11. Mayor Echols advised that the Staff had determined that the
proposed sign could be permitted should the Council approve
the variance to the minimum lot width required.
Mayor Pro Tem Davis moved, seconded by Councilman Kenna, to
approve SO 85-13.
Motion carried 6-0.
12. Dr. Alexander Graham, 5409 Davis Boulevard, appeared before
the Council.
Dr. Graham stated that he felt the reasons given in the
letter he had sent to the Council justified his request.
Dr. Graham stated that he had a medical facility at this
location and felt it needed to be properly identified.
Mayor Echols stated that in the Staff's opinion approval
of this variance request would set a precedence for
several adjacent lots in the same area.
Mr. Brian Mead, Mead Construction Company, appeared
before the Council.

Mr. Mead stated that there were residential homes on both
sides of Dr. Graham's property.
Mayor Pro Tem Davis asked what the minimum width of a
commercial lot was.
Mr. Royston stated the minimum width was 50 foot
frontage on the street.
Mayor Pro Tem Davis asked if this meant that if the
adjacent property to Dr. Graham was zoned commercial then
they could not have a pole sign.
Mr. Royston stated no, not without a variance.
Councilwoman Moody asked if there was any type of sign
that could be on the site that would be in conformance
with the ordinance.
Mr. Royston stated no, Dr. Graham could install a wall
sign.
Mr. Mead stated that he felt it was important that the
office be identified.
Dr. Graham asked about installing a portable sign.

This Zoning Application is presented on two existing lots located on the northeast
corner of Grapevine Highway and Ken Michael Court. The property is currently vacant
although in the past some type of building had been started on the two lots. The
requested rezoning is from C-1 Commercial and R-2 Single Family to C-2 Commercial. The
purpose for the requested rezoning is to allow the applicants to develop an automotive
repair and retail center on the site.

The Staff noted to the Commission that the rezoning request include a lot which is
currently zoned residential and as such represents an encroachment into the existing
neighborhood. It is apparent, however that an assumption was made by a previous owner
of this property that the two lots were available for commercial development. This
would explain the foundation already in place on the property. The Staff also noted
that a replat of the two lots will be required to combine the lots in order to develop
the property.

RECOMMENDATION:
The Planning and Zoning Commission recommended approval of Zoning Application PZ 85-114,
rezoning Lots 10 and 11, North Edgley Addition from C-1 and R-2 toC-2.

Commercial zoning to the east of this
property and Multi-Family zoning to
the north of this property. Mr.
Perkins stated the development would
be a quality product with steep roofs
and they would stick to the site plan.

I am Opal H. Kreitner (formerly Opal H. Ma1es),owner of the property-
Lot 9, North Edge1y Addition. This lot is abutting Lot 10 on the north.
I am very much in favor of rezoning this property from R-2 and C-1 to
C-2 so that a nice business can be built on it. A building built ac-
cordi ng to requi rements of the City of North Ri ch 1 and Hi 11 s \'Ii 11 be an
asset to our area. This spot has been an EYESORE long enough and I think
something should be done to dress-up our entrance to Ken-Michael Court.
These businesses can be made attractive so that the residents of North
Rich1and Hills will be proud to have someone drive through our area.
Mr. Kenworthy and Mr. McKenzie' have plans to build an attractive building
on Ken-Michael Court and Grap~vine 'Hwy. (now Hwy. 26) and a business of
the type planned is needed in our area. I would like to see the Planning
and Zoning Committee of our City grant this request.

This Zoning Application is presented on the vacant tract of land located on the west
side of Eden Road north of the St. Louis and Southwestern Railroad. The requested
rezoning is from AG Agriculture to R-2 Single Family. The purpose for the requested
rezoning is to allow the development of a single family project in compliance with the
R-2 District criteria. The subject tract is 5.0 acres in size. The configuration of
the tract dictates that the lot layout be a tier of lots arranged on either side of the
proposed street. The Staff to the Commission that the width of the subject property
makes it physically impossible for the proposed lots to meet the minimum lot depth
criteria of the R-2 District. The district requires that the average depth of the lots
be a minimum of 100 feet. One proposed tier of lots is 97 feet deep and the other tier
ranges from 97.3 feet to 99.2 feet. The provisions of the Zoning Ordinance will allow
the Commission the latitude to approve these deviations in unusual circumstances. The
applicant indicated that the proposed lots would be oversized as to the required square
footage in the R-2 District and that the project would be restricted to homes of 1800
square feet or larger.

The layout also proposes that the street not be terminated within the tract but he left
for later extension into the vacant tract to the west when further development occurs.
This should be coordinated with the development of the adjacent tracts.

The Planning and Zoning Commission recommended approval of Zoning Application PZ 85-116,
rezoning Tract 4C J.B. Eden Survey Abstract 499 from AG (Agriculture) to R-2 Single

north side of Loop 820 and Bedford Euless Road at Oakridge Terrace. The requested
rezoning is from R-1 single Family to C-1 Commercial. The applicant's stated intent to
develop the property into an office/retail complex. Also the proposed project would be
coordinated with the commercial center recently approved on the property immediately to
the east of the subject property.

In the Staff review of the rezoning proposal two areas were noted for Commission
consideration.

1) The subject property is located directly in the intersection of Bedford Euless
Road and Loop 820. Currently the access to the property is from Oakridge Terrace. This
side street provides a very minor movement into the existing traffic signal at Bedford
Euless Road and the Airport Freeway. With the addition of a commercial use at this
location the increased traffic will require some modification of the signal allocation.
The signal system is the responsibility of the City of Hurst and the State Highway
Department.

