Councilman Davis moved, seconded by Councilwoman Hinkle,
to approve the minutes of the regular meeting February
14, 1983.
Motion carried 4-0; Councilman Fisher abstaining due to
absence from the meeting.

6. Councilman Davis moved, seconded by Councilman Kenna,
to ~pprove the consent agenda, with the stipulation
the State would participate in the extension of
Davis Boulevard and the City's estimàted cost would
be approximately $72,000.
Motion carried 5-0.
7. Mayor Pro Tern Ramsey, on behalf of Mayor Faram, appointed
Mr. Vincent H. Darrough to the Library Board to replace
Mr. J. Fred Davis.
8. Mayor Pro Tern Ramsey opened the public hearing and called
for anyone wishing to speak in favor of this request to
please come forward.
Mr. Mike McCoy, owner of the property, appeared before the
Council.
Mr. McCoy stated he had owned the property for several
years and wanted to develop the property to correspond
with Stoneybrooke Addition.

Mayor Pro Tern Ramsey called for anyone wishing~o speak
in opposition to the request to please come forward.
There being no one else wishing to speak, Mayor Pro Tem
Ramsey closed the public hearing.
9. Councilman Kenna moved, seconded by Councilman Davis,
to approve PZ 83-1, Ordinance No. 1005.
Motion carried 5-0.
10. Mayor Pro Tern Ramsey opened the public hearing and called
for anyone wishing to speak in favor of this request to
please come forward.
Mr. Earnest Hedgcoth, Consulting Engineer, representing the
owners, appeared before the Council.
Mr. Hedgcoth stated the owner planned to build a
Texian Inn on the property. Mr. Hedgcoth stated
the property fronted on Airport Freeway and behind
Jo Beel's Restaurant. Mr. Hedgcoth stated he did
not have a time schedule for the project.
Councilman Kenna asked Mr. Hedgcoth if there would be
any variances asked for from the City Codes.
Mr. Hedgcoth·replied no.
Councilman Hubbard asked if the applicant was aware
of the Sign Ordinance.

11. Councilman Kenna moved, seconded by Councilwoman Hinkle
to approve PZ 83-5, Ordinance No. 1006.
Motion carried 5-0.
12. Mayor Pro Tern Ramsey advised the Council the applicant
and wanted to build five four-plexes with a private drive
from Irish Drive and the plan would have a circulation around
it in case of fire the fire trucks could go around and turn
around in the complex. Mayor Pro Tern Ramsey stated the Planning
and Zoning Commission had recommended approval subject to the
Engineers' comments.

Mr. Delbert Stembridge, Consulting Engineer, appeared
,before the Council. Mr. Stembridge stated that.Mayor
Pro Tem Ramsey had explained basically what they planned
to do, and he would answer any questions the Council might
have.
Councilman Hubbard asked how many acres did the property
consist of.
Mr. Stembridge stated approximate~y 1.288 acres.
Mayor Pro Tern Ramsey called for anyone wishing to speak
in opposition to the request to please come forward.
Councilman Davis stated there was a letter in the packet
from Joseph and Erma Raines in opposition to the request.
There being no one else wishing to speak, Mayor Pro Tem
Ramsey'closed the public hearing.

Councilman Hubbard moved, seconded by Councilman Kenna,
to approve PZ 83-6, Ordinance No. 1007, subject to the
Engineers' comments.

to the Sign Ordinance the Council had to approve permits
for billboards. Mayor Pro Tern Ramsey stated that
the applicant had met all the requirements.
Councilman Kenna moved, seconded by Councilman Hubbard,
to approve the request of Kem Advertising Incorporated.
Mayor Pro Tem Ramsey stated he would depart from the rules
and Let Mr. Kerry Moseley speak.
Mr. Mosley stated he understood the Ordinance and they would
be in strict ·compliance.

Councilman Davis moved, seconded by Councilman Newman,
to approve the following resolution:
RESOLUTION NO.. 83-5 ..... '.
WHEREAS, the City of North Richland Hills; Texas, will
hold its general C~ty Election on April 2, 1983; and
WHEREAS, the official absentee paper ballots have been
counted and sealed up with instruction cards, poll list, tally
sheets, distance markers, returning blanks, stationery and a
list of voters and the number of each endorsed on the package.
NOW, THEREFORE, be it Resolved by the City Council of
the City of North Richland Hills, Texas, that:

so certifies.

