one of the Youth Sports Groups had a question on one of the requirements
in the resolution and asked that the resolution be sent back to the Park
and Recreation Commission for review.
Councilwoman Moody moved, seconded by Councilwoman Hinkle, to reconsider
Item No. 10.
Motion carried 4-0.

LEAGUE TO AMEND SALES TAX PERMITTING PROCESS,
RESOLUTION NO. 86-42

Mr. Line stated this resolution would require that the City Secretary of
each affected city certify the location of each sales and use ,tax
permitee. Mr. Line stated this would be a way of insuring that the sales
tax was going to the correct city.
Mayor Echols stated this resolution would be submitted to the TML
Resolutions Committee for consideration.
Councilman Ramsey moved, seconded by Councilman Garvin, to approve
Resolution No. 86-42.
Motion carried 4-0.

Mr. Robert Parsons, 5304 Topper, appeared before the Council.
Mr. Parsons stated the only question he had was would the system operate
without causing interference with the City of Garland. Mr. Parsons stated
he would like for the City to have assurance from Motorola that there
would be no interference.
Mayor Echols stated the Council had directed the City Manager that no
payment would be made until assurances were made that the system would
work adequately.
Motion carried 4-0.

This Zoning Application is submitted on a portion of the vacant commercial tract located
at the northeast corner of Rufe Snow Drive and Chapman Road. The rezoning is from C-l
Commercial to C-2 Commercial. The applicant is in the process of developing a multi-use
retail shopping center on the site. The purpose for the proposed rezoning is to expand
the possible uses allowed in the shopping center. In the hearing before the Commission
the applicant indicated two or three prospective tenants, such as self-service car wash,
an auto parts store and an auto service center.
The Staff noted to the Commission that the Mobil Service Station site on the corner of
Chapman and Rufe Snow was just recently rezoned to allow a car wash use.
RECOMMENDATION:
The Planning and Zoning Commission recommended approval of Zoning Application PZ 86-39
requesting rezoning of a portion of Tract 3A2, Wm. Mann Survey, Abstract 1010, from C-l
to C-2.

has the right to appeal to the City

office supply, fast food restaurant
and an auto supply. Mr. Hamm stated
this zoning change would help with the
leasing of the property, but some of
the things allowed in C-2 he would not
want.

AFTER APPROPRIATE NOTICE AND PUBLIC HEARING THE FOLLOWING RECOMMENDATION

This Zoning Application is presented on the vacant commercial tract located on the
northwest corner of Grapevine Highway and Colorado Boulevard. The requested rezoning is
from C-l Commercial to C-2 Commercial. The applicant proposes to develop a retail strip
center on the site and wishes to enlarge the possible uses for the proposed center. In
discussion with the Commission the applicant offered to voluntarily restrict the
additional uses allowed in the C-2 Commercial District to those which would be less
objectionable to the neighborhood and the City. The applicant did not indicate that any
prospective tenants had been contracted or secured for the proposed center.
RECOMMENDATION:
The Planning and Zoning Commission recommended that Zoning Application PZ 86-40
requesting rezoning from C-l to C-2 on Lot BR, Block 11, Clearview Addition be approved
with the stipulation that the applicant provide to the City Council the list of proposed
uses which he would use from the C-2 criteria.

forward. He stated he wishes to up
grade this property to give additional
uses. He stated the property is
bounded by C-1 on both sides with an
office supply, fast food restaurant
and an auto supply. Mr. Hamm stated
this zoning change would help with the
leasing of the property, but some of
the things allowed in C-2 he would not
want.

Don Hughes, 8004 Standley, came
forward. He asked what Mr. Hamm
planned to do with the property
directly behind his property. He said
there is already a wall of bUildings.
He said it would be getting away from
the residential area.
Chairman Bowen stated the property is
already zoned C-l for retail uses.
Mr. Tucker read from the Zoning
Ordinance the list of what could be in
C-l zoning. He stated it would not
change the type of building he could
have, just the uses within the
bUilding.
Chairman Bowen stated there were some
objectionable uses in C-2.
Jerry Apple, 8008 Standley, came
forward. He stated there is a
drainage problem in this area. He
said it floods his back yard and is
cracking the foundation. Mr. Apple
stated his property is already
'isolated so that he can not sell his
property, but the taxes still keep
going up.
Chairman Bowen stated the drainage
would be taken care of in the platting
process. He stated the drainage plan
would have to be approved by the City
Engineer.
Mr. Apple stated he had called down to
the city about his problem, but did
not get the problem solved.
Mr. Royston stated some of the
neighbors do have a drainage problem.
He said some would be solved with this
development of Mr. Hamm's property,
but some is caused by the lay of the
land.

