INFORMAL REPORT TO MAYOR AND CITY COUNCIL
No. IR 88-36
Date: August 22, 1988
Subject: Electrical Problems - Police Communications
Since opening the new Police Facility and installing the new
electronics console, 9-1-1 Emergency Telephone System, Computer Aided
Dispatch, Call-Check System and Tlet's I and II, we have experienced
several problems concerning operation.
Power surges caused by TU Electric has adversely affected emergency
public service operation by knocking out some or all of the items
outlined above. Should this equipment be down for long periods of
time or burn up, emergency operation and public safety would be in
jeopardy and cost thousands of dollars for repair. In the previous
30 days we have experienced 18 reported and confirmed TU Electric
power failures that have affected our operation.
Even though we have emergency backup generators, they do not provide
an uninterrupted power source "UPS". Engineers and consultants have
been contacted and advise the only solution is the "UPS" System.
Management Services has procured pricing for an installed "UPS"
System in the amount $22,500.
Management Services would like direction as to whether we should
proceed on an emergency basis or proceed with the normal bidding
purchasing process. Should Council choose to proceed on an emergency
basis, installation could be complete in approximately 15 to 20 days.
The formal bid process would require 60 days plus the 15 to 20 days
installation as mentioned above.

Mayor Brown opened the Public Hearing and called for anyone wishing to
speak in favor of this request to please come forward.
Mr. David Washington, Engineer, representing the applicant, appeared
before the Council.
Mr. Washington stated this property was bounded on the north by a mobile
home park and on the east and west by industrial. Mr. Washington stated
the property was across from Tarrant County Junior College and he felt
apartments would be advantageous for the students attending the college.
Mayor Brown-called for anyone wishing to speak in opposition to please
come forward.
Mr. Roy Owen, 8245 Pearl, appeared before the Council.
Mr. Owen stated he felt there were enough apartments in North Richland
Hills that could not be rented. Mr. Owen stated E-Systems had not said
what kind of apartments they were going to build or how many.
Mayor Pro Tern Davis stated the City had restrictions on the number of
units that could be built per acre and had an elevation of the proposed
project.
Mr. Charles Scoma, 8300 Cardinal, appeared before the Council.
Mr. Scoma stated he represented a large group of people who were unable to
attend because of attending the School Board Meeting. Mr. Scoma stated he
realized this was adjacent to a mobile home park and felt that if this was
multi-family it would become low income housing in the future. Mr. Scoma
asked the Council to deny the request.

Counci1man Sibbet asked Mr. Scoma what his suggestion for the property
would be.
Mr. Scoma stated that he felt it should be commercial or industrial.
There being no one else wishing to speak, Mayor Brown closed the Public
Hearing.

Mayor Pro Tem Davis moved, seconded by Councilman Garvin, to approve
Ordinance No. 1556.
Mayor Pro Tem Davis stated he felt the multi-family would be a good buffer
zone. Mayor Pro Tem Davis stated there were very strict guidelines for
the development of multi-family and he also felt multi-family was the
highest and best use for the land.
Motion carried 4-0.

Mr. Randall Turner, Western Realty Corporation, appeared before the
Council.
Mr. Turner stated the message board would be for the Crossroads Plaza
Shopping Center and would be installed on existing poles.
Mayor Pro Tem Davis asked if there was an existing sign for the shopping
center on Bedford-Euless Road.
Mr. Turner replied no.
Councilman Garvin asked if consideration had been given to the height of
the sign if Loop 820 was raised.
Mr. Sanford stated this portion of Lpop 820 would not have any effect on
the sign.

Mr. McEntire stated he was authorized to present at this time a withdrawal
letter from Tom Shockley in Place 1 that reads:

DECLARATION OF WINNER IN PLACE 1 COUNCIL ELECTION,
RESOLUTION NO. 88-28

Mr. McEntire stated he proposed at this point that the next item on the
Agenda be Resolution No. 88-28 which reads:
"WHEREAS, a run-off election has been called to elect a City Council
person to Place 1; and
WHEREAS, the run-off is between Lyle E. Welch and Tom Shockley; and
WHEREAS, Tom Shockley has presented a written withdrawal of his name
from the ballot.

