Subject:
ENGINEER'S ESTIMATE
An engineer's estimate is made by Knowlton-English-Flowers, Inc. on every capital
improvement project they do for the City. We expect the estimate to be done so we can
budget the funds ahead of time for each project. This is common procedure for most all
m unici pa I ities.
Some of the Council have been concerned that the knowledge of this estimate by the
Contractors may increase the bids. I believe this concern is based on the fact that most
engineers try to be conservative in their estimates. Therefore, the engineer's estimate is
normally more than the actual low bid amount.
Not knowing if the knowledge of the engineer's estimate truly affects the bidding, I offer
the following comments.
1 · Companies that publicize the project to prospective bidders (i.e., Dodge Reports and
Texas Contractors) normally give the engineers estimate along with the other
information. A few cities do not give out the engineer's estimate but give a range
for the estimated cost to fall within.
2. Contractors can compare their bids with the engineer's estimate prior to the bid
date and make sure they did not miss anything.
3. Contractors must know an approximate amount for the project in order to
determine if they can provide the adequate performance, payment and maintenance
bonds to cover the project. They need at least a cost range for the project to
determine this.
4. Typically a low bid should be acquired from the contractors who are competing for
the project, not because the engineer's estimate is not publicized.
If the Council does not want to publicize the engineer's estimate in the future, please
direct us to do so.

Dear Mayor Brown,
The fire department respectfully requests that you make a
presentation to four North Richland Hills residents who risked
their lives to rescue three small infants from a burning
apartment.
On December 3, 1991 Mrs. Patsy Grady returning to her
apartment heard a smoke alarm and noticed heavy smoke coming from
her neighbors apartment. She sent her son to the apartment
complex office to summon help and she began to attempt entry as
she knew small children lived in this apartment. Complex office
personnel called 911 then went to the apartment which was burning.
These people were Tamela Erickson, assistant manager of the
complex, Dorothy Pritchett and Poncho Herron Santana, both whom
are maintenance workers.
These four people were able to gain access to the apartment
utilizing a master key. Inside the burning apartment were three
children whom were left unattended. They were Jamie Bailey (9
mos.), Tarus Bailey (1 yr.) and Latisha Bailey (4 yrs.).
It is believed the four year turned the fire on under a
skillet of grease left on the cook stove. This skillet of grease
caused some fire damage to the stove top and adjoining cabinets.
Heavy smoke filled the entire apartment causjng the nine month old
child to lose consciousness and causing smoke inhalation to the
other two children.
Poncho Santana used a portable fire extinguisher to fjght the
fire in order for these three women to rescue the small infants
which were on the other side of the burning kitchen.

Outside, Tamela Erickson immediately began C.P.R. and revived
the infant. The fire department emergency units arrived shortly
after this rescue was accomplished. The three children were taken
to North Hills Medical Center by fire department ambulance where
they were treated and released later that night. Mr. Santana
successfully extinguished the fire prior to the arrival of the
fire department.
It is the opinion of the fire department and the fire
investigator that the three children would have died in this fire
had it not been for the quick and courageous actions of these four
citizens. It is also the opinion of the fire department that this
fire had not been extinquished in it's early stages, the property
damage would have been costly and the displacement of numerous
families occupying this complex would have been inevitable.
On behalf of the City of North Richland Hills it is felt that
these citizens should be recognized and honored for their acts of
bravery at the next City Council meeting on January 13, 1992. The
fire department will have plaques for your presentation to Mrs.
Grady, Tamela Erickson, Dorothy Pritchett and Poncho Santana.

