The actual settlement of the Plaintiff is $99,350.00 with an added $600.00 for her incurred court costs. This settlement was approved by the Council on July 7, 1990. Finance Director Page 1 of I- I I I I I I I I I I I I I I I I I I RESOLUTION NO. 90-33 WHEREAS, on or about the 5th day of December, 1988 a utility employee of the City was responding to a call to a Watauga address and was involved in an automobile collision on the Denton Highway with one Vada Rostad who was driving an automobile belonging to a Hazel Downs; and WHEREAS, Vada Rostad sustained severe personal injuries and the automobile of Hazel Downs was damaged in the amount of $2,601.00 as a result of said collision; and WHEREAS, the City has settled all claims in connection with such automobile collision and has incurred the following costs in connection with the claim arising from said collision: a. $ 2,601.00 - Property Damage to Hazel Downs. b. $99,950.00 - Personal Injuries to Vada Rostad c. $ 1,856.25 - Claims Administration Costs to GAB. d. $ 450.00 - City Court Costs (Est.). e. $ 5,350.00 - Attorney Fees; and WHEREAS, the City Council finds that the above costs are direct expenses attributable to the Watauga portion of the City water and sewer system. IT IS, THEREFORE, RESOLVED by the City Council of the City of North Richland Hills, Texas that: 1. The above expenditures in settlement of the claims involved in said collision are hereby approved. 2. The sum of $55,103.62 is hereby ordered transferred from Account No. 02-00-00-0186 (Equity-1986 Revenue Bonds) to Account No. 08-00-00-0100 (Equity, Risk Management Fund) and the sum of $55,103.63 in ordered transferred from Account No. 02-09-00-0100 (Equity Revenue Bonds prior to 1985) to Account No. 08-00-00-0100 (Equity, Risk Management Fund), to pay the above claims and costs. The City Council finds that a sufficient surplus exists in said Utility Funds from interest earned on prior bond sales, to make the above transfers. The Director of Finance is directed to make such transfers and record such transfers as a direct expense of the Watauga portion of the water and sewer system of the City. 4. The total sum of $110,207.25 is authorized to be paid from Account No. 08-00-00-0100 (Equity, Risk Management Fund) when the transfers from the Utility Funds have been made. 5. The Attorney for the City is directed to procure releases from Vada Rostad and to cause the case styled Vada Rostad versus City of North Richland Hills (No. 48-126674-90) in the District Court of Tarrant County to be dismissed with prejudice. PS 90-07 REQUEST OF DENNIS LAND FOR SHORT FORM PLAT OF LOT 1, BLOCK 1, DENNIS LANG ADDITION APPROVED Councilman Scoma moved, seconded by Mayor Pro Tem Davis, to approve PS 90-07 subject to the elimination of the rear building line shown on the plat. Motion carried 7-0. 11. GN 90-91 PROPOSED RENAMING OF NOREAST DRIVE TO DICK LEWIS DRIVE - ORDINANCE NO. 1680 APPROVED Councilman Garvin moved, seconded by Councilman Sibbet, to approve Ordinance No. 1680 renaming a portion of Noreast Drive (behind Richland High School) to Dick Lewis Drive. Motion carried 7-0. 13. GN 90-92 CITY HALL LANDSCAPE PROPOSAL APPROVED Councilwoman Spurlock moved, seconded by Councilman Scoma, to approve GN 90-92 to be inconclusive with the additional alternative of the berm area at the flagpole, finish the final landscaping of City Hall in the amount of $25,800. Motion carried 7-0. *14. GN 90-93 PROPERTY TAX REFUND APPROVED 15. GN 90-94 MARTIN DRIVE STREET ASSESSMENT APPROVED Councilman Scoma moved, seconded by Mayor Pro Tem Davis, to reduce Lots 13 and 14, Block 1, Thomas Park Estates to the residential rate, if the property was platted into one lot. Motion carried 7-0. 16. GN 90-95 PARKS, RECREATION AND OPEN SPACE MASTER PLAN APPROVED Councilman Scoma moved, seconded by Councilman Metts, to approve GN 90-95. Mr. Victor Baxter, Schrickel, Rollins and Associates, appeared before the Council. Councilman Scoma stated that the contract stipulated that the master plan would take into consideration the adoption of planning map basis and study of existing land use, future land use calculations of existing I Ie I I I I I I I Ie I I I I I I Ie I I June 25, 1990 Page 4 population. Councilman Scoma stated also thoroughfares and drainage were included. Councilman Scoma stated a number of issues related a great deal to the land use and community development efforts that were underway. Councilman Scoma asked what the extent of their involvement would be in terms of land use development, drainage map planning and so forth. Councilman Scoma asked if they were planning on working with the staff and Planning and Zoning Commission in refining the plans that were currently underway. Mr. Baxter stated it was their policy to work with