Subject: Vacancy on Planning and Zoning Commission
A vacancy now exists on the Planning and Zoning Commission due to the
resignation of George Tucker.
There is a large program of work at the present time that needs to be done
by the Planning and Zoning Commission and a full Commission would be
advantageous.
Attached is a list of the present Planning and Zoning Commission members,
when they were appointed, when their term expires, and what council place
they are assigned to.
All Commission members are presently assigned to a council place, but were
not necessarily appointed by that council member or that place because
they were on the Commission prior to the present selection system being
established.
The position that was held by George Tucker was assigned to Place 6 which
would be an appointment by Byron Sibbet.

Subject: Effect; ve Tax Rate Ca 1 cul at; ons
As you are aware, the City received the certified tax roll information
from the Appraisal District last week showing a significant reduction
from the current year's tax roll. The current tax roll (1987-88) was
$1,499,829,896 as compared to the new roll (1988-89) of $1,446,751,304.
That reflects a decrease of 3.53%. The difference is even greater if
compared to the preliminary numbers provided by TAD in May. The
preliminary numbers were $1,550,647,452 or a reduction of 6.7%.
The second phase of the State Property Code dealing with the "Truth in
Taxation" process requires the City to publish summary calculations for
last ~ear's tax rate, this year's effective tax rate, the 3% limitation
tax rate, and the 8% rollback tax rate. The attached document is the
publication that is required to be published in our official newspaper.
The "effective tax rate" is the tax rate required to generate the same
tax dollars that were generated in the previous year when comparing
properties that were taxed in both years. In previous years the new
calculated effective tax rate has always been lower than the current
adopted rate because overall property values have generally increased,
especially in periods of high inflation.
Because of the overall decrease in values (3.5%) that is not the case
this year. An individual example is as follows:

As indicated above, to generate the same tax income in 1988-89 as was
produced in 1987-88 a 42.7979¢ tax rate is required. This is a simplistic
example. The real calculation has other adjustments that are mandated by
State law. The new effective tax rate as calculated from the reduced tax
roll is 43.38937¢ per $100 value.
The 3% limitation tax rate is the maximum tax rate the City may adopt
without conducting public notice and hearing requirements as mandated by
State law. That rate limit is 44.691¢ per $100 value.

The 8% rollback tax rate is the maximum tax rate the City may adopt without
incurring the possibility of a rollback petition. The rollback tax rate is
45.378544¢ per $100 value.
The final parts of the required publication deal with the estimated reserve
balances for the General Fund (M&O), Debt Service (I&S), and a schedule of
Debt Service requirements.
This informal report is transmitted to inform City Council of the
publication requirements for tax rate calculations. The attached documents
will appear in the Fort Worth Star Telegram, Northeast Section, Wednesday,
August 10, 1988.

1988 PROPERTY TAX RATES IN CITY OF NORTH RICHI:..AND HILLS
This notice concerns 1988 property tax rates for City of North Richland
Hills. It presents infonnation about three tax rates. Last year I s tax rate
is the actual rate the taxing unit used to detennine property taxes last
year. This year's effective tax rate would impose the sarre total taxes as
last year if you canpare properties taxed in both years. Cœ1pare it to the
tax rate the taxing uni t proposes for this year. This year's rollback tax
rate is the highest tax rate the taxing unit can set before taxpayers can
start tax rollback procedures. In each case these rates are found by
dividing the total anount of taxes by the tax base (the total value of
taxable property) with adjusbœnts as required by state law. The rates are
given per $100 of property value.

The low bid for the sprinkler system in the amount of $11,260 (see Cover
Sheet PU 88-39) from Hydrotech of Texas and the low bid from Plush
Landscaping Service in the amount of $19,394 totals $30,654. As
indicated above the amount appropriated for City Hall Facilities is
$41,000. This will leave a surplus of $10,346. The surplus could be
used for repair of the present sprinkler system on the east side of City
Hall and the addition of plants and shrubs deleted due to lack of
funding.

