Adjournment CITY OF NORTH RICHLAND HILLS Department: Purchasing - Council Meeting Date: 9/14/87 New Recreation Center Agenda Number: During the tour of the new City facilities on Saturday, August 22, 1987, some concern was expressed about the appearance of the Recreation Center carpet, walls, and the lack of window coverings throughout the complex. The carpeted walls on the second floor will be removed and the walls textured and painted, at a cost of $3,456.00. Mr. Line has authorized the Director of Support Services to proceed, and this project will be completed before the grand opening, September 26, 1987. In addition I have obtained the cost of recarpeting and blinds as outlined below: RECREATION CENTER First Floor Carpet and Pad (9,378 sq. feet) $21,875 Second Floor Carpet with Pad (3,978 sq. feet) $ 9,272 Mini Blinds for Library and Park's Offices $ 6.269 $37,416 Recommendation: Council advise what their wishes are in regards to carpeting and window coverings for the new Recreation Center and Library. """ ".,.~ - CITY OF NORTH RICHLAND HILLS Finance Department: 9/14/87 Public Hearing - Ad Valorem Tax Rate Increase Council Meeting Date: Agenda Number: GN 87-91 In accordance with the State Property Tax Code, the City Council must hold a public hearing in order to give citizens an opportunity to speak on the Ad Valorem Tax Rate Increase. Notice of the public hearing was published in the official newspaper on Sunday, August 30, 1987. 1987 Effective Tax Rate $.38457 per $100 of value 1987 Proposed Tax Rate .41300 per $100 of value Percent Increase 7.38% Calculation of the 1987 Effective Tax Rate and an Ad Valorem Tax History is attached. The following is proposed as a guideline in conducting the public hearing: 1. Open public hearing allowing all interested citizens to speak pro or con. 2. Close public hearing after all interested citizens have been given the opportunity to speak. 3. Set the date for final adoption of the tax rate. The date should be between three and fourteen days from the public hearing. Mayor Echols presented Mr. Ed James with a proclamation for helping the City of Saragosa after the tornado. 6. SPECIAL PRESENTATION OF GREEN THUMB AWARD BY NORTHEAST TARRANT COUNTY CHAMBER OF COMMERCE Ms. Wanda Strong, Chainman, Project Pride Committee of the Northeast Tarrant County Chamber of Commerce, presented the Green Thumb Award to Ground Crew Inc. for the landscaping and maintenance of Cambridge Property located at Loop 820 and Rufe Snow. 7. REMOVAL OF ITEM(S) FROM THE CONSENT AGENDA Councilman Davis removed Item No.9 and Councilwoman Spurlock removed Item No. 16. . 8. PS 87-12 REQUEST OF LAMAR SAVINGS ASSOCIATION AND TECHNOL COMPANY FOR REPLAT OF TRACTS 4, 5, AND 6, NORTH RICHLAND HILLS INDUSTRIAL PARK ADDITION (LOCATED ON INDUSTRIAL PARK DRIVE EAST OF RUFE SNOW DRIVE) APPROVED Mayor Echols stated that the Planning and Zoning Commission approved the request with the stipulation that no further replatting in the subdivision be submitted without the covenant agreement for the railroad crossing being executed and the stipulation requiring the street dedication on Industrial Park Boulevard to Holiday Lane on any future rep1atting of the property. Mr. Mack Reeve, 7450 Whitehall, representing Technol, appeared before the Council. Mr. Reeve stated he was present to answer any questions the Council might have. Mr. Line stated Mr. Reeve was representing Technol and the issue before the Council was a replat that affects only Technol. Mr. Line stated the stipulations that were placed on the replat had to do with the company that owned the remainder of the property, Lamar Savings. Councilman Davis asked for a brief summary pertaining to the plat. Mr. Royston stated the plat had been submitted previously and had some technical problems. Mr. Royston stated the stipulations pertained to the remainder of the property. Councilman Davis moved, seconded by Councilman Garvin, to approve PS 87-12_// Motion carried 7-0. *10. PS 87-28 REQUEST OF RUFE SNOW VILLAGE PARTNERSHIP AND KROGER COMPANY FOR REPLAT OF LOTS 2R THROUGH 5R, AND 6, BLOCK 1, NORTHLAND SHOPPING CENTER ADDITION (LOCATED ON THE EAST SIDE OF RUFE SNOW AND SOUTH OF WATAUGA ROAD) APPROVED 11. SO 87-7 RECONSIDERATION OF REQUEST OF 5TH AVENUE DINETTES FOR VARIANCE TO THE SIGN ORDINANCE DENIED . Councilwoman Moody stated the applicant would like a variance granted for a ground sign at the ~edfdrd Euless Road entrance. Councilwoman Moody stated the applicant had three existing signs at the present time, but would be willing to take the sign on the building down if the request was approved. Councilwoman Moody stated one sign was over the front door, one was a pole sign on the freeway side and one was painted on the side of the building. Councilwoman Moody advised the Council the applicant was present if they would like to ask any questions. Mayor Echols advised he had a request to speak from Mr. Richard Amoedo. Councilman Ramsey called for point of order. Councilman Ramsey stated this was a reconsideration and was strictly for the Council's consideration. Councilman Ramsey stated the City had historically attacked the symptoms of the problem pertaining to the Sign Ordinance and not the problem itself. Councilman Ramsey stated he felt if one person was allowed to have a variance then the Council should just wipe out the Sign Ordinance and let everyone have one. Councilman Ramsey stated the City was not being consistent. Mayor Pro Tem Fisher asked Councilwoman Moody if she would amend her motion to make sure the third sign was removed. Councilwoman Moody amended her motion, Councilman Garvin amended his second, to state that the sign that was painted on the building would be removed. Councilman Davis stated there were other tenants in the center and what was going to keep them from requesting to place a sign there also. Councilwoman Spurlock stated she felt that if this request was granted the other tenants would make the same request. Councilwoman Hinkle stated that when the request was originally made the question had been asked about the other tenants wanting signs and Mr. Amoedo stated he had polled the other businesses and that they did not want a sign, but what if new businesses came in and they did want one. Mayor Pro Tem Fisher stated he felt the situation here was an individual who was trying to compete with people who were out of his league and maybe the City should encourage people like this to keep their businesses in the City even if you had to deviate from the Sign Ordinance. Councilwoman Moody asked Mr. Amoedo if the pole sign belonged to him or the center. Mr. Amoedo stated it belonged to all of the tenants. Councilwoman Moody asked if everyone there could use it but he was the only one that had chose to. ., Mr. Amoedo stated the10thers had signs on the existing sign. Councilman Ramsey stated that if there was a problem with the Sign Ordinance where variances were continuously given then he felt the ordinance should be corrected. Councilwoman Moody called for the question. Councilwoman Spurlock stated she felt that if someone came before the Council to give testimony she did not like the idea of hear say. Councilwoman Spurlock stated she liked verification in writing of the other business.es