7. Mayor Echols advised that if the Council granted the
request it could be set for July 22, 1985.
Councilman Ramsey stated that he thought some of
the Council members would be absent at the July 22nd
meeting and before the hearing was set to make sure all
would be present.
Councilman Newman and Councilwoman Moody advised they would
not be present at the July 22nd meeting.
Councilman Ramsey moved, seconded by Councilman Kenna, to
grant the appeal hearing to be heard August 12, 1985.
Motion carried 7-0.
8. Mayor Pro Tem Davis'moved, seconded by Councilwoman Moody,
to approve SO 85-9.
Mrs. Virginia Rader, 5004 Oak Timber Ct., Colleyville,
appeared before the Council.

Mrs. Rader stated she wished to have the sign at 8011 and
8013 Grapevine Highway. Mrs. Rader stated that two years
ago a permit was granted for one sign, but another sign
was needed.
Councilman Ramsey asked Mrs. Rader if she would be satisfied
with the size of the sign.
Mrs. Rader stated yes.

13. Mayor Pro Tem Davis moved, seconded by Councilman
Kenna, to approve GN 85-61.
Councilman Kenna stated that in the preamble to this
item it seemed that the City missed the fact that the
driveway would open onto Rufe Snow Drive. Councilman
Kenna stated that if in fact the plans showed the
location of the drive and the plans were approved, he
thought it would be very wrong to come back and require
someone to change the plans. Councilman Kenna stated he
would recommend that in the future when construction
plans were reviewed, more attention should be payed to
such things as driveways.

DENIED
Mayor Pro Tem Davis stated that if the driveway was
overlooked he did not think the burden should be placed
on someone to change their plans.
Councilman Ramsey stated that the ordinance was clear
concerning curb cuts on Rufe Snow Drive and just because
the staff overlooked something that was in violation of
the ordinance, it did not give everyone carte blanche to
go out and do what they wanted to.
Mayor Pro Tem Davis stated he did not think there was an
ordinance against this, but it was at the discretion of
the Public Works Director to approve curb cuts on Rufe
Snow Drive.
Mr. Line stated that the ordinance gave the Public Works
Director the authority to review and approve curb cuts
onto any street. Mr. Line stated the initial review of
these plans was from the standpoint of looking at the
construction of the house and it would have been very
desirable if the driveway had been noticed.
Mayor Pro Tem Davis called for the question.
Motion to approve failed 5-2; Councilmen Fisher, Newman
and Ramsey and Councilwomen Hinkle and Moody voting
against; Councilman Kenna and Mayor Pro Tem Davis voting
for.
Mr. Rick Tuggle appeared before the Council.

Mr. Tuggle stated that if had known he would not be
allowed to make a curb cut on Rufe Snow he would not

have built the house. Mr. Tuggle stated he had
submitted his plans and they were approved and it would
be a tremendous cost to change the driveway.
Mayor Pro Tem Davis stated he felt Mr. Tuggle had done
what he was suppose to and his reason for wanting to
approve the request was because the construction was
already started.
Councilman Ramsey stated the discussion was out of order
and the Council should move to the next item.
18. Mayor Pro Tem Davis moved, seconded by Councilman Ramsey,
to table PW 85-18 for two weeks to allow the Staff and CIP
Committee time to evaluate the bid and possibly talk to the
contractor about the long number of days.
Motion carried 7-0.

Fort Worth, appeared before the Council.
Mr. Bushong gave the Council a briefing on the emergency
services offered by the Civil Air Patrol. Mr. Bushong stated
he was offering the services of the Civil Air Patrol in any
emergency the City might have. Mr. Bushong stated that
anytime the City might need help, feel free to call.

This Zoning Application is pT..ented on the existing residential tract located on the
southwest corner of Amua4sonROad at Precinct Line bad.. . The subject property is 4.77
acres in size. The requested rezoning is from AG Agricultura.to 0-1 Office District.
The applicants stated intent is to build sn office parkwñ:ichwould be compatible with
their surrounding residential' de~elopment . -
The Staff made several comments on the proposed request for the Commission's
consideration.
(1) Both Precinct Lil)e Road and Amundson Road are. proposed for widening in the
Thoroughfare Plan. PrecinetLine Road is projected to be a six lane divided street.
Amundson Road is projected to be a four lane undivided straet.Both these improvements
will require additional street right of way dedication from the subject property and
participation in the street eonstrúction.
(2) In the proposed. laud use of the area no commercial Uses are projected. However,
recently the Commission.:a.nd the City Council approved a si1nilar request for office
zoning on the opposite'corner ofihis intersection.

