ORDINANCE NO. 2015
AN ORDINANCE BY THE CITY OF NORTH RICH LAND HILLS, TEXAS, AMENDING ORDINANCE
NUMBER 1874, THE COMPREHENSIVE ZONING ORDINANCE, TO AMEND REGULATIONS FOR
MULTI-FAMILY DEVELOPMENTS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS
CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Plmming and Zoning Commission has reviewed a proposal for to amend the R-7-MF
Multi-Fmnily District regulations; and
WHEREAS, the Planning and Zoning Commission has recommended that the sections, paragraphs and
sentences applicable to the R-7-MF MuIti-Fmnily District by mnended; and
WHEREAS, after appropriate notice and public hearing, the following recommendation is submitted to
the City Council of tlle City of North Richlmld Hills, Texas, by the Plmming and Zoning Commission;
and
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS,
TEXAS:
1.
THA T, Section 430, R-7-MF MuIti-Fmnily District regulations be and are hereby mnended to read in its
entirety as follows:
Section 430. R-7-MF MULTIl~AMIL Y DISTRICT
A. Purpose
R-7-MF District Multi-Fmnily Residential District is intended to provide areas for high density
development of apartment type atu\ched dwelling units.
B. Permitted Uses Uses permitted within tlle R-7-MF district are provided in Section 310, Table
of Pennitted Uses.
C. Lot and Area Requh-ements The following lot and area requirements shall be required of all
development located within R-7-MF District:

2 Buildings placed within sixty feet n of property lines adjacent to R-I, R-I-S, R-2, or R-3 Districts shall be single
story. Beginning at 60 feet from said property line additional height of structures shall be allowed at a ratio of 3: 1
slope until maximum height of 50 feet is obtained.
3 When the exterior walls of one building or of adjacent buildings are within sixty degrees of being parallel and
neither contains windows or doors, such walls shall be separated by not less than tenfeet of open space.
When the exterior walls of one building or of adjacent buildings are within sixty degrees of being parallel and one
but not both contains windows or doors, such walls shall be separated by not less thanfifteenfeet of open space.
When the exterior walls of one building or of adjacent buildings are within sixty degrees of being parallel and both
contain windows or doors such walls shall be separated by not less than twenty feet of open space.
D. General Conditions The following general conditions shall be required of all development
located within the R-7-MF District:
1. Fences: A six (6) foot masonry screening wall is required between certain adjacent
properties. A six (6) foot perimeter screening fence constructed of masonry or a combination
of masonry and wrought iron is required along street right-of-ways, parks, and other
dedicated open spaces. Refer to Article 9, Section 910, Walls and Fences for these
requirements.
2. Parking: See Appendix F - Minimum Number of Parking Spaces. The ratio of covered
parking space per living unit shall be one space required for each living unit within the Multi-
family development. All covered parking shall be located within 200 feet from the dwelling
unit utilizing the space. See Article 7, Section 700 E for parking dimension regulations.
3. Accessory Buildings: See Article 6, Sections 600 F & G for accessory building regulations.
4. Customary Home Occupations: See Article 6, Section 600 T for home occupation
regulations.
5. Garage Requirement: Garages or carports shall not be permitted within any required yard,
easement, or right-of-way.
6. Masonry Requirement: See Article 6, Section 600 for residential masonry regulations.
7. Landscaping Requirement: In addition to paved parking and driving areas, at least fifteen
percent of the lot shall be maintained in landscaped open area. Landscaping shall consist of a
combination of trees, shrubs, and appropriate ground cover. At least twenty-five (25) percent
oflandscaping shall be dedicated to trees and shrubs. See also Article 9, Section 900 for
landscaping regulations. Ifparking and maneuvering space exceeds one acre, at least five (5)
percent thereof shall be maintained as landscaped area, with adequate and inconspicuous
irrigation systems.

8. Recl'eation Space Requirement: At least ten (10) percent of the total lot shall be utilized
for common recreation space. The common recreation space may be indoor or outdoor
space, including, but not limited to, clubhouses, picnic areas, swimming pools,
tennis/basketbalI courts, volleyball courts, and jogging trails. That area which is used for
recreation space and consists of live plant material may also be utilized in satisfying the
landscape requirement. All common recreation space shall be designed such, or screened
with live plant materÜùs, that they are not visible to any public dedicated street right-of-way,
or from adjacent properties.
9. Signs: See Article 8, Section 800 for sign regulations.
10. Refuse containers: All refuse containers shall be screened from view of adjacent property
or public streets witl) an enclosure of masonry construction. A refuse container shall not be
located in any required yard, easement, or right-of-way.
11. Gated Entry: All multi-family developments shall provide for secured and controlled
access to tl)e development. Gated Entries utilizing gumd stations and/or security gates shall
be required.
12. Site Plan Appl'oval Required: Upon review by the Building Official ~md prior to the
issuance of a building permit for éUlY multi-fmnily development, a site plan, in accordmJec
wiili the requirements of Section 510, shall be approved by tl)e City Council after
recommendation by ilie Planning and Zoning Commission.
E. Zoning Request Submission Requirement.; Zoning requests for this district must include as a
minimum a site plan showing proposed grade and sizes for each lot, building lines for each lot,
parking for cach lot, access to public streets, proposed open spaces and recreation m"cas,
elevations and building materials, proposed areas for refuse containers, mId a survcy of ilie tract.
Survey shall not be more tlUlI) one ye~u' old.

