WHEREAS, the City of North Richland Hills has incurred numerous problems with respect to recovering from various library patrons fines for damages to books, magazines, newspapers, pamphlets, manuscripts, audio- visual materials or other property belonging to the Public Library, and in recovering detained library materials; and WHEREAS, it is the consensus of the City Council of the City of North Richland Hills that a fine not to exceed two-hundred dollars ($200.00) should be required of certain library patrons who detain or damage library materials; and NOW THEREFORE, BE IT ORDAINED by the City Council of the City of North Richland Hills, that from and after the date of passage hereof, whoever willfully detains any book, magazine"newspaper, pamphlet, manuscript, audiovisual material, or other property belonging to the public library for thirty (30) days after notice in writing to return the same, given after the expiration of the time which by the rules of such institution such property may be kept, or willfully injures or defaces any book, newspaper, magazine, pamphlet, manuscript~ audiovisual material, or other property belonging to the public library, by writing, marking, tearing, breaking, or otherwise mutilating, shall be fined not to exceed two-hundred dollars ($200.00). _. J(örth Richland Hills Public Library leÅ I 7lF I I I I I Ie I I' I I I I I Ie I TO: Dennis Horvath, Deputy City Manager FROM: Brenda Lewis, Library DATE: June 5, 1989 SUBJECT: RECOMMENDATION OF LIBRARY BOARD ON THE POLICY FOR FAILURE TO RETURN LIBRARY MATERIALS On Friday, June 2, Municipal Court Administrator Bobbie McCorkle telephoned inquiring about the Library Board's recommendation on the policy for failure to return library materials. She said Dennis Horvath would like the Board's recommendation as soon as possible. Library Director Arlita Hallam was on vacation at this time. I telephoned Library Board Chairman Kay Schmidt. She said she would do a telephone poll of the members and get back with me. According to Chairman Kay Schmidt, the majority of the Library Board members feel that the policy on the failure to return library materials should remain as it is. (Library Board member Roxie Hamilton could not be reached.) I I I I I I I Ie I I· I I I I Ie I I '" ' INFORMAL REPORT TO MAYOR AND CITY COUNCIL No. IR 89-41 Date: June 8, 1989 Subject: Ch; mney Inspect; ons Staff was directed to devise a plan to implement a Chimney Inspection Program in our current inspection schedule. We contacted all the certified chimney sweeps in the area for a cost estimate and scheduling times for inspections. The cost figures range from $25 to $40. None of them would guarantee inspection scheduling times. Our department currently gives same day service for inspections called in by 8:00 a.m. the day the builder wants the inspection. Staff feels there are going to be delays in getting these inspections done with us coordinating between the builder and the chimney sweep companies. Builders could have delays and be held up waiting for the chimney sweep to do the inspection, leaving the City in the middle and possibly causing delays in closings. It is our recommendation that the builders be allowed to handle their own scheduling and pricing of the inspection and submit a certificate of completion to us before the house is finaled. The easements for these projects have all been acquired except two easements on Calloway Branch, Phase I and one easement on Calloway Branch, Phase II-A. The staff will acquire these in the near future. The attached letters from Knowlton-English-Flowers, Inc. describe each project and have location maps attached. Loop 820 North Richland Hills, Texas 76180 Re: 3-349, CITY OF NORTH RICHLAND HILLS CALLOYAY BRANCH, PHASE I, IMPROVEMENTS PRESENTATION OF PLANS FOR APPROVAL As instructed, we have prepared construction plans and contract documents for Calloway Branch, Phase I, Drainage Improvements for your review and consideration of approval. This project consists of concrete channel liner construction on Calloway Branch from Glenview Drive to north of Booth Calloway Road, as shown on the attached vicinity maps. This project is part of the 1985 Capital Improvements Program approved by the voters. Although not many homes and business are located along this channel reach, concrete channel liner improvements in this section are required to help make other upstream improvements north of I.H. 820 function properly by reducing dowstream backwater effects between Glenview Drive and I.H. 820. Easement documents required for construction of these improvements have been transmitted to the City for acquisition. Although the proposed channel section is a lOa-year storm frequency design, the downstream box culvert on Glenview Drive, which is located in Richland Hills, is only about a 50-year frequency design. Therefore, even with the laO-year channel section, the channel will not fully contain the lOa-year discharge due to backwater effects from the 50-year Glenview Drive box culvert. If the Glenview culvert is enlarged in the future, and additional improvements are made downstream in Richland Hills, then the lOa-year channel in North Richland Hills will be fully functional. Meanwhile, the proposed channel liner improvements included in this project will greatly reduce the current potential for flooding for most large storms from Glenview up to I.H. 820. The proposed channel liner section consists of a vertical wall structure immediately upstream from Glenview, then a formed concrete transition structure, then an unformed trapezoidal section to the existing concrete riprap at Booth Calloway. The proposed section north of Booth Calloway is mainly an unformed concrete trapezoidal shape. The proposed concrete thickness on the channel bottom and the walls through the unformed trapezoidal sections is 5-inches, which conforms to the current City . .. This is the minimum recommended design and the service life of this type channel liner may be only 20 or 30 years. Soil movement, possible erosion, and hydrostatic uplift pressure over the years could cause riprap failures if the channel is not properly maintained. The estimated cost of this project based on the 3D-year life section is less than $800,000. To increase the design life of channel projects like this one to 50 years or more, and reduce the potential for future concrete liner failures, the Corps of Engineers has been using a thicker "structural" concrete section with more reinforcing steel. The extra concrete and steel would increase the construction cost about 45-percent. Cost of the proposed $800,000 non-structural 30-year channel would increase to about $1,160,000, for a , 50-year structural channel, which would exceed the current budget for this project. Ye would request that the Council specify the prefered design option to use for this project. After acquistion of the