involved. Motion failed 4-3; Councilwomen Hinkle and Spurlock and Counci1men Ramsey and Davis voting against and Councilwoman Moody, Mayor Pro Tem Fisher and Councilman Garvin voting for. Councilman Davis stated he would like to make a motion that did not affect thi s ca·se if it was not out of order. I I Ie I I I I I I Ie I I I I I I I -- I August 24, 1987 Page 5 Councilman Davis moved, seconded by Councilman Ramsey, that all sign variances not be brought before the Council until Staff and a committee, to be appointed by the Council, had reviewed the Sign Ordinance and made recommendations to the Council on potential changes. Councilwoman Spurlock asked if a time limit could be placed on the moratorium on sign variances. Councilman Davis amended his motion and Councilman Ramsey amended his second to state a moratorium would be in effect until the first of the year. Motion carried 7-0. *12. GN 87-78 PARK & RECREATION BOARD, ORDINANCE NO. 1477 (POSTPONED AT THE AUGUST 10, 1987 MEETING) APPROVED *13. GN 87-79 LIBRARY BOARD, ORDINANCE NO. 1478 (POSTPONED AT THE AUGUST 10, 1987 MEETING) APPROVED 14. GN 87-80 REVENUE SHARING BUDGET HEARING Mayor Echols presented the following information: "The proposed use as determined at Council Meeting 7/27/87 of Revenue Sharing Funds remaining from previous years allotment and interest earnings to date is as: fo1:lows: A. General Government (City Secretary's Office) Funds to be used to retain a records management consultant to establish an official policy and procedures for retaining official public records and purchase required equipment and supplies _ $27,000 B. Public Safety (Fire Department) Funds to be used to convert one modular ambulance unit to a diesel chassis - $22,000 C. Public Works (Streets) Funds to be used to obtain a new sign machine and an epoxy machine - $19,700 Total Funds - $68,700." Mayor Echols opened the Public Hearing and called for anyone wishing to speak in favor to please come forward. There being no one wishing to speak in favor Mayor Echols called for anyone wishing to speak in opposition to please come forward. GN 87-87 RECORD VOTE ON PROPOSED 1987-88 AD VALOREM TAX oRATE INCREASE APPROVED Councilman Davis moved, seconded by Councilman Garvin, to take a record vote on the intent to increase ad valorem tax not to exceed 41.3 cents per $100 valuation and to set September 14, 1987 as the date for the public hearing on the proposed increase. Motion carried 7-0. Councilman Davis stated that the homestead exemption would be increased an additional 5%. *22. PAY 87-4 APPROVAL OF PAYMENT TO JAMES & SHERYL BELLOMY IN THE AMOUNT OF $1,677.11 _ RIGHT-OF-WAY ON HIGHTOWER DRIVE APPROVED *23. PAY 87-5 RIGHT-OF-WAY PURCHASE ON HIGHTOWER DRIVE APPROVED 24. CITIZEN PRESENTATION Dr. Peter Sakovich, 5341 Lynda Court, appeared before the Council. Dr. Sakovich stated he moved back to North Richland Hills in May and purchased a house on Lynda Court. Dr. Sakovich stated the street was behind North Ridge Vi~lage Apartments. Dr. Sakovich stated that the apartment complex's dumpster was approximately 25 feet from his back porch. Dr. Sakovich stated he had talked to the apartment manager about keeping the area around the dumpster clean and had not gotten anywhere. Dr. Sakovich stated the dumpster was especially bad on weekends. Dr. Sakovich stated he was requesting the City to do something about the situation. Councilman Davis stated the Council would ask the City Manager to investigate the situation especially on weekends and see what the City could do to help. Ms. Myrtis Byrd, 7312 Hialeah Circle, appeared before the Council. Ms. Byrd asked if the City had an ordinance on how long a street could be closed while under construction. Ms. Byrd stated she was referring to Amundson Road and also wanted to know why the bridge was still closed. Mr. Line stated that the delay in this project was because of getting the utilities relocated. Mr. Line stated he would check into the situation. Thomas Elementary School. The requested rezoning is from R-3 Single Family to R-8 Zero Lot Line Single Family Residential. The applicants stated purpose is to develop a zero lot line residential subdivision of ninety-five lots in conformance with the R-8 District criteria. The Staff, in reviewing the proposed subdivision, noted that Newman Drive, which is designated as a four lane Collector Street will bisect the subject property. The layout submitted with the application indicated that the street dedication required by the Thoroughfare Plan will be provided. A portion of the subject tract is currently located in the one hundred (100) year flood plain of a tributary of Walker Branch. In the development of the property the applicants will be required to provide the necessary channel improvements to remove the project from the flood hazard area. On September 9, 1987 the Staff was presented with a petition in opposition to Zoning Application PZ 87-14. The petition contained sixteen names of persons residing within two hundred (200') feet of the subject property representing eleven (11) properties. 4IÞThese properties do not meet the twenty (20%) percent criteria for a legal petition. In addition a petition was presented containing a total of one hundred fifty-one names of citizens in the surrounding neighborhoods who are in opposition to the proposed rezoning but are not located within the two hundred (200') foot zone of influence. RECOMMENDATION: The Planning and Zoning Commission recommended that Zoning Application PZ 87-14 requesting rezoning of Tract 16E, W.W. Wallace Survey, Abstract 1606 from R-3 to R-B be approved. This property is located south of Emerald Hills Way and west of Grapevine Highway. Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. -- Attorney George Staples came forward to represent the applicant. He stated there is 18 plus acres which lies south of Emerald Hills Way. He said the Master Plan shows two thoroughfares, one at the top and one at tbe bottom of this property~ Mr. Staples stated that part of this property is in the flood plain and there would have to be some extensive channel work done. He said they plan to put a concrete channel to the south and west. -- . . Mr. Staples stated the ''Windsor Park" development is owned by his client and this development will be similar to it. He said they are asking for R-8 zoning for the lot size. Mr. Staples stated the City will participate in building the channel since the property is adjacent to a City Park. He said it would cost the developer $60,000 for the concrete channel without the bridge and the only way they could see any return would be to have this zoning. I ( Mr. Staples stated there is an elementary school across the street from this property; there are 5 houses that back up to the channel, but there are no houses immediately adjacent to this property. He said he felt this would be compatible to the neighborhood. He said the lots would be from 4100 to 5000 square feet. Mr. Staples showed the Commission pictures of development in the area. He also showed them pictures of the Windsor Park development. Mr. Staples stated he had others present who would be able to answer any questions the Commission might have. Chairman Bowen asked what the minimum house size would be. Mr. Staples stated they would probably be from 1200 to 1400 square feet. He said they don't have a firm figure on that yet. Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. Carl Ball, 5512 Irish Spring Lane, came forward. He said he had not been able to see the site plan. He said part of the channel is in his back yard and he wondered how much he would be assessed for it. Mr. Royston stated there is no assessment for drainage. Mr. Ball asked if they plan to build two story houses. He said he was sure they would since the lots are so small. I PZ 87-14 APPROVED ( ( Mr. Ball stated if this zoning is approved, he would request the houses be 1200 to 1400 square feet. Chairman Bowen stated the minimum for R-8 is 1200 square feet. Larry Telford, 5517 Irish Springs Lane, came forward. He said when the multi-family came in, they made more traffic. He said there is no light at Grapevine Highway, but they put one in on Davis Boulevard. Mr. Telford said there is a school right across the street from this property and this would cause increased traffic. He said to the east there is the largest tract of R-7-MF in the City of North Richland Hills; to the north is Industrial; to the east and west is commercial; then the Northeast Campus; and a park to the south. Mr. Telford said when he moved there, he was proud of the R-3. He said he felt it was better for the neighborhood. Mr. Telford said if this request is approved, he would like to see the houses 1300 square feet. Ms. Flippo asked Mr. Staples what the difference would be in the cost of the streets and drainage for R-3 and R-8. Mr. Staples stated the drainage and street cost would still be required in R-3. Chairman Bowen closed the Public Hearing. Mr. Wood made the motion to approve PZ 87-14. This motion was seconded by Ms. Flippo and the motion carried 4-1 with Mr. Schwinger voting against. Chairman Bowen stated this is only a recommendation to the City Council and they have the right to speak at their meeting which will be September 14th. Ordinance No. 1487 PZ 87-15 Agenda Number: This Zoning Application-is presented on a portion of the vacant residential and commercial property on the south side of Meadow Lakes Drive. The existing commercial zoning in this area was established for the development of a future golf course. The requested rezoning is from OC Outdoor Commercial to R-2 Single Family and from R-2 Single Family to DC Outdoor Commercial. The purpose for the proposed rezonings is to readjust the boundary between the residential tract and the commercial tract to match the proposed residential subdivision layout submitted by the applicants. The requested rezoning from DC to R-2 is on two parcels totalling 0.76 acres in size and the one parcel to be changed from R-2 to OC is 0.240 acres. The net change will add 0.684 acres to the R-2 tract. The applicant's intent is to construct an addition to the existing residential subdivision along a street exiting off Meadow Lakes which will ultimately extend along the golf course. According to the preliminary plat currently under Staff review the proposed subdivision will contain eight lots. The Staff noted to the Commission that the proposed rezoning will create at least a minor shift in the property designated for the future golf course. The applicants assured the Commission that the proposed revision will not affect the development of the golf course. The applicant stated that a prospective developer of the golf course has reviewed the revision and has no objections to the changes. The Staff also noted to the Commission that in previous approvals given in this subdivision the stipulations were added that all lots must be a minimum 10,400 square feet and all residential units must be a minimum of 2000 square feet. The applicant had not requested these minimums but indicated that the development would be consistent with the adjoining residential lots and that he would have no problem with the stipulations. RECOMMENDATION: The Planning and Zoning Commission recommended that Zoning Application PZ 87-15 requesting rezoning from OC to R-2 and R-2 to OC on a portion of Tract 2, W.A. The Staff noted to the Commission that the proposed plat is at the intersection of Smithfield Road and Hightower Drive, both of which are designated as four lane Collector Streets in the Master Thoroughfare Plan. The proposed plat does include the required street dedications to accomplish the applicant's portion of the street improvements. The applicants also have made arrangements with the Public Works Director to provide their portion of the street construction costs for future construction of both streets. The Staff also noted that the subdivision design will create four (4) lots which face Hightower Drive. This is not the most desirable layout. However, it appears that the design submitted is the most efficient use of the property. The Staff suggested to the Commission that these lots, Lots 5 through 8, Block 6, be restricted to either side of rear-entry garages to preclude the backing out of vehicles into the thoroughfare. The Food Service Program is the culmination of two years of work and study by this Department. The Program is designed to be self-supporting and will include two inspectors to handle all of the inspections, permitting, plan review and record keeping as well as the enforce- ment of the "Grease Trap Ordinance" which will be presented to the Council at a later date. This ordinance incorporates the "Rules and Retail Food Store Sanitation" and the "Rules on Food Service Sanitation" which are part of the State Code dealing with protecting the public from the threat of a food borne' illness outbreak. These Rules are incor- porated in··our inspection forms and define each critical control point that the inspectors look for during an actual on-premises inspection. This Division has worked very closely with Chief Sanitarian John Schaffer of the Texas Department of Health in putting this Program together. Temporary food establishments which operate at a fixed location for a period of tim~ not to exceed forty-eight (48) hours in conjunction with a single event or celebration provided that such temporary food establishments are both owned and operated by non- profit organizations based within the City. I I (4). Concession stands, which operate at a fixed location in conjunction with scheduled, community-based sporting or recreational events provided: I (a). Such establishments are both owned and operated by nonprofit organizations based within the City. I I , Pa ge 2 I I ~ I (b). The preparation and serving of potentially hazardous food shall be restricted to only those pre-cooked, potentially hazardous food products requiring limited preparation such as heating, seasoning, and serving. I (c). This restriction does not apply to any pre- packaged, potentially hazardous food product that has been properly prepared and packaged in accordance with all Texas Department of Health and local requirements and is properly stored, handled, and served in the unopened, original package from said concession stands. I I I (5). Establishments which handle only fresh, unprocessed fruits, nuts, and vegetables whether such establishments operate from a fixed location or are mobile in