This change from the .4095/$100 that we used at work session due to IIhe new figures that we received on July 26 from TAD which had higher increases in assessed values ,on 1983 properties than previously reported to us, to the extent of approximately 11200,000,000. In Table 2 - over-65 Ex.emption $15,000 - the tax rate would be .3329/$100. II In Table 3 - over-65 $15,000'+ 10% Residence Homestead - the calculated Tax Rate ould be .3432/$100 and this will not cover the amount needed for the budget. We will lie approximately $104,837 short. The reason for this is that in the year that you IIrant a new exemption, State law requires that you must reduce the amount of tax revenue raised in the prior year associated with this exemption. To figure this we used 1983 lingle family appraised value $411,067,182 X 10% = $41,106,718 X .28/$100 (M&O Rate 1983) = $115,098 revenue lost due to new exemption. To arrive at amount of exemptions lIor 1984 I took the Total Appraised Value X 62% X 10% to arrive at Taxable Value for calculations. (The 1984 Tax roll is estimated by TAD to be comprised 62% of single lIaiY I residences.) I figured the revenue lost for the over-65 change also. All of I I lI~evenue lost due to new exemptions is the number in DATA ITEM #6. To come close to the amount required for the budget, (within $7,269) you need to set the rate at the lfaximum Effective Tax Rate (3% limit without Public Hearing) which is .3534/$100. In Table 4 - over-65 $15,000 + 20% Residence Homestead - the tax rate would leo .3558/$100 and this will be approximately $215,375 short of budget. This is due same reason as explained in Table 3 and we used the same method except we used ílO% instead of 10% in the calculations. Compare the effect to DATA ITEM 6 of the ~emptions to revenue. To give 20% Residence Homestead exemption you would need to raise the tax rate approximately 6.5% above the effective tax rate, thereby forcing II public hearing on the tax rate, which would have to be advertised in the City's official newspaper in a one quarter page ad as a tax rate increase. II In Table 5 and Table 6 - I have summarized the effect of each of the methods of exemptions on the tax bills at the Effective Tax Rate and the Maximum Effective ~x Rate. Table 7 will show the effect of each tax rate on the Tax Levy and the ~fect on the budget. II The 11·1) 2) 3) exemptions are deducted in the following order: Percentage Residence Homestead Over-65 Disabled Veterans II If you do decide to give the Residence Homestead exemption, the citizens that have filed with TAD for homestead for County or School district would also qualify for the Ifty exemption. Per State law a citizen can file for a homestead exemption up to one year after the delinquency date for that tax year and the refund is retroactive. (For Ifample 1984 tax year, a citizen could file an application up to January 31, 1986 and Ipeceive a refund for taxes paid on this exemption amount.) l When the tape for this year is received from TAD the programmer can run different tail information for each of the different methods for exemptions to determine the __ctual effect on the tax rate. The tape may be received by August 10th. Then you lÞuld have more actual information on which to base the calculation of the tax rate. The information contained in this report does contain several assumptions which could Irfect the tax rate up or down. I City of j\(8rth Richland Hills, Texas August 8, 1984 Memo to: Mayor/City Council From: Dennis Horvath Assistant City Manager Subject: Sound System in Council Chambers John Whitney has recently finished a complete reworking of the sound system in the Council Chambers. Improvements include: 1. 24 speakers are now in place - before we had six.: 2. An automatic mixer has been added which was custom made for the room size and acoustics. 3. There is now an individual sensitivity adjustment for each microphone. A word of caution - the new system is extremely sensitive and private conversations will not be possible at the Council table. You no longer have to speak directly into the microphone. There may be some feedback at first as the sound engineer could not adjust the system properly with an empty room. This change from the .4095/$100 that we used at work session due to tit new figures that we received on July 26 from TAD which had higher increases in assessed alues on 1983 properties than previously reported to us, to the extent of approximately $10,000,000. In Table 2 - over-65 Exemption $15,000 - the tax rate would be .3329/$100. I In Table 3 - over-65 $15,000 + 10% Residence Homestead - the calculated Tax Rate w ld be .3432/$100 and this will not cover the amount needed for the budget. We will b¡approXimatelY $104,837 short. The reason for this is that in the year that you g nt a new exemption, State law requires that you must reduce the amount of tax revenue raised in the prior year associated with this exemption. To figure this we used 1983 S~gle family appraised value $411,067,182 X 10% = $41,106,718 X .28/$100 (M&O Rate 1983) = $115,098 revenue lost due to new exemption. To arrive at amount of exemptions fit 1984 I took the Total Appraised Value X 62% X 10% to arrive at Taxable Value for calculations. (The 1984 Tax roll is estimated by TAD to be comprised 62% of single ~ residences.) I figured the revenue lost for the over-65 change also. All of I I I e IIrevenue lost