional building for detailing and· cleaning of the vehicles. He also plans to erect several light standards and a security fence on the property for safety purposes. All these items are shown on the site plan. The Planning and Zoning reviewed this request at their May 18th meeting and recommended approval. However, the Planning and Zoning Commission recommended that the applicant be allowed to utilized planter boxes with flowers and shrubs to achieve some landscaping on the lot rather than removing asphalt to meet the landscaping requirement. Attached is a copy of Ordinance # 1890 which authorizes a Used Vehicle Sales Lot at the requested location and allows planter boxes to satisfy the landscaping requirement. The appropriate signatures need to be added to the Owner's Acknowledgment and Dedication. In addition the Surveyor's seal and signature need to be added to the plat. 2. A Metes and Bounds description needs to be added to the plat. In addition the Point of Beginning needs to be clearly labeled on the plat. 3. The City has obtained a Global Positioning System (GPS) Horizontal Control Survey. This survey was accomplished to create an accurate base map for the Geographical Information System. City policy requires that all new plats be tied by survey to the GPS. This will allow the City to keep the GIS up-to-date. The Public Works Department has written descriptions for all of the GPS Benchmarks located around the City. This plat needs to include the NAD83 Texas State Plane Coordinates for at least two property corners. The coordinates need to be determined by a survey tied to the City's GPS monuments. 4. The attached easement dedication needs to be incorporated into the closing paragraph after the Metes and Bounds description. 5. The last replat called for a 2.5 foot TESCo easement on lot R18A. This was an error since the last replat did not include lot R 18A. The existing 5 foot TESCo easement needs to be properly identified on the adjacent lot. This is not a revision to the easement width. This is only a clerical correction. 6. The current zoning needs to be clearly indicated on the face of the plat. 7. We believe this will complement and expand the scope of the existing Ordinance No. 1866. In view of the magnitude of recent park land and facility site acquisitions, the Parks and Recreation Board formed a committee composed of Board Members J. D. Davis, Denny stout, and Recreation Manager Monica Walsh. This committee reviewed other cities' ordinances which addressed the naming of park and recreation facilities. The committee found that the naming-of park and recreation facilities prese~t unique considerations separate and apart from those criteria appropriate to the naming of other city streets or buildings. For instance, some citizens would provide park land or other open space areas at very little cost to the city or by outright donation in return for the naming of such facility for the donor or a loved one. An amendment, such as proposed, could offer encouragement for such donations. Park and recreation facilities have traditionally been named for current and past community members, celebrated person$ in recognition of their special contribution benefitting the public as a whole, as well as names which identify the park or facility geographically (fostering community pirit and local area pride). Under this proposed ordinance, the Parks and Recreation Board will review and evaluate suggested names for parks and recreation facilities and forward their recommendations to city council for final ~pproval. At the March 1, 1993 Parks and Recreation Board meeting the Board unanimously approved forwarding the attached Ordinance No. 1888, amending Ordinance No. 1866, for naming park and-recreation facilities, to the City Council. RECOMMENDATION: The Parks and Recreation Board and Staff recommend that the city Council approve Ordinance 1888, amending Ordinance No. 1866, naming and renaming park lands and facilities. The attached letter from TU Electric proposed the removal of almost all the aerial electric on Bedford-Euless Road from Grapevine Highway to Airport Freeway. Included with this proposal was the reinstallation of steel pole street lights with underground service. The total cost to the City for the street light installation is $ 7,790. The proposal was contingent upon the Texas Department of Transportation (TDOT) approving an appeal to relocate some of the aerial electric lines from Bedford-Euless Road to the south side of the restaurants in the north fringe of the new Loop 820 Interchange right-of-way. TDOT only recently approved the appeal which had to be reviewed in Austin. Due to the street contractor on the Bedford-Eules~ Road Reconstruction Project being at a standstill waiting for TU Electric to relocate, staff approved the proposal prior to Council approval. Fundina Source: Sufficient funds were budgeted by Council October 26, 1992 in PW 92-25 to cover the $7,790 cost for street lights. Dear Mr. Dickens: I have enclosed some information and agreements pertaining to the road construction and street lighting applications at the above mentioned location. Mr. Jim Painter, TU Electric Distribution Engineer, has prepared a work authorization to accommodate your specific needs. Enclosed is a copy of the proposed construction. In addition to the work associated with the road construction is a new street lighting application for the area. It has been proposed to remove the street lights mounted on wood poles and to replace them with street lights on steel standards, thus increasing the aesthetics of the thoroughfare. Taking into consideration