In furtherance of your interest, we have contacted several vendors who have agreed to install their equipment in some of our marked patrol fleet for the purpose of conducting a sixty day study as to the worthiness and durabi 1 i ty of such equi pment. The -proposed study wi 11 begi n wi thi n the next thirty days. The equipment to be installed includes video recorders and wireless microphone systems all contacts with the public. ISSUED BY THE CITY MANAGER NORTH RICHLAND HILLS, TEXAS I Ie I I I I I I I t' I I I I I I -, I I INFORMAL REPORT TO MAYOR AND CITY COUNCIL IR 91-143 No. Date: October 22, 1991 Subject: September 1991 Revenue and Expenditure Reports Attached for your review are revenue and expenditure reports for fiscal year end September 30, 1991. Some adjustments have been made to show a valid comparison of actual revenues and expenditures for fiscal year 1990/91. Previous monthly financials have shown all appropriations of general fund reserves (i.e. 1989/90 encumbrances, funding for Richfield Park Light System, and the Bomb Disposal Suit. With these adjustments eliminated from the financials, the reporting amounts for actual revenues and expenditures can be compared more precisely to the respective adopted budgets. The 1990/91 actual revenues total $13,659,716 compared to expenditures of $13,622,423. The net addition to the general fund reserves is $37,293. This amount may change as a result of the annual audit currently in progress. If needed, we will be happy to give a more comprehensive explanation of the adjustments made to the general fund revenue and expenditure reports. Utility Fund Revenues - Total revenues collected for the year amounted to $13,678,456 or 91.23% of the revised budget. utility Fund Expenditures - utility Fund expenditures were $13,798,685 or approximately $120,000 above revenues. The audit adjustments for water and sewer sales will eliminate what appears to be a deficit situation. Management Services Fund - Total revenues include charges to the General and Utility Funds and other miscellaneous revenues. The total revenue for the year amounted to $1,797,832. Total expenditures for 1990/91 amounted to $1,666,334. This does not include depreciation expense to be charged as an adjustment during the year end audit. Park and Library Fund - Total revenues for 1990/91 amounted to $166,067 compared to the budget of $162,074. Total expenditures amounted to $128,164 compared to the budget of $162,074. The total revenue available for the fund was $2,054,062. The total expenditures including $165,000 for incurred claims not paid in September are $2,023,655. The net addition to fund balance is estimated to be $30,407. This amount may change as a result of year end accruals and audit adjustments. Promotional Fund - Total revenues of $171,541 are less than budgeted revenues by approximately $8,800 or 95.1% of the adopted budget for 1990/91. Total expenditures are only 83.6% ($150,853) of the adopted budget for 1990/91. The Public Works Department has been in contact with the Texas Department of Transportation (TOoT) since September 21, 1989. In December 1989, the TOoT agreed the intersection warranted a signal. The signal is to be installed with the second phase of the FM 1938 construction. In November 1990, the City Council passed Resolution No. 90-51 requesting the state install temporary signals at this location. Due to budget reductions, the TOoT is proposing a January 1993 bid date for the project. The letting date means the signals could be in place by May 1994. In a recent telephone conversation with TOoT the Public Works staff explored the possibility of constructing temporary signals at the subject intersection. The TOoT is supportive to constructing temporary signals however, do not have funds to participate in the cost. The City would have to bear all expenses to install the temporary signal. After the signals are in place, the state will maintain the signals and pay for the electricity. When the permanent signal installation at the subject intersection is complete, the original temporary equipment will be returned to the City. The staff has prepared two estimates to install the temporary signals at the intersection of FM 1938 and starnes Road. The first cost estimate of $29,800 incorporates all new equipment. The second estimate of $24,800 anticipates reuse of equipment salvaged from the Rufe Snow Drive Synchronization Project. The salvaged equipment from the Rufe Snow Project may not be available for approximately 6 weeks. Although funds are not now available for this project, drawdown funds from interest and assessments will be available during the second quarter of fiscal year 1991-92. CITIZENS PRESENTATION Mr. Tom Reilly, 6828 Megan, spoke on the proposed mall going in on the northeast corner of Loop 820 and Rufe Snow. Mr. Reilly stated Rufe Snow already carried a lot of traffic and asked how the City planned on handling the traffic that would be generated. Staff advised there were hopes of extending Industrial Boulevard from south of Browning to Loop 820 and traffic could then go west under Rufe Snow to the Meadow Lakes exit to go north. Mr. Marlin Miller, 5109 Susan Lee, asked the cost of the study that was to be done on Rufe Snow. Mr. Miller also asked what the City was receiving from Laidlaw on recycling. Staff replied the cost of the study would be $12,422 and the City had received $12,593 in revenue from Laidlaw on the recycling. Mr. Charles Cole, 6125 Riviera, asked if any progress had been made on the request that had been made pertaining to no trespassing signs. Attorney for the City explained he had been in trial and had not had time to research it. Mr. Cole asked