This resolution shall be entered as a part of the minutes
of this meeting.
Passed and Approved at a special meeting of the City
Council this 7th day of March, 1983.
Motion to approve carried 4-0.
4. Mr. Line stated that the Council needed to auehorize the
City Manager to execute the agreement with Mobile Pipe
Line for the casing extensions. Mr. Line stated the
estimated cost would be $10,107.
Councilman Davis moved, seconded by Councilman Hubbard,
to authorize the City Manager to sign the letter of
agreement with Mobile Pipe Line.
Councilman Fisher asked if Mobile would be responsible for
moving the lines and responsible .for the safety factors.
Mr. Line stated Mobile would be responsible.
Motion to approve carried 4-0.
5. Mayor~ Pro Tem Ramsey adjourned the meeting for the Council
to go into executive session.
Mayor Pro Tern Ramsey called the meeting back to order.
The same Council Members were present as recorded at the
beginning of the meeting.
Mayor Pro Tem Ramsey adjourned the meeting of March 7, 1983.

AN ORDINANCE by the City Council of the City of
North Richland Hills, Texas, authorizing the
issuance of $1,500,000 "CITY OF NORTH RICHLAND
HILLS, TEXAS, GENERAL OBLIGATION BONDS, SERIES
198311, dated March 1, 1983; prescribing the form
of the bonds and the form of the interest coupons;
levying a continuing direct annual ad valorem tax
on all taxable property within the limits of said
city to pay the interest on said bonds and to
create a sinking fund for the redemption thereof
and providing for the assessment and collection ~f
taxes; enacting provisions incident and related to
the subject and purpose of this ordinance; and
providing an effective date.
WHEREAS, the City council of the City of North Rich~and
Hills, Texas, hereby finds and determines that general
obligation bonds of the City in the total principal amount
of $1,500,000 should be issued and sold at this time; such
general obligation bonds having been approved and authorized
. to be issued at an election held August 9, 1980, and a

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF NORTH RICHLAND HILLS, TEXAS:

SECTION 1: That the bonds of said city, to be known as
"CITY OF NORTH RICHLAND HILLS, TEXAS, GENERAL OBLIGATION
BONDS, SERIES 1983", be and the same are hereby ordered to
be issued in the principal sum of ONE MILLION FIVE HUNDRED
THOUSAND DOLLARS ($1,500,000) for the purpose of making
permanent public improvements and public purposes, to wit:
$1,000,000 for street improvements including drainage incidental
thereto and $500,000 for acquiring or improving, or both,
land for park purposes, under and by virtue of. the constitution
and laws of the state of Texas.
SECTION 2: That said bonds shall be dated March 1,
1983; shall be numbered consecutively from One (1) through
Three Hundred (300); shall each be in the denomination of
Five Thousand Dollars ($5,000), and shall become due and
payable serially on September 1 in each of the years and
bear interest at the per annum rates in accordance with the