nature. I G. Health Department: Environmental Services Division of the Police Department of the City of North Richland Hills. I H. Mobile Food Itinerant: Any place of a mobile nature which offers food for consumption in single or larger portions or quantities, including but not limited to fruit or vegetable stands, and including food sales from vehicles, and any other mobile facility. All rules applying to mobile food units, as defined herein, shall apply to this classification. . I I. Mobile Food Unit: A vehicle-mounted food service establishment or a food service establishment pulled behind a vehicle to be readily moveable. I J. Potentially Hazardous Food: Any food that consists in whole or in part of milk or milk products, eggs, meat, poultry, fish, shellfish, edible crustacean or other ingredients, in a form capable of supporting rapid and progressive growth of infectious or toxicogenic microorganisms. I I K. Regulatory Authority: The Environmental Services Division of the Police Department of the City of North Richland Hills. I L. Reinspection: Inspection to determine compliance prior to closure or suspension of permit due to imminent health hazard or gross non-compliance with applicable health regulations. I I f Page 3 I I -. I I I I I I I . I I I I I I I f I M. Rules and Regulations: "Rules on Food Service Sanitation" of the Texas Department of Health, Division of Food and Drugs. A copy of those rules are attached hereto and made a part hereof. Such Rules and Regulations are adopted and shall be in full force and effect within the City limits of North Richland Hills, Texas. N. Seasonal Food Service: An establishment which operates for no more than four (4) consecutive months (one hundred and twenty (120) days) in a twelve month calendar year, and is restricted to non-potentially hazardous food. O. Temporary Food Service: An establishment which operates for no more than fourteen consecutive days. ARTICLE 4. COMPLIANCE PROCEDURES SECTION 1. Compliance Required: It shall be unlawful for any person or firm to operate any food establishment as defined in Article 3, above within the corporates limits of the City of North Richland Hills, Texas unless such operation is done in conformance with the requirements of this ordinance. SECTION 2. Authority of Issue Permits: The City Environmental Health officer or his/her authorized representative is hereby authorized to issue a permit to any person or firm making application for a food establishment permit in the City of North Richland Hills provided that the person or firm that com?lies with the requirements of this ordinance shall be entitled to receive and retain such permit. SECTION 3. Permit Required: Is shall be unlawful for any person or firm to operate a food establishment without a permit. SECTION 4. Application for Permit: A. Application for such a permit as required in this Article in Section 3 shall be made in writing to the City Environmental Health Officer or his authorized representative upon forms prescribed and furnished by the City of North Richland Hills. B. Plans and specifications review are required as follows: (1.) Prior to construction, extensive remodeling or conversion of an existing structure to be used as a food establishment, a complete set of plans and speci- fications shall be submitted to the building official Page 4 I ~ I I I I I I I . I I I I I I I , I for review under the building code and administratively coordinated and made available to the fire marshal and the Environmental Health Officer or his authorized representative for review under the provisions of the fire code and this article, and no construction of a food establishment shall take place nor will a building permit be issued prior to the approval of the submitted plans and specifications by the specified City Officials. The plans and specifications shall indicate the proposed layout, arrangement, mechanical plans, and construction materials or work areas, and the type and make of proposed fixed equipment and facilities. Construction according to the specifications which have therefore been submitted and approved by the City Environmental Health Officer or his/her authorized representative must be commenced within six (6) months of the said approval date and completed within twelve (12) months of commencement, or the plans must be resubmitted for plan review and being subject to current City requirements. (2). Projects which at the time of approval are of such size or which are planning to use equipment that cannot be delivered and installed within this eighteen (18) months may apply to the City Environmental Health Officer for a waiver of this review at the time of original submission, but not thereafter. (3). Whenever plans and specifications are required to be submitted to the City, the Ci~y shall inspect-the food establishment prior to its beginning operations to determine compliance with the approved plans and specifications and with the requirements of the ordinance. SECTION 5. Issuance of Permit; Transferability; Terms; Penalties; Categories. A. The City Environmental Health Officer or his/her authorized representative shall issue a permit if he/she determines that: (1). The technical review of plans and specifications are in compliance with applicable laws and this ordinance and, (2). The fee in this Article, Section 6, and all other applicable fees have been paid and, Page 5 I Ie I (3). By means of physical inspection, the food establishment is determined to be in compliance with this ordinance. I B. Every permit issued under the provisions of this Article shall be non-transferable. A food establishment shall permit the operation of the establishment only at the location for which granted. I c. Any permit granted under the prOV1Sl0ns of this Article shall remain in full force and effect for the term allowed according to permit category and type as defined in this section unless sooner suspended and/or revoked for cause, and shall be displayed in a conspicuous place for inspec- tion by the City Environmental Health Officer or his/her authorized representative. I I D. Any fùod establishment that fails to renew any permit issued under the provisions of this Article by the expiration date of said permit and continues to operate without a valid permit shall be assessed twenty five ($25.00) dollars for each day of operation of that establishment, plus any other penalties provided in this Article. Such assessments and/or penalties shall be paid along with the required permit fees before a valid permit will be reissued. I I It E. Permit Categories are authorized as proved herein: I (1). Before a permit is issued, an applicant shall pay the fee(s) as required in this Article. B. The following fees shall be due and payable on October first (1st) of each calendar year: (1). Food Service Establishments with one (1) to five (5) employees: One hundred and fifty dollars ($150.00) (2). Food Service Establishments with six (6) to twenty (20) employees: Two hundred and fifty dollars ($250.00) (3). Food Service Establishments with twenty-one (21) or more employees: Three hundred dollars ($300) (4). Temporary Food Service Establishment: Fifty dollars ($50.00) (5). Season31 Permit: One hundred dollars ($100.00) (6). Reinspection: