No. IR 95-120 ,-/ * Date: October 23, 1995 Subject: Texas Recycles Day This year November 15, 1995 has been designated as TEXAS RECYCLES DAY by the Texas Natural Resource Conservation Commission. The City of North Richland Hills is planning to celebrate the day with a planned event to be held on the parking lot of Home Depot from 3:00 p.m. to 6:00 p.m. on that Wednesday. We have established a partnership between several area businesses to include Home Depot, Sack 'N Save, Chief Auto, and Laidlaw working with city staff and the Beautification Commission, North East Environmental Team (NEET) and Habitat for Humanity to collect all sorts of recyclables. There will be demonstrations by Master Gardeners on using native Texas plants for Xeriscaping and Master Com posters on backyard composting. In addition, we are planning a "Can Smash for Kids" contest where children can bring whole aluminum cans and participate in an event to see how many cans they can smash during a designated time limit. Prizes will be given to the winners and all proceeds from aluminum cans will be donated to the Animal Services Center Shelter Fund. Laidlaw has agreed to provide one of their recycle trucks to collect various types of paper, glass, plastic, cardboard, steel and aluminum cans and newspaper and we will target apartment complexes in North Richland Hills with special mailings to let them know about the event. Habitat for Humanities will be there to collect usable construction materials for their various projects. We plan to send a special mailing to the area builders to ask them to participate by donating any usable materials such as doors, windows, hardware, or lumber which can be used by Habitat for Humanities. We are working to secure a tractor/trailer to be donated locally to collect and haul the donated materials for Habitat for Humanities. In addition, we plan to set up a pet recycle display to encourage recycling through adoption of a pet from the Animal Services Center, offering special discounts during that week. Signs As part of Tarrant County's "LlD" program to combat illegal dumping, we have been offered metal signs similar in size to speed limit signs to place in strategic locations around North Richland Hills. Working with Community Development and Park and Recreations Departments, we have identified several locations where the signs are needed. These signs are provided free of charge and installed at no cost to the City. The locations identified for sign placement are as follows: 1. Davis and North Tarrant Parkway 2. Smithfield and North Tarrant Parkway 3. Cardinal and Amundson 4. Cardinal and Grapevine 5. Precinct and Martin 6. Onyx Drive South and Billie Faye 7. Smithfield and Shadygrove Tarrant County will be installing these signs at the above locations in the near future. Motion carried 6-0. - Mr. Michael Tarko, 6901 Watauga Road, appeared before the Council. Mr. Tarko expressed his opposition to the name change. Mr. Tarko was also concerned that the proposed ordinance did not provide for the dual name on the street signs that was mentioned in the letter he received from the City. Mayor Brown advised that City Staff had assured Council that a dual street sign would be maintained for a minimum of two years. Mayor Brown stated that Council could also make a motion to maintain dual names on one sign for two years. Ms. Jo Ann King, 6925 Watauga Road, appeared before the Council. Ms, King owned a business and felt the name change would be expensive. Ms. King also did not feel that "Mid Cities Boulevard" was an appropriate name, Councilman Sibbet moved, seconded by Mayor Pro Tem Johnson, to amend the motion approving Ordinance No, 2080 with the stipulation that the dual name remain on the City Council Minutes October 9, 1995 Page 5 street signs for two years after the street name has been changed to Mid Cities Boulevard. CALL TO ORDER Ms. Pultz called the meeting to order August 15, 1995 at 7:04 p.m. 2. APPROVAL OF THE MINUTES Ms. Lueck made a motion, seconded by Ms. Ward, to approve the minutes of the July 18, 1995 Beautification Commission meeting. Motion carried 6 - O. 3. DRAFTING OF TREE ORDINANCE Ms. Pultz brought before the Commission the suggestion for Ms. Dunkelberg to draft a tree ordinance for the City. Ms. Tucker made the motion with Ms. Ward seconding the motion, Motion passed 6-0. 4. STAFF REPORTS Tim Hightshoe mentioned the lightpole banners for NRH20 would soon be removed. The water park is scheduled to close for the season after Labor Day. 5. DISCUSSION OF OTHER ITEMS/CITIZEN INPUT Ms. Ward requested for the Commission to look into a new location for the recycling of Christmas trees. Her suggestion was to possibly move the location to the other side of the barn, Mr. Hightshoe stated that he would research and report to the Commission at the next meeting. Discussion was held for exact dates for the Christmas tree lighting and Christmas tree recycling. At the conclusion of the discussion it was decided, the dates of December 5, 1995 for the Christmas tree lighting and January 6, 1996 for Christmas tree recycling, Ms. Tucker made an inquiry of updated guidelines for the Adopt-A-Spot program. The updated guidelines would ensure that any citizen making this request would have specific