required easements, and upon your authorization, we will proceed with advertisements for construction bids. Loop 820 North Richland Hills, Texas 76180 Re: 3-350, CITY OF NORTH RICHLAND HILLS CALLOYAY BRANCH, PHASE II (a), IMPROVEMENTS PRESENTATION OF PLANS FOR APPROVAL As instructed, we have prepared construction plans and contract documents for Calloway Branch, Phase II(a), Drainage Improvements for your review and consideration of approval. This project consists of concrete channel liner construction on Calloway Branch from I.H. 820 to just south of Maplewood Drive, as shown on the attached vicinity maps. This project is part of the 1985 Capital Improvements Program approved by the voters. Several homes are located along this channel reach which are currently subject to flooding from heavy storms, and will have reduced potential for flooding after these proposed channel liner improvements are constructed. Phase II(b) will continue upstream from Maplewood to north of Lola Drive when additional funding becomes available. Construction of Calloway Branch, Phase II, was originally scheduled to begin in June, 1990, which includes channel improvements from I.H. 820 to Lola Drive. The CIP Committee and Staff instructed us to move this schedule up and accelerate preparation of plans for a portion of this project which includes concrete channel liner improvements from I.H. 820 to Maplewood Drive. These improvements will help protect existing structures along the channel north of I.H. 820 and allow development of the vacant property on the east side of the Calloway Branch north of I.H. 820. Easement documents required for construction of these improvements have been transmitted to the City for acquisition. Although the proposed channel section is a 100-year storm frequency design, the downstream bridge on I.H. 820, which is c~ntrolled by the State Highway Department, is only about a 50-year frequency design. Therefore, even with the proposed 100-year channel section, the channel will not fully contain the 100-year discharge due to backwater effects from the 50-year I.H. 820 bridge. If the Interstate culvert is enlarged in the future, then the 100-year upstream channel will be fully functional. The proposed channel liner section consists of an unformed trapezoidal section from I.H. 820 to just south of Maplewood. The proposed concrete thickness on the channel bottom and the walls of the unformed trapezoidal sections is 5-inches, which conforms to the current City standards for this type of section. This is the minimum recommended design and the service life of this type channel liner may be only 20 or 30 years. Soil movement, possible erosion, and hydrostatic uplift pressure over the years could cause riprap failures if the channel is not properly maintained. The estimated cost of this project based on the 30-year life section is about $1,100,000. As discussed in our report on the Calloway Branch Improvements, Phase I, to increase the design life of channel projects like this one to 50 years or more, and reduce the potential for future concrete liner failures, the Corps of Engineers has been using a thicker "structural" concrete section with more reinforcing steel. The extra concrete and steel would increase the construction cost about 45-percent. Cost of the proposed $1,100,000 non-structural 30-year channel would increase to about $1,595,000, for a 50-year structural channel, which would exceed the current budget for this project. Again, we would request that the Council s~ecif~ the prefered design option to use for this project. After acquistion of the required easements, and upon your authorization; we will proceed with advertisements for construction bids. The location and alignment of the proposed storm drain is shown on attached Figure 1. Detailed plans and contract documents have been completed as required to advertise for bids. Yilman Avenue is actually located in the Richland Hills City limits, however business which front on the east side of the street are in North Richland Hills. Presently, stormwater runoff ponds at the depression in Yilman Avenue, causing local flooding, and then slowly drains overland to the Methodist Church parking lot and also to the North Hills Mall area. The proposed storm drain will carry this runoff underground to an existing storm drain at the north end of Ruth Street at the North Hills Mall parking lot. The estimated construction cost of this project is about $121,000. Figure 2 is a sketch showing easement parcels required for construction of the proposed storm drain. Ye understand that your ROY Agent, Mark Bradley, has been negotiating with these property owners for acquistion of the easements. After acquistion of all the required easements, and upon your authorization, we will proceed with advertisments for bids. Loop 820 North Richland Hills, Texas 76180 Re: 3-557, CITY OF NORTH RICHLAND HILLS AMUNDSON DRIVE ELEVATED TANK, COUNCIL APPROVAL OF PLANS As instructed, we have prepared plans for construction of an elevated water storage tank at the location shown on the attached vicinity map. These plans include complete detailed drawings and contract documents required to advertise for construction bids. The proposed 1.5 million gallon storage tank is located in the TRA Service Area of the City and will supplement existing elevated storage tanks located on Davis Blvd., Bursey Road, Starnes Road, and Rufe Snow Drive for a combined volume of 6.5 million gallons. The ultimate projected population of NRH is about 96,000. Based on an average daily requirement of 130 gallons per person, the combined elevated storage capacity will provide fireflow supply for a period of about 12.5 hours. The State Board of Insurance recommends a minimum of a 10 hour supply. Additional elevated storage will be required to satisfy future City of Yatauga demands. The proposed tank design is a concrete pedestal type structure with a steel bowl on top as shown on the attached drawings. In addition to providing support for the storage tank, the concrete pedestal walls create an interior storage area which can be used by the Public Yorks Department, Fire Department, or possibly other City Departments. An alternate bid is included in the design for a second floor which would double the available storage. The bowl will be painted light blue with dark blue trim and dark blue lettering spelling out -- "CITY OF NORTH RICHLAND HILLS, HOME OF SMITHFIELD RAIDERS". Other elevated tanks with a similar type design are located in Southlake and in Colleyville, on Hall-Johnson Road near the Bluebonnet Cemetery. This type of tank is more economical than the traditional elevated tank with the steel legs. The construction cost is estimated between $1.1 and $1.4 million depending on the combination of alternates included. GN 89-59 COMPREHENSIVE ENVIRONMENTAL HEALTH ORDINANCE _ ORDINANCE NO. 1607 POSTPONED Mayor Pro Tem Davis moved, seconded by Councilman Metts, to postpone Ordinance No. 1607 until after the committee, that was appointed in Pre-Council, met with the Day Care Centers. Motion carried 7-0. 