who was responsible for cleaning the lakes in Meadow Lakes. Mr. Cole was advised the developer was responsible for cleaning the lakes. Mr. Marlin Miller, 5109 Susan Lee Lane, asked when the City was going to get the Fort Worth sign off of the post office building. Mayor Brown advised that it was being worked on. Ms. Myrtis Byrd, 7312 Hialeah Circle West, asked if the City could meet regularly with the EP A to stay informed on their activities. The company has submitted a request to replat 26 of the lots into 23 lots and thus give each lot additional width. The developer has satisfied all engineering comments. The Planning and Zoning commission requested the developer to add a five foot utility easement along the west side property line of Lot 7R-1R, Block 33 (at the southwest part of the repIat) so that adequate side yard clearance is provided between the adjacent lot and any home constructed on Lot 7R-1R. The developer has agreed to this request and it is shown on the Replat drawing. No water, sewer or street improvements will be required for this repIat. Sidewalks will be required for each lot and these will be installed as building permits are issued for construction of each dwelling unit. The Planning and Zoning commission reviewed and approved this replat at their October 10th meeting. Agenda Number: PS 91-21 - Brookes Baker Surveyors has advised the City that there are some dimensional errors in the Steeple Ridge Final Plat and have submitted a corrected plat for approval. State regulations contained in Section 212.016 of the Texas Local Government Code stipulate the procedures for approval of a corrected plat. If the Final Plat was still in the review cycle with the City, it would be a simple matter of handling this administratively. However, since the Final Plat previously approved by the City Council on 10-8-90 has been filed for record in the County Clerk's Office it will be necessary to comply with the amended plat regulations. The State platting regulations allow a city to approve an amended plat without the need for a public hearing if the purpose of the Amended Plat is to correct- a technical error in distance or a bearing, such as the case in this agenda item. No lot lines are being changed. Only the correct dimensions are being added to the few lots being corrected. The Planning and Zoning Commission reviewed this corrected plat at its October 10th meeting and has recommended approval as submitted. The concerns of the Council were: (1) Requiring masonry screening walls along C2U thoroughfares may not be appropriate, (2) Someone may construct an unattractive plain concrete wall, and (3) The maintenance requirement for a homeowners association is the wrong approach. ~ The planning and Zoning commission has completed a second review of the proposed regulations and made modifications to eliminate the masonry wall requirement on Minor Collector streets (C2U). It was determined that masonry screening walls should only be required along thoroughfares with four or more lanes. Initially, it was anticipated that masonry screening walls would be required along every thoroughfare shown on the Master Thoroughfare Plan, even Collector streets with two lanes. The technical specifications contained in the Design Manual for Public Works will prohibit "ordinary concrete finishes" and ass~re that masonry screening are aesthetically attractive. The proposed ordinance provides the Planning and Zoning Commission with the opportunity of reviewing a1 ternati ve maintenance plans, such as a maintenance bond or a similar plan which is satisfactory to the city. At the september 26th meetinq the Planning and Zoning Commission recommended approval of the attached Orãinance #1750 to amend the Subdivision Ordinance to require masonry screening walls on C4U thoroughfares and larger as shown on the Master Thoroughfare Plan. The .attached materials also includes a copy of the proposed technical construction specifications which will be contained in the Design Manual for Public Works. No masonry or concrete screening wall or its foundation shall be constructed within the street right-oi-way. Furthermore, any masonry screening wall constructed within the City of North Richland Hills not required by Section 7.1 of this Ordinance shall be constructed in a manner consistent with the standards and specifications contained in the Design Manual for Public Works/Utilities. 7.3 Unless an alternative maintenance plan is determined satisfactory to the Planning and Zoning Commission, a maintenance agreement between the City and a Homeowners Association for the continued maintenance of said screening wall shall be included with the Final Plat submittal. II. SEVERABILITY CLAUSE. Compresive strength tests conducted by an independent testing laboratory shall be submitted to the City staff for confirmation. All testing costs shall be paid by the developer or his contractor. 2. Reinforcing steel shall be new billet steel conforming to the requirements of ASTM A-615-GR.60. 3. Concrete for peirs shall be place within 8 hours of drilling pier holes. 4. Brick masonry shall be as approved by the City. 5. Mortar shall be Type "S". 6. Construction shall be in accordance with the requirements of the "Recommended Practice for Engineered Brick Masonry" Brick Institute of America. 7. Use #9 Gauge 1-3/4" wide galvanized ladder wire to extend horizontal in wall panel on every course. 8. The wall shall be a minimum of six feet in height as measured from the nearest/adjacent sidewalk grade. No masonry or concrete screening wall or column shall exceed eight feet in height unless the wall is functioning as a retaining wall and is designed as such. 9. Where it has been determined by the Director of Public Works that no drainage problems are anticipated, a four (4) inch opening, or similar design, to allow for storm water drainage shall be provided. 