guidelines to follow for the program, Mr. Hightshoe said that he would contact other cities and see what guidelines each was currently using to see if we could incorporate into our City program. Ms. Pultz proposed to make the October workshop dedicated to revising the Adopt-A- Spot program. Ms. Dunkelberg informed the Commission in more detail of the Water Monitors responsibilities with a handout of the testing requirements. The responsibilities consist of monitoring 7 sites and the approximate time required 6 hours, Ms. Tucker inquired about environmental conditions affecting the test, such as wind, temperature, etc. Ms. Dunkelberg told the Commission that a twenty year database is being set up to see how all factors tie in together. Sandra Miller ~ j Secretary ìepartment: '-- Subject: CITY OF NORTH RICHLAND HILLS Planning and Inspections - Council Meeting Date: 10/23/95 Request of Glen Good to rezone Tract A, Block 25, Agenda Number: Holiday North Addition, from R-7-MF Multi-Family Residential to a Planned Development for an Assisted Living Center. (Located in the 78.00 block of North Richland Boulevard) PZ 95-05 Ordinance No. 2043 This item was postponed by the City Council at the April 10, 1995 at the request of the applicant. Mr. Glen Good has submitted an application for a Planned Development district on property located at the northwest corner of Ross Road and North Richland Boulevard. He intends to construct an Assisted Living Center on the site. The property is currently zoned R-7-MF Multi-Family Residential. Since an Assisted Living Center is an uncommon type of land use activity, the developer is requesting a Planned Development designation to allow the use. The proposed Assisted Living Center is a single story brick structure housing 80 beds. The proposed building is shaped in the form of an "H", and a courtyard area is provided in between each wing. The following are other items associated with this request: '---- 1. The applicant has submitted a site plan of the property (see attached site plan). The site plan shows all items as required by the Zoning Ordinance with the exception of sign elevations and locations. The property is approximately 4.7 acres in size. The Assisted Living Center will generally occupy a 129,000 square foot building site on the property. The actual building will be approximately 37,700 square feet in size. 2. Access to this property will be from North Richland Boulevard and Ross Road. The applicant proposes one driveway on North Richland Boulevard and two driveway locations on Ross Road. All driveways will be designed and constructed in accordance with Public Works design criteria. 3. There are 41 parking spaces provided on the property. The Ordinance requires 40 spaces (1.5 spaces for each 3 beds). 4. The Landscaping Regulations require that 15% of the lot, or its equivalent, be maintained as a landscaped area. The applicant proposes to provide 46% of the building site area as a landscaped area. The courtyards will be accessible from the building or through gates located at each end. 6. Sidewalks will be provided along Ross Road and North Richland Boulevard. The Planning and Zoning Commission considered this item at its March 9, 1995 meeting and recommended approval. The City Council conducted a Public Hearing for this request at its March 27, 1995 meeting. The City Council postponed action on this request at the April 1 0, 1995 meeting at the request of the applicant. Mr. Glen Good has submitted an application for a Planned Development district on property located at the northwest corner of Ross Road and North Richland Boulevard. He intends to construct an Assisted Living Center on the site. The property is currently zoned R-7-MF Multi-Family Residential. Since an Assisted Living Center is an uncommon type of land use activity, the developer is requesting a Planned Development designation to allow the use. The proposed Assisted Living Center is a single story brick structure housing 80 beds. The proposed building is shaped in the form of an "H", and a courtyard area is provided in between each wing. The following are other items associated with this request: ""- 1. The applicant has submitted a site plan of the property (see attached site plan). The site plan shows all items as required by the Zoning Ordinance with the exception of sign elevations and locations. The property is approximately 4.7 acres in size. The Assisted Living Center will generally occupy a 129,000 square foot building site on the property. The actual building will be approximately 37,700 square feet in size. 2. Access to this property will be from North Richland Boulevard and Ross Road. The applicant proposes one driveway on North Richland Boulevard and two driveway locations on Ross Road. All driveways will be designed and constructed in accordance with Public Works design criteria. 3. There are 41 parking spaces provided on the property. The Ordinance requires 40 spaces (1.5 spaces for each 3 beds). 