these people. Councilman Scoma stated his concern was if they were going to provide them with information or only going to seek information from them. Mr. Baxter stated it would be a two-way relationship. Councilman Scoma stated he would like to call attention to page 2, Subsection C of the contract relating to city's responsibility. Councilman Scoma stated it talked about the City's Park Board and Director of Parks participating in the Parks Master Plan development. Councilman Scoma stated it would be his suggestion that the contract be amended to include the Chairman of the Planning and Zoning Commission and Director of Community Development to sit on the panel of the public hearings so input could be received from all. Mr. Baxter stated he had no problem with the change. Councilman Scoma stated the point in including them was if at some time it was turned over to Planning and Zoning or the Community Development Director and there were things included they could not live with. Councilman Scoma stated he felt if that were made an initiative part of the planning process then the problem would be eliminated down the way. Mayor Pro Tem Davis stated that as a Council they wanted to make sure that these planning tools were used in the overall scope of doing a master plan for the City. Councilman Scoma stated paragraph 3, talked about the consultant billing his services performed and he felt it should be approved by the City. Councilman Scoma moved to amend the motion to include the changes as outlined. Motion died for lack of a second. Original motion carried 5-2; Mayor Pro Tem Davis, Councilmen Welch, Garvin, Metts, Sibbet voting for and Councilman Scoma and Councilwoman Spurlock voting against. *17. Mayor ATTEST: City Secretary I CITY OF NORTH RICHLAND HILLS I A1epartment: Management Information Services .-r Elimination of the Requirement for a Subject: Public Access Studio From the Cable Television Franchise - Ordinance No. 1681 Council Meeting Date: 7/9 /90 Agenda Number: GN 90-96 I I I I I I I I' I I I I I I I I I On June 4, 1990 the City Council instructed staff to negotiate with Sammons Communications, Inc. to arrive at an acceptable financial settlement for releasing the franchise holder from maintaining a public access studio within the city limits of North Richland Hills. After negotiations, Sammons increased their initial offer from $12,500 to $25,000. Attached is Ordinance No. 1681 which releases the franchise holder from the obligation of providing a public access studio. Recommendation: Staff recommends City Council approve Ordinance No. 1681. Number Sufficient Funds Available - !2~ City Manager , Finance Director ent Head Signature CITY COUNCIL ACTION ITEM Pa e 1 of ~ ~- I I I I I I I I- I I I I I I I_ I I ORDINANCE NO. 1681 WHEREAS, Sammons Communications, Inc. is the present holder of the Cable Television Franchise in this City; and WHEREAS, in exchange for a waiver of any ordinance provision which requires the Cable Television Franchise Holder to operate and maintain a studio and appurtenances for local public access at no charge, the present franchise holder has agreed to contribute the sum of $25,000.00 to the City for its use in connection with the operation of "City Cable 36"; and WHEREAS, the City Council finds that it is in the best interest of the City to accept such $25,000.00 contribution and to waive any requirement for the franchise holder to maintain a studio and appurtenances within the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, that: 1. Any requirement for the Cable Television Franchise Holder to maintain a studio together with cameras, audio equipment and lights for a public access channel is hereby waived. 2. The City Manager is authorized and directed to accept the contribution of $25,000.00 by Sammons Communications, Inc. and is directed to use said funds in connection with the City operation of "City Cable 36". 3. The terms of this ordinance shall control over any prior ordinance which imposes a requirement for the Cable Television Franchise Holder to provide a public access television studio, with appurtenances, at no charge. This property is assessed at the "all other property" rate of $40.23 per foot in keeping with Ordinance No. 1338 which states "property zoned residential but being used primarily for other purposes will be treated as all other property." Ordinance No. 1338 further states that "vacant land and/or lots are assessed at all other property rates." Tract 7D falls into the vacant land category and as specified by Ordinance No. 1338 was assessed accordingly. The Haltom City Church of the Nazarene has requested that City Council reconsider the assessment on Tract 7D and that it be given an adjustment. The largest system (Station #7) is located at the