One-half (1/2) the cost of one inspection. C. Applicable fees may be prorated up to fifty percent (50%) for permits issued on or before the first (1st) day of April. Permits issued after the first (1st) day of April shall require fifty percent (50%) of the annual designated fee. Permit shall expire on the first (1st) day of October of each year. SECTION 7. Certificate Fees. A. Food Service Manager: Ten dollars ($10.00). B. Food Service Employee: Ten dollars ($10.00). Page 7 I ~ I I I I I I I . I I I I I I I , I ARTICLE 5. INSPECTIONS SECTION 1. Enforcement Authority; Inspections, Report of Inspections. A. The City Environmental Health Officer or his/her authorized representative is authorized to enter upon any private property and to enter any establishment, subject to the provisions of this Article for the purpose of determining compliance with this ordinance and for the purpose of determining the identity of the owner, operator, manager or supervisor thereof and all persons employed therein. B. Before a permit is issued, the City Environmental Health Officer or his/her authorized representative shall inspect and approve the food establishment areas to be used. An inspection of a food establishment may be performed at least once every six (6) months. Additional inspections of the food establishment shall be performed as often as necessary. c. Whenever an inspection of a food establishment is made the findings shall be recorded on an inspection report. The inspection report shall summarize the requirements of the ordinance and shall set forth a weighted point value for each requirement. Inspectional remarks shall be written to reference,by section number, the section violated and shall state the correction to be made. The rating score of the establishment shall be the total of the weighted point values for all violations, subtracted from one hundred (100). A copy of the inspection form shall be furnished to the person in charge of the establishment at the time of the conclusion of the inspection. The completed inspection report form is a public document that shall be available for public disclosure to any person who requests it according to law. D. Refusal of an owner, manager or employee to allow the City Environmental Health Officer or his authorized representative, upon presentation of credentials, to inspect any permitted business or operation therein during normal business hours will result in an immediate suspension of the permit, requiring all permitted activities to abate until after the hearing required in Section 2-D (1) of this Article. Nothing herein or therein shall require notice of suspension for this violation. E. In the event that the City Environmental Health Officer or his authorized representative should have cause to believe that a business required to be permitted under this Article Page 8 I ~ I I I I I I I . I I I I ! I I I , I is operating without a permit (or has failed to renew a permit) and refuses entry, during normal business hours, then the City Environmental Health Officer or his authorized representative may apply to the North Richland Hills Municipal Court for an inspection warrant of the suspect premises upon the filing of a probable cause affidavit and compliance with the Texas Code of Criminal Procedure. If an inspection warrant is granted by the MUnicipal Court, the City Environmental Health Officer or his/her authorized representative may be assisted in service thereof by the North Richland Hills Police Department or such other law enforcement agencies as are deemed necessary to obtain entry. F. The City Environmental Health Officer or his authorized representative may also be accompanied during any inspection by the Building Official and/or Fire Marshal of the City of North Richland Hills or his/her designee. SECTION 2. Correction of Violations; Suspension of Permit; Revocation of Permit. A. Enforcement procedures: The City Environmental Health Officer or his/her authorized representative may establish enforcement procedures to insure compliance with this ordinance and which are consistent with the regulations adopted herein, including, but not limited to, written warnings, compliance time limits, permit suspensions and permit revocation. B. Inspections: The inspection report form shall specify a reasonable period of time for the correction of the violations found, and correction of the violations shall be accomplished within the period specified, in accordance with the following provisions: (1). If an imminent health hazard exists, such as complete lack of sanitization, refrigeration or sewage backup into the establishment, then all food sales and/or service operations shall cease immediately. Operations shall not be resumed until authorized in writing by the regulatory authority following reinspect ion. (2). All violations of four or five point weighted items shall be corrected within a time specified by the regulatory authority, but in any event, not to exceed ten (10) days following the inspection. Within fifteen (15) days after the inspection, the holder of Page 9 I ~ I the permit, license, or certificate shall submit a written report to the regulatory authority stating that the four or five point weighted violations have been corrected. A follow-up inspection shall be conducted to confirm correction. I (3). All one or two point weighted items shall be corrected within a time specified by the regulatory authority, but in any event, by the time of the next routine inspection. I I (4). When the rating score of the establishment is less than sixty (60), the establishment shall initiate corrective action on all identified violations within forty-eight (48) hours. One (1) or more reinspections will be conducted at reasonable time intervals to assure correction such reinspection shall be subject to the fee schedule authorized by this ordinance. I I (5). In the case of temporary food establishments, all violations shall be corrected within a time specified by the regulatory authority, but in any event, not to exceed twenty hour (24) hours following the inspection. I C. Reinspection . (1). To determine corrected imminent health hazards as defined in the regular semiannual inspection. I (2). To determine compliance with plan review after initial inspection and prior to issuance of permit. I D. Compliance with inspection report: The inspection report shall state that failure to comply with any time limits for correction may result in cessation of food sale and/or service operations. An opportunity for a formal administrative hearing is provided for in Section 2-D and E of this Article. I I D. Suspension of permit: I (1). The City Environmental Health Officer or his/her authorized representative may, without notice or hearing, suspend any permit authorized herein if the holder of this permit does not comply with the requirements of the ordinance, or if the operation otherwise constitutes a substantial hazard to the public health. Suspension is effective upon service of I I , Page 10 I I -- I I I I I I I It I I I I I SECTION 3 I I (' I the notice as required in Section 3 of this Article. When a permit is suspended, the holder of the permit or the person in charge shall be notified in writing, that the permit is, upon