I Ie I I I I I I I Ie I I I I I I I Ie I INFORMAL REPORT TO MAYOR AND CITY COUNCIL No. IR 91-45 Date: April 22, 1991 Subject: STONYBROOKE SOUTH ADDITION; Water, Sanitary Sewer, Street and Drainage Improvements As reported to you on January 14, 1991, we have been trying to get the developer of the subject addition to clean out and repair the drainage channels. To date, the developer has not initiated any corrective action. The Attorney for the City and myself are in the process of investigating the most appropriate manner in which to proceed with this matter concerning the developer. We will have further information for the Council the last meeting in Mayor the first meeting in June. Respectfully submitted, ISSUED BY THE CITY MANAGER NORTH RICHLAND HillS, TEXAS I I I I I I I I I I I I I I I I I Ie I ,/ -- INFORMAL REPORT TO MAYOR AND CITY COUNCIL No. IR 91-6 Date: January 14, 1991 Subject: STONYBROOKE SOUTH ADDITION; Water, Sanitary Sewer, Street and Drainage Improvements Final acceptance of the subject project by the City and beginning of the maintenance bonds were never formally issued. Several building permits were issued by the City under temporary ?greement allowing the developer to build houses prior to total completion uf the subject improvements. With issuance of the initial building permits, .:. t appear =d to the City that only minor items and cleanup remained to be accomp}ibhcd ?rior to final approval of the subject improvements. Dur ing an extensive d~: ~~! ~n coordination with the Railroad over drainage improvements to be ins1:allecl. in their right-of-way, some of the drainage improvements began to shift and Gome apart. The attached correspondence shows our continued effort to coordinate with the developer on correcting this problem. To date, no corrective construction measures have been initiated. The purpose of this IR is to inform you that the City has stopped issuing building permits for the subject addition until all the problems are resolved. The City Manager, Director of Public Works and Attorney for the City are considering possible remedies the City may pursue. This includes among other things a civil suit. I I I I I I I f I I I I I I lit I I INFORMAL REPORT TO MAYOR AND CITY COUNCIL No. IR 91-46 Date: April 22, 1991 March 1991 Revenue and Expenditure Reports Subject: Attached for your review are revenue and expenditure reports for the six months ended March 31, 1991. Following is additional information regarding the General and utility Funds: General Fund Revenues - Total revenues through March are slightly below prior year collections. The following items should be noted: *Sales Tax - Receipts of $2,025,271 were received in comparison to a budget of $2,175,217 indicating a shortfall of approximately $150,000. Past experience has shown the April Sales Tax will be a strong indicator in the final Sales Tax forecast. *The Building Permit revenue is below the mid-year budgeted revenue by approximately $32,000. This is expected to improve some during the remainder of this fiscal year. *Curb and drainage permits exceed the budget by approximately $7,800. · *Interest Income revenue is significantly lower than the mid-year budqet. The mid-year budget is $237,500 vs. an actual of $152,585. The average rate of return for this year is lower than the previous year. General Fund Expenditures - Expenditures per the report are comparable to prior year same period. utility Fund Revenues - Revenues are slightly below the same period last year primarily due to a decline in water sales. utility Fund Expenditures - utility Fund expenditures are below budget. This can be attributed to less purchases of water from TRA and Ft. Worth. Please call if additional information is required. Such hearing shall be given and held on the 13th day of May, 1991, at 7:30 p.m. in the Council Chambers in the City Hall in the City of North Richland Hills, Texas and the City Secretary is hereby directed to give notice of the time and place of such hearing and of other matters and facts in accordance with the terms and provisions of an Act passed at the First Called Sessions of the Seventieth and Seventy-first Legislature of the State of Texas, and known as Chapters 149 and 1, respectively, of the Acts of said Sessions, now being shown as Title 13, Chapter 402, Subchapter D, of the Texas Local Government Code. In this connection, the City Secretary shall prepare and file with these proceedings a list of the properties to be assessed, the names of those persons owning or claiming any interest in said properties to whom the notice was mailed, together with the last known address of the respective owners and those persons owning or claiming an interest in said property. The City Secretary shall certify that each of the parties named in said list whose address was known was mailed a copy of the notice of hearing and shall further certify the date or dates on which said notice was mailed. A copy of the notice shall be attached to such certificate. The certificate of the City Secretary shall be conclusive evidence of the facts therein recited. Also included is the engineer's estimate of the project cost. The total assessment costs to property owners served by the proposed sanitary sewer improvements is based on 90-percent of the estimated project cost less the cost of the 2-inch pavement overlay and miscellaneous sewer allowance. The computed assessment rate per front foot is $23.42, which is $78,385.23 divided by the total front footage of 3,347.43. The total estimated project cost is $109,150.80. Finance Director Page 1 of 1 I Ie I AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IIMPROVEMENTS AND AMOUNT TO BE ASSESSED FOR SANITARY SEWER IMPROVEMENTS ON THE FOLLOWING STREET: VALLEY PARK ESTATES ADDITION WHICH INCLUDES SANITARY SEWER MAIN EXTENSIONS UP VALLEYVIEW DRIVE, PARKWAY AVENUE, AND SOUTHERN MOST PORTION OF CRANE ROAD IN THE CITY OF NORTH RICHLAND HILLS, ITEXAS; FIXING TIME AND PLACE FOR HEARING TO THE OWNERS OF BENEFITTED PROPERTIES AND TO ALL OTHER INTERESTED PARTIES; DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARINGS; AND DIRECTING THE CITY ISECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY OF NORTH RICHLAND HILLS CITY COUNCIL AND BY FILING THE COMPLETE ORDINANCE IN THE APPROPRIATE RECORDS OF THIS I CITY; PROVIDING AN EFFECTIVE DATE, AND DECLARING AN EMERGENCY. A hearing be given and held by and before the City Council of the City of North Richland Hills, Texas, to all owning or claiming any benefitted