HomeMy WebLinkAboutOrdinance 2712 2 4 6 8 10 12 14 16 18 20 22 24 26 28 30 32 34 36 38 40 42 II ORDINANCE NO. 2712 ZONING CASE PZ 2003-10 AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN AND THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF NORTH RICHLAND HILLS; AMENDING THE ZONING MAP AND OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, AND REZONING A 4.030 ACRE TRACT OF PROPERTY FROM AG (AGRICULTURAL) TO TC (TOWN CENTER) ZONING; ESTABLISHING A PENALTY; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, notice of a hearing before the Planning and Zoning Commission was sent to real property owners within 200 feet of the property herein described at least 10 days before such hearing; and, WHEREAS, notice of a public hearing before the City Council was published in a newspaper of general circulation in the City at least 15 days before such hearing; and, WHEREAS, public hearings to zone the property herein described were held before both the Planning and Zoning Commission and the City Council, and the Planning and Zoning Commission has heretofore made a recommendation concerning the zone change; and, WHEREAS, the City Council is of the opinion that the zone change herein effectuated furthers the purpose of zoning as set forth in the Comprehensive Zoning Ordinance and is in the best interest ofthe citizens ofthe City of North Richland Hills; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: Section 1: THAT the Comprehensive Plan, the Comprehensive Zoning Ordinance and the zoning map of the City of North Richland Hills are hereby amended by rezoning a 4.030 acre tract of land located in the 8100 Block of Bridge Street and 6200 Block of Shirley Drive, more particularly described on Exhibit "A" hereto, from AG Agricultural to TC Town Center zoning District for Center Sub-Zone Uses. Section 2: Any person, firm or corporation violating any provision of the Comprehensive Zoning Ordinance as amended hereby shall be deemed guilty of a misdemeanor and upon final conviction thereof fined in an amount not to exceed Two Thousand Dollars ($2,000.00). Each day any such violation shall be allowed to continue shall constitute a separate violation and punishable hereunder. Staples, Attorney -~ Department Head /' Ordinance No. 2712 Page 2 of 2 2 4 6 8 10 12 14 16 18 20 22 24 26 28 30 32 34 36 38 II PROPERTY DESCRIPTION Being a 4.030 acre tract ofland out of the John Barlough Survey Abstract 130, in the city of North Richland Hills, Tarrant County, Texas, and being more particularly described as follows: BEGINNING North 00 degrees 34 minutes West, 635.90 feet and North 00 degrees 25 minutes 45 seconds West, 131.25 feet from the southwest corner of a 61.2 acre tract conveyed to Earnest Earl Newman and wife, as recorded in Volume 2254, Page 218, of the Deed Records of Tarrant County, Texas; said point being in the west property line of said Newman tract; THENCE North 89 degrees 34 minutes 15 seconds East, 96.20 feet to the beginning of a curve to the left with a radius of 304.05 feet; THENCE Northeasterly along said curve to the left for a distance of 159.66 feet to the end of said curve; THENCE North 59 degrees 29 minutes 00 seconds East, 59.38 feet to a point for corner; THENCE South 00 degrees 25 minutes 45 seconds East, 639.49 feet to a point for corner; THENCE South 89 degrees 34 minutes 15 seconds West, 300.00 feet to the POINT OF BEGINNING and containing 4.030 acres of land, more or less. Exhibit A to Ordinance No. 2712 Attachments to Ordinance No. 2712 Motion to approve Ordinance included stipulations that several attachments be attached. Attachments were never received by the Planning Department. Applicant encountered problems and stopped working on project. Applicant does not have plans to continue with project. (See attached e-mail from Carolyn Huggins! Planning Department dated May 5, 2004.) City Attorney advised 5/6/04 that there is not any actíon that the City needs to take to fulfill Council's requirements in the motion.
