HomeMy WebLinkAboutOrdinance 2681 2 4 6 8 10 12 14 16 18 20 22 24 26 28 30 32 34 36 38 40 42 II ORDINANCE NO. 2681 ZONING CASE PZ 2002-27 AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN AND THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF NORTH RICHLAND HILLS; AMENDING THE ZONING MAP AND CHANGING THE ZONING OF PROPERTY IN THE 6300 BLOCK OF DAVIS BOULEVARD BY GRANTING A SPECIAL USE PERMIT; APPROVING THE SITE PLAN; PROVIDING A PENAL TY; PROVIDING FOR PUBLICATION; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, notice of a hearing before the Planning and Zoning Commission was sent to real property owners within 200 feet ofthe property herein described at least 10 days before such hearing; and, WHEREAS, notice of a public hearing before the City Council was published in a newspaper of general circulation in North Richland Hills at least 15 days before such hearing; and, WHEREAS, public hearings to change the zoning on the property herein described were held before both the Planning and Zoning Commission and the City Council, and the Planning and Zoning Commission has heretofore made a recommendation concerning the zone change; and, WHEREAS, the City Council is ofthe opinion that the zone change herein effectuated furthers the purpose of zoning as set forth in the Comprehensive Zoning Ordinance and is in the best interest of the citizens ofthe City of North Richland Hills; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: Section 1: THAT the Comprehensive Plan, the Comprehensive Zoning Ordinance, and the Official Zoning Map ofNorth Richland Hills are hereby amended by changing the zoning of property currently zoned Commercial ("C-l ") and described as Block A, Lot 1, Q. T. 855 Addition ofthe City of North Richland Hills, Texas, and more fully described in Exhibit A hereto, and set forth on the site plan attached hereto and incorporated herein as Exhibit "B," by granting an SUP to allow for a gasoline service station, subject to the following conditions: (a) The gasoline pump canopy shall have a pitched roof conforming to residential pitch standards. (c) Signs shall be posted limiting access through the curb cut on Davis Boulevard and to right in-right out. (d) Sidewalks depicted on the site plan adjacent to streets shall be moved away from such streets by five feet. (e) Trees depicted on the site plan landscaping plan shall be a minimum of twelve feet tall at the time of planting. Any person, firm or corporation violating any provision of the comprehensive zoning ordinance as amended by this ordinance shall be deemed guilty of a misdemeanor and upon final conviction thereof fined in an amount not to exceed Two Thousand Dollars ($2,000.00). Each day any such violation shall be allowed to continue shall constitute a separate violation and punishable hereunder. The City Secretary is hereby authorized and directed to cause the publication of the descriptive caption and penalty clauses of this ordinance as an alternative method of publication provided by law. This ordinance shall be in full force and effect immediately upon passage. AND IT IS SO ORDAINED. Passed on this 13th day of January, 2003.