the steel pole placement back off of the Right-Of-Way, it has been proposed to utilize longer arms and bulbs with more lumen output. The cost to perform the majority of this work will be absorbed by TU Electric. Other costs associated with the new street lighting application must be passed on to the city. TU Electric's standard policy is to charge a D.I.C. or Difference In Cost for an overhead feed street light on wood poles (standard installation) and an underground feed street light on a steel pole. According to Section 214.001 of the Texas Local Government Code, municipalities are required to establish minimum property standards for the continued use and occupancy of a residential structure. The Uniform Housing Code, 1991 Edition, will provide the legal foundation for implementing a substandard residential structure demolition program. Attached is Ordinance #1883 which will amend the Building Ordinance and adopt the Uniform Housing Code, 1991 Edition. WHEREAS, the City of North Richland Hills adopted a new building ordinance number 1813 on June 22, 1992; and WHEREAS, the building ordinance does not contain a provision for minimum housing standards; and WHEREAS, pursuant to Texas Local Government Code Section 214.001, a city shall establish minimum standards for the continued use and occupancy of all buildings regardless of the date of their construction; now therefore, BE IT ORDAINED BY THE CITY COUNCil OF THE CITY OF NORTH RICHLAND HillS, TEXAS: 1. They made a request for a $5,000 donation to the Arts Council. I have checked with Hurst, Euless and Bedford and all contribute to the Arts Council in varying degrees. Hurst contributes approximately $7,000 and in return the Arts Council presents the IIMasters Work Series II on a monthly basis at their library. Both their City Manager and Assistant City Manager say that this has been extremely well received. In the past our City has contributed $2,500 a year from the Hotel Motel Tax to this organization. This is an appropriate use of the funds as determined by the regulations governing this tax. There are adequate funds in this years budget to cover this request if you so desire. YJ-¿4 Mandates of Senate Bill 1340, 72nd Texas Legislature (1991), requires the Texas Water Commission to develop and implement an automotive used oil management program. The TWC is offering financial assistance to public agencies interested in starting a used oil collection program. with the City Council authorization, Staff will submit an Used- oil Collection Grant application for a $19,000 grant to the TWC. These funds would be used for purchasing 3,000 oil collection containers and to educate the residents of North Richland Hills on the importance of used oil recycling. Residents of North Richland Hills would be able to dispose of their used oil at any Chief Auto Parts store free of charge. Resolution No. 93-24 which states that the City will comply with the terms of the grant program must be submitted along with the grant application. Thomas Powell Assistant Director of the Management Services Department has been responsible for the City's Equipment Services Division since it was implemented in 1987. The Equipment Services Division follows State and Federal guidelines for recycling used oil, oil filters, batteries, and tires. He has attended TWC and EPA seminars on hazardous waste and recycling programs. This person will coordinate monthly activities with Chief Auto Parts and will submit quarterly reports to the TWC. PURPOSE: This project is intended to educate the public regarding proper oil disposal and the importance of recycling while providing a safe and convenient location for disposing of used oil. This would be a pUblic/private venture between the City of North Richland Hills and Chief Auto Parts Inc. Residents would be able to pick up a free oil collection container to use when changing their own oil. This used oil could then be disposed of at any Chief Auto Parts store free of charge. state funds would be used to purchase the containers and to make the public aware of current laws concerning the proper disposal of used oil. The City would provide the staff time needed to implement this program. B. GOALS: 1. Provide the residents of North Richland Hills a convenient means of disposing of used oil. 2. Enhance public awareness of recycling programs and the proper disposal of used oil. 3. Protecting the environment by reducing unlawful dumping of used oil. C. OBJECTIVES/TASKS: 1. The City will purchase 3,000 DIY oil recycling containers at a cost of approximately $6 per container for a total of $18,000. 2. Containers will be àistributed to resiàents of the City of North Richland Hills. 3. DIY generators will dispose of used oil at any Chief Auto Parts store free of charge. Council authorized a budget of $40,000 for this project (PW 92-30) based on a 500/0 assessment of the property owners. The plans are now complete and an assessment roll has been developed. The public hearing date was set by Council at the May 10th meeting (GN 93-61). All notices to the owners of the 5 properties adjacent to the section of Amundson Road where the improve,ments are to be made have been mailed in accordance with the law. Advertisement of the proposed assessment rates and public hearing occurred in a local newspaper on April 25th, May 2nd, and May 9th. Staff recommends the public hearing be opened and the consultant conducting the Enhancement Study be introduced. There exists a public necessity for the improvement of the hereinafter described portions of sanitary sewer in the City of North Richland Hills, that, to wit: (see attached charts) II. Each unit above described shall be and constitute a separate and independent unit of improvement and the assessments herein provided for shall be made for the improvements in each unit according to the cost of the improvements in that unit and according to the benefits arising from the improvements in that unit. Each of the above described portions of sanitary sewer in the City of North Richland Hills, Texas, shall be improved by laying sanitary sewer main and laying sanitary sewer service line stubouts on proper grade and line, and setting manholes where same are not already so constructed, together with any any necessary incidentals and appurtenances; all of said improvements to be constructed as and where shown on the plans in strict accordance with the plans and specifications therefore. V. After bids have been advertised as required by law, and the bid found to be the lowest and best bid for the construction of said improvements, the work of constructing said improvements and contract therefore shall be awarded for the prices stated in the proposal of said company as recorded and recommended by the City's Engineer, which said report and recommendation shall be on file with the City, the Mayor and City Secretary are hereby directed to execute the said contract in the name of the City of North Richland Hills, Texas, and to impress the .corporate seal of the City thereon, the said contract embracing, among other things the prices for the work. VI. To provide for the payment of the indebtedness incurred by the City of North Richland Hills, Texas, by said contract, there is hereby appropriated out of available funds and current revenues of the City, an amount sufficient to pay said indebtedness so incurred. VII. The cost of said improvements as herein defined shall be paid for as follows, to wit: (a) Amundson Road from Walter Drive approximately 760 feet west to Clift Street in the City of North Richland Hills, Texas, the property abutting on that portion of the street to receive sanitary sewer improvements and the real and true owners thereof shall pay for these improvements at the appropriate rate of (see attached charts) linear front foot for all property fronting on said portion of street which in no way exceeds five-tenths (5/10ths) of the estimated cost of the sanitary sewer improvements. (b) The City of North Richland Hills shall pay all of the remainder of the cost of said improvements after deducting the amounts herein specified to be paid by the abutting properties and the real and true owners thereof as set out above in subsection (a). I I I I I I I Ie I I I I I I I {' I Ordinance No. 1 884 Page Three The amounts payable by the abutting properties and the real and true owners thereof shall be assessed against such properties and the real and true owners thereof shall constitute a first and prior lien upon such properties and a personal liability of the real and true owners thereof, and shall be payable as follows, to wit: When the improvements are completed and accepted by the City on a particular unit, the same assessed against property abutting upon such completed and accepted unit shall be and become payable in five (5) equal installments, due respectively on or before thirty (30) days, one (1), two (2), three (3), and four (4) years from the date of such completion and acceptance, and the assessments against the property abutting upon the remaining units shall be and become due and payable in installments after the date of completion and acceptance of such respective unit. The entire amount assessed against the particular parcels of property shall bear interest from the date of such completion and acceptance of the improvements on the unit upon which the particular property abuts at the rate of eight percent (8°;ö) per annum, payable annually except as to interest on the first installment, which shall be due and payable on the date said installment matures, provided that any owner shall have the right to pay any and all such installments at any time before maturity by paying principal, with interest accrued to the date of payment, and further provided if default be made in the payment of any installment promptly as the same matures, then at the option of the City of North Richland Hills or its assigns, the entire amount of the assessment upon which default is made shall be and become immediately due and payable; but it is specifically provided that no assessment shall in any case be made against any property or any owner thereof in excess of the special benefits to property in the enhanced value thereof by means of said improvements in the unit upon which the particular property abuts, as ascertained at the hearing provided by law in force in the City, nor shall any assessment be made in any case until after notice and hearing as provided by law. Said assessments against the respective lots and parcels of property and owners thereof shall be evidenced by certificates of special assessment which shall be executed in the name of the City of North Richland Hills, provided, however, that the City of North Richland Hills retains the right to authorize payment of the sums assessed against property abutting upon such completed and accepted unit in a period of not more than four (4) years in equal regular installments or not less than TEN AND NO/100 DOLLARS each, the first of such installments to become due and payable not more than thirty (30) days after the completion and acceptance by the City of the particular unit, PROVIDED FURTHER, that such method of payments shall be authorized only in instances where