PROVIDED, HOWEVER, the City reserves the right to
redeem the bonds of this series maturing on September 1,
1994, and subsequent, in whole or any part thereof, on
September 1, 1993 , or on any interest payment date thereafter,
at the price of par and accrued interest to the date fixed
for redemption; PROVIDED, FURTHER, that at least thirty (30 )
days prior to a date any of said bonds are to be redeemed, a
notice of redemption, signed by the City Secretary (specifying
the serial numbers and amount of bonds to be redeemed) ,
shall have been filed with Texas American Bank/Fort Worth,
N.A. , Fort Worth, Texas (the paying agent named in each of
said bonds ) ; and if the City shall have made available by
the redemption date funds sufficient to pay the bonds to be
redeemed and accrued interest thereon,_ any bond or bonds not
presented for redemption pursuant to such notice shall cease
to bear interest from and after the date so fixed for redemption.
SECTION 3 : That said bonds shall bear interest from
date to maturity, or the redemption thereof in accordance
with the terms prescribed therefor, at the per annum rates
shown above, such interest to be evidenced by proper coupons
attached to each of said bonds and said interest shall be
payable on September 1, 1983, and semiannually thereafter on
March 1 and September 1 in each year.
SECTION 4: That both principal of and interest on this
issue of bonds shall be payable in lawful money of the
United States of America, without exchange or collection
charges to the owner or holder, at Texas American Bank/Fort
Worth, N.A. , Fort Worth, Texas, upon presentation and surrender
of bonds or proper coupons .
SECTION 5 : That the seal of said City may be impressed
on each of said bonds, or in the alternative, a facsimile of
such seal may be printed on said bonds . The bonds and
interest coupons appurtenant thereto may be executed by the
imprinted facsimile signatures of the Mayor and City Secretary
of the City, and execution in such manner shall have the
same effect as if such bonds and coupons had been signed by
the Mayor and City Secretary in person by their manual
signatures . Inasmuch as such bonds are required to be
registered by the Comptroller of Public Accounts for the
State of Texas, only his signature ( or that of a deputy
designated in writing to act for the Comptroller ) shall be
required to be manually subscribed to such bonds in connection
with his registration certificate to appear thereon, as
hereinafter provided; all in accordance with the provisions
of Article 717j-1, V.A.T.C.S .

SECTION 9: That to provide for the payment of the debt
service requirements on said bonds, being (i) the interest
on said bonds and (ii) a sinking fund for their redemption
at maturity or a sinking fund of 2% (whichever amount shall
be greater), there shall be and there is hereby levied for
the current year and each succeeding year thereafter while
said bonds or interest thereon shall remain outstanding and
unpaid, a sufficient tax on each one hundred dollars' valua-
tion of taxable property in said city~- adequate to pay suÇh
debt service requirements, full allowance being made for -
delinquencies and costs of collection;, said tax shall be _
assessed and collected each year and applied to the payment
of said debt service requirements, and the same shall not be
diverted to any other purpose. The taxes so levied shall be
paid into a fund known as "SPECIAL SERIES 1983 GENERAL
OBLIGATION BOND FUND", which is hereby established for the
payment of the obligations herein authorized. The Council
hereby declares its purpose and intent to provide and levy a
tax legally and fully sufficient for such bonds, it having
been determined that the existing and available taxing authority
of the city for such purpose is adequate to permit a legally
sufficient tax in consideration of all other outstanding
indebtedness.

Printing of a true and correct copy of said opinion on the
reverse side of each of said bonds, with appropriate certifi-
cate pertaining thereto executed by facsimile sigriature of the
City Secretary of the City of North Richland Hills, Texas,
is hereby approved and authorized.

SECTION 12: That the City hereby certifies and covenants
that the p~oceeds of the bonds are needed at this time to
finance the costs of capital improvements planned by the
city; based on current facts, estimates and circumstances,
it is reasonably expected final disbursement of the bond
proceeds will occur within three years from the date of the
receipt thereof by the City; it is not reasonably expected,
that the proceeds of the bonds or moneys deposited in the
interest and sinking fund created for the payment of the
bonds will be used or invested in a manner that would cause
them to be or become "arbitrage bonds" within the meaning of
section l03(c) of the Internal Revenue Code of 1954, as
amended, or any regulations or pub~ished rulings pertaining
thereto; and save and except for the interest and sinking
fund created herein no other funds or accounts have been
established or pledged to the payment of the bonds. Proper
I officers of the city charged with the responsibility in the
issuance of the bonds are hereby authorized and directed to
make, execute and deliver certifications as to facts, estimates
. and circumstances in existence as of the date of the issue
i of the bonds and stating whether there are any facts, estimates
or circumstances which would materially change the City's
current expectations, and the covenants herein made and
certifications herein authorized are for the benefit of the
holders of the bonds and coupons appertaining thereto and

