HomeMy WebLinkAboutOrdinance 2642 11 13 15 17 19 21 23 25 27 29 31 33 35 37 39 41 43 45 1 ORDINANCE NO. 2642 3 ZONING CASE PZ 2000-20 Rl 5 AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, BY AMENDING THE PLANNED DEVELOPMENT SITE PLAN ON CERTAIN PROPERTY IN THE CITY; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING FOR SEVERABILITY; PROVIDING FOR SAVINGS; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. 7 9 WHEREAS, the City Council has received the recommendations ofthe Planning and Zoning Commission concerning the matters herein dealt with, which recommendations were made after the holding of a public hearing before said Commission on such matters; and WHEREAS, notice has been published of the time and place of a public hearing held before the City Council concerning the changes herein made, which public hearing has been duly held; and, WHEREAS, the City Council has determined that the amendment to the Comprehensive Zoning Ordinance herein made is in the best interest of the health, safety and general welfare of the citizens of the City of North Richland Hills; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: Section 1: THAT the Comprehensive Plan and the Comprehensive Zoning Ordinance are hereby amended by adopting the amended "PD" site plan for that property containing approximately 1.08 acres of land, located at 6413 Precinct Line Road, and being Lot 3R, Block 1, Home Depot Addition, North Richland Hills, Tarrant County, Texas, as set forth on the site plan attached hereto and incorporated herein as Exhibit "A." Section 2: The official zoning map, of the City of North Richland Hills is hereby amended and the City Secretary is hereafter directed to revise the zoning map to reflect the amendment as set forth above. Section 3: It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases ofthis ordinance are severable and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional or otherwise invalid by the final judgment or decree W:\N~\GeneraI\Ordinances\MapChange.PD Amend.Home Depot.wpd Page 1 21 23 25 27 29 31 33 35 37 39 41 43 45 !; 1 of any court of competent jurisdiction, such invalidity shall not affect any ofthe remaining phrases, clauses, sentences, paragraphs and sections ofthis ordinance, since the same would have been enacted by the city council without the incorporation in this ordinance of any such invalid phrase, clause, sentence, paragraph or section. 3 5 7 Section 4: All rights and remedies ofthe City of North Richland Hills are expressly saved as to any and all violations of the provisions of any ordinances affecting health and safety which have accrued at the time ofthe effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance, but may be prosecuted until final disposition by the courts. 9 11 13 15 Section 5: Any person, firm or corporation violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon final conviction thereof fined in an amount not to exceed Two Thousand Dollars ($2,000.00). Each day any such violation shall be allowed to continue shall constitute a separate violation and punishable hereunder. 17 19 Section 6: The City Secretary is hereby authorized and directed to cause the publication of the descriptive caption and penalty clauses of this ordinance as an alternative method of publication provided by law. Section 7: This ordinance shall be in full force and effect immediately upon passage. AND IT IS SO ORDAINED.
