7. The Mayor presented Mr. Duane Hickman of the Fire Department
with his five year certificate and Pin.

10. Mayor Pro Tem Davis moved, seconded by Councilwoman Hinkle, to
approve PS 84-75, subject to the Engineers' comments.
Mayor Pro Tem Davis stated that the applicant's engineer did
not feel the water line should be extended because it would
go into the property west of which was currently the Hilltop
Apartment complex and a loop could not be completed. Mayor
Pro Tern Davis stated the staff had advised that was not correct
for a clarification from the application.
Mr. Vollintine, applicant, appeared before the Council.
Mr. Vollintine stated the property was being platted into
three separate tracts, the first two would be built on
shortly and the third sat on top of the hill and the western
boundary was totally surrounded by Hilltop apartments. Mr.
Vollintine stated the first engineering letter pertained to
fire protection and they had agreed to that. Mr. Vollintine
stated that part of the water line was already being looped
from Hilltop Drive to Browning Drive so the water would be
serviced in a total loop and they did not feel that the
extension of the line would serve any real useful purpose
because of the inability to loop it at the present time.

Mr. Albin stated that extending the line would provide the
ability to loop it into the apartment area at such time the
loop became necessary. Mr. Albin stated he had a map that
showed how the line could be looped in.
Mayor Pro Tem Davis asked Mr. Albin if he had a
recommendation.
Mr. Albin stated that additional information had come to his
attention that he was not aware of before and he would hate
to delay the plat.
Motion to approve, subject to the Engineers comments, carried 7-0.

12. Councilman Fisher moved, seconded by Councilman Kenna to grant
the appeal hearing for October 22, 1984.
Motion carried 7-0.
13. Councilman Kenna moved, seconded by Councilwoman Hinkle to
grant the appeal hearing for October 22, 1984.
Motion carried 7-0.
14. Mayor Echols advised that this request had been denied at the
September 10, 1984 meeting.
Mr. Line stated this was a request for re-consideration and
the Council Rules and Procedures provided that a motion to
reconsider action previously taken could be made only by one
of those persons that voted with the prevailing side and in
this case the side that prevailed was for denial. Mr. Line
stated that in order for the Council to reconsider the request,
presumably at the next Council Meeting, it would be necessary
for someone to make a motion that it be reconsidered.

23a. Mayor Echols stated that this item would not be heard
because a Planning and Zoning meeting was not possible.
24. Mr. Ed Stiggney appeared before the Council.
Mr. Stiggney stated that he had taken his problem to Mr.
Wheeler's office and he in turn looked the problem over and
advised him that everything the party had done was wrong.
Mr. Stiggney stated the party that did the job was a
citizen of North Richland Hills. Mr. Stiggney stated
that six citations had been issued to this person and
everyone had told him they would take care of it. Mr.
Stiggney stated he had gone to the County and they took
proceedings against him. Mr. Stiggney stated he got a
judgement against the person and warrants had been issued.
Mr. Stiggney stated everyone had told him they would
take care of it and nothing had been done. Mr.
Stiggney asked if there was anything he could do to
expedite the case.
Mr. Line stated that Mr. Stiggney had a lawn system
installed and it did not meet the City Code. Mr.
Line stated it constituted a serious health problem
in that there was no check valve on it to keep the
water that was sprinkled out of the City system.
Mr. Line stated the Inspectors had issued numerous
citations and there were warrants out for the person.
The Warrant Officer had not been able to find him.
Mr. Line stated the person was being looked for
and as soon as he was caught he would be put in jail.

The Mayor stated that there was a recommendation from the
Planning and Zoning Commission.
Mr. Line stated that the recommendation was to approve PS 84-87
subject to the engineers comments, with the exceptions that
the 30 foot right-of-way be dedicated to provide for a 60 foot
right-of-way on Crane Road and to provide the fire hydrant
coverage until such time as the water mains were adequate in
the area.
Councilman Ramsey moved, seconded by Councilwoman Hinkle, to
approve PS 84-87 according to Mr. Line's explanation.
Motion carried 6-0.
3a. Mr. Line stated that it had been brought to the staff's
attention that the City did not have an ordinance regulating,
prohibiting and controlling the sale and possession of drug
paraphernalia. Mr. Line stated that it would be in the best
interest of everyone that such a law be on the books in the
event somebody came along and wanted to open what was commonly
referred to as a head shop. Mr. Line stated that there
might be some urgency to this and the staff took this