This Zoning Application is submitted on the vacant commercial and multi-family tract
located on the north side of Grapevine Highway east of Emerald Hills Way and facing the
TCJC Northeast Campus. The requested rezoning is from C-l Commercial and R-7-MF
Multi-Family to C-2 Commercial. The applicant proposes to combine the property in this
application with the tract in Zoning Application PZ 86-42 to create a multi-use site.
The subject tract in his application includes all of the applicant's frontage on
Grapevine Highway.
In the Staff review of the application several items were noted for Commission
consideration.
1) The configuration of the proposed development does not match the existing zoning
pattern. The net result of the proposed changes would be the elimination of the
multi-family zoning from the applicant's property.
2)
The development of the subject tract will require the construction of a
thoroughfare street through the property. This proposed street is shown as a
four lane Collector Street on the North Richland Hills Thoroughfare Plan and is
an extension of Simmons Drive. The applicant has submitted a proposed
layout of his property which includes the proposed street. Also the layout
indicates the proposed street will align with the main drive entrance to TCJC
across Grapevine Highway.

3) The C-2 request is noted by the applicant to produce a wider range of available
uses. The layout submitted with the application portrays several individual
lot areas within the project site.
RECOMMENDATION:
The Planning and Zoning Commission recommended approval of Zoning Application PZ 86-41
requesting rezoning on a portion of Tract 3, L.C. Walker Survey, Abstract 1653 from C-l
and R-7-MF to C-2.

This Zoning Application is also presented on a portion of the vacant commercial tract
located on the north side of Grapevine Highway east of Emerald Hills Way across the
highway from TCJC Northeast Campus. The requested rezoning is from C-l Commercial and
R-7-MF Multi-Family to I-I Industrial. The subject tract is to be combined with the
tract in Zoning Application PZ 86-41 to create a retail/office/warehouse complex.
In reviewing the application the Staff noted two items for Commission consideration.
1) The extension of Simmons Drive as a four lane Collector Street will be a
requirement of this development. The location and necessary right of way for
the street are shown on the site layout submitted by the applicant.
2) A portion of the subject tract is in the Flood Plain of a Walker Branch
tributary which is on the site. The applicant indicates future improvements
will be made to the channel. The improvements to the channel and the providing
of finish floor elevations for all proposed buildings will be a requirement of
this development.
The Planning and Zoning Commission recommended approval of Zoning Application PZ 86-42
requesting rezoning of a portion of Tract 3, L.C. Walker Survey, Abstract 1653, from C-l

This Zoning Application is presented as one of three parcels of a coordinated rezoning
request on the undeveloped portion of the Meadow Lakes Subdivision. This particular
request is from R-2 Single Family, R-7-MF PD Multi-Family Planned Development, and DC
Outdoor Commercial (Golf Course) to R-2 Single Family. The intent of the requested
rezoning is to re-define the tract which is to be developed as single family residences.
The change in configuration of the Single Family is coordinated with the overall scheme
contained in this request and Zoning Application PZ 86-44 and PZ 86-45. The net change
in the overall design will enlarge the single family area, remove the multi-family
zoning in favor of townhouse development, and re-configure the property dedicated to the
Golf Course to correspond with the current course layout.
RECOMMENDATION:
The Planning and Zoning Commission recommended approval of Zoning Application PZ 86-43
requesting rezoning of a portion of Tract 1, 2 and 4A, W.A. Trimble survey, Abstract
1520 from R-2, R-7-MF PD and DC to R-2 with the stipulation that the minimums in the
proposed subdivision be 10,400 square Feet for the lots and 2000 square feet for the
residences as shown on the Zoning Plat submitted with the application.

Chairman Bowen asked if the R-2 zoning
would have 10,000 square foot lots and
2000 square foot homes.
Mr. Frank said the lots would be
10,450 and the houses 2000 square
feet.
Chairman Bowen asked Mr. Royston if
these requirements should be stated.
Mr. Royston stated the PD has been
eliminated and if you want
restrictions, they should be stated.
Mr. Massey said he would hope the
Commission would not hold them to the
restriction of no building permits
till the golf course is in. He said
he hoped that since there is no
multi-family, they would not hold us
to the construction of the golf
course. Mr. Massey said they came
fairly close to a date of development
of the golf course.
Mr. Frank said he guessed they could
tie it to the townhomes.
Chairman Bowen called for those
wishing to speak in opposition to this
request to please come forward.
w. D. Clark, 6305 Riviera Drive, came
forward. He stated he would like to
know what is going to happen to the
property behind his house.
Mr. Wood said it would be single
family.
Mr. Clark asked if the single family
would go. to the canal.

then the single family. He showed Mr.
Clark the layout.
Mr. Clark asked who plans to maintain
this property.