10. Prefabricated screening fences such as "brickcrete" or "woodcrete" may be substituted for on-site masonry construction, provided that the finish resembles typical masonry constructed fences. He asked Mr. LeBaron to explain the history of this item. Mr. LeBaron said this issue started about a year ago. He said the Commission asked City Staff to look into what other cities were doing regarding masonry screening walls. Mr. LeBaron said he found that some cities were requiring them, some did not require them, and some had construction standards for developers if they put in screening walls. Mr. LeBaron said he had a slide show for the Commission where we looked at different types of construction of these fences. He said he took Planning and Zoning's suggestions and prepared this ordinance. He said this ordinance was then submitted to the City Council for their review and on July 22nd they asked questions regarding the way you were going to apply the requirement for masonry screening walls. Mr. LeBaron said the ordinance stated that when a subdivision is developed adjacent to a thoroughfare as shown on the City's Master Thoroughfare Plan, the development would be required to construct a masonry screening wall according to these standards. Chairman Brock said there is concern that this amendment could create more problems than it would be eliminating and that was not P & Z's intention to do that. He said economics sometimes takes care of problems like this. He said we had concerns about fences that were built, that they would meet certain requirements and standards so they would not fall down after a few years. Mr. Barfield said he felt that requiring these on a C2U might be a little restrictive. He suggested changing it to require them on C4U or greater. Also in the design criteria, he suggested eliminating the column spacing. He said in the last paragraph it talks about it being designed by a professional engineer and the engineer should be able to tell if the columns need to be on 10 feet or 25 feet or what. Mr. Barfield said the requirement for a 4 inch opening along the bottom of the fence to allow storm water to pass could be arbitrary, if a fence is at the top of a grade and you have water shed both directions, you would not need water passing under the fence. He said he thinks they should put more burden on the structural engineer. Mr. Lueck said he also feels the 4 inch requirement should be left up to the engineer. Chairman Brock said paragraph 7 of the ordinance needs to be changed from a C2U to C4U or greater, but how should we deal with the sentence that deals with a distance of 400 feet. Mr. LeBaron said if we are going to change the requirement to C4U, we might want to change that criteria also. He said when P & Z first started talking about this, you said that any subdivision or replat that would be adjacent to a C2U or greater would have to put a masonry screening wall along the C2U or greater. He said then they felt it might become a hardship for a small subdivision with maybe 2 lots that adjoins a thoroughfare. Mr. LeBaron said they decided that if you have one street intersection or if you extend 400 feet or more, it would be required and you would be excluding the small subdivisions. Chairman Brock said he felt if they change it to a C4U, you would need the masonry screening fence. Mr. Barfield said if it backs up to a C4U, but the entrance is off a C2U and if there is no intersection, they would not have to put up a masonry fence. He said you would probably need one or the other. Mr. LeBaron said if you are on a 4 lane or larger, whether the subdivision is one lot or 50 lots, you want it masonry. Chairman Brock said it is our intent that if a subdivision backs up to a C4U, we want it masonry if it is 100 lots or if it is 4 lots or 2 lots. Mr. Bowen asked if Section 107 in the Design Manual, could these be changed without a change in the ordinance. Mr. LeBaron said they could. He said those are technical engineering requirements. Mr. Barfield made the motion to send this back to City Staff to change the wording from C2U to C4U or larger; anything that has to do with column spacing and restricting the design should be deleted and put it more on the back of the structural engineer. Chairman Brock said he needs a clarification on Mr. Barfield's motion. He asked if we could approve it with these changes. Mr. Barfield said he would change his motion to approve it on C4U streets or larger. This motion was seconded by Mr. Moody. Mr. Lueck asked what the changes would be. He said it would not be fair for him to have to put up a masonry screening fence. Mr. LeBaron said the way you are designing this ordinance, if the subdivision is adjacent to a C4U whether it be one lot, 2 lots or more, that property line would have to have a screening wall. Mr. Barfield said that is what he is trying to exempt. He said we need different verbiage on that. He said it would be like the man on Douglas Lane who came in to replat his property into 2 lots. Mr. Bowen asked if it would be possible for him to escrow funds for the fence. He said he did not think they would want to put up a masonry fence on one lot, but the intent is you would eventually want a masonry screening fence there. Mr. LeBaron said anytime you have a property that is different from ,the norm, as your roll as Planning and Zoning Commission you can evaluate that and make a recommendation to the City Council based on those facts. Chairman Brock said then we