right-of-way, parks, or other dedicated open space, shall be provided a'\ follows:
a. Where a proposed multi-fmnily development is adjacent to a C4U tlwroughfare, or larger, as
shown on ilie Master Thoroughfare Plan, said screening shall consist of a permm)ent decorative
ma'\onry screening wall, not less !l)an six (6) feet in height, constructed along mId adjacent to
said tlwroughfare.
b. Where a proposed muIti-fmnily development is adjacent to a C2U or R2U !l)()roughfare, pm"k, or
oilier dedicated open space, said screening wall shall consist of a pennanent decorative screening
wall of masonry, stone, or wrought iron type construction, or a combination thereof, not less tlmn
six (6) feet in height. Wrought iron material sh~ùl not exceed 40% of !l)e total wall face,
including columns.
c. Perimeter screening shall be constructed prior to tl)e issuance of a Certificate of Occupancy.

THA T, Sections 900 E and F - Landscaping Regulations be and are hereby mnended to read as follows:
Section 900 . Landscaping Regulations
E. Required Landscaped AI'ea Every platted lot, as required by tl1is Section, shall provide a
Im1dscaped area equivalent to tïfteen (15) percent of tl1e total land area of the lot. Will1 the exception
of the R-7-MF District, at least one-half of the required total landscaped area shall be located in the
street yards. All ground surfaces not used for building, sidewalks, roadways, or other impermeable
surfaces shall be covcrcd with Jive grass, turf, shrubbery, trees, ground cover, tlowering plants or
appropriate mateJiaI.
F. Landscaping CJ·edit.... With the exception of the R-7-MF District, all zoning districts subject to this
section shall be provided the option of utilizing landscaping crcdits to reduce the mnount of
l<U1dscapingo As an alternativc to thc requircd fifteen (15) percent total landscaped moea, landscape
credits may be utilized to reduce tl1e total mnount of l,md area dedicated for landscaping purposes.
However, in no instance shall tl1e credits reduce 1l1e total mnount of landscaping on a lot to less tl1an
seven and one-half (7.5) percent of the total land area. Credits are only allowed if the feature is
m,úntained as a pennanent element of 1l1e Landscape Plan. Credits are allowed a<; follows:

THAT, Section 600 A.l - Masonry Requirements be and are hereby mnended to read in its entirety to
read as follows:

1. The exterior wall surface, ,L<; viewed from each primary elevation, of all permanent structures
constructed in the R-l, R-I-S, R-2, R-3, R-4-D, R-6-T, and R-8 Zoning Districts shall consist of
at least seventy-five percent brick, stone, or if approved by the City Council, 01l1er masonry or
materials of equal characteristics. For the purposes of this requirement, the exterior wall surface
shall be defined as the area between the wall comers extending from the top of the foundation up

to the door or window header height of tile first floor, whichever is greater. The area of door and
window openings shall not be included in tile calculation of ti1Ís requirement.
6.
THAT, Section 600 A. - Masonry Requirements be and are hereby amended to insert the following
paragraph with the remainder of the section being renumbered consecutively.

THAT, Section 700 D - Parking Requirements be and are hereby amended to read in its entirety to read as
follows:

D. Minimum Pal'king Dimensions The minimum required dimensional area for each parking
space and Ole required maneuvering space shall not be less than tilat estahlished by the Schedule
of Minimum Parking and Maneuvering Dimensions, contained in Appendix G.
8.
SEVERABILITY CLA USE. That it is hereby declared to be tile intention of the City Council that the
section, paragraphs, sentences, clauses ¡md phrases of this ordinance are severable, and if any phrase,
clause, sentence, paragraph or section of tbis ordinance shall be declcu'ed invalid or unconstitutional by the
valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall
not affect any of tile remaining phrases, clauses, sentences, paragraphs or sections of ti1Îs ordinculce, since
the scune would have been enacted by tbe City Council without the incorporation in this ordinculce of any
such invalid or unconstitutional phrase, clause, sentence, pcu'agraph or section.
9.
SA VINGS CLAUSE. That Ordinance Number 1874, the Comprehensive Zoning Ordinculcc of tile City
of North Richland Hills, Texas, as runended, shall remain in full force and effect, save and except as
cunended by this ordinance.

10.
KFFECTIVE DA TE. This ordinance shall be in full force from and after its passage.