SECTION 13: That the Mayor of the city shall be and is
hereby authorized to take and have charge of all necessary
orders and records pending investigation by the Attorney
General of the State of Texas, and shall take and have

by the Comptroller of Public Accounts.
SECTION 14: That CUSIP numbers may be printed on the
bonds herein authorized. It is expressly provided, however,
that the presence or absence of CUSIP numbers on the bonds

thereof and neither the city nor attorneys approving said
bonds as to legality are to be held responsible for CUSIP
numbers incorrectl¥ printeQ on the bonds.
SECTION 15: That, in reference to the Official statement
prepared in the initial offering and sale of the bonds
herein authorized by the City, the city council ratifies and
confirms its prior approval of the form, and content thereof
and hereby approves the form and content of any addenda,
supplement or amendment thereto; the use of such Official
statement in the reoffering of the bonds by the above named
purchaser(s) is hereby approved and authorized; and the
proper officials of the city are hereby authorized to execute
and deliver a certificate pertaining to said Official statement
as prescribed therein, dated as of the date of payment for
and delivery of the bonds.
SECTION 16: That this ordinance shall take effect

Tierra Financial, Inc. He said due to the
location of the property and thé shape of
the land, they felt Multi-Family zoning
would be the best use for this land.
The Chairman opened the Public Hearing·

David Payne, 6983 Cox Lane, came forward.
He stated that the traffic on Davis Blvd.
was alreädy congested and where Turner '\
Drive comes into Davis Blvd., there would
have to be a traffic light because of the
traffic problem apartments would generate.
Mr. Payne said he has had sewer problems
and had won a $10,000 settlement. He said
if apartments come~ in there, it would
only add to the sewer problems.
Mr. Payne said it is residential zoning
on all sides of this property and he feels
the Multi-Family zoning would create both
sewer and traffic problems. He said that
Smithfield Elementary School h~s been
enlarged to accomodate the number of school
children and he doesn1t see how this zoning
could be in the best interest of the city or
the homeowners.
John Larriviere, 6971 Cox Lane, came forward.
He said he was not sure if Turner Drive could
handle the additional traffic this zoning
would generate. Mr. Larriviere said Turner
Drive had just been resurfaced. He said it
is a very narrow street and he did not feel
it could handle the traffic; there would be
congestion.
Mr. Larriviere said he had been lucky because
he had not had any sewer problems, but his
neighbors on both sides of him had sewer
problems.

Chairman Tucker said the developer would
have to go through the platting process
and if there was a drainage problem or a
water or sewer problem, they would be
required to make it ~dequate.
Mr. Tucker said the traffic would be a
problem.
The Chairman closed the Public Hearing.
Mr. Wood asked if there were any improve-
ments to be made on Davis Blve.
Mr. Bronstad said that would be up to the
State since it is a State highway.
Mr. Tucker asked about Turner ,Drive.
Mr. Bronstad said he was not sure if Turner
Dri've was listed in the bond program.

Rodger Carson, 7024 Crabtree Lane, came
forward. He said he wanted to voice his
opposition to this request. He said he
is a concerned parent. Mr. Carson said
his family had lived about a mile from
this store 'since 1970. He said it was
previously an old landmark, but is now
modernized and fixed up with several
video games. Mr. Carson said he has a
son 12 years old who spends all his
allowance there. He said there are so
many kids and bikes there until they had
to put up signs about moving their bikes.
Mr. ·C-arson said hi-s family uses this
store because Smithfield Road is not as
congested as some of the other major
streets. He said he sends his teenage
daughters there for a loaf of bread, etc.
Mr. Carson said this store is across the
street from the First Baptist Church of
Smithfield which he has been a member for
eleven years. He said the church is
about 308 feet from the front door of this
store, directly west is the Church of
Christ which is 304 feet away and up the
street from this store is the Smithfield
Methodist Church and across the street
just north of the store is the Little
Tyke Day Care Center and Smithfield
Elementary school.

Mr. Carson said s;-nce he had lived in
this area, there has been three different
owners of the store, and he knows the
economics would be in their favor if they .
could sell beer, but he ;s against beer
being sold in this location.
Mr. Carson said he has a petition with 76
signatures who back him, )both morally

request.
Chairman Tucker closed the Public
Hearing.
Mr. Wood asked if it was true that they
moved the front door to make the store
fall within the letter of the law. He
said while that might be true, he did
not feel it was the intent of the law.
Mr. Wood said regardless where the door
is, the location of the store is the
same as in previous requests when it was
denied, and moving a door does not correct
the prob 1 eni .

