Randy Rainbolt informed me that last night some unknown
actors cut the fence at Fossil Creek

(2) sets of aluminum bleachers and partially disassembled

This is not a rare occurrence. While attending in Austin g a recent
TRAPS meeting , Mr. Petty of Houston Parks and
Recreation Department spoke on this subject. It seems
that
people are cutting tip the bleachers, park toys and is ' c
tables and selling the aluminum for
about $.30 a pound.
Houston finally had to post additional security in these
parks at night.
To date, two and a half bleachers and two '
i�ew picnic tables
have met this demise in the last three months.
My budget can not replace these items. I have instructed ted
the Parks Department to replace ace the missing planks with
wood, but even this will result in deficit spending.

As part of the 1986 amendments to the Safe Drinking ater Act, ct, new U.S.
Environmental Protection Agency rules were promulgated in June, 1986

Subject: Reconsideration of Watauga Road Alignment
On May 26, 1988 the Planning and Zoning Commission re- opened the
discussion regarding revisions to the Master Thoroughfare Plan. In their
discussion the Commission noted that they had sent a mixed signal to the
City Council in their recommendation regarding the alignment of Watauga
Road. The Commission suggested that the City Council should reconsider
their earlier decision.
The Planning and Zoning Commission recommended that the alignment of
Watauga Road between Davis Boulevard and Amundson Road be along the
central or middle route with every effort being made to miss both of the
affected homes,

information.

WATAUGA ROAD IMPROVEMENTS
CENTERAL ALIGNMENT STUDY
As you instructed, we have prepared a preliminary study of the Watauga Road
cation of the right-of "Central Alignment" alternative to determine the to g
ght-of-way
relative to the homes of Charles Scoma and Billy Delp. Attached is a sketch
showing the approximate location of this right -of -way.
As shown on the attached sketch, Charles Scoma's home would be located inside
the south right -of -way line about 30 feet. Billy Delp's home would be 1
ocated
outside the north right -of -way line about 95 feet. The approximate distance
between the two homes is about 200 feet. A right -of -way of 130 or 140 feet
could be located between the two homes with a slightly different alignment
with 30 or 35 feet from the front of Charles g
Scoma's home to the south
right -of -way line and 30 or 35 feet from the rear of Billy Delp 's home to the
north right -of -way line. We would note that the distances given are based on
measurements from aerial photographs and not from detailed field surveys.

Barfield said he feels they need to
look at Watauga Road as a State
Highway; there needs to be some long
range planning. He said he knows two

property owners will be upset, but he
requests the City Council reconsider.
Chairman Tucker said to go south would
hurt several homeowners and to go
north would be too close to the
school. He said to go through the
middle would be the most logical
route.
Mr. Barfield made the motion to
recommend to the City Council they
reconsider the alignment of Watauga
Road to cause it to go through the
middle and try to miss both houses.
This motion was seconded by Mr. Wood
and the motion carried 6-0.

Subject: Water & Sewer Utility Study Update Information

The purpose of this memo is to transmit updated information for the
Utility Rate Study public hearing scheduled for Monday, June 13 � 1988.
The attached Addendum is a s of the final report reviewed by City

Council on Tuesday, May 31, 1988 and contains updated information based
on the preliminary findings of the City Council regarding the proposed
rate increases. The alternative rate increase information requested by
the Council is shown on page 1 of the Addendum.
Background Information on
Water & Sewer System - North Richland Hills
For your information, the City's last rate increase was December, 1981.
That increase has been sufficient for the past 6 1/2 years for operations
and Support of three separate revenue ue bond issues. That increase e
is

The implementation scenario on n of the attached Addendum offered
three different alternatives for the proposed increase. Scenario I, as you
recall, was presented to City Council at the May workshop and is summarized
as follows:
Scenario I:
18.5% effective June 1, 1988
10.5% effective October 1, 1.9 8 8
4.6% effective October 1, 1989
4.0% effective October 1, 1990
1. Of the 10.5% increase in October, 1988, 1.28% was due to increase in the
cost of water purchases and wastewater treatment from TRA and City of
Fort Worth,
2. Of the 4.6% increase in October, 1989, 2.67% is a pass- through of costs
as stated above.
3. Of the 4.0% increase in October, 1990, 3.91% is a pass- through of costs
as stated above.
4. A summer surcharge was also proposed effective June 1, 1988. It was to
be applied for the months of June, July, August and September for each
fiscal year.