Addition, from its present classification of C-l
Commercial to C-l, Special Use Permit for an Auto
Inspection station. This property is located at the
southeast corner of Rufe Snow Drive and Watauga Road.
Ordinance 1778
Mr. Mark Miranda with I-20 Matlock, Inc. submitted a request to
rezone this property from C-1 to C-2 to allow for the conversion
of an old car wash into an auto inspection station. The
property was previously occupied by a convenience store and a
car wash. The old car wash facili ty existed prior to the
establishment of the current zoning regulations which makes this
a non-conforming use. A car wash is only permitted in a C-2
zoning district or in a C-l district with an approved Specific
Use Permit. This was an apparent oversight in the early 1980's
when the current zoning classifications were established.
The Planning and Zoning Commission expressed considerable
concern about changing this property to a C-2 zoning district
classification due to the large number of uses allowed in the c-
2 zone which are considered incompatible with adjaceot
properties. The Planning and Zoning Commission asked the
property owner if he was agreeable to obtaining a Specific Use
Permit to allow for the proposed Auto Inspection station without
having to change the zoning district to a C-2 classification.
The owner stated that this would meet his needs for the
property.
The Planning and Zoning Commission reviewed this request at
their November 14, 1991 meeting and recommended to approval of a
Specific Use Permit for an Auto Inspection station.
Recommendation:
It is recommended that the City Council hold the required Public
Hearing and consider the recommendation of the Planning and
Zoning Commission.

Vice Chairman Barfield said this
property, until it recently closed
down, was operating in non-compliance.
He said the city in 1984 changed their
classifications from just "commercial"
to "C-l" and "C-2" and this piece of
property was classified as C-l, but a
car wash is listed under C-2. He said
the city has partial responsibility in
this and we should consider that also
in our decisions.

Public Hearing and called for those
wishing to speak in favor of this
request to please come forward.

Mark Miranda, owner of the property,
came forward. He said he developed
the property behind this property, the
Kroger property, back in 1984 and 1985
and he just recently purchased this
property with another group with the
intention of somehow blending it into
their shopping center. Mr. Miranda
said the Stop and Go had been an
eye sore for sometime. He said he has
had several people come to them
wanting to put a State Auto Inspection
Center in the car wash area. Mr.
Miranda said they would take the
building as it is and convert it into
a State Inspection Sticker place. He
said he plans to take the old Stop and
Go building and clean it up and lease
it out for some other use. He said
the old car wash is kind of an
eye sore. Mr. Miranda said they have a
lease agreement contingent on this
change to C-2, Automotive Use, and he
requests approval.

just wishes to have the Inspection
Station or is he planning on a full
blown service.
Mr. Miranda said he understands they
are not allowed to do oil changes and
such.
Vice Chairman Barfield said we have
available to us in the C-1 zoning with
a Specific Use that would allow you to
do State Inspections. He asked Mr.
Miranda if he would consider this
instead of the C-2 zoning.
Mr. Miranda said he would consider it,
but would like to have the highest and
best use for the property.
Mr. Bowen asked Mr. Miranda, besides
the Inspection Station, does he plan
an automotive use for the other
building also.
Mr. Miranda said he would like to take
the old Stop and Go building and put
in an ice cream shop or a cleaners, or
something like that in it.
Mr. Lueck asked if the State
Inspection was a franchise.
Mr. Miranda said there are two
franchises.
Mr. Miller asked what type of repairs
would they be doing.
Mr. Miranda said they are regulated by
the State. He said he thought they
could adjust the head lights, but they
can not do mechanical work.

Davis Memorial United Methodist Church is interested in
developing a day care center at their facility located on Davis
Boulevard. However, the property is currently zoned R-2 Single
Family Residential and the operation of a day care center is not
a legal use in the R-2 zoning district. The church has
submi tted a request to rezone the property to the U-
Institutional zoning district which does permit the use of a day
care center. Notices have been mailed to all property owners
having property located within 200 feet of the property being
rezoned. No negative comments have been received regarding this
zoning request.
The Planning and Zoning Commission reviewed this request at
their December 10, 1991 meeting and recommended approval of the
zoning district change to the U-Institutional zoning district.
Recommendation:
It is recommended that the City Council hold the required Public
Hearing and consider the recommendation of the Planning and
Zoning Commission.