Equipment Service Center and is in need of repair at this time. The other two systems are located at Fire Station #1 on Starnes Road (presently out of service) and Fire Station #3 on Davis Boulevard. All three systems require yearly registration to the Texas Water Commission and must comply with the EPA ten year upgrading program. Completing the entire upgrade program in conjunction with the current repair requirements is cost efficient. The main fuel system at Station #7 and the system at Fire Station #1 currently require repair. The concrete parking lot above the fuel tanks at Station #7 is sinking. The fuel tank at Fire Station #1 has four hundred gallons of contaminated diesel fuel. Water leaked into the tank during spring rains. The area around the tanks at Station #7 has been temporarily barricaded and the system at Fire Station #1 is out of service. The change order was necessitated by the location of the existing storm drain within the existing utility easement. Considerable effort was spent in attempts to locate the existing storm drain prior to construction. Record construction drawings were unavailable and field attempts of locating the pipe proved unsuccessful. The contractor was therefore asked to verify the location of the existing 36" RCP storm drain as part of the construction contract. Subsequently, it was discovered that the alignment of the existing storm drain transgressed diagonally across the existing easement thereby taking up all but two (2) feet of easement width. This situation, if left unresolved would prevent the proposed storm drain from being constructed within existing easements. Alternatives were evaluated to arrive at the presented solution (see Exhibit 1). Unfortunately, this solution requires that additional work be included. We therefore recommend approval of Change Order No.1 in the amount of $7152.00. This results in increasing the total contract price to $173,318.65. The low bid paving and drainage price per linear foot is $120.70. Since th~ low bidder did not bid the Alternates, the Contract amount cannot be reduced by negotion, in accordance with County restrictions. Of the two bidders who bid the Alternates, the third low bidder, ALL-TEX Paving, has the lower price per linear foot for the base bid, ($130.36 per foot), and for both the Alternates, ($144.58/L.F. for Alt. 1, and $155.97/L.F. for Alt. 2). Therefore, if the overall high bidder, ALL-TEX Paving, is awarded the Contract for Alternate 2, then approximately 400 feet of the total 750 foot project will be constructed. The County would pay for $50,900 of the $62,133.55 paving and drainage costs, and the City would pay for the remaining $11,233.55. In addition, the City would pay for the utility work in the amount of $29,437.00. Total City cost would be $40,670.55. If the second low bidder, L. Grimes, is awarded the Contract, City participation would be $16,689.44 for paving and drainage, plus $18,368.28 for utilities, for a total of $35,057.72. Based on the above options, if the City wants the best value, we would recommend award of the base bid (750-feet) to the low bidder, APAC-Texas, in the amount of $129,571.80, with City participation in the amount of $78,671.80. Thus, we provide all data from the most accurate equipment available. The Wild-Heerbrugg Aviolyt BC-l analytical plotter reaches the full potential of photogrammetry. This automatic digitizing system has an interior-calibrated accu- racy of 1 micron. A state-of-the-art system, the BC-l can plot direct while digitizing or digitize and delay the plot. Various focal length cameras can be accomodated and translations to numerous CAD systems can be accomplished. The TAlO, an automatic plotting table attached to the BC-l allows for plots in pencil, ink or negative scribe. The table can be accessed from the BC-l's Data General computer or the Kork System. The Kork Interactive Graphics system provides an on-line link to all of DAS's stereo-plotters. While data is being viewed on the graphics screen functions such as editing, digitizing, text and labeling can be performed. Data from plotters such as the BC-l are transferred to the Kork Systems where the data can be manipu- lated and then formatted for auto-table plots and/or translated into various computer systems such as Intergraph, Synercom, Auto- Cad and numerous others. Attached is a "Construction Project Status Report" which accounts for the differences in as-built quantities and estimated cons tract quantities and amounts. The main overrun quantities are associated with additional loop detector wire and additional pavement markings. The two year maintenance bond begins on this date, and therefore, will expire on July 2, 1992, in accordance with the provisions of Item 3.2.11(b) of the Specifications.