This Zoning Application is the second of three applications presented by Richmond Bay
Development Company on the undeveloped portion of the property in the Meadow Lakes
Subdivision. The requested rezoning is from R-7-MF PD Multi-Family Planned Development
and OC Outdoor Commercial (Golf Course) to R-6-T Townhome. The applicants wish to scale
down their project to eliminate any consideration of apartment development. Their
intent is to concentrate on patio home type housing. The proposed rezoning also reduces
significantly the area of the site dedicated to multi-family housing.
RECOMMENDATION:
The Planning and Zoning Commission recommended approval of Zoning Application PZ 86-44
requesting rezoning on a portion of Tract 1, 2, and 4A, W.A. Trimble Survey, Abstract
1520 from R-7-MF PD and OC to R-6-T with the stipulation that the provisions for
guaranteeing the construction of the Golf Course be continued as a condition of building
in this district.

Agenda Number:
Waldrum Sign Company has submitted a request for First American Savings Banc, located at
the northwest corner of Oakridge Terrace and Bedford Euless, to place a ground sign on
the site which would include an electronic message area. The proposed sign would be a
total of 166 square feet in area. The "Message Sign" area would be 54 square feet of
that total. The total sign area would be well within the area allowed for either
frontage of the lot. The applicants propose to install the sign on the Bedford-Euless
Road frontage with sufficient set back to allow for a 40 foot height. The application
is submitted to the City Council for approval of the "Message Sign" area under Section
5.8 of the Sign Ordinance.
RECOMMENDATION:
It is Staff's opinion that the proposed sign for the First American Savings Banc is in
compliance with all other criteria of the Ordinance and the City Council can approve the
proposed "message area" under Section 5.8 of the Sign Ordinance.

Request of D & G Advertising for Billboard Sign SO 86- 13

D & G Adyertising Company has submitted a request for approval for the erection of an
off-site Billboard Sign to be located on the north side of the Loop 820/Highway 183
Interchange on the lot belonging to the Cafe Laredo. The Cafe address is 8204
Bedford-Euless Road. The sign is proposed to be constructed on the southeast corner of
the property adjacent to the Freeway Service Road. The applicant has submitted drawings
indicating the location of the sign on the site. There will be an intrusion of the sign
support into one parking space. However, the overhang of the sign will be over a total
of five spaces. The Ordinance does not specify that this arrangement is in violation.
All of the spaces could still be used with the exception of the space where the pylon is
situated. The Cafe Laredo is required to provide a minimum of 75 spaces. The site
currently has a total of 78 spaces. To eliminate parking under the proposed sign would
take the restaurant parking below the minimum required number.
In observing the site the Staff noted that Cafe Laredo does not currently have a pole
sign on the freeway side of their site. However, many of the other restaurants and
motels do have on-site ground signs along this service road. These signs, being
controlled by different criteria, are not as large nor are they as high as the billboard
can be. Therefore the billboard could have a detrimental effect upon the existing signs
on the adjacent properties. The owners of the other businesses may feel that they are
placed at a disadvantage by a billboard at this location. Certainly from several angles
the billboard will provide a visual barrier for the existing signs at the various
businesses.
The proposed billboard location is 2200 feet from the nearest billboard to the west and
2700 feet from the nearest billboard to the east. Therefore if this sign location is
approved no other requests may be submitted in this area.
RECOMMENDATION:
The Staff is of the op1n10n that the requested billboard located on the Cafe Laredo site
may be approved under a strict interpretation of the Ordinance. However, the City
Council should be aware that two specific problems will be created by the approval of
this sign.
1) Cafe Laredo will remain in compliance with the parking requirements if the
parking spaces under the sign are included. No information is available as to whether a
liability problem is created by this arrangement.
2) There are a great many pole signs already in the area along the Freeway Service
Road. Many of these were approved by a variance to the Sign Ordinance for size,
location and height. The billboard location, by blocking the sight of those signs,
could cause a new round of requests for variance to the Ordinance.

