Concurrently , citizen volunteers from North Richland Hills and the Fort Worth Nature Center are preparing a bio- inventory and natural habitat assessment. In preparation for making this bio-inventory, mowing was discontinued for a time to enable assessment of the plants on the site. This assessment has been completed. Short term and long term mowing plans need to be developed, including information from the Fort Worth Nature Center. On the other hand, citizens residing in the area have expressed concern about excessive growth of grass and weeds. Of the 100 acres site, approximately 40 acres includes dense tree coverage. Native blue stem grasses and wild flower meadows encompass approximately 30 acres of the interior. If this area is to be preserved, the native grasses and wildlife habitat should be left unmowed. The western portion of the park along Douglas, south of Bursey Road, does not have any major natural significance. This area, along with the area north of North Ridge Elementary (Adventure World), can be mowed on a regular basis. Also, a boundary strip adjacent to residences can be mowed regularly to avoid creating a nuisance and fire hazard. It is requested that the City Council provide guidance regarding mowing of the 100 acre City Park, taking into account environmental concerns as well as citizens' requests. I, Ie I I I I I I I Ie I I I I I I Ie I I INFORMAL REPORT TO MAYOR AND CITY COUNCIL No. IR 93-153 Date: October 11, 1993 Subject: RUFE SNOW DRIVE from Loop 820 to Lewis Drive; Raised Median This section of street has had a large number of accidents due to vehicles attempting to cross the opposite lanes of traffic. The Council recently asked staff to review the cost of installing a median down this entire section of street and stop any left turning movements or any crossing movements at the Tapp Addition signal in front of McDonald's. Our estimated cost for installing a curb and gutter median with pavestone is $63,000. Our estimated cost for installing curb and gutter with a concrete median is $48,000. Upon Council's instruction, staff will proceed with the median project. If a funding source can be located, the project will be presented at a future Council meeting for formal action. GN 93-86 RECONSIDERATION OF GREEN VALLEY SOCCER COMPLEX APPROVED Mayor Brown advised this was not a public hearing. Several meetings had been held with the City Staff and residents of the area. Ms. Terri Mace, 7506 Aubrey Lane, appeared before the Council. Ms. Mace stated she had been involved with the project since it began. Ms. Mace felt the residents of other areas should not be involved in the development of the park. Ms. Mace felt that the proposed site was not appropriate for the area. If the project was put to a public vote it would fail. Mayor Brown called for a vote on the Neighborhood Plan. Motion failed 5-2; Mayor Pro Tern Welch, Councilwomen Spurlock and Johnson, and Councilmen Wood and Oujesky voting against, and Councilmen Garvin and Sibbet voting for. Councilwoman Johnson moved, seconded by Mayor Pro Tern Welch, to approve Concept Plan 3/3A. Councilwoman Johnson expressed her appreciation to the citizens for their concern and to the Park and Recreation Board members for their time spent working on the project. Councilman Oujesky advised he felt a difficult issue was being resolved. He supported soccer, but did not support the proposed plan. Councilman Garvin advised the plan was subject to change. He felt the Neighborhood Plan was a good plan. He would support a motion to move to another site. Mayor Pro Tem Welch advised he had said if a compromise would not be reached he would make a motion to sell the property. He will support the motion to approve Concept Plan 3/3A. Councilman Sibbet advised he supported soccer, but felt the proposed site was not the right place for the complex. Motion to approve Concept Plan 3/3A carried 4-3; Mayor Pro Tern Welch, Councilwomen Johnson and Spurlock and Councilman Wood voting for and Councilmen Garvin, Sibbet and Oujesky voting against. The Animal Care and Control Division has been working on this application for a year at the request of the Animal Shelter Advisory Board. Our application was submitted and the on-site inspection was performed in May, 1993. American Humane Association (AHA) sent an evaluator to spend the day at the Center observing the facility and the staff in operation. The on-site evaluator, Richard Meyer with the Animal Protection Division of AHA toured the Center and spoke with staff members as well as video taped our facilities and equipment including vehicles and the new crematorium. He looked at all aspects of our facility and programs. In addition to the on-site inspection, we were required to submit all of our forms, ordinances, a copy of our Policy and Procedure Manual, photographs of the ACOs' in uniform and any material associated with our outreach programs such as Warm Hugs on Wheels and the school education presentations. It should be noted that there are five parts to the program: Facilities and Staff; Operational Program; Euthanasia; Community Relations and Education; and Planning, each of which is looked at and evaluated separately. Our Center is among the few shelters to receive recognition in all five categories. In addition to this recognition the program also has provided valuable suggestions to further improve our facilities and program. On being accepted into the program we join more than sixty other shelters around the country as being recognized as having one of the top quality facilities and services in the animal care and protection field. I would like the City Council to know that our recognition and admittance into the program is due in part to the excellent facility that the City Councif supported and also to the excellent staff of the Animal Care and Control Division. Without an outstanding staff to maintain the facilities and provide a high level of services to our community we would not have been able to secure this prestigious award. We will be issuing the attached Press Release provided to us by AHA to area media and press. The property is currently zoned 1-2 Medium Industrial, and the proposed use is allowed in the 1-2 district with a Special Use Permit. MetroCel has applied for a Special Use Permit to allow the facility on the site. MetroCel intends to lease a suite in the shopping center for the purpose of housing their communications equipment. The tower itself will be constructed near the northwest corner of the property and behind the existing building (see attached site plan and drawings). This portion of the site is in the corner of the shopping center that is the farthest from both Rufe Snow Drive and Hilltop Drive. The tower will occupy 324 square