Mayor Echols opened the Public Hearing and called for anyone wishing to
speak in favor of this request to please come forward.
Mr. Mark Shelton, Engineer, representing MGM Development, appeared before
the Council.
Mr. Shelton stated they were currently constructing two-story attached
garden homes ranging from 1,100 to 1,500 square feet per unit. Mr.
Shelton stated they were proposing zero lot line detached garden homes.
Mr. Shelton stated he felt this zoning was keeping with the current
lifestyle in the area. Mr. Shelton stated the only reason for the R-8
zoning was because the duplex market had bottomed out and they believed
this type of zoning and homes would be more marketable at this time.
Councilman Fisher asked why the duplex market was soft and the zero lot
line home was more attractable.
Mr. Shelton stated they had received a lot of positive response to
detached garden homes.
Councilman Ramsey asked how many duplex lots were left.
Mr. Shelton stated approximately 40 lots, which would be 20 buildings.
Mayor Echols called for any opposition to this request to please come
forward.
There being no one else wishing to speak Mayor Echols closed the Public
Hearing.

Mayor Echols advised that when the proposed propositions were cleared with
the Justice Department, a copy would then be sent to all the citizens of
North Richland Hills and an election would be held November 3rd.
Councilman Ramsey expressed his appreciation to the Chairman and members
of the Charter Commission.
Motion carried 6-0.

GN 87-23 REGULATING SMOKING IN PUBLIC PLACES,
ORDINANCE NO. 1445
POSTPONED
Councilwoman Moody moved, seconded by Councilman Garvin, to postpone
action on Ordinance No. 1445 until the April 13, 1987 meeting so certain
sections that were not clear could be rewritten.
Motion carried 5-1; Councilwomen Moody and Hinkle and Councilmen Fisher,
Ramsey, and Garvin voting for; Mayor Pro Tem Davis voting against.

Mr. Steve Stevens, President, Town & Country Food Store, appeared before
the Council.
Mr. Stevens requested the Council grant him permission for a curb cut on
Davis Boulevard leading into his property.
Mayor Echols advised Mr. Stevens to get with Mr. Royston and the other
property owner to the north on constructing a curb cut suitable for both
owners.

Over the past several months the Staff has had occasion to deal with several property
owners in residential neighborhoods regarding the location and construction of accessory
storage buildings. In some of these cases there was obvious confusion as to what
constituted a portable accessory building. what was classified as a permanent accessory
building and how the various controls, yard requirements, brick construction,
foundations, lack of foundations and etc. were to be applied. To deal with these
confusions the Staff drafted a proposed Zoning Ordinance revision to include a specific
definition for hoth permanent and portable accessory buildings and to set the minimum
construction criteria for each type. In addition the requirement is included that all
accessory buildings must be permitted and must submit to a stake-out inspection to
verify that the proposed location will meet the location criteria of the Ordinance.
RECOMMENDATION:
The Planning and Zoning Commission recommended that the proposed revision to the Zoning
Ordinance regarding the definition and administration of accessory buildings be
approved.

ORDINANCE NO. 1449
BE IT ORDAINED by the City of North Richland Hills, Texas,
that Ordinance No. 1080 (Zoning Ordinance), adopted January 9, 1984
and as heretofore amended, be and the same is hereby amended at the
following section:
a. Subsections 4.5.7, 5.5.7, 6.5.7, 7.5.8, 8.5.9, 9.4.12, and
10.4.8 be revised as follows:
"ACCESSORY BUILDINGS: See Section XXIV, Subsection 24.7."
b. SUBSECTION 24.7 SHALL BE DELETED IN ITS ENTIRETY AND
REPLACED WITH THE FOLLOWING:
24.7 ACCESSORY BUILDINGS
24.7.1 DEFINITIONS
ACCESSORY BUILDING is any structure used or intended for a
secondary or supporting use to the main structure, residence
or occupancy.
PORTABLE ACCESSORY BUILDING is any structure that meets the
following criteria: (i) does not exceed (120) one hundred
twenty square feet in total area; (ii) does not exceed (10)
ten feet in height measured from grade level to the highest
point of the structure; and (iii) is not permanently
attached to a concrete slab, foundation or to the ground.
PERMANENT ACCESSORY BUILDING is any structure that is
permanently attached to a concrete slab, foundation or the
ground. If the permanent accessory building does not fall
under the definition of a carRort in Section III, then
regardless of size it shall conform to the brick
requirements of this Ordinance.

