Dear Citizen,
I
We need your help and involvement in planning a special North Richland
Hills Celebration - "Jubilee 33".
I
In 1985-86, the State of Texas will be celebrating its sesquicentennial
(150th birthday) and North Richland Hills will become one-third of a century,
or 33 years old. We are a young community, but now is the time to preserve
and record our heritage, celebrate our present, and plan for our future.
I
"Jubilee 33" will begin on the City's anniversary, June 23, 1985, and
continue through July 4, 1986.
I
There is much to be done during the year-long celebration: we will
be hosting the 25-mile-Iong Texas Wagon Train; putting on. a historic pageant;
planting commemorative gardens; writing histories, preserving photographs;
holding parades, presenting old-fashioned style shows, concerts, fireworks,
and patriotic celebrations. Everyone in North Richland Hills can and should
be involved!

We encourage you to attend the TOWN HALL MEETING to plan "Jubilee 33"
in the CITY COUNCIL CHAMBERS, MONDAY, FEBRUARY 4, 1985, at 7:30 p.m. to see
how you, your family, your club, your church, your school and your business

Aubrey Brothers Development
Gentlemen:
I represent Aubrey Brothers, the developer of Flamingo Estates
Addition to the City of North Richland Hills, Texas.
The final plat of Flamingo Estates Addition Section II was
presented to and approved by the City Council, sitting as the
City Planning Commission of the City of North Richland Hills, on
the 25th day of June, 1984.
Such plat was filed of record with the County Clerk of Tarrant
County, Texas on the 28th day of September, 1984 and recorded in
Volume 388-178, Page 12, Plat Records of Tarrant County, Texas.
The statutory authority providing for the approval of such
plats by a City Plan Commission or a City Council sitting as a
City Planning Commission, is contained in Section 3 of Article
974a, V.T.C.S., as amended.
Indorsement of approval of a plat by a Planning Commission or
City Council is contained in Section 4 of Article 974a and is
couched in mandatory terms reading as follows:

streets, alleys, parks, playgrounds and public utility
facilities, including those which have been or may be
laid out, and to the general plan for the extension of
such city and of its roads, streets and public highways
within said city and within five miles of the corporate
limits thereof, regard being had for access to and ex-
tension of sewer and water mains and the instrumentalities
of public utilities, and if same shall conform to such
general rules and regulations, if any, governing plats
and subdivisions of land falling ~ithin its jurisdiction
as the governing body of such city may adopt and promulgate
to promote the health, safety, morals or general welfare
of the community, and the safe, orderly and healthful
development of said community (which general rules and
regulations for said purposes such cities are hereby
authorized to adopt and promulgate after public hearing
held thereon), then it shall be the duty of said City
Planning Commission or of the governing body of such
city, as the case may be, to endorse approval upon the
plan, plat or replat submitted to it." (Emphasis supplied)
No provision is contained in Artile 974a authorizing or re-
quiring a developer or subdivider to dedicate or donate any property
other than that which the developer or subdivider owns.
In 1983 my client, Aubrey Brothers Development and Building,
Inc., purchased 6.349 acres of land and the deed is recorded in
Volume 7560, Page 03 of the Deed Records of Tarrant County, Texas.
Pursuant to the provisions of Article 974a, V.T.C.S., Aubrey
Brothers caused to be prepared through his Engineers, Teague, Nall
and Perkins, a plat subdividing the property into lots and blocks
for the construction of single-family residences. Out of the
6.349 acres of land owned by Aubrey Brothers and along the northerly
boundary thereof, Aubrey Brothers, in accordance with the require-
ments of the City of North Richland Hills dedicated to the public
thirty (30) feet of right-of-way for the location of one-half of
the "future Rumfield Rd."
After the approval of the plat by the City Planning Commission
and the City Council on June 25, 1984, and after the filing of the
plat and recordation of the plat with the County Clerk on September
28, 1984, it was discovered that there were certain errors and
omissions in courses or distances shown on such plat already filed
of record.

