4. Councilman Ramsey moved, seconded by Councilwoman Moody, to
approve the minutes of the regular meeting of January 28,
1985.

5. Mayor Echols removed item #19 from the Consent Agenda.

6. Councilman Kenna moved, seconded by Councilwoman Hinkle, to
approve the Consent Agenda.

Motion carried 6-0.

Mayor Echols opened the public hearing and called for anyone
wishing to speak in favor of this request to please come
forward.
Mr. Bud Austin, 805 Grapevine Highway, appeared before the
Council.
Mr. Austin stated they felt R-2 zoning,was the best use of
the land. Mr. Austin stated they had changed the radius of
Bursey Road from 500 to 700 foot radius.
Mayor Echols called for anyone wishing to speak in opposition
to the request to please come forward.
Mr. Bill Mabry, 7524 Bursey Road, appeared before the Council.
Mr. Mabry stated that he lived south of the property in
question. Mr. Mabry stated that in his opinion the property
would be ideal for a first class addition. Mr. Mabry stated
he felt the lots were too small and there was already enough
R-2 and R-3 in the area. Mr. Mabry stated he would like to
see it zoned R-1. Mr. Mabry stated that the smaller houses
were not needed.
Mr. Dale Edding, 8009 Valley Drive, appeared before the Council.
Mr. Edding stated he had lived in the area 12~ years and had
selected the area for his family to grow in. Mr. Edding stated
that R-1 zoning would attract more people to the area.
There being no one else wishing to speak, Mayor Echols closed
the public hearing.
8. Mayor Pro Tem Davis asked Mr. Austin if he would be in favor
of keeping the R-2 lot size and building 1,800 square foot
houses.
Mr. Austin stated he would not object to 1,800 square foot
houses however he would like to keep the R-2 zoning.
Mayor Pro Tem Davis moved, seconded by Councilman Kenna, to
approve PZ 85-1B, Ordinance No. 1178, with the stipulation
of a minimum of 1,800 square foot houses.
Councilman Ramsey stated that he felt the Council was
getting away from the Zoning Ordinance by stipulating the
size of the houses and he thought that was what the Zoning
Ordinance was for.

Mayor Pro Tem Davis stated he was not trying to make the
zoning request lesser, but increasing it for a more
compatible buffer.
Councilman Ramsey stated that he could foresee a problem
with this kind of density and the race track still being in
existence. Councilman Ramsey stated he could see the City
getting into a situation like lots of communities have, like
who was there first. Councilman Ramsey stated he did not
understand Bursey Road coming down into a cul-de-sac.
Mayor Pro Tem Davis stated that according to the Planning
and Zoning minutes Bursey Road was a main concern of the
Staff and Planning and Zoning Commission.
Councilman Ramsey stated he saw it as a piecemill effect.
Councilman Ramsey stated he saw it as getting the zoning up
front and then the City was committed to a plan that he was
not ready to commit to.
Councilman Kenna called for the question.
Motion carried 4-3; Mayor Pro Tem Davis and Councilwomen
Hinkle and Moody voting for; Councilmen Ramsey, Fisher and
Kenna voting against; Mayor Echols voting for to break the
tie.

9. Mayor Echols opened the public hearing and called for anyone
wishing to speak in favor of the request to please come forward.
Mr. Scott Steward, 3921 Vance Road, appeared before the Council.
Mr. Scott stated he wanted to build single family R-2 homes
and was present to answer any questions the Council might have.
Mayor Echols called for anyone wishing to speak in opposition
to the request to please come forward.
There being no one else wishing to speak, Mayor Echols closed
the public hearing.
10. Councilman Kenna moved, seconded by Councilman Fisher, to
approve PZ 85-3B, Ordinance No. 1179.

Council.
Mr. Beane stated he would like to have the property zoned for

Councilman Kenna asked if the property would consist of three
lots.
Mr. Beane replied yes.
Mayor Echols asked Mr. Beane if he was Willing to grant right-
of-way for Smithfield Road.
Mr. Beane stated yes.
Mayor Echols called for anyone Wishing to speak in opposition
to the request to please come forward.
There being no one else wishing to speak, Mayor Echols closed
the public hearing.
12. Mayor Pro Tem Davis moved, seconded by Councilwoman Hinkle, to
approve PZ 85-4B, Ordinance No. 1180.

15. Mayor Echols presented the following information:
"Venture Outdoor Advertising has submitted an application for
the erection of a billboard sign on the north side of Airport
Freeway on Lot 1, Block 5, Richland Oaks Addition. The tract
currently contains a vacant restaurant. The address of the
property is 8701 Airport Freeway. The staff has verified that
the proposed location meets or exceeds all the criteria for
locating billboards as contained in the Sign Ordinance".