heavily proselyted, with review and revisions by the City
Attorney and the staff recommended adoption of this ordinance.
Councilman Kenna moved, seconded by Councilman Ramsey/to approve
Ordinance 1155.
Motion carried 6-0
Councilman Ramsey commended the staff for their efficiency.
3b. Mayor Echols read the following resolution:
WHEREAS, Mr. Pat Moffatt has served as City Manager of
Haltom City for the past 21 years; and
WHEREAS, he has served in that capacity with wisdom,
professionalism, compassion for his fellow human beings,
steadfastness and integrity; and
WHEREAS, the citizens of North Richland Hills as well
as Haltom City have benefitted from Pat Moffatt's leadership
due to their sharing of a common city boundary; and
WHEREAS, the bond of friendship and goodwill between
the cities has been strengthened by Pat Moffatt's willingness
and desire to provide support and assistance for worthwhile
area projects; and
WHEREAS, it is the desire of the North Richland Hills
City Council to extend gratitude and best wishes to Pat Moffatt
upon his decision to enter into his well-deserved program of
retirement and other pursuits;
NOW THEREFORE BE IT RESOLVED that the City Council of the
City of North Richland Hills, Texas, recognizes and commends
Mr. Pat Moffatt and extends its appreciation for his service
to the Northeast Tarrant County community.
PASSED AND APPROVED this the 27th day of September, 1984.

Mr. Hubbard stated the building was already built. Mr. Hubbard
stated the building had brick pillars in front and he was
asking the Council to allow siding on the sides and back.

give.

abandoned vehicles and they will keep
the place clean. She said they feel
this zoning would upgrade and beautify
our city. Mrs. Byrd said since it is
adjacent to Byrd Automotive, they feel
the best use for it would be for a car
lot.
Doyne Byrd, 8320 Dude Court, came
forward. He said he would like to ask
the Commission's consideration of this
request. Mr. Byrd said he did not
feel there could be a better use of
this property and it would not be an
eyesore to the highway.
Acting Chairman Bowen called for those
wishing to speak in opposition to this
request to please come forward.
There being no one wishing to speak,
the Acting Chairman closed the Public
Hearing.
Mr. Wood said this is the same request
that was denied previously.
Mrs. Byrd said the Planning and Zoning
Commission approved it the other time,
but the City Council denied it.
Mr. Hannon said there are other
problems with this property.

Ms. Nash and the motion to deny
carried 4-0.

Chairman Tucker called for those

26 duplex lots to back up to the
railroad which would be single family
attached. He said this would be the
samð zoning as is on the other side of
the railroad.
Luke Arms, 8441 Dawn, came forward.
He asked where the children would go
to school.
Mr. Wood said they would probably go
to Smithfield Elementary and
Smithfield Junior High.
Chairman Tucker said that schools have
their own legislative powers and we
can not take their needs into
consideration, but he said the schools
and the Commission trade information
now so they can plan their growth.
Mr. Arms said he felt this zoning
request would create more traffic.
Chairman Tucker said the Commission
plans to submit the Thoroughfare Plan
to the City Council in about two
weeks. He said if one zones and
plats, they must build the streets
which is the only way the city can get
the streets built.
Mr. Long said they will build their
half of Amundson Road.
Chairman Tucker said without
developers, the city could not make
it.
Chairman Tucker called for those
wishing to speak in opposition to this
request to please come forward.
Gerald Stewart, 8840 Main Street, came
forward. He stated he was in
opposition to this request. He said
he does not feel this is a duplex
ares. Mr. Stewart said there would
not be 26 lots, there would be 52
duplexes which would mean 200 people.

Mr. Stewart said his brother lives in
a very exclusive neighborhood which is
within 200 feet of a railroad causes
no problems. He said he does not feel
this railroad is a nuisance, but he
does wish they would fix the crossing
on Main Street.
Mr. Stewart said he felt this area
should stay single family. He said
this is one way to pack areas for
profit. He read from the Zoning
Ordinance page 55 regarding home
occupations. He asked how could you
guarantee they would not do all these
occupations in duplex zoning.
Mr. Wood said that is what is allowed,
not what they cannot do. He said they
are also allowed in single family.
Mr. Stewart said they were against
duplex zoning previously when William
Garrison came in for a zoning change
and do not feel they should change
now.
Stephen Roberson, Surveyor, came
forward to represent Mr. & Mrs. Marcus
H. Roberson at 7008 Eden Road. He
said they were in opposition to this
request. Mr. Roberson said they would
have duplexes behind their house.
Chairman Tucker closed the Public
Hearing.
Mr. Wood said in regard to Mr.
Stewart's remark about Mr. Garrison,
Bill Garrison asked for duplex and
fourplex zoning in the middle of a
residential area.
Chairman Tucker said they are asking
for this duplex zoning to serve as a
buffer between the railroad and the
single family.

seconded by Mr. Wood and the motion

to see offices all along Precinct Line
Road. Mr. Nelson said it will be a
major thoroughfare and felt it would
be ideal for office zoning.