2) The recently proposed improvements to the Freeway Interchange will require that
some additional right of way be acquired from this site. At this time it is not known
to what extent and in what configuration the right of way will be needed. However, the
applicant should be made aware of this need and asked toma~e some commitment to this
future project.

this property lies on Airport Freeway
and Bedford-Euless Road. He said it
joins Burk Collins' property on the
east. Mr. Smith said the channel is
on his property. He said the property
to the west was zoned about 8 months
ago. He said he will use the same

Mr. Smith said with the traffic light
at Mr. Collins' property and the light
at Oakridge, they would not need any
curb cuts. He said this would be for
office use and some retail, but not

Associates came forward. He said they
have the plat and plans for the Old
Town Center which shows box culverts
and retention basins. He said they
had reçeived the comments from both
cities. Mr. Fluitt said the only
comment from Hurst was they require
sidewalks. He said they plan to
upsize the sanitary sewer. He said
the majority of the engineering has
been done.
Mr. Wood asked if there would be no
curb cuts.
Mr. Smith said,they would use the
existing curb cuts.
Mr. Wood asked Mr. Smith if the
interchange goes through, would he be
willing to give additional
right-of-way if needed.
Mr. Smith said he would work with
them.

This proposed Zoning Ordinance revision concerns the uses included in the C-1 Commercial
District. The Staff had noted to the Commission that there is an existing Bowling Alley
in the City which is located in the C-1 Commercial Zone. However, that use had existed
prior to the adoption of the present ordinance. That existing use qualifies as a "Legal
Non-conforming Use". Recently the Staff had been requested to provide the information
to a developer as to where a new bowling alley could be located in the City of North
Richland Hills. In that research it was discovered that the current Ordinance has no
provision for allowing the Bowling Alley use. Therefore it became necessary to
prescribe within the Ordinance the allowable districts where the use could be placed.
In preparing the draft ordinance the Staff made the assumption that the Commission had
correctly located the existing use in the C-1 District and that the pattern could be
continued in any proposed uses of the same type.
RECOMMENDATION:
The Planning and Zoning Commission recommended that the Zoning Ordinance Revision
allowing the Bowling Alley use in the C-1 District be approved.

This Final Plat Application is presented for consideration of Fair Oaks Addition, 2nd
Filing. The property is located on the northwest corner of Bursey Road and Smithfield
Road. The purpose for the proposed plat is to subdivide the property into individual
residential lots in conformance with the R-2 Single Family criteria.
In the Preliminary Plat review the Staff noted that the realignment of Bursey Road was
in conformance with the adopted Thoroughfare Plan. The applicant has shown the right of
way for Bursey Road to be 80 feet which is in excess of the required 68 feet to support
a four lane Collector Street. The applicant has chosen to continue the 80 foot
dedication rather than re-calculate his entire subdivision.
The Staff had also noted that the "open bubble" configuration of the proposed Bursey
Court was not compatible with its location on a thoroughfare street. In the engineering
submittal with the Final Plat the street construction plans show a more conventional
design cul-de-sac which can be constructed within the plat configuration.

We have a copy of Mr. Richard Albin's letter datedOctober 16, 1985
pertaining to the captioed project and have the following comments:
1. The plat will be revised to note the property corner monumentation
to agree with the metes and bounds description and the legend as
shown on the plat.
2. The utility easement between Lots 2 ånd 3, Block 11 will be
changed to drainageand utility easement.
3. Item 10 of letter dated June 17, 1985 (PS 85-39) is a statement
of City's pro-rata policy.
Item 12 of the June 17th letter (PS 85-39) was a request to upsize
the 6-inch sewer line in Kristina Lane to an 8-inch sewer line to
serve future potential commercial or multi-family development. The
Owner has requested this property be zoned R-l single family; therefore,
the proposed 6-inch sewer line in Kristina Lane will serve less than
60 lots and this is far less than the capacity of the line. Therefore,
we request that the 6-inch sewer line be allowed rather than the
requested 8-inch sewer line. '

4. The Developer-Owner has been made aware of his responsibility to comply
with all ordinances and requirements of the City.

We have reviewed the referenced materials for this subdivision and offer the
following comments:
1 The Thoroughfare Master Plan shows that Keller-Smithfield Road is
designated as a C4U Section which means the future right-of-way should be
68-feet and the future pavement 49-foot BIB. The plan does show, however,
that the proposed alignment of Keller-Smithfield Road will be shifted to
the east of the existing intersection of Bursey Road and Smithfield Road.
If you are committed to this future realignment of Keller-Smithfield Road
then additional street right-of-way dedication by this developer would not
be required for the section of Smithfield Road which fronts on this
proposed development.
2 Permission should be obtained from R.G.A. Development Corp. for
concentrated discharge of proposed 42-inch and 3D-inch storm drains.
Off-site easements may also be required for off-site channelization
required to dicharge concentrated storm water to the nearest recognized
watercourse. -
3 Sheet flow from off-site drainage area 16 could cause flooding on lots 1
through 9 of block 9 along the east side of this proposed development. We
would recommend that a concrete flume be constructed within a dedicated
drainage easement along this 720-foot property line designed to carry the
100-year flow to the proposed 3D-inch storm drain at the northeast corner
of lot 9, block 9. Also, overland relief for the 100-year flood should be
provided over all storm drains, and cross-sections and calculations -
provided to verify such capacity.
4 Sheet flow from the off-site area adjacent and east of lots 11 through 20
could also cause flooding on these lots since the natural low runs through
these lots. We would also recommend construction of a concrete flume
within a dedicated easement along the full 80S-foot length from lot 11 to
lot 20 terminating at the proposed 27-inch storm drain pipe in Continental
Trail. Such flume should be designed to a 100-year capacity.