24.7.2 REQUIREMENTS
All accessory buildings are to be permitted through the
Building Department. A site plan showing where the
accessory building is to be placed with dimensions shall
accompany the application for permit. Accessory buildings
shall only be placed in the rear yard. A portable accessory
building may be placed in any rear yard with a maximum of
(2) two per lot. A permanent accessory building shall not
be placed in a minimum required rear yard. All accessory
buildings are subject to Building Line requirements, City
Building Codes, and City Ordinances. All accessory
buildings are required to submit to a stake-out inspection
prior to installation to insure compliance with the Building
Line requirements of the Zoning Ordinance.

This Replat Application is presented for consideration of Lot llR-l, Block 29, Richland
Terrace Addition. The property is located on the south side of Loop 820 at the
intersection of Marilyn Lane. The purpose for the proposed replat is to combine the
four existing residential lots into a single tract. The applicants, First Church of
Christ Scientist, of North Richland Hills, have recently purchased the property and wish
to construct a church building on the subject tract.
In reviewing the proposed plat the Staff noted several items for Commission
consideration.
A) The subject property has a split zoning. The existing Lots llR through 13R are
currently zoned 'R-5D Duplex while Lot 14R is zoned R-2 Single Family. This zoning
configuration will not hinder the development of the proposed church.
B) The proposed Replat indicates a ten foot utility easement bisecting the lot.
The City currently has a six inch sanitary sewer main in that easement. The easement
cannot be released nor can there be any structure constructed on the easement. The
applicants have been made aware of the requirements of the easement and have stated that
the existing conditions will not create any difficulty with the proposed church project.
C) The applicants were required to provide engineering plans for the installation
of an additional water main along the Loop 820 Service Road in order to provide proper
protection for their project. Installation of this water main has been approved by the
State Department of Highways and Public Transportation as well as the City.
D) The Commission also noted that the front building line along the Marilyn
frontage currently has an off-set from 15 to 25 feet because of the split zoning
configuration.
RECO:MMENDATION:
The Planning and Zoning Commission approved the Replat of Lot 11R-l, Block 29, Richland
Terrace Addition with the stipulation that the front building line along the entire
length of the Marilyn Drive frontage be 25 feet.
After consideration of their proposed site layout and the building plans for the Church
the applicants would like an opportunity to discuss with the City Council the
stipulation of the Planning and Zoning Commission regarding the 15 foot building line on
Marilyn Lane.

Engineers came forward. He stated he
was here to represent the Building
Committee in their request.
Chairman Bowen said the only problem
he has is the split building line of
25 feet and 15 feet. He said it
needs to be a 25 foot building line.
Mr. Martin stated he would correct
that.

stated there are two zonings on this
property and a church is allowed in
this area. Chairman Bowen stated that
no protest would be heard against the
church but if there was opposition to
the replat to please come forward.
Susan Foster came forward. She asked
what is planned for the area. She
said all she knew was there was a sign
up on the property.
Chairman Bowen said they plan to build
a church there and a church is allowed
in duplex and residential zoning.
Ms. Foster asked what kind of
structure do they plan to build.
Chairman Bowen said they did not
submit any plans. He said this is
only a replat.
Mr. Royston stated the church has four
lots they are combining into a single
tract.
Ms. Foster asked what benefit it would
be.
Chairman Bowen said you cannot build
over a lot line.
Ms. Foster asked if they have any
plans as to what they are going to
build.
Chairman Bowen said they will be able
to build any building they wish as
long as it meets the city codes.
Arlene Tinkler, 7304 Marilyn Lane,
came forward. She asked if there
would be enough room for the building
and for enough parking.

Ms. Tinkler asked what they were.
Mr. Royston stated it was one parking
space for each three seats.
Ms. Flippo stated the area is
approximately 3,000 feet short of an
acre.
Ms. Tinkler asked how much do they
have on Marilyn Lane.
Ms. Flippo stated there was 137.33
feet plus 135 feet on Marilyn Lane and
216 feet on 820. Ms. Flippo gave Ms.
Tinkler a copy of the plat.
Chairman Bowen closed the Public
Hearing.
Mr. Schwinger made the motion to
approve PS 87-2 subject to the
realigning of the building line. This
motion was seconded by Mr. Hallford
and the motion carried 5-0.
Chairman Bowen stated the plat complies
with the Subdivision Ordinance and
must be approved.