due to new exemptions is the number in DATA ITEM #6. To come close the amount required for the budget, (within $7,269) you need to set the rate at the IJmum Effective Tax Rate (3% limit without Public Hearing) which is .3534/$100. In Table 4 - over-65 $15,000 + 20% Residence Homestead - the tax rate would 113558/$100 and this will be approximately $215,375 short of budget. This is due !lame reason as explained in Table 3 and we used the same method except we used linstead of 10% in the calculations. Compare the effect to DATA ITEM 6 of the ptions to revenue. To give 20% Residence Homestead exemption you would need to I- e the tax rate approximately 6.5% above the effective tax rate, thereby forcing blic hearing on the tax rate, which would have to be advertised in the City's fficial newspaper in a one quarter page ad as a tax rate increase. I In Table 5 and Table 6 - I have summarized the effect of each of the methods f exemptions on the tax bills at the Effective Tax Rate and the Maximum Effective alRate. Table 7 will show the effect of each tax rate on the Tax Levy and the f ct on the budget. County Judge l-nnd County Commissioners of Tarrant County: On behalf of the nearly 50 member organizations of the Senior Citizens Alliance of Tarrant County, we want you to know our great concern about pos- I sible large tax increases on the homesteads of older citizens which may re- sult from the recent tax appraisals by the Tarrant Appraisal Distriçt. Our members, most of whom are living on low fixed incomes, cannot pay increased II homestead taxes. Undoubtedly, you are hearing the dismay of many older cit- izens at the 100% and more increases in their homestead tax valuations. While we recognize that tax rates may be reduced, the large increased I tax appraisals, especially on the older homes owned by most older citizens, will increase their tax burden beyond their ability to pay, unless the tax exemption on the homesteads of those over 65 years is increased in an amount II proportionate to the valuation increase. We respectfully urge an increase in the homestead tax exemption for those over 65 to not less than $50,000 - the exemption extended in Dallas, Brazos, Galveston, Orange, Travis and perhaps lather counties. We believe such action b:)' the County Board and all City Coun·- cils is necessary to avoid tax increases older homeowners cannot afford. While some older citizens are well off financially, the large portion I are dependent on Social Security or other limited retirement annuity. In- cluding the recent modest cost-of-living adjustment, the average SS retired worker receives only $430 per month and the average for an elderly couple is only $744. A study by the National Council on Aging concluded that 75% of ~all persons 65 and over depend on Social Security or other limited pension. Texas Senate study found that the income level of persons over 65 in Texas , s about half that of those under 65 years. Already faced with escalating II utili ty, medical and other Ii ving costs, mo,st senior ci tizens have no margin for increased taxes. After talking to he directors of Public Works in these five cities, I have changed my opinion nd recommendation concerning what we should do with the developers in our City. Ii now recommend that we require more than just the letter of approval that we have been requiring. My recommendation is that we require a minimum of I temporary drainage easement and that the developer's engineer design the ischarge so that it will not cause any off site erosion. fy recommendation is based on the comments that I received from the five ities involved in the survey. Also, the City of Hurst is sending me some ecent literature that they obtained in a training session on this matter. The following is the results of a survey of the five cities. ~4IÞ Hurst - Requires the developer to obtain an easement from the downstream property owner. They feel like that I if they 'do not have an easement from the downstream property owner, the downstream property owner could block the flow legally. This also makes the down- I stream property owner more aware of what's taking place across his property. I I I I I Ie I Haltom City - They also obtain an easement plus they require the developer's engineer to show that they have designed a facility that will not cause erosion downstream. If they cannot control the erosion problem downstream in a proper manner then they must improve the downstream drainage facility until the erosion problem is taken care of. Bedford - Handles the problem in the same manner in which we do. They simply require a letter from the downstream property owner stating that he has given his permission for the discharge of storm water onto his property. Euless - Requires a letter from the downstream property owner that he gives his permission for the storm water to be discharged across his property and that he also understands that erosion will probably take place across his property. Arlington - Requires that the upstream developer must obtain a detailed ' letter signed by the downstream property owner stating that he is aware of all of the drainage facilities that are going in and how they are going to effect his property. Or instead of the letter, the upstream developer can obtain an easement from the downstream property owner. I .. ... ... Box 184)8 North Richland Hills, TX 76118 Dear Mayor Echols: As