Aubrey Brothers then caused to be prepared by his engineers
an amending plat correcting such discrepancies in courses and
distances and caused same to be presented for approval by the City
Council, sitting as a Planning Commission, on November 26, 1984.
These corrections were prepared consistent with the provisions of
Section 5(d) of Article 974a, V.T.C.S., as amended by the Legis-
lature effective August 29, 1983, authorizing corrections of such
nature without notice, hearing or approval of other lot owners.
After considering such amending plat, which merely contained
corrections in courses and distances of the final plat already
filed and recorded by the County Clerk, approval was granted by the
City Council "subject to" the arbitrary and unauthorized requirement
that Aubrey Brothers attempt to obtain, purchase and acquire an
additional thirty (30) feet from each of the adjoining landowners
along his northerly boundary, to-wit: Royal W. Sherbet and James
Pierson, so that the entire sixty (60) feet of right-of-way for
"future Rumfield Rd." would be available to the City of North
Richland Hills.
Such arbitrary, capricious and unauthorized requirement of the
subdivider and developer has no basis in law. We know of no lawful
authority vested in the City Council of the City of North Richland
Hills under the Constitution and laws of the State of Texas which
authorizes or permits a City to require a landowner to dedicate
property other than that which he owns.
Article 974a, the platting statute, limits its regulatory
authority to the:
"owner of any tract of land" * * * "who may
thereafter divide the same in two or more parts
for the purpose of laying out any subdivision of
any tract of land or any addition to any town or
city."
The action of the City Council in approving Aubrey Brothers'
amending plat "subject to" his obtaining lands that he does not
own himself from adjacent and abutting property owners was thoro-
ughly outside of the scope, power and authority of the City Council
of the City of North Richland Hills as provided for in Article 974a,
V.T.C.S. and is a violation of Article I, Section 17 of the Consti-
tution of the State of Texas.
As counsel for Aubrey Brothers, we respectfully request that
the City Council rescind its action of November 26, 1984 and
approve the amending plat, which merely corrected courses and

distances as authorized by the statute, so that same may be filed
with the County Clerk of Tarrant County, Texas.
It is my understanding that prior to having taken the action
of which we complain, no inquiry was made as to the legality of
such action of your very capable City Attorney, Rex McEntire.
Mr. McEntire is thoroughly familiar with the decision of the court
in City of Corpus Christi v. Unitarian Church, 436 S.W.2d 923
(Tex.Civ.App. 1968, writ ref'd, n.r.e.) and the mandamus case of
Commissioners' Court, et al v. Frank Jester Development Co., 199
S.W.2d 1004 (Tex.Civ.App. 1947, writ ref'd, n.r.e.).
In City of Corpus Christi, supra, the Court held in part as
follows:
"If the statutes, charter provisions or ordinances
pertaining to the City of Corpus Christi do not impose upon
the Church a legal obligation to dedicate a portion of its
land for street purposes under these facts, or if such
statutes, charter provisions or ordinances do not authorize
the City to require a property owner to make such dedication,
then the issuance of a mandamus will be proper. Where the
church has done all that the statutes and law demands, the
authorized granting of a building permit becomes a mere
ministerial duty, the performance of which may be compelled
by mandamus. Thus where the City itself or by and through
its planning commission, in its construction of the law, de-
prives a citizen of an unquestionable legal right and there
is no other adequate remedy, the court having power to issue
mandamus may review the matter. Commissioners Court v.
Frank Jester Development Co., 199 S.W.2d l004 (Tex.Civ~App.-
Dallas 1947, n.r.e.)."

without litigation.

We have reviewed the referenced materials for this subdivision and offer the following
conmen ts :
1 Please see our letters dated September 2, 1984 and September 21, 1984, regarding
off-site letters, permits, prorata and escrow requirements.
2 Regarding our water line prorata comment no. 8 in our September 2, 1984, letter,
we indicated that the length upon which prorata is based ;s the Bursey Road
. frontage less the right-of-way width of the intersecting side streets. We have
been advised by the Public Works Department that the developer will be required to
pay his prorata share based on the full Bursey Road street frontage including
intersecting side streets. The full length is used since the developer would have
been required to construct a new water line the full frontage length if he had
installed the line in Bursey Road himself. Therefore, the required prorata would
be $5.50 per linear foot based on 900 feet rather than 780 feet.
3 As a general reminder, the Developer or Owner should be made aware that he is
responsible for all provisions of the Subdivision Ordinance, Zoning Ordinance,
Water and Sewer Policies and Procedures, and all other applicable City Development
Codes unless specific discretionary variances and exceptions are made and agreed
upon by the Planning and Zoning Commission and City Council, and covered in
writing in the City-Developer Agreement, if this proposed plat is approved. If no
such specific variances are provided then the Developer or Owner remains
responsible for all other Ordinance and Policy requirements as written in the
regulatory codes.

1 We would recommend that the name of this proposed subdivision be changed from the
Fair Oaks Estates to the Green Valley Estates since this development is contiguous
with Green Valley Estates. Also the lot and block number should be changed
accordingly.
2 In accordance with the Subdivision Ordinance requirements the Developer's
. Engineer should affix the following certification to the drainage plan:

of Texas, have prepared this drainage study in compliance with the
latest' published requirements and criteria of the City of North
Richland Hills, and have verified that the topographic information used
in this study is in compliance with said requirements and is otherwise
suitable for developing this workable·overall Plan of Drainage which
can be implemented through proper subsequent detailed construction
planning.

4 The developer, Kingswood North Joint Venture, presently owns contiguous property
north and east of this proposed subdivision. Paragraph 13., page 17, of the
Subdivision Ordinance requires that the developer show a preliminary layout of the
entire area if it is intended to be sUbsequently subdivided as additional units of
the same subdivision. We will assume for purposes of this review that the
contiguous property may be sold to other parties and therefore off-site easements,
letters of permission for drainage discharge, etc., should be provided to the
City, which will run with the land.

