Mayor Echols apologized for the inconvenience caused when the Special Meeting
of April 7th was advertised on cable t.v. as being at 7:30 p.m. when it was

Mayor Echols advised that he would like to depart from the regular agenda and
recognize Mr. Jim Nichols, 2829 Winterhaven, Baseball Commissioner of RYA.
Mr. Nichols stated that RYA would like to express their appreciation to Mr.
John Whitney for his efforts in getting the lights repaired at Richfield
Park. Mr. Nichols stated that RYA opened their 1986 baseball season at the
park today and Mr. Whitney was invited to throw out the game opening ball on
the Shelton and Mustang field. Mr. Nichols stated that RYA was also running
another program within their association for a boy who was one of the
baseball players, Greg McElyea, a leukemia victim. Mr. Nichols stated that
RYA was dedicating part of their season to him in an effort to help with his
medical needs and Mr. Whitney on his own dedicated a special gift of money.
Mr. Nichols stated RYA just wanted to show their appreciation.

Councilman Kenna stated this request was tabled at the last meeting because
of concern with the original ordinance that zoned the property. Councilman
Kenna stated the owner at that time had verbally said it would be used for
office, but in checking the records this stipulation was not placed on the
ordinance.
Councilman Fisher stated he felt he was wrong in voting to table the request
because it had created a hardship.
Mayor Pro Tem Davis stated that at the previous hearing there was a question
on whether there was adequate parking and after checking, the parking was
adequate.
Motion carried 7-0.

Mr. Line stated that the passing of this resolution would authorize the City
to sell four million dollars in water and seWer bonds to finance three major
projects in the city - (1) Beach Street Water Line - to provide an additional
source of supply and backup capability in the event of a major main break;
(2) Amundson Standpipe - to provide 6,000,000 gallon storage capacity at the
supply point from the main TRA input source at Precinct Line Road; (3)
College Hills Tank - to replace the existing tank that was beyond repair.
Councilman Kenna moved, seconded by Councilman Ramsey, to approve Resolution
No. 86-17.

Mrs. J.N. Walker, 7217 Riviera, appeared before the Council.
Mrs. Walker stated she was asking for a variance from the Brick Ordinance to
allow her to build a garage and storage bUilding. Mrs. Walker stated they
had torn down their old garage and were not aware they would have to brick it
when it was rebuilt. Mrs. Walker stated that she had checked and there was
not a brick building in her neighborhood. Mrs. Walker stated it would be an
added expense to brick the bUilding.
Councilwoman Moody stated Mrs. Walker had stated there were not any brick
bUildings in the area, was her house not brick.
Mrs. Walker stated that there were not any brick storage buildings in the
area.
Councilwoman Moody asked if she would consider building anything smaller.
Mrs. Walker stated the foundation to the old building was going to be used
and also they had three cars which she did not want to leave parked outside.

Councilman Kenna asked if the old building was the same size as the building
she wanted to build.
Mrs. Walker stated they had added 10 x 12 feet for storage facilities.
Mayor Pro Tem Davis stated he would like to remind the Council that there had
been a case about two blocks from this location where a nice barn-type
structure was built for a garage and it fit into the neighborhood. Mayor Pro
Tem Davis stated he felt this building would also fit into the neighborhood.
Mayor Echols stated that in the Staff's opinion the size building requested
exceeded the maximum 200 square feet and should be subject to the provisions
of the Ordinance.
Councilman Kenna moved, seconded by Councilwoman Moody, to approve GN 86-34.
Motion carried 6-1; Mayor Pro Tem Davis, Councilwomen Hinkle and Moody and
Councilmen Newman, Kenna, and Ramsey voting for and Councilman Fisher voting
against.

Mayor Pro Tem Davis moved, seconded by Councilman Ramsey, to approve PU 86-12.
Mr. Dick Boehler, 1420 Riverside Drive, representing Bowles & Edens, appeared
before the Council.
Mr. Boehler stated that when the Council gets recommendations from
purchasing, maybe they are a little bit lax in knowing the whole story, in
this case about water meters. Mr. Boehler stated he felt that based on the
experience that they had in North Richland Hills with this type of meter,
that he would like for the bid award to go to Bowles & Edens. Mr. Boehler
stated that his meter did meet AWA specifications and they were the low
bidder and that was the reason for his appearing tonight.
Councilwoman Moody stated she appreciated Mr. Boehler's time, but his company
did not meet the specifications according to the City Staff. Councilwoman
Moody stated that Mr. Boehler could talk all night and she was sorry but she
would not know what he was talking about. Councilwoman Moody stated she felt
that the City Manager had a very reliable staff and that the Council had to
depend on the Staff to make their recommendations to the Council.
Councilwoman Moody stated that the Council did not always award the bid to
the low bidder. Councilwoman Moody stated that for obvious reasons there was
also a certain set of specifications that had to be met and at the best price.