As aresult of the workshop in May, City Council reccnmended that staff
consider the implementation of the proposed rate increase effective Jul
1st , 1988, assuming (1) across the board rate increases; (2) implementation
of the surcharge; and (3) the pass- through charges to become effective
starting October 1988. That pass- through fee could change slightly based
on more detailed information which g y
will be received fran TRA and Fort Worth
prior to October, 1988. Another possible implementation schedule also
considered the proposed rate increase effective October 1, 1988. The Jul
1 and October 1 scenarios are summarized on e 1 y
page o f the Addendum,
Impact of Scenarios
The impact of the proposed rate increase for Scenario II & III is
highlighted on page 2 of the Addendum. Scenario II assumes the rate
increase will become effective July 1, 1988. Under that assumption, the
revenues collected through September �
g p umber 30, 1988 appear to be sufficient to
meet bond covenant requirement of 1.3. The bond sale could take lace at
the same time as the proposed General Obligation p
p po igation Bond Sale if the rate
increase is as outlined in Scenario II. This would minimize extra bond
sale costs associated with separate issues.
Scenario III (page 2) of the Addendum is based on postponement of the rate
increase until October 1, 1988. The rates would be increased across the
board by 34% with an additional 1.85% anticipated as pass -thru cost for TRA
and Fort Worth. This pass- through rate is based on current information
supplied from the City of Fort Worth. As indicated on page 2 of the
Addendum, the revenue bond rate coverage thru September 30th, 1988 (0,823)
would not be sufficient to sell bonds. The City must have a minimum of
130% coverage in order to issue new debt. Because of this inadequacy, equ cy, a
complete fiscal year must pass before having sufficient coverage. The
earliest date for the proposed bond sale would be January-February, 1990.
The rate study outlined many projects that were anticipated in fiscal ear
1988/89. Scenario III will require a delay of these y
� y ese projects until early
1990.
Key Elements of Water & Sewer
Fund Expenditures
The City of North Richland Hills budgeted expenditures for F/Y 1987/88 can
be summarized in the following categories:
A. CIxe-trati g Costs (26% of costs);,includes salaries, supplies,
services, repair and maint.enaLnce r
B. wholesale water costs and wastewater treatment cost (44% of
cost); payments to TRA and the City of Fort Worth,
C. Debt Service (19% of costs); payment of principal and interest
payments on Revenue Bonds,
D. Overhead charges (6% of costs); general and administrative fees
and payment in lieu of property taxes.
E. Capital funded from operations (5% of costs) ; minor capital
replacement and partial funding

The cost of operation can be divided between fixed cost and variable cost
or controllable and non - controllable cost. Items B and C are not
controllable by the City and those items represent 63% of our total costs.
Debt Service (Item C) is legally required payments on prior bond issues and
proposed future issues. Wholesale cost (Item B) are services rovided
P by Fort Worth and TRA and are
controlled by long -term contracts with those
entities.
Conclusion
The rate study was conducted for two reasons. First, a comprehensive plan
was established for future system imp rovements and replacement needs th r
u
fiscal year ending 1992. Secondly, the rates charged to our customers
should be sufficient to meet current operating costs and debt service
requirements as outlined in our revenue bond covenants. The comprehensive
study conducted by Administrative and Fiscal Consulting Services, Inc. has
included a review of all current contracts, bond covenants, pa st audited
financial information, and projected needs. With Staff's concurrence the
findings of the Water and Sewer Rate Study were presented to the City
Council and are summarized in the attached Addendum.,
City Staff and the Consultants will be available to answer questions that
may arise during the public hearing Monday, June 13th.

Definitions
1. Sumter Surcharge - An additional charge added to the volume rate for
usage over a certain amount greater than the average use: *i.e. 10,000
gallons for 3/4" meter). The surcharge is to be applied during the simmer
months of June, July, August, and September in order to equitably
distribute the added cost charged for the Fort Worth water supply 1 durin g
peak usage periods.
2. Pass - through Rate - A rate associated with the increased cost for the
purchase of treated water and payments made for treating of wastewater over
the prior year. Example: treated water cost fram Fort Worth for fiscal
year 1987/88 is $21,500,000. The cost projected for fiscal year 1988/89 is
$3,000,000. The incremental increase would be $500,000. That increase is
a pass -thru cost divided by the projected gallons purchased fram Fort Worth
and allocated to the individual custcoer based on gallons used.

Mr. Gilbert Caldwell, 6813 Old Mill Road, appeared before the Council,
Mr. Caldwell stated he had a question on the removal of items from the
Consent Agenda, specifically PZ 88-6. Mr. Caldwell stated this was the
first time he had seen the request for an Appeal Hearing. Mr. Caldwell

This Rezoning request is presented on four pacrcels of property located
Flory Street and extending astward to P P Y on both sides of
g Scruggs Drive. The requested rezoning is from
R -7MF Multifamily and C -2 Commercial to I -2 Industrial.
The Staff noted to the Commission that the applicants had earlier submitted
t ted a portion of
the property contained in this request for industrial zoning, nd that •
submission was not of sufficient s" g' the earlier
size to allow consideration of the request . That is,
the area of the property did not meet the required two (2) acre minimum for the I -2
District. The Commission delayed consideration of the request to allow
revise the subject property to meet q the applicant to

has added two additional parcels belonging to two other owners which
h are contiguous with
the original request. The area now included in the application is
PP 3.56 acres.
The original applicants' intent in requesting the industrial zoning was to allow the
property to be utilized for uses which required significant outside storage i