Mr. McEntire administered the following Oath of Office to Virginia Moody
and lyle E. Welch.

that I will faithfully execute the duties of the office of (City
Councilman/Councilwoman or Mayor) of the City of North Richland Hills,
State of Texas, and will, to the best of my ability, preserve, protect and
defend the Constitution and laws of the United States and of this State;
and I furthermore solemnly swear (or affirm) that I have not directly
paid, offered, or promised to pay, contributed nor promised to contribute -
any money, or valuable thing, or promised any public office or employment
as a reward for the giving or ~ithholding a vote at the election at which
I was elected. So help me God."
Councilwoman Moody asked for a point of special privilege

Councilwoman Moody delivered the following speech:
"Taking the Oath of Office this time is very special for me. The untimely
loss of Dick Fisher has left a void in many of our lives that will never
be filled. I am especially proud to sit in his chair and complete his
term in serving the community. I appreciate the confidence placed in me
by the voters and will work diligently not to displace that trust. There
are many who have worked very hard in this summer heat wave so that I
might take the Oath of Office tonight and my heartfelt thanks goes out to
a11 of you, but I must say a special thank you to my good friends, Dick
Faram and Jim Ramsey, my campaign manager, Charles Scoma, and campaign
treasurer, Alice Scoma. You guys are really the ones that made things
happen during this election and it is very much appreciated by me. II

PU 88-42 AWARD OF BID TO PLUSH LANDSCAPE SERVICES
IN THE AMOUNT OF $53,094 - LANDSCAPE OF CITY HALL/
POLICE AND FIRE FACILITIES
APPROVED
Councilwoman Spurlock moved, seconded by Councilman Garvin, to approve PU
88-42.
Councilwoman Moody asked that this item be postponed until after the
budget work session so that Councilman Welch and herself might bring
themselves up-to-date on what has been going on so they would be more
comfortable in placing a vote.
Councilman Garvin stated this item had been postponed and talked about on
numerous occasions and he felt the Council should go ahead with the
project.
Councilman Welch asked if the money had already been appropriated by the
bond issue and set aside for this project.
Mr. Line stated the money that would be used to do the landscaping at the
fire station was part of the proceeds from the bond sale for the
construction of that facility and the money could not be used for any
other purpose other than improvements for fire protection. Mr. Line
stated the money appropriated for landscaping at City Hall came from two
sources: (1) Utility Fund and (2) Building Maintenance Account. Mr. Line
stated these funds could not be used for any other purpose other than
Building Maintenance and Utility Fund. Mr. Line stated he thought there
was a lot of concern, which was understandable about the budget that was
upcoming and the financial problems that the City had, but he felt it was
significant to point out that these funds could not be used to offset any
costs in the General Fund AccQunt.
Mayor Brown asked if the money that was coming from the Utility Fund could
be used for other purposes.
Mr. Line stated it could be used for some other purpose in the Utility
Fund.
Mayor Brown stated he would. like to express the opinion that the City just
raised the water rates and he did not feel right about spending $53,000
for landscaping and using money from the Utility Fund.
Mayor Pro Tem Davis stated the reason the money was being taken out of the
Utility Fund was because the Utility Department used the bUilding and
there was an account in the Utility Fund to pay for the use of the
building, whether it be utilities, building maintenance or janitorial
service. Mayor Pro Tem Davis stated there was only $20,000 coming from
that fund and Council approved the appropriation on May 23rd.
Mayor Brown stated it was approved where the money was coming from but he
did not think it had been approved to spend the money.

Councilwoman Spurlock stated that the Utility Fund was only paying for the
sprinkler system.
Mayor Brown stated the City was spending $53,000 for these improvements
and he just wanted to make a point that the water rates were increased and
now the City was going to spend $20,000 for landscaping from the Utility
Fund.
Councilman Garvin stated the $20,000 that was being spent was not a result
of the rate increase.
Mayor Pro Tem Davis stated funds were not being spent as a result of the
water rate for this landscaping.
Councilman Sibbet asked if the funds that were coming out of the Utility
Fund were being used to offset what would be purchased from the funds that
came from the 34% increase in the water rate.
Mr. Line stated the money could be used for capital projects in the
Utility Fund area. Mr. Line stated that in terms on the effect on the
rate increase, he did not think you could carry it out enough decimal
points to miss $20,000 when you were taking about a 12 million dollar per
year operation.
Motion carried 5-2; Mayor Pro Tem Davis, Councilwoman Spurlock,
Councilmen Garvin, Metts and Welch voting for and Councilwoman Moody and

The sponsor is Meadowlakes Retirement Center, Inc., a non-profit cor-
poration wholly owned by the Richland Hills Church of Christ. The
purpose of the sponsor being to provide a quality facility to enhance
the lifestyle of ambulatory persons ages 55 and above.
Meadowlakes Retirement Center is designed to provide individual apart-
ments plus common areas for the use and benefit of the resident. A
total of 80 individual apartments are proposed. Each unit will be
complete with kitchen, either one or two bedrooms, individually control-
led air conditioning, phone, TV and cable jacks. Each resident will
have free access to and from the facility at anytime they choose.
Meadowlakes will provide a high level of services which are designed
to make residing there enjoyable and relatively carefree. These ser-
vices include:

Smoke detectors/Fire sprinklers
Safety grab bars in bathrooms
Two nutritious meals each day
Elevators to all floors
Activities director
Regular maid, housekeeping and laundry service
Scheduled transportation for shopping, etc.