feet on the ground. All zoning districts limit the height of structures. However, structures such as antennas are exempt from the maximum height requirement. MetroCel's proposed tower is a 75-foot tall monopole antenna. Since this is a Special Use Permit application, the City Council can impose development restrictions as provided for in Article 5, Section 400, of the Zoning Regulations. A copy of this Section is attached for your reference. The Planning and Zoning Commission considered this request at their September 23, 1993 meeting and recommended approval. This property is located at the northwest corner of Rufe Snow Drive and Hilltop Drive. Chairman Brock opened the Public Hearing and called for those wishing to speak to come forward at this time. Mr. Doug Athas, of MetroCel, 17300 North Dallas Parkway, Dallas, came forward to speak. He stated this tower is needed to continue coverage in this portion of North Richland Hills. He stated there are not enough facilities in this area to handle the cellular phone traffic. Mr. Athas stated the tower would be located in the back corner of Hilltop Square. He stated the power line poles are taller than the proposed tower. He stated this use fits into the industrial nature of the area. There being no one else wishing to speak, Chairman Brock closed the Public Hearing. Mr. Baxter asked what type of eight-foot security fence is proposed. Mr. Athas stated it would be chain link with barbed wire on top. Mr. Baxter asked what provisions have been made for removal of the tower when the lease expires. Mr. Athas stated one of the conditions of the lease is that they remove the tower when the lease is terminated. He stated they project the use of this tower to be 30 years or longer, but the tower would be removed if the lease is terminated. Mr. Wilson asked if the tower meets all other federal regulations regarding this type of use. Mr. Athas stated yes. He stated it is a monopole antenna, with a platform at the top. Mr. Lueck asked what is at the top of the pole. Mr. Athas stated it is a triangular platform with antennas on each side of the triangle. Mr. Lueck asked if there has been any interference with other types of radio waves. Mr. Athas stated the spectrum is assigned by the Federal Communications Commission and is unique to MetroCel. A Special Use Permit may be authorized for a specifIC site for an additional land use when such use is determined to not have adverse effect on sunounding properties and, when such use is consistent with the purpose of the zoning distrid. B. General Provisions A Special Use Permit shall constitute an amendment to the Zoning Ordinance and shall be processed according to the procedures established for all amendments to the Zoning Ordinance. Special Use Pennits will be issued to the site being considered and be subject to any time limitations imposed by the City Council during the approval process. C. Procectu... 1. Application Procedure · The applicant requesting a Special Use Permit shall submit a written application and furnish plans and data concerning the operation, location, function and characteristics of any use of the land or building being proposed. The Planning and Zoning Commission may consider an application for a Special Use Permit for a parcel of land in those districts established in the Table of Permitted Uses, contained in Section 310. All applications for a Special Use Permit shall be treated in the same manner as an amendment to this Ordinance as prescribed in Section 200, Amendments. 2. Special Site Plan Requirements· A site plan shall accompany every application for a Special Use Permit. Such site plan shall Include all the contents established for Site Plans contained in Sedion 510, and such plan, when approved, shall be made a part of the amending ordinance. 3. Public Hearing · After a public hearing conducted by the Planning and Zoning Commission and after receiving a recommendation from the Planning and Zoning Commission, the City Council shall conduct a public hearing to obtain citizen input. 4. Conditions Related to Approval · Each Special Use Permit application shall be evaluated by the Planning and Zoning Commission and City Council as to its probable effect on the adjacent property and the community welfare and may be approved or denied as the findings indicate appropriate. In considering an application for a Special Use Permit, the Planning and Zoning Commission shall review the following conditions associated with the proposed operation: a. Other conditions or restrictions as shown on the site plan The Planning and Zoning Commission may recommend safeguards or conditions of approval to reduce the effect on adjacent or surrounding properties. The City Council may, in the public welfare and to assure compliance with the intent of this Ordinance, require such development standards and safeguards as recommended by the Planning and Zoning Commission. Applicants shall comply with the terms and conditions of the Special Use Permit for the duration of the Certificate of Occupancy; noncompliance shall be considered a violation of this Ordinance. 5. Building Permit Compliance · No building permit for any structure shall be issued, nor shall a Certificate of Occupancy be issued on any existing structure, until such development plans are consistent with the approved site plan and the conditions established for the Special Use Permit. Building permits must be consistent with the site plan and must comply with design standards, policies, and any design criteria deemed necessary to the safety, health, and welfare of the City. 6. Grievances and Appeals: An aggrieved party may appeal the decision of the Building Official to the Zoning Board of Adjustment in accordance with the provisions of this Ordinance. 7. Recording Site Plans: The Building Official shall maintain a record of all site plans approved for a Special Use Permit. A list of all approved Special Use Permits shall be listed in the Appendix. 