Mr. Boehler stated he understood that, but would like to say in defense that
maybe the City was a little lax in knowing what was available to write
specifications and that there were over 6,000 meters of this specification in
the City's system.
Councilwoman Moody stated she personally felt that the Council had to depend
on the recommendations of the Staff.
Mr. Boehler stated he did not disagree, his contingency was that the Staff
did not always know what was available and therefore could not write
specifications.
Mayor Pro Tem Davis asked how many Badger meters were located within the City.
Mr. Boehler stated there were probably 7,000 or 8,000 meters.
Mayor Pro Tem Davis stated that in looking at the bid specifications, Badger
was low bidder on all except the I 1/2 inch meters plus they had a twenty-
five year guarantee.
Mayor Echols stated that the Staff had made the decision to go with the
American Works Standard.
Mayor Pro Tem Davis stated that he had confidence that the Purchasing Agent
was going to get the City the best buy and if there was new equipment in line
then maybe that would be bid on next time.
Councilman Kenna stated he would recommend that Mr. Boehler get with the City
Staff next year at this time and if there was any educating that should be
done, maybe it could be done at that point. Councilman Kenna stated he did
not know how much time Mr. Boehler had to respond to the request for a quote
but thought it was a little late to be telling about the changes now.
Mr. Boehler stated Bowles and Edens has been a part of the City system before
and the only changes that had been made was in the seal register, the style
of register had been the same for 140 years.
Councilman Ramsey called for the question.
Motion carried 7-0.

Ordinance 1334
This Zoning Application is presented on a vacant tract of land located on the north side
of Green Valley Drive west of Davis Boulevard. The requested rezoning is from AG
Agriculture to R-8 Zero-Lot-Line Single Family. The purpose for the rezoning is to
allow the applicants to develop a single family zero-lot-Iine project.
The subject tract is immediately east of a tract also belonging to the applicant on
which an R-2 request is under consideration in this agenda. The area between the
subject tract and Davis Boulevard is currently zoned commercial. It is the applicant's
intent that this project provide a buffer between the residential property and the
commercial use.
The Staff noted in the review of this request that the proposed realignment of Bursey
Road as a four lane Collector Street will carry it through both the applicants tracts.
RECOMMENDATION:
The Planning and Zoning Commission recommended approval of Zoning Application PZ 85-147
requesting rezoning of Tract 4A1 and Tract 5, S. Richardson Survey, Abstract 1266 from
AG to R-8.

This Zoning Application is presented on the vacant tract of land located on the north
side of Green Valley Drive, west of Davis Boulevard and immediately east of the Green
Valley Raceway site. The requested rezoning is from AG Agriculture to R-2 Single Family
Residential. The applicants propose to develop the property into single family lots.
This tract of land was submitted earlier for rezoning to R-3 Single Family. The request
was denied by the City Council. The applicants resubmitted the current request in light
of that denial.
The adjacent property to the east of the subject tract was also submitted by the
applicant requesting R-8 Zero-Lot-Line Single Family. This case number PZ 85-147 is to
be heard on this same agenda.
RECOMMENDATION:
The Planning and Zoning Commission recommended approval of Zoning Application PZ 86-4
requesting rezoning on Tract 5, S. Richardson survey, Abstract 1266, from AG to R-2.

This Zoning Application is presented on the residential tract located on the northwest
corner of Glenview Drive and Ashmore Drive and adjacent to the Calloway Branch. The
requested rezoning is from R-2 Single Family residential to C-2 Commercial. The purpose
for the rezoning request is to allow the applicant to sell the property to a party who
wishes to construct an auto service center and parts sales area for a new automobile
dealership on the tract.
The Staff noted to the Commission that the property has a considerable exposure to the
flood plain of Calloway Branch. Any development of the subject tract will require that
the channel be improved and any structure built be placed at such an elevation as to
protect them from potential flooding.
The Staff also noted that the change in zoning, if approved, would represent an
intrustion into an existing established residential neighborhood which has, up until
this time, been well maintained. The rezoning of this tract could also establish a
precedent for further proposed commercial activity along this portion of Glenview
Drive.
RECOMMENDATION:
The Planning and Zoning Commission recommended that the rezoning request contained in
Zoning Application PZ 86-5 requesting a change from R-2 to C-2 on Tract IDA, W.W.
Wallace Survey, Abstract 1606 be denied. This hearing is in appeal of that denial.