The Owner's Acknowledgement and Dedication Statement and the Notary
Certification should be fully executed before approval of the final plat.
A surveyor's seal, certification, and signature should be affixed to the
final plat.
Lots 6 and 7 of Oakvale Addition should be replatted to show frontage on
the new alignment of Bursey Road.
Jason Court in Eden Meadow Estates (PS 85-41) may be too similar to Jasen
Lane in this addition, therefore we would recommend the street name be
changed.
9 The old part of Bursey Road to the south of the new alignment should have
a new street name.
10 The owner should be required to pay his prorata share of an existing
16-inch water line in Bursey Road and Smithfield Road. We would estimate
prorata at $5.50 per linear foot for one half of an equivalent 8-inch line
for a total length of 1,502.7 feet.
11 Water and sanitary sewer services to each lot should be shown on the
final plans.
12 The 6-inch sanitary sewer line in Jasen Lane and Bursey Road should be
upsized to an 8-inch line as required to serve future potential commercial
or multi-family developments adjacent to this proposed platting.
13 This review is based on preliminary planning only since final water,
sewer, 'paving and drainage plans have not been submitted to our office for
review yet. Comments in this review have been limited to preliminary
platting, water,< sewer, and drajnage~
14 As a general reminder; the Developer or Owner should be made aware that

For many years the City of North Richland Hills has enjoyed an excellent and financially
beneficial relationship with First Southwest Company as its financial advisor under the
~ terms of a contract which has now expired. It is proposed that this contract be renewed
for an additional five year period with a provision to cancel, at the City's option, at
any time upon 30 days written notice. The recommended fee remains essentially the same.

It is recommended that the City Council approve Resolution No. 85-29 authorizing the
City Manager to enter into a contract with First Southwest Company for a five year
period in accordance with the terms and conditions of the attached agreement.

b. On the basis of the information developed by the survey described in the
above and foregoing paragraph, and on the basis o~ other inform.ation. and. experie~ce

Our plan will include recommendations as to the date of issue, interest payment
dates, schedule of principal maturities, options of prior payment, and any other
necessary additional security provisions designed to make the issu~ attr~ctive to
investors. All recommendations will be based on our best professIonal Judgment
with the goal of designing bonds which can be sold under terms most advantageous
to City; and at the lowest interest cost consistent with all other considerations.
c. We will advise you of current bond market conditions, forthcoming bond
issues, and other general information and economic data which might normally be
expected to influence the interest rates or bidding conditions, so that the date for
the sale of the bonds can be set at a time, which, in our opinion, will be favorable.
d. We understand you have retained, or will retain, the firm of Dumas,
Huguenin, Boothman and Morrow, Dallas, Texas, municipal bond attorneys ("Bond
Counsel"), whose fee will be paid by. you. . We will assist in coordinating the assembly
and transmittal to Bond CQunsel of such data as may be required for the preparation
of the necessary petitions, orders, resolutions, notices and certificates in connection
with the election.
e. We will coordinate the preparation and submission of the Notice of Sale,
the Official Statement, and such other market documents which you may require.
We will also supervise preparation of the uniform bid form consistent with the bonds
offered for sale. We will submit to you all such offering documents, including the
Official Statement, for your proper examination, approval and certification. After
such examination, approval and certification, we will furnish you with a supply of
such documents and shall mail a set of the same to a list of prospective bidders, and
to banks, life, fire and casualty insurance companies, investment counselors and
other prospective purchasers of the bonds. We will also supply sifficient copies of
the Official Statement to the purchaser of the bonds in accordance with the terms
of the Notice of Sale. The cost of preparing, printing and distributing these
documents will be paid by you. We will arrange for such reports and opinions of
recognized independent consultants which we and you deem necessary and required
in the successful marketing of the bonds. The fees and charges for such services
will be paid by you.

f. We will advise financial publications of the forthcoming sale of your
bonds and furnish them with the pertinent information.
g. We will make recommendations to you on the matter of a credit rating
or ratings for the proposed issue and when directed by you shall coordinate the
preparation of $uch information as in our opinion is required for submission to the
rating agency or agencies. Any expense incurred in obtaining a rating or ratings will
be paid by you. In those cases where the advisability of personal presentation of
information to the rating agency or agencies may be indicated, we will arrange for
the personal presentation. The travel expense of our representatives for such
presentation will be paid by us. .
h. We will assist you at the sale for the purpose of coordinating the receipt
of bids, and the furnishing of good faith checks where indicated, and for the purpose
of tabulation and comparison of bids, and will advise you as to the best bid, and will
provide our recommendation as to acceptance or rejection of such bid.
i. As soon as a bid for the bonds shall be accepted by you, Wf; will proceed
to coordinate the efforts of all concerned to the end that the bonds may be
delivered and paid for as expeditiously as possible. We shall assist you in the
preparation or verification of final closing figures, and when requested, will provide
suggestions on a program of temporary investment of proceeds, in consultation with
Issuer's architect or consulting engineer, consistent with the construction timetable
for the project.