4. The Landscaping Regulations require that 15% of the lot, or its equivalent, be maintained as a landscaped area. PZ 95-05 Public Hearing to consider the request of Glen Good to rezone Tract A, Block 25, Holiday North Addition, from R-7-MF Multi-Family Residential to a Planned Development for an Assisted living Center. This property is located in the 7800 block of North Richland Boulevard. Mr. Husband stated the request for a Planned Development is for an Assisted living Center. He stated this use is not allowed in an R-7-MF district. He stated the Commission might consider rezoning the entire tract to a PO to prevent a portion of the lot from becoming non- conforming in relation to the multi-family regulations. Mr. Husband stated the developer would be able to amend his site plan as part of the PO if he does develop the remainder of the lot. Vice-Chairman Barfield asked what the difference between a planned development and a traditional zon ing district is. Mr. Husband stated a Planned Development is a zoning district unto itself. He stated it allows more flexibility in the types of uses and development requirements, but restricts development of the property to that specified in the approving ordinance. Vice-Chairman Barfield opened the Public Hearing and called for those wishing to speak to come forward at this time. Mr. Glen Good, 4424 Misty Meadow, Fort Worth, came forward to speak. He stated he is the owner and operator of this project. He stated they have a similar facility in Arlington. Mr. Good stated the facility is a 24-hour care facility licensed by the state. He stated an assisted living center is a step below a nursing care facility and one step above a retirement center. He stated the residents are ambulatory. Mr. Good stated some of the residents need assistance with cooking, dressing, medication, and hygiene. He stated they offer transportation services and have activities on site. He stated the residents pay their own way. He stated the state inspects the facility twice each year. Mr. Good stated the project will cost about $3.5 million. He stated the facility will be affordable to those on social security or other pension funds, He stated they may accept some Medicaid patients. He stated most of them stay in the facility but are encouraged to take part in social activities outside the facility. Since the Texas Legislature, during the most recent past session, established insurance requirements for house movers operating over State regulated highways at $500,000 combined single limits, it seems appropriate to adopt this requirement for house movers who operate in North Richland Hills. Attached is Ordinance 2084 which amends the North Richland Hills Building Code to insert this new insurance requirement for house moving contractors. In addition, the existing $200 house moving permit fees is recommended to be changed to $50 so that the cost of the permit is more in line with the actual inspection services rendered. I know that your day is filled with many problems that arise almost hourly and it was very nice of you to visit with me briefly about this matter. As I understand it, you are going to look into the problem that I related to you. We would appreciate your considering lowering the permit fee on house removals from $200 to perhaps $25 or $30 or less. Once a house is gone, there is absolutely nothing left to inspect. Also, it is somewhat out of character with the permitting schedules of most other Texas cities. The lifting of power lines, etc. is entirely apart from and does not bear any relationship to this permit fee. Once a house is gone, it's gone, and all that is left to inspect is a vacant lot in most cases. Also, you might wish to think about going ahead and posting an insurance requirement that is consistent with good reason and protective of your people there. The City has had very good experience with this equipment as it has been extremely reliable. The maintenance service is fast and good. Reliability and performance are important factors with equipment that is heavily depended upon. The difference in monthly payments ($167) between Felco and Xerox can be justified in the known dependability of this equipment. Also, each machine will be on a separate contract. This will make future upgrades easier to accomplish and the City will have greater flexibility at the end of each contract term. The City Council finds and determines the necessity for these improvements and orders same. 3. That a portion of the estimated cost of $485,752.65 be paid for by assessment of abutting property owners and the abutting property based upon the front foot rule. 4. The assessments made and established by this ordinance are on the property shown on the assessment rolls attached to this ordinance as Exhibit "A". 5, The assessment against each owner and each tract shall be paid to the City of North Richland Hills in five equal installments as follows: The first installment shall be due ninety days from the date the project is finished and approved by the City; the second installment shall be due one year from the date the first installment is due; the third installment shall be due one year from the date the second installment is due, the fourth installment shall be due one year from the date the third installment is due and the fifth installment shall be due one year from the date the fourth payment is due. The rate of interest on the assessment shall be 8% per annum which shall begin to run from the date the project is finished and approved by the City, Nothing contained herein shall prevent the entire assessment from being paid in one payment. A personal liability and charge against the owner of the abutting property, regardless of whether or not he is named, is hereby assessed, as well as the assessment against the property. 