Home My WebLink AboutOrdinance 0655 I , ORDINANCE NO. 655 AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF SECTION 167 AND 169 OF ARTICLE XIX, R.C.S. 6701d, UNIFORM ACT REGULATING TRAFFIC ON HICHWAYS, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION UPON 'CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF NORTH RICHLAND HILLS AS SET OUT IN THE ORDINANCE: AND PROVIDING A PENALTY OF A FINE NOT TO EXCEED $200.00 FOR VIOLATION OF THIS ORDINANCE. WHEREAS, Section 167 and 169 of Article XIX, R.C.S. 6701d, Uniform Act Regulating Traffic on Highways, provides that whenever the governing body of the City shall determine upon the basis on an engineering and traffic investigation that any prima facie speed there·· in set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part of a street or highway, with the City taking into considera- tion the width and condition of the pavement and other circumstances on such portion of said street or highway, as well as the usual traffic thereon, said governing body may determine and declare a reasonable &nd safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway, now therefore, BE IT ORDAINED by the City Council of the City of North Richland Hills, Texas: Section 1. Upon the basis of an engineering and traffic investigation heretofore made as authorized by the provisions of Section 167 and 169 of Article XIX, R.C.S. 6701d, Uniform Act Regulating Traffic on Highways, the following prima facie speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named streets and highways, or parts thereof, described as follows: Control 1978-1 Farm to Market Road 1938 Tarrant County f -- -2- A. From Station 90+39.4 (North Richland Hills-Keller City Limit) southerly 4.683 miles to Station 338+45 (approximately 5551 north of the centerline of Emerald Hills Way) at 55 miles per hour. 1. School Speed Zone - From Station 267+00 (approximately 660' north of Main Street) southerly 0.269 mile to Station 282+00 (approximately 760' south of Main street) at 35 miles per hour when so signed for school crossing, 55 miles per hour all other times. B. From Station 338+45 southerly 0.200 mile to Station 349+00 (approximately 551 north of Mary Street) at 45 miles per hour. C. From Station 349+00 southerly 0.920 mile to Station 397+56 (intersection with SH 121 Business) at 35 miles per hour. 1. School Speed Zone - From Station 356+50 (approximately 90' south of Lynda Street) southerly 0.294 mile to Station 372+00 (approximately 150' south of Clark Street) at 30 miles per hour when so signed for school crossing, 35 miles per hour all other times. Section 2. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not more than two hundred ($200.00) dollars. Section 3. All ordinances and part of ordinances in conflict herewith and expressly including Ordinance No. 563, shall be, and the same are hereby repealed. The map was revised to reflect a reduction in the 85 percentile speed from SH 121 to just north of Mary Street. A new city ordinance will be required for this section of highway. Also transmitted herewith are two copies of a typical speed zone or- dinance for your consideration. When the ordinance has been passed, please forward the original to this office.
