HomeMy WebLinkAboutOrdinance 2078 ORDINANCE NO. 2078 AN ORDINANCE REZONING PROPERTY IN ACCORDANCE WITH ARTICLE 2, SECTION 200, OF ZONING ORDINANCE NUMBER 1874, PASSED, APPROVED AND ADOPTED BY THE CITY COUNCIL ON MARCH 22,1993; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, after appropriate notice and public hearing, the following recommendation is submitted to the City Council of the City of North Richland Hills, Texas, by the Planning and Zoning Commission; and WHEREAS, the Planning and Zoning Commission of the City of North Richland Hills, Texas, has forwarded a recommendation to the City Council for amendment of Ordinance No. 1874 and the Official Zoning Map by rezoning certain property; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: 1. THAT, on Case Number PZ 95-20, the following property shall be rezoned from R-3 Single Family Residential to C-1 Commercial: BEING all that certain tract, parcel, or lot of land located in the J.H. Barlough Survey, Abstract No. 130, Tarrant County, Texas, and being the remainder of a 1.57 acre tract deeded to B.C. Brown and wife Louise Brown, as recorded in Volume 2427, Page 583, Deed Records, Tarrant County, Texas, and also being a part of that certain tract recorded in Volume 3648, Page 125, Deed Records, Tarrant County, Texas, and more particularly described by metes and bounds as follows: BEGINNING at an iron rod found for corner situated 44.97 feet north from the northwest corner of that certain tract recorded in Volume 2427, Page 583, said point also being the southwest corner of that tract recorded in Volume 3648, Page 125, Deed Records of Tarrant County, Texas, and being in the East line of Lewis Lane; THENCE North 89 degrees 36 minutes 02 seconds East, 123.85 feet to an iron rod for corner; THENCE South 00 degrees 05 minutes 53 seconds West, 45.42 feet to an iron rod for corner; THENCE North 89 degrees 48 minutes 35 seconds East, 7.69 feet to an iron rod for corner; THENCE South 00 degrees 03 minutes 20 seconds West, 164.55 feet to an iron pipe for corner in the north line of Newman Drive; THENCE South 89 degrees 49 minutes 50 seconds West, 131.30 feet along said Newman Drive to an iron pipe for corner in the east line of the aforesaid Lewis Lane; THENCE North 209.47 feet to the POINT OF BEGINNING, containing 0.625 acres of land, more or less. This property is located at the northeast corner of Newman Drive and Lewis Lane. 2. THAT, the Official Zoning Map be redrawn to incorporate this zoning district boundary amendment and the herein described ordinance number be affixed to the property described herein. 3. SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the section, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. 4. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage.