request does not indicate that the additional parcels have been designated fo

development at this time. However, at the
p is hearing the owner of Lot 8, Block 1,
indicated his intentions are to build a building for Office /Showroom facilities,

residential neighborhood,

Hearing and called for those wishing
to speak in favor of this request to
please come forward.
Delbert Stembridge. Consulting
Engineer, came forward. He stated he
represents 3 different owners of
contiguous property. He stated there
is approximately 31 acres in the
request.
Mr. Wood asked what did they plan to
use the property for.
Mr. Stembridge stated Mr. Hazel
presently has a wrecker service on one
of his lots and Mr. Hall on Lot 8,
Block 1, Henry Addition, intends to
build an office type building and
warehouse. Mr. Stembridge stated that
Mr. Hazel needed the zoning change to
Industrial, but did not have the 2
acre requirement so he got the others
to come in with him to request the I -2
zoning
Mr. Wood asked if there is a
requirement of 2 acres.
Mr. Royston
stated that is correct.
Mr. Barfield stated there is
residential around the lot on Scruggs.
He asked if they had talked to the

property owners on Scruggs.
Mr. Stembridge said they had not.
Bob Hall, owner of Lot 8, Block 1,
Henry Addition, came forward. He said
that previously the property owner on
the end of Scruggs and Glenview had
said he would join with him to request
a zoning change, but didn't. Mr . Hall
stated that most of the land in the
area has been zoned Multi - Family, but
has been used as Commercial. He said
Mr. Walker has property he uses as
I -2.

Mr. Wood asked Mr Hall if he needed
the I -2 zoning.
Mr. Hall stated he plans to put up
some type of warehouse complex. He
said he joins the church property and
the church needs some storage space.
Mr. Hall stated he plans to build a
5,000 square foot metal building with
a masonry front with storage space for
the church. Mr. Hall stated he talked
Mr. Stimmel and Mr. Skur into joining
in the request for I -2. He said the
building would be the same if it is in
C -2 or I -2.
Mr. Barfield asked if the Commission
could recommend two zoning
classifications for this request.
Mr. Royston stated the Commission
could recommend what ever they choose,
but if Mr. Hall wants to build a
warehouse, he would have to have
Industrial zoning.
Chairman Tucker called for those
wishing to speak in opposition to this
request to please come forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing,
Mr. Bowen said he agrees that this is
a re- development area, but feels there
should be more of a coordinated
effort. He said he thinks the whole
area needs to be coordinated.
Chairman Tucker asked how can you
coordinate unless you start. He said
the Council could go in and blanket
zone the whole area.
Mr. Bowen stated some of this request
is real close to a residential area.
Steven S an, share owner of Americity
' Corpo ion, came forward. He said he
wou like to say he appreciated
. R' and Royston and Wanda Calvert for
' heir help in negotiating this
request.
Mr. Sloan stated previously the City
had contacted him that there was a
building on his property that had
become in bad shape and requested it
be torn down. He said he took care of
that. He stated this request if for
71 acres. He said the remainder of
the 22 acres is C -1 Commercial. Mr.
Sloan said they wish to create a

property is located on the northwest corner of Glenview
Drive and Booth Calloway Road. The property is the site of the existing Four Seasons
Nursing Home. The applicants
propose xpand the existing nursing home on to the
adjacent vacant property which they own. The additional property is n

In the review of the proposed plat the Staff noted that the Thoroughfare

that Glenview Drive is designated n M5U, Minor Arterial Street, five lanes undivided
and that Booth Calloway Road is designated as a CO, Collector Street

undivided. In order to accom
p se designations the applicants would be required
to provide additional street dedications on both streets. On Glenview Drive, the
ultimate right of way need is for eighty-two
feet requiring the applicant to dedicate an
additional twelve and one -half feet. The applicants objected to the magnitude of the
required dedication noting improvements currently underway on Glenview Drive by
the State Department of Highways and Public Transportation will result u It in a four Lane
street within the existing right of way. The applicants agreed that an additional tional lane
would be desirable at the intersection
of Booth Calloway Road. They suggested that a
total of twelve feet of additional right of way would be sufficient to accomplish ccompllsh that
nd. They submitted an alternative proposal in which the Nursin Home '

additional six feet of right y for a distance of two hundred feet. The assumption
being that in the future the property on the Richland Hills side of the
street will be
required to match that dedication.
On the Booth Calloway frontage the required right of way dedication amounted
to a sliver
of property at the northeast corner of the lot which the applicants included

We have received your comments of May 2, 1988, and have concluded
the plans as follows:
1. We have added the name of the addition and lot and block to
the title.

border of the cover sheet,
5. We have included the lot and block or tract numbers for the
adjacent property owners on the plat.
6. The building line requirements along Booth Calloway Road
have been verified,
7. All volume and pages have been verified.
8. As requested the existing centerline of paving along
Glenview Drive and Booth Calloway Road has been verified.
Based on your recent thoroughfare plan, it is our
understanding that Booth Calloway Road will be ultimately
designated as a 68 foot R.O.W. which would require a
minimum distance from the centerline of the existing
pavement of 34 feet. This would result in clipping our
property at the northeast corner. Glenview Drive is
ultimately designated as a 82 foot R.O.W. with the
centerline verification of the roadway paving resulting in
an additional 15 feet of property dedication along our
frontage. We are hereby requesting a variance to the
dedication of that R.O.W. along Glenview and Booth Calloway.