service of notice, immediately suspended and that an opportunity for a hearing will be provided if a written request for a hearing is filed with the City by the holder of the permit, within ten (10) days. The permit holder shall be afforded a hearing within ten (10) days of the date on which the City is in receipt of the written request for said hearing. (2). If the permit holder or the person in charge does not file a written request for a hearing with the City within ten (10) days of the notice of suspension then the suspension is sustained. The City may end the suspension at any time if the reason for suspension no longer exists. (3). Whenever a food establishment is required under pro- vision of this Article to cease operation, it shall not resume operations until such time as a reinspection determines that conditions responsible for the require- ment to cease operations no longer exist. Opportunity for reinspection shall be offered within a reasonable time. E. Revocation of permit: The City Environmental Health Officer or his/her autnorized representative may, after providing opportunity for a hearing as specified in Section 2-D, revoke a permit for serious or repeated violations of any of the requirements of this Article or for interference with the City's enforcing authority in the course of his duties. The City shall notify the holder of the permit or person in charge, in writing, of the reason for which the permit is subject to revocation and that the permit shall be revoked at the end of the ten (10) days following service of such notice unless a written request for a hearing is filed with the City by the holder of the permit within such ten (10) day period. If no request for hearing is filed within the ten (10) day period, the revocation of a permit becomes final. Whenever a revocation of a permit has become final, the holder of the revoked permit may make written application for a new permit. Service of Notice: A notice provided for in this Article is properly served when it is delivered to the holder of the permit or person in charge, or when it is sent by registered or Page 11 I ~ I I I I I I I . I I I I I I I , I certified mail, return receipt requested, to the last known address of the holder of the permit or is hand delivered to the person in charge of the establishment at the time of delivery. A copy of the notice shall be filed in the records of the City of North Richland Hills. SECTION 4 Hearings: The hearing provided for in this Article shall be conducted by the Municipal Judge of the City of North Richland Hills or his/her designated agent at a time and place designated. Based upon the record evidence of such hearing, the Municipal Judge shall make a final finding, and shall sustain, modify or rescind the permit. A notice of the hearing decisions shall be furnished to the holder of the permit by the City Environmental Health Officer. SECTION 5 Examination and condemnation of food: Food samples may be examined or taken for analysis by the City Environmen'~al Health Officer or his authorized representative as often as necessary for enforcement of this Article and may, upon written notice to the owner or person in charge specifying with particularity the reasons thereof, place a hold order on any food which is believed to be in violation of any portion of this ordinance, and shall tag, label, or otherwise identify any food subject to the hold order. No food subject to a hold order shall be used, served or removed from the establishment until the vendor of such food has furnished proof of the wholesomeness of the food product to the City Environmental Health Officer or his authorized representative. The City shall permit stoyage of the food under conditions specified in the hold order, unless storage is not possible without risk to the public health, in which case immediate destruction shall be ordered and accomplished. The hold order shall state that a request for hearing may be filed within ten (10) days and that if no hearing is requested, the food shall be destroyed. A hearing shall be held if so requested and, on the basis of evidence produced at that hearing, the hold order may be vacated, or the owner or person in charge of the food may be directed by written notice to denature or destroy such food or to bring it into compliance with the provisions of this Article. All costs accruing from such removal thereof shall be borne and paid for by the owner thereof. SECTION 6 Equipment and Utensils; Design and Fabrication A. Residential refrigerators, freezers, and ranges are not approved for use in commercial food service establishments or food stores. Only equipment or utensils that meet or exceed the standards of the National Sanitation Foundation (NSF) will be approved. Page 12 I ~ I I I I I I I . I I I I I I I , I SECTION 7 SECTION 8 B. An exception to the former equipment requirements may be made with written approval of the City Environmental Health Officer or his/her authorized representative for the following establishments or operations. (1). Food establishments that will operate only under a temporary permit. (2). Mobile food establishments. (3). Child care facilities licensed for up to twelve (12) children by the Texas Department of Human Resources. Equipment Installation and Location: Auxiliary equipment such as water heaters, remote connected refrigerator com- pressors, and the central units of equipment used to treat the air by either heating, cooling, or otherwise conditioning the air must be located outside food preparation areas. Sanitary Facilities and Equipment. A. Lavatories: Lavatories shall be separate facilities from sinks used for food preparation or utensil washing. Such facilities located in the food preparation areas of food establishments shall be equipped with hot and cold, potable water under pressure and metered by a mixing valve. B. Lavatory Supplies: If hand drying devices providing heated air are provided they may only be used in restrooms. A sanitary dispenser containing hand cleaner shall be provided at each restroom lavatory. Sanitary disposable towels shall be provided in a dispenser conveniently located near each lavatory in food preparation areas. C. Toilet Facilities: (1). All new or extensively remodeled food service establishments within the City in which food served to the customer is intended to be consumed on the premises, shall be equipped with separate toilet facilities for men and women, and shall comply with all requirements of the City Plumbing Code. (2). Toilet facilities shall be located within the food Page 13 I ~ I I I I I I I . I I I SECTION 9 I I I I , I service establishment and will provide the customer of said establishment direct and easy access to the establishment's toilet facilities from the dining area without having to go either outside the establishment, or through the food preparation area. D. Cleaning Physical Facilities: In all new or extensively remodeled food service establishments or food stores, at least one utility sink or curbed floor drain supplied with hot and cold water under pressure by means of a mixing valve or combination faucet, shall be provided and used for the cleaning of mops or similar wet cleaning tools and for the disposal of mop water or