5 It appears that only a small quantity of concentrated stormwater will be
discharged from this proposed development eastward to the Kingswood North Joint
Venture property from Kim Lane, however, we would still recommend that written
permission be provided by the downstream property owner for concentrated
discharge. We would note that although most of the stormwater generated from
drainage area No. 26 will cross Kim Lane in a valley gutter, some of the runoff
from this area could turn the corner and discharge eastward on the Joint Venture
property increasing the predicted concentrated discharge on this downstream
property. Some off-site grading at Kim Lane may be required to accomodate this
runoff. The same is true at the north end of this development at Continental
Trail and permission for concentrated runoff discharge at this point would also be
required. Additionally, an easement for construction of the off-site 72-inch
storm drain north of this development should be provided.
6 The water distribution system master plan calls for a future ease-west 12-inch
line to be located in this vicinity. We would recommend that the proposed a-inch
line in Continental Trail be upsized to a 12-inch as a segment of this east-west
grid. City participation in oversizing above an a-inch line would be in order.
The developer should be required to pay his pro-rata share of the existing
16-inch water line in Bursey Road. We would recommend pro-rata at $5.50 per
linear foot for one-half of an equivalent a-inch line for a total length of
approximately 780 feet. Note that this distance represents this subdivision
frontage along Bursey Road less the dedicated right-of-way widths of Hunter,
. Kendra, and Kandy Lanes.
a Written permission should be obtained from TRA for IIPoint of Servicell connection
to the off-site 24-inch little Bear Outfall Sanitary Sewer. Also, an off-site
easement should be provided for the proposed a-inch sanitary sewer connection to
the Little Bear line.
9 The owner should be required to escrow his prorata share of future street
improvements on Bursey Road or construct any required paving improvements along
the frontage of his property at this time.

wishing to speak in favor of the request to please come
forward.
Mr. J.D. Scott, 7501 Grapevine Highway, appeared before the
Council.
Mr. Scott stated he would like for his request to be postponed
because the attorney representing him had a confl~ct tonight.
Councilman Kenna moved, seconded by Councilman Newman, to
postpone action on PZ 84-60 until the first meeting in
December.

Chairman Tucker opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
Bill Warren, Attorney, came forward to
represent Scott and Burton. He said
they were automotive air condition
specialists having a total of 40 to 50
years experience. Mr. Warren said
they do business allover the
metroplex and out of state.
Mr. Warren said he usually starts by
telling the history of the property,
but this property has no history; it
has always been pasture land. He
showed pictures of the area. Mr.
Warren stated the property is by the
railroad and north of the railroad is
high Industrial zoning with a cabinet
shop, welding shop, and the storage of
some old tanks. He said Bates
Container on Davis Boulevard is not
far from this property. Mr. Warren
said they feel it is totally unsuited
for residential; they would not be
able to get financing close to the
railroad.
Mr. Warren said the place is an eye
sore now with an old house on the
property and another one to the west.
Mr. Brents asked why there were no
pictures made of the area south of
this property.
Mr. Warren said there were no homes
there. He said there was one
southeast of the property on the south
side of Main Street.
Mr. Brents said he knew there were
about four nice homes there on the
south side of Main Street.

Mr. Warren said his client plans to
build an automotive air conditioning
shop there with six bays and an
office. He said they would repair
auto airconditioners within the shop.
Mr. Warren said they have equipment
which makes no noise, no smoke or
fumes. He said their hours would be
7:30 to 5:30 Monday thru Friday and
7:30 to 1:00 on Saturday. Mr. Warren
said it would not be an eyesore. He
said the area should be industrial,
but they feel the best use for the
property is for commercial.
Mr. Wood asked if Mr. Warren thought
it would be good for duplexes.
Mr. Warren said he did not feel it
would be good for duplexes.
Mr. Warren requested rebuttal time.
Chairman Tucker called for those
wishing to speak in opposition to this
request to please come forward.
Gerald Stewart, 8840 Main Street, came
forward. He said they know this
property is an eyesore to the
neighborhood, but this is not th~
ideal use for this property. Mr.
Stewart said this is a "Y" shaped
piece of property with a street on
both sides and a school right down the
street. He said the Glenann Addition
has lived with the airport for many
years and feel this area should be
single family. He said he requests
they consider this very carefully.
Councilwoman Virginia Moody came
forward. She said her son goes to
Smithfield Junior High and has to go
by this property twice each day. Ms.
Moody said she felt there should be a
better location for these people to
have their business which would not be
in a residential area.