Support for Certification of all Coaches in

The National Youth Sports Coaches Association (NYSCA) is a non-profit organization of
volunteer coaches dedicated to the improvement of youth sports programs through education,
public awareness, league assistance and sports promotions. The NYSCA volunteer coach
training program is endorsed nationally by the National Recreation and Parks Association
and locally by the Texas Amateur Athletic Federation. The goals and objectives of the
NYSCA are as follows:
To train and certify the volunteer coach so that he/she has a better
understanding of organization, teaching proper techniques, injury
prevention and treatment, as well as the psychology of coaching youth
sports.
To provide leadership and education to foster youth sports programs
in a wholesome atmosphere under conditions that will assure maximum
athletic performance through youth participation and competent
coaching.
To foster high standards of ethics among athletes, coaches,
administrators, and the general public.
To conduct research and disseminate information on the operation of
youth sports programming.
The NYSCA National Certification Program lasts approximately six hours held on two
evenings or one Saturday, the first year. The second and third year programs are more
advanced and are only two and one-half hours in length. The cost of certification is a
$15.00 annual fee for the coaches. In addition to the training, the coaches receive
$300,000 in liability coverage, a certified coach patch membership card, certificate of
completion, bi-monthly newsletter, first-aid card, and travel discounts on various hotels
and car rentals. Coaches can be certified in more than one sport by attending, at no
additional charge, the second half (sport specific portions) after completing the regular
certification in another sport.
Being an NYSCA certified coach does not indicate that volunteer coaches are qualified in
the sense of a paid coach on the high school, college, or professional level. By virtue
of attending the approximately six hours of instructions conducted by a trained clinician,
NYSCA headquarters certifies that they are aware of their responsibilities to children in
sports.

Those responsibilities are specifically:
1. Responsibility for being aware of the psychological and emotional
needs of children while participating in sports.
2. Responsibility for knowing that safety and first-aid are the most
important factors in the physical well being of children and that
at all times a person of authority (physician, paramedic, etc.)
should be called on to treat any kind of injury.
3. Responsibility for being aware that conditioning, nutrition,
flexibility, and strength development are important factors for
growing children that are involved in sports.
4. Responsibility for organizing fun and interesting practices in
children sports.
5. Responsibility for teaching, to the best of their ability, proper
techniques in sports.
Finally, by signing the Code of Ethics Pledge, coaches are constantly reminded throughout
their volunteer coaching career, that in youth sports the consideration for children
should be placed far above their own personal desires for accomplishments.
The training program is conducted by the local NYSCA Chapter Certified Clinician with the
use of video tapes prepared by professionals in the respective subject areas. The North
Richland Hills Parks and Recreation Department is the first department in our area to be
granted NYSCA chapter status and the recreation department staff have been certified as
NYSCA clinicians. Upon meeting NYSCA criteria for a Chapter, the Department will be
provided all materials at no cost to the city.
The groups affected by this resolution would incude any youth sports group or association
using city facilities. Currently, this includes the Richland Youth Association and the
North Richland Girls Softball Association. The leadership of both groups have been
contacted and have been informed about the program. Other groups affected will include
volunteer coaches for Recreation Department sponsored youth basketball and Junior Olympic
volleyball programs to be offered at the new Community Center.
The advantages of instituting this program by resolution would include: 1) a greater
participation by youth sports coaches; 2) better training for volunteer youth sports
coaches; 3) liability coverage for youth sports coaches; 4) reduction in liability risks
for the City of North Richland Hills by providing instruction training to providers of
high risk activities in city facilities; 5) compliance by youth sports coaches with a
(NYSCA) Code of Ethics; 6) and most importantly, safer - higher quality youth sports
programs for the children who participate in these programs.
RECOt1MENDA T I ON :
It is the recommendation of the Parks and Recreation staff and the Parks and Recreation
Board (in unanimous votes at the September 2 and October 1, 1986 Parks and Recreation
Board meetings), that the City Council approve the attached resolution requiring NYSCA
certification effective January 1, 1987.