11. GN 89-60 ANIMAL CONTROL ORDINANCE _ ORDINANCE NO. 1609 POSTPONED Mayor Pro Tem Davis moved, seconded by Councilman Garvin, to approve Ordinance No. 1609. Councilwoman Spurlock asked that the motion be amended to include that a committee be appointed consisting of the Director of Environmental Services, the City Veterinarian, or approval of the City Manager in declaring vicious animals. Mr. Line stated that he felt that Animal Control should be the one to make the decision. Mayor Pro Tem Davis stated that on page 13, section 7 "with the advice and written consent of two veterinarians" should be added. Ms. Burney advised that before this could be added to the ordinance, the consent of the veterinarians was needed. After further discussion, Councilwoman Spurlock withdrew her motion to amend. Councilman Scoma stated that as far as the responsibility of determining a vicious animal, he felt it needed to go to both the staff and City Council. Councilman Scoma asked if the veterinarians had reviewed this ordinance. GN 89-61 ORDINANCE AMENDING ORDINANCE NO. 310 AND ADOPTING THE 1987 EDITION OF THE ELECTRIC CODE - ORDINANCE NO. 1605 APPROVED 13. GN 89-62 PROPOSED UTILITY REVENUE BOND REFUNDING SERIES 1989-B APPROVED Mr. Harold McInroe, First Southwest Company, appeared before the Council. Mr. McInroe stated he was present to answer any questions. Councilman Scoma stated he had reviewed the budget pertaining to debt services and he felt the City needed to be in a holding structure. Councilman Scoma stated this should be discussed at the Pre-Budget Meeting and the Goals and Objectives Meeting. . Mayor Pro Tern Davis stated he felt that any time the City could increase their borrowing power it should be done. Mayor Pro Tem Davis stated if a major catastrophe occurred the City may need the power to borrow. Mayor Pro Tem Davis moved, seconded by Councilman Garvin, to approve GN 89-62. GN 89-63 COMMUNITY DEVELOPMENT BLOCK GRANT - NORTH RICHLAND HILLS SENIOR CITIZENS CENTER APPROVED Councilman Scoma moved, seconded by Councilman Garvin, to approve GN 89-63. Motion carried 7-0. 15. GN 89-64 REQUEST OF MR. DALE E. JONES, 7140 HIGHTOWER DRIVE TO BE CONNECTED TO CITY SEWER SERVICE APPROVED Mr. Dale Jones, 7140 Hightower Drive, appeared before the Council. I· Ie I I I I I I I Ie I I I I I I I Ie I May 22, 1989 Page 5 Mr. Jones stated he wished to connect on to the City sewer without platting his property and not donating land for future streets. Councilman Garvin asked the reason for him wanting to tie on to City sewer. Mr. Jones stated that they had a tremendous drainage problem and the septic tank would not drain properly. Councilman Garvin asked what caused the drainage problem. Mr. Jones stated that when Hightower was reconstructed and raised it caused all of the water to drain on to his property. Mayor Pro Tern Davis advised that Mr. Jones had applied for a short form plat in 1987 and was issued a certificate of occupancy with the understanding the platting process would be completed and the platting was never done. Mayor Pro Tern Davis advised Mr. Jones he could sign a covenant for future street improvements and the plat could be finalized. Mr. Jones stated he did not want to sign a covenant. Councilman Garvin advised that if Mr. Jones applied for a permit now he would not have to plat. Mr. Tucker advised that when the ordinance was amended to allow for'add-on construction it was not the intent to change the section pertaining to City services. Councilman Garvin moved, seconded by Councilman Welch, to allow Mr. Jones to connect to City sewer, pay customary fees and not sign a covenant for future improvements. ~ Councilman Scoma asked if Hightower was going to be improved in this·-area. Mr. Line stated no, that all of the construction had been completed that was going to be done. GN 89-65 IMPROVEMENT OF FOSSIL AND SINGING HILLS CREEK CHANNELS - IRON HORSE GOLF COURSE APPROVED *17. GN 89-67 APPROVAL OF GOLF COURSE EARTH WORK CONTRACT CHANGE ORDER NO. 3 APPROVED Councilman Scoma stated that much of the erosion problem in Singing Hills tributary had. been caused by recent heavy rains. Councilman Scoma stated the way he understood it, the staff was coming to the Council with a breakdown of various items. Councilman Scoma stated that he had concerns about the $136,000 of expenditures on the channel to help prevent additional damages. Councilman Scoma stated that number one, perception as well as actual fact, while the money was designated through funds other than CIP, he felt there needed to be concern for those citizens that had been flooded recently. Councilman Scoma stated that some of the channels were included in the bond issue, but based on prudent judgment by the Council, were later restrained from funding as an attempt from having to sell additional bonds. Councilman Scoma stated he felt the approach for this particular request for expenditures should be one for absolute necessity. Councilman Scoma stated he felt the staff needed to re-assess the request in terms of the total dollar expenditure and only request items such as dredging that must be done, in their opinion, to save other dollars later. Councilman Scoma moved to deny this request. Mayor Pro Tem Davis called for a point-of-order. Mayor Pro Tem Davis advised that Councilman Scoma was addressing Item No. 16, which was not removed from the Consent Agenda. Motion to deny died for lack of a second. , Mayor Pro Tem Davis moved, seconded by Councilman Metts, to approve GN 89-67. Councilman Scoma asked if this work was being done because of the recent heavy rains. Mr. Sanford advised it was a design correction. Motion carried 7-0. Mayor Pro Tem Davis advised that he felt Councilman Scoma intended to remove Item No. 16, GN 89-65. GN 89-68 APPROVAL OF GOLF COURSE EARTH WORK CONTRACT CHANGE ORDER NO. 4 APPROVED Mayor Pro Tern Davis moved, seconded by Councilman Garvin, to approve GN 89-68. Councilman Scoma stated he hoped that at the end of this project it could be said that it was within the budget. Councilman Scoma asked if this was caused by the heavy rains. Mr. Sanford stated no, it was needed because the State Highway Department had changed the drainage design along Highway 377. ' Motion carried 7-0. 20. GN 89-69 APPROVAL OF GOLF COURSE EARTH WORK CHANGE ORDER NO. 5 APPROVED ~ Mayor Pro Tern Davis moved, seconded by Councilman Metts, to approve GN 89-69. Councilman Scoma asked why the drainage system was not included in the original design. Mr. Sanford stated that after grading an underground spring was discovered. Motion carried 7-0. 