Cameo Development Inc. has submitted a request to rezone Lot 15,
Richland Oaks Addition from R-l Single Family Residential to C-2
Commercial. This is an area that had previously been a single
family residential subdivision. However, the area has changed
considerably over the years to a commercial character due to its
proximity to Airport Freeway and Loop 820.
Recently, a large 18 acre tract adjacent to this property was
also approved for a zoning district change from R-2 to C-2. A
major commercial development (Pace Warehouse) has already
announced plans to construct a new facility on the adjacent
tract of land. The proposed new owner is interested in
obtaining similar zoning.
The Planning and Zoning Commission reviewed this request at
their December 10, 1991 meeting and recommended approval of the
zoning district change to the C-2 zoning district.
Recommendation:
It is recommended that the City Council hold the required Public
Hearing and consider the recommendation of the Planning and
Zoning commission.

Mr. stanley Peskind and Lawrence R. Burk with Rufe Snow/Loop
820, A Texas General Partnership have submitted a Final Plat of
a 17.9 acre tract being developed on the north side of Loop 820
and approximately 1800 feet west of Rufe Snow Drive. The plat
consists of a one lot addition and will be used for a commercial
development.
The project will be served by a new street to be known as
Boulder Drive which the right-of-way is being conveyed by a
separate document to the city. The street will be constructed
by the City with the development costs assessed to the property
owner. The project site will also be served by an extension of
Industrial Park Blvd. which is currently under construction by
Tarrant County work crews. All water and sewer lines will be
installed by the developer.

The developer has agreed to all engineering comments. The
Planning and Zoning Commission will review this Final Plat at
their meeting on January 9th. Any additional comments will be
provided to the council under separate cover.
ReCOBDaendation:
It is recommended that the city Council approve the
recommendation of the Planning and Zoning Commission.

We have reviewed the subject material resubmitted to this office on December 24, 1991
and offer the following documents.
1 · Add Texas State Plane Coordinates for one corner to the plat.
2. Profile for proposed 1 8-inch RCP culvert under the easterly drive approach onto
Loop 820 access road should be on a profile grid on Sheet #4.
3. On Sheet #5, reduce all curb return radii for drive approaches onto Boulder Drive to
20 foot. Decrease the two southeasterly drives to 30 foot wide and increase the
northwesterly drive to 35 foot wide.
4. All City details must be copied onto plan sheets with the original borders and title
blocks, no changes or deletions unless red marked on detail in plans during review.
The details should be recopied completely.
5. All other minor corrections marked in plans should be corrected.
A red marked blueline set of the plans is being returned to the engineer with our comments
noted. This marked up set must be returned with the next submittal.

is located on the west side of Rufe Snow Drive
and north of Northeast Loop 820 Service Road.
Mr. stanley Peskind and Lawrence R. Burk with Rufe Snow/Loop
820, A Texas General Partnership have submitted a Final Plat of
a 10.2 acre tract being developed on the north side of Loop 820
and approximately 1,200 feet west of Rufe Snow Drive. The plat
consists of a one lot addition and will be used for a commercial
development.
The project will be served by two new streets. One of the new
streets will be a C-4-U street and named Boulder Drive. The
right-of-way for this street is being conveyed by a separate
document. The street will be constructed by the City with the
development costs assessed to the property owner. The project
site will also be served by a new street to be named Combs Drive
which will extend in a' westerly direction from Rufe Snow Drive
and connect with the proposed Boulder Drive. The right-of-way
for this street is also being conveyed under separate document.
However, Combs Drive will be constructed at the developer's
expense. All water and sewer lines will be installed by the
developer at the developer's cost.
The Planning and Zoning Commission will review this Final Plat
at its meeting on January 9th. Any additional comments will be
provided to the council under separate cover.
Reco..endation:
It is recommended that the City Council approve the
recommendation of the Planning and Zoning Commission.