the owner or owners of property abutting upon such completed and accepted unit shall have executed and delivered to the City of North Richland Hills, a lawful, valid and binding note and mechanic's and materialman's contract upon forms supplied by the City granting a mechanic's lien upon and conveying the said owner or owners according to the terms thereof of the sums assessed against such property. The assessments against the respective lots and parcels of property and the owners thereof may be evidence by certificates of special assessment, which shall be executed in the name of the City by the Mayor of said City, and the City Secretary shall attest the same and impress the corporate seal of the City thereon, and which may have attached thereto coupons in evidence of the several installments, which the assessment is payable, which certificates shall be issued to the City of North Richland Hills, shall recite the terms and time of payment, the amount of assessment, the description of the property, and the name of the owners, as far as known, and shall contain such other recitals as may be pertinent thereto, and shall further recite substantially that all proceedings with reference to the making of such improvements have been regularly had in compliance with the law, and the prerequisites to the fixing of the assessment lien against the property described in said certificates and the personal liability of the owners thereof, have been regularly had, done and performed, and such recitals shall be prima facie evidence of the matters so recited, and no further proof thereof shall be required in court, and the certificates shall provide substantially that if default be made in the payment of any installment promptly as the same matures, then, at the option of the City of North Richland Hills, or its assigns, the entire amount of the assessment shall be and become immediately due and payable, together with reasonable attorney's fees and costs of collection, if incurred, all of which, as well as the principal and interest on the assessment, shall be first and prior lien against the property, superior to all other liens and claims except State, County, School District, and City ad valorem taxes. No error or mistake in naming any owner or in describing any property or any other matter or thing, shall invalidate any assessment or any certificate issued in evidence thereof, and the omission of improvements on any particular unit or in front of any property except by law from the lien of special assessment for sanitary sewer im provements shall not invalidate any assessment levied. The certificates referred to need not contain recitals in exactly the words a bove provided for, the substance thereof shall suffice, and they may contain other additional recitals pertinent thereto. IX. The City Engineer of the City of North Richland Hills, Texas, be and he is hereby ordered and directed to file with the City Council estimate of cost of such improvements in each unit. X. The City Secretary is directed to prepare, sign and file with the County Clerk of Tarrant County, Texas, a notice in accordance with the provisions of Texas Local Government Code, Title 1 3, Chapter 402, Subchapter D and amendments thereto. XI. The improvements provided for herein shall be made and constructed, notice give, hearing held and assessments levied and all proceedings taken and had in accordance with and under the terms of the powers and provisions of an Act passed at the First Called I I I· I I I I I I -- I I I I I I I ~ I Ordinance No. 1884 Page Five Sessions of the Seventieth and Seventy-first legislature of the State of Texas, and knows as Chapters 149 and 1, respectively, of the Acts of said Sessions, now being shown as Title 13, Chapter 402, Subchapter D, of the Texas Local Government Code, and under which law these proceedings are taken and had. In addition, I have made an mspection of the subject neighborhood and comparable properties referenced in the report. The purpose of this study is to estimate the value influence attributable to each subject parcel by the proposed sanitary sewer lines to be constructed along Amundson Road. A comprehensive investigation was made for market information within the subject neighborhood and this data provides the underlying support for the conclusions derived. Based on the analyses included herein, the value enhancement for each of the subject parcels is considered to exceed the proposed costs allocated to each by the City of North Richland Hills. The narrative report which follows includes a project overview, descriptions of the neighborhood and surrounding market areas, as well as information and exhibits pertinent to the final analyses and conclusions. This was also reflected in interviews with home builders, realtors, and land developers active in the northeastern submarket. Based on these market indicators, a value enhancement within the lower middle limits of the range, or say $5,000 each for the subject lots (Sales No. 2 and No. 3 were considered as one lot due to their unity of use), is sufficient to meet or exceed the proposed assessments for each parcel; and, in my opinion, each of the parcels will be enhanced by a minimum of $5,000 by the proposed sanitary sewer improvements. Said hearing, be and the same is hereby, closed and the said protests and objections, and any and all other protests and objections, whether herein enumerated or not, be and the same are hereby, overruled. The City Council, from the evidence, finds that the assessments herein levied should be made and levied against the re$pective parcels of property