Mr. Wood stated this was a tough issue
for the Commission. He said this
would be putting commercial next to
residential. Mr. Wood said he felt it
would go commercial some day, but he
was not in favor of it now.
Mr. Schwinger said he shared Mr.
Wood's concern. He said this is an
encroachment into the neighborhood.
Chairman Bowen stated he shared this
same concern. He said if the entire
frontage along Glenview came in as one
package, he would be in favor of it,
but he does not feel it feasible now.
Ms. Nash made the motion to deny
PZ 86-5. This motion was seconded bÿ·
Mr. Schwinger and the motion for
denial carried 4-0.
Chairman Bowen stated that Ms. Hunter
does have the right to appeal to the

AFTER APPROPRIATE NOTICE AND PUBLIC HEARING THE FOLLOWING RECOMMENDATION
IS SUBMITTED TO THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS BY
THE PLANNING AND ZONING COMMISSION:
RESOLVED that on Case No. PZ-86-5 the following described property shall be
rezoned from R-2 to C-2.
BEING 2.631 acres of land located in the W. W. Wallace Survey, Abstract
1606, City of North Richland Hills, Tarrant County, Texas, and also being a
portion of a tract of land conveyed to John Patrick Hunter, by the deed
recorded in Volume 1901, Page 487, Deed Records, Tarrant County, Texas.
Said 2.631 acres of land being more particularly described by metes and
bounds as follows:
BEGINNING at a n±n cut in concrete at the intersection of the North right
of way line of Glenview Drive with the West R.O.W. line of Ashmore Drive,
said n±n being 6 feet North of the Southeast corner of the aforementioned
Hunter tract;

This Final Plat Application is presented for consideration of Lot 1, Block 3, North 820
Commercial Addition. The property is located on the southwest corner of Rufe Snow Drive
and Northeast Loop 820. The subject tract contains an existing Exxon Service Station.
The purpose for the proposed plat is to create a subdivision of the previously unplatted
tract. The applicants wish to renovate the service station use on the subject tract.
In the Staff review of the proposed plat it was noted to the Commission that the
intersection of Rufe Snow Drive with the service road must be improved in the future to
facilitate the handling of the traffic. It was necessary to require an additional
dedication of right of way along Rufe Snow from the subject tract to accomplish this
future construction. Initially when the surveyor submitted the plat the right of way
dedication seemed to be a total width of 29 feet of additional property. A further
investigation by the Exxon Company has revealed that in 1969 the majority of this right
of way was acquired by the City and the actual additional dedication varies from seven
to eight feet.
All of the Engineer's comments have been satisfactorily answered.
RECOMMENDATION:
The Planning and Zoning Commission approved the Final Plat Application PS 86-5 of Lot 1,
Block 3, North 820 Commercial Addition as submitted.

We have reviewed the referenced materials for this subdivision and offer the
following comments:
1 The Owner's Acknowledgement and Dedication Statement and the Notary
Certification should be fully executed before approval of this plat.
2 The right-of-way of Rufe Snow Drive appears to be approximately 77 feet
wide at the southeast of this platting. The Thoroughfare Master Plan
proposes Rufe Snow Drive to be an M5U Minor Arterial, with a minimum
80-foot right-of-way. The existing and proposed right-of-way width
dimensions on Rufe Snow should be noted on the plat.
3 The existing sanitary sewer service connection location should be shown
on the utility plan sheet. We would note that the existing sanitary sewer
line which serves this site is a 6-inch diameter pipe. Since a minimum
8-inch diameter is required for commercial zoning, a variance for 6-inch
service is required. The closest 8-inch_sanitary sewer line to this lot
is located at Meadow lakes Drive and Lariat Trail which is about 1300 feet
away.
4 Please see our letter dated January 7, 1986, PS 85-103, regarding prorata
for future improvements of Rufe Snow Drive and for existing 8-inch water
line, also, regarding approval from State Highway Department for
improvements within highway right-of-way.
5 As a general reminder, the Developer or Owner should be made aware that
he is responsible for all provisions of the Subdivision Ordinance, Zoning
Ordinance, Water and Sewer Policies and Procedures, and all other
applicable City Development Codes unless specific discretionary variances
and exceptions are made and agreed upon by the Planning and Zoning
Commission and City Council, and covered in writing in the City-Developer
Agreement, if this proposed plat is approved. If no such specific
variances are provided then the Developer or Owner remains responsible for
all other Ordinance and Policy requirements as written in the regulatory
codes.