Hearing and called for those wishing
to speak in favor of this request to
please come forward.
David Barfield came forward to
represent Hanson Properties. He said
they had purchased most of the land
from Amundson to Martin. He said they
plan to build an office which will
resemble houses. Mr. Barfield said
they want it to match Nob Hill
Addition which will have brick streets
and old type street lights. He said
they already have 0-1 zoning on the
other side of the street. Mr.
Barfield said he had talked with the
neighbors and they have no objections.
He said the office would look like the
one on Harwood Road and it will be
deed restricted.
Chairman Bowen called for those

forward. He asked what they plan to
do to improve the streets. He said
they have traffic problems now, but he
had rather have this instead of a 7-11
store.
Mr. Royston stated that Precinct Line
is proposed for a 6-lane thoroughfare
and Amundson a 4-lane and Mr. Barfield
will build half of the road.
Chairman Bowen closed the Public
Hearing.
Mr. Tucker made the motion to approve
PZ 85-36. This motion was seconded by
Ms. Nash and the motion carried 4-0.

David Barfield came forward. He said
they had bought the Coulson property
which had been zoned Multi-Family for
about 15 years which allows 19.8 units
per acre. He said they have added Mr.
Mitchell's property to allow them to
have from 125 to 128 units spread over
more land. Mr. Barfield said they
plan to build garden homes which will
sell from $80,000 to $120,000. He
said they will be 1,200 square foot
minimum instead of the required 1,000
square feet and would be of the same
structure as the Nob Hill Addition.

AFTER APPROPRIATE NOTICE AND PUBLIC HEARING THE FOLLOWING RECOMMENDATION

Chairman Bowen called the meeting back
to order at 8:40 P. M. with the same
members present.
Request of Roma Corporation to rezone
Lot 3, Block 2, Cochran Addition, from
its present classification of C-2
(Commercial) to C-2-Specific Use-Sale
of Alcoholic Beverages. This property
is located at 8010 Bedford-Euless
Road.
Chairman Bowen opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
Susan Riess with Roma Corporation came
forward. She said they plan to have a
Tony Roma restaurant which would serve
Bar-B-Q and Chicken. She said they
have three stores located in Addison,
Dallas, and Houston. Ms. Riess stated
that the previous restaurant located
there sold alcoholic beverages.
Chairman Bowen said they would need
the name of an individual to put the
Specific Use Permit in when they go to
the City Council.
Ms. Riess said that would be fine.
Chairman Bowen called for those
wishing to speak in opposition to this
request to please come forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.
Mr. Tucker made the motion to approve
PZ 85-60. This motion was seconded by
Ms. Nash and the motion carried 4-0.

Chairman Bowen opened the Public
Hearing and called for those w~shing
to speak in favor of this request to
please come forward.
Peggy Krussell came forward. She said
they wish to provide a carwash service
for their customers. She showed a
picture to the Commission of a Mobil
Carwash. Ms. Krussell said it would
be a self service, fully enclosed
35,000 square feet carwash. She said
this property is surrounded by 12
acres of Commercial zoning. Ms.
Krussell said the closest carwash to
this proposed site is one block north
of 820 on Lewis Drive. She said they
had several studies made which show
the carwash is preferred by their
customers. She said it is free to
customers who buy gas.
Chairman Bowen called for those

Engineer, came forward. He stated
this property is located at the corner
of Glenview and Dawn Drive; it is
1,185 feet along Dawn Drive and 540
feet along Glenview Drive. Mr.
Stembridge said there would be.80+
lots of high quality, detached garden
homes with a masonry fence. He said
they would range in size from 1,200
square feet to 2,400 square feet;
Pat Marin, 6412 Harmonson, came
forward. She asked if it run along
Dawn Street to Honey Lane.
Mr. Stembridge said it runs along Dawn
Drive and is bounded by Harmonson Road
and Glenview Drive.
Ms. Marin said she is very much in
favor of this request.
Chairman Bowen called for those
wishing to speak in opposition to this

Edmond Howell, 4033 Honey Lane, came
forward. He said this area consists
of the young adults and the elderly
folk. He said they have a very nice
view of the Fort Worth sky line. Mr.
Howell asked if there would be a
private alley. He stated that others
see them as low income people, but
some have lived there 23 to 30 years
and do not wish to be encroached on.
Mr. Howell said the plat looked like
there were quite a few lots and feel
they would have a box car effect.