An assessment of the 20 MPH speed zone located in the 6100 -6300 blocks of Onyx Drive South
was recently conducted to determine a reasonable prima facie speed. The existing

was researched regarding the original 20 MPH zone. Ordinance #722, implemented
shows no reason for reducing the speed. On May 1 P in 1979,

the North Richland Hills Police Department Traffic Officers regarding traffic violations, pedestrian traffic, road visibilit y, Fossil C reek Park and motor
vehicle related accidents_.
Vehicle speeds were found to be within the limit, pedestrian traffic was minimal, and the
park area was not judged to be a Factor in vehicular flow. There were therefore, no
major areas determined to be of a hazardous nature -to the public.
Recommendation:

NOW, THEREFORE, BE IT ORDAINED by the City Council of North Richland
Hills, Texas, that:

Ordinance No. 722 of the City of North Richland Hills, Texas, be and
is hereby amended by setting the prima facie speed limit at 30 miles per hour on
Onyx Drive South from the intersection of Onyx Drive South and Wendell Drive to
the intersection of Onyx Drive South and 3500 Billie Faye Drive,

Any person operating a motor vehicle upon said above - described
section, in the City of North Richland Hills, Texas, at a speed in excess of 30

The City of North Richland Hills is one of the last major cities in Northeast
Tarrant County still permitting organizations to solicit or sell by walkin g or
standing in the street or highways of the City. The Cities of Hurst, Euless and
Bedford have prohibited this practice as a result of its hazardous nature. This
activity is hazardous not only to the solicitors, who must move between vehicles,
but to the driver of the vehicle, who must negotiate our already overcrowded intersections
while having the added burden of the solicitor in his /her path.
On a recent Saturday three seperate charitable groups were in various major intersections
in North Richland Hills. Sirce this conduct was not permissable in other major
Northeast Tarrant County cities no solicitors were seen in comparable locations.
The overabundance of solicitors exacerbates our already overburdened intersections
and needlessly inconveniences our citizens as they attempt to go about their daily
business.
The Police Department therefore proposes to add a section to the solicitation
ordinance which will prohibit this hazardous conduct.
Ordinance 111357 regulating Itinerant Vendors and Solicitors was passed and approved
on March 24, 1986. When the police department staff prepared to draft an amendment
to the ordinance to prohibit soliciting from streets and highways, numerous errors
is were found-in the numbering of the articles, sections and subsection of the ordinance.
Rather than adding the additional information by amending this ordinance, it
appeared that the proper avenue of revision was to repeal Ordinance 111357 in its
entirety and request passage of Ordinance 111550, which covers all areas previously
covered by Ordinance 111357 and the additional prohibition
p of soliciting from streets
and highways. No changes were made in the original ordinance other than cleaning
up the numbering system and adding to Article IV a Section 3 described above
.
Recommendation:
It is recommended that Ordinance 111357 be repealed and that Ordinance 111550 be
.approved.

PREAMBLE
This entire ordinance is and shall be deemed as an exercise of
the police power of the State of Texas, and of the City of North
Richland Hills, for public safety, comfort, welfare, convenience
and protection of the City and Citizens of said City, and all of
the provisions hereof shall be construed for the accomplishment
of that purpose.
ARTICLE I ITINERANT VENDERS
SECTION 1: DEFINITION
For the purpose of this article, an itinerant merchant is any person
who either sells from house-to-house or from place -to -place in the City,
SECTION 2: PERMIT REQUIRED
Every itinerant merchant as defined in the foregoing section shall be
required to obtain a permit prior to the engaging in the business of an
itinerant merchant. An applicant for a permit to do business as an
itinerant merchant shall file an application in writing with the city
secretary not less than ten (10) days before the first month in which he
proposes to engage in business as an itinerant merchant. The application
must contain the following information:
(a) The full name of the person applying for a permit and his address
and telephone number, if. any. If the itinerant merchant is sellin g on
behalf of an organization, the name and address of the parent organization
shall also be supplied.
(b) The license plate number of any and all vehicles to be used by
the permittee must be provided. The Texas drivers license number of an
and all who will operate a motor vehicle for the y
permittee must be
provided.
(c) Proof of liability insurance (as required by State Law) must be
provided at the time of request for this permit. Such proof shall be in
format permitting retention by the city secretary.
(d) The addresses of the itinerant merchant during the P revious five
;(5) years with the name of at least one reference in each community,
(e) The name, address, date of birth and fingerprints of each agent
selling with the City.
(f) A copy of a limited sales tax permit issued b y the State of
Texas, or proof that the goods sold are not subject to such sales tax.
(g) A statement of the type of goods or wares to be sold.
(h) A copy of a current health certificate if merchandise of edible 10
quality is to be sold; provided, however, this shall not apply o the sale
of candy,