Mr. Wood asked how much land was there

Mr. Long said he did not have that
information.
Mr. Wood asked if they could have
opened the cul de sac and made it

Mr. Long said they felt they needed to
limit the streets onto Precinct Line
Road and feel a small office would be
better.
Mr. Wood asked why they did not put

Mr. Long said they would have to back
out onto the street and they were
concerned with the traffic in that
area.
Chairman Tucker asked what size office
they could put on these corners.
Mr. Long said after taking the parking
and landscaping off, not very large.
Jess Nelson, 8013 Precinct Line Road,
came forward. He said he would like
to see offices all along Precinct Line
Road. Mr. Nelson said it will be a
major thoroughfare and felt it would
be ideal for office zoning.

your review. As the tabulation indicates, bids were received from five (5)
contractors.
The low bid submitted was from APAC - TEXAS, INC., P.O. Box 1807, Fort Worth,'
Texas 76101, in the amount of $496,996.70, for a period of 250 calendar days.
T.he engineer's estimate was $528,000. The second low bid was submitted by
Austin Road in the amount of $509,563.36, (a difference of $12,566.66)", for a .
period of 265 calendar days.
The low bidder, APAC - TEXAS, has worked extensively throughout the Metroplex,
and we are not aware of any engineering considerations sufficient to preclude
award of the project to this Contractor.
Therefore, on the basis of the bids submitted, we would recommend that this
contract be awarded to APAC .- TEXAS, INC. in the amount of $496,996.70 for a
period of 250 calendar days.
We will be present at the October 8 Council Meeting to answer any questions
you may have concerning this project.

GENERAL CONDITIONS
PROPOSAL REQUIREMENTS AND CONDITIONS
In submitting his bid, the proposer understands and agrees 'to be bound by the
following terms and conditions:
WITHDRAWING PROPOSALS
Proposals deposited with the City of North Richland Hills cannot
be withdrawn prior to the time set for opening proposals. Request for
nonconsideration of proposals must be made in writing to the Purchasing Agent
and received by the City of North Rich1and Hills prior to the time set for
opening proposals. After other proposals are opened and publicly read,
the proposal for which nonconsideration is properly requested may be returned
unopened. The proposal may not be withdrawn after the bids have been opened,
and the bidder, in submitting the same, warrants and guarantees that his
bid has been carefully reviewed and checked and that it is in all things
true and accurate and free of mistakes and that such bid will not and cannot
be withdrawn because of any mistake committed by the bidder,.
2. CONSIDERATION OF PROPOSALS
After proposals are opened and publicly read aloud, the proposals
will be tabulated for comparison on the basis of the bid prices and quantities
shown in the proposal. Until final award of the contract, the City of North
Richland Hills reserves the right to reject any or all proposals, to waive
technicalities, and to readvertise for new proposals, or proceed to do the
work otherwise in the best interests of the City of North Richland Hills.
3. IRREGULAR PROPOSALS
Proposals will be considered irregular if they show any omissions,
alterations of form. additions, or conditions not called for, unauthorized
alternate bids, or irregularities of any kind. However, the City of North
Richland Hills reserves the right to waive any irregularities and to make
the award in the best interests of the 'City of North Richland Hills.
4. REJECTION OF PROPOSALS
The City of North Richland Hills reserves the right to reject any
or all proposals. and all proposals submitted are subject to this reservation.
Proposals may be rejected, among other reasons. for any of the following
specific reasons:
(a) Proposal received after the time limit for receiving proposals as
stated in the advertisement.
(b) Proposal containing any irregularities.
(c) Unbalanced value of any items.
(d) Where the bidder, any sub-contractor or supplier, is in litigation
with the City of North Richland Hills, or where such litigation is
contemplated or imminent, in the sole opinion of said City.

DISQUALIFICATION OF BIDDERS
Bidders may be disqualified and their proposals not considered,
among other reasons, for any of the following specific reasons:
(a) Reason for believing collusion exists among the bidders.
(b) Reasonable grounds for believing that any bidder is interested in
more than one proposal for the work contemplated.
(c) Where the bidder, any sub-contractor or supplier, is in litigation
with the City of North Richland Hills, or where such litigation is
contemplated or imminent, in the sole opinion of said City.
(d) The bidder being in arrears on any existing contract or having
defaulted on a previous contract.
(e) Lack of competency as revealed by a financial statement, experience
and equipment, questionnaires, etc.
(f) Uncompleted work which in the judgment of the City of North Richland
Hills will prevent or hinder the prompt completion of additional work
if awarded.
6 . AWARD OF CONTRACT
Award of contract, if it be awarded, will be made by the City of
North Richland Hills to the lowest responsible bidder meeting the
requirements of the City of North Richland Hills, and will be made within
sixty (60) days after the opening of the proposal, but not before said
City's next monthly meeting. No award will be made until after investigations
are made as to the responsibilities of the low bidder,s.
7 . ASSIGNMENT
The successful bidder may not assign his rights and duties under
an award without the written consent of the City of North Richland Hills
City Mariager~ Such consent shall not relieve the assignor of liability
in the event of default by his assi~ee.
8. NOTICE OF DELAYS
Whenever the vendor encounters any difficulty which is delaying
or threatens to delay ~imely performance (including actual or potential
labor disputes), the vendor shall immediately give notice thereof in
writing to the Purchasing Agent, stating ail relevant information with
respect thereto. Such notice shall not in any way constitute a basis for
an extension of the delivery or performance schedule or be construed as a
waiver by the City of North Richland Hills of any rights or remedies to which
it is entitled by law or pursuant to provisions herein. Failure to give
such notice, however, may be grounds for denial of any request for an
extension of the delivery or performance schedule because of such delay.
9. BRAND NAME OR EQUAL
(This clause is applicable only when a "brand name or equal" purchase
description is included in an invitation for bids. As used in this clause,
the term "brand name" includes identification of products by make and model.)