WHEREAS, the Mayor and of City Council of the City of North Richland Hills
recognize the need for quality youth sports programs; and

certification program for youth sports coaches whereby the coaches are schooled in
psychology of coaching youth sports, maximizing performance, injury prevention, and first
aid; and
WHEREAS, The National Youth Sports Coaches Association program should be applied
to our present athletic programs to help improve coach/parent relationships, to educate
our volunteer coaches so they have a better understanding of organization, teaching proper
techniques, safety, and to bring them up to a more knowledgeable level in the
psychological and physical needs of deal ing with young athletes, and to ensure all
children obtain a wholesome experience in youth sports; and
WHEREAS, through this certification program, the quality of youth sports in the
City of North Richland Hills will be improved to the benefit of all persons involved.
NOW, THEREFORE BE IT RESOLVED by the Mayor and City Council in meeting duly
assembled and by the authority thereof that all coaches of youth sports programs operating
within the structure of the North Richland Hills Parks and Recreation Department and/or
using City facilities shall be required to be certified through the National Youth Sports
Coaches Association Certification Program commencing January 1, 1987.

This proposed revision to Section 10 of the Zoning Ordinance is in the area of the
Multi-Family Planned Development District. The proposed revision would modify the
maximum unit density allowed on a Planned Development Multi-Family Site. The intent of
the Ordinance Revision would be to allow an incentive increase in the maximum density of
units when the PD Site Plan is submitted and approved by the Commission and the City
Council. The proposed revision would allow Planned Development Sites to increase
density to a maximum of 20 units per acre.
RECOMMENDATION:
The Planning and Zoning Commission recommended approval of the proposed revision to

The City .of North Richland Hills is required from time to time to make wire transfers
for investment, insurance, and bond payment purposes. Our present bank depository
contract is not specific in this area to authorize certain personnel to make the
necessary transfer. The City's depository banks (Interfirst Richland and Texas
Commerce Bank - Hurst) request the attached contracts be formally approved by Council
action.

It is recommended that the wire transfer côntracts be approved for Interfirst Richland

count ( s ) are wi th the Bank or other bank ( s ); and

count (s) of a third party, whether such third party account (s )
are with the Bank or other bank(s);

Electronically record telephone conversations between Bank and
CUSTOMER's authorized representatives. The decision to record
a call is solely within Bank's discretion and Bank shall have no
liability for failing to do so.
We agree to report any discrepancies between the CUSTCKER's
records of these transactions and the Bank statement to the
Bank's Wire Transfer Department in writing wi thin fourteen
( 14) dB8S after the statement date. Failure to notify the
Bank of any discrepancies within the fourty-four (44) day
period will reliev-e the Bank of any liability.

Act upon all transfer requests on- the date received, when re-
ceived prior to the deadlines required by the Bank, and to use
any means for the transmission of funds the Bank IDa3' consider sui t-
able and charge the appropriate account for ~ direct charge to
the Bank for the transfer (i.e., access charge from Federal Reserve
for transfers under $1, <XX> ) .

It is understood that this funds transfer service (including oral
transfer request) is provided as a convenience to the CUSTCNm and
in consideration of obligations of the Bank hereunder, we Agree to
(a) Release the Bank from res pons ib ili ty for liability, loss or
damage or delB¥ resulting from: CUSTOMm 's failure to follow
this Agreanent or other procedures for wire transfers of which
Bank has notified CUSTOMm; any delay in the performance by
Bank of, or failure to perform, the provisions of this Agree-
ment which is caused by an act of God, fire or other catastrophe,
electrical, or computer failure; acts of, delays or failure to
act by, any carrier and/or agent operating between Bank and
Customer, or by recipients of transferred funds and their per-
sonnel; or, without limiting the generality of the foregoing,
any other cause beyond the Bank's control. Customer will in-
demnify and hold Bank harmless from any claims, demands, ex-
penses (including reasonable attorney's fees), losses or damages
arising out of the Bank's acting upon a transfer request, persons
purporting to be authorized Customer representatives and which
transfers are made by Bank in accordance with this Agreement or
fran Bank's refusal to act upon requests not made in accordance
wi th this Agreement or which cannot be authenticated by Bank if
Bank elects to attanpt an authentication.
(b) Subject to :paragrap¡. 4 above, agree that compensation if any,
for the loss of interest or use of funds due the CampaQy as a
result of a Bank error or of the Bank's failure to execute a
transfer request on the date received, when received prior to
the Bank's deadline, and when such error is within the Bank's
control, will be for a period not exceeding fourteen (14) days
(the CUSTOMm Notification of Discrepmcies period) or the date
of actual transfer or error correction whichever comes first,
and will be in the form of either of the following at the Bank's
option:
1 ) Adjust the aggregate ledger and collected balances of the
CUSTCNm's account to reflect proper¡Y in the aver~
balances on the account analysis the amounts that would
have resul ted had no error occurred .