6. A lien is hereby established against each tract of land abutting the project as shown on the assessment rolls (Exhibit "A", hereto). 7. The City Secretary is authorized and ordered to file the liens created hereby with the office of the County Clerk of Tarrant County, Texas. 8. Summary of Reasoning and Conclusion of Value Several sales of properties within the subject neighborhood and competing neighborhoods were analyzed in order to arrive at an opinion of the subject tract. Four of these sales have been attached to this letter and were the primary basis in forming an opinion of value for the subject tract. In addition, several older sales of property located throughout the city of North Richland Hills have been compared primarily for determining the difference in price of property on streets with concrete curb and gutter and storm sewer facilities compared to the price of otherwise similar tracts, with the exception that they were on unimproved streets without concrete curb and gutter or storm sewer facilities. It is my opinion that the remainder subject property fronting on Harmonson with concrete curb and gutter and drainage facilities has a value 5% greater than that which existed prior to the Harmonson Road Improvement Project. For the subject property it is my opinion that the market value prior to Harmonson Road Improvement was $1.50/SF. It is also my opinion that the property has been enhanced by 5% as a result of the Harmonson Road Improvement Project or 5% times $1.50 is $0.075/SF. DlrectOf ORDINANCE NO, 2082 AN ORDINANCE MAKING SPECIAL ASSESSMENTS FOR STREET, CURB AND GUTTER, DRAINAGE AND SIDEWALK IMPROVEMENTS ON A PORTION OF HIGHTOWER DRIVE; CLOSING A PUBLIC HEARING; PROVIDING FOR PAYMENT IN ANNUAL INSTALLMENTS; PROVIDING FOR RECORDING THE LIEN WITH THE COUNTY CLERK AND ADOPTING ALL STATUTORY POWERS. WHEREAS, the City Council has heretofore examined and approved the estimates for construction of street, curb and gutter, drainage, and sidewalk improvements on Hightower Drive from Rufe Snow Drive east a distance of 1200 feet, more or less, a public street, and has set a time and place for a public hearing on assessment of abutting property; and WHEREAS, said assessment hearing has been held this date and all owners of abutting property have been given the right to offer protests and suggestions concerning all aspects of the assessment for said improvements; and WHEREAS, all notices have been lawfully published and mailed and all things have been done to perfect the passage of this assessment ordinance. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, that 1. The public hearing be closed. 2. That the previous approval of the estimate of costs of these improvements on Hightower Drive is hereby ratified and affirmed. The City Council finds and determines the necessity for these improvements and orders same. 3. That a portion of the estimated cost of $603,000.00 be paid for by assessment of abutting property owners and the abutting property based upon the front foot rule. 4. The assessments made and established by this ordinance are on the property shown on the assessment rolls attached to this ordinance as Exhibit "A". 5, The assessment against each owner and each tract shall be paid to the City of North Richland Hills in five equal installments as follows: The first installment shall be due ninety days from the date the project is finished and approved by the City; the second installment shall be due one year from the date the first installment is due; the third installment shall be due one year from the date the second installment is due, the fourth installment shall be due one year from the date the third installment is due and the fifth installment shall be due one year from the date the fourth payment is due. The rate of interest on the assessment shall be 8% per annum which shall begin to run from the date the project is finished and approved by the City, Nothing contained herein shall prevent the entire assessment from being paid in one payment. A personal liability and charge against the owner of the abutting property, regardless of whether or not he is named, is hereby assessed, as well as the assessment against the property. 6. A lien is hereby established against each tract of land abutting the project as shown on the assessment rolls (Exhibit "A", hereto). 7. The City Secretary is authorized and ordered to file the liens created hereby with the office of the County Clerk of Tarrant County, Texas. 8. The City Council declares that it has adopted this ordinance pursuant to the laws of the State of Texas and all of the powers and rights given to Home Rule Cities in the laws granting assessment powers are adopted and incorporated herein by reference the same as if set out verbatim. During construction two change orders were executed in the amount of $6,479 for additional painting, carpet and miscellaneous work necessary to complete the project. Sufficient funds are available for these changes.
