These departments could be without servioe for up to three hours. The emergency service nwnber (911) should not be affeeteCl.. However, emerqency technicians will be on site from Southwestern Bell anc! Siemens (Tel Plus) should any unexpected problems arise. In addition, , police and fire radio communication back up systems will :be in place during the conversion. The new system will be operational Satur4ay morn1n;. · Attachment "A" is the new phone number directory which will be in- effeot by Monday morning, February 25. Attachment "B" is a copy of the key phone number liatinC;8 which will appear 1n the newspaper over the weekend and regional telephone dlreotories a~ they are published. This revised policy in the form of an ordinance is attached. Currently, the City is processing two street assessment projects. Davis Boulevard (FM 1938) from Emerald Hills Way to Rumfield Road assessment hearing is to reconvene on March 25, 1991. A final assessment roll will need to be included with the ordinances passed to set the assessments on the 117 õdjacent properties. Also, Bursey Road from Rufe Snow Drive to Kandy Lane is being prepared for an enhancement study and subsequent assessment hearing. The new assessment policy will affect the assessments on these projects depending on when the new policy is approved by Council. Summary tables for both Davis Boulevard and Bursey Road assessments are attached as Exhibits "A" and "B", respectively. A comparison of the effect the new policy will have on the overall assessment amounts is shown below. They will be applicable to construction, reconstruction, and major maintenance projects where substantial improvement results and abutting property is increased in value. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, that: 1. Ordinance No. 1338 is repealed. 2. GENERAL Residential assessments will be based on the "1/3-1/3-1/3" rule, i.e.,property owners on each side of the street would be assessed 1/3 of the cost of paving a standard 30-foot street, and the City would pick up the remaining 1/3 plus any additional costs for street widths greater than 30-foot (face-of-curb to face-of-curb). Non-Residential assessments will be based on the "45-45-10" rule, i.e., property owners on each side of the street would be assessed 45-percent of the paving costs and the City would pick up the remaining la-percent. ASSESSMENT CATEGORIES The type of land use of adjacent property is considered in calculation of the assessment rates. There are two assessment categories, RESIDENTIAL and NON-RESIDENTIAL. This applies to both RESIDENTIAL and NON-RESIDENTIAL categories. This does not apply to curb & gutter, sidewalks, or driveways. PETITIONED STREETS Any existing street in the City of North Richland Hills may be considered for improvements by the City Council. All currently unimproved streets which are upgraded to City Standards are subject to the provisions of the City's Street and Drainage Assessment Policies as outlined herein. Streets not currently being considered for improvements by the City Council, the Public Works Department or City staff, may be considered for improvements if 50-percent or more of the property owners adjacent to the street request improvements by Petition. If Council approves construction of the Petitioned street, then all adjacent property owners are subject to assessments based on the "Non-Residential" category rates as outlined above. ESTIMATED CONSTRUCTION COSTS AND ENHANCEMENT STUDY An assessment roll of all privately owned property adjacent to the proposed street and drainage improvements will be prepared by the City Engineer or Public Works Department staff. Assessment values will be computed based on the estimated construction cost of the street facilities times the appropriate percentage factors. An enhancement study will be prepared by an independent Certified Land Appraiser to determine the effect of the proposed improvements on adjacent land values. Assessments to adjacent property shall not exceed the enhanced value of the adjacent property after construction of the improvements in accordance with State law. Curb Inlets per Each Construction items not considered in the assessment calculations include concrete valley gutters; traffic buttons or striping; traffic signal lights; seeding, sodding, or other landscape improvements; concrete retaining walls or landscape timbers; cross-drainage such as box culverts or bridges; off-site storm drainage or concrete channels; and water or sewer utility adjustments. Drainage costs per linear foot will be computed based on the total estimated cost of the Drainage Construction Items listed above divided by the total length of the street (including side streets). The assessable portion of this linear foot cost is computed based on the provisions outlined below. Appropriate CREDITS are given to adjacent property owners for removal and replacement of existing concrete curb and gutter, concrete sidewalks, or concrete driveways depending on the condition of the existing facilities. Property owners will be required to pay 100-percent of the cost of new concrete driveways if existing driveways are dirt, grass, crushed stone, gravel, asphalt, or other non-standard materials. The estimated construction costs computed for purposes of assessments shall include an allowance for Engineering, Layout, Inspection, Testing and the Appraisal Costs. In the absence of actual costs, an allowance of 10- percent of total construction cost for Engineering, Layout, Inspection and Testing will be used. An estimate of 2-percent of construction costs will be used for the Enhancement study unless actual costs are available. 