2) Reimbursement by check not exceeding the average Fed Funds
interest rate for the period and amount in question, less
reserves, computed on a daily basis.
(c) Assume full responsibility for all transfers made by the Bank: in
gpod faith in accordance with these procedures and agree that
the Bank: shall be conclusive¡Y deemed to have exercised ordinary
care if it has followed these procedures or if the CUSTOMm has
not followed them.
(d) Agree that the transfer requests will at no time exceed the
account's collected balance as determined by the Funds (Wire)
Transfer Depirtment of the Bank. CUSTOMm shall be liable for
any funds transferred upon proper instructions by CUSTCNm
whether or not such amount exceeds collected balance at the
Bank .

(e) Agree to SIlpp¡Y the Bank, in addition to Form A, any other in-
formation that the Bank may reasonably request, including but
not limited to money amounts, accounts to be affected, date of
transfers, supplemental instructions, a resolution authorizing
Wire Transfer of Funds and further evidence of any authorized
representative's authority to transfer funds or to do aQY other
act contemplated under these procedures. Bank will assign
CUSTCNm a Securi~ Code Number which authorized representative
must use when requesting Bank to make funds transfers.

(f) Agree that all requests by CUSTOMm for transfers shall conform
to the procedures as Bank ~ from time to time prescribe. Bank
~ change these procedures upon notice to CUSTOMm. CUSTOMm
further agrees that it will prevent the disclosure wi thin and
outside of its organization, except on a "need to know" basis,
of any of Bank's procedures relating to transfers of funds.
If the confidentiality of the procedures is compromised, CUSTQMm
will notify Bank immediately.
(g) Confirmation and advice of each transfer will be mailed daily by

This Agreement will be governed by the law of the State of Texas. All
obligations hereunder are performable in Tarrant County, Texas. This
Agreement will terminate upon Bank's written notice to CUSTOMm, or upon
receipt by Bank's Wire Transfer Department of CUSTCMm's written notice
of termination. The indemnification and limitation of liability pro-
visions of this Agreement will survive any such termination.

The City of North Richland Hills on July 2, 1980 approved Ordinance NO. 833 levying
assessments for Davis Blvd. from Grapevine Highway to Emerald Hills Way. Davis
Memorial United Methodist Church located at 5301 Davis Blvd. was assessed $12,337.38 on
May 4, 1982 after the project was completed and accepted by the City. Statements were
sent annually to the Methodist Church with no response recognizing the liability. The
current amount outstanding is $15,547.74 including accrued interest to September 30,
1986.
The Church was in the process of preparing for a major expansion to the facilities and a
request was made for a building permit. The Church Administrative Staff was informed
at that time that no permit could be issued until the assessment lien was resolved by
paying a prorated portion of the lien. According to State statutes "each individual
property owner may pay the balance due in five equal installments plus accrue interest
at 6% per annum':
The City Staff and the Administrative Staff of the Church attempted to resolve the
problem in a meeting held Tuesday, October 7, 1986. It was our proposition that if
4/5's of the current amount outstanding, or $12,438.19 were paid immediately with the
balance due on or about May 24, 1987 that a permit could be issued. It is the
contention of the Church that the amount will place a hardship on the Church and that
a loan for the expansion cannot be obtained with another lien against the property.
The Pastor and the Administrativ~ Staff have requested time to appear before the
Council to request waiver of the accrued interest due.
Conclusion:
Assessments should be applied uniformly to all property owners that are being assessed.
The City when placing the levy against the Methodist Church property assessed the
property at the residential rate instead of the commercial front footage rate in an
attempt to not place a burden on the C~urch.
Recommendation:
It is the Staff recommendation that the assessment amount plus accrued interest should
be paid in full on or before May 24, 1987 or that 4/5's of the amount should be paid
immediately with the balance due on May 24, 1987.

Fees presently charged by the Police Department have fallen below those fees charged
by other area police agencies and no longer cover actual cost to the City. These
changes will enable the Police Department to recoup actual cost incurred by the City
and remain consistant with other agencies.
The Police Department currently charges $2.00 for one page accident reports, $3.00
for incident/offense reports and $5.00 per hour to research files. This proposed
ordinance will increase the cost for accident and offense/incident reports to $4.00.
regardless of number of pages, and $11.50 per hour for research of files. This is
based on an average Clerk II salary at the overtime rate. Fingerprint cards will
remain at $4.00 per card.
This ordinance will replace Ordinance #1064 which was passed in September, 1983.
Recommendation:
Request passage of ordinance.