abutting upon the said portions of and public places and against the owners of such property, and that such assessments and charges are right and proper and are substantially in proportion to the benefits to the respective parcels of property by means of the improvements in the unit for which such assessments are levied, and establish substantial justice and equality and uniformity between the respective owners of the respective properties, and between all parties concerned, considering the benefits received and burdens imposed, and further finds that in each case the abutting property assessed is specifically benefitted in enhanced value to the said property by means of the said improvements in the unit upon which the particular property abuts and for which assessment is levied and charge made, in a sum in excess of the said assessment and charge made against the same by this ordinance and further finds that the apportionment of the cost of the improvements is in accordance with the law in force in this City, and the proceedings of the City heretofore had with reference to said improvements, and is in all respects valid and regular. III. There shall be, and is hereby, levied and assessed against the parcels of property hereinbelow mentioned, and against the real and true owners thereof (whether such owner be correctly named herein or not), the sums of money itemized below opposite the description of the respective parcels of property and the several amounts assessed against the same, and the owners thereof, as far' as such owners are known, being as follows: (see attached charts) IV. Where more than one person, firm or corporation owns an interest in any property above described, each said person, firm or corporation shall be personally liable only for its, his or hers pro rata of the total assessment against such property in proportion as its, his or her respective interest bears to the total ownership of such property, and its, his or her respective interest in such property may be released from the assessment lien upon payment of such proportionate sum. V. The several sums above mentioned and assessed against the said parcels of property, and the owners thereof, and interest thereon at the rate of eight percent (8 %) per annum, together with reasonable attorney's fees and costs of collector, if incurred are hereby declared to be and are made a lien upon the respective parcels of property against which the same are assessed, and a personal liability and charge against the real and true owners of such owners be correctly named herein or not, and the said liens shall be and constitute the first enforceable lien and ciaim against the property on which such assessments are levied, and shall be a first and paramount lien thereon, superior to all other liens and claims, except State and County, School District and City valorem taxes. I I I I I I I Ie I I I I I I I I· I Ordinance No. 1885 Page Three The sums so assessed against the abutting property and the owners thereof shall be and become due and payable as follows, to wit: in five (5) equal installments, due respectively on or before thirty days (30), one (1), two (2), three (3), and four (4) years from the date of completion and acceptance of the improvements in the respective unit, and the assessments against the property abutting upon the remaining units shall be and become due and payable in such installments after the date of the completion and acceptance of such respective units, and shall bear interest from said date at the rate of eight percent (80/0) per annum, payable annually with each installment except as to the first installment, which shall be due and payable at the maturity thereof, so that upon the completion and acceptance of the improv'ements in a particular unit, assessments against the property abutting upon such completed and accepted unit shall be and become due and payable in such installments, and with interest from the date of such completion and acceptance. Provided, however, that any owner shall have the right to pay the entire assessment, or any installment thereof, before maturity by payment of principal and accrued interest, and provided further that if default shall be made in the payment of any installment or principal or interest promptly as the same matures, then the entire amount of the assessment upon which such default is made shall, at the option of said City of North Richland Hills, or its assigns be and become immediately due and payable, and shall be collectible, together with reasonable attorney's fees and costs of collection incurred, PROVIDED, however, that the City of North Richland Hills retains the right to authorize payment of the sums assessed against property abutting upon such completed and accepted unity over a period of not more than four years in equal regular installments or not less than TEN AND NO/100 DOLLARS ($10.00) each, the first year installments to become due and payable not more than thirty days (30) after the completion and acceptance by the City of the particular unit, and PROVIDED FURTHER that such method of payment shall be authorized only in instances where the owner or owners of property abutting upon such completed and accepted unit shall have executed and delivered to the City of North Richland Hills granting a mechanic's lien upon and conveying to the said abutting property in trust to secure the payment of said owner or owners according to the terms thereof of the sums assessed against such property. VI. If default shall be made in the payment of any assessment, collection thereof shall be enforced either by the sale of