The amendment governs all streets surrounding or intersecting with school
grounds. Elementary schools will have an added 11: 00 a. m. - 12: 00 noon
school zone for kindergarten students. The morning school zone time has
been reduced to 1 hour, 7:30 a.m. - 8:30 a.m., since all classes should be
underway by 8:10 a.m. Main traveled roadways around the schools will be
controlled by the additicm of amber flashing lights in conjunction with
school zone signs. Addition of flashing amber lights have altered the
length of some school zones. These changes require that Section 3.05 of
Ordinance #722 be amended.
The Deputy Superintendent of BISD has indicated approval of the proposed
changes.
Reconunendation:
It is recommended that the proposed Ordinance No. 1559 be approved.

Section 3.05 of Ordinance No. 722 shall hereafter read as
"Section 3.05 -- Speed Limits in School Zones
Upon the basis of an engineering and traffic investigation
heretofore made as authorized by the provisions of Section 169,
Article 6701d, V.T.C.S., the Uniform Act Regulating Traffic on
highways, the prima facie speed limits hereinafter indicated for
vehicles are hereby determined and declared to be reasonable and
safe, and such speed limits are hereby fixed for vehicles
traveling upon the following named streets and highways, or parts
thereof during the hereinafter designated hours, either (1) when

I In February, 1988 the Department of Community Development was formed and it combined
several inspection functions in one department. Included is the responsibility of
performing all building and fire inspections for all building construction in the City
of North Richland Hills. In the past, the Building and Fire Codes contradicted each
other in many areas and led to confusion and interpretation problems for all involved in
the construction business. In an effort to simplify the two codes, the Building
Ordinance has been re-written.
Attachment 1 is a summary of the proposed changes to the existing Building Ordinance.
Attachment 2 is the new Building Ordinance submitted for adoption.
Recommendation:
It is recommended that the City Council approve Ordinance No. 1560.

(No. 1560)
This section will outline by paragraph and section any
changes to the existing Building Ordinance.
SECTION 1.
Paragraph 2 - Changes the Uniform Building Code from
the 1985 edition to the 1988 edition. This will
keep us working in the same edition as the architects.
SECTION 4.
Item D - Sets a permit fee for demolition of a structure.
Item E - Sets a fee to go before the Appeals Board to help
eliminate inconsequential appeals.
Item H - Requires an address sign to be posted at constuc-
tion sites. This allows the site to be recognizable for
public safety.
Item I - Sets guidelines for figuring value of construction
work to be permitted for a swimming pool.
Item J - Sets requirments for smoke detectors in all lodging
houses used for sleeping purposes. Also required by
State Law.
Item L No. 3 - Outlines the requjrements for Beam Steel
installation in construction foundations.
No. 5 - Outlines the requirements for Piers in construction
foundations.
No. 8 - Outlines the requirement for installing Post-Tension
cables in construction slabs.
SECTION 6.
Items A-F - Deletes the requirement of bonding of all
contractors and replaces it with contractor's
registration. All surrounding cities are currently
using this system of registration.
Fees collected from registrations are a source of
revenue for the City.
Recommended fees are listed under Item C of this
section.

adopted in its entirety.
C. Appendix Chapter 49, Patio Covers, is hereby adopted in
its entirety.
D. Appendix Chapter 70, Excavation and Grading, is hereby
adopted with the following amendments:
1. Grading Guidelines for Development of Lots and
Tracts, to maintain protection of adjoining
properties and alleviate erosion problems encountered
by improper drainage:
a. Excavations or Fills made for purpose of develop-
ment of a lot or tract shall grade permanent
slopes no steeper than five (5) feet horizontal to
one (1) foot vertical.
b. Deviation from Excavation or Fill Limitations for
slopes shall be permitted only upon the presenta-
tion of soil investigation report acceptable to