3 . The percentage figures cited above are general in nature and the Council reserves the right to adjust the actual dollar amounts within the limits allowed by Texas Law from project to project in accordance with the relative value added to the assessed property. In the absence of substantial evidence to the contrary, the primary factor in determining the value added to abutting property will be the cost of the improvements. 4. This ordinance shall be in full force and effect from and after its passage and publication as provided by law. CITY OF FORT WORTH (FW) WASTEWATER SERVICE RATE CASE The subject rate case is currently before the Texas Water Commission for hearing. The City of Arlington has never signed the standard wholesale wastewater contract which we and all the other wholesale customers agreed to in 1987. ARL is trying to get rates established for FW's wastewater service to them in a different manner than the way it is calculated for the other wholesale customers. If they succeed, their rates will be considerably less than the other wholesale customers and will result in approximately an annual $800,000 revenue decrease for FW. The results of this action will be an increase in the rates to the other wholesale customers under the renegotiated 1987 contract. In an emergency Wholesale Wastewater Advisory Committee meeting held February 20, 1991, FW has recommended the wholesale customers may want to express to the Texas Water Commission (TWC) our concern with this rate case. At the Council's discretion, our participation in the case could be as little as giving deposition here and sending it to the TWC or as great as hiring our own lawyer to handle our involvement. The City could drop out of the proceedings at any time. Greg Dickens was involved in the tail-end of the negotiations between FW and the wholesale wastewater customers in 1987 concerning a uniform wastewater service contract. He feels it is necessary at this time to take a stand with FW on this rate case. If Arlington prevails in this case, he feels it will cause our rates to increase and may cause the II system-widell concept of calculating the rates to dismantle. On the other side of this coin, advocating on behalf of Fort Worth against another customer city may have some potentially negative results to North Richland Hills citizens. The owner, Mr. Ron Honea, is wanting to connect the trailer park sewer system to the Trinity River Authority's (TRA) Little Bear Creek sewer outfall. He would like to acquire the offsite easements and pay for installation of a public sewer main to be laid up to and through his property. This will allow Mr. Honea to abandon his current wastewater treatment plant serving approximately 45 to 50 mobile homes. The subject mobile home park owner came to the City staff in January, 1985 to replat the original 1970 City of Hurst platting of this site. He was allowed to fill out an application and submit engineering plans. staff reviewed the plat submittal and commented on the requirements for drainage, water and sewer improvements to meet the subdivision ordinance. Apparently, the owner never revised this plat submittal to meet these requirements and therefore the plat was never submitted to the Planning and Zoning Commission for consideration. We believe the owner is being forced at this time by the Texas Water Commission to repair and expand this wastewater treatment plant or tie onto City sewer service (see attached TWC letter). The mobile home park is a nnon- conforming usen as defined by the City's zoning ordinance. A nnon-conforming use" by Section XXVI, paragraph 26.8, page 169 cannot be enlarged or extended. Due to these factors, staff recommends the Oak Leaf Mobile Home Park not be allowed to replat unless the nnon-conforming use" is stopped and a conforming use is proposed. We also recommend the City not allow the non-conforming use to tie onto public sewer at this time. Your guidance in this matter is requested. Mr. Bud Conyers, contract plant operator, was contacted for the inspection. Mr. Larry Coleman was contacted by telephone on July 9. A copy of the inspection report is available from our office upon request. The following problems were noted during the inspection and are in need of correction: 1. The plant bar screen had rusted away. The absence of the bar screen can result in excess wear on, and clogging of, plant pumps and reduce the overall efficiency of plant operation. A new bar screen should be installed immediately. 