Mr. Tucker said there would be drives
in the back with rear entry garages.
Mr. Howell said he felt there would be
noise and they would disrupt the view.
He said when their peace and quiet and
the view .go, we will have to move. He
said he is for progress as long as it
does not infringe on them. Mr. Howell
said he felt they would be rooted out
and he is against this rezoning.
Russ Borson, 6408 King Arthur Court,
came forward. He said this is .an
exclusive, nice residential area and
they have 4 apartment complexes. He
said this is a mixed use and enough is
enough.
Mr. Tucker stated these will be single
family detached houses that will range
from 1,200 to 2,400 square feet with
rear entry garages. He said they
propose to build single family
detached houses similar to Diamond
Loch and at the prices they will be,
they would not buy for a rent house.
Thomas Jacques, 6513 Memory Lane, came
forward. He said the Valleyview
apartments did not do good as
townhouses so they went as apartments.
Vicki Borson, 6408 King Arthur Court,
came forward. She said she wanted to
buy one for her mother, but they were
never for sale.
Mr. Tucker said the ordinance has been
re-written since then; they must show
a site plan and lots which is
protection for the property owners.
Mr. Howell asked how many units per
acre is R-3.
Mr. Tucker said approximately 4 per
acre.

be in this zoning.
Mr. Tucker said there are 82 lots in
15 acres.
Mr. Howell asked if they thought it
could be developed in nice homes as
Diamond Loch.
Chairman Bowen said R-3 zoning is the
smallest single family dwelling.
Larry Martinez, 4025 Honey Lane, came
forward. He said he is in opposition
to this request. He said he came here
from the John Petersmith area to get
away from this. He said it is now a
field and this would invite more
traffic and crime in the area.
Pat Marin came forward. She said
someone has a misunderstanding, the
value of these houses will be in
excess of $100,000; they will not
increase crime, they will raise the
value of the homes in the area. Ms.
Marin said they would be a plus for
the neighborhood and she had nine
people stand who are for the rezoning.
Mr. Tucker said he figured and they
would run from $92,500 to $250,000.

AFTER APPROPRIATE NOTICE AND PUBLIC HEARING THE FOLLOWING RECOMMENDATION
IS SUBMITTED TO THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS BY
THE PLANNING AND ZONING COMMISSION:
RESOLVED that on Case No. PZ-85-66 the following described property shall
be rezoned from R-3 to R-6-T.
BEING a tract of land in the M. Lynch Survey, Abstract 953, Tarrant County,
Texas, and being all that tract conveyed to E. E. Jeanes as recorded in
Volume 3670, Page 112, and tract conveyed to E. E. Jeanes and recorded in
Volume 3670, Page 115, Deed Records, Tarrant County, Texas, and being more
particularly described by metes and bounds as follows:
BEGINNING at a point at the intersection of the south right-of-way of
Glenview Drive and the East right-of-way of Dawn Drive, said point being
the Northwest corner of said Jeanes Tract, Volume 3670, Page 112;
THENCE South along the east R.O.W. of Dawn Drive for a distance of
1210.00feet to a point in the centerline of Harmonson Road for corner;
THENCE South 89 degrees 37 minutes East along the centerline of Harmonson
Road for a distance of 540.12 feet to a point for corner;
THENCE North along the east property line of Tract 2E for a distance of
1210.00 feet to a point for corner in Glenview Drive;

David Barfield came forward to
represent Mr. & Mrs. Hanson. He said
these would be part of the Nob Hill
Addit~on and is located at the top of
the hill. He said they plan to deep a
large oak tree in the middle of the
cuI de sac. He said the street would
be made of brick. Mr. Barfield said
the other request, they had to buy to
have access 1nto the addition. He
said they bought 1~ acres, but got
only one lot out of it. He said the
lots would be thé same size and
criteria as Nob Hill.