21. , GN 89-70 REQUEST FOR AUTHORIZATION TO PROCEED WITH THE SALE OF $265,000 IN CONTRACTUAL OBLIGATIONS FOR EQUIPMENT AT IRON HORSE GOLF COURSE APPROVED Councilman Garvin moved, seconded by Councilman Sibbet, to approve GN 89-70. PU 89-15 APPROVAL TO PURCHASE A 0.198 ACRE TRACT OUT OF THE JAMES MATTHEWS SURVEY, A-I051, HALTOM CITY, TEXAS APPROVED Mayor Pro Tern Davis moved, seconded by Councilman Garvin, to approve PU 89-15. Councilman Scoma asked if the plans would be concluded prior to the purchase of the property. Mr. Dickens stated that the plans were 90% complete. Councilman Scoma asked the cost of bring the property out of the flóod plain. Mr. Dickens advised approximately $3,000; that the seller was obligated to bring the property out of the flood plain. Motion carried 7-0. *23. PW 89-21 AWARD OF BID ON BEACH STREET WATER TRANSMISSION MAIN IMPROVEMENTS APPROVED 24. CITIZENS PRESENTATION Mr. Cliff Stevens, 9201 Kirk Lane, appeared before the Council. Mr. Stevens stated that during the recent rains his street flooded and the creek backed up. Mr. Stevens stated there was not a flooding problem until the surrounding property was platted. Mr. Stevens asked that the Council not approve any more plats or issue building permits until something was done about the drainage in Little Bear Creek. Mayor Brown advised Mr. Stevens the problem would be looked into. Councilwoman Spurlock asked if the proposed drainage impact fee would help. Mr. Dickens stated yes. Mr. Stoppiello stated he wanted to ask a question pertaining to Item No. 16 on the Agenda. Mr. Stoppiello asked if the funds that were being spent were part of the certificates of obligation for the golf course construction. Mayor Brown replied yes. Mr. Stoppiello asked if there was any bond money being used for the construction of the golf course that he had rather see the money spent to improve his area, Calloway Creek. Mayor Brown stated bond funds that were designated for the golf course could only be used for that purpose. 25. Also attached is Ordinance No. 1338, dated January 27, 1986, which establishes the method of calculation and criteria used in establishing assessment rates. For clarification purposes, the assessment roll attached to Ordinance No. 1595 is divided in two sections: 1) property located on the west side of the street; 2) property located on the east side of the street. The first column indicates the current usage of the property. and the abbreviation used are as follows: NF - nonresidential front NS - nonresidential side NR - nonresidential rear RF - residential front RS - residential side RR - residential rear The next three columns indicate the property owners name, property description and the arrount of frontage on Smithfield Road. The next column "ASSESS RATE" indicates the rate of assessment, based on the usage indicated on the key in the upper right corner of the assessment roll, for instance Parcel #1 - \41est side, Mr. John Hum. His assessment rate is $60.08, based on the usage of NF. The next column is the credi ts colurm. This Acolumn indicates the credi t received by the property owner for any existing curb and Wgutter. Where large arrounts of credit are shown, it would indicate that the property owner has prepaid the assessment or a covenant is on file. The last column is the front f(X)tage times the assessment rate minus the apparent credi ts . The CIP Corrmi ttee has recornnended that sidewalks be constructed on the east side of Smithfield Road only. Please note on the key in the upper right of the assessment roll that residents on the west side of the street are not assessed for sidewalks" (NO SW.) There exists a public necessity for the improvement of the hereinafter described portions of streets, avenues and public places in the City of North Richland Hills, Texas, to wit: (See attached charts) I I . Each unit above described shall be and constitute a separate and independent unit of improvements and the assessments herein provided for shall be made for the improvements in each units according to the cost of the improvements in that unit and according to the benefits arising from the improvements in that unit. Each of the above described portions of streets, avenues, and public places in the City of North Richland Hills, Texas, shall be improved by raising, grading and filling same and by constructing thereon an asphaltic concrete surface together with combined concrete curbs and gutters on proper grade and line where same are not already so constructed, together with. storm sewers and drains and other necessary incidentals and appurtenances; all of said improvements to be constructed as and where shown on the plans and in strict accordance with the plans and specifications therefore. v. Bids having been advertised for as required by the Charter of the City of North Richland Hills, Texas, and the bid having found to be the lowest and best bid for the construction of said improvements, the work of constructing said improvements and contract therefore is hereby awarded for the prices stated in the proposal of said company as recorded and recommended by the City's Engineer, which said report and recommendation is on file with the City, the Mayor and City Secretary, and hereby directed to execute the said contract in the name of the City of North Richland Hills, Texas, and to impress the corporate seal of the City thereon, the said contract embracing, among other things, the prices for the work. VI. To provide for the payment of the indebtedness incurred by the City of North Richland Hills, Texas, by said contract, there is hereby appropriated out of available funds and current revenues of the City, an amount sufficient to pay said indebtedness so incurred. VII. The cost of said improvements as herein defined shall be paid for as follows, to wit: (a) On Smithfield Road from Turner Drive to John Autrey Road in the City of North Richland Hills, Texas, the property abutting on that portion of the street to be improved and the real and true owners thereof shall pay for these improvements at the rate of (see attached schedule a.) linear front foot for all property fronting on said street which in no way exceeds nine-tenths (9/10ths) of the estimated costs of the improvements in addition to curb and gutters. (b) The City of North Richland Hills shall pay all of the remainder of the cost of said improvements after deducting the amounts herein specified to be paid by the abutting properties and the real and true owners thereof as set out above in subsection (a). The amounts payable by the abutting properties and the real and true owners thereof shall be assessed against such properties and the real and true owners thereof shall constitute a first and prior lien upon such I . .; Ie I I I I I I I Ie I I" I I I I ~ I I .... t . Ordinance No. 1595 Page 3 properties and a personal liability of the real and true owners thereof, and shall be payable as follows, to wit: When the improvements are completed and accepted by the City on a