The 1988 Uniform Building Code is amended and changed in the
following respects:
A. Section 105.(e) Moving Bond and Permits, is hereby
amended to read as follows:
1. No building or part of any building shall be moved
through or across any sidewalk, street, alley or
highway within the city unless and until a permit
therefor shall first have been obtained from the
Building Official. A fee of $50.00 shall be charged
for each permit and $10.00 for each additional day,
or fraction thereof, that the house or building is in
or on the street, alleys, avenues, or public
grounds.
2. House Moving Permit Application. Any bonded house-
m o·v e r des i r i n g a h 0 use m 0 v i n g per m its hall f i 1 e wit h
the Building Official a written application therefor,
not less than five (5) days prior to the proposed
date of removal, setting forth the following
information:
a. the type and kind of building to be moved
b. the original cost of such building

new location by lot, block, subdivision and street

the Building Official, the moving of any building

deteriorated more than fifty percent (50%) of its

SECTION 5.
Fire protection and separation between zero lot line,
two-family and multifamily dwellings.
A. Zero lot line and two-family dwellings shall have a
one-hour fire separation from each other continuous from
the floor to the bottom of roof deck. Where the
roof-ceiling framing elements are parallel to the walls,
such framing and elements supporting such framing shall
be of not less than one-hour fire-resistive construction
for a width of not less than four (4) feet on each side
of the wall. Where roof-ceiling framing elements are
perpendicular to the wall, the one-hour fire-resistive
construction shall extend not less than four (4) feet on
each side of the wall with fire blocking between the
rafters.
B. Multifamily dwellings shall have a one-hour fire
separation between e~ch unit. If trusses are used in the
floor-ceiling assembly, then they shall be protected by
one-hour fire-resistive materials enclosing the entire
truss assembly on all sides for its entire length and
height. Draft stops shall be installed in the attics
above and in line with the walls separating each unit
from another unit. Multifamily dwellings shall be of
Type V One-Hour construction or better.

SECTION 7.
Relationship to Zoning
In the event that the Zoning Ordinance as currently
amended conflicts in any way with the Building Code, then
the Zoning Ordinance sh~ll govern.
SECTION 8.
Sidewalk Requirements
Sidewalks shall be installed on both sides of all collector
and thoroughfare streets. The contractors shall grade and
pour a four-foot-wide sidewalk, four (4) inches in depth,
reinforced with six-inch-by-six-inch number 10 wire mesh or
equivalent. A two-inch sand cushion is to be used for
grading purposes. Where sidewalks intersect at a corner,
the entire radius shall be part of the sidewalk. Sidewalk

installation shall start at the property line and extend
four (4) feet toward the street. In the event that the
prescribed location is prohibitive, the Building Official,
with the concurrence of the Director of Public Works may
specify an alternative location. In subdivisions where
asphalt or concrete parking lots are allowed to be extended
to the street, sidewalks shall be installed as stipulated
above. The sidewalks will be two and one-half (2-1/2)
inches higher than the top of the curb at the property line.
SECTION 9.
Requirements for Drive Approaches
The minimum requirements for a drive approach shall be two
(2) inches of cushion sand; approach must be six (6) inches
in depth at the street and tapered to match the driveway,
reinforced with six-inch-by-six-inch number 10 wire mesh or
equivalent. The drive approach shall start at the property
line and extend to the ~treet, being two and one-half
(2-1/2) inches higher than the curb at the property line.
There shall be a two and one-half-foot radius. The minimum
width shall be twelve (12) feet in residential zones.
SECTION 10.
FEDERAL SAFE DRINKING WATER ACT
A.
Shall require the use of lead-free materials for the
installation and repair of water systems or any
plumbing system providing drinking water.

SECTION 11.
Temporary Occupancy of Streets with Building Material, etc.

Hereafter any person or persons, firm or corporation
desiring to temporarily occupy any portion of any public
I
street, alley or sidewalk within the city for the purpose
I
of placing thereon material or rubbish for or from building
operations, or for any excavation of any area under such
I
street, alley or sidewalk or for any purpose whatsoever
connected with the erection, removal, alteration or repair
I
of any building or other structure, shall apply to the
building official for permission for such temporary
I
occupancy, with the condition that the principal therein

will discharge all claims of every character arising from
or occasioned by such occupancy of such street, alley or
I
sidewalk, or the construction or repair of such bUilding or
the making of such excavation and discharge all judgments

obtained, together with. all costs attached thereto against

the city, by reason of any such claim, injury or damage
sustained; and every person or persons, firm or corporation

carrying on any such excavation or bUilding operation shall
keep all streets, alleys and sidewalks adjacent to such

excavations or bUilding operations carried on by them, in a

provided herein, during such operation; and at the

SECTION 12.
Penalty
Any person who shall violate any provisions of this
ordinance or shall fail to comply therewith or with any
requirement thereof, shall be deemed guilty of a misdemeanor
and shall be liable to a fine, and upon conviction or any
such violation shall be fined in any sum not to exceed One
Thousand ($1,000.00) Dollars.
SECTION 13.
Severability
Should any provision of this ordinance be held invalid or
unconstitutional, the remainder of such ordinance shall not
be deemed to effect the validity of any other section or
provision of this ordinance.