8. Special Use Permit Amendments - Changes to any Special Use Permit or to its approved site plan shall be processed in the same manner as the original approved request. Changes of detail within a site plan which do not alter the basic physical relationship of the property to adjacent property; do not alter the uses permitted; do not increase the density, floor area, height, or reduce the yards provided at the boundary of the site as indicated on the approved site plan, may be authorized by the Building Official. Mr. Lueck asked if the lots are deep enough to accommodate the right-of- way for Precinct Line Road. Mr. Long stated TxDOT has indicated they intend to take 15-17 feet, and the lots are deep enough to handle a reduction by that amount. He stated they would dedicate whatever right-of-way is necessary. There being no one else wishing to speak, Chairman Brock closed the Public Hearing. Mr. Wilson stated that the proposed residential use is more appropriate for the area than the present office use. Mr. Barfield made the motion to approve PZ 93-16. This property is immediately north of Hidden Oaks Drive. The owner plans to develop single family homes on this property. The owners are requesting to rezone a O.741-acre strip of this land from C-1 Commercial to R-8 Zero Lot Line Residential. The owners are preparing a plat of the property, and have determined that an additional strip of land needs to be rezoned in order to accommodate deeper lots (see attached exhibit). The R-8 district requires 1 DO-foot deep lots, and the developer would like to plat 115-foot deep lots. There are two issues regarding this request: e 1. The City Council approved an ordinance on June 22, 1992 that stated zoning change applications for the R-8 district would not be accepted. Quadrangle Development has submitted a letter requesting that this requirement be waived since the reason for the change is only to make some of the proposed lots deeper. I ~ 2. If the property is platted as is, without the zoning change, several of the lots would be split by a zoning district line. The rear portion of the lots would be zoned C-1 Commercial, and the front portion R-8. Generally accepted planning principles discourage this type of situation. The Planning and Zoning Commission considered this request at their September 23, 1993 meeting and recommended approval. RECOMMENDATION It is recommended that the City Council hold the required Public Hearing and consider the recommendation of the Planning and Zoning Commission. From the Planning and Zoning Commission's previous input, the attached proposed ordinance has been prepared. The key elements of amended landscaping regulations are: 1. Requires 15% of the lot to have landscaping in all non-residential zoning districts. The current landscaping regulations contain 150/0 landscaping requirements only in the multi-family, office, and institutional zoning districts. The remaining non-residential districts require 10% of the lot to be landscaped. The Planning and Zoning Commission unanimously favored the 15% requirements because the new regulations include more choices, options, and opportunities for obtaining credits for enhanced landscaping such as small shrubs and bushes. The current landscape regulations provide no credits for shrubs under three feet in height. This change will make it easier for businesses to satisfy the landscape requirement. 2. Requires half of the landscaping to be located between the building and the street. The existing ordinance allows the owner to use unwanted land located behind the building to count as the landscaped area. 3. Allows square footage credits for shrubs less than 3 feet tall, whereas the existing ordinance only allows credits for shrubs over 3·feet in height. 4. Requires a six foot masonry wall between commercial and residential property when a new commercial building is constructed, or when an existing building is substantially renovated, or when the footprint of the building is expanded by 30% of the existing building. The existing ordinance only requires a six foot wooden stockade fence for commercial screening. Also, when a masonry screening wall is constructed, no landscaped buffer yard is required. The Planning and Zoning Commission considered this amendment at their September 23, 1993 meeting and recommended approval by a 5-1 vote. LANDSCAPING REGULATIONS I A. Purpose These landscaping regulations provide standards and criteria for new landscaping with live plant material, and are intended to promote the value of property, enhance the general welfare, improve the physical appearance of the City, and enhance the community's ecological, environmental and aesthetic qualities. It is the intent of this Section to establish requirements for the installation and maintenance of landscaping and buffering elements and other means of site improvement on existing and newly developed property in order to enhance the community's ecological, environmental and aesthetic qualities. 2. It is the intent of this Section to reduce the negative effects of increases in air temperatures, glare, noise, erosion, and sedimentation caused by expanses of impervious and unvegitated surfaces within the urban environment. 3. It is the intent of this Section to preserve and improve the natural urban environment by recognizing that the use of landscaping elements can contribute to the processes of air purification; oxygen regeneration; ground water recharge; storm water runoff retardation; and the abatement of noise, glare and heat. 4. It is the intent of this Section to safeguard and enhance property values and protect public and private investment. B. Applicability The provisions of the Landscaping Regulations contained in this Section shall apply in the following situations: 1. When an existing building is proposed for remodeling, alteration, addition, or expansion, in which the value of the proposed construction exceeds seventy-five percent of the current appraised value of the existing structures, excluding the value of the land; or, 2. When an existing building is proposed for an addition that will increase the square footage of the existing building by thirty percent or greater; or, 3. The standards contained in this Section are considered minimum standards and shall apply to the following zoning districts: R-7-MF Multi-Family District; 0-1 Office District; LR Local Retail District; C-1 Commercial District; C-2 Commercial District; OC Outdoor Commercial District; 1-1 Light Industrial District; 1-2 Medium Industrial District; and U School, Church, and Institutional District. Agricultural uses and single- family and two-family residences and their accessory buildings shall be exempt from the requirements of this Section. 2. All landscaping shall be installed prior to the issuance of a Certificate of Occupancy. A Certificate of Occupancy will be issued only when it is determined by the Enforcing Officer that all landscaping has been installed in accordance with the approved Landscape Plan. If it is determined by the Enforcing Officer that planting of live material is hindered by adverse weather conditions, an extension of time may be granted for a period of up to six months. 