2. Sludge had begun to accumulate in the chlorine contact basin. Such an accumulation will ultimately result in the discharge of solids in the plant effluent and the violation of permitted effluent quality limits. Adequate sludge management is one aspect of the proper operation and maintenance of the treatment facility required by your permit. Sludge should not be allowed to accumulate in the contact basin. Changes in the frequency of wasting and/or removal of sludge from the plant may be needed to correct this problem. Please consult with your plant operator as to the necessary corrective action. 3. The treatment plant is subject to overflow and flooding during extended periods of wet weather. The situation is more likely the result of the inability of the plant's effluent to discharge to the receiving stream when the creek is at high flow. The discharge point is blocked by the high water, and flow backs up into the plant. The plant overflows and is often covered as flow builds up inside the berm around the plant. The berm is over six feet above the top of the plant, and thus flow is initially contained on-site. Once the discharge line begins flowing; however, inadequately treated waste may be discharged as the water level drops inside the berm. This problem was the cause of the exceedence of the permitted total suspended solids (TSS) limit in June 1989. In addition to the impact of the effluent back-up and flooding, restoration of treatment plant operation is hampered by the fact that the plant power supply is often interrupted during the flooding. The plant's electrical connection is on a pole immediately adjacent to the plant, within the bermed area. The connection has been flooded as water rises within the berm. Your permit (Item C.4, page 8) states: "The permittee is responsible for installing prior to plant startup, and subsequently maintaining, adequate safeguards to prevent the discharge of untreated or inadequately treated wastes during electrical power failures by means of alternate power sources, standby generators, and/or retention of inadequately treated wastewater. II This situation has existed for several years. Please investigate these problems and take the appropriate corrective actions. An effluent pump may be nec~ssary to prevent the recurring back-up of flow into the plant and flooding of the power supply. Your engineer and plant operator may be able to advise you of viable alternative solutions. 4. A large pool of water was observed next to the treatment plant. This pool had formed following the collapse and blockage of the plant discharge 1 ine, which resul ted in a back-up into and flooding of the plant in late March. Such a pool likely contains excess sludge, nutrients, and fecal coliform bacteria, and provides a potential mosquito breeding habitat within the mobile home park. The contents of this pool should ei ther be pumped into the treatment plant or removed by a licensed septic hauler, and the area properly disinfected. Honea Page 3 August 15, 1990 305.125(4) states: liThe permittee shall take all reasonable steps to minimize or correct any adverse impact on the environment resulting from noncompliance with the permit and shall carry out such measures as are reasonable to prevent significant adverse impacts on human health or the environment. ,. Cleanup activities should be undertaken as soon as plant operation is restored following any bypass or flooding event. As you are aware, this facility became the subject of formal enforcement action in early 1988 due to effluent quality violations, inadequate plant operation and maintenance, and inadequate record-keeping. Following the initiation of enforcement, you contacted an engineering firm regarding a sludge management plan for the treatment plant, and began exploring the possibility of a sewer connection with the City of North Richland Hills. In October 1988 you were informed that the plant's daily average flow had exceeded 90 percent of the design capacity for three consecutive months, requiring either a plant expansion or a request for a waiver under 31 TAC Chapter 305.126. You reported at that time that preparations for connection with the City sewer in a nearby development were being made. In a February 10, 1989 letter to our office, you reported that, although plans had been completed, you had been unable to obtain funding for the desired sewer connection. Letters from the TWC Wastewater Enforcement Section dated December 1, 1988 and March 15, 1989 informed you that plant flow had again exceeded 75 percent of design flow for three consecutive months. There has apparently been no response to these letters. Mr. Coleman reported on July 9 that a state Highway Department project tó widen Precinct Line Road is to begin on January 1, 1991, and that a sewer line will be extended along this route. Mr. Coleman reported that you are willing to connect the mobile home park to this new line. The city of North Richland Hills reports, however, that there are no definite plans to extend a sewer line along Precinct Line Road at this time. Although plant operation has greatly improved over the conditions that led to the initiation of enforcement action, this case remains open pending a final resolution of all problems affecting the facility. This includes correction of the problems described in this letter, and a decision regarding either the upgrading of the facility, or a connection with the City sewer and elimination of I· I Ie I