recognized manufacturer or a Texas manufacturer meeting standards imposed

(i) A statement of the period of time such applicant wishes to sell

SECTION 3: BOND REQUIRED
The application described in Section 2 hereof shall be accompanied by
a bond in the penal sum of $10,000.00, signed by applicant, and signed, as
surety, by some surety company authorized to do business in the State of
Texas, conditioned for the final delivery of goods, wares, merchandise or
services, in accordance to indemnity any and all purchasers or customers
for any and all defects in material or workmanship that may exist in the
article sold by the principal of said bond, at the time of delivery, and
that may be discovered by such purchaser or customer within 30 days after
delivery, and which bond shall be for the use and benefit of all P ersons,
firms or corporations that may make any purchase or give any order to the
principal on said bond, or to an agent or employee of the principal.
Provided that in case applicant is a persons, firm, company, partnership,
P
corporation or association engaging in any activity mentioned in paragraph
two hereof through one or more agents or employees, such persons, firm,
company, partnership, corporation or association shall be required to enter
into only one bond, in the sum Of $10,000-00 as above required, which bond
shall be made to cover the activities of all its agents or employees up to
a maximum of 5 agents or employees,
SECTION 4: FEES ATTACHED
That the license fee for an itinerant merchant, or itinerant vendor
shall be $100.00. Provided, however, when any person, firm, company,

partnership, corporation or association engages in any activity mentioned
in Section One hereof through one or more agents or employees such P ersons
firm, company, partnership, corporation or association shall, in addition
to said $100.00 above mentioned, pay a license fee of $50.00 for each agent
or employee so engaged, all of which licenses shall be valid for one Y ear
from the date of their issuance. The fees herein provided for shall be
used for the purpose of defraying expenses incident to the issuing of said
licenses.
SECTION 5: EXEMPTIONS
(a) The provisions of this ordinance shall not apply to sales made to
dealers by commercial travelers or sales agents in the usual course of
business, nor to sales made upon authority and by order of law, nor to
vendors of farm products, if such products are from the farm of the vendor.
(b) Sells or offers 'to sell a product, article, to service

(c) Holds, promotes or participates in entertainment, s orts event
benefit dance, fair, bazaar, or other P
type of organized social
entertainment; on the plea or representation, whether express or implied,
that the proceeds from the solicitation, sale or entertainment are for a

SECTION 6: CHARITABLE PURPOSE means the use of money or property for
the benefit of:
(a) Charity or philanthropy, or poor, impoverished, destitute
underprivileged, needy, refugee, diseased, injured, crippled, disabled, or
handicapped persons, or persons in need of rehabilitation;
(b) Patriotism, that is, for the teaching of patriotism or the relief
of assistance of veterans or veterans' organizations; or
(c) Existing educational institutions or for the establishment or
endowment of educational institutions or in aid of the education of any
person or group of persons,
SECTION 7: PERMIT REQUIRED; EXCEPTIONS; DEFENSES
(a) No person or organization may conduct a charitable solicitation
by handbills, advertisements, house -to -house canvass, or by any other
method in the city without the person, organization, society, or
corporation responsible for conducting the solicitation first obtaining
permit in compliance with the terms of this article. g
(b) If a persons or organization conducts or manages a charitable
solicitation in the name of or on behalf of another person or organization
each entity shall obtain a charitable solicitation permit.
(c) It is a defense to prosecution under this article that:
(1) an organization solicits funds or good only from its own
membership
(2) a person or organization solicits funds only by use of a
public broadcasting media;
(3) a person or organization solicits funds only from
foundations;
(4) the organization, person, society, corporation holds a
religious solicitation permit under this ordinance.
(d) This article shall not apply to persons under eighteen (18)
ears y
of age if engaged in fund raising activities for a nonprofit
organization anization
using all profits for young people's activities or donating all
profits to
charities other than a sponsoring organization. This article shall also'
not apply to persons under fifteen (15) years of age engaged in f

conducting the charitable solicitations.

The period within which the charitable solicitation will be
conducted, including the dates for

and ending of the solicitation.