We have reviewed the referenced materials for this subdivision and offer the
following comments:
1 We would recommend that the name of this proposed subdivision be changed
from the Exxon West Addition to the North 820 Commercial Addition since
this development is contiguous with the North 820 Commercial Addition~
2 The right-of-way width of Rufe Snow Drive should be shown. The
Thoroughfare Master Plan proposes Rufe Snow Drive to be a M5U Minor
Arterial, with a minimum 80-foot right-of-way. We would note that it
appears the owner is dedicating enough right-of-way for future widening,
however. The owner should be required to escrow his prorata share for
future improvements of Rufe Snow Drive.
3 The owner should be required to pay his prorata share of the existing
8-inch water line in Rufe Snow Drive, if this has not already been paid.
We would estimate prorata a~ $5.50 per linear foot for one half of the
line.
4 In accordance with the Subdivision Ordinance requirements the Developer's
Engineer should affix the following certification to the drainage plan:
4.1 I, , a professional engineer registered in the
State of Texas, have prepared this drainage study in compliance
with the latest.published requirements and criteria of the City
of North Richland Hills, and have verified that the topographic
information used in this study is in compliance with said
requirements and is otherwise suitable for developing this
workable overall Plan of Drainage which can be implemented
through proper subsequent detailed construction planning.

5 The plan scale of the drainage and fire protection map should be noted on
the drawi ng .
6 Any driveway or other improvements within the highway right-of-way should
be approved by the State Highway Department.
7 Lone Star Gas Company should be contacted to establish the depth of the
existing 6-inch gas main which the proposed water line boring will cross.
The depth of this line should be noted on the profile of the Fire
Protection Line Extension drawing. Southwestern Bell should also be
contacted regarding their underground telephone line crossing. This line
should also be shown in,.the profile.
8 As a general reminder,the Developer or Owner should be made aware that
he is responsible for all provisions of the Subdivision Ordinance, Zoning .

Addition. The property involved is the City's Service Center Site located on the south
side of Watauga Road east of Rufe Snow Drive. The purpose for the proposed replat is to
dedicate the street right of way on the east side of the center property in order to
provide for the location of utilities for the site and to provide for the future
construction of the access street to be built along the east side of the site.
RECOMMENDATION:

THIS AGREEMENT IS MADE BY AND BETWEEN THE STATE OF TEXAS, acting by
and through the State Department of Highways and Public
Transportation, hereinafter called the State, and the City of
N. Richland Hills ,hereinafter called the City, acting by and
through its duly authorized City Manager .
WHEREAS, the State's Commission Minute Order Number 82606 authorizes
the State to launch an extensive, ongoing campaign designed to educate
the people of Texas concerning the detrimental effects of littering
and to exhort every citizen not only not to litter, but also to become
active participants in the litter reduction campaign; and,
WHEREAS, the State has determined that local emphasis on litter enforce-
ment and related activities will favorably impact the State's litter
reduction campaign; ,
NOW, THEREFORE, premises considered, the State and the City do
mutually agree as follows:
1. This agreement becomes effective when finally executed by both
parties and shall termi nate on one year from that date unless otherwi se
terminated as hereinafter provided.
2. The State will identify those locations on State highway rights of
way within the city limits that have'consistently high litter volumes,
and the City will include these locations in its enforcement activi-
ties. The City will further utilize free media space and time to the
extent available to publicize its enforcement activities.
3. The State will compensate the City only for those citations issued
for litter violations on State Highway rights of way. The basis for
compensation is $20.00 per litter citation, provided, however, that
said total amount payable to the City under this contract shall not
exceed $ 12,500.00 '
4. To request compensation, the City will submit the original and two
copies of the State's Form 132 Billing Statement to the following
address: State Department of Highways and Transportation,
P. O. Box 6868, Fort Worth, Texas 76115

The City must summarize its activities to show the number of citations
issued during the billing period, the location of the violation, and
the date issued. A copy of each citation must be attached to the
Billing Statement. The billing periOd may not be more frequent than
monthly nor less frequent than quarterly. The State will make payment
to the City within thirty days after receipt of properly prepared and
executed Billing Statements.