I I I I I Ie I I I I I I I Ie I Mr. Ronald G. Given the fact that plant flow has exceeded 90 percent of design for three consecutive months, you must make some decision with regard to the requirements of Chapter 305.126. If you plan to keep the existing facility in operation, then, as per 31 TAC Chapter 305.126, you must either plan for expansion of the plant to meet increased flow or request a waiver of this requirement. Please respond in writing to this office within 30 days of receipt of this letter explaining (1) the actions taken to correct the problems enumerated above, and (2) your plans regarding either the upgrading of the facility, intent to request a waiver, or connection with the City sewer. GN 91-15 PUBLIC HEARING FOR CONSIDERATION OF REVISIONS TO THE MASTER THOROUGHFARE PLAN REGARDING WATAUGA ROAD, RUMFIELD ROAD, AND BURSEY ROAD - ORDINANCE NO. 1710 APPROVED Mayor Brown opened the Public Hearing and called for those wishing to speak to please come forward. Mr. Mark Wood, Chairman of the Planning and Zoning Commission, explained the changes. Council had been presented a petition in Pre-Council requesting a change on Bursey Road from four lanes to two. It was advised that any changes to Bursey Road needed to be acted upon by the Planning and Zoning Commission. Some Council members felt that in that area Bursey Road did not need to be four lanes. The following appeared and spoke against Bursey Road being a four lane thoroughfare: Mr. Konrad Roeder, 8016 Hunter Mr. David Wells, 7508 Bursey Road There being no one else wishing to speak Mayor Brown closed the Public Hearing. GN 91-19 IRON HORSE GOLF COURSE; 1991 RATES APPROVED Mayor Pro Tern Davis moved, seconded by Councilwoman Spurlock, to approve GN 91-19 rates to be effective March 1, 1991. Mr. Bill Whitaker, 6757 Greenacres, spoke in favor of the rates for the golf course. Mr. Bill Smith, 8409 Springbrook, spoke against the higher fees and felt that all participants should be charged the same fee. Mr. Smith advised he was the President of the Men's Golf Association and approximately 70 percent were non-residents and had to pay the higher fee. Council advised the rates would be looked at again in one year. Council Meeting Date: PS 91-,01 Agenda Number: for Final Plat of Lot 1, Block 1, Northglenn Addition. This property is located on the west side of Rufe Snow Drive, north of Glenview Drive. JEMtex Development Company has submitted a Final Plat of a 4.07 acre tract located near the northwest corner of Glenview Drive and Rufe Snow Drive. The purpose of the proposed plat (Lot 1, Block 1, Northglenn Addition) is to provide for the construction of a new grocery store facility at this location. The property is currently zoned C-l Commercial and a grocery store is a permitted use in this zoning district. I ~ I The developer has agreed to provide an extension of a sewer line to serve the Castlewinds Apartments on the tract to the north of this proposed plat. The Castlewinds Apartments are currently provided sewer service through a sewer lift station which will be removed should the Castlewinds Apartments choose to connect to the new sewer line. This Final Plat was reviewed and approved by the Planning and Zoning Commission at their February 14th, 1991 meeting. The attached easement dedication should be incorporated into the closing paragraph of the "Metes and Bounds" description. 2. This subdivision will be required to construct a sidewalk along Rufe Snow Drive. The sidewalk should therefore be included with the construction plans. 3. Due to the minimum driveway and street entrance spacing allowed on major collectors, future additional access drives will not be allowed along Glenview. 4.. street lighting is required by Section 1-06 of the Design Manual. The locations of any existing street lights should be shown on the plans to confirm compliance with current ordinances. A street light may be required at the proposed driveway entrance onto Rufe Snow. If a street light is required, the installation should be coordinated with Public Works and TU Electric. The installation cost of additional street lights will be paid by the developer directly to TU Electric. 5. A general 7.5 foot utility Easement is required around the perimeter of the plated lot. This easement is normally required for primary electric, telephone and cable utilities. This easement is not required along street right-of-ways. A combination "Drainage and utility Easement" is acceptable in lieu of a separate "utility Easement." Utility information (Water, Sewer, and Storm Drains), Flood Plain information and City Limits to be overlaid the base map with associated information attached as relational data. Final model to be delivered to the City in Arc/Info format. MAP DESIGN Utilizing the aerial maps as the base map, a grid system will be established for the Cities of North Richland Hills and Watauga. This grid will be based on the coordinate system defined by Tarrant Appraisal District (TAD) which follows the HAD '27 Texas State Plane Coordinate System. TAD defined Right-of-Way and property lines will be corrected for minor distortion, if necessary, and added as a reference layer. Utilities will be digitized in a "Heads-Up" manner