j. We will act as your agent in arranging for the printing of the bonds, the
cost of which will be paid by you. We will attend to their delivery to the Attorney
General for approval and the Comptroller of Public Accounts for registration, it
being understood that title to and ownership of the printed bonds shall be in the City
until they are delivered to the purchaser.
k. We will maintain liaison with Bond Counsel in the preparation of all
legal documents pertaining to the authorization, sale, issuance and delivery of the
bonds. Bond Counsel will furnish an unqualified approving legal opinion on the bonds
at the time of delivery.
1. After closing we will deliver to you a schedule of annual debt service
requirements on the obligations being delivered to the purchaser. We will furnish to
the paying agent or paying agents a copy of the authorizing ordinance.
m. We will attend any and all meetings of your governing body, or any
representatives thereof, as desired by you, whenever we may be of assistance and
the subject of financing is to be discussed.
4. In consideration of the services rendered and expenses to be incurred by us, it is
understood and agreed that our fee for each issue of bonds will be as follows:
Base Fee - Any Issue $ 3,000.00
Plus $9.00 per $1,000 up to $ 250,000 of a total of $ 5,250.00 for $ 250,000 Bonds
Plus 8.25 per $1,000 next 250,000 or a total of 7,312.50 for 500,000 Bonds
Plus 3.85 per $1,000 next 500,000 or a total of 9,237.50 for 1,000,000 Bonds
Plus 2.50 per $1,000 next 1,500,_000 or a total of 12,987.50 for 2,500,000 Bonds
Plus 1. 95 per $1,000 next - 2,500,000 or a total of 17,862.50 for 5,000,000 Bonds
Plus 1.35 per $1,000 next 5,000,000 or a total of 24,612.50 for 10,000,000 Bonds
Plus 0.85 per $1,000 next 10,000,000 or a total of 33,112.50 for 20,000,000 Bonds
Plus 0.40 per $1,000 next 10,000,000 or a total of 37,112.50 for 30,000,000 Bonds

The above schedule does not apply to any advance re funding of any of the City's
outstanding debt. In the event of an advance refunding, whether or not in
conjunction with issuance of new debt, our fee shall be $20,000.00 plus $0.50 per
bond issued.

5. In the event any bond election be necessary, if such election shall fail,
I. the fee due us shall be nothing; however, should the same or similar propositions
again be submitted to election held within twelve months from the date hereof, then
at our option the agreement covered by this proposal shall apply to any such bonds.
6. It is further ,.understood and agreed that we reserve the right to submit a bid for
the bonds when offered for sale.
7. This agreement shall remain in effect for a period of five years from the date
hereof provided however, it may be terminated by you upon thirty (30) days' written
notice to us. In the event of termination, it is understood and agreed that only the
amount due us for services or expenses to date of termination would be due and
payable, and that no penalty for cancellation of the contract would be allowed. It is
the intent of this provision that our services be satisfactory to you at all times.
This proposal is submitted in duplicate originals. When accepted by you, it will
constitute the entire agreement between City and the undersigned for the purposes
and considerations herein specified. Your acceptance will be indicated by the
signature of your authorized officials or representatives on both copies, and the
returning of one executed copy to us.

ORDINANCE NO. 1308
WHEREAS. the Supreme Court of Texas has ruled that in order for
the City or its officers or employees to claim the "Emergency" exception as
provided by Article 6252-19. Section 14(8) that it must have an ordinance
applicable to emergency situations and actions; and
WHEREAS, the City Council finds that it is in the best interests of
the city and its inhabitants that this ordinance be passed in order to protect
the health and general welfare of the city and its inhabitants.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
City of North Richland Hills, Texas, that:
1.
Every officer, employee or agent of the City of North Richland
Hills, Texas, while responding to or engaging in emergency situations is
hereby authorized to act in such manner as to most effectively deal with the
emergency in order to prevent injury or damage to persons or property or to
prevent violations of the law or to apprehend persons that the officer or
employee has reasonable cause to believe has violated the criminal laws of the
city. state or federal government.

The exception for emergency actions as provided by Article
6252-19, Section 14Vis hereby claimed for all purposes in emergency

This prOVIsIon shall prevail over any other ordinance or any other
law establishing a standard of care that may conflict with this ordinance.
Neither the city nor its agent, officer, or employee shall be liable for failure
to use ordinary care in an emergency situation.
4.
The terms of this ordinance are severable and if any phrase,
clause. sentence, paragraph or section should be declared invalid, such
invalidity shall not affect any of the remaining portions of the ordinance.

In the September Bond Election $14 million were approved for street construction for
major and minor streets within the City. After due consideration the construction of
Watauga Road asa six lane divided Principal Arterial Street from Rufe Snow Drive to
Davis Boulevard was determined to have the highest priority of all the street projects.
Accordingly our Engineers, Knowlton, English and Flowers were authorized to proceed with
the plans for this construction as quickly as possible.

In the development of the exact plans for street construction the first effort is
directed toward the needs for additional right of way. In the case of Watauga Road the
needed right of way to accommodate the proposed street is a total of 110 feet in width.
In order to identify the specific properties which will be affected by the right of way
acquisition an alignment map has been prepared by the Engineers. It is this alignment
which the Staff is requesting that the City Council review and approve. If the
alignment is satisfactory the Engineer and the Staff may proceed with right of way
negotiations with the adjacent property owners.

RECOMMENDATION:
It is recommended that the City Council approve the proposed alignment of Watauga Road
from Rufe Snow Drive to Davis Boulevard and authorize the Staff to proceed with the
necessary steps to acquire the additional right of way needed to accomplish the street
construction.