5. This agreement may be tenminated before the stated completion date
by either party giving notice one to the other stating the reason for
termination and the effective date of tenmination. Should this
agreement be so tenminated, the State will pay the City for citations
described above not preiious1y paid by the Statê.
6. This agreement may be modified only by a written supplemental
agreement signed by the parties hereto prior to the modification
becoming effective.
7. The City shall hold hanm1e-ss· the State from all claims and 1iabil-
ity due to activities of its agents or employees, perfonmed under this
contract or which result from an error, omission, or negligent act of
the City or of any person employed by the City. The City shall also
save harmless the State from a~ and all expenses, including attorney
fees which might be incurred by the State in litigation or otherwise
resisting said claim or liabilities which might be imposed on the
State as the result of such activities by the City, its agents or
employees.

In recent months the Planning and Zoning Commission has found it difficult to gather the
full Commission membership together for its regular scheduled meetings. For several
reasons the Commission has had one or more of the members absent at each of the
meetings. Although the Rules and Procedures of the Commission state that a minimum
quorum is three members, the Commission has felt that the citizens who appear before the
Commission should have the benefit of the full body to make the necessary decisions.
The Chairman of the Planning and Zoning Commission recently presented the City Council
with the proposal that a second alternate position be created on the Commission. This
proposed alternate would function in the same manner as the existing alternate member,
that they would fill the place of and act in the stead of the absent members of the
Commission.
Acting upon the City Council's authorization the Staff has drafted the attached
Ordinance No. 1358 adding a second alternate position to the Planning and Zoning
Commission.
RECOMMENDATION:
It is recommended that City Council approve Ordinance No. 1358 revising the membership
of the Planning and Zoning Commission by adding the second alternate position.

WHEREAS, by Ordinance No. 955 the City Council created the office of
one additional member of the Planning & Zoning Commission; and
WHEREAS, in order to be able to have a full five member Commission
present for hearings, the City Council deems it necessary to create an
additional alternate member position on the said Planning & Zoning Commission;
NOW, THEREFORE BE IT ORDAINED by the City Council of the City of
North Richland Hills, Texas, that:

Section 3 of Ordinance No. 955 be and is hereby amended to read as
"3. In order to facilitate procurement of a quorum at Commission
meetings there is hereby created the offices of two alternate members of the
Planning & Zoning Commission, to be known as Alternate 1 and Alternate 2. The
alternate members may attend all meetings but shall be entitled to vote only .
in the event that one or more members are absent. In the event of the absence
of one regular member, Alternate 1 only may vote. In the event of the absence
of two or more members, Alternates 1 and 2 may vote. Such alternates shall
serve one year terms to be appointed in May of each year to serve for the said
one year term and until their successors are duly appointed and qualified."

The City of North Richland Hill's Auditors (Peat, Marwick, Mitchell, & Co.) have commented
in the Management Letter for the past two years that a detailed analysis should be
conducted to. document the Administrative Fee that is transferred annually from the Utility
Fund to the General Fund. The Utility Fund currently transfers $500,000 to cover
estimated overhead costs associated with activities performed by the General Fund for
Utility Fund purposes. A brief analysis conducted internally by staff revealed
approximately $650,000 as a prorated share of overhead that can be logically attributed to
the Utility Fund. A more detailed study could possibly reveal a larger amount. It is
essential that overhead services and costs be fully and accurately assessed to the Utility
Fund so that the General Fund does not subsidize the cost of Utility services.

Corporation to be Used as a Water Line Easement

The City Staff has been negotiating with Lone Star Gas Company for some time to
purchase their pipeline and easement generally extending from Jackie Lee Street and
Glenview in North Richland Hills west to Beach Street in Haltom City. The easement is
needed to assure a route for the additional major water supply line from Fort Worth.

When we first started negotiating with Lone Star Gas we had ideas of slip lining their
pipe with a PVC liner to provide a water line without having to dig except in a few
locations. However, the State Health Department has ruled against such a project
because they felt there was a possibility of leaching from the gas pipe into the water
pipe. The Staff pursued this matter further and it is our opinion that we should still
purchase this easement from Lone Star Gas. The most important of the easements is the
easement labelled "2" which crosses the Diamond Oaks Country Club. After we cross _
under one lot in Diamond Loch and go across the Diamond Oaks Country Club we will be in
street right-of-ways to Beach Street.