from the water and sewer grid sheets. Storm drains will also be similarly digitized from the 1985 Drainage Master Plan. Flood plain, flood way and city limits will also be digitized from existing FEMA and other maps. Following the entry of spatial information, the maps will be transferred to an Arc/Info platform and database information related to the map features. Following the completion of data entry, the individual grid areas will be referenced to an Arc/Info "Library" file. This library will organize the grid areas into an indexed file system to lessen the computer load and allow true multi-user capabilities on the system. STUDY AREA The scope of this project includes all land within the City Limits of North Rich1and Hills and Watauga plus approximately a 200 ft. buffer area. Storm drainage information is not proposed to be included for the area within the Watauga City Limits. FEATURES See DESCRIPTION OF FEATURES following. SYMBOLS Symbols to be utilized in this project will be similar to those found in other City utility maps and other accepted mapping standards. DATA INPUT Utilizing the drafting capabilities of AutoCad, the utility features will be located on the maps relative to their location on the water and sewer grid maps. Upon completion of the map feature entry, the maps will be transferred to an Arc/Info platform whereby the Database information will be entered. EDITING During the input of information, check prints will be plotted for the City's use in more accurately locating the utilities in the field. . These check prints should be utilized by the City for noting corrections to the graphic information. Major differences in placement of utilities on the maps will be resolved prior to the final draft. CORRECTIONS Following the City's return of the check prints, corrections will be made to the drawing files revising the noted utility as needed. SCHEDULE Following receipt of the electronic aerial photographic maps, K-E-F will begin inputting graphic and statistical information related to the utility. This entry process is expected to be completed within seven months following receipt of the aerial photography. LIST OF DELIVERABlES Following completion of the mapping procedure, a final set of plots will be provided the City. Nine track tapes of all files containing the maps and database will be delivered. Hardcopy printouts of database files will be made and provided. The map grid for this project is based on a grid system matching Tarrant Appraisal District's grid system. Each of the TAD grid sheets (6,000' x 4,000' coverage) will be divided into four sections, each covering 3,000' x 2,000'. The Church has expressed concern for its members and guests who park in a lot on the west side of Parchman street. The members and guests enter Parchman street between parked cars on their way to and from church activities. The No Parking Zone will increase visibility of pedestrians to vehicles traveling Parchman street. The Church as also expressed concern about the width of Parchman street. When vehicles are parked on both sides, Parc.hman street is reduced to one lane of through traffic. The No Parking Zone is requested to be "No Parking Anytimeu. The "No Parking Anytime" will allow Parchman street to remain passable at all times. The enforcement of "No Parking Anytimeu zone is less confusing than a uNo Parking During Worship Service" zone. The Uniform Act governing Texas Motor Vehicle Laws (Art. I, Subdivision II, Section 12) allow local authorities to enact laws relating to traffic. Pursuant to Art. XII, Section 96, of the Uniform Act, Local Authorities may prohibit or restrict stopping, standing or parking of vehicles which unduly interfere with the free movement of traffic. The new rates will result in an estimated annual revenue increase for the eighteen cities on Lone Star's Fort Worth distribution system of $3,715,813, or 4.1%. The portion of the increase attributable to customers in the City of North Richland Hills is $150,031. The proposed increase in annual revenues is intended to allow Lone Star Gas Company the recovery of its expenses and also to provide Lone Star with the opportunity to earn a fair and reasonable rate of return upon its investment in the distribution system. A reasonable return is required in order to retain our present level of investors and attract new invested capital. The revenues, expenses and investment on which our filing is based have been measured as of June 30, 1990, which is the end of the test year. The proposed rate is based upon adjusted sales volumes during the test year. Attachment No.2 is a summary of the distribution system's revenue requirement, which is supported by documents recently filed with the city. The revenue required to operate this system, as with most other businesses in North Richland Hills, equals the wholesale cost of the product plus operating expenses, federal income tax and a return on investment suffi- cient to make it worthwhile to stay in business. Lone Star's last rate increase in North Richland Hills occurred in November, 1985. Since that time, revenues have become inadequate to cover operating expenses and still allow a reasonable return. Even though these