Dear Mr. Dickens:
Please find attached the revised Final Plat and plans for public
improvements for Lot 2, Block 4 of the Tapp Addition and your staff
comment set stamped "received Dec. 13, 1991". Our firm has
incorporated all of the City staff comments as listed in a memo
from yourself to the Planning and Zoning Commission dated December
17, 1991, except for two items listed below.
The current owner/developer and the future owner will enter into
a Reciprocal Easement Agreement which will cover "cross access"
between Lot 2 and subsequent lots to the east. Therefore, the
parties prefer that access easements not be shown on the Plat.
Secondly, given the current legislation regarding trench safety
plans and recommendations from our insurance representative, we do
not include a Trench Safety Planes) in our set of construction
plans · However, we do require the Contractor to submi t, for
approval, a Trench Safety Plan prepared, signed, and sealed by a
Geotechnical Engineer registered in the state of Texas prior to the
start of construction, for all excavations deeper than five (5)
feet. This requirement is shown on the plans and is covered in the
project's specifications.
It is our understanding that we are currently on the agenda for the
January 9, 1992 Planning and Zoning Commission meeting. Please
call me if I can be of further assistance.

3. The City has recently obtained a Global Positioning System (GPS) Horizontal Control
Survey. This survey was accomplished to create an accurate base map for the
Geographical Information System. City policy requires that all new plats to be tied
by survey to the GPS. This will allow the City to keep the GIS up-to-date. The
Public Works Department has written descriptions for all of the GPS Benchmarks

15. Construct a 6-inch segmented concrete curb on both driveway curb returns onto
I.H. 820 access road. See attached sheet.
Water and Sewer Lavout
16. Label '2" Tap & Valve' as '2" Service Connection' for proposed domestic water
service.
17. Use 1" or 2" service connection for irrigation, not 1-1 /2".
18. Get approval for 340-foot fire hydrant lead from Steve Pence, Building Official, if
you are not going to loop the line west to Boulder Drive.

In your City Council Agenda for Monday night are two items relating
to subdivision plats near the intersection of Rufe Snow and Loop
820. The developer had requested an expedited review schedule to
meet certain time constraints being imposed on him by the potential
buyer of the property. As stated in the cover sheet included with
your Council Agenda, the Planning and Zoning Commission was to
review these two plats at its Thursday, January 9th meeting and
forward any comments to you under separate cover prior to your
consideration at the Council Meeting on Monday night.
This is to advise you that the Planning and Zoning Commission has
offered no additional comments as a result of its review and is
recommending approval of the two Tapp Addition plat as submitted.
The City Manager has advised me that these two items were
inadvertently placed on the Consent Agenda. Since the
recommendation of the Planning and Zoning Commission is not
included on the cover sheets, these items should be removed from
the Consent Agenda so that a separate motion can be made.

RESOLUTION NO. 92-01
WHEREAS, the Americans with Disabilities Act is intended
to eliminate barriers preventing persons with disabilities from
participating in the same employment opportunities and enjoying the
same leisure activities and use of public services and facilities
available to the non-disabled population; and
WHEREAS, the Act prohibits discrimination against people
with disabilities in public accommodations, employment,
communications, transportation and accessibility to services from
state and local government; and
WHEREAS, cities must shoulder the responsibility and
embrace the opportunity to set the standards for the implementation
of the Americans with Disabilities Act; and
WHEREAS, state and local governments must be in
compliance with the Act by January 26, 1992.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of North Richland Hills to support the spirit and the letter
of the Americans with Disabilities Act and encourage all employers,

Ordinance Adopting TMRS Prior Service Credit

The Texas Municipal Retirement System (TMRS) now allows a member to
receive credit for service previously performed as an employee of
a non-TMRS city provided our City adopts this benefit by ordinance.
Ordinance No. 1777 satisfies that requirement. The credit for any
such prior service has no monetary value in computing retirement
annuities and does not increase the City's contribution rate.
Recommendation:
It is recommended that the City Council approve Ordinance No. 1777
adopting the TMRS Prior Service Credit benefit.