per our phone conversation, I am including a brief synopsis of events that took place in regard of our alteration lady being accosted. I would appreciate any recognition that the city could provide for this act of a concerned citizen, Jim Martin. Hazel Bowlby, our alteration lady, was leaving work around noon, Wednesday, July 25. She had reached her car when out of no where, a car pulled up beside her and a man jumped out to~atched her purse. Hazel didn't give it up and struggled with the man. In the meantime, Jim Martin of Martin's Barber Shop saw this happening and ran to aid Hazel. Just before reaching her, the man was able to e~cape with the purse. He had been successful in wrestling Hazel to the ground. Mr. Martin ran to his car and proceeded to chase the purse snatcher. This lasted for some time when finally the man made a wrong turn and was cornered on a cul-de-sac. He drove up to Mr. Martin and asked if he could give the purse back, and in turn be let go. The man sped. away. Mr. Martin returned the purse and money intacted. The action of this one man is, partly along with an excellent police department, responsib16 in retrieving the purse and apprehended the criminal. It is even nicer to help Hazel Bowlby, who is 79 years old. I spoke (and in behalf of my husband, Clifford Pearson) against the requested apartment zoning for two reasons: 1. We believed the cons truction of apartments in addition to the already granted commercial zoning for a proposed shopping center would create water runoff on our adjoining property to the east. Our property is located on Bursey Road immediately below the proposed zoning change. 2. Also, we believed that the mere fact that apartments could be located adjacent to our property would lower our property's value significantly. Inasmuch as we have been assured by Doug Long, engineer/developer on ~he apartment project, that every effort will be made to construct quality apartments with adequate green belts for water absorbtion¡ we withdraw our objection to the apartment zoning with one stipulation: That both the property adjacent to the south of our property and the property adjacent to the west of our property (both of which Mr. Long is involved in developing) be considered Very carefully by the City Engineer as to proper drainage. It is our desire now, as then, that any displaced water be channeled property to avoid future problems. If planned adequately, it may be that our property value will be in- creased rather than diminished. In that respect, we certainly have no objection. Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Owen D. Long, Consulting Engineer, came forward. He said this is the first request for this classification in the new zoning ordinance which requires site plan approval. Mr. Long said he hoped they had provided all the information the Commission needed. He said their site plan exceeds the minimum requirements. Mr. Long said this property is adjacent to commercial zoning and is north of Southland Corporation's property who sent a letter of approval. Chairman Tucker asked if the complex would empty onto Bursey Road. Mr. Long said it would, but they are extending Crosstimbers which follows a double gas line. He said they might want to swing this road a little farther to the side. Mr. Long said they had problems with the sewer and the reason for putting the sewer where they did was the crest of the hill. Mr. Long stated they have the parking and lighting directed internally so they would not be too close to the adjacent property owners. He stated they would be constructing their half of Bursey Road. Mr. Schwinger asked if they plan to dump 300 cars onto Bursey Road with this development. He said there are plans for Bursey Road to go west to Highway 377 and Crosstimbers will be a 37 foot collector street to Hightower Drive. Mr. Long said people going to work would use Bursey and Rufe Snow. Mr. Long said there are plans to develop the property to the south of this property at a later date and also there is a church interested in purchasing the property to the east of this property. Mr. Long said they would like to develop the commercial and apartments at the same time. He said this is sort of like a Planned Development; if they had to change any elevations, they would have to come back for another site approval. Mr. Long said they already have someone who is interested in developing this property and they are working on the engineering now. Mr. Wood said he agreed with having the commercial to the west, but he did not feel this property was ideal for Multi-Family. He said apartments should be located on major thoroughfares. She said she owns 25 acres adjacent to this property on the east which is separated by a wooden fence. Ms. Pearson said there are three existing homes and their property circles around them to Douglas Lane. She said if apartments are built on this property, it would limit 'their use of their land. Ms. Pearson stated they had a drainage problem. She said the commercial area is on top of a hill and all the rain drains down to their property and with this apartment complex with all the cement, their property would flood. He said he understands there is a drainage problem in this area, but he plans to correct that. He said he had discussed this with the City Engineer and he said it would take a 60 inch line from the bridge to Chapman Road. Mr. Cook