HomeMy WebLinkAboutOrdinance 1955 ORDINANCE NO. 1955 AN ORDINANCE REZONING PROPERTY IN ACCORDANCE WITH ARTICLE 2, SECTION 200, OF ZONING ORDINANCE NUMBER 1874, PASSED, APPROVED AND ADOPTED BY THE CITY COUNCIL ON MARCH 22,1993; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, after appropriate notice and public hearing, the following recommendation is submitted to the City Council of the City of North Richland Hills, Texas, by the Planning and Zoning Commission; and WHEREAS, the Planning and Zoning Commission of the City of North Richland Hills, Texas, has forwarded a recommendation to the City Council for amendment of Ordinance No. 1874 and the Official Zoning Map by rezoning certain property; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: 1. THAT, on Case Number PZ 93-23, the following properties shall be rezoned from AG Agriculture to R-2 Single Family Residential: ALL that certain tract or parcel of land situated in the William Cox Survey, Abstract No. 321, Tarrant County, Texas and embracing the westerly tract described in the deed to Sinaco Development, Inc. recorded in Volume 11278, Page 978, of the Deed Records, Tarrant County, Texas and described by metes and bounds as follows: BEGINNING at a 1/2-inch steel rod found for the northwesterly corner of said westerly Sinaco tract; THENCE South 89 degrees 59 minutes 58 seconds East with the northerly boundary line of said westerly Sinaco tract 98.14 feet to a 1/2-inch capped steel rod stamped "Moak Surv. Inc." being in the westerly right-of-way line of Hightower Drive; THENCE South 14 degrees 14 minutes 11 seconds West with said westerly right-of-way line 133.54 feet to a 1/2-inch capped steel rod stamped "Moak Surv., Inc." for the beginning of a curve to the right; THENCE with said curve to the right having a radius of 199.83 feet, a central angle of 37 degrees 31 minutes 06 seconds, an arc length of 130.85 feet and a long chord South 33 degrees 00 minutes 10 seconds West 128.53 feet to a 1/2-inch capped steel rod stamped "Moak Surv., Inc." for the Southerly corner of said westerly Sinaco tract; THENCE North 01 degrees 08 minutes 09 seconds East with the westerly boundary line of said westerly Sinaco tract 237.28 feet to the place of beginning and containing 0.3516 acres of land, more or less. AND ALL that certain tract or parcel of land situated in the William Cox Survey, Abstract No. 321, Tarrant County, Texas and embracing the easterly tract described in the deed to Sinaco Development, Inc. recorded in Volume 11278, Page 978, of the Deed Records, Tarrant County, Texas and described by metes and bounds as follows: BEGINNING at a 1/2-inch capped steel rod stamped "Moak Surv., Inc." for the northwest corner of said easterly Sinaco tract and being in the easterly right-of-way line of Hightower Drive from which a 1/2-inch steel rod found for the northwest corner of said westerly Sinaco tract bears North 89 degrees 59 minutes 58 seconds East 98.14 feet; THENCE North 89 degrees 58 minutes 41 seconds East with the northerly boundary line of said easterly Sinaco tract 90.80 feet to a 1/2-inch capped steel rod stamped "Moak Surv., Inc." for the northeast corner of same; THENCE South 00 degrees 32 minutes 00 seconds West with the easterly boundary line of said tract 388.94 feet to a 1/2-inch capped steel rod stamped "Moak Surv., Inc." for the southeast corner of said easterly Sinaco tract; THENCE North 89 degrees 38 minutes 25 seconds West with the southerly boundary line of said easterly Sinaco tract 186.15 feet to a 1/2-inch steel rod found for the southwest corner of same; THENCE North 19 degrees 28 minutes 37 seconds West with the westerly boundary line of said easterly Sinaco tract 101.36 feet to a 1/2-inch capped steel rod stamped "Moak Surv., Inc." being in the easterly right-of-way line of Hightower Drive and a curve to the left; THENCE with said right-of-way line and said curve to the left having a radius of 267.83 feet, a central angle of 38 degrees 02 minutes 13 seconds, an arc length of 177.80 feet and a long chord of North 33 degrees 15 minutes 37 seconds East 174.56 feet to a 1/2-inch capped steel rod stamped "Moak Surv., Inc."; THENCE North 14 degrees 14 minutes 11 seconds East continuing with said right-of-way line 142.60 feet to a a 1/2- inch capped steel rod stamped "Moak Surv., Inc." for the beginning of a curve to the right; THENCE continuing with said right-of-way line and said curve to the right having a radius of 634.00 feet, a central angle of 00 degrees 44 minutes 31 seconds, an arc length of 8.21 feet and a long chord of North 13 degrees 52 minutes 13 seconds East 8.21 feet to the place of beginning and containing 1.3561 acres of land, more or less. This property is generally located in the 7500 block of Hightower Drive. 2. THAT, the Official Zoning Map be redrawn to incorporate this zoning district boundary amendment and the herein described ordinance number be affixed to the property described herein. 3. SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the section, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. 4. SAVINGS CLAUSE. That Ordinance Number 1874, the Comprehensive Zoning Ordinance of the City of North Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. 5.