3. The landscaped area shall not be used for parking, the display or storage of merchandise, or any structure requiring a permit, except for permanent signs. D. Landscape Plan Required When an application is submitted for a building permit on any site where these Landscape Regulations are applicable, the building permit application shall be accompanied by a Landscape Plan. The Enforcing Officer shall review the Landscape Plan to determine compliance with these Landscape Regulations. The Landscape Plan shall include sufficient information to determine compliance with this Section, and shall as a minimum contain the following information: 1. The date, scale, north arrow, title, and name of owner. 2. A minimum scale of not less than one inch equals twenty feet. 3. All existing and proposed buildings and other structures, paved areas, planted areas, power poles, light standards, fire hydrants, signs, fences, sidewalks, and other permanent features to be added and/or retained on the site. 4. The location and height of all trees to be preserved or retained. 5. The location of all plants and landscaping material to be used including paving, benches, screens, fountains, statues, or other landscape features. 6. A delineation of the designated landscaped area 7. A list of the species of all plant material to be used. 8. A list of the size and height of all plant material to be used. 9. The spacing of plant material where appropriate. 10. The layout and description of irrigation system. 11. The name, address, and telephone number of the person or firm responsible for the preparation of the Landscape Plan. E. Required Landscaped Area Every platted lot, as required by this Section, shall provide a landscaped area equivalent to fifteen percent (150/0) of the total land area of the lot. At least one-half of the required total landscaped area shall be located in the street yards. All ground surfaces not used for buildings, sidewalks, roadways, or other impermeable surfaces shall be covered with live grass, turf, shrubbery, trees, ground cover, flowering plants or appropriate mulching. F. Landscaping Credits As an alternative to the required fifteen percent total landscaped area, landscape credits may be utilized to reduce the total amount of land area dedicated for landscaping purposes. However, in no instance shall the credits reduce the total amount of landscaping on a lot to less than seven and one-half percent of the total land area. Credits are only allowed if the feature is maintained as a permanent element of the Landscape Plan. G. Maintenance of Landscaping All landscaping and related maintenance shall be the responsibility of the property owner. The following minimum standards shall be required: 1. All required landscape areas shall be permanently maintained and shall have an underground irrigation system which satisfies all applicable requirements of the City. The irrigation system shall be installed by a licensed irrigator or master plumber. 2. Irrigation systems may be buried on public street right-of-way; however, the City or any franchised utility will not be responsible for damage to any landscaping material or equipment while performing repairs of maintenance to its system. 3. Landscaped areas shall be kept free of trash, litter, weeds, and other such material or plants that are not a part of the landscaping. 4. All plant materials shall be maintained in a heahhy and growing condition as appropriate for the season of the year. The property owner is responsible for regular weeding, mowing of grass, irrigation, fertilizing, pruning, and other maintenance of all plantings as needed. Plant materials which die shall be replaced by the owner within a six month period with plant material of similar variety and size. H. Landscaping of Parking Areas It is the intent of this Section to encourage the design and construction of parking areas in a manner whereby areas within the parking lot are landscaped as well as areas considered unusable for parking or maneuvering space. It is also the intent of this Section to aid in the abatement of noise, glare, and heat associated with large expanses of hard paved surfaces and motor vehicles. Parking areas shall be landscaped in accordance with the following regulations: 1. Landscaping within the parking and maneuvering areas may apply to the overall landscape requirement for the lot. 2. When the parking and maneuvering area exceeds one acre, not less than five percent of the interior parking and maneuvering area shall be maintained as landscaped area. The interior parking and maneuvering area is determined by drawing a straight line along the outermost edge of pavement on each side of the parking and maneuvering area. The line shall not follow the landscaped bump-outs or islands but shall continue to project in a straight line around the perimeter of the parking area. Landscaping on the perimeter of the parking and maneuvering area shall not be included in calculating the required five percent landscaped area. 3. All landscaping within the parking lot shall be located within a landscape island or module. The island or module shall be delineated from the surrounding paved area by a curb or barrier of not less than six inches in height around the perimeter of the island or module. The curb or barrier shall be constructed of masonry or concrete. Each island or module shall be a minimum of five feet wide. Each island or module shall be located entirely within the confines of the parking and maneuvering area. 4. Landscape islands or modules shall be irrigated by an underground system as required by this Section. Irrigation of all landscaped area adjacent to any parking and/or driving surfaces shall be installed such that a minimum amount of water is applied to parking and/or driving spaces. 5. All shrubbery, flowering plants, and trees planted in parking lot islands or adjacent to parking lots shall be set back two and one-half feet from any curb and/or curb stop. 6. Landscaping material in parking lots shall include shrubs and trees or a combination thereof, which in turn may be planted with a combination of grass, ground cover, and/or flowering plants. 