Dear Mrs. Calvert:
Attached please find a copy of the engineering plans for the
above referenced replatting. We have reviewed the engineer's
comments and have the following additional information regarding
these comments:
1. The replat has been signed and sealed by a registered public
surveyor and is being forwarded under separate cover.
2. The Owner's Acknowledgement Dedication Statement and Notary
Certification is being executed and is being forwarded under
separate cover.
3. Copies of the engineering drawings and an application have
been forwarded to Mr. Richard Royston for further submittal
to the Texas Department of Highways and Public Transporta-
tion for a permit to construct a water line within the Loop
820 right-of-way.
4. The archi tect has been advised that special building con-
struction and controls will be required in the construction
of site improvements.
5. The most current site plan indicates that the building will
not be constructed over the existing sewer line which
extends through the replatted area. This fact has also been
brought to the attention of the architect.

6. The general note referring to a force main has been deleted
from the plans.
7. A review of the Texas Department of Highways and Public
Transportation construction plans and drainage calculations
for Loop 820 indicates that the replatted area will drain to
two different curb inlets along the service road of Loop
820. Utilizing an increased coefficient of runoff of O. 8
for the replatted area, the additional runoff to each of the
two curb inlets affected will be less than one cubic foot
per second. The 24" laterals from these inlets have
additional capacity which will satisfactorily absorb this
increase in runoff.
8. The owner has been made aware of this letter and the general
policies and procedures of the City of North Richland Hills
regarding platting and construction of public facilities.
We hope this submittal will satisfy the City's administrative
requirements regarding the submittal of this project for
replatting and look forward to final approval of the replat. If
you have any questions or need additional assistance in this or
any other matter, please do not hesitate to call.

We have reviewed the referenced materials for this subdivision and offer the
following comments:
1 The proposed Replat should be signed and sealed by a Registered Public
Surveyor.
2 The Owner's ACknowledgement and Dedication Statement and Notary
Certification should be fully executed before approval of this Replat.
3 These plans should be submitted to the State Highway Department for
review and approval since proposed water utility construction will be
located within the I.H. 820 right-of-way. Also, any other construction,
such as driveways within the highway right-of-way should be approved by
the S.D.H.P.T. All permit forms submitted to the Highway Department
should be first submitted to Richard Royston for approval.
4 The existing zoning for this proposed church site is R-5-D and R-2. We
understand that the property does not have to be rezoned to U District,
but since the proposed construction is in a residentially zoned area,
additional building controls will be required. Also, we further
understand that a public hearding must be conducted because of the
residential location. See Richard Royston for more details in this
regard.
5 The water and sanitary sewer grid maps for the city shm.¡s an existing 6"
sanitary sewer line in the approximate center of the proposed replat area.
According to the Subdivision Ordinance, no building of any kind shall be
constructed over an existing sanitary sewer main or lateral unless the
line is replaced with a heavy cast iron pipe. However, to provide easier
access to the sanitary sewer for maintenance purposes it is reccommended

that this line be relocated. The relocation must be done under city
supervision and the developer must furnish easements and right-of-ways as
may be required to accomplish construction of the relocation or
replacement. Plans for relocation or replacement should be submitted for
review.
6 A comment on sheet 1 of 1 under general notes states that at station 1+15
a 12" force main and lift station is to be relocated. This note probably
doesn't apply to this replat for the new church site, and if not, it
should be removed from the plans. We are not aware of an existing lift
station in this vicinity.
7 A drainage plan and calculations are not normally required for a replat,
however, the proposed development increases the amount of impervious
surface in the subbasin thus increasing the coefficient of runoff from
about 0.5 or 0.6 to 0.8. Since this higher coefficient raises the peak
discharge, the existing drainage structure (60-inch pipe in highway
R.O.W.) may not have been designed to handle this flow. A drainage
analysis for a 5 year storm should be performed for this area as required
to verify that the existing downstream drainage system will not be
excessively overloaded. The developer's engineer may wish to consult with
the Highway Department on this matter.
8 As a general reminder, the Developer or Owner should be made aware that
he is responsible for all provisions of the Subdivision Ordinance, Zoning
Ordinance, Water and Sewer Policies and Procedures, and all other
applicable City Development Codes unless specific discretionary variances
and exceptions are made and agreed upon by the Planning and Zoning
Commission and City Council, and covered in writing in the City-Developer
Agreement, if this proposed replat is approved. If no such specific
variances are provided then the Developer or Owner remains responsible for
all other Ordinance and Policy requirements as written in the regulatory
codes.