In February, 1988 the Department of Community Development was formed. The department is
responsible for fire inspections for all buildings in North Richland Hills. In the
past, the Building and Fire Codes contradicted each other in many areas and led to
confusion and interpretation problems for all involved in the construction business. In
an effort to simplify the two codes, the Fire Ordinance has been re-written.
Attachment 1 is a summary of the changes incorporated into the new proposed Fire
Ordinance. Generally, the proposed Fire Ordinance is somewhat less restrictive than our
existing ordinance as the new ordinance adopts the uUniform Fire Codeu and deletes many
requirements of the NFPA (National Fire Protection Association). The proposed new Fire
Code is believed to provide adequate fire protection, and will be much easier to
administer in conjunction with the Building Code.
Attachment 2 is the new proposed Fire Ordinance which is submitted for adoption.
Recommendation:
It is recommended that the City Council approve Ordinance No. 1561.

SECTION 1
Paragraph 2 - Currently we operate under the N.F.P.A. Life
Safety Codes. We request a change to the Uniform
Fire Code 1988 Edition. This code is written by the
same organization that writes our Building Codes.
They are designed to work together to compliment each
other and not contradict each other.
SECTION 3
Paragraph 1 - A definition of Ilauthority having jurisdic-
tion.1I As in all codes many approvals of equipment
and materials are left to the authority having
jurisdiction. This definition is not given in the
Codes.
SECTION 5
Paragraph 1 - Transfers authority for Fire Code Enforcement
from the Fire Department to the Department of Community
Development.
Paragraph 3 - Recognizes the Fire Marshal as the enforcing
body of the Fire Prevention Code of the City.
SECTION 15
Paragraph 1 - Sets a fee to be paid by anyone wishing to go
before the Board of Appeals. This was suggested by the
Board of Appeals members as their agendas were growing
longer. This requirement is consistant with Building
Ordinance.
SECTION 17
Paragraph 1 - This will be a deleted section from the
Building Code. This section allows for buildings to be
built to unlimited square footage without being
sprinklered, as long as area separation walls are
installed. Several cities have either adopted this
same policy or are looking at it. It keeps buildings
at a sensible size to handle in case of fire in an
unsprinklered bUilding.

Paragraph 2 - Cleans up the confusion of interpretation of
what a total building is.
Paragraph 3 - This is a clarification of the new Fire Codes
alarm requirements. It is designed to give an alarm
to an outside agency, who in turn calls Police Dispatch
for notification of' a fire alarm through sprinkler
system activation.
Paragraph 5 -
Item 1 - Requires a fire sprinkler system to be
installed in buildings with a gross square footage of
24,000 square feet or more.
Item 2 - Requires underground fire mains to be
installed by a licensed sprinkler contractor. This
is also a State Insurance requirement.
Item 4 - This keeps a fire hydrant within a realistic
area of the fire sprinkler connections of the building.
SECTION 20
Item 2- Changes the size of turnarounds on dead-end
firelanes from 90 feet to 50 feet to correspond
with the Sub-Division Ordinance.
Item 4 - The current Ordinance requires a hard paved surface
around any construction area before construction begins.
The new Ordinance deletes this requirement if the
construction is withi~ 150 feet of a hard paved surface.
This allows for Fire D"epartment access in emergency
situations.
Item 5 - Allows for the Fire Marshal's discretion to be
used in unique situations in enforcing the above
requirement.
SECTION 22
Paragraph 1 - Re-defines the requirements for smoke detectors
in all buildings. This section will require them to
be hard wired into a dedicated circuit of the building.
This has been enforced the last two years, but only by
policy. This will give us some written guidelines to
follow.

SECTION 23
Paragraph 1 - This is a new section to the Ordinances which
deals with guidelines for LP Gas (propane) use in the
City. This is a growing problem that has already
created two critical situations for the Fire Department
to handle during the last two years. LP Gas is not safe
to use in a high density urban area. It was designed
to be used in open rural areas. It is being used to heat
swimming pools instead of electricity for cost reasons.
At the request of pool contractors, the 250 gallon
capacity container is permitted. (Note: Where natural
gas is available in the area, LP Gas will not be
allowed.)
Restricts the delivery of LP Gas into portable
containers on site. This will cause anyone needing
a portable container filled to go to an LP Gas station
to have them filled.
SECTION 24
Sets requirements for above ground storage of flammable and
combustible liquid containers.
SECTION 25
Sets require~ents for addressing of commercial buildings.
Currently being enforced on a policy only.
SECTION 26
Defines a violation for obstructing any fire hydrant in
the City. Sets a minimum clearance distance around all
fire hydrants.
SECTION 27
No. 1
Defines at what point an existing building must be brought
into compliance with current Codes and Ordinances of the
City. There is nothing in the Fire Codes concerning this
at the present time. It is covered for the Building Codes
already.
No. 2
Explains how value will be assessed for Multi-Family
developments with multiple buildings and multiple building
developments of other classifications.
No. 3
Authorizes Fire Marshal to adjust cost of work figures
if inaccurate figures are given in an effort to avoid
the requirements of this Ordinance.