the property by the City of North Richland Hills as near as possible in the manner provided for the sale of property for the nonpayment of ad valorem taxes, or at the option of the City of North Richland Hills, or its assigns, payment said sums shall be enforced by suit in any court of competent jurisdiction or as provided in any mechanic's or materialman's contract as foresaid, and said City shall exercise all of its lawful powers to aid in the enforcement and collection of said assessments. VII. The total amount assessed against the respective parcels of abutting property, and the owners thereof, is in accordance with proceedings of the City relating to said improvements and assessments therefore, and is less than the proportion of the cost allowed and permitted by the law in force in the City. Although the aforementioned charges have been fixed, levied and assessed in the respective amounts hereinabove stated, the City Council does hereby reserve unto itself the right to reduce the aforementioned assessments by allowing credits to certain property owners where they are currently served by the public sanitary sewer system. Notwithstanding the City Council has herein reserved the right to issue credits as hereinabove provided, it shall not be required to issue such credits, and will not do so, if same would result in any inequity and/or unjust discrimination. The principal amount of each of the several assessment certificates to be issued the City of North Richland Hills, Texas, as hereinafter provided, shall be fixed and determined by deducting from the amount of any assessment, hereinabove levied such amount or amounts, if any, as may hereafter be allowed by the City Council as a credit against the respective assessments. IX. For the purpose of evidencing the several sums assessed against the respective parcels of abutting property and the owners thereof, and the time and terms of payment to aid in the enforcement and collection thereof, assignable certificates in the principal amount of the respective assessments less the amount of any respective credit allowed thereon, shall be issued by the City of North Richland Hills, Texas, upon completion and acceptance by the City of the improvements in each unit of improvement as the work in such units is completed and accepted, which certificates shall be executed by the Mayor in the name of the City and attested by the City Secretary, with the corporate seal of the City of North Richland Hills, or its assigns, and shall declare the said amounts, time and term of payment, rate of interest, and the date of completion and acceptance of the improvements abutting upon such property for which the certificate is issued, and shall contain the name of the owners, if known, description of the property by lot and block number, or front feet thereof, or such other descriptions as may otherwise identify the same; and if said property shall be owned by an estate, then the description of same as so owned shall be sufficient and no error or mistake in describing any property, or in giving the name of the owner, shall invalidate or in anyway impair such certificate, or the assessments levied. The certificates shall provide substantially that if same shall not be paid promptly upon maturity, then they shall be collectible, with reasonable attorney's fees and costs of collection, if incurred and shall provide substantially that the amounts evidenced thereby shall be paid to the City Secretary of the City of North Richland Hills, Texas, who shall issue his receipt therefore, which shall be evidence of such payment on any demand for the same, and the City Secretary shall deposit the sums so received in a separate fund, and when any payment shall be made to the City Secretary, upon such certificate shall, upon presentation to him of the certificate by the holder thereof, endorse said payment thereon. If such certificate be assigned then the holder thereof shall be entitled to receive I I. I I I I I I I Ie I I I I I I I ~ I Ordinance No. 1885 Page Five from the City Secretary the amount paid upon presentation to him of such certificate so endorsed and credited; and such endorsement and credit shall be the Secretary's Warrant for making such payment. Such payment by the Secretary shall be receipted for by the holder of such certificate in writing and by surrender thereof when the principal. together with accrued interest and all costs of collection and reasonable attorney's fees if incurred have been paid in full. Said certificate shall further recite substantially that the proceedings with reference to making the improvements have been regularly had in compliance with the law, and that all prerequisites to the fixing of the assessment lien against the property described in such certificate and the personal liability of the owners thereof have been performed, and such recitals shall be prima facie evidence of all the matters receipted in such certificates, and no further proof thereof shall be required in any court. Said certificates may have coupons attached thereto in evidence of each or any of the several installments thereof, or may have coupons for each of the first four installments, leaving the main certificate to serve for the fifth installment, which coupons may be payable to the City of North Richland Hills, or its assigns may be signed with the facsimile signatures of the Mayor and City Secretary. Said certificates shall further recite that the City of North Richland Hills, Texas, shall exercise all of its lawful powers, when requested to do so, to aid in the enforcement and collection thereof, and may contain