Tony Skur, 6536 Sherri Lane, came
forward. He said he was against this
zoning request. He said it would be a
drastic change in zoning which would
change the area forever. Mr. Skur
said it would bring in more traffic.
He said there are lots of little
people who walk to school in this
area. He said also there are 18
wheeler trucks that park across the
street from this area, sometimes as
many as 27. Mr. Skur said he felt
this was spot zoning and would be
taking the residential atmosphere away
for commercial.
Mr. Skur said he is not in favor of
duplexes either. He said the property
to the east is duplex and duplex
zoning would make it more congested.
Mr. Skur said he felt the property
would be good for single family. He
said it is an eyesore now and they
need to clean up the property, but
they do not need commercial. Mr. Skur
said they have about 250 people in
Glenann and they are opposed to this
zoning.

Glenn Walker, 8400 Glenann, came
forward. He said he moved away from
the hustle ·and bustle to the peace and
quiet of this area, but it looks like
it is following him.

Mr. Walker said they do not want
antifreeze running down the street
into their yards, killing their grass.

hands of the people who were in
opposition to this request. There
were several present.

never go industrial because under the
new ordinance, you have to have at

across the street with residential
homes on it and he feels it could be
used for duplexes.

In accordance with your instructions, bids were received on December 3, 1984;
for the referenced project. This project includes paving, drainage, and
utility improvements on Harwood Road from Bob Street to Grapevine Highway.
The individual bid tabulations are attached for your review. As the
tabulation indicates, bids were received from four (4) contractors.
The low bid submitted was from Austin Road Company, P.O. Box 2285, Fort
Worth, Texas 76113, in the amount of $336,825.03, for a period of 180 calendar
days. The engineer1s estimate was $370,000. The second low bid was submitted
by SRO Asphalt Company in the amount of $378,761.36, (a difference of
$41,936.33), for a period of 175 calendar days.
The low bidder, Austin Road Company, has worked extensively throughout the
Metroplex and NRH, and we are not aware of any engineering considerations
sufficient to preclude award of the project to this Contractor.
Therefore, on the basis of the bids submitted, we would recommend that thi.s
contract be awarded to Austin Road Company in the amount of $336,825.03 for a
period of 180 calendar days.
We will be present at the December 10 Council Meeting to answer any questions
you may have concerning this project.

$15,959.28), for a period of 160 calendar days.
The low bidder, Austin Road Company, has worked extensively throughout the
Metroplex and NRH, and we are not aware of any engineering considerations
sufficient to preclude award of the project to this Contractor.
Therefore, on the basis of the bids submitted, we would recommend that this
contract be awarded to Austin Road Company in the amount of $279,051.22 for a
period of 165 calendar days.

Delivery
Upon completion, the apparatus herein described will be delivered F.C.B.
(Depending on city location). Truck freight (price individually),
A factory-trained delivery technician will be provided to the purchaser for
a period not to exceed three(3) days, during which time the technician
will mount any loose equipment and train the purchaser in the operation
and maintenance of the apparatus. The purchaser will also be provided
with two(2) complete sets of "Operation Maintenance and Parts" manuals
pertaining to the apparatus.
Custom Warranty
American LaFrance conditionally warrant each new fire apparatus (except
the engine and certain other components noted below) manufactured by us
for a period of one (1) year from date of delivery. Under this warranty we
agree to furnish you any parts to replace-parts that have failed due to
defective material or workmanship where there is no indication of abuse,
neglect, unusual or other than normal service providing that such parts
are, at our option, made available for our inspection and at our request,
returned to our factory or other location designated by us (transporta-
tion charges prepaid) within thirty days after date of failure or within
one year from date of delivery of apparatus to the original purchaser
which ever occurs first and inspection indicates that failure was attri-
buted to defective material or workmanship. We further agree to furnish
you the labor to install the replacement part where failure occurs within
one year of the delivery of the apparatus, if all conditions outlined
above are met.
The warranty on engine, transmission, tires and tubes, storage batteries,
electrical lamps, and other devices subject to deterioration is limited
to the warranty of the manufacturer thereof and adjustments for same are
to be made directly with the manufacturer.
This warranty shall not apply to any fire apparatus which shall have been
repaired or altered outsiae of our factory in any way, which in our opin-
ion might affect its stability or reliability.
This warranty shall not apply to those items which are usually considered
normal maintenance and upkeep services' including but not limited to
normal lubrication or proper adjustment of main pump, aerial ladder, or
aerial device installation.
This warranty being expressly in lieu of all other warranties, expressed
or implied, and of all other obligations or liabilities on our part. We
neither assume nor authorize any other person to assume for us any lia-
bility in connection with the sale of our apparatus unless made or assumed
in writing by the Company.