We recommend that the City of North Ri chl and Hi 11 s award the contract for
construction of the above referenced projects to T. W. Gilmore Construction Co.
and Calvin Baker Construction Co., a full Joint Venture.
Based on the bids received and read publically at 2 p.m., September 25, 1986,
this joint venture presented the low bid for the "combined base bid" category
and we feel the City will benefit from having a single contractor build both
projects. We also recommend that the City accept alternates AI, A2, and B1, and
reject alternates A3, A4, and B2, bringing the total to $2,215,700.00.
Through the Wm. Ri gg Co. in Fort Worth, I have veri fi ed that the bondi ng com-
pany, Fidelity and Deposit Company of Maryland, is certified to do business in
the State of Texas as well as nationwide. We do advise that the City consult
legal counsel regarding the bid bond.
Both contractors are known to our firm, but we have not had experience with them
operating as "a full joint venturell per the bid bond. The City might wish to
have further documentat i on presented as to the joi nt venture agreement ; tse 1 f
and advise you seek legal couns~.l. We have their independent qualification
statements on file, including financial statements, should you wish to review
them.

alterations.
The low bid for the Police Department was $1,208,000. Our estimate cost for this
project was $1,867,117. Funds allocated for this project are restricted and can not be
reallocated to projects other than Police facilities. Several major items in the Police
Department plans were deleted as a cost saving effort. One of these items includes
resurfacing the entire parking lot around City Hall with concrete. We also anticipate
major remodeling costs in the old Police wing of City Hall. We are now in the process
of combining an estimated cost of all items so that they may be included in this
project. We will present these items to the City Council at a later time in the form of
a proposed Change Order.

NRG Softball Association Proposed Building
North Richland Girls Softball Association approached the Parks and Recreation Board on
October 1, 1986 with plans for a restroom and meeting hall (20' x 55') to be erected at
Fossil Creek Park. Since this item was not on the Park Board Agenda, the Board gave a
consensus opinion in which they showed no objection to the construction of this building
with the condition that the building complies with all city building codes and if such
construction by a private organization on public land is legal.
The North Richland Girls Softball Association has also asked for assistance from the City
in the funding for this construction project in the amount of $4,000.00. The estimated
value of the entire building will be approximately $40,000.00.
Funding Source:
Although funds were not specifically budgeted in the Parks and Recreation Department
Budget for this request, sufficient funds are available in Reserve for Contingency
Account Number 01-99-01-5970.
Recommendation:
It is recommended that City Council approve this request and appropriate $4,000.00 from
the Reserve for Contingency to the Parks and Recreation Department Account Number
01-70-02-6200.

SYSTEM/36 COMPUTER AND DISPLAY UNITS; FINDING THAT AN EMERGENCY
AND URGENT PUBLIC NECESSITY EXISTS THAT NECESSITATES THE PURCHASE
OF SUBJECT EQUIPMENT IS COMPATIBLE FROM AN ECONOMIC AND REALISTIC
STANDPOINT TO BE IMPROVED UPON AND MODIFIED BY THIS SUBJECT
EQUIPMENT DUE TO ITS UNIQUE CHARACTERISTICS: FINDING THAT THE
PRINCIPAL AMOUNT OF THE CONTRACT AS BID IS THE LOWEST COMPETITIVE
PRICE IN THE MARKET PLACE FOR THIS TYPE OF EQUIPMENT; FINDING
THAT THE SAVINGS TO THE CITY AND ITS TAXPAYERS ARE SUBSTANTIAL;

WHEREAS, in November 1983 the City authorized and did purchase an
additional IBM System/36 Computer to upgrade our computer system; and
WHEREAS, the City's needs for this type of equipment have
increased dramatically and it is necessary to expand the system
capabilities to meet the ongoing and ever increasing needs of the City's
citizens; and
WHEREAS, the City Staff that works with the computer system daily
and has experienced the problems brought about as a result of the rapid
growth has concluded that the needs of the City created an emergency
condition and an urgent public necessity to immediately purchase equipment
to expand the system and t~e City Council so agrees and finds; and
WHEREAS, the IBM System/36 Computer is the logical migration path
for the City due to its cost, its capacity, its speed and the fact that the
IBM System/36 is directly compatible with the City's present System/36
Computer and IBM 8809 Tape Drive and present Display Stations which will
eliminate any conversion and/or modification; and
WHEREAS, the City Council finds that the said IBM System/36
Computer has unique characteristics that are not found in other equipment
in so far as a conversion is concerned; and
WHEREAS, the City Council finds that the sales price bid by
Municipal Software for the IBM System/36 and Display Stations with all
attachments is the lowest and best bid available in the market place and
the City, its citizens and its taxpayers savings are substantial.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
North Richland Hills:
Section 1. That all of the statements contained in the preamble
are found to be true and correct and are incorporated herein as if copied
in their entirety in the body of this resolution.
Section 2. That the City Council does hereby find based on the
above recited facts, that all competitive bidding requirements of State Law
have been duly and reasonably satisfied and that the bid of Municipal
Software for an IBM System/36 which system is described in detail in the