Mr. Hannon said the Commission is dealing
with two laws, the State law which can not
issue a permit if they are within the 300
ft. distance, and the City Ordinance which
is used as a guideline, and neither say
just because it is 300 feet or more away
they would b~ granted a permit.
Mr. Wood made the motion to deny PZ 83-2.
This motion was seconded by Ms. Nash and
the motion carried 5-0.

117 feet east of Tourist Drive and
approximately 150 feet south of Bewley

Mr. Bowen said due to a conflict in
interest, he wanted to disqualify himself
and ask the alternate member, Mr. Schwinger,
to take his place.
Ms. Nash made the motion to allow Mr. Bowen
to disqualify himself on this request.
This motion was seconded by Mr. Wood and
the motion carried 5-0.
Mr. Bowen stepped down and sat in the
audience and Mr. Schwinger took his place.
Elmer Allison with Aleo Develoþment Corp.
came forward. He said he purchased this
property nine years ago and at that time,
it was a jungle and in poor condition. He
said they have put the sewer through part
of the property and filled it in. He said
he feels it would be a disadvantage to have
to put single family on it.
Mr. Allison gave copies of a preliminary
plat of the property and some pictures of
the area to the Commission.
Mr. Allison said this property is close to
the city water tank, and there is no market
for 1400 to 1500 sq. ft. homes. He said
they would like to get the property on the
tax rolls and put duplexes on it instead of
it being a dump ground.
Mr. Wood asked if this would be rental
property.

Mr. Allison',said they plan to sell the
duplexes and most of the time, the
owner lives in one side and rents out
the other side.
Mr. Wood asked how long the storage tank
had been there.
Mr. Bronstad said ft had been there for
many years.
Mr. Allison said there would be 4 lots,
with 4 duplexes, or 8 units.
The Chairman opened the Public Hearing
and c~lled for those wishing to speak in
favor of this request to please come
forward.
There being no one wishing to speak, the
Chairman called for those wishing to speak
in opposition to this request to please
come forward.
BilT Rhodes, ;3628-Wendell Drive, came
forward. He said he did not want to
stand in the way of progress, but he feels
this would be a step backward. Mr. Rhodes
said he and his wife selected this area
for their home and to raise their children
here. He said he felt there would not be
adequate fire hydrants for this area and
the area adjacent to it.
Chairman Tucker stated if the zoning is
approved, the City Engineer would review
their plat and would tell what is needed
and if more fire hydrants are needed, they
would be required before the plat could be
approved.
Mr. Rhodes said also erosion has cut a
gulley across the property. He asked if
there would be a requirement for the
developer to take care of the drainage and
keep it off of the adjacent property owners
and be responsible for where it would go.
Chairman Tucker asked Mr. Bronstad to answer
this question.

Mr. Bronstad said the plat would need to
be approved subject to the City Engineer's
comments. He said the City Engineer
would check the Topo map and it would have
to comply before the plat would be approved.
Eddie Hinds, 3513 Tourist Drive, came
forward. He said this is the fourth or
fifth time this property has come'up for
rezoning. Mr. Hinds asked how many times
can they request a 'zoning change.
Mrs. Calvert said every six months.
Mr. Hinds said he bought his home six years
ago knowing the water tower was there. He
said he enjoys sitting on his porch with
a glass of tea and looking at the water )
tower. He said his property is next to the
water tower.
Mr. Hinds said, he is concerned with the .
added traffic this project would make, 16
or more vehicles. He said there would be
more~hildren to·p.lay in the area. Mr.
Hinds said this is at the bottom of a hill
and is very dangerous.
Mr. Hinds said rental property. is never
kept up and he feels if the d~veloper wants
to get his money out òf this property, he
should put single family hoMes on it.
Rick Rhodes, 3612 Wendell Drive, came
forward. He said he had lived in this
area for seven years. Mr. Rhodes said
they already have a traffic problem. He
said you can not see traffic, you have to
go up the hill. Mr. Rhodes said it is
used as a race track now. He said they
also have a lighting problem in this area
and a water problem. He said he would
rather .have single family homes there.
Jesse Loudermilk, 6009 Tourist Drive, came
forward. He said his property is immediately
adjacent to this property. Mr. Loudermilk
said he agreed with everything the others
have said. He said he does not feél this
request would be an improvement over what
they already have. Mr. Loudermilk said he