DETROIT DIESEL ENGINES
USED IN AUTOMOTIVE FIRE APPARATUS
Detroit Diesel Allison (Detroit Diesel Allison, Division of General Motors Corporation) warrants to the owner that it will
repair any defective or malfunctioning parts of each new Series 53, 71 and 92 Detroit Diesel engine (referred to as engine)
used in automotive fire apparatus applications and each new generator, starting motor, voltage regulator, air compressor,
hydraulic pump and vacuum pump (referred to as optional equipment) manufactured or supplied by Detroit Diesel Allison
in accordance with the following schedule:

The warranty periods shall begin on the date the engine is delivered to the first retail purchaser or, if the engine is first placed
in service as a demonstrator prior to sale at retail, on the date the engine is first placed in such service.
This warranty covers only malfunctions resulting from defects in material or workmanship.
This warranty does not cover conditions resulting from misuse, negligence, alteration, accident or lack of performance of
normal maintenance services; any engine which shall have been repaired by other than an authorized Detroit Diesel Allison
service outlet so as in any way, in the judgment of Detroit Diesel Allison, to affect adversely its performance and rei ¡ability;
the replacement of maintenance items (such as filters, belts and air cleaners) made in connection with normal maintenance
services; loss of time, inconvenience, loss of use of the engine or other consequential damages; or labor for removal or
reinstallation of the Detroit Diesel engine found necessary in connection with the repair of a defective or malfunctioning
engine or optional equipment part.
The repair of defective engine parts qualifying under this warranty will be performed by an authorized Detroit Di~sel Allison
service outlet within a reasonable time following the delivery of the engine to the service outlet's place of business using new
parts or rebuilt parts designated reliabilt and sold by authorized Detroit Diesel Allison Distributors.
The repair of defective optional equipment qualifying under this warranty will be made by any authorized Detroit Diesel
Allison service outlet within a reasonable time following the delivery of the defective optional equipment to the service
outlet's place of business.
The owner is responsible for the performance of regular maintenance services as specified in the Driver's Handbook.
THIS WARRANTY IS THE ONLY WARRANTY APPLICABLE TO DETROIT DIESEL ENGINES AND ENGINE OPTIONAL
EQUIPMENT AND IS EXPRESSLY IN LIEU OF ANY OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY
IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND OF ANY OTHER
OBLIGATION OR LIABILITY ON THE PART OF DETROIT DIESEL ALLISON, AND DETROIT DIESEL ALLISON
NEITHER ASSUMES NOR AUTHORIZES ANY OTHER PERSON TO ASSUME FOR IT ANY OTHER LIABILITY IN
CONNECTION WITH SUCH ENGINES OR ENGINE OPTIONAL EQUIPMENT. DETROIT DIESEL ALLISON SHALL NOT

This warranty covers only malfunctions resulting from defects in material or workmanship.
This warranty does not cover:
ef Malfunctions resulting from misuse, negligence~ alterations, accident or lack of performance of normal
maintenance services;
· Any transmission which shall have been repaired by other than an authorized Detroit Diesel Allison ser-
vice outlet so as in any way, in the judgment of Detroit Diesel Allison, to affect adversely its performance
and reliability;

with normal maintenance services;

The owner is responsible for the performance of regular maintenance services as specified in the driver's

Repairs qualifying under this warranty will be performed by any Detroit Diesel Allison Distributor or his
specifically designated Service Dealer within a reasonable time.

TWlNFLOW PUMP
The American LaFrance Twinflow pump gives you the water flow
and pressure selection you want in any situation. The Twinflow is a
two-stage, parallel/series centrifugal fire pump, manufactured only
by American LaFrance. You can select a Twinflow with NFPA-
approved ratings ranging from 750 to 2,000 gpm (at 165 psi). It
will produce in excess of 70% of rated capacity at 200 psi, and at
more than 50% of rated capacity at 250 psi and has a pressure
capability to 600 psi.
Each model offers discharge connections at side, rear and turret
position with suction connections at side, front and rear.
ßecause the Twinflow is engineered and built by American
LaFrance for use only in our apparatus, we start with the finest
quality materials which are then precision machined and
assembled. All Twinflow pumps undergo two full pressure tests, after
final assembly and after installation in the vehicle. UL certification
of each pump is provided when requested.
The Twinflow is designed with more than performance in mind; it's
also easy to operate and maintain.

SAVES MANPOWER-PROTECTS HOSE MEN
Automatically throttles the engine to vary the
speed of the fire pump impellers to maintain a
constant pump pressure, from 90 PS I to 300 PSI as
preset by the operator, when the volume of water
required is changed by the nozzles on the various
hose lines being opened, closed or metered.

Disengages, allowing the engine to return to idle
speed, when the water supply becomes insufficient
to meet the demands of the discharge lines causing
pump cavitation.

This protects the hose line operators from the
severe surge in nozzle reaction, that occurs during
cavitation. It also protects the engine and pump
from possible damage by IIrunaway".
This has the further advantage of freeing the pump
operator, after placi ng the governor in operation,
for other functions.