Section 4.
It shall be unlawful for any person to violate this
Ordinance, to permit or maintain such a violation, to refuse
to obey any provision thereof, or fail or refuse to comply
with any such provision or regulation except as variation may
be allowed by the action of the Fire Marshal in writing, or
his designee.
Proof of such unlawful act or failure shall be
deemed prima facie evidence that such act is that of the
owner or other person in control of the premises. Prosecution

Section 6.
It shall be the duty of the personnel assigned to
the Community Development Department to enforce all laws and
ordinances pertaining to Fire Codes of the City of North
Richland Hills. They shall have such other powers and
perform such other duties as are set forth in other sections
of this Ordinance, and as may be conferred and imposed from
time to time by law. The Fire Marshal of the City of North
Richland Hills may delegate any of his power or duties under

this Ordinance.
Section 7.
The Fire Investigation Division shall have the
authority to investigate the cause, origin, and circum-
stances of any fire or explosion involving a loss of life
to persons, or destruction or damage to property.
When in
the opinion of the Fire Chief, or his designee reasonable
cause exists that the fire explosion may have been of
incendiary origin, the Fire Chief, or his designee shall have
the authority to take custody of all physical evidence
relating to the cause of the fire or explosion and to
continue the investigation to conclusion.
Proprietary information which may relate to trade
secrets or processes shall not be made part of the public
record except' as may be directed by a court of law.
Every fire shall ~e reported in writing to the Fire
Investigation Division within three (3) days after the
occurrence of the same by the Fire Department Officer in
whose jurisdiction such a fire has occurred.
Such report
shall contain a statement of all facts relating to the cause,
origin, and circumstances of such fire, the extent of the
damage thereof, the insurance upon such property, and such
other information as may be required, including the injury,
death or rescue of persons.
Section 8.
The Fire Marshal and/or his designee shall be

responsible for the issuance of permitsþ certificates,
notices, approvals, and other orders pertaining to fire
control and fire hazards as provided for in the Code.
Section 9.
The Fire Inspection Division shall inspect or cause to
be inspected all premises as required by the Fire Prevention
Code of the City of North Richland Hills and shall make such
orders as may be necessary for the enforcement of the laws,
ordinances governing the same and for safeguarding of life
and property from fire.
Section 10~
Whenever any inspector, as defined above, shall find
in any building, or upon any premises or other places,
combustible or explosive matter or dangerous accumulations or
rubbish or unnecessary accumulation of waste paperþ boxed
shavings, or any highly flammable materials especially liable
to fire, and which is so situated as to endanger property; or
shall find obstructions to or on fire escapes, stairs,
passageways, doors, corridors, or windows, liable to inter-
fere with the operations of the Fire Department or egress of
occupants in case of fire, he shall order the same to be
removed or remedied, and such order shall forth with be
complied with by the owner or occupant of such premises or
buildings, subject to the appeals procedure provided for in
the Fire Prevention Code of the Uniform Fire Code.
Any owner or occupant failing to comply with such
order within a reasonable period after the service of the

Section 11.
The Fire Support Division of Investigation shall
compile and record of all fires and of all facts concerning
the same, including injuries, rescue of persons and
statistics as to the extent of such fires and the damage
caused thereby, and whether such losses were covered by
insurance, and if so, in what amount.
Such record shall be
made daily from the reports made by Fire Department personnel
under the provisions of this Ordinance.
All such records
shall be open to the public.
Section 12.
The City Manager, Fire Marshal or Fire Chief of the
City of North Richland Hills shall also recommend any amend-
rnents to the Fire Prevention Code of the City of North
Richland Hills or Ordinance which, in his judgement shall
be desirable.
Section 13.
The provisions of the Fire Prevention Code of the
Uniform Fire Code shall apply to all structures and their
occupancies, except as otherwise specified.
Section 14.
This act shall be deemed an exercise of the police
powers of the City of North Richland Hills for the
preservation and protection of the public health, peace,
safety, and welfare, and all provisions of the Fire

Section 16.
It shall be in violation of this Ordinance to use any
wood shingles as part of the construction material on
structures classified as multi-family (including duplexes) or
commercial buildings.
All single family dwellings using wood shingles or
shakes shall be factory pressure treated with a fire
retardant chemical to meet class C fire resistant
requirements of the National Fire Protection Association
No. 256.
Existing wood shingles or shake roofs may be repaired
with wood shingles or shakes providing the area repaired does
not exceed twenty-five percent (25%) of the entire area of
the roof, otherwise the entire roof shall be replaced with
material specified in the code.