1984
1. Vehicles other than new models 1985 will not be considered as responsive
to the specifications. It is the intention of the City of North Richland
Hills,to purchase based on the specifications, a standard production model.'
In addition to the equipment set out in the'specifications, the units shall
include all equipment set out in the manufacturer's literature as standard
equipment. They shall include all exterior moldings, name plates, medallions,
series identifications, and chrome of every description that is usual for
standard stock modèls of this series.
2. The specifications are intended to govern, in general, the size and type of

specifications may be acceptable provided such variation, in each instance,
is noted on the bid. The City of North Richland Hills reserves the right
to evaluate variations from the specifications and its judgment in such
matters shall be conclusive.
3. The units shall be completely assembled, lubricated, adjusted, with all
equipment including standard and extra equipment installed, and the units
made ready for continuous operation with a minimum of ten (10) gallons of fuel.
4. The bidder shall attach hereto, as part of this bid, regularly printed
literature published by the factory, which sets forth and describes the'
vehicles he proposes to furnish.
5. The successful bidder shall furnish a manufacturer's Certificate of Origin
and Parts Manual with delivery of each unit.
6. For bids on more than one unit of equipment, the City of North Richland Hills
reserves the right to make multiple purchases from more than one bidder if
it deems such action to be in its best interest.
7. All equipment covered by this bid shall be delivered from point of assembly
to the City of North Richland Hills area by railway freight 'or conveyed by
truck. Equipment shall not be driven or "towed in whole or part. Each
invoice request for payment shall be accompanied by an affidavit in which
shall be set out that the equipment covered by this invoice has not been driven
or towed in whole or part from point of manufacturer to the City of North
Richland Hills area. Vehicles may be driven from dealer's service center to
the City of North Richland Hills provided the distance from the service center
to the City does not exceed fifty (50) miles.

To provide additional eligibility clarification and assure a uniform appli-
cation, the warranty policy established for vehicles placed in law enforce-
ment service applies only to:

The following policy should be used by all field personnel authorizing
warranty adjustments on vehicles placed in law enforcement service complyin~

In submitting his bid, the proposer understands and agrees to be bound by the
following terms and conditions:
1. WITHDRAWING PROPOSALS
After proposals are opened and publicly read aloud, the proposals
will be tabulated for comparison on the basis of the bid prices and quantities
shown in the proposal. Until final award of the contract, the City of North
Richland Hills reserves the right to reject any or all proposals, to waive
technicalities, and to readvertise for new proposals, or proceed to do the
work otherwise in the best interests of the City of North Richland Hills.
. 3. IRREGULAR PROPOSALS
Proposals will be considered irregular if they show any omissions,
alterations of 'form, additions, or conditions not called for, unauthorized
alternate bids, or irregularities of any kind. However, the City of North
Richland Hills reserves the right to waive any irregularities and to make
the award in the best interests of the 'City of North Richland Hills.
4. REJECTION OF PROPOSALS
The City of North Rich1and Hills reserves the right to reject any
or all proposals, and all proposals submitted are subject to this reservation.
Proposals may be rejected, among other reasons. for any of the following
specific reasons:
(a) Proposal received after the time limit for receiving proposals as
stated in the advertisement.
(b) Proposal containing any irregularities.
(c) Unbalanced value of any items.
(d) ~~ere the bidder, any sub-contractor or supplier, is in litigation
with the City of North Richland Hills, or where such litigation is
contemplated or imminent, in the sole opinion of said City.