WATAUGA ROAD PAVING AND DRAINAGE IMPVTS.,
RIGHT-Of-WAY ALIGNMENT APPROVAL
Enclosed is a copy of the proposed right-of-way alignment of Watauga Road from
Rufe Snow Drive to Precinct Line Road which is shown on the City Zoning Map.
Construction plans are being prepared for the section from Rufe Snow to Davis
Blvd. The detailed design is based on the proposed alignment as shown and
recommended for approval by the City Staff.
The section from Davis Blvd. to Precinct Line Road is tentative and approval of
this alignment is not required at this time. Alternatives for the section from
Davis to Precinct Line are shown primarily for your approval of the general
concept and for future planning as development occurs east of Davis Blvd. We
anticipate construction of the section from Davis to Precinct to be performed by
private developers, and you will have an opportunity to approve the final
alignment in this section when future platting occurs.
Upon your consideration and approval of the recommended right-of-way alignment of
Watauga Road from Rufe Snow to Davis Blvd. we will continue with preparation of
right-of-way documents to obtain the full 110-foot wide right-of-way required, and
the City Staff will proceed with negotiations with private property owners for
right-of-way acquisition. _
We would note that any future changes in the approved alignment of Watauga Road
will required additional field surveys, revised detailed construction planning,
additional costs, and possibly delays in the scheduled completion date.
We will be present at the next Council Meeting to answer any questions you may
have concerning this project.

contract sweeping is almost 50% more than last year.

$38,250 per year. The amount of money that would be needed per year for
gas, oil and maintenance is not expected to exceed $lO,OOO per year,
for a total annual cost of $48,250.

GENERAL CONDITIONS
PROPOSAL REQUIREMENTS AND CONDITIONS
In submitting his bid, the proposer understands and agrees to be bound by the
following terms and conditions:
I. WITHDRAWING PROPOSALS
Proposals deposited with the City of North Richland Hills cannot
be withdrawn prior to the time set for opening proposals. Request for
nonconsideration of proposals must be made in writing to the Purchasing Agent
and received by the City of North Richland Hills prior to the time set for
opening proposals. After other proposals are opened and publicly read,
the proposal for which nonconsideration is properly requested may be returned
unopened. The proposal may not be withdrawn after the bids have been opened,
and the bidder, in submitting the same, warrants and guarantees that his
bid has been carefully reviewed and checked and that it is in all things
true and accurate and free of mistakes and that such bid will not and cannot
be withdrawn because of any mistake committed by the bidder.
2. CONSIDERATION OF PROPOSALS
After proposals are opened and publicly read aloud, the proposals
will be tabulated for comparison on the basis of the bid prices and quantities
shown in the proposal. Until final award of the contract, the City of North
Richland Hills reserves the right to reject any or all proposals, to waive
technicalities, and to readvertise for new proposals, or proceed to do the
--'- work otherwise in the best interests of the City of North Richland Hills.
3. IRREGULAR PROPOSALS
Proposals will be considered irregular if they show any omissions,
alterations of form, additions, or conditions not called for, unauthorized
alternate bids, or irregularities of any kind. However, the City of North
Richland Hills reserves the right to waive any irregularities and to make
the award in the best-interests of the City of North Richland Hills.
4. REJECTION OF PROPOSALS
The City of North Richland Hills reserves the right to reject any
or all proposals, and all proposals submitted are subject to this reservation.
Proposals may be rejected, among other reasons, for any of the following
specific reasons:
(a) Proposal received after the time limit for receiving proposals as
stated in the advertisement.
(b) Proposal containing any irregularities.
(c) Unbalanced value of any items.
(d) Where the bidder, any sub-contractor or supplier, is in litigation
with the City of North Richland Hills, or where such litigation is
contemplated or imminent, in the sole opinion of said City.

5. DISQUALIFICATION OF 'BIDDERS
Bidders may be disqualified and their proposals not considered,
among other reasons, for any of the following specific reasons:
(a) Reason for believing collusion exists among the bidders.
(b) Reasonable grounds for believing that any bidder is interested in
more than one proposal for the work contemplated.
(c) .Where the bidder, any sub-contractor or supplier, is in- litigation
with the City of North Richland Hills, or where such litigation is
contemplated or imminent, in the sole opinion of said City.
(d) The bidder being in arrears on any existing contract or having
defaulted on a previous contract.
(e) Lack of competency as revealed by a financial statement, experience
and equipment, questionnaires, etc.
(f) Uncompleted work which in the judgment of the City of North Richland
Hills will prevent or hinder the prompt completion of additional work
if awarded.
6. AWARD OF CONTRACT
Award of contract, if it be awarded, will be made by the City of
North Richland Hills to the lowest responsible bidder meeting the
requirements of the City of North Richland Hills, and will be made within
sixty (60) days after the opening of the proposal, but not before said
City's next monthly meeting. No award will be made until after investigations
are made as to the responsibilities of the low bidders.
7. ASSIGNMENT
~ The successful bidder may not assign his rights and duties under
an award without the written consent of the City of North Richland Hills
City Manager. Such consent shall not relieve the assignor of liability
in the event of default by his assignee.
8. NOTICE OF DELAYS
Whenever the vendor encounters any difficulty which is delaying
or threatens to delay "timely performance (including actual or potential
labor disputes), the vendor shall immediately give notice thereof in
writing to the Purchasing Agent, stating all relevant information with
respect thereto. Such notice shall not in any way constitute a basis for
an extension of the delivery or performance schedule or be construed as a
waiver by the City of North Richland Hills of any rights or remedies to which
it is entitled by law or pursuant to provisions herein. Failure to give
such notice, however, may be grounds for denial of any request for an
extension of the delivery or performance schedule because of such delay.
9. BRAND NAME OR EQUAL
(This clause is applicable only when a "brand name or equal" purchase
description is included in an invitation for bids. As used in this clause,
the term "brand name" includes identification of products by make and model.)