Any apartment, condominium, hotel, motel, or townhome,
three or more stories in height or more than thirty-five feet
elevation from finished floor level shall be equipped with a
fire protection sprinkler system that meets the minimum
standards of N.F.P.A. Standard l3,13D OR l3R as applicable.
1. The system shall be installed on all floors of the
. building.
2. The sprinkler heads installed in occupied areas of
the structure shall be fused at 165 degrees
Fahrenheit unless otherwise approved by the Fire
MARSHAL.
3. Any Multi-Family structure over thirty-five feet
in height shall be equipped with a sprinkler
system that meets the requirements of N.F.P.A.
Standard 13,13D OR 13R as applicable.

Section 18.
Any residential occupancy having a living area below grade
level shall have two (2) means of egress, one of which shall
have a door leading directly to the outside of the structure.
Stairways and ramps leading from outside the exit to grade
level shall conform to the Uniform Building Code,Chapter 33.
Any means of escape into any portion of the living quarters
shall be protected by a twenty (20) minute rated fire door at
the top of the stairs leading out of the basement.
This provision of the Fire Prevention Ordinance will include
structures or parts of structures which may be converted
to living areas in the future.
Section 19.
Any occupancy used for group A, group B, group E,
group H, or group I shall be separated from the other occu-
pants or businesses in the same building by construction
having a fire resistive rating of not less than one hour.

Section 21.
Any motor vehicle, vehicle or combination thereof,
which is designed to carry or transport a cargo or payload
considered a hazardous material by the Uniform Fire Code
that is loaded or unloaded is prohibited from parking
within 150 feet of any and all structures, buildings, public
thoroughfares, railroads, and is also prohibited from parking
on city streets or in residential areas of the City of North
Richland Hills, Texas unless said vehicle is in the process
of loading or unloading its cargo or payload.

material vehicles shall not be parked in public garages.

Any person who shall violate any of the provisions of
the Code hereby adopted; or shall fail to comply therewith;
or shall violate or fail to comply with any order made
thereunder; or shall build in violation of any details,
statements, specifications, or plans submitted or approved
thereunder; or shall operate not in accordance with the
provisions of any certificate, permit, or approval issued
thereunder, and from which no appeal has been taken; or who
shall fail to comply with such order as affirmed or modified
by the Fire Marshal and/or the City Manager, or by a Court of
competent jurisdiction within the time fixed herein shall
severalty for each and every violation and noncompliance,
respectively, be guilty of a misdemeanor punishable by fine
not less than $50.00 nor more than $200.00 for fire lane
violation; providing for a penalty or fine not less than
$50.00 nor more than $2000.00 for violation of any other
portion of Ordinance No.
The imposition of a penalty for any violation shall
not excuse the violation nor shall the violation be permitted
to continue. Each day the violation exists constitutes a new
and seperate violation. All such persons shall be required to
correct or remedy such violations or defects within a reason-
able time, and when not otherwise specified, the application
of the above penalty shall not be held to prevent the enfor-
cement or removal of prohibited conditions.

As we have discussed, the City of North Rich1and Hills needs
·to acquire right-of-way off of the south boundary of your
property as referenced above.
The City hereby further agrees to build or provide, at the
City's cost, a 12 foot drive entrance from Starnes Road into
your property. This paved entrance will extend approximately
10 feet deep from the new curb line to the new property line.
The entrance will be as nearby as possible in the center of
your 365' of frontage on Starnes Road.

The staff negotiated with Rocky Q. Turner and Gwendolyn Turner to purchase right-of-way
from their property that sides on Smithfield Road and fronts on Redwood Court. The
negotiated price as determined by an appraisal is $9,900. The following is a
breakdown of this figure per the appraisal.

The appraisal evaluated the damage to the property by determining the market value of
the property before the taking and the market value ~fter the taking and calculating
the difference. The right-of-way taking will damage ~the property because the existing
house with the new property line will be in noncomplíance with the corner lot side
building line set back.

The Turner property is mortgaged to Independence One Mortgage Company. Independence
One must co-sign the ROW instrument and agree to a partial release of the property.
The processing fee charged by Indpendence One is $100.
I ~hiS right-of-way acquisition was brought to Council previously on June 13, 1988 for
approval at $1,457.28. Before payment could be made, the mortgage note was sold to a
new company, Independence One Mortgage Company. They would not agree to the payment
amount of $1,457.28 and requested an appraisal.