I do not agree that the driveway is going to cost an additional 5 to 7
dollars as Mr. Tuggle has stated. .1n·his letter and it will not devalue
property. I had told Mr. Tuggle that 'there are plepty of other houses
have garages on the back of the house with driveways running along the
side of the house and suggested that he could run his drivèWáY along either
side of this house to get into the aarage which is on tlie raar of the house.
Rufe Snow in this area in the future is' going to carry. lot of traffic
and if we can eliminate' a traffic hazard by not allowing a driveway opening
onto Rufe Snow, we willbè better off in the future. I do not feel that
this creates a hardship' on this bùilder.
Recommendation: The staff reCOllllDandà,tion is to deny the reqùest of Rick
Tuggle for a driveway Opèning onto Rufe Snow.

A RESOLUTION ABANDONING AN EASEMENT ON THE NORTH SIDE OF
LOT 4R, BLOCK 3, RICHLAND OAKS ADDITION TO THE CITY OF
NORTH RICHLAND HILLS, TEXAS:
WHEREAS, the City Council of the City of North Richland Hills,
Texas, finds that it presently owns a five foot by one hundred foot easement,
previously dedicated for general utility use purposes, on property described.
below; and
Whereas, the City Council further finds that the City of North
Richland Hills no longer needs, uses or anticipate& a need or use for such
easement.
Now therefore, BE IT RESOLVED by the City Council of the City of
North Richland Hills that:
I.
The City of North Richland Hills shall, and does hereby, abandon
all right, title or interest in and to that certain five foot by one hundred
foot easement along the north property line of Lot 4R, Block 3 of the
Richland Oaks Addition to the City of North Richland Hills, Texas, such
easement having been previously granted and dedicated to the City of North
Richland Hills by platting of said Richland Oaks Addition in Vol. 388-8, page
80, Plat Records, Tarrant County, Texas.
II.
By passage and adoption of this Resolution it is the intent of the
City of North Richland Hills to relinquish any and all claims to such
easement or to any future use of such easement. This Resolution shall be
filed with the Deed Records of Tarrant County, Texas, as evidence of the

INTRODUCTION

The following document is a request for proposal (RFP) for bank
depository services to be approved by the City Council and to be sent to
eligible banking institutions in the City of North Richland Hills. The
current depository contract expires on September 30, 1985. State laws
empower the City to initiate a bidding process and to select a bank which, in
the sole opinion of the City Council, is the best overall proposal. The
request for proposal is being sent only to banks within the corporate City's
boundaries.. a legal requirement if there are two or more banks residing
within the City.
This is a format and a process which has been used and accepted by at
least ten cities in the State of Texas and has received favorable response
from over two dozen banks in regard to its completeness and its professional
approach. It is structured to be a fair proposal, taking into consideration
most of the safeguards and concerns of a majority of banks, However, it is a
pro-city contract. By that I mean that it's goal is to maximize every aspect
of the depository relationship in favor of the City of North Richland Hills,
It is for that reason that this RFP needs the review and approval of the City
Council and that authorization be given to the staff and consultant to
proceed with the bidding process as outlined.
HIGHLIGHTS
One of the more significant aspects of this depository approach is that
the City is not asking for any free services from the banking community. The
banking services are viewed separately from the investment services. The
City is offering to pay for any and all of the services provided by the bank
based on defined rates, considered to be the cost of providing those services
to the City.

The City then expects the banks to bid a competitive rate on investments
in certificates of deposit, The bids are compared to a widely used market
rate indicator, the treasury bill yield for similar maturities. If the rates

are lower than market, the City is establishing up front that they will
likely decide to invest directly in T-bills or any other legal investment, a
prerogative provided by the State Legislature several years ago, In the
event this investment path is selected, the City is asking the proposing
banks to handle the placement of these investments on a fee basis.
Texas law is very one-sided in favor of public funds having maximum
protection. For instance, all of the bank accounts plus any investments in
certificates of deposit must have an equal amount of securities held in
safekeeping by a third party which is collateral put up by the depository
bank, This RFP outlines the required trustee arrangement so that there will
never be a circumstance when the City's funds are jeopardized, regardless of
the financial condition of the depository bank.
The RFP calls for SuperNow accounts, interest bearing accounts which are
offered to individuals, sole proprietorships and governmental bodies, In
essence these accounts were created to allow unlimited deposit and check
writing privileges while providing a yield that originally was established to
compete with the money market funds. Although the bank. rates are less
competitive than when the SuperNow accounts first became eligible, -they are
nevertheless comparable to a reasonably good market rate and allow for the
City to be earning money on all funds at all times,