5. DISQUALIFICATION OF BIDDERS
Bidders may be disqualified and their proposals not considered,
among other' reasons, for any of the following specific reasons:
(a) Reason for believing collusion exists among the bidders.
(b) Reasonable grounds for believing that any bidder is interested in
more than one proposal for the work contemplated.
(c) Where the bidder. any sub-contractor or supplier, is in litigation
with the City of North Richland Hills, or where such litigation is
contemplated or imminent, in the sole opinion of said City.
(d) The bidder being in arrears on any existing contract or having
defaulted on a previous contract.
(e) Lack of competency as revealed by a financial statement, experience
and equipment, questionnaires, etc.
(f) Uncompleted work which in the judgment of the City of North Richland
Hills will prevent or hinder the prompt completion of additional work
if awarded.
6 . AWARD OF CONTRACT
Award of contract, if it be awarded, will be made by the City of
North Richland Hills to the lowest responsible bidder meeting the
requirements of the City of North Richland Hills, and will be made within
sixty (60) days after the opening of the proposal, but not before said
City's next monthly meeting. (No award will be made until after investigations
are. made as to the responsibilities of the low bidders.
7. ASSIGNMENT
The successful bidder may not assign his rights and duties under
an award without the written consent of the City of North Richland Hills
City Manager! Such consent shall not relieve the assignor of liability
in the event of default by his assignee.
8. NOTICE OF DELAYS
Whenever the vendor en'counters any difficulty which is delaying
or threatens to delay timely performance (including actual or potential
labor disputes), the venàor shall immediately give notice thereof in
writing to the Purchasing Agent, stating all relevant information with
respect thereto. Such notice shall not in any way constitute a basis for
an extension of the delivery or performance schedule or be construed as a
waiver by the City of North Richland Hills of any rights or remedies to which
it is entitled by law or pursuant to provisions herein. Failure to give
such notice, however, may be grounds for denial of any request for an
extension of the delivery or performance schedule because of such delay.
9. BRAND NAME OR EQUAL
(This clause is applicable only when a "brand name or equal" purchase
description is included in an invitation for bids. As used in this clause,
the term "brand name" includes identification of products by make and model.)

DEFINITION OF EMPLOYEE:
SECTION 3. The word Employee or Employees, as used In this bond, shall be deemed to mean, respectively, one or more of the
natural persons (except directors or trustees of the Obligee, if a corporation, who are not also officers or employees thereof in
some other capacity) while in the regular service of the Obligee in the ordinary course of the Obligee's business during the term
of this bond, and whom the Obligee compensates by salary, or wages and has the right to govern and direct in the performance of
such service. and who are engaged in such service within any of the States of the United States of America, or within the District
of Columbia, Puerto Rico, the Virgin Islands, or elsewhere for a limited period, but not to mean brokers, factors, commission
merchants, consignees, contractors, or other agents or representatives of the same general character.
FRAUDULENT OR DISHONEST ACT:
SECTION 4. A fraudulent or dishonest act of an Employee of the ObÍlgee shall mean an act which is punishable under the
Criminal Code in the jurisdiction within which act occurred, for which said Employee is tried and convicted by a court of proper
jurisdiction.
SECTION 5. If any natural persons shall be taken into the regular service of the Obligee through merger or consolidation with
some other concern, the Obligee shall give the Surety written notice thereof and shall pay an additional premium on any increase
in the number of Employees covered under this bond as a result of such merger or consolidation computed pro rata from the date
of such merger or consolidation to the end of the current premium period.
NON-ACCUMULATION OF LIABILITY:
SECTION 6. Regardless of the number of years this bond shall continue In force and the number of premiums which shall be
payable or paid, the liability of the Surety under this bond shaH not be cumulative in amounts from year to year or from period to
period.

GENERAL CONDITIONS
PROPOSAL REQUIREMENTS AND CONDITIONS
In submitting his bid, the proposer understands and agrees to be bound by the
following terms and conditions:
1. WITHDRAWING PROPOSALS
Proposals deposited with the City of North Richland Hills cannot
be withdrawn prior to the time set for opening proposals. Request for
nonconsideration of proposals must be made in writing to the Purchasing Agent
and received by the City of North Richland Hills prior to the time set for
opening proposals. After other proposals are opened and publicly read,
the proposal for which nonconsideration is properly requested may be returned
unopened. The proposal may not be withdrawn after the bids have been opened,
and the bidder, in submitting the same, warrants and guarantees that his
bid has been carefully reviewed and checked and that it is in all things
true and accurate and free of mistakes and that such bid will not and cannot
be withdrawn because of any mistake committed by the bidder.
2.
CONSIDERATION OF PROPOSALS
After proposals are opened and publicly read aloud, the proposals
will be tabulated for comparison on the basis of the bid prices and quantities
sh-own- in. thé-·propo·sal-.----tintil- final award of the contract, the City of North
Richland Hills reserves the right to reject any or all proposals, to waive
technicalities, and to readvertise for new proposals, or proceed to do the
work otherwise in the best interests of the City of North Richland Hills.
3.
IRREGULAR PROPOSALS
Proposals will be considered irregular if they show any omissions,
alterations of form, additions, or conditions not called for, unauthorized
alternate bids, or irregularities of any kind. However, the City of North
Richland Hills reserves the right to waive any irregularities and to make
the award in the best interests of the 'City of North Richland Hills.
4.
REJECTION OF PROPOSALS
The City of North Richland Hills reserves the right to reject any
or all proposals, and all proposals submitted are subject to this reservation.
Proposals may be rejected, among other reasons, for any of the following
specific reasons:
(a) Proposal received after the time limit for receiving proposals as
stated in the advertisement.
(b) Proposal containing any irregularities.
(c) Unbalanced value of any items.
(d) 'Where the bidder, any ,sub-contractor or supplier, is in litigation
with the City of North Richland Hills, or where such litigation is
contemplated or imminent, in the sole opinion of said City.