The Beach Street Water Line Project is a proposed project to be completed with th~sale
of the 1986 Revenue Bond Series. However those funds are not available until June
1986, but sufficient funds are in Utility Unspecified. This would require the

ENSERCH CORPORATION, a Texas Corporation, located at 301
South Harwood, Dallas, Texas 75201, (hereinafter referred to as "SELLER"
and/or "ASSIGNOR"), for and in consideration of the sum of Twelve Thousand,
Nine Hundred Eighty-five and No/IOO Dollars ($12,985.00) cash in hand paid by
City of North Richland Hills, located at 7301 N. E. Loop 820, North Richland
Hills, Texas 76118, (hereinafter referred to as "BUYER" and/or "ASSIGNEE"), has
bargained, sold, and delivered, and does by these presents bargain, sell, and
deliver, subject to the terms and conditions set out below, unto the said BUYER,

feet of SELLER'S 16-inch pipe, known and designated as former Line C, now
North Richland Hills and Haltom City Distribution (from the West right of way

Pipeline Station No. 183+90 and Pipeline Station No. 313+75, being further
located in the G. B. Stanley Survey, Abstract No. 1378; the William, Screech
Survey, Abstract No. 1416; the Heirs of S. Sawyer Survey, Abstract No. 1424'; the
\ViUiam N. Triß)ble Survey, A·bstract No. 1520; and the R. T. Barton Survey,..
Abstract No. 175, Tarrant Count~, Texas.
This sale is made with the express understanding that there is NO IMPLIED
WARRANTY THAT THE GOODS SHALL BE MERCHANTABLE NOR AN

pipeline and the removal of same in whole or in part, insofar and only insofar

Andrews, to Lone Star Gas 4,Company' of Fort
\Vorth covering 110 acres of land, more or less,
out of the M. Lynch Survey, Tarrant County,
Texas, recorded in Volume 549, Page 19, Deed
Records of said County and State.
ENSERCH CORPORATION hereby assigns its rights to the Easement described
above only as to that portion of the existing abandoned 16-inch pipe located
\Vest from the West property line of the Birdville Measuring Station for a
distance of approximately 1,763 linear feet. It is specifically provided that
ASSIGNOR (SELLER) does not assign its rights to any other portion of the
Easement described above.
For the same consideration herein stated, ENSERCH CORPORATION
has transferred and assigned and by these presents does transfer and assign, unto
the said ASSIGNEE (BUYER), all of its rights, titles and interest in and to those
certain right of way and easement grants as set out and listed on the Exhibit
'A' attached hereto and by reference made a part thereof;
This assignment is made by ASSIGNOR (SELLER) without recourse
and without warranting, either express or implied, the validity of the RIGHTS
OF \VA Y AND EASEl\IENT GRANTS SET OUT HEREIN.
ASSIGNEE (BUYER) accepts this assignment with all defects of title,
irrespective of whether such defects appear of record, and agrees to assume nnd
fill 311 conditions and obligations set out in the rights of way and easement
grants set out herein.
It is the intent of ASSIGNOR (SELLER) to convey its pipeline and
facilities and whatever rights it mny hüve, all without warranty, and only those
rights set out above, to the ASSIGNEE (BUYEH).

and assigned from and after the date of this Assignment of Rights of Way and
Easements .and Bill of Sale.

Approval of Change Order for Fuel System at the Agenda Number: PW 86-14
Municipal Complex
Subject:
The fuel control system at the municipal complex was not included in the original
contractors bid. The fuel system for the complex with other equipment was funded out of
Revenue Sharing Funds approved at a subsequent Council Meeting.
At this time the contractor is ready to install the new tanks, plumbing, pumps and the
fuel island. We do not have the exact amount that is involved in this change order but
it will be available by Tuesday nights meeting. The approximate amount of this change
order will be $49,698.24.
Recommendation:
The staff recommends approval of the change order for the fuel control system at the
municipal complex.

Rone Engineering was retained to perform tests on this street, and
the final payment Was withheld until we could get the results of
this testing. The Engineer's letter dated April 24th does not
recommend assessment of penalties as a result of these tests.
A check of the contractor's time was made and it was found that
they overran by 37 days without any legitimate excuses. Therefore,
liquidated damages in the amount of $9,250 will be assessed.
Recommendation:
The staff recommends approval of payment to Austin Road Company in
the amount of $38,088.ll less $9,250 for liquidated damages which
brings the total amount payable $28,838.11.