(a) If items for which bids have been called for have been identified by
a "brand name or equal" description, such identification is intended
to be descriptive, but not restrictive, and is to indicate the quality
and characteristics of products that will be satisfactory. Bids offering
"equal" products will be considered for award if such products are
clearly identified in the bids and are determined by the Purchasing Agent
to be equal in all material respects to the brand name products
referenced.
(b) Unless the bidder clearly indicates in his bid that he is offering an
"equal" product, his bid shall be considered as offering a brand name
product referenced in the Invitation for Bids.
GENERAL CONDITIONS
VEHICLE BID
1.
Vehicles other than new models will not be considered as responsive
to the specifications. It is the intention of the City of North Richland
Hills to purchase based on the specifications, a standard production
model. In addition to the equipment set out in the specifications, the
units shall include all equipment set out in the manufacturer's literature
as standard equipment. They shall include all exterior moldings, name
plates, medallions, series indentifications, and chrome of every
description that is usual for standard stock models of this series.
2.
The specifications are intended to govern, in general, the size and type
of vehicles desired and are minimum requirements. Variations from these
specifications must be outlined on a separate document noting the item
number and fully explaining the exceptions. The City of North Richland
Hills reserves !È! right !£ evaluate variations from ~ specifications
and its judgment ~i ,matters shall be conclusive.

The units shall be completely assembled, lubricated, adjusted, with all
equipment including standard and extra equipment installed, and the units
made ready for continuous operation with a full tank of fuel.

4. The bidder shall attach hereto, as part of this bid, regularly printed
literature published by the factory, which sets forth and describes the

5. The successful bidder shall furnish a manufacturer's Certificate of origin
and Parts Manual with delivery of each unit.
6. For bids on more than one unit of equipment, the City of North
Richland Hills reserves the right to make multiple purchases from more
than one bidder if it deems sùch action to be in its best interest.
7. All equipment covered by this bid shall be delivered from point of
assembly to the City of North Richland Hills area by railway freight or
conveyed by truck. Equipment shall not be driven or towed in whole or
part. Each invoice request for-pãÿment shall be accompanied by an
affidavit in which shall be set out that the equipment covered by this
invoice has not been driven or towed in whole or part from point of
manufacturer to the City of North Richland Hills area. Vehicles may be
driven from dealer's service center to the City of North Richland Hills
provided the distance from the service center to the City does not exceed
one hundred (100) milés.
8. Warranty for parts and labor must be described and included in this bid.
This specification is intended to describe the minimum requirements for a 1986
two door sedan sports Coupe suitable for police freeway patrol, and municipal
highway patrol, operating with occasional speeds in excess of 100 miles per hour
for both long and short durations with occasional high speed pursuit in heavy
traffic.

Having bid all size "wheelbase" vehicles, we find the larger 112" vehicle is not only
low bidder but we also have the benefit of the heavier duty car.
Six of the vehicles will be used by Police Administration, CID Investigation, Training
and the Division Commanders (all are replacements). Two will be used by Utility-Water
Repair Superintendent and Assistant Director of Utilities (Replacement).

GENERAL CONDITIONS
PROPOSAL REQUIRE}ŒNTS AND CONDITIONS
In submitting his bid, the proposer understands and agrees to be bound by the
following terms and conditions:
I. WITHDRAtvING PROPOSALS
Proposals deposited with the City of North Richland Hills cannot
be withdrawn prior to the time set for opening proposals. Request for
nonconsideration of proposals must be made in writing to the Purchasing Agent
and received by the City of North Richland Hills prior to the time set for
opening proposals. After other proposals are opened and publicly read,
the proposal for which nonconsideration is properly requested may be returned
unopened. The proposal may not be withdrawn after the bids have been opened,
and the bidder, in submitting the same, warrants and guarantees that his
bid has been carefully reviewed and checked and that it is in all things
true and accurate and free of mistakes and that such bid will not and cannot
be withdrawn because of any mistake committed by the bidder.
2. CONSIDERATION OF PROPOSALS
After proposals are opened and publicly read aloud, the proposals
will be tabulated for comparison on the basis of the b~d prices and quantities
shown in the proposal. Until final award of the contract, the City of North
Richland Hills reserves the right to reject any or all proposals, to waive
-'- technicalities, and to readvertise for new proposals, or proceed to do the
work otherwise in the best interests of the City of North Richland Hills.
3. IRREGULAR PROPOSALS
,
Proposals will be considered irregular if they show any omissions,
alterations of form, additions, or conditions not called for, unauthorized
alternate bids, or irregularities of any kind. However, the City of North
Richland Hills reserves the right to waive any irregularities and to make
the award in the best interests of the City of North Richland Hills.
4. REJECTION OF PROPOSALS
The City of North Richland Hills reserves the right to reject any
or all proposals, and all proposals submitted are subject to this reservation.
Proposals may be rejected, among other reasons, for any of the following
specific reasons:
(a) Proposal received after the time limit for receiving proposals as
stated in the advertisement.
(b) Proposal containing any irregularities.
(c) Unbalanced value of any items.
(d) Where the bidder, any sub-contractor or supplier, is in litigation
with the City of North Richland Hills, or where such litigation is
contemplated or imminent, in the sole opinion of said City.
5. DISQUALIFICATION OF BIDDERS