particular unit, the same assessed against property abutting upon such completed and accepted unit shall be and become payable in five (5) equal installments, due respectively on or before thirty (30) days, one (1), two (2), three (3), and four (4) years from the date of such completion and acceptance, and the assessments against the property abutting upon the remaining units shall be and become due and payable in installments after the date of completion and acceptance of such respective unit. The entire amount assessed against the particular parcels of property shall bear interest from the date of such completion and acceptance of the improvements on the unit upon which the particular property abuts at the rate of eight percent (8%) per annum, payable annually except as to interest on the first installment, which shall be due and payable on the date said installment matures, provided that any owner shall have the right to pay any and all such installments at any time before maturity by paying principal, with interest accrued to the date of payment, and further provided if default be made in the payment of any installment promptly as the same matures, then at the option of the City of North Richland Hills or its assigns, the entire amount of the assessment upon which default is made shall be and become immediately due and payable; but it is specifically provided that no assessment shall in any case be made against any property or any owner thereof in excess of the special benefits to property in the enhanced value thereof by means of said improvements in the unit upon which the particular property abuts, as ascertained at the hearing provided by law in force in the City, nor shall any assessment be made in any case until after notice and hearing as provided by law. Said assessments against the respective lots and parcels of property and owners thereof shall be evidenced by certificates of special assessment which shall be executed in the name of the City of North Richland Hills, provided, however, that the City of North Richland Hills retains the right to ~authorize payment of the sums assessed against property abutting upon such completed and accepted unit in a period of not more than four (4) years in equal regular installments or not less than TEN AND NO/I00 DOLLARS each, the first of such installments to become due and payable not more than thirty (30) days after the completion and acceptance by the City of the particular unit, PROVIDED FURTHER, that such method of payments shall be authorized only in instances where the owner or owners of property abutting upon such completed and accepted unit shall have executed and delivered to the City of North Richland Hills, a lawful, valid and binding note and mechanic's and materialman's contract upon forms supplied by the City granting a mechanic's lien upon and conveying the said owner or owners according to the terms thereof of the sums assessed against such property. VIII. The assessments against the respective lots and parcels of property and the owners thereof may be evidence by certificates of special assessment, which shall be executed in the name of the City by the Mayor of said City, and the City Secretary shall attest the same and impress the corporate seal of the City thereon, and which may have attached thereto coupons in evidence of the several installments, which the assessment is I.: " Ie I I I I I I I Ie I I" I I I I ~ I I .... . Ordinance No. 1595 Page 4 payable, which certificates shall be issued to the City of North Richland Hills, shall recite the terms and time of payment, the amount of assessment, the description of the property, and the name of the owners, as far as known, and shall contain such other recitals as may be pertinent thereto, and shall further recite substantially that all proceedings with reference to the making of such improvements have been regularly had in compliance with law, and the prerequisites to the fixing of the assessment lien against the property described in said certificates and the personal liability of the owners thereof, have been regularly had, done and performed, and such recitals shall be prima facie evidence of the matters so recited, and no further proof thereof shall be required in court, and the certificates shall provide substantially that if default be made in the payment of any installment promptly as the same matures, then, at the option of the City of North Richland Hills, or its assigns, the entire amount of the assessment shall be and become immediately due and payable, together with reasonable attorney·s fees and costs of collection, if incurred, all of which, as well as the principal and interest on the assessment, shall be a first and prior lien against the property, superior to all other liens and claims except State, County, School District, and City ad valorem taxes. No error or mistake in naming any owner or in describing any property or any other matter or thing, shall invalidate any assessment or any certificate issued in evidence thereof, and the omission of improvements on any particular unit or in front of any property except by law from the lien of special assessment for street improvements shall not invalidate any assessment levied. The certificates referred to need not contain recitals in exactly the words above provided for, but the substance thereof shall suffice, and they may contain other additional recitals pertinent thereto. IX. The City Engineer of the City of North Richland Hills, Texas, be and he is hereby ordered and directed to file with the City Council ~estimate of cost of such improvements in each unit. X. The City Secretary is directed to prepare, sign and file with the County Clerk of Tarrant County, Texas, a notice in accordance with the provisions of Article 1220a of Vernon's Texas Civil Statutes and amendments thereto. XI. The improvements provided for herein shall be made and constructed, notice given, hearing held and assessments levied and all proceedings taken and had in accordance with and under the terms of the powers and provisions of Chapter 106 of the Acts of the First Called Session of the Fortieth Legislature of the State of Texas, now shown as Article 1005b of Vernon's Texas Civil Statutes, and under which law these proceedings are taken and had. They will be applicable to construction, reconstruction, and major maintenance projects where substantial improvement results and abutting property is increased in value. NOW, THEREFORE, Be it ordained by the City Council of the City of North Richland Hills, Texas, that: 1. Note 4 - Vacant land and/or lots are assessed at "all other property" rate. These properties are considered as investments regardless of the zoning classification or what they are being used for. The percentage figures cited above are general in nature and the council reserves the right to adjust the actual dollar amounts