THIS AGREEMENT, made in duplicate by and between the AMERICAN LAFRANCE
Division of FIGGIE INTERNATIONAL Inc., hereinafter called the "Company," and
by its authorized representative's, hereinafter called the "Buyer".
WITNESS: That the Company agrees to sell, only upon the terms and condi-
tions which are below written, the motor fire apparatus and appurtenances (here-
inafter referred to as the "Apparatus") as described in and to be in accordance
with the proposal attached, which is also made a part of this contract.
The Apparatus shall be delivered at within
approximately working days after the receipt and acceptance of
this contract at the Company's office at Elmira, New York. The Company shall
not be responsible for delays in delivery due to strikes, inability to obtain
cars or materials, or other causes beyond its control. This transaction shall
be 1) F.O.B destination if delivered by a Company driver or 2) F.O.B. Elmira,
New York, if delivered by any other mode or party other than a duly authorized
Company driver. The Company sharI be responsible for transportation expense and
delivery of the apparatus shall be completed in the case of one (1) above at the
above designated location, or, in the case of two (2) above when and where the
Company makes said apparatus available to the carrier for loading or shipment.
The Buyer agrees to purchase and pay for ~he aforesaid property, delivered
as aforesaid, the sum of
Dollars, ($ ) including sales tax of
Dollars, ($ ) where applicable, to be paid to the American LaFrance
Division, or its authorized agents, in the manner stated below. No payments
shall be made to agents except on presentation in writing of an express power of
attorney to accept payment. Terms of payment are cash on delivery.
The Company reserves the right to increase the above stated selling price
for the addition or change of any safety features and/or equipment that are
required by Federal and/or State laws enacted after the date of this contract.
If more than one piece of apparatus is covered by this contract and the
pieces are shipped at different dates, the above terms of payment shall apply to
each piece or shipment and an invoice covering each piece or shipment shall be
rendered in the prope.r amount.
It is agreed that the Apparatus described in this contract shall remain the
property of the Company until the entire purchase price has been paid, and any
obligation or obligations, security or securities given thereunder are actually
paid. In case of default in payment, the Company may take full possession of
the Apparatus sold by the Company to the Buyer and payments that have been made
shall be applied as rent in full for use of the apparatus up to date of taking
possession.
No agent, salesman or other party is authorized to bind the Company by any
agreement, warranty, statement, promise or understanding not herein expressed.

Inasmuch as the apparatus described in these specifications will be
subj ected to emergency service for a period estimated to be in excess of
twenty (20) years, the sales representative must certify the following:
Parts and service will be available for this apparatus for a minimum
of twenty(20) years.
The unit proposed is not a prototype unit and is of an
established model and design that has been in fire service for at
least five(5) years.
The proposed apparatus will meet or exceed all applicable require-
ments of NFPA Bulletin #1901, 1979 edition or latest in effect.

TITLE
SERVICE REQUIREMENTS
To insure the purchaser a source of service and parts over the twen-
ty(20)-year anticipated life of the apparatus, the bidder shall have estab-
lished his permanency in the industry and include with his proposal a list oÍ
company owned or affiliated service agencies.
The bidder must state the number of company employed service personnel
available upon request to provide the necessary service backup for the unit
being purchásed.
The unit shall be delivered by a factory delivery technician who is to
remain three (3) days to train Fire Department personnel and mount equipment.

PROPOSAL REQUIREMENTS AND CONDITIONS
In submitting his bid, the proposer understands and agrees to be bound by the
following terms and conditions:
1. WITHDRAWING PROPOSALS
Proposals deposited with the City of North Richland Hills cannot
be withdrawn prior to the time set for opening proposals. Request for
nonconsideration of proposals must be made in writing to the- Purchasing Agent
and received by the City of North Richland Hills prior to the time set for
opening proposals. After other proposals are opened and publicly read,
the prop~sal for which nonconsideration is properly requested may be returned
unopened: The proposal may not be withdrawn after the bids have been opened,
and the bidder, in submitting the same, warrants and guarantees that his
bid has been carefully reviewed and checked and that it is in all things'
true and accurate and' free of mistakes and that such bid will not and cannot
be withdrawn because of any mistake committed by the bidder.
2. CONSIDERATION OF PROPOSALS
After proposals are opened and publicly read aloud, the proposals
will be tabulated for comparison on the basis of the bid prices and quantities
shown in the proposal. Until final award of the contract, the City of North
Richland Hills reserves the right ~o reject any or all proposals, to yaive
technicalities, and to readvertise for new proposals, or proceed to do the
work otherwise in the best interests of the C:i:t'y of North Richland Hills.
3. IRREGULAR PROPOSALS
Proposals will be considered irregular if they show any omissions,
alterations of 'form, additions, or conditions not called for, unauthorized
alternate bids, or irregularities of any kind. However, the City of North
Richland Hills reserves the right to waive any irregularities and to make
the award in the best interests of the 'City of North Richland Hills.
4. REJECTION OF PROPOSALS
The City of North Richland Hills reserves the right to reject any
or all proposals, and all proposals submitted are subject to this reservation.