Bidders may be disqualified and their proposals not considered,
among other reasons, for any of the following specific reasons:
(a) Reason for believing collusion exists among the bidders.
(b) Reasonable grounds for believing that any bidder is interested in
more than one proposal for the work contemplated.
(c) Where the bidder, any sub-contractor or supplier, is in litigation
with the City of North Richland Hills, or where such litigation is
contemplated or imminent, in the sole opinion of said City.
(d) The bidder being in arrears on any existing contract or having
defaulted on a previous contract.
(e) Lack of competency as revealed by a financial statement, experience
and equipment, questionnaires, etc.
(f) Uncompleted work which in the judgment of the City of North Richland
Hills will prevent or hinder the prompt completion of additional work
if awarded.
6.
AWARD OF CONTRACT
Award of contract, if it be awarded, will be made by the City of
North Richland Hills to the lowest responsible bidder meeting the
requirements of the City of North Richland Hills, and will be made within
sixty (60) days after the opening of the proposal, but not before said
City's next monthly meeting. No award will be made until after investigations
are made as to the responsibilities of the low bidders.
7.
ASSIGNMENT
The successful bidder may not assign his rights and duties under
an award without the written consent of the City of North Richland Hills
City Mañager! Such consent shall not relieve the assignor of liability
in the event of default by his assignee.
8.
NOTICE OF DELAYS
Whenever the vendor encounters any difficulty which is delaying
or threatens to delay timely performance (including actual or potential
labor disputes), the vendor shall immediately give notice thereof in
writing to the Purchasing Agent, stating all relevant information with
respect thereto. Such notice shall not in any way constitute a basis for
an extension of the delivery or performance schedule or be construed as a
waiver by the City of North Richland Hills of any rights or remedies to which
it is entitled by law or pursuant to provisions herein. Failure to give
such notice, however, may be grounds for denial of any request for an
extension of the delivery or performance schedule because of such delay.
9.
BRAND NAME OR EQUAL
(This clause is applicable only when a "brand name or equal" purchase
description is included in an invitation for bids. As used in this clause,
the term "brand name" includes identification of products by make and model.)

GENERAL CONDITIONS
.
MISCELLANEOUS PURCHASE
1. Delivery shall be to the location identified on the purchase order within
the City of North Richland Hills.
2. The contract will be awarded to the lowest bidder meeting specifications at
the price bid.
3. In the event of partial shipments or multiple deliveries, the quantities
shown on the bid are estimated quantities only. The City of North
Richland Hills reserves the right to purchase more than or less than the
quantities shown. In any event, the unit bid prices shall govern.
4. Bidder warrants that all deliveries made under the contract will be of the
type and quality specified; and the City of North Richland Hills
Purchasing Agent may reject and/or refuse any delivery which falls below
the quality specified in the specifications. The City of North Richland
Hills shall not be held to have accepted any delivery until after an
inspection of same has been made and an opportunity to exercise its right
of rejection has been afforded.
5. All manufacturers' warranties shall inure to the benefit of the City of
.North.Richland Hills, and replacement of-defective materials shall be made
promptly upon request. ·
6. Failure by the contractor to make reasonable delivery as and when requested
shall entitle the Purchasing Agent to acquire quantities from alterna;e
sources wherever available, with the right to seek reimbursement from the
contractor for amounts, if any, paid by the City of North Richland Hills
over and above the bid price.
7. All materials delivered shall be free of any and all liens and shall upon
acceptance thereof become the property of the City of North Richland Hills
free and clear of any materialman" -s, supplier's, or other type liens.
8. Regardle~s of the award of a contract hereunder, the City of North Richland
Hills retains the right to purchase the same or similar materials or items
from other sources should it be determined that doing so would be in the
City's best interest, based on cost and quality considerations; however, in
such event, the contractor will be given the first option of meeting or
rejecting the proposed alternate source's lower price or higher quality.
9. Acceptance.by the City of North Richland Hills of any delivery shall not
relieve the contractor of any guarantee or warranty, express or implied,
nor shall it be considered an acceptance of material not in accordance with
the specifications thereby waiving the City's right to request replacement
of defective material.