A full statement of the character and extent of the
charitable work done by the applicant within the city during
the preceding year and a statement of the ur specific P purpose

for which funds are to be solicited, together with a
detailed account of their intended use.
(8) If the applicant is a corporation, a copy of its charter or
articles of incorporation from its state of incorporation if
the applicant is a foreign corporation, a copy of its

SFCATION 9: INVESTIGATION: ISSUANCE AND DENIAL OF PERMITS
(a) Upon receipt of an application, the city secretary hall
y make or
cause to be made, an investigation to determine the qualifications of the
applicant for a permit.
(b) If the city secretary finds:
(1) That the applicant has met all the requirements of this
ordinance;
(2) That none of the circumstances in subsection (f ) of this
sections exists:
the city secretary shall issue a permit.
(c) If the city secretary finds that the applicant does not meet the
requirements for a charitable solicitation permit as provided in subsection b
of this section, or that there is subsection ( b)
need to question the applicant to clarify the
application, the city secretary shall so notify the applicant at least ten
days in advance of a hearing,
(10)
(d) After a formal hearing if the city secretary finds:
(1) That the application has met all the requirements of this
article;
(2) That none of the circumstances in subsection (f) of this
section exist;
the city secretary shall issue a permit,
(e) In the case of unforeseen emergency or circumstances
necessitating immediate action to render aid for a charitable purpose, the c'

secretary may issue a charitable solicitation permit on a temporary y

a hearing on there application are false.
(2) The applicant or person in charge of the charitable
solicitation has been convicted of fraud, theft, conversion
embezzlement, swindling, robbery, or burglary, or that the
applicant or person in charge has made or caused to be made
false statements or misrepresentations to a member of the
public with regard to the charitable solicitation campaign
or other activities described in the
permit, or has in any
way publicly represented that the charitable solicitation
permit is an endorsement or recommendation of the cause for
which the charitable solicitation is being conducted or has
otherwise violated any of the terms of a charitable
solicitation permit or this article.
(3) There is no local resident in a responsible osition

the organization conducting the charitable solicitation.
(4) Applicant received a charitable solicitation ermit o

conditional basis in the previous year and failed to comply
with conditions of the permit. P y

SECTION 10: DURATION OF PERMIT; NONTRANSFERABLE
(a) Charitable solicitation permits are valid only or

SECTION 11: PROCEDURES AND REQUIREMENTS
(a) When contributions to a person or organization are not wholly tax
deductible, the person or organization shall rominentl
materials used in the solicitation and in all P Y state, in all
verbal solicitations, the
percentage which is not tax deductible.

Ile (b) No provision of this ordinance shall be construed to apply to children
engaged in the sales of items for extra curricular activities sanctioned by the
school district nor for agricultural products in their natural state sold by the
' grower.
(c) No exemption is either expressed or implied for any vendor of
confectionary or dairy products (including those foods commonly referred to as
ice cream) sold from mobile vending trucks nor for the sale of botanical
products vended from the roadside or door -to -door.
' SECTION 12: EDIBLE MERCHANDISE, SANITATION
Every person who is licensed as an itinerant merchant to peddle edible
' merchandise, as required by this chapter, shall keep all articles for sale to
the public in a clean and sanitary condition, as well as the wagons,: vehicles,
or other conveyances used in the transportation of such merchandise.
' SECTION 13: QUALITY AND ACCURATE MEASURES
It shall be unlawful for any itinerant merchant to sell or offer to sell
' any unsound or unwholesome merchandise or to give a false weight or measure to
such article sold or offered for sale.
SECTION 14: CANCELLATION OF LICENSE
Each itinerant merchant license issued hereunder shall be subject to
• cancellation for any violation of any provision of this chapter applicable to
' itinerant merchants.
SECTION 15: NO PERMITS TO CERTAIN PERSONS
' No permit shall be issued to any person who shall have been convicted of
any crime involving moral turpitude, including, but not limited to fraud,
swindling or related crimes.
SECTION 16: DISPLAY BADGE OR PLACARD
' Any itinerant merchant, vendor or peddler in the City of North Richland
Hills, Texas shall at all times while working in such capacity wear and
prominently display a badge or placard clearly identifying the said vendor by
name and clearly identifying the base or parent organization he is representing.
The letters of said badge or placard must be at least 1/8 inch in height.
ARTICLE II. CHARITABLE SOLICITATIONS
' SECTION 1: DEFINITIONS

ry expenses incident to
the solicitation, collection, and disbursement of the funds.
(e) No person may solicit or obtain gifts in money or merchandise directly
or indirectly, by the misrepresentation of names, occupation, affiliation,
physical disability, financial condition, social condition, or residence.
SECTION 2: COMPLIANCE WITH ORDINANCE
No person may solicit contributions for a charitable purpose until the
provisions of this ordinance are fully complied with and until a permit for the
purpose has been issued by the city secretary authorizing the solicitation inn
the city,
(a) In all cases where the city secretary has reason to believe that a
person or organization is soliciting for a charitable purpose without a permit
or the funds of a person or organization operating under a charitable
solicitation permit have been or are being diverted from the purposes for which
they are collected, or have been secured by misrepresentation, the erson or
organization involved is subject to investigation b P
g y the city secretary, and may
require the person or organization to file an immediate account of its receipts
and expenditures.
(b) The city secretary may execute in writing and cause to be served upon a
person who is believed to have information, documentary
ry material, or physical
evidence relevant to an alleged or suspected violation of this article an
investigative demand requiring the person to furnish, under oath or otherwise a
report in writing setting forth the relevant facts or circumstances of which he
has knowledge, or to appear and testify or to produce relevant documentary
material or physical evidence for examination, at a reasonable time and place a
as
may be stated in the investigative demand, concerning a charitable solicitation
that is subject matter of an investigation.
(c) Failure or refusal to comply with an investigative demand made ursuan
p t
to the provisions of subsection (b) of this section is a violation of this
ordinance,
SECTION 3: REVOCATION OF PERMIT
■ (a) The city secretary shall revoke a charitable solicitation
of a
permittee for any one or more of the following reasons:
(1) Making of a false statement as to a material matter in
an
application or hearing concerning an application;
(2) The making of a false statement or misrepresentation to a member
of the public with regard to the solicitation activity
(3) Violation of any of the terms or conditions of the charitable
solicitation permit;