Enclosed is one copy of Contractor's Final Pay Estimate No.6, dated March 27, 1986,
made payable to Austin Road Co., in the amount of $38,088.11, for materials fur-
nished and work performed on the referenced project as of August 25, 1985.
This project includes paving, drainage and utility improvements on Glenview Drive
from Honey Lane to Rufe Snow Drive.
The quantities and condition of the project have been verified on-site by your
representative, Floyd A. McCallum, as indicated by signature on the estimate, and
we have checked the item extensions and additions. If the Public Works Department
is satisfied that trench density control and subgrade settlement problems have been
resolved, then we would recommend approval of final payment.
Contractor earnings for this project total $26~,12B.77 which is $15,922.45 under
- the contract amount of $279,051.22 based on Contract unit prices and original esti-
mated quantities of construction. Some of the items provided in the Contract were
eliminated such as top soil, seeding, and part of the proposed utility adjustments
which were not required. Please see the attached "Project Status Report" for a
complete list of as-built quantities. .
In accordance with Section 3.2.11(a) of the Contract, the two (2) year term of main-
tenance will begin on this date, and therefore, will terminate on March 31, 1988.
The maintenance obligation includes repair of all water line leaks and malfunctions
of all valves, fire hydrants, and other equipment furnished and installed under this
Contract. The maintenance obligation also includes sealing of pavement cracks, re-
pair of pavement buckling or other failures resulting from backfill settlement or
other subgrade failure, along with failure of all concrete flatwork and other Con-
crete structures.
The total time of completion was 202 calendar days, based on a "Substantial Com-
pletion Date" of August 25, 1985, as confirmed by your Owner's Project Representa-
tive, which is 37 days over the Contract completion time of 165 calendar days.
As covered in Section 3.2.12 of the "Information for Bidders", liquidated damages
are set at $250.00 per day, therefore, based On the 37 day over run, liquidated
damages for this project total $9,250.00.

HARWOOD ROAD AND GLENVIEW DRIVE,
SUB-SURFACE TESTING
Construction on the two captioned projects, Harwood Road and Glenview
Drive, has recently been completed by Austin Road Paving Company. Cracks
have formed in portions of the pavement and evidence of possible subgrade
failure exists. Rone Engineers, Geotechnical Consultants, have performed
tests in the area of the cracks and have prepared a report on their
findings (see attached report). The proJect limits on Harwood Road extend
from Bob Drive to Grapevine Highway, and the limits on Glenview Drive
extend from Dawn Drive to Rufe Snow Drive.
The tests indicate that the subgrade materials, at the limited locations
tested, are not completely stabilized. The report suggests that not
enough lime was used or the lime was not thoroughly mixed as required to
provide uniform stabilization. High mOisture content in the soils below
the stabilized subgrade was also reported. The source of the moisture is
not known. The cracks which have formed are located in the vicinity of
new waterline construction and such cracks could be caused by settlement
of the backfill materlals in the water}lne excavations.
The report is not conclusive regarding the exact cause of the cracking.
Further testing is requlred to determlne the full extent of the subgrade
conditions, and additional testing on the possiblity of water line leaks
is also required. Meanwhile, the cracks should be sealed to prevent
additional excessive moisture from filtering into the subgrade thus
causing additional instablllty of the subgrade soils.
We would recommend additional testing and monitoring of the pavement if
other cracks appear. The maintenance obligation by the Contractor covers
20 perc~nt of the total contract amount which is $67,365.01 on Harwood
Road and $55,810.24 on Glenview Drive. This obligation covers repair of
all pavement cracks or other failures for a period of 2 years after the

If you choose to recommend flnal payment by the Council to the Contractor
for these two projects, then the Contractor still remains responsible for
correcting any future pavement problems which may occur within the
warranty period outlined above.
In the absence of any evidence that further major pavement cracking or
failure appears imminent, we would recommend final payment to the
Contractor as covered in our letters dated January 13, 1985, for Harwood
Road, and April 1, 1986, tor Glenview Drive.