Mayor Pro Tem Davis moved, seconded by Councilwoman Moody,
to deny the request for a billboard permit.
Councilman Ramsey asked the reason for denial if the
billboard application met all the criteria.
Mayor Pro Tem Davis stated that even though it met the
criteria, just to the west there was a large sign for
Texian-Inn, up on the hill the bank had a big sign and he
felt the freeways and highways were getting cluttered enough.
Mayor Pro Tem Davis stated he had found out that in the last
few months some of the neighboring cities had taken some
action on ordinances on billboard, etc. Mayor Pro Tem Davis
stated that it seemed every time a billboard permit was
granted the City regretted it later on.
Councilman Kenna stated he was also getting a little tired
of seeing the billboards, but felt the only recourse was to
change the Sign Ordinance. Councilman Kenna stated he could
see no legal grounds for denial.
Mayor Pro Tem Davis stated the Council did have discretion-
ary powers, if they felt it was not in the best interest of
the City.
Councilwoman Moody stated she agreed with Mayor Pro Tem
Davis that the area was getting highly congested.

Councilman Ramsey stated that Mayor Pro Tem Davis and
Councilwoman Moody's points were well taken, but did not
think they were persuasive. Councilman Ramsey stated that
just because he was voting for a billboard did not mean he
was for all billboards. He stated there was an ordinance and
if the staff told him it met the requirements, then so be it.
Councilman Fisher stated he was not in favor of billboards
all up and down Loop 820 but this one was in compliance with
the ordinance.
Motion to deny failed by a vote of 2-4; Councilwoman Moody
and Mayor Pro Tem Davis voting for; Councilmen Kenna,
Ramsey, Fisher and Councilwoman Hinkle voting against.
Councilman Kenna moved, seconded by Councilman Ramsey, to
approve the billboard permit.
Motion carried 5-1; Councilmen Fisher, Ramsey, Kenna and
Councilwomen Hinkle and Moody voting for; Mayor Pro Tem
Davis voting against.
16. Mayor Echols presented the following information:

'--
"Councilwoman Virginia Moody has requested that the City
change official newspapers from the Mid-Cities Daily News to
the Star Telegram. Attached is the most recent price quotes
from each newspaper. Based on 1983-84 data, our legal
advertising bill to the Mid-Cities Daily News was $3,941.31.
During the same period of time our Star Telegram bill would
have been approximately $30,000."
Councilwoman Moody stated that she was negotiating as late
as Friday night and would like to apologize to the Council
for not having all of the information needed.
Councilwoman Moody moved to postpone action on this item.
Motion died for the lack of a second.
Councilwoman Moody presented the following information.
"I have talked with most of you over the week-end and
apologized for not having my material ready for your
packets. I believe we all share a concern for keeping
the channels of communication open between City Hall and
the citizens of NRH, and with this thought in mind I
would appreciate your consideration of the following facts:

Our 1983/84 records reflect that we spent $3,941.31 for legal
notices in the Mid-Cities Daily News, or 1,313.77 column
inches at $3.00 per column inch. This same 1,313.77 column
inches if published in the Star Telegram would have cost
us $9,196.36 or $5,255.05 more at their rates of $7.00
per column inch. Circulation of Mid-Cities - 1,200 or
3% of population; Star Telegram - 14,000 or 40% of population.
I will be asking for a postponement tonight so that we might
have sufficient time to explore any and all avenues available
to us and in the hope this can be a joint effort on the part
of the Council.
Did not get a chance to check Dallas papers that service our
area."
Mr. Al Mann, 813 Vale, Euless, Representative of the Mid-
Cities Daily News, appeared before the Council.
Mr. Mann stated the reason he had asked to speak was because
he realized there had been a problem with circulation in the
City. Mr. Mann stated he would like to bring forth some
data that was being done to correct the circulation problems.
Mr. Mann stated that in December of 1984 Mid-Cities had received
124 complaints in the North Richland Hills area, which was 7%
and since that time in changing circulation and District
Managers it had been reduced to 52 in January, this month it was
running 1%. Mr. Mann stated that at the last check most of
the problems they had been having had been taken care of.

Mr. Mann stated the daily circulation figures for North
Richland Hills was 1,400 and 2,400 on Wednesday. Mr. Mann
stated they did ask that North Richland Hills maintain
Mid-Cities Daily News as their legal paper.
Mayor Pro Tem Davis stated that the numbers that were offered
were not offered to the Council. Mayor Pro Tem Davis stated
the Council did not authorize to seek bids.
Mayor Pro Tem Davis stated that he received the Mid-Cities
and felt they did cover North Richland Hills activities
satisfactorily. Mayor Pro Tem Davis stated he wanted to
maintain the Mid-Cities as the City's official newspaper.
Councilwoman Moody stated this was not a campaign against the
Mid-Cities. Councilwoman Moody stated her major concern was
that the citizens be informed. Councilwoman Moody stated
that when the City published information on the proposed
Master Plan so few of the citizens received the Mid-Cities
and the majority of the citizens were not aware of it until
it was too late.
Councilwoman Hinkle stated her concern was the cost
difference and felt the City should maintain the Mid-Cities
Daily News as the official newspaper.
Councilman Kenna stated he felt the Mid-Cities had given the
City good coverage and would prefer to keep them as the
official newspaper.
Councilman Ramsey stated he felt that what Councilwoman Moody
was trying to bring to attention was that there must be a way
to reach everyone in the community. Councilman Ramsey stated
that frankly he felt that the Star Telegram or the Mid-Cities
miss that. Councilman Ramsey stated he did not feel they
were reporting what was going on in the community very
objectively, writers kind of took their own viewpoint on how
they see it. Councilman Ramsey stated he felt Councilwoman
Moody ha a valid point on wanting to reach out through some
sort of media, but he did not see that on the horizon for the
Mid-Cities or the Star Telegram. Councilman Ramsey stated he
was not willing to vote to pay an additional increase knowing
what it was going to buy.
Councilman Fisher stated he did support Councilwoman Moody in
the data reaching the citizens, but he often wondered how
many people read the legal advertising ads. Councilman
Fisher stated he was in favor of staying with Mid-Cities.
Mayor Pro Tem Davis moved, seconded by Councilman Ramsey, to
leave the Mid-Cities as the City's official newspaper.
Motion carried 5-1; Councilmen Kenna, Ramsey, Fisher, Mayor
Pro Tem Davis and Councilwoman Hinkle voting for;
Councilwoman Moody voting against.