within the limits allòwed by Texas Law from project to project in accordance with the relative value added to the assessed property. In the absence of substantial evidence to the contrary, the primary factor in determining the value added to abutting property will þe the cost of the improvements. WHEREAS, the City of North Richland Hills, Texas, has by Ordinance No. 1595, heretofore ordered that each of the hereinafter described portions of streets, avenues and public places in the City of North Richland Hills, Texas, be improved by raising, grading or filling same and by constructing thereon permanent surface in accordance with specifications of the State of Texas on proper grade and line where same are not already so constructed together with storm drains and other necessary incidentals and appurtenances; all of said improvements are to be constructed as and where shown in strict accordance with the plans and specification therefor, said portion of streets, avenues and public places being as fo11ows, to wit: SMITHFIELD ROAD FROM TURNER DRIVE TO JOHN AUTREY ROAD and, WHEREAS, estimates of the cost of the improvements on each such portion of streets, avenues and public places were prepared and filed and by Ordinance No. 1594, approved and adopted by the City Council of the City, and a time and place was fixed for a hearing and the proper notice of time, place and purpose of said hearing was given and said hearing was had and held at the time and place fixed therefore, to wit, on the 12th day of June, 1989, at 7:30 p.m. o'clock, in the Council Chambers in the City of North Richland Hills, Texas, and at such hearing the following protests and objections were made, to wit: and all desiring to be heard were given full and fair opportunity to be heard, and the City Council of the City having fully considered all proper matters, is of the opinion that the said hearing should be closed and assessments should be made and levied as herein ordered: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, THAT: I . II. The City Council, from the evidence, finds that the assessments herein levied- should be made and levied against the respective parcels of property abutting upon the said portions of streets, avenues and public places and against the owners of such property, and that such assessments and charges are right and proper and are substantially in proportion to the benefits to the respective parcels of property by means of the improvements in the unit for which such assessments are levied, and establish substantial justice and equality and uniformity between the respective owners of the respective properties, and between all parties concerned, considering the benefits received and burdens imposed, and further finds further that in each case the abutting property assessed is specially benefited in enhances value to the said property by means of the said improvements in the unit upon which the particular property abuts and for which assessment is levied and charge made, in a sum in excess of the said assessment and charge made against the same by this ordinance, and further finds that the apportionment of the cost of the improvements is in accordance with the law in force in this City, and the proceedings of the City heretofore had with reference to said improvements, and is in all respects valid and regular. III. There shall be, and is hereby, levied and assessed against the parcels of property hereinbelow mentioned, and against the real and true owners thereof (whether such owner be correctly named herein or not), the sums of money itemized below opposite the description of the respective parcels of property and the several amounts assessed against the same, and · the owners thereof, as far as such owners are known, being as follows: (See attached charts) IV. Where more than one person, firm or corporation owns an interest in any property above described, each said person, firm or corporation shall be personally liable only for its, his or hers pro rata of the total assessment against such property in proportion as its, his or her respective interest bears to the total ownership of such property, and its, his or her respective interest in such property may be released from the assessment lien upon payment of such proportionate sum. v. The several sums above mentioned and assessed against the said parcels of property, and the owners thereof, and interest thereon at the rate of eight percent (8%) per annum, together with reasonable attorney's fees '-and costs of collector, if incurred are hereby declared to be and are made a lien upon the respèctive parcels of property against which the same I. . I" I I I I I Ie I Ordinance No. 1596 Page 3 are assessed, and a personal liability and charge against the real and true owners of such owners be correctly named herein or not, and the said liens shall be and constitute the first enforceable lien and claim against the property on which such assessments are levied, and shall be a first and paramount lien thereon, superior to all other liens and claims, except State and County, School District and City valorem taxes. The.sums so assessed against the abutting property and the owners thereof shall be and become due and payable as follows, to wit: in five (5) equal installments, due respectively on or before thirty days (3), one (1) two (2), three (3), and four (4) years from the date of completion and acceptance of the improvements in the respective unit, and the assessments against the property abutting upon the remaining units hall be and become due and payable in such installments after the date of the completion and acceptance of such respective units, and shall bear interest from said date at the rate of eight percent (8%) per annum, payable annually with each installment except as to the first installment, which shall be due and payable at the maturity thereof, so that upon the completion and acceptance of the improvements in a particular unit, assessments against the property abutting upon such completed and accepted unit shall be and become due and payable in such installments, and with interest from the date of such completion and acceptance. Provided, however, that any owner shall have the right to pay the entire assessment, or any installment thereof, before maturity by payment of principal and accrued interest, and provided further that if default shall be made in the payment of any installment or principal or interest promptly as the same matures, then the entire amount of the assessment upon which such default is made shall, at the option of said City of North Richland Hills, or its assigns be and become immediately due and payable, and shall be collectible, together with reasonable attorney's fees and costs of collection incurred. PROVIDED, however, that the City of North Richland Hills retains the right to authorize payment of the sums assessed