expenses have continued to rise, Lone Star Gas Company still has one of the lowest operating costs per customer among major gas utilities. With this proposed increase, Lone Star will be able to continue to provide its cus- tomers in North Richland Hills an excellent quality of service at the low- est possible cost. There are three important changes proposed in this rate application that should be noted. First, Lone Star Gas is proposing a three step declining block rate for commercial customers, designed to recover the cost of serving this customer class and to encourage business growth. The sec- ond change is the elimination of the public school rate offered under contract. As these contracts expire, the school districts will become com- mercial customers and be billed under the same uninterruptible commercial rate approved by the City of North Richland Hills. The third change is a weather normalization adjustment, which would automatically adjust rates for winter weather which is abnormally cold or warm. Weather Normalization Adjustment: Effective with bills rendered during the October 1991 through April 1992 billing months and annually thereafter for the October through April billing months, the above residential and commercial consumption rates for gas service shall be subject to a weather normalization adjustment to reflect the impact of monthly variations in the actual number of heating degree days from the normal level of heating degree days during the preceding billing months of October through April. The weather normalization adjustment will be implemented on a per Mcf basis. The adjustment will be determined separately for residential and commercial customers based on heating degree data recorded by the D/FW weather station. The dollars of margin overcollected or undercollected due to temperature variations will be calculated each month during the October through April billing months according to the following formula: (AHL) M = (ADD) (NOD-ADD) (TM) (AC) Where: M Margin dollars overcollected or undercollected due to weather Actual heating load per customer Actual heating degree days Normal heating degree days included in the determination of the above rates Tailblock margin per Mcf in the above rates Actual number of customers billed AHL ADD NDD TM AC The monthly overrecoveries and underrecoveries will be accumulated during the October through April billing months to determine the net margin dollars subject to the weather normalization adjustment. Tax Adjustment: The tax adjustment shall be an amount equivalent to the proportionate part of any new tax, or any tax increase or decrease, or any increase or decrease of any other governmental imposition, rental fee or charge (except state, county, city and special district ad valorem taxes and taxes on net income) levied, assessed or imposed subsequent to July 1, 1990 upon or allocable to the Company's distribution operations, by any new or amended law, ordinance or contract. E. Rate Case Expense: If rate case expense is incurred in this current case, it is the intention of Lone star Gas Company to recover the current and any unrecovered prior rate case expense through a surcharge designed for a six-month nominal recovery period. The surcharge per Mcf would be calculated by dividing the rate case expense to be recovered by one-half of the adjusted annual sales volume to residential and commercial customers. When a surcharge is applicable, monthly status reports will be provided to account for the collections. F. WHEREAS, pursuant to the Texas Housing Finance Corporations Act, Chapter 934, Local Government Code, V.T.C.A. (the "Act"), the creation of the Tarrant County Housing Finance Corporation (the "Corporation"), was approved by resolution of the governing body of Tarrant County, Texas (the "County"), adopted on the 14th day of April, 1980, to provide a means of financing the cost of residential ownership and development that will provide decent, safe and sanitary housing for residents of the County at prices they can afford; and WHEREAS, the Corporation has the power under the Act to issue its bonds to defray, in whole or in part, the costs of purchasing or funding the making of home mortgages, provided that the aggregate principal amount of such bonds in any calendear year shall not exceed the total of (a) the costs of issuance of such bonds, any reserves or capi talized interest required by the resolution or resolutions authorizing the bonds, plus any bond disscounts, and (b) the largest of (i) $20,000,000, (ii) a figure determined by multiplying $150 times the population of the County as determined by the Corporation's rules and regulations, resolutions relating to the issuance of bonds, or financing documents relating to such issuance, or (iii) an amount equal to 25 percent of the total dollar amount of the market demand for home mortgages during such calendar year as determined by the Corporation's rules or regulations, resolutions relating to the issuance of bonds, or financing documents relating to such issuance; and WHEREAS, in accordance with the Act the Corporation is not permitted to provide financing of home mortgages for homes which are located wi thin a municipa 1 i