19. Mayor Echols advised the Council that Councilwoman Moody had
requested that she be replaced as a voting member for CONET
and requested the Council appoint a new voting member.
Mayor Echols advised that Mr. Dennis Horvath was the alternate
member to vote in Councilwoman Moody's absence.
Mayor Pro Tem Davis moved, seconded by Councilman Kenna, to
postpone the appointment with the understanding that Mr.
Horvath would furnish the Council with minutes of the past
meetings of CONET.
Motion carried 5-1; Councilmen Kenna, Fisher and Mayor Pro
Tem Davis and Councilwomen Hinkle and Moody voting for;
Councilman Ramsey voting against.

25. Mr. O.K. Carter with the Star Telegram, appeared before the
Council.
Mr. Carter introduced the new reporter for North Richland
Hills, Mr. Chris Williams. Mr. Carter stated the Star
Telegram had planned some changes in the coverage of North
Richland Hills and thought there might be questions from the
Council and he was here to answer any questions.
Councilwoman Hinkle asked what type of changes were going to
be made.
Mr. Carter stated the Star Telegram circulation had been
growing so rapidly in the area and the neighborhood extra was
circulated to about 250,000 people and they felt they were
going to have to redefine what the neighborhood was. Mr.
Carter stated they planned to break the neighborhood into two
parts, both of which would come out twice weekly. Mr. Carter
stated this would take place in early March.

Mayor Echols asked if it would be divided by zip codes.
Mr. Carter stated they would not divide any city, this
particular area had school districts and chambers that were
compatible to it, but there were some zip codes that were
split. Mr. Carter stated there would be no city that got the
neighborhood and another part not.
Councilwoman Hinkle asked if the only section North Richland
Hills would get would be the Haltom/Richland area.
Mr. Carter stated that they estimated that about 70% of the
advertisers would be both Haltom/Richland and Hurst/Bedford.
Mr. Carter stated there would be no change in the coverage of
the city governments and school districts.
Councilman Ramsey stated that Haltom/Richland and Hurst/
Bedford was one big area and people had been working and
striving to pull it together and now the Star Telegram was
coming in to try and split it apart. Councilman Ramsey
stated they did not print enough about North Richland Hills
now and they never showed up at the Council meetings.
Mr. Carter stated it was difficult to have a neighborhood
with 100,000 subscribers.

that one concern over the split up was the City had worked so

the mid cities area. Councilwoman Moody stated she felt it
would create a lot of problems to split it up.
Mayor Echols thanked Mr. Carter for taking the time to
discuss this with the Council.

Cross Survey, Abstract 281, & Tract 3,
William Cox Survey, Abstract 321, from
their present classification of AG
(Agriculture District) to C-1
(Commercial District). This property
is located on the east side of Davis
Boulevard, approximately 300 feet
north of Odell Street.
Delbert Stembridge, Consulting
Engineer, came forward to represent
Mr. & Mrs. Spencer. He stated this
property fronts on Davis which is not
good for residential. He said the
tract to the north of this property is
already commercial and there is
commercial across the street, also.
Mr. Stembridge said they feel that
commercial is the highest and best use
of the land. He said they would have
a screening fence around the property.
Mr. Stembridge said they had been
contacted by a prospect who wishes to
build a shopping center on this
property.
Chairman Tucker asked if they plan to
develop the property.
Mr. Stembridge said if they get the
zoning, they have a contract to sell
the property.
Chairman Tucker called for those
wishing to speak in opposition to this
request to please come forward.
Mr. Don Chaille, 8405 Timberlane
Court, came forward. He said he was
representing himself and 16 households
or 59% of the property owners within
200 feet of the property in question
who oppose this zoning request.

Mr. Chaille stated they had submitted
a petition within 200 feet and another
one with 180 signatures not within the
200 foot radius who also oppose this
request.