similar liquid wastes. E. Grease Traps: Grease Traps installed in food establishments shall be located outside of the establishment, unless approved in writing by the Building Official, Plumbing Board, Director of Public Works, and City Environmental Health Officer or his authorized representative. Grease traps shall be located for easily accessible cleaning. F. In all new extensively remodeled food establishments at least a three compartment sink shall be provided for the manual washing, rinsing, and sanitizing of utensils and equipment. An exception to the former equipment re- quirements may be made with written approval of the City Environmental Health Officer or his/her authorized representative only in the case of a food establishment that shall operate under a temporary permit or food establishments that handle only non-potentially hazardous foods which require limited preparation. G. In all new and extensively remodeled food establishments having mechanical utensil washing facilities, at least one (1) three (3) compartment sink shall be provided in addition to the mechanical utensil washer. Restricted Operations: The retail sale and/or offering for sale, and/or holding for sale, of raw potentially hazardous food for consumption from temporary and mobile food establish- ments of all types and categories is prohibited within the City limits. The City Environmental Health Officer or his/her authorized representative may impose additional requirements pertaining to temporary and mobile food establishments in order to protect the public health and may prohibit the sale of some or all potentially hazardous foods from the former establishments. Page 14 I ~ I I I I I I I . I I I I I I I , I SECTION 1 SECTION 2 ARTICLE 6 Food Service Manager's Training Certification A. Every food service establishment permitted herein shall employ no less than one (1) Food Service Manager or other responsible employee in charge of food service operations who shall possess a current certification as a Food Service Manager from an approved training agency or certification program, audited by the Texas Department of Health, as determined by the City Environmental Environmental Health Officer or his/her authorized representative, except that temporary food service establishments and food service establishments that handle only pre-packaged foods and non-potentially hazardous foods which require only limited preparation are exempt from the provisions of this section. B. The Food Service Manager must be employed on the premises of the establishment to be in compliance with this Article. The Food Service Manager certificate shall be obtained within the first ninety (90) days of employment in a managerial capacity. C. The owner or person in charge of any establishment permitted herein shall display all such certifications in a conspicuous place for inspection by the City Environmental Health Officer or his/her authorized representative. A copy of each manager's certification, as described and required in this Article shall be filed in the records of tte City. D. The fee set out in Article Four (4) is intended to cover the of issuing the certificate only. If the training is obtained through the Environmental Services Division of North Richland Hills any cost to the city for such training shall be passed on to the Food Service Manager. Food Service Employee Certificate A. Every employee of a food service establishment shall obtain a Food Service Employee Certificate, within the first (1st) thirty (30) days of employment, from the Environmental Services Division of the Police Department of the City of North Richland Hills. B. Prior to obtaining Food Service Employee Certificate, employee shall attend a training session on food safety available through the Environmental Services Division. Page 15 I -- I I I I I I I II I I I I I I I , I SECTION 1 SECTION 2 SECTION 3 C. There shall be a fee, as set out in Article four (4) of this ordinance, for this training session. The fee shall also include the Food Service Employee Certificate and shall be displayed in a conspicuous place in the establishment for inspection by the City Environmental Health Officer or his/her authorized agent. A copy of each Food Service Employee Certificate shall be filed in the records of the City. D. Employees in grocery stores that do not work in a food service area shall be exempt from this Section provided they do not handle potentially hazardous food. ARTICLE 7 SEVERANCE; REPEALER; PENALTY Severance That it is hereby declared that the sections, articles, subsec- tions, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, subsection, article, or section of this ordinance shall be declared void, ineffective, or unconstitutional by a valid judgment or final decree of a court of competent jurisdiction, such voidness, ineffectiveness, or unconstitutionality shall not effect any of the remaining phrases, clauses, sentences, paragraphs, subsections, article, or sections of this ordinance since the same would have been enacted by the City Council with the incorporation herein of any such void, ineffective, or unconstitutional phrase, clause, sentence, paragraph, subsection, article, or section. Repealer All ordinances or parts of ordinances not consistent or conflicting with the provisions of this ordinance are hereby repealed; provided that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered in this ordinance. Penalty Any person, firm, association of persons, company, corporation, or their agents, servants, or employees violating or failing to comply with any of the provisions of this article shall be fined upon conviction not less than one dollar ($1.00) nor more than one thousand dollars ($1,000.00) and each day any violation of non-compliance continues shall constitute a Pa ge 16 I ~ I I I I I I separate and distinct offense. The penalty provided herein shall be cumulative of other remedies provided by state law and the power of injunction as provided in Vernon's Ann. Civ. St. Art. 1175(f), (1) to (8) and as may be amended may be exercised in enforcing this article whether or not there has been a complaint filed. Bids for the regular banking services were received from Bank of North Texas (BNT) and First RepublicBank Richland (FRB-the current depository). First RepublicBank Richland also submitted a bid for the investment services. The contract period is proposed to be extended an additional six months in order to move the process from the normal budgeting period. State law permits a contract period up to three years. Both the Bank of North Texas and First RepublicBank Richland agreed to the revised terms. I I I I I I I II I I I I I I' I it I Analytical Services In keeping with the foregoing, the Receiving Agency employs the Performing Agency and the Performing Agency agrees to perform analytical services within the parameters listed on the attached schedule sheet. The Re~eiving Agency estimates an average of ~ samples per month will be collected and delivered to the laboratory for analysis. It is understood that these samples will be properly collected and preserved in accordance with applicable sections of A Practical Guide to Water Quality Studies of Streams, Federal Water Pollution Control Administration