FOG SEAL SPECIFICATIONS
I.
A. All work shall meet or exceed Texas Highway Department specifications
11300 .
B. Mixture shall be 30% Riffe Petroleum MS-2 with 70% water.
c. Mixture shall be applied at a rate of 0.15 gallons per square
yard of surface.
D. Streets shall be vacuum swept clean of dirt, trash and debris prior
to application emulsion.
E. Vendor shall insure that the full width of the street will be covered
and curbs/gutters, drain pans at intersections shall not be discolored
or stained with emulsion.
F. Drying time shall be a minimum of two (2) hours or until vehicular
traffic can pass without tracking and/or sticking which ever shall
be longer.
G. Vendor shall insure that all streets are open on or before 5:00 P.M.
each day and no work is to be performed on Saturday and Sunday.
H. Vendor shall not apply rock and/or sand except with the expressed
permission of the Director of Public Works.

GENERAL CONDITIONS
PROPOSAL REQUIREMENTS AND CONDITIONS
In submitting his bid, the proposer understands and agrees to be bound by the
following terms and conditions:
1.
WITHDRAWING PROPOSALS
Proposals deposited with the City of North Richland Hills cannot
be withdrawn prior to the time set for opening proposals. Request for
nonconsideration of proposals must be made in writing to the Purchasing Agent
and received by the City of North Richland Hills prior to the time set for
opening proposals. After other proposals are opened and publicly read,
the proposal for which nonconsideration is properly requested may be returned
unopened. The proposal may not be withdrawn after the bids have been opened,
and the bidder, in submitting the same, warrants and guarantees that his
bid has been carefully reviewed and checked and that it is in all things
true and accurate and free of mistakes and that such bid will not and cannot
be withdrawn because of any mistake committed by the bidder.
2.
CONSIDERATION OF PROPOSALS
After proposals are opened and publicly read aloud, the proposals
will be tabulated for comparison on the basis of the bid prices and quantities
shown in the proposal. Until final award of the contract, the City of North
Richland Hills reserves the right to reject any or all proposals, to waive
technicalities, and to readvertise for new proposals, or proceed to do the
work otherwise in the best interests of the City of North Richland Hills.
3. IRREGULAR PROPOSALS
Proposals will be considered irregular if they show any omissions,
alterations of form, additions, or conditions not called for, unauthorized
alternate bids, or irregularities of any kind. However, the City of North
Richland Hills reserves the right to waive any irregularities and to make
the award in the best interests of the City of North Richland Hills.
4. REJECTION OF PROPOSALS
The City of North Richland Hills reserves the right to reject any
or all proposals, and all proposals submitted are subject to this reservation.
Proposals may be rejected, among other reasons. for any of the following
specific reasons:

(c) Where the bidder, any sub-contractor or supplier, is in litigation
with the City of North Richland Hills, or where such litigation is
contemplated or imminent, in the sole opinion of said City.
(d) The bidder being in arrears on any existing contract or having
defaulted on a previous contract.
(e) Lack of competency as revealed by a financial statement, experience
and equipment, questionnaires, etc.
(f) Uncompleted work which in the judgment of the City of North Richland
Hills will prevent or hinder the prompt completion of additional work
if awarded.
6.
AWARD OF CONTRACT
Award of contract, if it be awarded, will be made by the City of
North Richland Hills to the lowest responsible bidder meeting the
requirements of the City of North Richland Hills, and will be made within
sixty (60) days after the opening of the proposal, but not before said
City's next monthly meeting. No award will be made until after investigations
are made as to the responsibilities of the low bidders.
ASSIGNMENT
The successful bidder may not assign his rights and duties under
an award without the written consent of the City of North Richland Hills
City Mariager. Such consent shall not relieve the assignor of liability
in the event of default by his assignee.
8.
NOTICE OF DELAYS
Whenever the vendor encounters any difficulty which is delaying
or threatens to delay timely performance (including actual or potential
labor disputes), the vendor shall immediately give notice thereof in
writing to the Purchasing Agent, stating all relevant information with
respect thereto. Such notice shall not in any way constitute a basis for
an extension of the delivery or performance schedule or be construed as a
waiver by the City of North Richland Hills of any rights or remedies to which
it is entitled by law or pursuant to provisions herein. Failure to give
such notice, however, may be grounds for denial of any request for an
extension of the delivery or performance schedule because of such delay.
BRAND NAME OR EQUAL
(This clause is applicable only when a "brand name or equal" purchase
description is included in an invitation for bids. As used in this clause,
the term "brand name" includes identification of products by make and model.)