Bidders may be disqualified and their proposals not considered,
among other reasons, for any of the following specific reasons:
(a) Reason for believing collusion exists among the bidders.
(b) Reasonable grounds for believing that any bidder is interested in
more than one proposal for the work contemplated.
(c) -Where the bidder, any sub-contractor or supplier, is in litigation
with the City of North Richland Hills, or where such litigation is
contemplated or imminent, in the sole opinion of said City.
(d) The bidder being in arrears on any existing contract or having
defaulted on .a previous contract.
(e) Lack of competency as revealed by a financial statement, experience
and equipment, questionnaires, etc.
(f) Uncompleted work which in the judgment of the City of North Richland
Hills will prevent or hinder the prompt completion of additional work
if awarded.
6. AWARD OF CONTRACT
Award of contract, if it be awarded, will be made by the City of
North Richland Hills to the lowest responsible bidder meeting the
requirements of the City of North Richland Hills, and will be made within
sixty (60) days after the opening of the proposal, but not before said
City's next monthly meeting. No award will be made until after investigations
are made as to the responsibilities of the low bidders..
7. ASSIGNHENT

The successful bidder may not assign his rights and duties under
an award without the written consent of the City of North Richland Hills
City Manager! Such consent shall not relieve the assignor of liability
in the event of default by his assignee. ,
8. NOTICE OF DELAYS

Whenever the vendor encounters any difficulty which is delaying
or threatens to delay timely performance (including actual or potential
labor disputes), the vendor shall immediately give notice thereof in
writing to the Purchasing Agent, stating all relevant information with
respect thereto. Such notice shall not in any way constitute a basis for
an extension of the delivery or performance schedule or be construed as a
waiver by the City of North Richland Hills of any rights or remedies to \.hich
it is entitled by law or pursuant to provisions herein. Failure to give
such notice, however, may be grounds for denial of any request for an
extension of the delivery or performance schedule because of such delay.
9. BRAND NAHE OR EQUAL
(This clause is applicable only \.hen a "brand name or equal" purchase
description is included in an invitation for bids. As used in this clause,
the term "brand name" includes identification of products by make and model.)
(a) If items for which bids have been called for have been identified by
a "brand name or equal" description, such identification is intended
to be descriptive, but not restrictive, and is to indicate the quality
and characteristics of products that will be satisfactory. Bids offering
"equal" products will be considered for award if such products are
clearly identified in the bids and are determined by the Purchasing Agent
to be equal in all material respects to the brand name products
referenced.
(b) Unless the bidder clearly indicates in his bid that he is offering an
"equal" product, his bid shall be considered as offering a brand name
product referenced in the Invitation for Bids.

VEHICLE BID
1.
Vehicles other than new models will not be considered as responsive
to the specifications. It is the intention of the City of North Richland
Hills to purchase based on the specifications. a standard production
model. In addition to the equipment set out in the specifications. the
units shall include all equipment set out in the manufacturer's literature
as standard equipment. They shall include all exterior moldings, name
plates, medallions, series indentifications, and chrome of every
description that is usual for standard stock models of this series.
2.
The specifications are intended to govern, in general, the size and type
of vehicles desired and are minimum requirements. Variations from these
specifications must be outlined on a separate document noting the item
number and fully explaining the exceptions. ~ City of North Rich1and
Hills reserves the right !£ evaluate variations from the specifications
and its judgment i~~ matters shall be conclusive.

The units shall be completely assembled. lubricated, adjusted, with all
equipment including standard and extra equipment installed, and the units
made ready for continuous operation with a full tank of fuel.
4. The bidder shall attach hereto, as part of this bid, regularly printed
literature published by the factory, which sets forth and describes the
'- vehicles he proposes to furnish.

5. The successful bidder shall furnish a manufacturer's Certificate of origin
and Parts Manual with delivery of each unit.

6. For bids on more than one unit of equipment, the City of North
Richland Hills reserves the right to make-multiple purchases from more
than one bidder if it deemi such action to be in its best interest.
7. All equipment covered by this bid shall be delivered from point of
assembly to the City of North Richland Hills area by railway freight or
conveyed by truck. Equipment shall not be driven or towed in whole or
part. Each invoice request for payment shall be accompanied by an
affidavit in which shall be set out that the equipment covered by this
invoice has not been driven or towed in whole or part from point of
manufacturer to the City of North Richland Hills area. Vehicles may be
driven from dealer's service center to the City of North Richland Hills
provided the distance from the service center to the City does not exceed
one hundred (100) milés.

PROPOSAL REQUIREMENTS AND CONDITIONS
In submitting his bid, the proposer understands and agrees to be bound by the
following terms and conditions:
I. WITHDRAtHNG PROPOSALS
Proposals deposited with the City of North Richland Hills cannot
be withdrawn prior to the time set for opening proposals. Request for
nonconsideration of proposals must be made in writing to the Purchasing Agent
and received by the City of North Richland Hills prior to the time set for
opening proposals. After other proposals are opened and publicly read,
the proposal for which nonconsideration is properly requested may be returned
unopened. The proposal may not be withdrawn after the bids have been opened,
and the bidder, in submitting the same, warrants and guarantees that his
bid has been carefully reviewed and checked and that it is in all things
true and accurate and free of mistakes and that such bid will not and cannot
be withdrawn because of any mistake committed by the bidder.
2. CONSIDERATION OF PROPOSALS
After proposals are opened and publicly read aloud, the proposals
will be tabulated for comparison on the basis of the bid prices and quantities
shown in the proposal. Until final award of the contract, the City of North
Richland Hills reserves the right to reject any or all proposals, to waive
technicalities, and to readvertise for new proposals, or proceed to do the
'--- work otherwise in the best interests of the City of North Richland Hills.
3. IRREGULAR PROPOSALS
Proposals will be considered irregular if they show any omissions,
alterations of form, additions, or condit~~ns not called for, unauthorized
. alternate bids, or irregularities of any ::ind. However, the City of North
Richland Hills reserves the:right to waive any irregularities and to make
the award in the best interests of the City of North Richland Hills.
4. REJECTION OF PROPOSALS
The City of North Richland Hills reserves the right to reject any
or all proposals, and all proposals submitted are subject to this reservation.
Proposals may be rejected, among other reasons, for any of the following
specific reasons:
(a) Proposal received after the time limit for receiving proposals as
stated in the advertisement.
(b) Proposal containing any irregularities.
(c) Unbalanced value of any items.
(d) t~ere the bidder, any sub-contractor or supplier, is in litigation
with the City of North Richland Hills, or where such litigation is
contemplated or imminent, in the sole opinion of said City.