(4) Violation of a provision of this ordinance •
(5) The representation by a permittee that the charitable
solicitation permit is an endorsement or recommendation of the
cause for which the solicitation is being conducted.
(b) The city secretary shall send written notice of a revocation to the
permittee by certified mail, return receipt requested,
settin g forth the reasons
ns for the revocation.
SECTION 4: PROHIBITED CONDUCT
A person engaged in charitable solicitation either door -to -door or
in a
public place shall not:
(1) Obstruct or impede the passage of a pedestrian or vehicle •
(2) Make physical contact with the person being solicited unless that
person's permission is obtained.
(3) Misrepresent the charitable purpose of the solicitation; or
(4) Misrepresent the charitable affiliation of those engaged ed in the
solicitation.

SECTION 5: BONDING REQUIRED
An organization described in Section one of Article two shall, at time of
application, submit a bond in the penal sum of $10,000.00, and signed as surety,
ety,
by a surety company authorized to do business in the State of
Texas; conditioned the final de live ry of g ood s wa res, merchandise or services,
in accordance
with the terms of any order obtained prior to delivery, and also conditioned to
indemnify any and all purchasers or customers for an and all defects ects in
material or workmanship that may exist in the article sold by the rinci al

said bond, at the time of delivery, and that may be discovered by such purchaser
or customer, within 30 days after delivery, and which bond shall be for the use
and benefit of all persons, firms or corporations that may make an purchase
give any order to the principal on said bond or to Y P se or
an agent or employee of the
principal. Provided that in case applicant is a person, firm com
partnership, � pany,
P p, corporation or association engaging in any activity mentioned in
paragraph two hereof through one or more agents or employees, such ersons f'

SECTION 6: PERMIT SHALL ISSUE WITHOUT FEE
In the event an organization shall qualify as a charitable organization, g ion, as
defined in Article two Section one of this ordinance no fee shall be attached to
the issuance of such permit for solicitations.
ARTICLE III. RELIGIOUS SOLICITATION
SECTION 1: DEFINITIONS
(a) Religious solicitation means conduct whereby person, '
society, corporation, or its agent, member or Y P . � organization,
g � representative.

(1) Solicits property, financial aid, gifts in an money, or

representing monetary value; or,
(2) Sells or offers to sell a product, article, tag, service or
printed material; on the plea or presentation, whether express or
implied, that the proceeds from the solicitation or sale are for
the religious purpose.
(b} Religious purpose means the use of money or property PP for the support of
a church, religious society, or other religious sect, group or order.
(c) Public place means any property open or devoted to P ublic use.
(d) Door -to -door means private residences and business of persons who are
both unknown to the person soliciting nd not church,: P
g members of the religious
society or other religious sect, group or order on whose behalf the solicitation
is performed,
SECTION 2: REGISTRATION; IDENTIFICATION BADGE
(a) A person who engages in religious solicitation door -to -door in a ublic
y, giving the following
place shall first register with the city secretar P
information:
(1) Name of registrant;
(2) Name of organization;
(3) Duration and locations of proposed solicitations; and
(4) Number of participants
(b) Registration expires after one year and must be renewed annually. If a
change occurs in any of the information submitted with the registration, the
person or organization shall notify the city secretary of the change,
(c) A person shall wear an easily readable identification bade meeting th

requirements of subsection (c) while engaged in religious solicitation in a
public place.
(d) The identification badge required by subsection (b) must:
(1) Be in a form prescribed by the city secretary;
(2) Identify the name of the organization as registered with the city
secretary; and
(3) Contain the statement "Religious Solicitation ".
(e) If a person, organization society, or corporation conducting
religious solicitation obtains a charitable solicitation permit in compliance
with Article two of this chapter, that persons, organization, society,

disturbing the occupant, unless the visit is the result of a request made e by the

SECTION 6: SEVERANCE CLAUSE
Each and every provision, paragraph, sentence and clause of this ordinance
has been separately considered and passed by the City Council of the City of
North Richland Hills, and each said provision would have been separately passed
without any other provision, and if any provision hereof should be ineffective,
invalid, or unconstitutional for any cause, it shall not impair, nor affect the
remaining portion nor any other part thereof, but the valid portion shall be
enforced just as if it had been passed alone, and all ordinances and parts of
ordinances in conflict herewith are hereby repealed. This ordinance shall take
effect and be in force from and after its passage and publication as provided by
law.