7. For any larger existing trees located in the parking area, which are being retained and incorporated into the Landscape Plan, an appropriate aeration system or an alternative method of protecting the trees must be provided and detailed in the Landscape Plan. At least three-fourths of the tree dripline area must be in a permeable area. I. Conflict with Traffic Landscape plantings shall not be erected or installed in such a manner as to interfere with traffic view or impose a safety hazard. All landscape plantings shall comply with any applicable Visibility Sight Triangles as provided for in these regulations. Purpose It is the purpose of this Section to provide buffering elements for visual buffering between zoning districts of different character in order to mitigate the effects of potential nuisances such as dirt, litter, noise, heat, and glare of lights; and to provide spacing between different zoning districts that may be considered incompatible. B. Buffer Yard Between Zoning Districts Required For any non-residential construction which abuts a single- family or two-family residential zoning district or agricultural zoning district, there shall be a buffer yard of live plant material for the entire width and distance along which the development abuts the residential district. The buffer yard shall be of a width as required in Table g-c. This green belt is included in the overall calculation of the percentage of required landscaping. Purpose It is the purpose of this Section to provide for screening between zoning districts of different character in order to mitigate the effects of potential nuisances such as dirt, litter, noise, heat, and glare of lights, and to protect public and private investment. It is also the intent of this Section to provide for the safe construction and maintenance of walls and fences constructed in the City. B. Screening Wall Required 1. Abutting Single- and Two Family Residential Districts For all new construction; or any proposed building remodeling, alteration, addition, or expansion in which the value of the proposed building remodeling, alteration, addition, or expansion exceeds seventy-five percent of the current appraised value of the existing structures, excluding the value of the land; or any proposed building addition intended to increase the square footage of the building by thirty percent or greater; on all property zoned R-7-MF Multi- Family; 0-1 Office; LR Local Retail; C-1 Commercial; C-2 Commercial; OC Outdoor Commercial; 1-1 Light Industrial; 1-2 Medium Industrial; and U School, Church, and Institutional which abuts any single-family or two-family residential zoning district, a permanent screening wall of masonry type construction, not less than six feet in height shall be erected prior to the issuance of a Certificate of Occupancy. The permanent screening wall shall be constructed along the entire length of the common property line between such properties, and within the property required to erect the screening. 2. The permanent screening wall shall be constructed along the entire length of the common property line between such properties, and within the property required to erect the screening. 3. Abutting Iron Horse Golf Course Iron Horse Golf course shall be exempt from the masonry screening wall requirement on those residential lots that abut the golf course. C. Screening Fence Required Where a masonry screening wall is not required, or no permanent screening wall or fence currently exists, there shall be a sight barring fence, not less than six-feet in height, on all property zoned R-7-MF Multi-Family District; 0-1 Office District; LR Local Retail District; C-1 Commercial District; C-2 Commercial District; OC Outdoor Commercial District; 1-1 Light Industrial District; 1-2 Medium Industrial District; and U School, Church, and Institutional District, which abuts a single-family or two-family residential zoning district. The screening fence shall be constructed along the entire length of the common property line between such properties, and within the property required to erect the screening. The screening fence shall be adequately maintained by the property owner. D. Safety No screening wall or fence shall be constructed or maintained in a manner that would endanger the health or safety of the general public. 1. Fences constructed of barbed wire, except for livestock fences, and walls topped with broken glass or surfaced with similar materials shall be prohibited. 2. A security fence of not less than six feet in height may be topped by barbed wire only in the C-2 Commercial, 1-1 Light Industrial, and 1-2 Medium Industrial zoning districts. 3. Electric fences shall be prohibited in the City. E. General Screening Wall and Fence Criteria Walls and fences shall be no greater than eight feet in height, and shall be subject to the following regulations: 1. Every screening wall and screening fence shall be adequately maintained by the property owner. 2. The height of a wall or fence shall be the vertical distance between the ground and the top of the wall or fence. In terrain where the ground slopes at a grade of ten percent or more, the wall or fence may be built in eight foot horizontal stair step sections. The average height of each fence section shall be no greater than eight feet in height. 3. Non-sight barring fences may be allowed in front yards. Such fences shall be wrought iron, and shall be no greater than four feet in height, excluding the posts. The posts must be constructed of brick or stone. 4. All walls and fences located on a corner lot shall comply with any applicable Visibility Sight Triangles as provided for in this Ordinance. 5. When two adjoining corner lots are situated so that the front of each lot faces parallel streets, and so that the side exterior yard of one is a continuation of the side exterior yard of the other, such side exterior yard on both lots may be enclosed by a wall or fence having a maximum height of six feet above grade to the rear of the side exterior yard on each lot. F. Vehicle Storage Facility Screening In addition to the landscaping requirements of the base zoning district, no Certificate of Occupancy shall be issued for a Vehicle Storage Facility until one of the following screening options has been satisfied. A permanent masonry screening fence of not less than six feet in height shall be constructed along the property line adjacent to any public street right-of-way; or, b. A wood stockade screening fence of not less than six feet in height shall be constructed within a landscaped buffer area which shall be parallel with the property line adjacent to any public street right- of-way. The landscaped buffer area shall contain not less than one-half of the required landscaped area and be irrigated and planted with shrubs, bushes, and/or trees facing the street right-of-way. The shrubs, bushes, and/or trees shall cover at least sixty percent of the fence. 2. 1-1 and 1-2 Districts A chain link fence of not less than six feet in height shall be constructed along the property line adjacent to any public street right-of-way. 2. THAT, Article 10, Section 1000 Definitions, be hereby amended to add the following definitions: SHRUB - A low, usually several stemmed, woody plant. TREE - A woody perennial plant have a single, usually elongated, main stem, generally with few or no branches on its lower part. YARD, STREET - The area extending across the entire width and/or depth of the lot and situated between the lot lines adjacent to the street rights-of-way and the building lines. 3. SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the section, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. 