the balance of the expansion of the IBM computer systems from IBM as it can
be delivered during the fiscal year for a maximum cost of $92,577.00.

Several years ago the City of North Richland Hills requested that
the railroad crossing at Smithfiel-d Road be upgraded with full "signals
and a new roadbed crossing. This crossing was approved by the State
to be rebuilt and it required that the City participate in the amount
of 10% of the total cost and that the rnilroad would participate 10%
of the total cost. The federal government would participate 80% of
the total cost through the state.

The state has requested that we escrow our $10,500 for this
construction with them at this time. It is the staff's understanding
at this time that it will be approximately nine months before this
crossing will be constructed.

Change Order #5, Chapman Drive Paving and Drainage
Improvements, North Forty Road
North Forty Road in Morgan Meadows was scheduled to have borrow ditches
on each side of the roadway during the construction of Morgan Meadows
East drainage facilities. However, it has been determined that these
borrow ditches would have to be constructed too close to the roadway
and would cause hazardous vehicular travel on this road. This was
discussed in a CIP Committee meeting and it was decided to recommend
approval of a change order to the APAC-Texas, Inc. contract on
Chapman Drive to construct a storm drain in North Forty Road and
to repave the road after completion of the storm drain. A change
order in the amount of $109,847.83 for this project has been negotiated
based on Chapman road unit prices, which were considered to be
advantageous.
Funds are available in the CIP Unspecified Projects account for this
project.

Reconnnendation:
It is recommended that Change Order #5 to the APAC-Texas, Inc.
Chapman Road contract be approved for the purpose of constructing
a storm drain and repaving a portion of North Forty Road; and that

was approximately $800' more than the $30,000 we are recommending.
The $30,000 figure is a negotiated amount. Even though this job
took a year and a half to complete, it is a good job and should
take care of the flooding in Morgan Meadows Subdivision and other
areas nearby.

Enclosed is one copy of Contractor's Partial Pay Estimate No. 11 & Final,
dated July 25, 1986, made payable to LCH Construction Company, in the
amount of $30,000.00, for materials furnished and work performed on the
referenced project as of July 7, 1986.
The quantities and condition of the project have been verified on-site by
your representatives, Floyd McCallum and Larry' Jones, as indicated by
signature on the estimate, and we have checked the item extensions and
additions.
This project includes drainage channel construction in the Morgan Meadows
Addition from Chapman to Hightower. Also included are· minor roadside
drainage ditch work on North Forty and Hightower Drive and concrete work
on the Walker Branch Channel. The total contract amount, including change
orders, based on original estimated quantities of construction, totals
$893,843.51. The total contractor earnings, based on actual verified
- as-built quantities totals $907,892.11, which is $14,048.60 over the
contract amount. The attached Construction Project Status Report accounts
for the differences in estimated and actual as-built costs for each pay
item.
In accordance with Section 3.2.11(a) of the Contract, the two (2) year
term of maintenance will begin on this date, and therefore, will terminate
on October 7, 1988. The maintenance obligation includes repair of all
water line leaks and malfunctions of all valves, including repair of all
sewer breaks or stoppage, and malfunctions of other equipment furnished
and installed under this contract. The maintenance obligation also
includes sealing of pavement cracks, repair of pavement buckling or other
failures, along with failure of all concrete flatwork and other concrete
structures.

The Contract Completion Time was 400 Calenday Days, including change
orders, plus an additional 62 days added due to delays caused by other
. utility companies, (see attached correspondence). Since the project was
substantially complete within the 462 day period, we would not recommend
assessment of liquidated damages.
In the absence of any outstanding legitimate claims against this
contractor from sub-contractors, suppliers, or adjacent property owners,
in accordance with the provisions of items 3.12 and 3.13 on page G-6 of
the "General Conditions" of the Contract, we would recommend that the
total final payment, in amount of $30,000.00, be made to LCH Construction
Company, 5001 Saunders, Fort Worth, Texas 76119.