On January 14, 1988 the Planning and Zoning Commission held a public hearing on Zoning
Application PZ 87-30, a request of E-Systems Pool Trust, Inc. for rezoning a portion of
Tract 8A, J.H. Barlough Survey, Abstract 130 from R-3 Single Family to R-7 MF
Multi-Family.
The purpose for rezoning by the applicant is to create a buffer zoning from the existing
Mobile Home Park located to the south. The Planning and Zoning Commission recommended
denial·of the rezoning request.

The applicant requested an appeal hearing before the City Council on the Planning and
Zoning denial. The hearing date was set for March 14, 1988. On February 22, 1988, the
applicant requested by letter that the appeal hearing be postponed until questions
concerning the alignment of Watauga Road and the zoning of adjacent tracts are resolved.
On July 20, 1988, the applicant requested that the City Council hold the appeal hearing
on the Planning and Zoning Commission's denial.

Mr. Washington said the owners are the
employees Trust Fund, their retirement
fund. He said they own properties
from Grapevine Highway and Precinct
Line Road to Davis Boulevard. He said
they are planning for a high tech
plant here similar to the Texas
Instruments plant which would enhance
the City's tax base. Mr. Washington
stated the Multi-Family and R-8 would
serve as a transition between the
Mobile Home Park north to the single
family. He said the Multi-Family and
R-8 would be separated by a collector-
street.
Mr. Washington said the Commercial
request is bordered on the east and
north by Commercial zoning.
Mr. Washington stated that the Master
Plan shows Watauga Road to curve down
through these tracts and the upper
route that the homeowners want runs
through their property. He said
either route is acceptable to
E-Systems and E~Systems will dedicate
the right-of-way in either place.

Mr. Barfield asked if the City chose
the northern route would E-Systems
consider coming in and down zoning the
Industrial zoning on the north side of
the road to some less zoning leaving
the Industrial on the south of the
road.
Mr. Washington stated he felt that
would be acceptable with E-Systems at
a later date, but until the route of
the road is decided, they request
these zonings.
Chairman Bowen called for those
wishing to speak in opposition to
these requests to please come forward.
Charles Scoma, 8300 Cardinal Lane,
came forward. He stated his primary
concern was for the land to be
developed properly and harmoniously.

He said there are some 200 acres of
Industrial in the economic plan of the
City. He said this creates some
concern. Mr. Scoma said he took the
Economic Plan and read it. He said
the City has designated $150,000 for a
committee to attract Industry to North
Richland Hills. Mr. Scoma stated
there are 4 major tracts or areas in
the City that are either zoned
Industrial or proposed to be
Industrial. He said he hoped the
Commission would have an open mind
and listen to what they are going to
hear tonight.
Mr. Scoma said he is aware that the
sales tax and revenue of the City are
ahead of the Ad Valorem tax. He said
the Ad Valorem is the smaller of the
three and if the City attracts more
businesses, they would have more sales
tax. Mr. Scoma said he feels that
none on this Economic Development
Committee represents the citizens of
North Richland Hills. He said he read
that the averagè home in North
Richland Hills is valued at $85,000.
He said the property values are too·~
high to interest businesses. Mr.
Scoma said E-Systems can not develop
the land, they will only sell to a
developer. He said they are wanting
to rezone to make it attractive to a
developer.
Mr. Scoma said there are so many other
things beside a high tech industry
that can go in Industrial zoning. He
said I-I goes all thè way down to
Multi-Family. He said he feels there
are several issues that needs to be
addressed: does the City have
anything in writing stating that
E-Systems will dedicated the right of
way for Watauga Road; do they have
anything in writing that they would
develop the road? Mr. Scoma said he
thinks it should be a commitment.

Mr. Scoma said there were several
interviewed, and 100% of them stated
they would not locate in North
Richland Hills because of the
availability to Industrial.
Mr. Scoma said a number of citizens
came to him and requested that a group
be organized to represent the citizens
of North Richland Hills to bring
issues they have to the Commission and
Council. He said he did not feel
there was anyone on the City Council
that was interested in the citizens
wishes.
Chairman Bowen asked Mr. Scoma to
stick with the issues at hand. He
said at the time the Master Plan was
written there were many Public
Hearings for the citizens to have an
opportunity to participate.
Mr. Scoma said he feels there needs to
be a citizens group.
Chairman Bowen said that would be
good.