Recommendation:
The staff recommends approval of payment for right-of-way on Smithfield Road to
Rocky Q. Turner and Gwendolyn Turner in the amount of $9,900 and $100 to Independence
One Mortgage for partial release application fee for a total amount of $10,000.

In the process of widening and improving Watauga Road from Rufe Snow to Davis Boulevard,
an existing Lone Star Gas metering station needs to be moved. The City Attorney .has
determined that the City must pay for the gas facilities to be relocated, in
consideration for which Lone Star Gas will sign a release to any rights to their
lease area which is within our Watauga Road right-of-way. The estimated cost of
this construction is $35,030.

Although sufficent funds are presently available in the construction account for
Watauga Road, this was not an anticipated cost of construction and may require future
appropriation of funds once the final construction contract cost is known, including
any other unanticipated costs. It is proposed to expense this cost as indicated below:

The two low bids are both below the budgets for paving, drainage, water, and
sewer improvements. The low bidder, Austin Paving, is $188,691.36 below the
total budget, and the second low bidder, J.L. Bertram, is $178,382.86 below
the total budget. Austin Paving is $10,308.50 below J.L. Bertram's bid. Ve
would recommend that the present budgets be maintained for possible change
orders and extra work which may be required.
Ve would note that several existing utilities owned by Southwestern Bell
Telephone Company, Lone Star Gas Company, TU-Electric Company, ahd Sammons
Cable Communications Company, may require relocation or adjustment, and such
work has not yet been performed. The contractor will be required to perform

all non-conflicting work in this contract first until such utility conflicts
have been resolved. Delays to the contractor due to utility conflicts shall
be cause for extension of contract completion time but not cause for extra
compensation to the contractor. Both of the two low bidders bid 260 Calendar

After much deliberation and investigation of the many proposals we received for our golf
course, we recommend RDM, Ltd.
1) A Management Agreement to supervise the design and construction of the course.
We would receive bids and award all construction contracts, and pay all
invoices from proceeds of Certificate of Obligations.
2) A five year contract with a three year cancellation clause to manage the golf
course. There is a management fee which increases each year. There is also a
contingent management fee based on gross revenues when they reach 75% of
revenue projections.
3) We receive all net profits after debt service for the City and RDM.
Attached are the following:
1) Ten year income and expense projections. Green fees are proposed to be $15
week days, $18 holidays and weekends. Cart fees are proposed to be $16 for 18
holes - and $9 for 9 holes.

2) Source and use of funds for the "Hills of North Richlandu Golf Course. We
propose to fund and operate the water wells from our Water Department.
There are numerous details to be addressed in our contract with RDM, Ltd. and we are
proceeding with these.
Recommendation:
It is recommended the City Council award the contract to RDM Ltd.

This CIP project was awarded by the Council on July 13, 1987 for $678,407 to Olmos
Equipment Company, Inc. Due to change orders which in effect reduced the overall
project costs, the final cost of work completed is $673,788.19. Assessment of
liquidated damages amounting to $5,400 for not meeting adjusted contract completion
date reduces the final total to $668,388.19. Based on this figure and subtracting
previous payments, the final payment due the contractor is $28,357.66.

Enclosed is one copy of Contractor's Final Pay Estimate No. 11, dated
August 3, 1988, made payable to Olmos Equipment Co., Inc., in the amount
of $28,357.66, for materials furnished and work performed on the
referenced project as of July 29, 1988.
The quantities and condition of the project have been verified on-site by
your representative, Ken Matheson, as indicated by signature on the
estimate, and we have checked the item extensions and additions.
This project includes construction of concrete riprap slope protection
along a portion of the west bank of Big Fossil Creek north of Broadway and
south of Bewley Drive. The original bid amount for this project was
$678,407. Final Contractor earnings, including change orders, totals
$668,388.19 which is $10,018.81 below the bid amount and $130,611.81 below
the budgeted amount of $799,000.
In accordance with Section 3.2.11(a) of the Contract, the two (2) year
term of maintenance will begin on this date, and therefore, will terminate
on August 5, 1990. The maintenance obligation includes repair of any
riprap cracks, buckling or other failures, along with failures of any
storm drain pipes or other facilities constructed as part of this
Contract.
The original Contract completion date was December 1, 1987, but this time
was extended due to weather problems, design modifications, and other
factors beyond the Contractor's Control. The Public Yorks Department has
determined that based on the permissible time extensions, the Contractor
is eighteen (18) days over the adjusted Contract completion time and has
therefore been assessed $5,400.00 in liquidated damages at $300 per day in
accordance with the provisions of Section 3.2.12 of the Contract