TEXAS MUNICIPAL RETIREMENT SYSTEM, RESTRICTED PRIOR SERVICE CREDIT
TO EMPLOYEES WHO ARE MEMBERS OF THE SYSTEM FOR SERVICE PREVIOUSLY
PERFORMED FOR TEXAS CITIES FOR WHICH SUCH EMPLOYEES HAVE NOT
RECEIVED CREDITED SERVICE; AND ESTABLISHING AN EFFECTIVE DATE FOR
THE ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLARD
HILLS, TEXAS:
Section 1. Authorization of Restricted Prior Service Credit
(a) On the terms and conditions set out in Section 853.305 of
Subtitle G of Title 8, V.T.C.A., Government Code, as amended
(hereinafter referred to as the "TMRS Act"), each member of the
Texas Municipal Retirement System (hereinafter referred to as the
"System") who is now or who hereafter becomes an employee of this
City shall receive restricted prior service credit for service
previously performed as an employee of any incorporated city or
town in this state and for which the person has not otherwise
received credited service in the System. The service credit hereby
granted may be used only to satisfy length-of-service requirements
for retirement eligibility, has no monetary value in computing the
annuity payments allowable to the member, and may not be used in
other computations, including computation of Updated Service
Credits.
(b) A member seeking to establish restricted prior service credit
under this ordinance must take the action required under said
Section 853.305 while still an employee of this City.
Section 2, Effective Date.
This ordinance shall be and become effective on the 1st day of

Request for Additional Funds - Removal
of Hazardous Waste

Agenda Number: GN 92-04
Funds are allocated each year in the Fire Department budget to pay for the
services of a professional firm to clean up and dispose of hazardous waste
spills. Every effort is made to recover these costs from the responsible
party, including legal processes. However, the firm providing the service must
be paid, and these events seem to be increasing.
The original appropriation for the Fire Department Hazardous Material account
was $2,000 for fiscal year 1991/92. The budget has almost been depleted with
minor clean-ups during the first three months of this year, and we now have a
$8,417.04 charge which must be paid, as described in PAY 92-01. Additional
funding is proposed for this expense and to provide for future possible
contingencies.
Recommendation:
It is recommended that City Council appropriate an additional $15,000 from the
City Council's Budget Reserve for Contingency to the Fire Department's
Hazardous Waste Contingency account.

The developer of the proposed Tapp Addition as shown on the attached
location map desires to dedicate to the City the street right-of-way
(ROW) for the subject streets. The developer will voluntarily agree to
90% street cost assessment on Boulder Drive by contract prior to
construction by the city. Boulder Drive paving and drainage
construction plans have already been reviewed by staff and preliminarily
approved.
After acceptance of the Boulder Drive ROWand final approval of plans,
the street project will be bid as a City project. Council will be
brought the bids for consideration and award of contract. Developer
will pay assessments prior to award of bid by Council.
Recommendation:
staff recommends Council approve dedication of the subject right-of-way.

THAT the Trustees, E-Systems, Inc. Pool Trust ("Grantor") of the County of
Dallas, state of Texas, in consideration of the sum of One and NO/IOO---
($1.00) Dollars---- and other good and valuable consideration in hand paid by
the City of North Richland Hills receipt of which is hereby acknowledged, do
by these presents grant, bargain, sell and convey unto to the City of North
Richland Hills ("Grantee") as a street right of way, the free and
uninterrupted use, liberty and privilege of the passage in, along, upon and
across the following described property owned by Grantor: See Exhibits "A"
and "B" attached hereto and made a part hereof by reference for all purposes.
The grant of this street right of way is subject to the following terms and
conditions:
1.
Grantor (its successors and assigns) shall have no liability for
any portion of the expense of construction of contemplated Boulder
Drive whether by assessment, pro rata change or otherwise.
2.
Any utilities placed within the right of way shall be underground
unless separately approved by Grantor (its successors or assigns) .
The road project contemplated for this Right of Way shall be
completed no later than December 31, 1993 and shall be in
accordance with plans and specifications approved by the City of
North Richland Hills.
3.