Mr. Tucker said when the Commission
was studying the Master Plan, they had
some 16 Public Hearings and they went
through many hours of discussion and
study. He said it took approximately
a year.' Mr. Tucker stated the
Commission wanted to keep the
Industrial away from the inter city.
He said Industry needs access and with
Watauga Road and Precinct Line Road in
this area would have access. He said
he hoped some day to have an outlet to
Highway 114. Mr. Tucker said this
Tract C was previously zoned
Industrial.
Mr. Scoma said he thought Mr. Cook had
it changed from Agriculture to R-3.
Mr. Tucker said it was Industrial
prior to the R-3.

just develop the Industrial they
already have.
Chairman Bowen asked Mr. Royston if
they could build Multi-Family in
Industrial zoning.
Mr. Royston said no, they would have
to have a Planned Development.
Mr. Scoma said it does not have to be
rezoned.
Chairman Bowen said yes they would
have to come back for a Planned
Development zoning.
Bill Rutledge, 6409 Sunnybrook, came
forward. He said his home is the last
one built in the Sunnybrook Addition
and it is the second smallest home in
the addition, 2500 square feet.
Mr. Rutledge said he is concerned with
the other things that could be put in
Industrial zoning such as a lumber
yard or steel fabrication. He asked ,_
if Tract C were developed, would thé/
traffic come out on Cardinal Lane. He
said this would be a problem.
Kathy Robinson, 6463 Chilton Drive,
came forward. She said the Commission
talks about the Thoroughfare Plan and
the Master Plan; why don't they talk
in plain english to where a citizen
can understand. She said if the
citizens would have known about the
Public Hearings regarding this there
would have been several attend.
Ms. Robinson said she does not want to
put in a road to be used for
Industrial. She said the city needs
to get the right-of-way dedicated
before they grant the zoning.

platting issue and the roads will have
to be put in before the property can
be used.
Ms. Robinson said E-Systems should
tell us up front that they will
dedicate.
Ms. Flippo asked if she was saying
E-Systems should commit to build the
road before receiving the zoning.
Ms. Robinson said yes.
Chairman Bowen stated that the zoning
request is for the appropriate use of
the land.
Mr. Tucker said you can make
stipulations in Zoning cases.
Mr. Royston said you can and we will
honor those stipulations with the
developer. He said the only way we
can put roads in is with platting or
covenants.
Mr. Tucker said the stipulations would
have to be a Council action.
Ms. Robinson said the Planning and
Zoning Commission could recommend to
the City Council.
Don Collins, 6290 Shirley Drive, came
forward. He said he built his home 11
years ago. He said it is adjacent to
Tract C. He said it would affect his
property value. He requested Tract C
be left R-3. Mr. Collins said his
only recourse is the Planning and
Zoning Commission. He said Tracts B-2
and B-3 are to the south of him. He
asked how many acres were in them.
Chairman Bowen said there were 20
acres in the Multi-Family request and
15 acres in the R-8 request.

Mr. Collins stated that Tract C was
previously owned by Mr. Hansard and
was Agriculture at that time. He said
Mr Hansard sold it to Mr. Barfield who
sold it to Mr. Cook who got it zoned
residential. He said now E-Systems
are asking for a zoning that would
devalue the adjacent property. Mr.
Collins requested that Tract C be left
residential.
The citizens requested they be allowed
to look at the layout.
Mr. Washington showed the audience the
layout of the area. He showed the
buffers to the Mobile Home Park and
Single Family area. He said the city
ordinance has specific landscaping and
set back requirements next to
residential property. Mr. Washington
said this type zoning could be better
for the neighborhood than residential.
He said there would be no one there at
night and no barking dogs.