4. SAVINGS CLAUSE. That Ordinance Number 1874, the Comprehensive Zoning Ordinance of the City of North Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. This survey was accomplished to create an accurate base map for the Geographical Information System. City policy requires that all new plats be tied by survey to the GPS. This will allow the City to keep the GIS up-to-date. The Public Works Department has written descriptions for all of the GPS Benchmarks located around the City. This plat needs to include the NAD83 Texas State Plane Coordinates for at least two property corners. The coordinates need to be determined by a survey tied to the City's GPS monuments. 3. The following items are the issues concerning this Replat: 1. Dedication of additional right-of-way will be required along Precinct Line Road and the developer has agreed to this dedication. 2. The Subdivision Regulations require that a masonry screening wall and sidewalks be constructed along Precinct Line Road (an M-6-D on the Master Thoroughfare Plan) and Amundson Drive (a C-4-U on the Master Thoroughfare Plan). The developer has agreed to install sidewalks, but is requesting a waiver from the masonry screening wall requirement. The developer is requesting that he be allowed to' construct a wood fence with brick columns in lieu of the masonry screening wall. The Planning and Zoning Commission has recommended that the masonry screening wall along Amundson Drive be waived beoause no wall exists at the present time elsewhere along Amundson Drive. However, the Planning and Zoning Commission recommended that a masonry screening wall be required along Precinct Line Road. The developer has agreed to all other engineering comments. The point of beginning needs to be clearly labeled on the plat. 2. The plat indicates a 5-foot utility easement along the west and north property lines and along Lots 29R and 30 of the subject property. The Subdivision Ordinance requires a minimum 7.5 foot width for utility easements. The 5.0 foot width will need to be changed to 7.5 foot. 3. The street intersection of Oaks Hills and Amundson Road will require sidewalk and utility easements as defined in the Design Manual. The easements need to be clearly indicated. 4. The lot grading for Lots 29R and 30 indicate that runoff will cross more than two lots. The lot grading will need to be changed as indicated on the mark-ups or a 1 0- foot drainage easement will be required along the north property line. Be aware that all drainage easements dedicated between lots need to include an overland concrete surface. This will discourage property owners from cross-fencing the easement as well as protecting the area from erosion. 5. The Zoning Ordinance requires sidewalks adjacent to all public streets. The surveyor's seal and signature need to be added to the plat prior to City Council consideration. 2. Building setback lines will need to be added to lots adjacent to this plat prior to City Council consideration. 3. All offsite easements and exhibits need to be prepared and forwarded to the Public Works Department for review. The signed easements need to be transmitted to the Public Works Department for filing with the approved final plat. 4. The offsite 10-foot sanitary sewer easement will need to be identified on the plat. Show the volume and page of the recorded easement if known. If unknown leave a blank for each. The City will fill in the blanks after the easement is filed. 5. Eden Road is designated at C4U on the Master Thoroughfare Plan. Eden Road has not been improved with curb and gutter. After comparing the coordinates with the City's GIS there is a discrepancy of approximately 6 feet. 8. There are comments regarding the engineering and construction plans recorded on a set of blueline construction plans. The plans and a blueline copy have been returned to the engineer for revision. The comments contained herein do not purport to relinquish the design engineer of his responsibility to provide adequate, accurate and buildable construction plans. The City's eventual approval of the construction plans will not signify acceptance of responsibility by the City of North Richland Hills for the engineering in the bid documents. The construction plans will need to be revised prior to final approval by the Public Works Department. Public Works is recommending that this plat be revised prior to City Council consideration. Loop 820 North Richland Hills, Texas 76180 SUBJECT USE OF THE GREEN VALLEY RACE TRACK (GVRT) BY TEXAS INSTRUMENTS INCORPORATED (TI) Dear Mr. Line: This letter is a follow up to a phone conversation I recently had with Mr. C. A. Sanford. TI has designed, and intends to market, a new product called TIRIS. TIRIS is an acronym for uTexas Instruments Registration and Identification System II . This product is a combination of a microchip, packaged in a very small tag or card, and the attendant electronic instrumentation. The microchip, programmed with selected information, is attached to an on-the-road vehicle. The attendant instrumentation recognizes, reads and records the information programmed into the microchip when the host vehicle crosses over a predetermined, information collection point. Locating the GVRT wraps up a six-month search for a workable test site, within reasonable proximity of the Dallas metroplex, for our TIRIS Program. As you might suspect, the availability of long, straight, paved surfaces in the metroplex area, not in use, are virtually nonexistent. I investigated six prospective, but unacceptable, locations before I found out about the GVRT. We breathed a sigh of relief when we discovered this facility - but maybe prematurely. \^le have entered into a six-month lease agreement with Mr. Bill Hielscher, the owner, for a portion of the GVRT property, and subsequent to executing the lease, TI discovered the intended use of the property may be inconsistent with the present zoning. Mr. Sanford informed me that TI could not use the subject property according to planned use without first acquiring approval from the City Council, in open session, October 11, 1993, and that a letter, prior to the Council meeting, setting forth the facts and circumstances would be useful; hence, this letter. The following is a list of anticipated questions, concerns or interests that the City and/or local residents might have regarding TI's utilization of this property: (1) Hours of operation? 8AM to 5PM, Monday through Friday, excluding holidays ,(2) ~.~aximum speed of vehicles? 35 MPH (3) Number of test vehicles in operation simultaneously? (6) Temporary Structures? 