Mr. Chaille stated they oppose the
request for a number of reasons which
relate directly to the value of their
investment in their homes, potential
physical damage to their property, the
safety and security of their families,
and the overall quality of life which
they now enjoy and are determined to
maintain. He said the map of the area
shows that the property in question as
well as the property north of it,
which is already zoned commercial, is
adjacent to or in close proximity to
two of the nicest residential
developments on the entire city. Mr.
Chaille said the property values of
the homes in this area on both side of
Davis Boulevard will suffer with
commercial development. He said what
they face is a handfull of individuals
will make a great deal of money on the
sale and development of this property
at the expense of hundreds of
residents who live there 365 days a
year. He said these residents will be
left holding the bag with not only
depressed property value, but a
dramatic decline in every aspect of
the quality of life which will be
endured every day of the year.
Mr. Chaille stated the quality of life
in regard to their homes and
surrounding area encompasses many
things: 1. Increased traffic
congestion. He said the increased
traffic on Davis Boulevard in the past
few years is apparent to anyone who
has lived here for a short time. He
said Davis Boulevard is not designed
to handle traffic of this magnitude.
Mr. Chaille stated there were two
schools and several churches in this
area and there are a number of
children who walk along Davis
Boulevard. He said we should not
compound this serious problem by
approving this development.

Mr. Chaille said additional streets in
Stoneybrook could possibly be
connected to Davis Boulevard thereby
opening up their residential streets to
transient non-residential traffic.
2. Safety: Mr. Chaille stated they
now live in a relativély safe area now
and parents feel comfortable allowing
their children to play in the streets.
He said resident drivers are familiar
with the neighborhood and drive
accordingly. He said with the
additional influx of non resident
traffic would severely diminish the
safety and well being of their
families.
3. Mr. Chaille said Video arcades and
other negative influences will be in
easy walking distance of children from
their homes in addition to the
additional exposure when enroute to
and from schools.
4. He said regardless of how good the
sanitation code is or how strictly it
is enforced, commercial developments
create conditions which attract rats
that cause health hazards by this
vermin.
5. Mr. Chaille said there would be
problems created by the disruption of
water drainage and the ability of the
area to absorb the rainfall with this
added development and this giant
blacktop and asphalt.
Mr. Chaille read from the zoning
ordinance the purpose of zoning: "The
purpose of this ordinance is to zone
the entire area of the City of North
Richland Hills into districts in
accordance with a comprehensive plan
for the purpose of promoting health,
safety, morals and the general welfare
of the general public. The
regulations and districts herein
established have been designed to

lessen congestion in the streets; to
provide 'safety from fire, panic, and
other dangers; to provide adequate
light and air, to prevent the
overcrowding of land, to avoid undue
consentration of populations, to
provide and facilitate adequate
provisions for transportation, water,
sewerage, schools, parks, and other
public requirements."
Chuck Geserick. 8400 Brookhaven, came
forward. He said he is in opposition
to this request. He said he was
concerned that the residential streets
would go through to Davis Boulevard.
Mr. Geserick said there were lots of
trees on this property which would be
ideal for residential property.
Pollard Rogers, Attorney, came forward
to represent Ms. Donnelly and Ms.
Chaison. He requested a postponement
of the request until more information
is available. Mr. Rogers said their
property would probably be developed
for single family.
James Bennett, 7120 Stonybrooke, came
forward. He said he lives next to the
creek and 20% of the property in his
area is low. He said he is an
engineer and has studied the
hydrology. Mr. Bennett said this
proposed development would increase
the runoff 20 to 30% and there would
be definite damage to their property.
Kathy Lawlor. 8400 Timberline Court,
came forward. She said she had a
prepared speech, but Mr. Chaille
covered most of the points she had.
She said did not see why Mr. Spencer
wanted to sell his land for commercial
because it would be a great area for
residential and could be a beautiful
asset to North Richland Hills. Ms.
Lawlor said there is already plenty of
commercial.

Ms. Lawlor said she went to the houses
getting signatures and out of 200 only
one man refused to sign; he wanted to
put a stop and go there.
Mr. V. L. Gibson, 8333 Odell Street,
came forward. He said he was a
believer in the Master Plan and he did
not believe in spot zoning and his
neighbors believes the same way. Mr.
Gibson said North Richland Hills has
lots of open land and should be
careful not to zone it commercial. He
said he would like to see it go
residential.
Gerald Graff, 6964 Cox Lane, came
forward. He said North Richland Hills
needs another shopping center like
they need a hole in the head. He said
Rufe Snow has one on every corner and
in between.
All who were in opposition to this
request stood up and three-fourths of
those in the council chamber were in
opposition.

PZ 84-79. This motion was seconded by
Mr. Schwinger.

Mr. Bowen said he did not feel there
was a need for this much commercial.
He said it would generate lots of
traffic. Mr. Bowen said, at this
time, they do not have any
thoroughfares but maybe someday they
would have a master plan which would
show Holiday Land and Precinct Line
Road being major thoroughfares to help
Davis Boulevard with the traffic.
Chairman Tucker said that in 5 to 7
years, Davis Boulevard would be a
major carrier.