The road is abandoned by replat or otherwise, the entire right of
way shall revert to the then current owner (or owners) of the land
on the south side of the road.
5.
Grantor (its successors and assigns) may landscape or pave any
portion of the land subject to this right of way conveyance.
Grantee shall be responsible for repairing or replacing any such
landscaping or paving which is disturbed in connection with Grantee
maintaining the streets or utilities which are located in the right
of way.
A water line shall be stubbed out at the east end of the right of
way as described in the Boulder Drive project plans. Grantor (its
successors and assigns) shall not be responsible for any cost of
the water stub out, by assessment, pro rata, or otherwise.
6.
Grantor reserves the right to alter the typography of the site in
connection with Grantors grading plan for the entire parcel of
which this right of way is a part.
S. The plans for Boulder Drive shall include appropriate treatment for
the spring water existing under Boulder Drive.
7.
TO HAVE AHD TO HOLD unto the said City of North Richland Hills as
aforesaid for the purposes aforesaid the pr,~ises above described.

Boulder Drive street and Drainage Agenda Number: GN 92-06
Improvements
Subject:
stanley M. Peskind and Lawrence R. Burk (Rufe Snow/Loop 820) are
currently platting and developing the property surrounding the subject
street improvements from Loop 820 north to Industrial Park Boulevard.
They have requested the City Council consider constructing the street
project and assessing the adjacent property owners for 90% of the total
cost including engineering. Mr. Peskind and Mr. Burk own and/or will be
responsible for the cost of all frontage along Boulder Drive concerning
assessment.
The engineer's estimate of cost for the subject improvements is
$528,074. The City will award the contract and pay the contractor for
all construction costs. Prior to award of the· contract Rufe Snow/Loop
820 will pay 90% of the construction costs by placing this amount in
escrow with the City, based on the actual bid.
The attached City-Developer Agreement addresses all these issues. It is
estimated the City's 10% cost participation will be $52,800.

That I/we, RUFE SNOW/lOOP 820, a Texas General Partnership composed of
Stanley M. Peskind and Lawrence R. Burk hereinafter called "Developer" and the
City of North Richland Hills, Tarrant County, State of Texas, hereinafter called
"City", witnesseth:
WHEREAS, the City has Boulder Drive shown on its Master Thoroughfare Plan as a
proposed four lane undivided street; and
WHEREAS, the Developer is developing the property which includes proposed
Boulder Drive; and
WHEREAS, the City is willing to construct Boulder Drive as a City project and
assess the adjacent property owners in accordance with State law; and
WHEREAS, the Developer is requesting voluntary assessment of the property
adjacent to the proposed Boulder Drive.
NOW THEREFORE, the parties agree as follows:
1 . The Developer will have his consulting Engineer prepare final plans and
specifications for the proposed street and drainage improvements. The
Engineer shall also furnish construction surveying, cut sheets, and change
orders as necessary.
2. With the assistance of the Developer's Engineer, the City will take bids for
the improvements. Upon recommendation from the engineer, the City
Council will award the contract.
3. Inspection of construction on this project will be provided by the City staff.
4. All Contractor pay estimates will be submitted by the Contractor to the
City's Inspector. The Inspector upon approval will submit the estimates to
the Engineer. The Engineer will review the pay estimates and write a short
letter of recommendation for payment. The Engineer will then submit the
pay estimates with letter of recommendation to the City for process of
payment.

Subject:
Rufe Snow/Loop 820, a Texas General Partnership comprised of Stanley M.
Peskind and Lawrence R. Burk (Developer) is ready to install the subject
improvements. The proposed water and wastewater mains are to be
installed to serve initially the proposed Lot 1, Block 6; Lot 7,
Block 1; and Lots 1 & 2, Block 4; Tapp Addition. The water mains were
included as Lines 8309, 8310, and 8311 in the Water and Wastewater
Impact Fee Study (Study) dated May 4, 1990 by Knowlton-English-Flowers,
Inc. The sewer main was included as Line B-1c in the study. The
subject improvements as outlined in the Study are eligible for
reimbursement up to a maximum of $192,619.
Upon Council's approval of the subject agreement and in accordance with
the Impact Fee Ordinance No. 1679, the Developer will be reimbursed 100%
of his total eligible costs upon completion and acceptance of the
subject water and wastewater improvements. The final reimbursement
amount will be based on actual bid prices times the actual linear feet
of line installed, but not to exceed the eligible amount of costs or
footage in the Study.
Fundina Source:
The subject property is eligible for reimbursement as outlined in the
Impact Fee Study. The proposed improvements may be funded from account
numbers 02-91-04-6000 (Impact CIP Water Lines 8309, 8310 & 8311) and
02-91-05-6000 (Impact CIP Wastewater Line B-1c).
Recommendation:
The staff recommends Council approve the subject City-Developer
Agreement and authorize the Mayor to sign said agreement on their
behalf.