1 modular building, 12 feet by 56 feet, is needed to house the program instrumentation and technical administration. In a pinch, and as a last resort, we could use a mobile facility (tractor trailer) for this purpose by modifying our test procedures and operational practices; however, we hope it will be unnecessary to employ this alternative. (7) Overhead power and phone lines? A live, overhead, power line is already in place at the property and will be adequate. An overhead phone line is needed to facilitate program voice and data communications. (8) Duration of Testing? 6 months (approximately October, 1993, through March, 1994) TI plans to have appropriate representatives present at the October 11, 1993, City Council meeting to seek the Council's approval to use the GVRT property according to the specifications set forth herein above. They have advised us that our stop loss for 1993-94 is $2,088,643. The premium is $97,429. Manulife, an A+ rated company, advised us that our stop-loss through their company would be $1,888,350 at a premium of $89,215. This would reduce our maximum claims liability by $200,000 and lower our stop-loss premium by about $8000. Recommendation: It is recommended that the City Council approve the change to Manulife as the stop-loss carrier for our health plan. Finance Review Acct. Provide the City Manager the flexibility to authorize department heads to award up to a 4% merit increase for those employees the department head deems worthy. The staff has met with representatives of Municipal Services Bureau (M.S.B.) and discussed the possibility of engaging their firm for collection services on warrants more than 120 days old. M.S.B. is a private collection agency whose only business is collection services for municipal courts in Texas. Staff has also contacted a number of cities currently under contract with M.S.B. and has received favorable reports about their services. Staff is proposing that M.5.B. be retained by the City for the purpose of collecting on these warrants which are no longer actively pursued by our warrant officers. M.S.B. will perform these services on a contingency fee basis, with no up front costs to the City. Their proposed fee would be; 1. 40% of the amount collected, if warrant is more than 120 days old or 2. if their efforts caused the warrant to be resolved, but no fee collected their percentage fee is waived and a $15.00 administrative fee is assessed. 3. 25% of the amount collected, when received within 120 days of issuance. Our experience with M.S.B. on collection of these warrants will be evaluated and a report submitted to the City Council at the end of one year. FINE COLLECTION A. Defendant Contact. MSB will mail notices, telephone or otherwise contact defendants with outstanding citations with the City in order to attempt to collect or resolve fmes owed by the Defendants. The notices will list the amounts of the outstanding fmes owed to the City, and the names and addresses of the Defendants owing the fmes will be provided to MSB by the City. The City will provide, in addition to the names and addresses of the Defendants, all information regarding the date(s) of the alleged violation(s), the date judgment was entered against the Defendant in the court having jurisdiction over the matter or the date of the citation itself, and the amount of such fme(s). B. Correct Information. MSB will rely completely on the City to provide correct information about the Defendants' existing citations or warrants and, specifically, about the dollar amount in question, and the City will immediately update and correct any information it has provided to MSB. In particular, the City will immediately notify MSB of any payment or other satisfaction of judgment made directly to the City, or any other action affecting the amount or timing of monies owed by the Defendant to the City. c. Accounts Returned. MSB will return any accounts requested to the City that MSB is unable to collect or resolve within 180 days of their referral by the City to MSB. This time period will be determined beginning with the fIrst day of the following month in which the account was referred to MSB. D. Questions Referred. MSB will refer Defendants with questions regarding their citations to the City Department or person designated by the City to answer questions regarding citations. II. COMMISSIONS ON FINES COLLECTED. A. Basic Commission Rate. For all citations referred by the City to MSB for collection or resolution for which the City is paid (in whole or in part), regardless of whether payment is accepted directly by the City or by MSB on the City's behalf, the City will pay to MSB a --L percent commission rate on the amount collected. This commission rate will apply to each citation referred to MSB for collection within ~ days of the date on which the warrant for that citation ·was issued. For citations referred to MSB after ~ days from the warrant date, including initial backlog submissions, a ..ÆL. percent commission rate will apply. B. Endorse N ee:otiable Instruments. The City authorizes MSB to endorse negotiable instruments provided to MSB in payment of the fmes collected, and to deduct commissions due on those fmes paid direct to MSB from the amounts collected by MSB. MSB will notify the City of all traffic fmes it collects from the Defendant on behalf of the City. C. Notification of Collections. The City will immediately notify MSB of fmes referred to MSB for collection that have been paid by the Defendants directly to the City whenever that payment is received. D. The contract states that lIeither party may cancel this agreement by giving the other party 90 days written noticell; however, Mrs. Kirkland would like to terminate earlier than the 90 days stated if possible. We have received a letter of interest from Mrs. Kathy Abelanet, currently a clerk in the Municipal Court, stating her interest in the position. She has been recommended for this position by Mrs. Nancy Kirkland and the Municipal Court Administrator, Bobbie McCorkle. I interviewed Mrs. Abelanet and also recommend that she be retained for this position. If approved, Mrs. Abelanet can begin immediately, thereby terminating the agreement early as requested by Mrs. Kirkland. I I I I I I: Mrs. Abelanet has requested that she be permitted to continue participation in the Texas Municipal Retirement System (TMRS) and not participate in the City Group Health Insurance Plan, if the City Council approves a contract with her for this position. In order to continue T.M.R.S. participation, Mrs. Abelanet I~~ould be classified as though she were a salaried (exempt) employee. She would ~ontribute the same percentage of her salary as other covered employees for T.M.R.S., Workers Compensation and income taxes. Also deducted from her monthly salary would be the City's premiums for Workers Compensation and F.I.C.A. benefits. The monthly salary would be reduced an amount equal to the amount paid by the City and those funds transferred to appropriate City accounts. The present rate of $1,500.00 per month would be reduced to $1,315.00 per month, with the $185.00 balance transferred to the City to cover its portion of the benefits. Vendor shall not drive a City funded or owned vehicle at any time. 5 . Kathy Abelanet exercises her option not to be covered by the City health and hospitalization plan and represents that she has full coverage under another heal th insurance program offered at her spouse's place of employment. 