HomeMy WebLinkAboutOrdinance 1999 ORDINANCE NO. 1999 AN ORDINANCE REZONING PROPERTY IN ACCORDANCE WITH ARTICLE 2, SECTION 200, OF ZONING ORDINANCE NUMBER 1874, PASSED, APPROVED AND ADOPTED BY THE CITY COUNCIL ON MARCH 22, 1993; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, after appropriate notice and public hearing, the following recommendation is submitted to the City Council of the City of North Richland Hills, Texas, by the Planning and Zoning Commission; and WHEREAS, the Planning and Zoning Commission of the City of North Richland Hills, Texas, has forwarded a recommendation to the City Council for amendment of Ordinance No. 1874 and the Official Zoning Map by rezoning certain property; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: 1. THAT, on Case Number PZ 94-11, the following property shall be rezoned from LR Local Retail, C-l Commercial, R-7-MF Multi- Family Residential, and a portion of Planned Development Number 11 to C-2 Commercial: BEING a tract of land in the W.W. Wallace Survey, Abstract Number 1606, Tarrant County, Texas, and being part of Block 2-R, Richfield Place Commercial Addition, an Addition to the City of North Richland Hills as evidenced by plat recorded in Volume 388- 150, Page 39, Plat Records, Tarrant County, Texas; and being part of Lot 2, Block 25, Clearview Addition, an addition to the City of North Richland Hills as evidenced by plat recorded in Volume 388-143, Page 59, Plat Records, Tarrant County, Texas; and being part of that certain tract of land conveyed to Zoya, Inc. as evidenced by deed recorded in Volume 10478, Page 1579, Deed Records, Tarrant County, Texas, and being more particulary described by metes and bounds as follows: BEGINNING as a 5/8-inch iron rod found for the most southerly comer of said Block 2-R, same also being in intersection of the northwest line of State Highway No. 26 (Grapevine Highway) and the northeast line of Interstate Highway 820; THENCE North 67 degrees 45 minutes 00 seconds West along the northeast line ofInterstate Highway 820 and the southwest line of said Block 2-R a distance of 144.83 feet to a 5/8-inch rod found for comer; THENCE along the east line ofInterstate Highway 820 as follows: North 03 degrees 45 minutes 13 seconds West a distance of 152.49 feet to ta Texas Department of Transportation monument found for comer; North 06 degrees 07 minutes 01 seconds West a distance of 122.36 feet to a PK nail found for comer; North 08 degrees 32 minutes 53 seconds West a distance of 320.94 feet to a 5/8-inch iron rod set for comer; North 10 degrees 24 minutes 16 seconds West a distance of 62.00 feet to a 5/8-inch iron rod set for comer; North 12 degrees 10 minutes 15 seconds West a distance of99.67 feet to a 5/8-inch iron rod set for comer; North 04 degrees 12 minutes 22 seconds West a distance of 132.58 feet to a Texas Department of Transportation monument found in the north line of said Zoya tract and the south line of Block 22, Clearview Addition, an addition to the City of North Richland Hills as evidenced by plat recorded in Volume 388-25, Page 100, Plat Records, Tarrant County, Texas; THENCE South 89 degrees 44 minutes 43 seconds East along the south line of said Block 22 a distance of751.09 feet to a 1/2-inch iron rod found for the northeast comer of said Zoya tract and the northwest comer of Lot 3R-A, Block 25, Clearview Addition, an addition to the City of North Richland Hills as evidenced by plat recorded in Volume 388-145, Page 39, Plat Records, Tarrant County, Texas; THENCE South 00 degrees 01 minutes 29 seconds West a distance of 185.11 feet to a 5/8-inch iron rod set for a common comer of the Zoya tract and Lot 3R-B, Block 25, of said Clearview Addition; THENCE South 50 degrees 04 minutes 29 seconds West, passing at a distance of282.92 feet a 5/8-inch iron rod found for the southeast comer of said Zoya tract, in all a distance of282.92 feet to a 5/8-inch iron rod set for comer; THENCE South 41 degrees 55 minutes 31 seconds East a distance of 10.27 feet to a 5/8-inch iron rod found for a re-entrant comer of Lot 2, Block 25, Clearview Addition, an addition to the City of North Richland Hills as evidenced by plat recorded in Volume 388- 143, Page 59, Plat Records, Tarrant County, Texas, same being the most northerly comer of Lot 1, Block 25, Clearview Addition, an addition to the City of North Richland Hills, Texas, as evidenced by plat recorded in Volume 388-119, Page 66, Plat Records, Tarrant County, Texas; THENCE South 47 degrees 42 minutes 38 seconds West a distance of 130.05 feet to a 3/8-inch iron rod found for a comer of said Lot 2 and the most westerly comer of said Lot 1, same being in the northeast line of said Block 2-R; THENCE South 41 degrees 43 minutes 20 seconds East a distance of219.30 feet to a 5/8-inch iron rod found for the most southerly comer of said Lot 1 and most easterly comer of said Block 2-R, same being in the northwest line of State Highway No. 26 (Grapevine Highway), a 140-foot right-of-way; THENCE South 48 degrees 10 minutes 00 seconds West a distance of 461.60 feet to the POINT OF BEGINNING, containing 10.43 acres of land, more or less. 2. THAT, the Official Zoning Map be redrawn to incorporate this zoning district boundary amendment and the herein described ordinance number be affixed to the property described herein. 3. THAT, any overhead dock doors servicing an automotive or truck repair facility or tire center facility must face commercial property, or any property to the east, west, or south. 4. SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the section, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. Ordinance No. 1999 Page 2 5. SAVINGS CLAUSE. That Ordinance Number 1874, the Comprehensive Zoning Ordinance of the City of North Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. 6.