against property abutting upon such completed and accepted unit over a period of not more than four years in equal regular ~ installments or not less than TEN AND NO/lOa DOLLARS ($10.00) each, the first year installments to become due and payable not more than thirty days (30) after the completion and acceptance by the City of the particular unit, and PROVIDED FURTHER that such method of payment shall be authorized only in instances where the owner or owners of property abutting upon such completed and accepted unit shall have executed and delivered to the City of North Richland Hills granting a mechanic's lien upon and conveying to the said abutting property in trust to secure the payment of said owner or owners according to the terms thereof of the sums assessed against such property. VI. If default shall be made in the payment of any assessment, collection thereof shall be enforced either by the sale of the property by the City of North Richland Hills as near as possible in the manner provided for the sale of property for the nonpayment of ad valorem taxes, or at the option of the City of North Richland Hills, or its assigns, payment of said sums shall be enforced by suit in any court of competent jurisdiction or as provided in any mechanic's or materialman's contract as foresaid, and said I. . The total amount assessed against the respective parcels of abutting property, and the owners thereof, is in accordance with proceedings of the City relating to said improvements and assessments therefore, and is less than the proportion of the cost allowed and permitted by the law in force in the City. VIII. Although the aforementioned charges have been fixed, levied and assessed in the respective amounts hereinabove stated, the City Council does hereby reserve unto itself the right to reduce the aforementioned assessments by allowing credits to certain property owners where curb and/or gutter or paving presently exists. Notwithstanding the City Council has herein reserved the right to issue credits as hereinabove provided, it shall not be required to issue such credits, and will not do so, if same would result in any inequity and/or unjust discrimination. The principal amount of each of the several assessment certificates to be issued the City of North Richland Hills, Texas, as hereinafter provided, shall be fixed and determined by deducting from the amount of any assessment, hereinabove levied such amount or amounts, if any, as may hereafter be allowed by the City Council as a credit against the respective assessments. IX. For the purpose of evidencing the several sums assessed against the respective parcels of abutting property and the owners thereof, and the time and terms of payment to aid in the enforcement and collection thereof, assignable certificates in the principal amount of the respective assessments less the amount of any respective credit allowed thereon, shall be issued by the City of North Richland Hills, Texas, upon completion and acceptance by the City of the improvements in each unit of improvement as the work in such units is completed and accepted, which certificates shall be executed by the Mayor in the name of the City and attested by the City Secretary, with the corporate seal of the City of North Richland Hills, or its assigns, and shall declare the said amounts, time and term of payment, rate of interest, and the date of completion and acceptance of the improvements abutting upon such property for which the certificate is issued, and shall contain the name of the owners, if known, description of the property by lot and block number, or front feet thereof, or such other descriptions as may otherwise identify the same; and if said property shall be owned by an estate, then the description of same as so owned shall be sufficient and no error or mistake in describing any property, or in giving the name of the owner, shall invalidate or in anyway impair such certificate, or the assessments levied. Ordinance No. 1596 Page 5 The certificates shall provide substantially that if same shall not be paid promptly upon maturity, then they shall be collectible, with reasonable attorney's fees and costs of collection, if incurred and shall provide substantially that the amounts evidenced thereby shall be paid to the City Secretary of the City of North Richland Hills, Texas, who shall issue his receipt therefore, which shall be evidence of such payment on any demand for the same, and the City Secretary shall deposit the sums so received in a.separate fund, and when any payment shall be made to the City the City Secretary, upon such certificate shall, upon presentation to him of the certificate by the holder thereof, endorse said payment thereon. If such certificate be assigned then the holder thereof shall be entitled to receive from the City Secretary the amount paid upon presentation to him of such certificate so endorsed and credited; and such endorsement and credit shall be the Secretary·s Warrant for making such payment. Such payment by the Secretary shall be receipted for by the holder of such certificate in writing and by surrender thereof when the principal, together with accrued interest and all costs of collection and reasonable attorney·s fees if incurred have been paid in full. Said certificate shall further recite substantially that the proceedings with reference to making the improvements have been regularly had in compliance with the law, and that all prerequisites to the fixing of the assessment lien against the property described in such certificate and the personal liability of the owners thereof have been performed, and such recitals shall be prima facie evidence of all the matters receipted in such certificates, and no further proof thereof shall be required in any court. Said certificates may have coupons attached thereto in evidence of each or any of the several installments thereof, or may have coupons for each of the first four installments, leaving the main certificate to serve for the fifth installment, which coupons may be payable to the City of North Richland Hills, or its assigns may be signed with the facsimile signatures of the Mayor and City Secretary. Said certificates shall further recite that the City of North Richland Hills, Texas, shall exercise all of its lawful powers, when requested to do so, to aid in the enforcement and collection thereof, and may contain recitals substantially in accordance with the above and other additional recitals pertinent or appropriate thereto; and it shall not be necessary that the recitals be in the exact form set forth, but the substance thereof shall be sufficient. The fact that such improvements may be omitted on any portion of any of said units adjacent to any premises except from the lien of such assessments shall not in anywise invalidate, affect or impair the lien of such assessment upon other premises. x. Full