The RFP also includes a number of bidding and operating requirements
which are designed to minimize confusion in the review process and to provide
for a good relationship throughout the contract period. Almost all of these
characteristics are welcomed by the banking community, Some of these
features have actually been at the request of interested bankers during the
bidding process over the past few years as this current RFP format has
evolved. The tone of the RFP reveals that the City is mainly interested in
being treated like a corporate customer, one who wants to have a good
business relationship in which all parties can be pleased over the contract
period.
SUM1'1ARY
This approach is the product of working with over ten cities and various
banks in the State, The RFP is structured to make this a pro-city
arrangement while being fair to the financial community. The bidding process
can yield a superior contract when there is true competition within the
banking community. This is not always easy to determine because of the
multiple factors involved, However, the standards of measurement are
published service fees from other banks and the market rates on investments
as established by treasury bill yields. The support of the City Council is
vital to the success of the bank depository bidding process,
I look forward to the opportunity to explain this approach to the City
Council and, subsequently, to meet with the bankers at a bidders conference.

The City of North Richland Hills is seeking applications from
eligible financial institutions to be the depository for public
funds of the City. The contract period will be two years
beginning October 1, 1985 and thereafter until the successor
depository shall have been duly selected and qualified according
to state laws, At the outset, the City wishes to communicate the
primary objectives of the depository agreement, an important
component of the overall treasury and debt management program of
the City of North Richland Hills:
o To seek a bank that is both capable of providing
banking services and willing to be attentive to the
City's money matters;
o To maximize the total dollars earned by the City on
invested monies in order to be prudent and effective
custodians of the taxpayer's financial resources;
o To maintain a good working relationship with the
Depositor Bank; and

bid form for the depository agreement. There are several blanks
to fill in and questions to be answered. The depository
agreement will be prepared based on the bidder's response to this
RFP. All points outlined and materials requested should be
incorporated into the bidder's reply to be considered for
evaluation. Attachments will be appropriate in order to answer
some of the enclosed questions.

To assist in the preparation of the RFP and in the review of the
resulting proposals, the City has engaged Mr. Lewis F, McLain,
Jr. to serve as an advisor. The depository review process will
be coordinated by Mr. Lee Maness, Finance Director. The City
desires to enter into a contract that will maximize the City's
interests, yet will be viewed as a good agreement on behalf of
the Bank. City staff and advisors will be happy to answer any

the largest total balances the City of North Richland Hills
maintains in the Bank. The securities comprising the pledge

pledging same must satisfy the requirements of Article 2560
Tex, Rev. Civ, Stat. Ann.
B. The Bank shall provide the City a report of securities
pledged at the end of each month or at any time requested by
the City Manager, the City Treasurer or a designated
representative. This report should reflect the following

issued by the Bank. However, since the state law now allows
the City to invest in direct debt securities of the U. S,
Government, the City will possibly select this permissible
alternative in the event the proposed C. D. rates are not
greater than the yields for Treasury Bills,
In the event the City elects to invest directly in T-Bills,
or any other allowable government securities, the City may

the Finance Director a period not exceeding one business day

B. The Bank agrees to loan funds to the City of North Richland
Hills on a short term basis, if needed, for operational
purposes and for capital expenditures only, The short-term
loan amount that will be assumed for bid evaluation purposes
is an eighty percent (80%) equipment loan of $500,000 set up
on a five year payback schedule which must be rolled over at
the end of the two year contract period. The payment period
will be monthly. If the interest rate is stated as a
percentage of prime, you must indicate how closely your
bank's prime interest rate tracks the accepted New York
prime rate which was 9.5% on July 1, 1985. What is the
basis for computing the rate to be paid the Bank by the City
of North Richland Hills is as indicated below:

VII. OTHER ~TIPULATloN~
A. The successful bidder will notify the City in writing within
ten (10) days of any changes in Federal or State regulations
or laws that would thereafter affect the depository
agreement. The Bank shall also notify the City of any
services that become available to the City throughout the
contract period.
B. Notification of wire transfers shall be made within one hour
of the transaction and a duplicate copy furnished to the
City within twenty-four hours.
C. That in the event it would be ruled illegal under the
provisions of any Federal Statute or regulation for the Bank
to pay interest in the manner outlined in this RFP, then the
City expressly reserves the right and privilege to cancel
the contract and to re-bid the depository services.
D.
The Bank's records relating to the City of North Richland
Hill's accounts shall be open to review by either City staff
members or City appointed independent auditors during normal
business hours.