could leave the ordinance the way it is written and take the one lot subdivision into consideration. This service to elderly, handicapped, and poverty level income citizens has been well received. The Assistant City Manager is on the Board of NETS and monitors the program closely. The Texas Department of Transportation heard about the NETS Program and voluntarily offered funding. Their program offers a 25% match of operating expenses and a 13% match of capital costs for both federal and city funds received by NETS. The funding (grant) can only be made to a City served by the system. There would not be any liability or additional responsibility on our city's part. We would forward the money on to NETS when it is received. This can be very helpful to the NETS Program and the service it provides. Recommendation: It is recommended that the City Council consider the NETS' request for North Richland Hills to apply for the funds from the Texas Department of Transportation. Jim Cotton of the Dept. of Transportation in Austin called me to notify us of the availablity of these funds. NETS is unique in that it serves several cities, and is receiving UMTA funds through the T. The grant requires that the "applicant" be a city that is being served by the system. This is in no way as complex as the UMTA grant was, and the requirements of the applicant agency appear to be minimal. Mr. Cotton indicated that the city would probably need only to forward our expense statements and request for funds, and then forward the funds to NETS. As this is a very new program, and NETS does not exactly fit the pattern, the guidelines under which we will operate are still somewhat unclear. However, Mr. Cotton is anxious that the application be filed so that the funds can be made immediately available to NETS. It is seldom that a state agency calls to suggest that funds are available, and shows so much interest in an individual program. NETS is a prototype program, and is being watched for its effectiveness and applicability to other areas of the state. The support and cooperation of the City of N. ' ! ~/ PROJECT DESCRIPTION NORTHEAST TRANSPORTATION SERVICE The Northeast Transportation Service was begun in March of 1991 to provide paratransit services to residents of Northeast Tarrant County who are elderly, handicapped, or very low income. The Northeast Tarrant County area is comprised of twelve cities, with a population of over 300,000. No public transportation system has been available in this area until the beginning of NETS. NETS operates lift equipped vehicles Monday through Friday, from 7 AM until 7 PM. After completing an application, riders may request services with a 24 hour notice. The fare is $1.25 per one-way trip. A 10 ten trip pass is available for $10.00. The NETS program is unique in the extensive cooperation between agencies and cities which has made the service possible. The YMCA of Metropolitan Ft. Worth, Urban Services Branch operates the service. United Way provides funding, and some funding is received through local civic groups and foundations. Of the twelve Northeast cities, seven currently participate in the NETS system. These cities provide 35¢ per resident per year. Starting October 1, 1991, an agreement with the Ft. Worth Transportation Authority allows NETS to receive UMTA Section 9 funds. This has allowed for dramatic expansion of the program, and the purchase of several vehicles. Though Industrial Park Boulevard West is scheduled to begin November 1, 1991 and has its own budget, we have included it as the top priority on the following list. Bid proposals were received from Sig-Op Systems, Inc. of Edmond, Oklahoma, Arjang Electric Systems, Inc. of Dallas, Texas, Durable Specialties, Inc. of Duncanville, Texas, and Sharrock Electric, Inc. of . Dallas, Texas. Sig-Op Systems proposed to use Econolite signal system equipment, Sharrock Electric proposed Eagle equipment, and both Arjang Electric and Durable Specialties proposed Winko-Matic/Multisonics equipment. Each submitted bid appears to be in order and the proposed equi'pment either meets or · exceeds t~e specification requirements. Table A presents a summary of the unit and total bid prices. Table B presents the average bid prices received. This project was designed to provide City sanitary sewer service to those residents along Crane Road south of Amundson Drive who were previously being served by individual septic tanks. The contract amount for this project is $107,784.45, which includes a change order and the Contractor's earnings total to $98,358.63, which is $9,425.82 under the bid amount. Most of the cost savings is the result of not needing the total estimated bid quantity of top soil, solid sodding and culvert drainage pipes. The proposed sanitary sewer line was moved into the existing ditch to avoid relocating telephone poles and removing existing trees and culverts in the R.O.V. as anticipated in the design and therefore did not require the full replacement of these items. The project was completed and a Final Inspection walk thru was performed on September 6, 1991 with only minor discrepancies found. The scheduled completion date of this project is October 27, 1991. The two year maintenance period begins on October 22, 1991 and therefore wi~l terminate on October 22, 1993. The following is a discussion of the primary reasons for the cost savings. 1. Topsoil and solid sodding were not replaced at the vacant lot crossings of the sewer main and services. Host of the cost savings is due to this reduction. 2. The City's street maintenance crew will provide the 2-inch HHAC overlay at the sewer main crossing on Valleyview Drive in lieu of the contractor. 3.