ty wi th more than 20, 000 inhabitants as determined by the Corporation's rules, resolutions relating to the issuance of bonds, or financing documents relating to such issuance, unless the governing body of the municipality approves the application of the Act to the property located within the municipality; and WHEREAS, the Board of Directors of the Corporation has requested the approval of the governing body of the Ci ty of North Richland Hi lIs, Texas (the "Ci ty") to provide f inanc ing for home mortgages for homes within the City with the proceeds of the issuance of the Corporation's proposed Series 1991 Single Family Mortgage Revenue Bonds (the "Bonds"); I I. This amendment agreement is the result of the litigation efforts brought against the City of Fort Worth (FW) by its Wholesale CUstomers. The main issue of "Fort Worth Access Fees (Impact Fees)" is covered clearly in the amendment. The fee levels to be collected from January 1, 1991 through June 5, 1993 are outlined clearly in Exhibit "A" attached to the back of the amendment. The three time periods outlined reflect collection ratios of the maximum FW access fee level at 30%, 35%, and 40% respectively. These collection levels were previously approved by Council in GN 91-12 on 1/28/91 (Ordinance No. 1708). Also, the amendment allows for a Customer Impact Fee Committee (CIFC) to be established which allows the Wholesale Customers to become more involved in what capital improvements can be included in the impact fee 3-year review study. This amendment agreement is to cover Walker-Calloway Service area of our City which flows into TRA outfall lines and is transported to the FW system. Wholesale System Access Fees "28.1 On a quarterly basis, TRA and cities agree to pay to Fort Worth a Wholesale System Access Fee for each new or enlarged connection for wastewater service made within the respective jurisdiction of TRA or the Cities served by the General Benefit capital facilities of the Fort Worth System. The Wholesale System Access Fee to TRA or to the Cities for each such connection shall be based upon the size of water meter and shall be equal to the Wholesale System Access Fee collected for the same size water meter made within the jurisdiction of Fort Worth. The calculation of said access fee shall be consistent with all applicable state and federal regulations, and shall include only those costs associated with General Benefit capital expansions and capital improvements necessary to provide service to new development. "28.4 Neither Fort Worth nor Cities shall waive any impact fee due from a retail customer for a new or enlarged connection to its respective system within its service area. However, either Fort Worth or Cities may pay such impact fee into the fund required for paying for the capital improvements. "28. 5 The Wastewater System Advisory Committee created pursuant to Section 29 hereof shall select five (5) of its members to a subcommittee to be known as the Customer Impact Fee committee (CIFC). Every three years, beginning June, 1992, the CIFC shall submit a list of five qualified engineers or planning consultants to the Director. In the event the CIFC fails to submit a list of five consultants to Fort Worth, Fort Worth shall select a consultant to perform in the manner described herein. "28.6 Fort Worth agrees that only those capital improvements as defined in section 1.29 hereof shall be included in the capital improvements plan for the purpose of determining Wholesale System Access Fees; provided, however, Fort Worth may incl ude other capital improvements for the purpose of determining impact fees to its own retai I customers. Fort Worth shall not be required to include all such capital improvements in the plan. The CIFC shall be responsible for working with Fort Worth and its consultant to determine the capital improvements to be included in the calculation of any Wholesale System Access Fees. The CIFC shall recommend to the Wastewater System Advisory Committee which capital improvements should be included in the calculation of any Wholesale System Access Fees. The CIFC shall also meet with Fort Worth's citizen advisory committee as such citizen's advisory committee reviews and considers land use assumptions, the capital improvements plan and impact fees. "28.9 For the period of time from the date of execution hereof until June 30, 1993, TRA and the Cities agree to pay to Fort Worth Wholesale Wastewater Access Fees per new connection based upon the size of the water meter, such fees to be equal to or less than ·those amounts set forth in Exhibit "A" attached hereto and incorporated herein for all intents and purposes. The actual Wholesale System Access Fee to be paid by either TRA or Cities shall be determined by the City Council of Fort Worth. After June 5, 1993, TRA and the Ci ties agree to pay access fees in such amounts as may be determined in the manner provided el sewhere herein." Pursuant to Section 2C-1 of the MUTCD, the determination to place the sign shall be on the basis of an engineering study using the criteria set forth in that manual. The staff understands the concerns of the residents in this area and suggests several other options the Council and citizens of the Ember Oaks Subdivision may wish to consider. 