Agenda Number:
Mr. Cal Herron, National Display Systems, representing North Hills Mercury Lincoln has
requested a hearing before the City Council to request approval of a new dealership sign
for North Hills Mercury Lincoln at 7820 N. E. Loop 820. The applicants propose to
replace the existing ground sign at the dealership with a new facility. The proposed
sign would be in compliance with all the criteria of the Sign Ordinance with regards to
the size and location of the sign. However, the applicants have proposed the inclusion
of an electronic message center in the design of the new sign. Under the terms of
Section 5.7 of the Sign Ordinance all message signs must be specifically approved by the
City Council.
RECOMMENDATION:
It is Staff's opinion that the proposed sign may be approved should the City Council
choose to do so. Although the Ordinance does not specify any particular type use for
these signs, those businesses which have been previously approved for the message center
type sign have been in the Bank or Savings and Loan trade.

Thank you for your letter of August 26th regarding the
above. You advise that Sgt. Barbara Stewart was present in the
Birdville Independent School District and the City of North
Richland Hills solely due to military orders. As such, under
Section 514 of the Soldiers' and Sailors' Civil Relief Act, 50
U.S.C. App. S574, she is not subject to the imposition ot ad
valorem personal property taxes. Based upon your letter, and
upon research done by our firm, I am recommending cancellation of
the personal property tax assessments by the Birdville
Independent School District and the city of North Richland Hills.

RESOLUTION NO. 87-14
WHEREAS, Tarrant County, Texas, is conducting a bond election on
April 4, 1987 for consideration of the passage of the Criminal Justice Bond
Package in the amount of 114 Million Dollars; and
WHEREAS, the City Council of the City of North Richland Hills,
Texas, supports the improvement of the County's criminal justice system
that the passage of the Criminal Justice Bond election would aid;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
North Richland Hills, Texas, that the City Council hereby supports the
passage of the Criminal Justice Bond Package to be presented to the voters
of Tarrant County, Texas, at an election held on Saturday, April 4, 1987.

On April 2, we have tentatively scheduled a press conference to annouce the county-
wide support of this much needed bond package to build new jail space, courts, a
crime lab and medical examiners office and provide services for abused children.
We are hopeful that 100% of the city councils in Tarrant County will embrace the
Criminal Justice Bond Package with the attached endorsement resolution (or a similar
resolution).
We also are asking that the city councils help distribute voter awareness posters
which we will have available beginning March 22, 1986. And that all interested
individuals, companies, corporations and groups in your area be encouraged to con-
tribute (if possible) to help with our voter awareness efforts.

March 30, 1987.

with a resolution and for assistance with informing your local news reporters of your

Dear Mayor and Council Members:
Tarrant County is declaring war.
This is a war against crime, against criminals, against
destruction of our property and businesses and against our own
personal safety. There is a battle waging in our neighborhood.
It's the criminals versus us.
We must win this battle if Tarrant County is going to
economically survive the next decade. We need your help.
On Saturday, April 4th, Tarrant County voters will have the
opportunity to vote for the "Criminal Justice Bond Package."
There are five propositions on the ballot to authorize; 1) a
$59.5 million bond for the construction of a new jail; 2) a $45
million bond for the construction of a new criminal courts build-
ing; 3) a $4 million bond for the renovation of the crime lab and
medical examiners' facility; 4) a $2.5 million bond for renova-
tion of the civil courts building; and,S) a $1 million bond for
the construction of a child protection services building for
battered and abused children.
The bond package will be a major step for the County in its
battle against crime. The new jail will relieve the overcrowding
we are currently experiencing. The court buildings will help
relieve a backlog of over 5,000 cases left over from 1986 and
meet the enormous increase of cases expected in the future. The
new crime lab will allow Tarrant County to process its own samples
and discontinue having to rely on the Dallas crime lab. And
finally, the county will have its own department to deal with
the epidemic of abused children.