5. DISQUALIFICATION OF BIDDERS

Bidders may be disqualified and their proposals not considered,
among other reasons, for any of the following specific reasons:
(a) Reason for believing collusion exists among the bidders.
(b) Reasonable grounds for believing that any bidder is interested in
more than one proposal for the work contemplated.
(c) Where the bidder, any sub-contractor or supplier, is in litigation
with the City of North Richland Hills, or where such litigation is
contemplated or imminent, in the sole opinion of said City.
(d) The bidder being in arrears on any existing contract or having
defaulted on a previous contract.
(e) Lack of competency as revealed by a financial statement, experience
and equipment, questionnaires, etc.
(f) Uncompleted work which in the judgment of the City of North Richland
Hills will prevent or hinder the prompt completion of additional work
if awarded.
6. AWARD OF CONTRACT
Award of contract, if it be awarded, will be made by the City of
North Richland Hills to the lowest responsible bidder meeting the
requirements of the City of North Richland Hills, and will be made within
sixty (60) days after the opening of the proposal, but not before said
City's next monthly meeting. No award will be made until after investigations
are made as to the responsibilities of the low bidders.
7.
ASSIGNMENT

The successful bidder may not assign his rights and duties under
an award without the written consent of the City of North Richland Hills
City Mariager. Such consent shall not relieve the assignor of liability
in the event of default by his assignee.
8.
NOTICE OF DELAYS
Whenever the venddr encounters any difficulty which is delaying
or threatens to delay timely performance (including actual or potential
labor disputes), the vendor shall immediately give notice thereof in
writing to the Purchasing Agent, stating all relevant information with
respect thereto. Such notice shall not in any way constitute a basis for
an extension of the delivéry or performance schedule or be construed as a
waiver by the City of North Richland Hills of any rights or remedies to which
it is entitled by law or pursuant to provisions herein. Failure to give
such notice, however, may be grounds for denial of any request for an
extension of the delivery or performance schedule because of such delay.
9. BRAND NAME OR EQUAL
(This clause is applicable only when a "brand name or equal" purchase
description is included in an invitation for bids. As used in this clause,
the term "brand name" includes identification of products by make and model.)

Instructions
The City of North Richland Hills will accept bids only for hardware. The
City will not consider changing application software systems. All hardware
bid must be completely adaptable to our present hardware and system
software configuration without recompiling or modification to those systems.
All prices/cost included in this proposal must be guaranteed not to be
increased for at least 60 days from the proposal opening dates for
contracting purposes.
All hardware bid must be delivered and operational within 90 days from the
point of awarding the contract.
The City of North Richland Hills reserves the right to request any
additional information deemed necessary for clarifying the proposal as
submitted.
The City of North Richland Hills reserves the right to accept and/or reject
any and all, or part of any proposals that it deems not to be in the best
interest of the City of North Richland Hills.
Hardware Requirements
The total hardware proposal must be delivered and operational within 90
calendar days after approval by the City Council of North Richland Hills.

Overview of Required System
1. The City is requesting bids on the Central Processing Unit (CPU) only.
2. The proposed CPU must have -the following capabilities:
A. Ability to communicate with terminals in a local environment up to
5000 feet away from CPU
B. Multi-programming, Multi-user environment
C. Print spooling
D. Input job queue
E. Inquiry ability into system while jobs are running
F. Security capabilities for hardware, system files, libraries and
application software programs
G. Directly compatible with the application software and hardware
devices currently in use by the City's existing IBM System/36
Minimum Hardware Requirements
1. The Central Processor Unit (CPU)
A. Main memory proposed must be a minimum of 1.0 Mb
B. Disk storage proposed must be a minimum of 600 Mb and must be
up-gradable at least once.
C. CPU must have a removable backup system such as diskette system.
D. CPU must support at least one tape drive system locally.
E. CPU must support at least 27 local workstations and must have a
multi-line communication attached.
F. CPU must support a high speed printer of at least 600 LPM and
must not reduce the capability of supporting at least 27 local
workstations.

This drainage project was approved by the Council several meetings ago. This
is a joint project between the City and the developer of Smithfield Acres.
The reason being is the developer was developing land next to an area where
the City needed storm drainage facilities. The City Engineer recommended
that we participate to oversize the developer's storm drainage to accommodate
what we needed.
The low bidder on the project was Huffman Construction Company in an amount
of $74,847.80. The city's participation in this would be $54,769.10 and
the developer's participation is $20,078.70.

the amount of $74,847.80.