publication and Methods for Chemical Analysis for Water and Wastes, EPA manual, as well as the latest edition of Standard ÑëthÕds for the Examination of Water and Wastewater. A chain- of-custody procedure shall be ~aintained in the field and the laboratory in accordance with procedures to be established by the Receiving Agency. The Receiving Agency will furnish chain- of-custody tags. The Performing Agency' (Trinity River Authority of Texas) will perform all analyses according to the approved procedures set forth in Standard Methods for the Examination of Water and tJastewater, current edition or the latest edition of Methods for Chemical Analysis of Water and Wastes, EPA manual. Samples will be analyzed by these methods on the production basis, to include àppropriate analytical quality assurance procedures. Re~ords will be kept for documentation of the Performing .Agency's quality assurance program and copies will be available to the Receiving Agency upon request. Unusual interferences and problems will be reported to the Receiving Agency at its authorized ~ddress noted above. ,Research into specific· techniques to overcome these difficulties will be underta ken when pract i ca 1, and by mutua 1 agreement. . The sample information sheet submitted with each sample will designate the particular analysis or analyses to be made of each sample submitted. The laboratories will be operated in such a manner as to insure the legal sufficiency of the sample handling; analytical and reporting procedures; and to remedy ~ffects in,the procedures should such be discovered. The various laboratory personnel shall be directed upon receipt of written notice from the Receiving Agency 72 hours in advance, to appear and testify in enforcement actions. In such event, travel and per diem expenses for such employees shall be paid by the Receiving Agency. Travel and per diem for court appearances hereunder shall be bäsed on current State laws. . ' . Receiving 'Agency may deliver to Performing Agency samples for analysis separate and apart from those'samples collected by the Performing Agency. When the Receiving Agency delivers samples to the Performing Agency for analysis, the Receiving Agency shall indicate the nature and extent of the analyses it desires to be conducted. Performing Agency shall not be responsible for the manner of collection or chain-of-custody tags or sheets which are matters entirely outside Performing Agency's control. Performing Agency shall receive, log and' perform such analyses of samples in accordance with that part of the chain-of-custody procedures identified as Transfer of Custody and, ~hiPment attache~ .he,re~o. .:: Samples analyzed to maintain the normal quality assur~nce program whicll the Performing Agency presently maintains in its laboratory will be charged to the Receiving Agency at the same rate as submitted samples. TERf·lI NA T I ON Either party to this Contract may terminate the Contract by giving the other party thirty (30) days notice in writing a~ their authorized address as noted previously. Upon delivery of such notice by either party to the other and before expiration of the thirty (30) day period, the Performing Agency \'Iil1 proceed promptly to cancel all existing orders, contracts, and obligations which are chargeable to this Contract. As soon as practicable after notice of termination is given, the Performing Agency will submit a voucher for work performed under this Contract through its termination. The Receiving Agency will pay the Performing Agency for the work performed less all prior payments. Copies of all completed or partially completed reports, documents, and studies prepared under this Contract will be delivered by the . Performing -Agency to the Receiving Agency when and if this Contract is terminated prior to the completion of the prescribed wor k. C. AMENDING THE CONTRACT The parties hereto without invalidating this Contract may alter or amend this Contract upon advance \'Iritten agreement of both parties to exclude work being performed or to include additional work to be performed and to adjust the consideration to be paid hereunder by virtue of alterations or am~nd~ents. III. BASIS FOR CALCULATING REIMBURSABLE COSTS The financial basis for calculating reimbursable costs shall be as stated in Attachment A. The expenditûres by the Trinity River Authority of Texas of funds paid. to it under this Contract shall be subject to such State or Federal audit procedures as may be required by law and by accepted practices of the State or Federal auditor, or both, if requested. The Trinity River Authority of Texas shall be responsible for maintaining books of account that clearly, accurately and currently reflect financial transactions. The financial records must include all documents supporting entries on the account records which substantiate costs. The Trinity River Authority of Texas must keep the records readily available for examination for a period of three (3) years after the close of the last expenditure. Reimbursement for the inspection, sampling, and/or analytical costs, and cost for any travel and per diem expenses shall not exceed Three Thousand dollars ($ 3,000 ) for the period of this Contract. IV. COrJTRACT ANOUNT The total amount of this Contract shall not exceed Three Thousand dollars ($ 3,000) nor be less than One Hundred do 11 a rs ($ 100 ) . v. To the maximum extent achievable, as few people as possible should handle a sample. 2. Stream and effluent samples should be obtained using standard field sampling techniques and preservation procedures. I 3. Chain-of-Custody tags or sheets should be attached to each sample at the time it is collected. The tag or sheet contains basically laboratory (requested parameters) information; however, certain identifying items including City, City Code, Type Sample, Material Sampled, and Method of Preservation must be completed by the· field personnel collecting the sample. In completing the Chain-of-Custody tag or sheet, care should be utilized to insure that all necessary information is correctly and legibly entered onto the form. A black ballpoint with water proof ink should be used at all times. I I I Transfer of Custody and Shipment 1. All samples should be handled by the minimum possible number of persons. 2. All incoming samples shall be received by the custodian, or his alternate, and logged into a record book (log book). Information to be entered into the Log Book shall include the sample number, date received, source, time(s) sampled, date(s) sampled. and analyses requested. 3. Promptly after logging, the custodian will distribute the sample to an analyst or place the sample in the sample room, which will be locked at all times except when samples are removed or replaced by analysts. The custodian shall ensure that neat-sensitive samples, or other sample materials having unusual physical characteristics, or requiring special handling, are properly stored and maintained. I 5. Samples shall be kept in the sample storage security area at all times when not actually being used by analysts, such as during overnight absences. 6. The analysis sheet will be signed and dated by the person performing the tests and· retained as a permanent record in the laboratory. I 7.