Cindy Fortier, 6425 Sunnybrook, came
forward. She said she wanted to speak
regarding PZ 87-27. She said she did
not think anyone present is against
development, but Tract C is important.
She said it would adversely affect the
value of the property in the area and
would cause heavy traffic. Ms.
Fortier said she had rather see it
stay R-3. She said no one wants
Industrial or Commercial next to their
subdivision. Ms. Fortier said one
other concern is the apartment zoning.
She said it would put a strain on the
school system; there would be a high
vacancy rate and high crime rate. She
said all this concerns the people who
live here, not E-Systems.

Commission is composed of citizens of
North Richland Hills.
Billy Delp, 8400 Cardinal Lane, came
forward. He said he lives adjacent to
Tract C. He said he developed the
Glenann Addition. He said E-Systems
has plenty of property around the
airport without taking Tract C. Mr.
Delp said he was not so sure it would
be good to have a high tech plant
there. He said he passed T I on the
way to the meeting and it has a 10
foot fence around it. He said it
looks like a prison. Mr. Delp said
when he bought his property two years
ago Tract C was residential. He said
he would not have bought had it been
Industrial. He said he did not feel
they should allow the Industrial
encroachment.
Robert Marks, 8224 Pearl Street, came
forward. He said the Master Plan is
an idea, just a plan, and can be
changed. He said if this zoning is
approved, the City would lose all
control of the land because you can /"
practically put anything in there.
Chairman Bowen said it is controlled
by the Zoning Ordinance.
Mr. Marks stated there were some very
objectionable things that could go in
Industrial zoning. He asked the
Commission to realize the magnitude of
these requests.
John Runnells, 8501 Cardinal Lane,
came forward. He said he is against
the rezoning of Tract C and even Tract
D is in his front yard. Mr. Runnells
mentioned there is a Junior High
School in the area and they have minor
trouble with youth going across their
property.

forward. He said he is against this
rezoning. He said he was present at
the last time E-Systems was here and
previously it was well planned, but
now they say just give me Industrial.
He said what are you really buying;
E-Systems can not tell us. Mr. Olson
said he felt E-Systems should sell to
the developer and the developer should
come in for the zoning. He said he
requests the Commission reject these
requests.
Ed Rice, 6204 Gayle Court, came
forward. He said the plans do not
show Amundson Road coming down. He
said this is too much, too fast. He
thinks they should start with the area
of the airport first.
Spider Webb, 6294 Shirley, came
forward. He said Tract C is 40 acres,
39 feet from the property line. He
said 40 acres developed into single
family lots would provide lots of
taxes. Mr. Webb requested the
Commission leave this area
residential.

Mr. Wood made the motion to approve
the minutes as written. This motion
was seconded by Mr. Barfield and the
motion carried 5-0 with Ms. Flippo
abstaining since she was not present
at the meeting.

Julio Neira came forward. He stated
his Brother-in Law wanted to open a
restaurant at this location.
Mr. Wood asked if they were aware of
the building codes.
Mr. Neira said they were.

Vice Chairman Schwinger called for
those wishing to speak in opposition
to this request to please come
forward.
Thurburn Key, 4024 Rita Beth, came
forward. He said the neighbors do not
want any business there. He said Rita
Beth is a little street, only one
block long. He said the parking would
block them and the traffic would be
dangerous for the 8 to 10 school kids
in the area.
Vice Chairman Schwinger asked Mr. Key
where he lived.
Mr. Key said he lives on the same side
of Rita Beth.
Mr. Bowen stated there are parking
requirements that would have to be
met.
Mr. Key said several of the neighbors
would have come tonight, but were ill.
Mr. Barfield asked Mr. Key if it woul~
be agreeable with him if the /
Commission stipulated that their
access would be to Glenview and there
would be no entrances on Rita Beth.
Mr. Key said it would not bother him
that way.
Mr. Tricoli said you can not stop them
parking on the street even if you put
up "No Parking" signs.
Mr. Wood said he was not sure the
Commission could grant a stipulation
that the only access would be on
Glenview. He said this is so close to
Rufe Snow Drive that it might back
traffic up to the intersection.