CITY-DEVELOPER AGREEMENT
THE STATE OF TEXAS
KNOW ALL MEN BY THESE PRESENTS
That RUFE SNOW/LOOP 820, a Texas General Partnership composed of Stanley M. Peskind and
Lawrence R. Burk, of the County of Dallas, State of Texas, hereinafter called "Developer" and the City of
North Richland Hills, Tarrant County, State of Texas, hereinafter called "City", enter into the following
contract.
In consideration of mutual covenants herein contained and for the purpose of providing water and
wastewater system improvements as indicated in the construction documents titled "THE T APP
ADDITION, Blocks 1, 4 & 6; Rufe Snow Drive at I.H. Loop 820" by Raymond L. Goodson Jr., Inc., Job
No. 91-357, initially installed to serve the T APP ADDITION, an addition to the City of North Richland
Hills, Texas, the Developer and the City hereto agree:

The Developer agrees to pay the City all inspection and processing fees and furnish all permits,
easements, and rights-of-way as required for the construction of the above referenced facilities.
In addition, at no cost to the City, the Developer agrees to have complete construction plans,
specifications and all other necessary contract documents prepared by a registered professional
engineer and also furnish construction surveying, cut sheets and field adjustments.
The Developer will advertise the proposed work in accordance with the City's requirements and
open bids publically at the City Hall at the advertised time and date.

The Developer will enter into a contract with the Contractor who will perform the work and who
will be paid by the Developer as specified in the construction contract documents. Monthly pay
estimates shall be subject to the City's review.
The Developer agrees to provide at no cost to the City, all testing necessary to insure that the
construction is in accordance with the project specifications and the City standards.
The Developer understands and agrees that he has no authority to cancel, alter or amend the
terms of the construction contract without specific written authority of the City and that he shall
be responsible for paying the costs of any cancellations, additions, alterations, or amendments to
the Contract unless specifically provided otherwise by written authorization from the City.
The Developer agrees to r~quire the selected contractor to provide to the City on City forms,
maintenance bonds in the amount of twenty (20%) percent of the contract price. The bond shall
be submitted prior to commencing with construction and shall be good for two (2) years
commencing with the City approved completion of the facilities.
The City agrees to participate in the cost of the facilities after construction is complete and
accepted. The description and amount of participation is as follows:

In accordance with Ordinance No. 1679, the Water and Wastewater Impact Fee Ordinance, the
City will reimburse the Developer the eligible impact fee funds for the proposed improvements.
The City shall reimburse the Developer the amount agreed upon from the "water impact fee fund"
account and the "wastewater impact fee fund" account. The reimbursement payment by the City
of the total agreed amount will be made to the Developer after the construction of the
improvements is complete and accepted by the City.

The City will provide the inspections as required and upon satisfactory completion of the work,
the City will accept ownership and operation of the system subject to the terms of the
maintenance bonds.
The Developer further covenants and agrees to, and by these presents does hereby, fully
indemnify, hold harmless and defend the City its officers, agents, and employees from all suits,
actions or claims of any character, whether real or asserted, brought for or on account of any
injuries or damages sustained by any persons (including death) or to any property I resulting from
or in connection with the construction, design, performance or completion of any work to be
performed by said developer, his contractors, subcontractors, officers, agents or employees, or in
consequence of any failure to properly safeguard the work, or on account of any act, intentional
or otherwise, neglect or misconduct of said developer, his contractors, subcontractors, officers,
agents or employees, whether or not such injuries, death or damages are caused, in whole or in
part, by the alleged negligence of the City of North Richland Hills, its officers, agents, servants,
employees, contractors or subcontractors.
Upon completion of the work, good and sufficient title to all facilities constructed warranted free
of any liens or encumbrances is hereby vested in the City of North Richland Hills.
Special provisions: None
This agreement shall become effective on the latest date of execution following and shall bind the
parties, their successors and assigns.