Proposal for Street Sweeping
I.
A. The City of North Richland Hills is accepting proposals for the
cleaning of the City streets.
B. Vendor submitting the most advantageous proposal to the City of
North Richland Hills shall be responsible for the proper cleaning
of all streets within the City of North Richland Hills present
and any additional subdivisions that may be added within the
contract year.
C. The only street within the City limits that will require center
median cleaning shall be Rufe Snow from Fair Meadows to Loop
820.
D. It shall be the responsibility of the vendor to inspect the City,
as to type, size and condition of all streets. (City map attached)
II.
A. The City of North Richland Hills reserves the right to add or delete
any portion of the City as necessary.
B. Failure by the contractor to make reasonable progress as and when
requested shall entitle the Purchasing Agent to acquire service
from alternate sources, with the right to seek reimbursement from
the contractor for amounts, if any, paid by the City of North
Richland Hills over and above the bid price.
C. Reguardless of the award of a contract hereunder, the City of North
Richland Hills retains the right to purchase the same or similar
services or work from other sources should it be determined that
doing so would be in the City of North.Richland Hills best interest,
based on cost and quality considerations; however in such event,
the contractor will be given the first option of meeting or
rejecting the proposed alternate source's lower price or higher
quality.
D. The City of North Richland Hills will have available at no charge
to the vendor storage space for approximatley three (3) sweepers.
E. Item "D" will be allowed so long as said sweepers are used solely
for the cleaning of the City streets of North Richland Hills.
F. The contract will be awarded at the price bid for a period of
approximatley one (1) year.
G. The quality and workmanship shall be the sole responsibility of
the vendor. The Director of Public ~10rks or His designate shall
have the right of final inspection, and their decision shall be
final.

Cleaning; "Definition", The definition of cleaning for this
contract shall be: Curb side shall be free of dirt, mud, cans,
bottles, small rocks, paper, animal waste,grass, leaves, broken

Consideration of City Participation at Hightower Drive

The developers of Century Oaks is proposing to build Hightower Drive from

where it ends in Briarwood Estates at the present time out to Smithfield Road.
Hightower Drive is proposed to be wider than a residential street so according to the
I
Subdivision Ordinance the City would have participation in this street.
I
However, there are several problems involved in buildin~ this street at this
time. The main problem being there are some people who own a home south of Century
I
Oaks and we may have to condemn a 30 foot by 300 foot strip off of their lot. The
other problem being the City's cost for participation in this street would be
I
approximately $95,000. This would cover the cost of approximately 1400 linear feet
of the street. There are several things for you as the Council to approve:

I. If it becomes necessary, would you approve condemnation of the Parker property.
2. Approve the appropriation of the $95,000 from Reserve Funds for this project.
II Since this is part of our thoroughfare plan, the staff recommends that you
approve the participation in this project. The Subdivision Ordinance requires
II
that the developer has the responsibility to obtain the right of way from the
I
abutting property owners to his development. However, if he is unable to obtain
the right of way from that property owner, then the City will assist him by
II condemning the property. The responsibility for paying for the condemnation is
II
still at the expense of the developer. If you do not approve this project, the
developer has asked to be relieved from the responsibility of obtaining this right
II
of way and he is asking to be allowed to build a street as it is shown on the
enclosed plans. The street narrows down to a width of 20 feet at some locations
I if it is built according to the plans. Also if you will look on the map where I
have marked Mr. Peskind's property concerning the signalization on Rufe Snow, you

will find in red the location of this project.

BACKGROUND: I have enclosed a map showing Mr. Peskind '8 s.ite that he is proposing
to develop. This site is immediately south of the outlet mall and north of
Loop 820 on the west side of Rufe Snow. According to Mr. Peskind's traffic en ineer
signalizing and channelizing at the location that he is would hel the traffic
at Loop 820 and Lewis Drive since the proposal would include t in all three
si~alstogether·so-thatthe traffic can flow more freelv between the si n Is.
This signalization would also line up with the drivewa of McDonalds where t
is quite a bit Qf congestion at this time.
I would recommend approval of this plan subject to Richard Albin's a?proval.
I would also recommend that if you do aperove this plan, that YOU approv~ it

the traffic conditions along Rufe Snow Road are really heavy.
We have had several meetings with Gene Riddle, Director of Public
Works, and have proposed to him that certain street improvements,
and traffic light signalization be done along Rufe Snow Road, in
accordance with the recommendations of our Consultants, Carter &
Burgess, Inc., and Lea, Elliott, McGean & Company. A copy of
their recommendations has been furnished to Mr. Riddle and addi-
tional copies of same will be delivered to him shortly.
The purpose of this letter is to respectfully request that the City
Council docket for October 8, 1984, include an item requesting
that the City Council take action on the above mentioned recommen-
dations.