said the cost to do this is almost prohibitive. He said that is the reason he has requested the duplex zoning for this tract. Mr. Cook said if he could work with the property owners, he could take the bend out and take it straight to Chapman; if not, he may have to put it at an angle. Mr. Cook said along Hewitt Street, there are large drainage ditches, but small culverts which are about 1,000 feet from Chapman Road. He said he would like to bring Hewitt Street straight south to Chapman Road. He said he had contacted adjacent property owners. He said if you put any deeper ditches than is already there, someone is going to drive off and drown. Mr. Richmond said the road gets covered up as deep as 18 inches when it rains. He said if it comes a good hard rain, you can not build ditches large enough to handle the water. Mr. Richmond said he does not desire to have duplexes across the street from him. William Gideon, 7717 Chapman Road, came forward. He said they had no problem with the water until houses were built around them. He said he had seen the water 3 or 4 feet, not 18 inches. He said if you go in there and build apartment houses, you will have real serious problems. Mr. Gideon said they have already laid too much concrete now. He said there needs to be a way to get the water from the elbow in Hewitt to Chapman Road. Marvin Miller, 6717 Hewitt Street, came forward. He said the drainage ditch goes behind his property. He said nothing has ever been done about the drainage. Mr. Miller said one culvert on the east side of Hewitt Street which is 36 inches deep and 12 feet wide, 36 square feet, would not even carry the volume of water. He said if water runs on grass and weeds, it will be absorbed, but more concrete will increase the drainage problem. Mr. Miller said as far as the duplex zoning, he did not know they were asking for it. Mike Dean, 6725 Hewitt Street, came forward. He said there was wrong information as to the location. Mr. Dean said he had seen 18 inches of water in the street in front of his house. He said he has a 50 feet wide and 18 inch deep berm to keep the water out. Mr. Dean said he is opposed to the development of this property due to the drainage. He said when the water hits Chapman Road, it has to make a 90 degree turn down Chapman. Mr. Dean said his house almost flooded because a trash can had stopped up the culvert. Mr. Dean said he is opposed to this request because of the streets. He said North Richland Hills has the worst streets around. He said there is already congested traffic at Smithfield Road and Davis Boulevard and at Main Street and Davis Boulevard. Mr. Dean said he was not in favor of duplexes; he does not like rental property. He said he would not be in favor of residential either because he likes the open area. Mr. Dean asked what they could do to stop this development. Chairman Tucker said if he could get a petition with signatures of 20% of the property owners within 200 feet of this property, then it would take a three-fourths majority of the City Council voting affirmative to pass it. Mr. Bowen said if this request is approved, it would go to the City Council on the 9th of July, but if denied by P & Z, Mr. Cook would have to request an Appeal Hearing. Mr. Dean said if the Commission would come out to this area, they would know that a 5 foot drainage system would not take care of it. Chairman Tucker said this Commission takes a hard look at the platting of a piece of property. He said they must satisfy both the City Engineer and this Commission. Chairman Tucker said it would be from 30 to 60 days before they could come back to the Planning and Zoning Commission with the platting. Mike Thompson, 6704 Habell, came forward. He said he was opposed to duplexes. He said the City Engineer may look at the platting, but someone allowed Marvin Smith to build his house several inches below the curb. Mr. Thompson said there are small culverts and the water can not get across Chapman Road and the water backs up and someone is going to sue someone one of these days. Ed Pruitt came forward. He said he lives at 6709 Mabell and owns 6717 Mabell and he is in opposition to this request. Charles Cundiff, 6721 Mabell, came forward. He said he is opposed to this request. He said he was concerned that the "quiet" of the area would change. Mr. Fuller said he would not object to the change, but he would like to see it tied to providing adequate drainage. Mr. Hannon said the City has special engineering guidelines on what to do with the drainage, the streets, how close they are, etc. He said if all the City's requirements are not met, his plat will not be approved. Mr. Hannon said if the zoning is approved, it might be 20 years before it could be developed. Mr. Fuller said he might solve the drainage on this property, but create one on the adjacent property. Mr. Fuller said he was against the zoning change, he would rather it stay Agriculture. Mike Dean, 6725 Hewitt Street, came forward. He said he was against this zoning request. Mr. Dean said there is an open drainage ditch and drainage problems which was to be fixed in the approved bond issue, but understand it has been cancelled. He said they did not have a drainage problem until the property was developed around them. Chairman Tucker closed the Public Hearing. Chairman Tucker said if they take the restrictions off this portion, the developer can go ahead and do what he wishes with the balance .pf the Planned 'pevelopment. He said the Commission does feel they must put -in the street. The representative of the church said they wished to continue. Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Bob Hamm came forwàrd' to represent the church. He said Chairman Tucker had expressed their desires and it sounded good to them. Chairman Tucker said the street is a major concern of the Planning and Zoning Commission because of the congestion at Rufe Snow. He said they might be able to get help from the State for a bridge and a ramp someday, but the street would give passage to the freeway. Mr. Hannon made the motion that Ordinance 11033 be amended as follows: 1. the MF be changed to U-PD; 2. the turn around be deleted; 3. the masonry wall be deleted; 4. the one-way requirement for Colonial Parkway be deleted; 5. Request of Burk Collins Investments, Inc. to rezone Blocks 1 & 2, Fox Hollow Addition, from their present classification of R-3 (Single Family) to R-5-D (Duplex). This property is located north of Watauga Road, bounded on the south by the railroad and on the west by North Park Estates. Acting Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Burk Collins came forward. He said he was requesting the change from R-3 to duplex for a higher yield. He said there had been flooding problems in this area and he has corrected most of it. Mr. Collins said he had built 1,500 foot concrete lined channel and would build another 500 feet. He said this is very expensive and if he could get this zoning, it would help with "this added expense. Mr. Wood asked how he plans to get access to this subdivision. Mr. Collins said he and Doug Long plan to build a road to Watauga Road. Acting Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. Mr. Hannon asked when it was 'zoned. Doug Long came forward. He said he had owned this property approximately 10 years. He said it was originally IF-7 (Single Family) which was done away with. He said they had intended to put 235 houses on it. Mr. Long' said then they zoned it Industrial since it was close to the railroad which was in 1973 or 74, but the financing fell through. Mr. Long said when the new ordinance and map was adopted, he was told he could not use it, it would be non-conforming and said it could go to R-3. He said they thought the Industrial zoning might not be the best so they allowed it to be changed to R-3. Mr. Long said he paid for the railroad crossing 10 years ago and he will assist Mr. Collins in bringing the street through to Watauga Road. He said they already have a culvert there and water and sewer, but it has been there so long, and so much has developed, they will have to increase the size of the culvert. Mr. Hannon asked if North Park Estates was built at the time they received the Industrial zoning. Mr. Long said he did not think the houses were built, but the property was zoned. He said the City Council said we would have to put a lesser use of Industrial next to them. Mr. Long said the property to the south of the property in question was previously Local Retail but is now C-l. Mr. Hannon asked how many property owners were contacted. I '." Vehicle, Recreational: Self propelled motor vehicle or "motor home" intended to provide mobile living quarters for one or more persons and used for recreational purposes; "Winnebago" or similar. Truck, Pickup: A vehicle in factory original configuration and being designated by its manufacturer as being a pickup truck; not including vehicles with special purpose bodies or beds installed by dealers or customizers. Trailer, private: A travel trailer, boat trailer, cargo trailer or any non-self propelled wheeled vehicle intended to be towed behind a commuter vehicl,e and used for recreational purposes or to transport goods and materials for home use; not including commercial trailer or house trailer. Trailer, Commercial: Any trailer not qualifying as a private trailer or commercial trailer. Vehicle, Parking of: The temporary and short term stationary placement of an unoccupied vehicle on a paved surface where the vehicle is fully operational and used on a frequent basis; does not include storage. Vehicle, Storage of: The temporary or permanent long term placement of an unoccupied vehicle on a paved surface where the vehicle is either not fully operational or is not used for commuting purposes at least monthly. Residential District: Any zoning district whose classification allows as a permitted use or as a legal nonconforming use the construction or maintenance of dwellings for human habitation; including, but not limited to: R-l, R-2, R-3, R-4-SD, R-5-D, R-6-T, R-7-MF, AG, and any and all portions o~ planned developments allowing residential construction; includes mobile home parks and special use residential property whether conforming or not. SECTION 9.4.1: Delete all wording and add the following: District area requirements: one acre. SECTION 24.15: Delete all wording and add the following: 24.15.1 24.15 PARKING AND STORAGE OF VEHICLES 24.15.2 This section applies to all residential districts. Parking of Commuter Vehicles: Commuter vehicles may be parked on paved driveways located anywhere on a platted lot or tract of land within a residential district including within required front, side and rear yards and within the public right of way between the curb face of a curbed street and