property abutting upon said portion of proposed sanitary sewer improvements, as well as to all owning or claiming any interest in any such property. Such hearing shall be given and held on the 13th day of May, 1991, at 7:30 p.m. in the Council Chambers in the City Hall in the City of North Richland Hills, Texas and the City Secretary is hereby directed to give notice of the time and place of such hearing and of other matters and facts in accordance with the terms and provisions of an Act passed at the First Called Sessions of the Seventieth and Seventy-first Legislature of the state of Texas, and known as Chapters 149 and 1, respectively, of the Acts of said Sessions, now being shown as Title 13, Chapter 402, Subchapter D, of the Texas Local Government Code. Such notice shall be by advertisement inserted at least three times in the City's official newspaper published in the City of North Richland Hills, Texas, the first publication to be made at least eleven (11) days before the date of said hearing. Said notice shall comply with and be accordance with the terms and provisions of said Act. The City Secretary is further directed to give personal notice of the time and place of such hearing to all owners or other claiming any property abutting on or benefitting from said portions of sanitary sewer as well as to allowing or claiming any interest in any such property. Such personal notice shall be given by the City Secretary mailing said notice, at least eleven (11) days before date of such hearing, postage prepaid, to the respective owners of record of the properties to be assessed, and to any person owning or claiming any interest in said properties, to the last known address of said owners or persons. It shall not be necessary for the City Secretary to mail said notice to any owner or other person claiming an interest in the property to be assessed when the address of such owner or other person in unknown to the City Secretary and cannot be determined by the City Secretary after reasonable investigation. In this connection, the City Secretary shall prepare and file with these proceedings a list of the properties to be assessed, the names of those persons owning or claiming any interest in said properties to whom the notice was mailed, together with the last known address of the respective owners and those persons owning or claiming an interest in said property. The City Secretary shall certify that each of the parties named in said list whose address was known was mailed a copy of the notice of hearing and shall further certify the date or dates on which said notice was mailed. A copy of the notice shall be attached to such certificate. The certificate of the City Secretary shall be conclusive evidence of the facts therein recited. Failure of the City Secretary to give notice of hearing by mail as herein provided for, or failure of the owners or other persons interested to receive said notice, shall in nowise invalidate said hearing or any assessments levied pursuant to said hearing, but notice of hearing shall be sufficient, valid and binding upon all owning or claiming such abutting property to any interest therein when same shall have been given by newspaper advertisement as first hereinabove provided. Such notice shall describe in general terms the nature of the improvements for which assessments are proposed to be levied, the sanitary sewer main to be extended and 2 I I. The City Secretary is hereby directed to engross and enroll this Ordinance by copying the caption of same in the Minute Book of the City Council and by filing the complete Ordinance in the appropriate Ordinance Records of this City. The total assessment costs to property owners served by the proposed sanitary sewer improvements is based on 90-percent of the estimated project cost less the cost of the 2-inch Crane Road pavement overlay and miscellaneous sewer allowance. The computed assessment rate per front foot is $23.72, which is $97,636.52 divided by the total front footage of 4,116.03 feet. The total estimated project cost is $117,436.82. Such amendments, supplements, changes, modification or repeal shall be deemed to amend, supplement, change, modify or repeal the comprehensive plan of the city and shall become a part of such comprehensive plan. AMENDMENT INITIATION An amendment to this ordinance may be initiated by: (a) City Council on its own motion; (b) Planning and Zoning Commission; (c) Request by owner or agent of owner of property to be changed. PROCEDURE All requests for amendments to zoning district boundaries shall be submitted, together with required fees, to the City Enforcing Officer, which officer shall cause notices to be sent and the petition placed on the Planning and Zoning Commission agenda. The City Council may not enact any proposed amendment until the Planning and Zoning Commission makes its final report to the City Council. This petition pertains to Blocks 1, 2, 3 and 4 of said Woodland Oaks Subdivision. All of Blocks 1, 2, 3 and 4 are currently zoned R-2 (1800 sq. ft. minimum) and are covered by deed restrictions which impose a 2500 square foot minimum on all of Block 1 and portions of the other three blocks. Block 2 is restricted to houses with minimum between 2200 square feet and 2500 square feet. Block 3 is restricted from 1800 to 2500 square foot minimum. Lot 4 is restricted from 1800 to 2500 square foot minimum. The undersigned property owners who own large homes in the addition are concerned that their property values will depreciate if residences are built in the addition which fall below a 2300 square foot minimum. We realize that we cannot formally request a zoning change. We respectfully signed that the City initiate a rezoning application covering these four blocks of Woodland Oaks Subdivision to rezone from R-2 (1800 sq. ft. minimum) to R-2 (2300 sq. ft. minimum). This piece of equipment is used after greens and tee boxes have been aerified. Plugs of grass and soil in large quantities are left after aerification. This job is labor intensive and time consuming. The use of the sweeper also allows the course to reopen sooner after we aerify. There is $1,604.16 in remaining Contractual Obligation Funds at NCNB. The balance of the purchase will be paid from the Iron Horse Maintenance Account. Recommendation: It is recommended that the City Council approve Resolution No. 91-19 authorizing the purchase of a turf sweeper for Iron Horse Golf Course with the remaining Contractual Obligation balances.
