HomeMy WebLinkAboutOrdinance 1937 ORDINANCE NO. 1937 AN ORDINANCE REZONING PROPERTY IN ACCORDANCE WITH ARTICLE 2, SECTION 200, OF ZONING ORDINANCE NUMBER 1874, PASSED, APPROVED AND ADOPTED BY THE CITY COUNCIL ON MARCH 22, 1993; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, after appropriate notice and public hearing, the following recommendation is submitted to the City Council of the City of North Richland Hills, Texas, by the Planning and Zoning Commission; and WHEREAS, the Planning and Zoning Commission of the City of North Richland Hills, Texas, has forwarded a recommendation to the City Council for amendment of Ordinance No. 1874 and the Official Zoning Map by rezoning certain property; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: 1. THAT, on Case Number PZ 93-17, the following properties shall be rezoned from C-1 Commercial to R-8 Zero Lot Line Single Family Residential: BEING a tract of land situated in the William Cox Survey, Abstract No. 321, Tarrant County, Texas, and being a portion of a tract as recorded on Page 968 of Volume 6160 in the Tarrant County Deed Records, and being more particularly described as follows: BEGINNING in the South line of Starnes Road and being 89 degrees 44 minutes 35 seconds East a distance of 500.05 feet from the Northeast corner of Lot 1, Block 4, Century Oaks Addition, and addition to the City of North Richland Hills, Tarrant County, Texas, according to the Plat recorded on Page 50 of Volume 388-176 in the Tarrant County Plat Records and also being by deed West a distance of 950.4 varas, South 89 degrees 44 minutes 35 seconds West a distance of 568.59 feet, and South 00 degrees 16 minutes East a distance of 30.0 feet from the Northeast corner of said William Cox Survey; THENCE North 89 degrees 44 minutes 35 seconds East along the south line of said Starnes Road a distance of 59.95 feet; THENCE South 00 degrees 16 minutes East a distance fa 538.55 feet; THENCE South 89 degrees 44 minutes 35 seconds West a distance of 59.95 feet; THENCE North 00 degrees 16 minutes West a distance of 538.55 feet to the PLACE OF BEGINNING and containing 0.741 acres or 32,286 square feet of land more or less. This property is generally located at the southwest corner of Smithfield Road and Starnes Road. 2. THAT, the Official Zoning Map be redrawn to incorporate this zoning district boundary amendment and the herein described ordinance number be affixed to the property described herein. 3. SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the section, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. 4. SAVINGS CLAUSE. That Ordinance Number 1874, the Comprehensive Zoning Ordinance of the City of North Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. 5. EFFECTIVE DATE. This ordinance shall be in full force from and after its passage.