In July, the FBI will be releasing their findings in the
national Uniform Crime Report for 1986. In a nationwide ranking,
Fort Worth will be listed as number one in per capita crime, for
urban areas with a population over 100,000. This report is going
to effect every person in the county. But then so does crime.
Every six minutes a crime is committed in Tarrant County.
Every hour and a half an assault takes place; every 12 hours a
forcible rape; and, every 36 hours, a murder. It is also esti-
mated that we will have over $120 million dollars worth of pro-
perty stolen during 1986. Theft has doubled in the last two
years.
Our reputation as a high crime area has already s~ead
too far. The county is having difficulty attracting new busi-
nesses. People are becoming more and more afraid to live here.
We must reverse this trend.

We know, of course, that if we could reduce crime, Tarrant
County would be the most desirable place to live in Texas. We
have every convenience and economic resource of a larger urban
area but have still been able to maintain the feeling of "small-
town" neighborhoods. We also have the lowest taxes of any major
county in the state.
We don't want to change any of our good qualities. And we
won't. But we must fight against the one situation that could
rob us of everything we have - crime.
There is a way.....
We are waging a campaign to pass the "Criminal Justice
Bond" election. Even though every resident of our county real-
izes we have a crime problem, few know that there is something
they can do about it. Many businesses and individuals like you
believe so strongly in this fight, that they are financially
contributing to this campaign.
We are still short of funds. We need to raise another
$106,000 to successfully complete a targeted voter contact and
turn out program for the April 4th election.
We are asking that you join us in writing a check to the
Bond Committee today. There is enclosed an envelope and a reply
card for your convenience. Please do not put it down and do it
later. We must be on television and radio by next Tuesday but
the stations need to be paid before then. There are only three
weeks before the election.
If you have any questions about the bond election, please
call us and we will try to answer them for you. But if not, we
urge you to help us on this project as soon as possible.

like you are rare these days. It's discouraging to have to
constantly ask the same people to help all the time. But as a
leader in the community you know how important this issue is to

CRIMINAL JUSTICE BOND SUMMARY
On Saturday, April 4, 1987, Tarrant County will hold an
election to decide if voters will approve a $114 million ex-
penditure and pass the "Criminal Justice Bond Package." The
ballot propositions allow voters to support separate initiatives
for the issuance of $59.5 million for the construction of a new
jail, $47 million for the construction of a new criminal courts
building, $4 million for the construction of a new crime lab
and medical examiners' facility, $2.5 million for renovation
of the civil courts building, and $1 million for construction
of a child protective service department for battered and abused
children (the State will match the county with a $1.5 million
appropriation) .
If passed, the new jail will alleviate the overcrowded
jail currently in use. The 25 year old facility has a capacity
of 1,200 beds but has held an average of 1,600 prisoners for
the last several months. The proposed jail will increase the
capacity with an additional 1,254 beds. It is planned to be
located on 40 acres in North Fort Worth near the Lynn W. Ross
Juvenile Center on Kimbo Road. The plans for the new jail will
follow the recommendations of the Tarrant County Criminal Jus-
tice Task Force. The new criminal courts will be located in
the downtown court corridor on the site currently occupied by
Fort Worth Billiards Supply Company. The phase that will be
completed from this bond will meet the county's needs for the
next seven years and has expansion capabilitites for potential
future needs.
The $114 million bond the county is asking voters to approve
will cost the owner of a $70,000 home approximately $11.55 a year
or $.96 a month in additional county taxes. The owner of a
$100,000 home will pay about $16.50 or $1.38 a month.
Due to widespread concern of the deteriorating condition of
the criminal justice system, the bond package has remained uncon-
troversial. It is endorsed by every bar association in the
county, the Mayors of all 36 cities in Tarrant County, the
Tarrant County Republican and Democratic Chairmen as well as num-
erous business and civic organizations. County Judge Roy English,
John McMillan and Kay Day are serving as the bond committee's
co-chairmen.
To pass the bill, the committee has implemented a campaign
utilizing a targeted direct mail, electronic media and grass-
roots organization. Its widespread appeal has encouraged.
volunteers to aid in the distribution of posters and literature.
A projected budget of $150,000 - 200,000 will be needed
to complete the campaign.