Phillip Bramer, 4019 Rita Beth, came
forward. He said he did not get a
letter and he has lived there 30
years. Mr. Bramer said he has the
same objections to this as Mr. Key.
He said there are no sidewalks and
this would create more traffic.
Julia Brewer, 4033 Rita Beth, came
forward. She said her mother lives at
this address. She said most of the
people who live in this area are old
people. Ms. Brewer said if two cars
park on the street no one could get
through. She said if the entire area
could go commercial, it would be fine
because they could sell, but not just
one lot.
G. D. Brewer, 4033 Rita Beth, came
forward. He said this man's
intentions are great, but what will
happen later on; what would be there
the next 5 years. He said odds are
not good for survival in the
restaurant business. Mr. Brewer said
it might work out if there was no
traffic on Rita Beth.

Vice Chairman Schwinger closed the
Public Hearing.
Mr. Barfield asked Mr. Neira if he
could live with an entrance only on
Glenview with a screening wall.
Mr. Neira said he could. He said he
does not need an entrance on Rita
Beth. Mr. Neira said all they need is
a drive around and out. He said these
people live behind this property.
Mr. Tricoli said he feels you can not
stop parking on the side of the street
and he is not in favor of this
request.

Mr. Barfield said if you have a
screening fence there would be no need
for them to park there. He said this
is adjacent to commercial and there is
commercial across the street and he
feels with commercial all around, this
is the best use for the property. Mr.
Barfield said the neighbors say they
would not be against it if there is no
entrance on Rita Beth and there is a
screening fence.
Mr. Tricoli made a motion to deny PZ
88-7. This motion was seconded by Mr.
Bowen. This motion failed by a vote
of 2-4 with Mr. Barfield, Mr. Wood,
Ms. Flippo and Vice Chairman
Schwinger voting against the denial.
Mr. Barfield made the motion to
approve PZ 88-7 with the stipulation
that there be no entrance to Rita Beth
and a 6 foot screening wall along the
western side of the property as long
as there is residential there. This
motion was seconded by Ms. Flippo and
the motion carried 4-2 with Mr.
Tricoli and Mr. Bowen voting against-;"'
Mr. Bowen asked if the fence would
block the view of traffic.
Mr. Sanford said it would have to be
set back far enough for the sight
triangle.

AFTER APPROPRIATE NOTICE AND PUBLIC HEARING THE FOLLOWING RECOMMENDATION
IS SUBMITTED TO THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS BY

RESOLVED that on Case No. PZ-88-7 the following described property shall be

ALL That certain tract or parcel of land being the North 150 feet of Block
3, J.L. Autrey Addition to the City of North Richland Hills, Tarrant

BEGINNING at a steel rod at the Northeast corner of said Block 3, said
point being in the South right-of-way line of Glenview Drive (a public

Marvin Smith came forward. He said
all they were doing was taking two
lots out of the Agriculture district
and add to the other R-2 lots. Mr.
Smith said his parents own this
property and they do not want to sell
off any more of their land. He said
this corner has been a problem with
people dumping trash on it. Mr. Smith
said selling these lots would give his
parents a little money to pay their
taxes.
Mr. Smith said the houses in this area
are from 1800 to 2250 square feet and
he plans to build approximately 2000
square feet on these lots. He said
the utilities are already there and
there would not be much change in the
neighborhood.
Vice Chairman Schwinger called for
those wishing to speak in opposition
to this request to please come
forward.
There being no one wishing to speak,
the Vice Chairman closed the Public
Hearing.

Mr. Randall Turner of Western Realty Corporation is requesting a permit to
erect a message board sign at the Crossroads Plaza Shopping Center located
at 8210 ' Bédford-Euless Road. The City's current sign ordinance requires
council approval on all permits issued for message board signs. The total
sign structure can carry 260 square feet of signage according to the sign
ordinance. Mr. Turner has agreed to maintain no more than the 260 square
feet on the sign. The message board sign is 162 square feet. As long as the
260 square feet is maintained the sign will be in compliance with our current
ordinance.
RECOMMENDATION