The reason for delaying the final payment on this job is that there appeared to be some
paving failures on this particular job, and we had Rone Engineering do some testing.
The engineer's letter dated April 24th, attached, does not recommend penalties as a
result of these tests. We were also waiting for the contractor to submit his work log
to check out the apparent 150 days overrun in time of the contract, as indicated in the
engineer's letter. It was found that the delays were caused by utility companies and
therefore not subject to the contractor's control.
Funding Source:
The original budget allotted to the Harwood Street and Drainage Project was
$333,683.00. Based on actual materials installed and the extra culvert concrete,
transition HMAC, and drainage inlets required by State the total cost associated with
the contract was $338,900.76. The associated cost overrun would require a transfer of
funds from CIP Unspecified as follows:

project are drainage culvert improvements on a tributary of the Walker's
Branch channel at Harwood and Grapevine Highway.
The quantities and condition of the project have been verified on-site by
your representative, Floyd McCallum, as indicated by signature on the
estimate, and we have checked the item extensions and additions. It is
our understanding that the City forces have monitored trench density
control and in the absence of any negative reports, we would recommend
approval of final payment.
Contractor earnings for this project total $338,900.76 which is $2,075.73
over the original contract amount of $336,825.03. Most of the over-run
cost is associated with extra culvert concrete, transition HMAC, and water
valve box adjustments, as noted on the attached "project Status Report".
In accordance with Section 3.2.11(a) of the contract, the two(2) year term
of maintenance will begin on this date, and therefore, will terminate on
January 13, 1988. The maintenance obligation includes repair of all water
line leaks and malfunctions of all valves, fire hydrants, and other
equipment furnished and installed under this contract along with stonm
sewer line breaks or stoppage. The maintenance"obligationalso includes
sealing of pavement cracks, repair of pavement buckling or other failures
resulting from storm drain backfill settlement or other subgrade failure,
along with failure of all concrete flatwork and other concrete structures
such as stanm drain vaults and inlets.

The total time of completion was 330 calendar days and the contract
completion time is 180 calendar days. Although we have not received a
written request from the Contractor for extension of the contract
completion time, substantial delays were caused by utility companies in
relocation of conflicting facilities. Tthe Contractor is obligated to
furnish a log to the City accounting for delays caused by utility
companies or others~ Liquidated damages for this project are $300.00 for
each day over the "Substantial Completion Date" in accordance with section
3.2.12 of the contract documents.
We recommend that the final payment, in amount of $35,962.02, less any
liquidated damages which may be set by the Public Works Department, be
made to Austin Road Co., P.O. Box 2285, Fort Worth, Texas 76113.
We will be present at the next Council Meeting to answer any questions you

SUBJECT: Request of Marcus A. Noble regarding driveway problem
at 7601 Doris Court.
Mr. Marcus A. Noble, 5620 Ammons Drive in Haltom City, is having a residence
constructed at 7601 Doris Court in Fox Hollow Addition. In the process of
setting up the driveway for the residence it was discovered that there is an
existing storm drainage inlet in the center of the lot on the Doris Court
frontage. This location dictated that the driveway for the house had to be
modified. The Staff discussed with Mr. Noble several alternatives for
modifying the location and/or design of the proposed drive. The alternative
which the Staff could approve was a slight dog-leg bend of the drive and the
placement of the drive approach on the east property line of the lot. This
would allow the driveway to be constructed without interfering with the
location or function of the existing storm drain inlet. Mr. Noble was not
satisfied that this was the only solution. He has requested a hearing before
the City Council to explore other alternatives:
Several other alternatives have been suggested by Mr. Noble:
1. A circular drive was proposed which would have a drive approach on
either side of the offending inlet. The Staff could not agree to this
alternate since the western drive approach would be too close to the
intersection of Holiday Lane and would promote dangerous traffic movements
at the intersection.
2. Mr. Noble also proposed that the City allow him to construct an
additional driveway on the Holiday Lane side of this lot. This could not be
approved because of the Major Collector Street status of Holiday Lane. When

the street is widened to four lanes the traffic will be such that it will be
unsafe to allow cars to back out onto Holiday Lane. In addition the
Thoroughfare Plan specifically states that all driveway openings from
residential lots should be discouraged unless there is no viable alternative.

3. Mr. Noble also suggested that the City was in error in allowing the
inlet to be placed in front of his lot and that the City should have the
inlet moved either at the City's expense or at the expense of the original
developer of the subdivision. The Staff can find no justification of this
position. The inlet location was determined on the basis of an overall
drainage design which was constructed by the developer and inspected and
approved by the City.