The staff has negotiated with steven F. Spiritas to purchase right-of-
way from his property that fronts on Bursey Road. The negotiated price
is $3,798.00, equaling $0.60 per square foot from property that is zoned
AG.
A total of 22 parcels of right-of-way need to be acquired. To date, 11
of the 22 parcels have been acquired. The remaining 11 parcels are
owned by 5 property owners.
Recommendation:
The staff recommends approval of payment for right-of-way on Bursey Road
to steven F. spiritas in the amount of $3,798.00.

Bids were taken on December 20, 1991, for the referenced project. This project includes
construction of an 8-inch diameter sanitary sewer main along the north side of Glenview
Drive from Ashmore to Glenview Court. This sewer main is required to transfer service
from homes and businesses in North Richland Hills from a Richland Hills-owned sewer main
in Glenview Drive. This project was approved by Council on April 8, 1991, per Agenda

The total budget for this project was set at $113,200 per PW 91-13, which includes $90,000
for construction. This is sufficient to cover the low bid amount of $59,113.94.
The low bidder, Radich Construction, Inc., has recently completed similar work in
Weatherford, Addison, and Arlington. The City Engineer of Weatherford indicated that
Radich Construction Company did an excellent job, and they also used Radich for additional
miscellaneous work after the primary project was completed. We received no negative
comments from any of the other references contacted. Therefore, we would recommend
award of this project to the low bidder, Radich Construction Company, Inc., P.O. Box
1355, Keller, Texas 76248, in the amount of $59,113.94, for a period of 45 Calendar
Days.
We will be present at the January 13, 1992, Council Meeting to answer any questions you
may have concerning this project.

In July 1991 our Fire Department responded to a fuel leak involving a dump
truck that had over-turned on private property at 7716 Davis Blvd. The dump
truck's fuel tank ruptured spilling diesel fuel into a fish pond. EM Tech
Environmental Services, Inc. was called in to clean up the diesel fuel.
The trucking firm's insurance company has refused to pay the clean up costs.
Since the contract with EM Tech is with the City, it is our responsibility to
pay the invoice and pursue recovery through the City Attorney.

Watauga Road Assessment
Ms. Cynthia Brunsch will be appearing before the Council Monday night
under citizen presentation. She will be asking to be relieved of her
street assessment on Watauga Road ($486.74). Ms. Brunsch lives in the
North Park Subdivision and owns a rent house that backs up to Watauga
Road. On July 27, 1987 the City Council waived the assessment for
citizens who have a residential homestead and whose homes back up to
Watauga Road. Ms. Brunsch would like a similar waiver and will ask to
be released from her assessment lien.
Attached, for your information, are the minutes of the July 27th City
Council Meeting and Ms. Brunsch's letter requesting that she be allowed
to appear before the City Council.

requested the reconsideration, he would make the motion that a variance
for the sign ordi~ance be granted.
Motion died for lack of a second.

GN 87-53 RECONSIDERATION OF ASSESSMENTS
FOR WATAUGA ROAD (HEARD AT THE JUNE 22, 1987 COUNCIL MEETING)
APPROVED
Councilman Davis moved, seconded by Councilman Garvin, to adopt revised
Ordinance No. 1468.
Mayor Echols presented the following revision:
liThe assessment on the property on the attached roll which is the actual
residpntiñl homestead of the owner, where he resides, will be waived by
signed release of the City in the case of residential front assessments
and will be waived by signed release of the City in the case of
residential side and residential rear assessments provided that it is the
actual residential homestead of the owner, where he resides, if such owner
executes' a covenant within 30 days permanently waiving his and future
owners' right to direct access to the improvement from the lot in
question. In addition, in order to procure said release from the City
such owner must execute an affidavit of homestead on a form provided by
the City within 30 days. II
Motion carried 6-0.