5. DISQUALIFICATION OF BIDDERS
Bidders may be disqualified and their proposals not considered,
among other reasons, for any of the following specific reasons:
(a) Reason for believing collusion exists among the bidders.
(b) Reasonable grounds for believing that any bidder is interested in
more than one proposal for the work contemplated.
(c) Where the bidder, any sub-contractor or supplier, is in litigation
with the City of North Richland Hills, or where such litigation is
contemplated or imminent, in the sole opinion of said City.
(d) The bidder being in arrears on any existing contract or having
defaulted on a previous contract.
(e) Lack of competency as revealed by a financial stat~ment, experience
and equipment, questionnaires, etc.
(f) Uncompleted work which in the judgment'of the City of North Richland
Hills will prevent or hinder the prompt completion of additional work
if àwarded.
6 . AWARD OF CONTRACT
Award of contract, if it be awarded, will be made by the City of
North Richland Hills to the lowest responsible bidder meeting the
requirements of the City qf North Richland Hills, and will be made within
sixty (60) days after the opening of- the proposal, but not before said
City's next monthly meeting. No award will be made until after investigations
are made as to the responsibilities of the low bidders.
7. ASSIGNMENT
The successful bidder may not assigñ -his rights and duties under
an award without the written consent of the City of North Richland Hills
City Mariager~ Such consent shall not relieve the assignor of liability
in the event of default by his assignee.
8. NOTICE OF DELAYS
Whenever the vendor encounters any difficulty which is delaying
or threatens to delay ~imely performance (including actual or potential
labor disputes), the vendor shall immediately give notice thereof in
writing to the Purchasing Agent, stating all relevant information with
respect thereto. Such notice shall not in any way constitute a basis for
an extension of the delivery or performance schedule or be construed as a
waiver by the City of North Richland Hills of any rights or remedies to which
it is entitled by law or pursuant to provisions herein. Failure to give
such notice, however, may be grounds for denial of any request for an
extension of the delivery or performance schedule because of such delay.
9. BRAND NAME OR EQUAL
(This clause is applicable only when a "brand name or equal" purchase
description is included in an invitation for bids. As used in this clause,
tl}e term "brand name" includes identification of products by make and model.)

EQUIPMENT BIDS
, 1.
Equipment other than new models will not be considered as responsive
to the specifications. It is the intention of the City of North Richland
Hills to purchase based on the specifications, a standard production model.
In addition to the equipment set out in the specifications, the units shall
include all equipment set out in the manufacturer's literature as standard
equipment. They shall include all exterior moldings, name plates, medallions,
series identifications, and chrome of every description that is usual for
standard stock models of this series.
2.
The specifications are intended to govern, ìn general, the size and type of
equipment desired and are minimum requirements. Variations from these
specifications may be acceptable provided such variation, in each instance,
~s noted on the bid. The City of North Richland Hills reserves the right
co evaluate variations from the specifications and its judgment in such
matters shall be conclusive.
3.
The unit shall be completely assembled, lubricated, adjusted, with all
equipment including standard and extra equipment installed, and the unit
made ready for operation.
4.
Bidder must fill in all inf~rmation asked for in the blanks provided under
each item. Failure to completely describe the equipment may result in
rejection of the bid. The City of North Richland Hills reserves the right
to evaluate variations from the specifications and its judgment in such
matters shall be conclusive.
5.
The bidder shall attach hereto, as part of this bid, regularly printed
literature published by the factory, which sets forth and describes the
equipment he proposes to furnish.
6.
Manufacturer's standard warranty for parts and labor must be included in
this bid.
7.
For bids on more than one unit of equipment, the City of North Richland Hills
reserves the right to make multiple purchases from more than one bidder if
it deems such action to be in its best interest.

In submitting his bid, the proposer understands and agrees to be bound by the
following terms and conditions:
1.
WITHDRAWING PROPOSALS
Proposals deposited with the City of North Richland Hills cannot
be withdrawn prior to the time set for opening proposals. Request for
nonconsideration of proposals must be made in writing to the Purchasing Agent
and received by the City of North Ricþland Hills prior to the time set for
opening proposals. After other proposals are opened and publicly readt
the proposal -for which nonconsideration is properly requested may be returned
unopened. The proposal may not be withdrawn after the bids have been opened,
and the bidder, in submitting the same, warrants and guarantees that his
bid has been carefully reviewed and checked and that it is in all things
true and accurate and" free of mistakes and that such bid will not and cannot
be withdrawn because of any mistake committed by the bidder.
2.
CONSIDERATION OF PROPOSALS
After proposals are open~d and publicly read aloud, the proposals
will be tabulated' for comparison on the basis of the bid prices and quantities
shown in the propo·sal. Until final award of the contract, the City of North
Richland Hills reserves the right to reject any or all proposals, to waive
technicalities, and to readvertise for new proposals, or proceed to do the
work otherwise in the best interests of the City of North Richland Hills.
3.
IRREGULAR PROPOSALS
Proposals will be considered irregular if they show any omissions,
alterations of "form, additions, or conditions not called for, unauthorized
alternate bids, or irregularities of any kind. However, the City' of North
Richland Hills reserves the right. to waive any irregularities and to make
the award in the best interests of the 'City of North Richland Hills.
4.
REJECTION OF PROPOSALS
The City of North Richland Hills reserves the right to reject any
or all proposals, and all proposals submitted are subject to this reservation.
Proposals may be rejected, among other reasons, for any of the following
specific reasons:
(a) Proposal received after the time limit for receiving proposals as
stated in the advertisement.
(b) Proposal containing any irregularities.
(c) Unbalanced value of any items.
(d) Where the bidder, any sub-contractor or supplier, is in litigation
with the City of North Richland Hills, or where such litigation is
contemplated or imminent, in the sole opinion of said City.