E. The proposing Bank should submit a copy of the last annual
financial statements along with the last four FDIC call
reports,
F. The term of the contract period will be for two years
beginning October 1, 1985, and ending September 30, 1987, or
thereafter until a successor depository has been selected.

WHEREAS, the City of North Richland Hills (hereinafter
"the Ci ty") has worked diligently for a number of years to cause major
interchange improvements to be made to the intersection complex of IH
820~ SH 121, SH 26, and FM 1938 (hereinafter "Interchange") ¡
WHEREAS, the State Department of Highways and Public
Transportation (hereinafter the "State"), through the actions of the
Highway Commission and of Mr. J. R. Stone, District Engineer of
Highway District No.2, have expressed keen interest in working with
the City, other municipali ties and concerned ci tizens to redesign the
Interchange so that the present and anticipated traffic congestion
will be eliminated¡
WHEREAS, the State and the City are in agreement that all
traffic movements in and around the Interchange must be closely
studied and corrected no later than the completion and operation of
the redesigned Interchange ¡
WHEREAS, the State has requested that the City agree to
support and cause the frontage road traffic adj acent to and along the
southwest portion of the Interchange to be oriented in a one-way
southbound movement as opposed to a two-way movement by such time as
the bids are received on the first increment of the Interchange
revision¡
WHEREAS, the City agrees that said one-way movements are
appropriate for the efficient and safe flow of traffic in and around
the Interchange, but recognizes that said goal cannot be accomplished
without great inconvenience to a large number of motorists prior to
the completion of several maj or road improvement proj ects in the area
immediately to the southwest of the Interchange¡ and
WHEREAS, the State acknowledges and understands the need
for the above mentioned road improvements to occur prior to the
frontage road directional movements being changed¡
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City
Council of the City of North Richland Hills, by the authority vested
herein, do hereby recommit their support to work with the State and
any and all other appropriate persons and entities to facilitate the
redesign, construction, and operation of the northeast Loop 820
Interchange as quickly as possible,
FURTHERMORE, BE IT RESOLVED that the City supports the one-
way southbound orientation of frontage road traffic adjacent to and

Enclosed is one copy of Contractor's Partial Pay Estimate No.4, and Final,
dated April 17,1985, made payable to Gibbins Construction Co., in the amount
of $5,109.63, for materials furnished and work performed on the referenced
project as of March 31, 1985.
This project includes curb and gutter and paving reconstruction of Palomar
Drive as required because of construction of the off-site storm drain in
Palomar by Burk Collins in connection with the Nor'East Addition Development.
Also included in this project is construction of a 12-inch water line as part
of a future extension from Davis Blvd. to Lola Drive.
The quantities and condition of the project have been verified on-site by your
representative, Floyd McCallum, as indicated by signature on the estimate, and
we have checked the item extensions and additions.
A "Construction Project Status Report" is provided which accounts for
differences in the original estimated quantities and actual as-built
quantities. We would note that the total contractor earnings are $9,860.75
less than the Contract Amount based on contract unit prices and original
estimated quantities.
We recommend that this payment, in amount of $5,109.63, be made to Gibbins
Construction Co. at 441 Haltom Road, Fort Worth, T~., 76117.
In accordance with Section 3.2.11(a) of the Contract, the two (2) year term of
maintenance will begin on this date, and therefore, will terminate on April
24,1987. The maintenance obligation includes repair of all water line leaks
and malfunctions of all valves, and other equipment furnished and installed
under this Contract. The maintenance obligation also includes sealing of
pavement cracks, repair of pavement buckling or other failures, along with

Although the total contract completion time of 100 calendar days was exceeded,
the Contractor was delayed by weather and other problems in the area which
were beyond his control, therefore, we do not recommend that liquidated
damages be assessed. (See attached letters)

Construction Company that they would not receive their final payment
until the church is satisfied with the condition of their back lot.
If Gibbins Construction Company did not make arrangements with the

there, then he will have to move it all out to your satisfaction.
I am enclosing an extra copy of this letter with a statement on the
bottom for the church to sign as soon as they are satisfied with
Gibbins Construction Company taking care of the problem on your lot.