Mr. Schwinger said, in regard to the
drainage, even if the zoning was
granted, the city staff and city
engineer would not allow them to
build until provisions for- the
drainage had been made.

ORDINANCE #1080 OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS, PASSED, APPROVED, AND ADOPTED
BY THE PLANNING AND ZONING COMMISSION AND THE
CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, JANUARY 9, 1984
AFTER APPROPRIATE NOTICE AND PUBLIC HEARING THE FOLLOWING RECOMMENDATION
IS SUBMITTED TO THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS BY
THE PLANNING AND ZONING COMMISSION:
RESOLVED that on Case No. PZ-84-79 the following described property shall
be rezoned from AG to C-1.
BEING a tract of land situated in the City of North Richland Hills, Tarrant
County, Texas and being part of the E.A. Cross Survey, Abstract 281, and
the William Cox Survey, Abstract 321.
BEGINNING at the southeast corner of the E.A. Cross Survey and being the
southeast corner of said tract.

THENCE North 89 degrees 36 minutes West a distance of 1027,3 feet to a
point in the East Right-of-Way line of State Farm to Market Highway 1938;
THENCE North 18 degrees 27 minutes East a distance of 240.0 feet with said
Right-of-Way of State Farm to Market Highway 1938 to a point for corner;
THENCE North 18 degrees 17 minutes East a distance of 5.3 feet with said
State Farm to Market Highway 1938 to a point for corner and the beginning
of a curve to the right with a radius of 1849.0 feet;
THENCE Continuing with said East Right-of-Way line in a northeasterly
direction along the curve 561.75 feet to a point for corner;
THENCE South 89 degrees 36 minutes East a distance of 709.8 feet to a point
for corner;
THENCE South 01 degrees 13 minutes West a distance of 505.3 feet to a point

Hearing and called for those wishing
to speak in favor of this request to

Mr. Collins came forward. He stated
he had a meeting with the homeowners a
few nights ago; it was a good meeting,
and some were for the request and some
were against it. Mr. Collins said he
was first interested in this property
two years ago, but found it had deed
restrictions on it so he backed off.
He said since then, the neighbors have
signed off the deed restrictions which
now makes it developable.

Mr. Collins said he feels the reason
Al Anz has agreed to sell the property
to him is he would be more accountable
than some other developer. He said
sooner or later, the property will be
zoned and developed. Mr. Collins said
the property abuts the large
interchange. He said if the
Commission would give him the
opportunity, he would build a good
shopping center. He said he had a
scale model to show what it would look
like. Mr. Collins said the center
would rent for from $16.00 to $18.00 a
foot. He said if the Commission turns
him down, an outside developer would
not work with the city and homeowners
as he has to try to please everyone.
Mr. Collins said he had been asked why
we need more shopping centers, but if
we did not have growth in the city,
the city could not provide the needed
services. He said he felt North
Richland Hills has done a good job
providing services to its citizens.
Chairman Tucker asked Mr. Collins
about the left turn lane. He said in
creating a left turn lane on Bedford
Euless Road, who would build it.
Mr. Collins said he would. He said he
met with the State Highway department
and gave them several proposals, one
being to straighten out the street and
they were receptive if he would align
the approach with the street to the
south. He said the State would build
the interchange, but he would build
the left turn lane.
Mr. Bowen asked if he would agree to
tieing the building permit to this.
Mr. Collins stated he would.
Betty Richardson with MB Bank, 777
Main Street, Fort Worth, Texas came
forward. She stated she represents
the Jess B. Woodard Trust who owns Lot
3 and part of Lot 4.

Ms. Richardson said they feel that
commercial zoning is the highest and
best use for the property. She said
they support this zoning change.
Allen Anz came forward. He stated he
lives on Strummer Drive and he is in
favor of this request.
Harvey Greenwald, 5016 Strummer Drive,
came forward. He said he was in favor
of a good quality commercial area.
Alfred Stanford, 5101 Pearl Drive,
came forward. He said back in 1969,
Bedford Euless Road was a two lane
road with seasonal fruit stands along
the sides. He said then everyone
wanted places to eat which we now
have plenty. Mr. Stanford said he
went to Mr. Collins meeting and it
seemed that the majority would go
along with Mr. Collins. He said he
goes along with Mr. Collins. Mr.
Stanford said why not, we cannot get
out on Bedford Euless now and we need
some assistance.
David Wiley, 4901 Oakridge Terrace,
came forward. He said he was in favor
of this zoning request.
Chairman Tucker called for those
wishing to speak in opposition to this
request to please come forward.
Doug Gilliland, 4901 Strummer Drive,
came forward. He said he participated
in Mr. Collins meeting where
approximately 100 residents came. He
said it was very productive. Mr.
Gilliland said this is a critical
zoning issue. He said it would be a
major transition and the city needs to
listen to the older citizens. He said
the traffic has not been properly
addressed. Mr. Gilliland said it would
cause a slow deterioration of the area
and the homeowners would suffer in
property value.