power to make and levy assessments and to correct mistakes, errors, invalidities or irregularities, either in the assessments or in the certificates issued in evidence thereof, is in accordance with the law in force of this City, .vested in the City. XII. The assessments so levied are for the improvements in the particular unjt upon which the property described abuts, and the assessments for the improvements in any units are in no way affected by the improvements or assessments in any other unit and in making assessments and in holding said hearing, the amounts assessed for improvements in anyone unit have been in nowise connected with the improvements or the assessments therefore in any other unit. XIII. The assessments levied are made and levied under and by virtue of the terms, powers and provisions of an Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, known as Chapter 106 of the Act of said session and now shown as Article 1105b of Vernons' Texas Civil Statutes. XIV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of North Richland Hills, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. xv. These are all non-traffic cases because the maximum fine for any traffic case in Municipal Court is $200.00. The tax on cases where the potential fine is $200.00 or less is $13.50. This situation is responsible for many appeals of non-traffic offenses because a $10 fine calls for a tax in excess of $30.00. Since the programs ended during February, the City has received requests from citizens for additional programs during the summer months. Based on an analysis, the additional costs associated with the summer programs are recoverable i~ charges to the users. City Council was advised by Mr. Harold McInroe of First Southwest Company that this issue will conclude the restructuring of the Utility Fund debt and give the City greater flexibility in the future if additional ,bonds were sold. Bids for the proposed sale of bonds will be opened at 7:30 p.m. on June 12, 1989. Our Fiscal Agent and Bond Counsel will be present to evaluate the bids and complete the ordinances and resolutions to be acted upon as. listed in the recommendation. Recommendation: It is recommended that the City Council consider matters incidental and related to the issuance and sale of said bonds and take the following action: 1. Accept the evaluation on said bonds as recommended by First Southwest Company. 2. Adopt Ordinance. No. 1612 authorizing the issuance of such bonds. 3. In Jtme, 1987, the State Legislature passed Senate Bill 336 which describes the procedure all municipalities shall follow to implement an "impact fee". An "impact fee" is defined as a charge or assessment imposed by a political subdivision against new develo¡;ment in order to generate revenue for funding or recouping the costs of capital improvements or facility expansions necessitated by and attributable to such developnent. On October 12, 1987 the City Council passed Ordinance No. 1503 which directed the staff to develop and implement a "drainage impact fee" in accordance with SB 336. The staff and our consultants accanplished the developnent of the impact fee in September, 1988. The Capital Improvements Advisory Carmittee was made aware of those findings and wrote a letter of recœmendation to the Mayor and City Council dated March 8, 1989. A copy of the letter is attached for your infonnation. The Drainage Inpact Fee Steering Ccmnittee recarmends the Council take no action at this meeting · The law requires that the Council adopt or reject the Inpact Fees wi thin 30 days of the "public hearing". However, after many hours of discu~sion, the Committee feels that to impose a drainage impact fee at this ,time would do hàrm to the City by slowing development. It is the understanding of the Committee that S.B. 336 does not stop the City from having developers pay to improve drainage as specified in the City's Subdivision Ordinance. The Committee is, however, concerned that S.B. 336 will not allow the City to collect pro-rata for sewer and water if an impact fee is not put in effect before June 1990. Recommendation: The Advisory Committee recommends that the drainage impact fee not be put into effect for at least the next two years. Public Hearing on Regulation of Skateboard Ramps GN 89-77 ~ubject: Agenda Number: I On April 10, 1989 the City Council heard a request from Mr. Donald Dougherty that consideration be given to enactment of a regulation similar to that of the City of Arlington (copy attached) that would regulate the placing of skateboard ramps in residential areas. The City Council directed that a public hearing be conducted on June 12, 1989 regarding thjs issue and that efforts be made to assure maximum citizen participation in this issue. The public hearing has been advertised in the City's April Newsletter and on the message section of the water bills. local newspapers have also given coverage to this matter. It is proposed that the public hearing be opened and all interested citizens be allowed to speak, for and against, following which the public hearing be closed. Recommendation: It is recommended that the City Council direct the staff as to whether or not an ordinance should be prepared for Council action regulating the location of skateboard ramps. It shall be unlawful for any person to erect, construct, keep, maintain or use a skateboard ramp that is located: 1. at a distance closer than one hundred fifty feet (150') from any building located on another's property that is used or intended to be used for habitation, regardless of whether the habitation existed prior to the erection of said skateboard ramp; or 2. at a distance closer than fifty (50) feet from the property line of the lot where said skateboard ramp is located. c. 1. Should a habitation be placed on another's property closer than one hundred fifty feet (150 ') to an existing skateboard ramp, the owner of said skate- board ramp shall remove or relocate, or cause to be removed or relocated, said skateboard ramp within ninety (90) days of the completion of construction of the habitation. 2. Should both a skateboard ramp and a habitation located on another's property both exist closer than one hundred fifty f~et (150') to each other on the date this ordinance becomes effective, the owner of said skateboard ramp shall remove or relocate, or cause to be removed or relocated, said skateboard ramp within ninety (90) days of the effective date of this ordinance. Failure to remove or relòcate, or cause to be removed or relocated, a skateboard ramp as required by this Section shall constitute a misdemeanor. Each day that a skate- board ramp remains in violation of this Section shall constitute a separate offense. 2 . Any person, firm, corporation, agent or employee thereof who violates any of the provisions of this Ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be -2- ."- I, I.