Approve Revised Drainage Plan for Carston Court Addition

The Council approved the final plat for Carston Court Addition on June 23, 1986.
The approval was subject to certain drainage improvements being installed. These
improvements were not installed, but the rest of the construction was completed.
Four building permits have been issued in the addition though total acceptance
of the subdivision was never issued by the Public Works Department.
The developer's designated representative, City Manager, Director of Public Works,
and City Engineer met on May 29, 1988. An agreement with reference to further
required drainage improvements for Carston Court was formulated and subsequently
signed by all parties. A copy of the signed agreement is attached.
Recommendation:
The Staff recommends the Council approve the revised drainage plan as outlined in
the attached agreement in lieu of the drainage stipulations approved with
PS 86 -24 on June 23, 1986.

Pursuant to our meeting with you as the Carston Court owners' representative
on May 29, 1988, we are recommending drainage improvements on Lots 10, 11,
and 12, of Block 1 in accordance with construction plans prepared by
Delbert Stembridge and submitted on April 19, 1988. These plans include
a concrete drainage flume located in an existing 10 -foot drainage easement
along the west line of said Lots 10, 11, and 12. Also included in this
recommendation is an extension of this proposed concrete flume along the
south line of Lot 10 as required to pick up concentrated flow at the
southwest corner of Lot 10.
Permanent drainage facilities along the south line of Lots 8 and 9 or any
other lots in the Carston Court Addition will not be required provided all
lots are graded properly to cause the runoff to drain to the street or to
sheet flow from one lot onto the adjacent lot without creating a concentration
of flow and without causing ponding . Block sodding of the back yard areas
will be necessary on the lots where concentration of flow cannot be avoided
in order to control erosion. In addition, the top of the proposed flume
curbs along the west line of Lots 10, 11, and 12 should be located below
the natural ground line of adjacent lots to the west which front on Lariat
Trail thereby allowing these Lariat Trail lots to freely drain to the ro osed
concrete flume.

This rescue unit will be used by the Animal Control officers to
transport animals with convenience, safety, and comfort for the animal.
Anconco is bidding a fiberglass unit and meets our specifications.
The unit bid by Deerskin Manufacturing is constructed of stainless
steel making it waterproof, corrosion resistant and chew proof. Each
compartment door will be made of steel with an aluminum louvered vent
and an aluminum one -way safety door inside.
The Director of Environmental Services, Pam Burney, and the Director of
Management Services, John Whitney, have inspected two (2) of these
units at the City of Arlington and find the unit bid by Deerskin
Manufacturing exceeds our specifications.
The "Animal Rescue Transport Unit" is the new state of the art for
Animal Control officers to transport and contain animals. This unit,
being modular, is mounted on a truck chassis enabling the City to reuse
the unit for many years. The many safety features not only protect the
animals but also protect the Animal Control officers from injury. Our
present unit does not have these capabilities.
Recommendation: Authorize the Director of Management Services to
purchase one (1) Animal Rescue Transport Unit from *Deerskin
Manufacturing, low bidder, in the amount of $7,110.

Emergency repair of air conditioning system for the

The Library and Recreation Center was opened in September 1987. From
the onset, we have been experiencing problems with the heating and air
conditioning system. Some areas are too hot, some too cold. This is
primarily due to the old system in the building was designed for use in
a church was modified for use as a library and full time recreation
center. Staff has received numerous complaints from patrons in the
main Library area of it being too hot. Staff has also received
complaints from patrons of areas too cold.
Staff has consulted a Mr. Roy Smith an independent air conditioning
consultant to evaluate and make recommendation to solve our problem.
Staff feels Mr. Smith's proposal will improve our system and ensure we
have proper temperature control in both facilities. Staff was unable
to evaluate Mr. Smith's proposal before the Council packages were
distributed on Thursday. A great deal of research was needed before a
decision could be made. With summer already upon us, staff feels it
would be in the best interest to proceed on an emergency basis
(additional information will be provided at the Council meeting),
• Funds are available in the regularly budgeted Building Maintenance
account.
Recommendation: Authorize the Director of Management Services to
proceed on an "Emergency Basis" and contract with Honeywell Inc. for
a complete rework of our air conditioning system in an amount not to
exceed $30,,00.0.

Preliminary engineering for the Grapevine Highway Water Line orti on of this s project was
begun in 1983. The main reason for the installation of this 12 �� water main from
Harmonson Road to North Hills Mall is to provide a needed link between an fisti x'

the Diamond Loch /North Hills Addition area.
The Pressure Plane Regulation portion of the project will consist of installing an
automatic pressure reducing valve on Holiday Lane at Calloway Branch to allow flow
automatically to occur between high and low pressure planes within the City during

The low bid of $311,111 is $278,889 under the budgeted amount of $590,000 for this
project. Since change orders may be required for this project due to unexpected
contingencies or for extra work ordered by the City, we would recommend that the