Mr. Gilliland said he and the other
property owners are opposed to this
zoning request now and would like to
be able to sit down and discuss it.
Michael Szot, 5008 Eldorado, came
forward. He said he had lived here 26
years and would like to die here. He
said he felt they need to give the
area a little more time to mature.
Mr. Szot said the traffic is a mess.
He said he has to challenge the 4
lanes of traffic every time he gets
out onto Bedford Euless Road. Mr.
Szot said Bennigans expands it's
parking lot into Eldorado and
Strummer. He said they do not have
enough police protection now.
Doug Randolph, 5017 Strummer Drive,
came forward. He said when they
bought their home, they looked for a
home in a nice neighborhood. He said
they have lived there for 16 years.
Mr. Randolph said it is a beautiful
place to live with nice trees. He
said they do not need shopping centers
to come to them; they have cars to
drive to the shopping centers. Mr.
Randolph said this was a residential
area with traffic problems and
drainage problems.
Mr. Randolph said he was here to
represent Mrs. Sellers who lives
across the street and could not be at
the meeting. He said she is also in
opposition to this request.
Tirey Samsill, 4908 Strummer Drive,
came forward. He said he has mixed
feelings about the request. He said
he had served on the Mayor's Committee
for a bond program and he has lived in
North Richland Hills for more than 20
years. Mr. Samsill said he was
opposed to the request mainly because
of the traffic. He said for the last
30 days, he has had to get to his home
from the north because of the traffic
on Bedford Euless Road.

Mr. Samsill said Mr. Collins did not
say that the upper story of the
shopping center would be looking into
his bedrooms.
Roland Starkey, 5013 Eldorado, came
forward. He said he would like to see
a show of hands of all who are against
this request.
Chairman Tucker said he would ask this
when Mr. Starkey finished.
Mr. Starkey said he wonders what would
happen if they had a fire with all
this traffic. He said Mr. Collins
says there would be no openings on
Strummer Drive, but after this Mayor
and Council are gone, someone will
come up and say why can't they have an
opening on Strummer. Mr. Starkey said
they also have a drainage problem. He
said the hole for the water to go in
is only so big and only so much water
can get in, the rest will back up.
Mr. Starkey said there are lots of
empty stores in shopping areas now and
we do not need anymore. He said this
is a planned neighborhood.
Chairman Tucker called for a show of
hands of the people who are in
opposition to this request. There
were several. Then he asked for a
show of hands of the ones who are in
favor of this request and there were
about half as many.
Ms. Allen 5100 Pearl Drive, came
forward. She said she is a single
woman who built there 8 years ago.
She asked who is going to buy at this
shopping center when all the
homeowners get disgusted and move
away.
Burk Collins asked to speak again. He
said the water flow and drainage has
to be taken care of before he would be
allowed to build; it has to be taken
out of the flood plain.

Chairman Tucker said this was a
difficult case since it is a change in
an existing residential area. He said
although it is not conducive to
residential, he is not sure if this is
the right time. Chairman Tucker said
he wanted to remind the Commission of
the "purpose" of the zoning ordinance.
He read from the Zoning Ordinance,
page 2: "The purpose of this
ordinance is to zone the entire area
of the City of North Richland Hills
into districts in accordance with a
comprehensive plan for the purpose of
promoting health, safety, morals and
the general welfare of the general
public. The regulations and districts
herein established have been designed
to lessen congestion in the streets;
to provide safety from fire, panic,
and other dangers; to provide adequate
light and air, to prevent the
overcrowding of land, to avoid undue
concentration of populations, to
provide and facilitate adequate
provisions for transportation, water,
sewerage, schools, parks, and other
public requirements. Said districts
have been established with reasonable
consideration of the character of the
district and its peculiar suitability
for the particular uses, and with the
view of conserving the value of
buildings and encouraging the most
appropriate use of land through the
community."
Mr. Wood said he felt this is a
commercial area and he likes the idea
that they would widen the road and put
a light there. He said he would be in
favor of the request if it would be
tied to this.

The reason for this letter is to point out there is both support

I am simply pointing out my side of the story. I am sure since

Road, came forward to represent Dr.
Graham. He stated this property is
across the street from the YMCA and is
one of four residential structures.
He said it is the third one from the
south. Mr. Evans stated that Dr.
Graham wishes to put his medical
office there. He said the parking
would be in the rear.

would have to postpone the approval of

PS 85-5. This motion was seconded by
Mr. Schwinger and the motion carried

APPROVED
Mr. Schwinger made the motion to
approve PS 85-6 with the stipulation
they obtain a letter from TESCO

We have reviewed the referenced materials for this subdivision and offer the following
comments:
RE:
1 Please see our review letter dated December 7, 1984, PS 84-113, regarding
prorata, escrow considerations, and special permit requirements such as permission
from the Highway Department and TESCO for construction within their rights-of-way.

We would recommend that the name of Richland Parkway be changed since there is
already a Richland Dr., Court, and Plaza Drive.
3 The existing zoning for this development area should be noted on the Plat.