6 . The City is interested in development of a program for the benefit of juveniles and the benefit of the City and its inhabitants and has created the Teen Court Program to further that cause. Applicants must answer correctly seventy percent of the questions to pass the written examination and to be eligible for the Assessment Center. The eight highest scorers passing the written exam shall be permitted to participate in the Assessment Center Exercise. In the event the written examination results in a tie among two or more persons for the eighth highest score, the individual's seniority in the department shall be the tie-breaker in determining the applicant who will be permitted to continue to the Assessment Center Exercise. The maximum achievable score for the written examination shall be equal to but not exceed the maximum achievable score for each of the remaining exercises. An Assessment Center Board, comprised of members approved by the department head, shall administer the Assessment Center Exercise. The Board members shall award points based on each applicant's performance for each phase of the exercise. The grade which shall be placed on the eligibility list for each applicant shall be the sum of all points awarded by an Assessment Center Board plus written test score, and applicable seniority points. The balance of their vacation schedule remains the same as other employees. For the purpose of this section, a week shall be defined as a normal workweek for all employees in each of the designated classifications. b. Regular part-time employees who are budgeted at least twenty hours a week shall receive pro-rated vacation leave credit on the basis of hours actually budgeted. Example: A 20-hour /week employee will earn vacation leave at 1/2 the rate established for full- time employees. c. By invoking the rule, all witnesses will remain in a room separate from the hearing until called to testify, and there will be no discussion of the hearing among them. a. Burden of Proof The burden of proof before the Commission will be "by a preponderance of the evidence". If any party alludes to the burden being "beyond reasonable doubt" the presiding officer shall correct the party and remind the Commission of the true burden. The Department Head shall have the burden of proof to sustain the action. The Department Head shall have the right to open and close. b. Opening The opening party may make an opening statement and then present their case. Following the opening statement, the other party will have the option of making an opening statement or waiting until that party's case is ready to present. c. Response The responding party may make an opening statement (if the decision was made to not make such statement earlier), and then shall present the case. d. Rebuttal Each party shall be entitled to enter rebuttal testimony in the order of the original presentation. e. Final Arguments The person with burden of proof will be entitled to open and close. The other party will present argument after the original final argument. f. Evidence 1. Pre-filed Any party may pre-file sworn written testimony at least 7 days before hearing. Such pre-filed written testimony may be considered only if the party giving the testimony is present at the hearing for cross-examination. This does not involve any North Richland Hills money going to these agencies. It involves receiving monies from these agencies for use of our M.D.T. System. There are currently four other agencies who want to lease access from our police department on this system. When our Police Department has an agency who wishes to come onto our system, it has been necessary for both North Richland Hills and the new agency to wait for council approval of each new contract or of minor changes in existing contracts. It is requested that the Counci 1 gi ve the Ci ty Manager and/or the Mayor the ability to execute these agreements in the future as need arises. Resolution No. 93-42 extends this authority. The Community Services Department is soliciting bids for this project with an anticipated cost of $17,000. Council will be requested to award the bid, and the work will be accomplished prior to delivery of the equipment hereby proposed to be purchased. In June 1993, the Purchasing Department received bids for new self contained circuit training machines. Several companies submitted sealed bids, Nautilus Acquisition Corporation was the only qualified bidder. They were the only company that met the specifications with "self contained" circuit training machines. Part of the equipment needed for the fire truck and ambulance is an intercom system to be compatible with the present system. In March, 1993 formal bids were solicited for intercom systems for the then existing emergency vehicles and at the March 22, 1993 meeting (PU 93-20), City Council awarded the bid to Quala- Tel Enterprises. Quala-Tel Enterprises has agreed to furnish and install intercom equipment for the new vehicles at the same unit prices bid in March. At the August 23, 1993 (PU 93-55) meeting Council awarded the purchase of this ambulance to Reliable Emergency Vehicles in the amount of $100,028. After the ambulance was ordered it was discovered two items had been left out of the specifications. The specifications called for seven cabinets to have pullout fronts; there are actually ten cabinets that require pullout fronts. The three additional fronts may be converted for $375. The addition of a second external air conditioning condenser is needed to improve the cooling capacity for the total vehicle. The cost for the second condense~ is $925. The total amount of the change order would be $1,300. Recommendation: It is recommended Council authorize the change order for the ambulance to Reliable Emergency Vehicles in the amount. of $1,300 making the total cost of the ambulance $101,328. To be compatible with all existing equipment these radios need to be manufactured by Motorola. The radios may be purchased directly from Motorola or through the cooperative purchasing agreement with Houston-Galveston Area Council (HGAC).