of notice of intention to issue certificates
of obligation.
WHEREAS, the City Council of the City of North Richland
Hi lIs, Texas, has determined tha t cert i fica tes of obI i gat ion
should be issued under and pursuant to the provisions of
V.T.C.A., Local Government Code, Subchapter C of Chapter 271,
for the purpose of paying contractual obligations to be
incurred for (i) constructing and equipping a municipal golf
course, including a clubhouse and maintenance/stora~e
'"acilities and the purchase of equipment and machinery for
.:,alntaining and operating such golf course, and (ii)
professional services rendered in connection therewith; and
WHEREAS, prior to the issuance of such certificates, the
City Council is required to publish notice of its intention to
issue the same in a newspaper of general circulation in the
City, said notice stating (i) the time and place the Council
tentatively proposes to pass the ordinance authorizing the
issuance of the certificates, (i i) the maximum amount proposed
to be issued, (iii) the purposes for which the certificates are
to be issued and (iv) the manner in which the Council proposes
to pay the certificates; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NORTH
RICHLAND HILLS, TEXAS:
SECTION 1: That the City Secretary is hereby authorized
and directed to cause notice to be published of the Counci 1 · s
intention to issue certificates of obligation in the principal
amount not 'to exceed $4, 500,000 for the purpose of paying con-
tractual obligations to be incurred for (i) constructing and
equipping a municipal golf course, including a clubhouse and
maintenance/storage facilities and the purchase of equipment
and machinery for maintaining and operating such golf course,
and (ii) professional services rendered in connection
therewith, such certificates to be payable from ad valorem
taxes and a lien on and pledge of the net revenues derived from
the ownership and operation of the City's municipal golf course
facilities. The notice hereby approved and authorized to be
published shall read substantially in the form and content of
Exhibit A hereto attached and incorporated herein by reference
as a part of this resolution for all purposes.

NOTICE OF INTENTION TO ISSUE CITY OF
NORTH RICHLAND HILLS, TEXAS, CERTIFICATES OF OBLIGATION
TAKE NOTICE that the Ci ty Counci 1 of the Ci ty of North
Richland Hills, Texas, shall convene at 7:30 o'clock P.M. on
the 12th day of September, 1988, at its regular meeting place
in the City Hall of said City, and, during such meeting, the
City Council will consider the passage of an oràinance
authorizing the issuance of certificates of obligation in an
amount not to exceed $4,500,000 for the purpose of paying
contractual obligations to be incurred for (i) constructing anà
equipping a municipal golf course, including a clubhouse and
maintenance/storage facilities and the purchase of equipment
and machinery for maintaining and operating such golf course,
and (ii) professional services rendered in connection
therewith, such certificates to be payable from ad valorem
taxes and a lien on and pledge of the net revenues derived from
the ownership and operation of the City's municipal golf course
facilities. The certificates are to be issued, and this notice
is given, under and pursuant to the provisions of V.T.C.A.,
Local Government Code, Subchapter C of Chapter 271.

RESOLUTION NO. 88-24
WHEREAS, the City has advertised for and received bids in connection
with the construction and operation of a Municipal Golf Course; and
WHEREAS, the bids were duly opened on the 20th day of July, 1988; and
WHEREAS, the City Staff and City Council need additional time to
compare and consider the bids received.
NOW, THEREFORE, be it ordained by the City Council of the City of
North Richland Hills, Texas, that:

The City Council shall act upon the bids opened on the 20th day of
July, 1988 by the 27th day of September, 1988 and any requirement for prior

Timber Lane is located just north of Little Bear Creek and on the east side of
Davis Boulevard. The proposed sanitary sewer is to be constructed as part of

detrimental to the premises and upon completion of the work, will promptly vacate

delivering them will result in our present supply being exhausted prior to that tiIœ.
We currently have on hand two nDnth' s supply.
As you are aware the Ci ty Staff is currently in the process of preparing bid
specifications for the lockbox processing system for utility bills and tax statements.
Due to the length of tiIœ for research of these specifications, it became necessary to
purchase additional water bills. We had refrained fran their purchase earlier because
it was anticipated that the present supply \VOuld last until the lockbox system was in
place.