A water line easement should be provided for the proposed
extension along the west side of Block 14. We would note
line is located within a 15-foot Lone Star Gas Easement.
Star Gas will be required for locating toe proposed water

5 The proposed pavement section on Richland Parkway consists of a 41-foot BIB
width, 6-inches thick on 8-inches of lime stabilized subgrade within a 60-foot
wide right-of-way. We would suggest that PAWA, the thoroughfare planning
consultant, be consulted regarding the adequacy of this proposed design. Please
contact Ron Perry at 661-9406.
6 As a general reminder, the Developer or Owner should be made aware that he is
responsible for all provisions of the Subdivision Ordinance, Zoning Ordinance,
Water and Sewer Policies and Procedures, and all other applicable City Development
Codes unless specific discretionary variances and exceptions are made and agreed
upon by the Planning and Zoning Commission and City Council, and covered in
writing in the City-Developer Agreement, if this proposed plat is approved. If no
such specific variances are provided then the Developer or Owner remains
responsible for all other Ordinance and Policy requirements as written in the
regulatory codes.

2 We would request that the proposed 5-foot utility easment located along the south
line of this lot be increased to a 10-foot width as required for construction of a
future l2-inch water line from the old Stegall Station to Roberta Drive.
3 All utility companies should be advised of this proposed replat in accordance
with standard City procedures.
4 As a general reminder, the Developer or Owner should be made aware that he is
responsible for all provisions of the Subdivision Ordinance, Zoning Ordinance,

January 28, 1985, in reference to Nob Hill Addition PS 85-8, item l.5.
In that paragraph they use $42 a lineal foot as a estimated street
cost escrow amount or pro rata cost. This figure should be $53.85
a front foot.
In reference to Stembridge and Associates' letter dated January 28, 1985,
in reference to Lot l, Block 1, Oak Leaf Park Addition, paragraph ll.
They are still insisting that drainage facilities not be an improved
pipe or channel. I would request that you require either underground
storm drainage system or concrete lined channels with maintenance

Dear Sir:
In accordance with our conversation on January 17, 1985 we
have instructed our engineers, Stembridge & Associates, to revise
the design of that portion of Precinct Line Road that fronts our
property. As a matter of record, the estimated cost of the pro-
posed design of Precinct Line Road is $61,321.00. The pro rata
fee due from us is $53.85 per foot on 847.50 feet equalling $45,637.88
leaving approximately $15,683.12 of City participation. As you
told us, the City will be unable to participate in the construction
of Precinct Line due to the lack of available funds. Due to this
problem we have decided, as we discussed, to install the curb and
,gutter section along our frontage, compact in front of the c·,rb and
install penetration to allow for proper drainage. There will be
certain areas, as designated on the revised design sheet, where 2"
of hot mix asphalt will be placed due to the amount of traffic they
will receive. The estimated cost of this construction ($15,000.00)
will be deducted from our pro rata cost and we will pay the remain-
der to the City. We would also like to note that the City agreed
to participate in the proposed construction of Crane anything over
the allowed pro rata cost.

1.10 Item 13: Plans for off-site lift station should be submitted to our
office and Health Department for review.
1.11 Item 14: We understand paving plans on Precinct Line Road may change
depending upon how bids come in for the proposed work. Plans for any
revisions should be sent to our office for review and recommendation of
approval. Plans for Crane Road could change depending on comments from
Ron Perry.
The developer's engineer may have already responded in writing to the above items.
If so, we would request that a copy of such correspondence be sent to our office
for our files.
2 The Owner's Acknowledgement and Dedication Statement and the Notary Certification
should be fully executed before approval of this plat. On our review copy, Owner
James Rust has not signed the plat.
3 Proposed water lines in Nob Hill Drive and Market Street should be located behind
the north curb on each street. Sheet 2 should be revised to show these
recommended changes.
4 We understand that the City of Hurst has requested that this developer construct
off-site underground storm drainage in Precinct Line Road. We assume that this
off-site storm drain would conform generally to the design prepared by Teague,
Nall, and Perkins as shown in their preliminary plans for Precinct Line Road
widening dated November, 1980. We have not seen any hydraulic calculations on the
off-site line, therefore, we cannot comment on the adequacy or need for this
off-site storm drain. We are not aware of any existing flooding problems along
Precinct Line Road in the vicinity of this subdivision, however, runoff quantities
will be increased and the potential for off-site flooding in Hurst could also
increase.
5 We would note that the developer plans to build only half of Crane Road along the
frontage of this development. The existing right-of-way width is presently
insufficient for widening to a full 49-foot BIB pavement width. Technically, the
Subdivision Ordinance states that the developer could be required to acquire the
additional right-of-way on the opposite side of the street in addition to his own
dedication if you so di.rect. If you choose to waive this provision, then we would
suggest that it be covered in the City-Developer agreement to avoid future
problems.
6 An easement should be provided for the off-site sanitary sewer line east of the
extension of Nob Hill Drive on the north end. The proposed manhole on the end of
the line should be extended to the east side of the future off-site cul Ide sac.
7 Plans for the off-site sanitary sewer line in Martin Road should be submitted to
our office for review, in addition to the off-site lift station.