the property line of said lot or tract provided that such paved driveways were constructed pursuant to a valid building permit. Where curb does not exist on the abutting public street, vehicles parked in driveways shall be positioned such that no part of any vehicle is closer than 25 feet from the centerline of said street or the right of way line whichever is less. Commuter vehicles.may also be parked along the curb on paved public streets for periods not to exceed 16 hours per day and provided that such location is not a designated no parking zone or upon a street designated as a collector, major or arterial thoroughfare on the most recentLcity master thoroughfare plan. Where curb does not exist on the abutting public street, vehicles parked along the street shall be positioned such that no part of any vehicle is closer than 25 feet from the centerline of said street. Such stored vehicles must be placed on paved surfaces and be screened from all public view. Such stored vehicles may be located anywhere on said lot or tract behind the front building line including within required side and rear yards, provided however that no vehicle may be stored within ten feet of the principal structure,~n the property unless it is garaged within said principal structure. 24.15.4 Temporary Parking: Recreational vehicles and private trailers may be parked within residential districts on the same basis as commuter vehicles for periods not to exceed 24 continuous hours nor more than three full or partial 24 hour periods in any consecutive seven day period. 24.15.5 Storage of Non-Commuter Vehicles: Recreational vehicles and private trailers may be stored in residential districts on paved surfaces located behind the front building line and screened from all public view including within required rear and side yards but no closer than ten feet from the principal structure on a given lot or tract unless garaged within said principal structure. Recreational vehicles and private trailers in storage may not be occupied nor connected to any utility that would permit, facilitate or enhance occupancy. 24.25.6 Agricultural Exemption: The requirements of this section will not apply to any portion of an AG zoned tract actually in use for farming or ranching. A valid agricultural exemption from the Tarrant Appraisal District will be considered as proof of agricultural use. 24.15.7 24.15.8 Other Vehicles Prohibited: Parking or storage of any vehicle except as above permitted is prohibited in a residential district. . Variances: The Zoning Board of Adjustment will hear requests for variances from these requirements and such variances, if granted, will specify a specific individual vehicle by VIN number and Texas registration tag number, a specific individual person by name and a specific individual platted lot or tract of land by street address and either lot and block or metes and bounds, and the specific date no more than five years after the effective date of the variance upon which said variance will expire. Said variance will expire upon the earliest of the following: expiration date of variance, disposal of the specified vehicle by the specified individual, at any time when the specified property ceases to be the principal residence of the specified individual. This requirement stipulates that 75% 1 must be on the lower floor only. The enforcement of this ordinance has been that the garage is included as part of the residence and the requirement I has been that they must have 75% brick or stone also. I As I understand it, Mr. Hubbard is requesting a variance on a five bay, -two story detached garage with an upstairs storage room. There is also 1 a two bay garage attached to the house by a covered walkway which will be masonry. Creating an operational organization; Granting necessary' powers to cope with emer- gencies threatening life and property in the City of North Richland Hills, Texas; Authorizing cooperative and mutual aid agreements for relief work between this and other cities or countries and for related purposes; ProhibitingJ unauthorized warning and all-clear signals and making violations a misdemeanor punishable by a fine not not exc~eding $200. In Fiscal year 83-84 Council approved the purchase and installation of the Civil Defense Siren System. This system has been purchased, installed, tested and any future needs will be yearly maintenance, electrical service, repairs arising from vandalism and miscellaneous inspections.' Ih the above mentioned Ordinance "971" Section 9 as it now reads "No person shall have the right to expend any Public funds of the City in carrying out any disaster service activity authorized by this Ordinance without' prior approval by the City Council, nor shall any person have any right to bind the City by contract, agreement or otherwise without prior and specific approval of the City Council." As written this Ordinanee requires any Purchase made for the Civil Defense System be approved by the City Council, whether it be in any amount. Section 9 as written does not fall within the guide lines set by City Charter or State Law. The powers of the Director shall include the authority to declare a state of emergency, but such action may be subject to confirmation by the City council at its next meeting. The duties of the Director shall also include the causing of a survey of the availability of existing