1 . No parkina Zone The majority of accidents involving children and vehicles occur due to limited visibility. Parked vehicles along the curb shield the view of children from the vehicles using the roadway. Children enter the street between the parked vehicle with little warning to the oncoming traffic. A No Parking Zone could be established along both curb lines of the street to provide a clear view of pedestrian in and along the roadway. 2 . Sidewalks alona Roadwav The residents have expressed concern for the lack of sidewalks in this area. The City could establish an assessment policy concerning the construction of sidewalks in areas where they currently do not exist. The construction of sidewalks will provide a location for children and other pedestrians to utilize other than the roadway. 3 . Subdivision Entrance Sign The residents of the subdivision could place an informational sign on the Subdivision Entrance Sign. The additlonal lettering of the sign could be decorative and match the style of the existing entrance sign. The sign could read "Please Drive Carefully, Children at I Play", below the subdivision name. The informational sign should in no way resemble a Traffic Warning Sign. The Staff believes the above mentioned suggestions would be much more effective than the "Children at Play" sign. We have received many requests from neighborhood groups to post a generalized warning sign, such as "Slow - Children at Play" or other similar messages. Parental concern for the safety of children in the street near home, and a misplaced but wide-spread public faith in traffic signs to provide protection often prompt these requests. Although some cities have posted such signs in residential areas, no factual evidence has been presented to document their success in reducing pedestrian accidents operating speeds or legal liability. Studies have shown that many types of signs attempting to warn of normal conditions in residential area have failed to achieve the desired safety benefits. If signs encourage parents and children to believe they have an added degree of protection, which signs do not and cannot provide, a great disservice results. Because of these serious considerations Texas does not recognize the use of "Children at Play" signs. Specific warnings for schools, playgrounds, parks and other recreational facilities are available for use where clearly justified. Children should not be encouraged to play in or near the street. The sign has long been rejected since it is a direct and open suggestion that this behavior is acceptable. Attached to this Informal Report is a copy of pages taken from the Texas Manual of Uniform Traffic Control Devices which regulates appropriate playground signs. Request City Council deny this petition. In a related matter Mr. Jerome Taylor, who presented the above petition, mentioned that a deaf child lives in his neighborhood. There is a provision in the Texas Manual for Uniform Traffic Control Devices that allows for a sign to warn drivers of this type situation. As you recall, we placed a "Deaf Child" Warning Sign at the corner of Terry and Maple several months back. We would be happy to erect a similar sign upon a request from the parents of the deaf child. WARNING SIGNS 2C-l Application of Warning Signs Warning signs are used when it is deemed necessary to warn traffic of existing or potentially hazardous conditions on or adjacent to a high- way or street. Warning signs require caution on the part of the vehicle operator and may call for reduction of speed or a maneuver in the interest of his own safety and that of other vehicle operators and pedes- trians. Adequate warnings are of great assistance to the vehicle opera- tor and are valuable in safe-guarding and expediting traffic. The use of warning signs should be kept to a minimum because the unnecessary use of them to warn of conditions which are apparent tends to breed disrespect for ~signs. Even on the most modern expressways there may be some conditions to which the driver can be alerted by means of warning signs. These conditions are in varying degrees common to all highways, and existing :;tandards for \varning signs are generally applicable to expressways. Typical locations and hazards that may warrant the use of warning sIgns are: 1. Changes in horizontal alignment ') Intersections ~3. ,\d vance warning of control devices 4. North Richland Hills' share of the project's total construction cost plus engineering fees is $24,172.01. The attached letter from Tarrant County explains how this was determined. Funding Source: Sufficient funds were appropriated by Council actions PW 90-39, PW 90-32, and PW 90-03. Any remaining funds will be transferred to Unspecified General Fund Drawdown or Unspecified Utility ClP Fund. Three change orders were issued during the course of the construction and are listed below: Change Order #1 $510. Additional soil removal and EPA re~uired soil testing. Change Order #2 $3250. Installed fiberglass piping which should have been installed when originally installed. Change Order #3 $1500. Installed new vent system. Original vent system leaked while pressure testing.