8 The drainage plans indicate that the downstream stock pond on the Region property
will be drained prior to construction. We would suggest that a letter from the
downstream owner be obtained which states that he has no objections to drainage
construction on his property.
9 As a general reminder, the Developer or Owner should be made aware that he is
responsible for all provisions of the Subdivision Ordinance, Zoning Ordinance,
Water and Sewer Policies and Procedures, and all other applicable City Development
Codes unless specific discretionary variances and exceptions are made and agreed
upon by the Planning and Zoning Corrmission and City Council, and covered in
writing in the City-Developer Agreement, if this proposed plat is approved. If no
such specific variances are provided then the Developer or Owner remains
responsible for all other Ordinance and Policy requirements as written in the
regulatory codes.

development.

3 The existing zoning for this development area should be noted on the Plat.
4 All contiguous platting and/or ownership should be shown on the plat.
5 Utility companies should be contacted to determine if any easements are required
to serve this lot.
6 A 10-foot easement of some kind is shown on the plat along the north property
line. The type of easement has not been noted. It appears to be a sanitary sewer
easement. In any event, it should be labeled.
7 A 25-foot building setback line should be provided along the cul'de sac.
8 The name of the cul'de sac should be noted on the plat (Nob Hill Drive?).

THE STATE OF TEXAS §
COUNTY OF TARRANT §
JOINT RESOLUTION
RESOLUTION NO. 85-6
WHEREAS, the City of North Richland Hills will be conducting C:1ty
Council Elections and such other matters as may be placed upon the ballot by
the governing body of said City on April 6, 1985; and,
WHEREAS, on April 6, 1985, Tarrant County will conduct an election on
the question of confirmation of the creation of a County-wide 9-l-l Emergency
Telephone Number District, and, the unincorporated portions of Tarrant
County will be conducting an election on the question of the formation of a
Rural Fire Prevention District; and,
WHEREAS, it is the finding of the governing bodies of the parties hereto
that the joint conduct of such elections would result in substantial savings to
the taxpayers of the governmental entities required to conduct such elections
and that such savings would be realized if the elections, where possible, be
held in the same location, utilizing the same personnel, and utilizing the same
voting machines, with the two governmental entities sharing the expenses
incurred in the conduct of this election; and,
WHEREAS, all the eligible voters of Tarrant County shall be entitled to
vote in the election to determine the question of confirmation of the creation
"- of the County-wide 9-1-1 Emergency Telephone Number District, and all those
eligible voters of Tarrant County who are residents of the unincorporated
portions of said County shall be entitled to vote on the question of the
formation of a Rural Fire Prevention District;
NOW THEREFORE, be it hereby resolved jointly, by the City Council of
the City of North Richland Hills and the Commissioners' Court of Tarrant
County, Texas, that these two entities, where possible, shall conduct said
elections jointly on April 6, 1985, and that in the event there are election
precincts which include incorporated territory lying within the limits of the
said City and unincorporated territory, lying outside the limits of any city,
that said voters from the unincorporated territory shall be allowed to vote
only on the question of the Rural Fire Prevention District formation and the
question of the confirmation of the creation of the County-wide 9-l-l
Emergency Telephone Number District; while those voters who are residents
of the City shall be allowed to vote only on the City Council races and such
other matters as may be placed upon the ballot by the governing body of said
City and upon the confirmation of the creation of the 9-l-l District; ~nd
BE IT FURTHER RESOLVED that the City of North Richland Hills and
the County of Tarrant share the costs involved in the conduct of such joint
elections by the County making available to the City, at no charge, the
voting machines necessary, including transportation of such machines, in
those Precincts where such elections are to be conducted jointly, and by the

Since June of 1984 the Staff has been trying to contact and negotiate the purchase of
right-of-way on Glenview Driye from Mr. Harold A. Pollman. The amount of property
required from Mr. Pollman is approximately l,l42 square feet. Mr. Pollman will not
respond to letters or phone calls regarding this right-of-way acquisition.

We have also been negotiating with the ANTA Corporation and Four Seasons Nursing Home
for the purpose of obtaining a parcel of land containing appro:ximately 378 square feet.
There has been a question of ownership and it has now been determined that Four Seasons
Nursing Home is the legal· owner of the property. We hope that the purchase of this right-
of-way will be finalized within the next two weeks. However, if negotiations again
break down we would ask the Council for the authority to condemn.

BE IT RESOLVED by the City Council of the City of North Richland
Hills, Texas, that:

The City Attorney is hereby authorized to acquire right-of-way for
the Glenview Drive project by eminent domain proceedings against the
following:
(a) Tracts 52 and 52 (TE) owned by Harold A. Pollman and Peter D.
Fonberg d/b/a Harpet Investments (0.0262 acres plus 10 foot
temporary easement; and
(b) Tracts 59 and 59 (TE) owned by Four Seasons Nursing Centers, Inc.
(0.009 acres plus 10 foot temporary easement).