Mr. Khasrow Yazhari of 2308 Farrington, Hurst, Texas has filed an appeal with the City
Council requesting a hearing of the ruling of the City of North Richland Hills Board of
Appeals regarding the Notice and Order to demolish and remove the dwelling structure
located at 7000 Davis Boulevard, North Richland Hills, Texas.
CHRONOLOGICAL HISTORY OF 7000 DAVIS BOULEVARD
March 6, 1986. The North Richland Hills Fire Department notified the Code Enforcement
Officer, that a dangerous situation exists at 7000 Davis Boulevard and the electrical
power should be pulled at this location due to excessive vandalism to the structure.
March 28, 1986. The Code Enforcement Officer sent a letter of the State of Condition to
Mr. Yazhari and requested that the situation be remedied.
March 31, 1986. The Code Enforcement Officer notified Mr. Yazhari that the Building
Official had deemed the structure to be a dangerous building and ordered that repairs or
demolition be undertaken.
April 27, 1986. Mr. Yazhari filed for an appeal of the order for repair or demolition.
That appeal was not processed by the Code Enforcement Officer.
Photos of the structure were taken by the Code Enforcement Officer.
December 9, 1986. A second letter was sent ordering the demolition of this structure.
The applicant was informed that if an appeal was to be made before the Building Code
Board, a letter should be sent to the Building Official within 30 days.
February 6, 1987. Mr. Yazhari filed an appeal with the Planning Department almost one
month past the 30 day deadline indicated in the letter. The Staff authorized the hearing
of the appeal and scheduled a hearing for March !O, 1987.
February 26, 1987 and March 3, 1987. Two letters were sent by regular mail notifying Mr.
Yazhari of the Board of Appeals meeting.
March 10, 1987. The Board of Appeals held a hearing and after taking evidence and
testimony by Lt. Don Andrews, North Richland Hills Fire Department, and Ken Miller, Code
Enforcement Officer, they ruled that the structure be demolished and removed from the
premises. Mr. Yazhari did not appear at this meeting. The Board established a time
limit of 30 days in which the applicant must begin the demolition. The Board also set a

deadline of March 18, 1987 for the applicant to file an appeal of their decision to
the City Council.
March 11, 1987. The Building Official sent a Notice and Order for demolition of the
structure stating the time limits and appeal process.
The Fire Department has made several fire calls and Lt. Don Andrews has made arrests
at this location. The latest fire was March 9, 1987 and arrests were made on March
10, 1987 of three juveniles.
The North Richland Hills Police Department made four calls to this location in 1985,
sixteen calls in 1986 and five calls this year.
Attached are photographs of the subject building.
Recommendation:
It is the Staff's opinion that this location is an attractive nuisance and a dangerous
situation exists presenting a hazard to life safety. The Staff believes that the
structure is beyond restoring and that Mr. Yazhari has not made an attempt to take
care of the property in the last twelve months. It is recommended that no additional
time be granted for demolition.

committee consisting of: Director of Public Works; Gene Riddle, Director of Support

Senior Buyer; Kane Kelly. The results of the committee's evaluation is as follows:

* Bucket size is considerably smaller than required by our street department. Larger
bucket is not available if boom extension is specified.

excavator for the following reasons:
* Did not demonstrate a boom extension. Vendor stated he was not advised the
demonstration required the boom extension. However, the City specified an 8 ft. boom
extension and informed all vendors by memo specified unit would be required for
demonstration. Vendor #4 was allowed another opportunity to demonstrate the boom
extension.
* Demonstated unit, without required extension, vibrated violently.
* The vendor declined the opportunity to demonstrate stating the factory would be unable
to provide the 8 ft. boom extension for several weeks and at an additional cost to the
vendor.

In a study conducted by purchasing, a dozen Badger users were contacted and not one of
them had an 8 ft. boom extension on a 666 excavator as was bid to North Rich1and Hills.
Only one (City of Dallas) had an 8 ft. extension and it was specified for a larger more
expensive model ( an 888, 172 ft. wheelbase as opposed to the 666, 150 ft. wheelbase).