5. DISQU~IFICATION OF BIDDERS
Bidders may be disqualified and their proposals not considered,
among other reaso~s, for any of the following specific reasons:
(a) Reason for believing collusion exists among the bidders.
(b) Reasonable grounds for believing that any bidder is interested in
more than one proposal for the work contemplated.
(c) Where the bidder, any sub-contractor or supplier, is in litigation
with the City of North Richland Hills, or where such litigation is
contemplated or imminent, in the sole opinion of said City.
(d) The bidder being in arrears on any existing contract or having
defaulted on a previous contract.
(e) Lack of competency as revealed by a financial statement, experience
and equipment, questionnaires, e~c.
(f) Uncompleted work which in the judgment of the City of North Richland
Hills will prevent or hinder the prompt completion of additional work
if awarded.
6 . AWARD OF CONTRACT
Award of contract, if it be awarded, will be made by the City of
North Richland Hills to the lowest responsible bidder meeting the
requirements of the City of North Richland Hills, and will be made within
sixty (60) days after the opening of the proposal, but not before said
City's next monthly meeting. No award will be made until after investigations
are made as to the responsibiliti~s of the low bidders.
·7. ASSIGNMENT
The successful bidder may not assign his rights and duties under
an award without the wri.tten consent of the City of North Richland Hills
City Manager! Such consent shall not relieve the assignor of liability
in the event of default by his assignee.
8. NOTICE OF DELAYS
Whenever the vendor encounters any difficulty which is delaying
or threatens to delay ~imely performance (including actual or potential
. labor disputes), the vendor shall immediately give notice thereof in
writing to the Purchasing Agent, stating all relevant information with
respect thereto. Such notice shall not in any way constitute a basis for
an extension of the delivery or performance schedule or be construed as a
waiver by the City of North Richland Hills of any rights or remedies to which
it is entitled by law or pursuant to provisions herein. Failure to give
such notice, however, may be grounds for denial of any request for an
extension of the delivery or performance schedule because of such delay.
9 · BRAND NAME OR EQUAL
(This clause is applicable only when a "brand name or equal" purchase
description is included in an invitation for bids. As used in this clàuse,
the term "brand name" includes identification of products by make and model.)

a "brand name or equal".description, such identification is intended
to be descriptive, but not restrictive, and is to indicate the quality
and characteristics of products that will be satisfactory. Bids offering
"equal" products will be considered for award if ~uch products are
clearly identified in the bids and are determined by the Purchasing Agent
to be equal in all material respects to the brand name products
referenced.
(b) Unless the bidder clearly indicates in his bid that he is offering an

GENERAL CONDITIONS
EQUIPMENT BIDS
1. Equipment other than new models will not be considered as responsive
to the specificatio1ls. It is the intention of the City of North Richland
Hills to purchase bésed on the specifications, a standard production model.
In addition to the Equipment set out in the specifications, the units shall
include all equipme1 t set out in the manufacturer's literature as standard
equipment. They shéll include all exterior moldings, name plates, medallions,
series identificaticns, and chrome of every description that is usual for
standard stock mode s of this series.
2. The specifications ére intended to govern, in general, the size aad type of
equipment desired ard are minimum requirements. Variations from these
specifications may èe acceptable provided such variation, in each instance,
is noted on the bid. The City of North Richland Hills reserves the right
to evaluate variaticns from the specifications and its judgment in such
matters shall be cor elusive.
3. The unit shall be ccmpletely assembled, lubricated, adjusted, with all
equipment including standard and extra equipment installed, and the unit
made ready for operation.
4. Bidder must fill in all inf~rmation asked for in the blanks provided under
each item. Failure to completely describe the equipment may result in
reject~on of the bid. The City of North Richland Hills reserves the right
to evaluate variations from the specifications and its judgment in such
~atters shall be conclusive.
The bidder shall attach hereto, as part of this bid, regularly printed
literature published by the factory, which sets forth and describes the
equipment he proposes to furnish.
6. Manufacturer's standard warranty for parts and labor must be included "in
this bid.
7. For bids on more thaa one unit of equipment, the City of North Richland Hills
reserves the right to make multiple purchases from more than one bidder if
it deems such action to be in its best interest.