recitals substantially in accordance with the above and other additional recitals pertinent or appropriate thereto; and it shall not be necessary that the recitals be in the exact form set forth, but the substance thereof shall be sufficient. The fact that such improvements my be omitted on any portion of any of said units adjacent to any premises except from the lien of such assessments shall not in anywise invalidate, affect or impair the lien of such assessment upon other premises. x. Full power to make and levy assessments and to correct mistakes, errors, invalidities or irregularities, either in the assessments or in the certificates issued in evidence thereof, is in accordance with the law in force of this City, vested in the City. XI. All assessments levied are a personal liability and charge against the real and true owners of the premises described, notwithstanding such owners may not be named, or may be incorrectly named. XII. The assessments so levied are for the improvements in the particular unit upon which the property described abuts, and the assessments for the improvements in any units are in no way affected by the improvements or assessments in any other unit and in I I. XIII. The assessments levied are made and levied under and by virtue of the terms, powers and provisions of an Act passed at the First Called Session of the Seventieth and Seventy-first Legislature of the State of Texas, and known as Chapters 149 and 1, respectively, of the Acts of said Sessions, now being shown as Title 13, Chapter 402, Subchapter D, of the Texas Local Government Code. XIV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of North Richland Hills, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. This project includes repainting of the Starnes Road 500,000 gallon elevated water storage tank along with miscellaneous site improvements. All construction and testing procedures have been based on the latest Federal guidelines concerning lead and other hazardous materials containment and disposal. We understand that the City has monitored laboratory testing results to verify compliance with the plans and specifications. The quantities and conditions of the project have been verified on-site by your representative, Mr. Larry Jones, as indicated by his signature on the estimate dated May 5, 1993, and we have checked the item extensions and additions. Mr. Jones has made changes to the Contractor's submittal as indicated on the request for payment form. The two (2) year period of maintenance begins on this date and therefore will terminate on May 5, 1995. "The maintenance obligation includes repair of all constructed welded connections failures, repair of cracks or other failures in concrete overflow and drain line structure, repair of installed water line leaks or other water system appurtenances, repair of installed electrical or cathodic protection system failures, repair of paint chipping, cracking, or otherwise defective surfaces. The maintenance obligation shall also include a visit to the site by a representative of the Contractor and his paint supplier just prior to the expiration of the two year warranty period to scrutinize all accessible welded and painted areas and arrange for warranty corrections, if any are found. Such visit shall be in company with a representative of the Ownertt. (See spec itelTI 3.2.11(a». The scheduled completion date was October 9, 1992, based on a work order date of June 1, 1992, and a contract completion time of 130 calendar days. The contractor requested an extension in time by letter dated October 5, 1992, (copy attached), due to equipment delivery delays for electrical materials, cathodic protection system, and weather delays. Agenda Numbe~AY 93-11 The construction of Richfield Park Parking Lot has been completed on time and under budget, representing the first major project completed using proceeds from the parks and recreation sales tax revenue. The new parking lot provides 420 parking spaces and has been enthusiastically received by the park users. A final inspection was performed on March 23, 1993, and the staff and consultant, Knowlton, English, Flowers, Inc. recommend approval of final payment to the contractor, Austin Bridge and Road, Inc. in the amount of $33,225.30. The construction was completed 11 days under the contract completion time and $4,406.08 under the total contract amount. Although the final pay request is in the amount of $33,563.30, the contractor is responsible for $338.00 in emergency repairs to the restroom/concession building which was damaged by vandals having access to unsecured equipment stored by the contractor at the park. The quantities and condition of the project have been verified on-site by your representative, Mr. Ken Matheson, as indicated by his signature on the estimate, and we have checked the item extensions and additions. Based on estimated quantities and contract unit prices the contractor's earnings total to $335,633.04 which is $4,406.08, (0.99-percent), under the total contract amount of $340,039.12. The total contract amount includes the original contract amount plus two (2) Change Orders. Please see the attached "Construction Project Status Report" for the differences in estimated contract quantities and final as-built quantities and for costs of each pay item in the project. The contract completion date was March 21, 1993. The substantial completion date was March 10, 1993, which was 11 days under the Contract Completion Time of 104 calendar days. A final inspection walk through was performed on March 23, 1993 where discrepancies were found and noted.