personnel, equipment, supplies and services which could be used during an emergency, as provided for herein, as well as a con- tinuing study of the need for a~endments and imProvements in the disaster services plan. SECTION 3: The duties and responsibilities of the Civil Preparedness Direc- tor shall include the following: (a) The control and direction of the actual operation or training of the disaster services organization of the city of North Richland Hills. The determination of all questions of authority and responsibility that may arise within the disaster services organization of the City of North Rich1and Hills. The functions and duties of this organization shall be distributed among such'officers and employees in accordance with the terms of the disaster services plan. Such plan shall set forth the form of the organization, establish and designate divisions and functions, assign tasks, duties, and powers, and designate officers and employees to carry out the pro- visions of this Ordinance. Insofar as possible, the form of organization, titles, and terminology shall conform to the recommendations of the state Disaster Emergency Services council of the state of Texas and of the Federal government. (d) The marshaling, after declaration of an emergency as provided for above, of all necessary personnel, equipment or supplies from any department of the City of North Richland Hills to aid in the carrying out of the disaster services plan. (e) The issuance of all necessary proclamations as to the existence of an emergency and the immediate operational effectiveness of the disaster services plan. (f) The issuance of reasonable rules, regulations or directives which are necessary for the protection of life and property in the City of North Richland Hills. (g) The supervision of the drafting and execution of mutual aid agree- ments, in cooperation with the representatives of state and of other local political subdivisions of the State, and the drafting and execution, if deemed desirable, of an agreement with the county in which said City is located and with other municipalities within the county, for the county-wide coordination of disaster services efforts. (h) The supervision of and final authorization for the procurement of all necessary supplies and e9uipment, including acceptance of private contributions. (i) The authorizing of agreements, after approval of the City Attorney, for the use of private property for public shelter and other purposes. I SECTION 5: Any unauthorized person who shall operate a siren or other device so as to simulate a warning signal, or the termination of a warning, shall be deemed guilty of a violation of-this Ordinance and shall be subje~t to the penalties imposed by this Ordinance. SECTION 6: At all times when the orders, rules, and regulations made and promulgated pursuant to this Ordinance shall be in effect, they shall supersede and override all existing ordinances, orders, rules, and regulations insofar as the latter may be inconsistent therewith. I I SECTION 7: This Ordinance shall not be construed so as to conflict with any state or Federal statute or with any military or naval order, rule or regulation. I SECTION 9: No person shall have the right to expend any public funds of the City in carrying out any disaster services activity authorized by this Ordinance without prior approval by the City Council, nor shall any person have any right to bind the City by contract, agreement or otherwise without prior and specific approval of the City Council. I SECTION 10: It shall be unlawful for any person willfully to obstruct, I hinder, or delay any member of the disaster services organization in the enforcement of any rule or regulation issued pursuant to this Ordinance, or to do any act forbidden by any rule or regulation issued pursuant to the authority contained in this Ordinance. It shall likewise be unlawful for any person to wear, carry or display any emblem, II.-insignia or any other ~eans of identification as a member of the disaster services ~rganization of the City of North Richland Hills, unless authority so to do has been granted to such person by the proper officials. Convictions for violations of the II provisions of this Ordinance shall be punishable by fine. SECTION 11: If any portion of this Ordinance shall, for any reason, be declared invalid, such invalidity shall not affect the remaining provisions hereof. II SECTION 12: The immediate passage of this Ordinance is deemed essential to the public health, safety and welfare and it shall take effect immediately upon passage. The firm of David C. Moak Surveyors, Inc. shall be engaged to prepare a right-of-way strip map and individual parcel descriptions for a 100 foot right-of-way for Precinct Line Road - from Grapevine Highway (SH 26) to Davis Boulevard (FM 1936) for a fee not to exceed $18,000. 2. Our latest report is that all signals are functioning properly. The Contract provides for a 3D-day test period which shall commence on this date and end on September 7, 1984. Any failure of equipment will require repair or replacement of defective units by the contractor and initialization of another 30-day test period. The two (2) year period of maintenance will begin on this date and terminate on August 7, 1986. This project was completed well under the contract completion date of September 26, 1984, therefore no liquidated damages were incurred.