feels it would reduce the property value
of his house.
Mr. Loudermilk said he would like to add
that the water tank is beautiful.
Dennis Baker, 6108 Wendell, came forward.
He said he would like to dispute the fact
that you can not buy a 1500 sq. ft. home
for less than $100,000; he said he just
bought a 1900 sq. ft. home in this area
for $76,000. Mr. Baker said he was moving
from Watauga where most of the homes are
now rental property and the neighborhood
has gone down since that happened. .
Mr. Baker said you can not be choosey
who you rent to because there is a
Federal Housing Act which makes that
illegal.

John Butler, 3629 Wendell, came forward.
He said he has lived there 7~ years. He
said he has a. small child and the traffic
is so-bad now that-he can not allow the
child in the front yard. Mr. Butler said
with multiple family development in this
area the traffic would increase at twice
the rate as if you had single family there.
He said he bought here because it had
single family all around. Mr. Butler, said
Wendell Drive is on the edge of North'
Richland Hills and he feels that is why
they have not gotten the attention that
some of the other streets get in the city.
He said this street is in need of repair
and with the added traffic this development
would bring, it would only exaggerate this
cond i tion.

Tim Thomas, 3636 Wendell, came forward. He
said with this additional development, it
would cause the depreciation of this area;
it would worsen the traffic problem they
now have. Mr. Thomas said why discourage
the park environment they have now. He
said Fossil Creek Park is just now being
utilized fully 365 days a year; the trees,
the squirrels and the rabbits are beautiful.
Mr. Thomas said it was evident that you buy
a home for two reasons: you either buy it

Bob Parrish, 3632 Wendell, came forward.
He said he bought his home in 1970 with
the idea it would always be singl~
family in this area and he wants to
keep it that way. Mr. Parrish said the
tra ffi cis a 1 ready 'bad and wi th the
addition of apartments, it would be
greater. He said it was hard to get up
that hill in icy weather. Mr. Parrish
said he had rather have single family
dwellings the,re.
Chairman Tucker said there had been a
legal petition submitted with 14 of the
property owners within 200 feet and also
a petition of those not within 200 feet
of this property.
Chairman Tucker closed the Public Hearing.
Mr. Hannon asked Mr. Allison if he was the
owner of the entire property shown in this
plat.
Mr. Allison said he was.
Mr. Hannon said there was another way he
could lay this area out where the water
tank would not be in front view.
Chairman Tucker said he drove down the
steep hill and found very well kept single
family homes. He said to plant a different
use in this small area, it would be hard
for him to look favorable on it.
Mr. Hannon said he felt it would be spot
zoning.,

We have reviewed the referenced materials for this subdivision and offer
the following comments:
1. The area of the proposed subdivision should be shown on the plat.
2. Utility companies should be consulted regarding their requirements
for any additional easements to serve this property.
3. A minimum 5 foot building setback should be provided on Ross Road
and Col.l ege Ci rcl e for commerci al zoni ng.
4. Plans should be provided which show the proposed sanitary sewer
service to this property.
5. The Developer should be required to pay his pro rata share of one

Mr. Long said when they revised this plat,
they lost one lot, and if they go back to
the original plan, they would show this
lot facing Rufe Snow. He said as· far as

Mr. Hannon said the Commission was concerned
with the street change they showed on the
final plat.
Chairman Tucker asked if they had any
objection to the change of the name of the
addition back to Parkrîdge.
Mr. Long said his client had no objections
to doing this.
Chairman Tucker asked if they had any problem
with items 8, 9, and 10 of the Engineer's
letter.
Mr. Long stated they had no problems with
them and they will work with the City Staff
to get them taken care of.
Mr. Hannon made the motion to approve PS 83-12

We have received a copy of your engineer's review letter dated Feb. 16,
1983 (from Mr. Richard Albin, P. E.) for Diamond Crest Estates Final
Plans and have the following comments:
1. My client has no objections to changing the name to PARKRIDGE
ESTATES if the Commission and Council want the name changed.
2.
With yoùr thoroughfare plan not showing Riviera Drive as a
collector to the west of Rufe Snow, we did not prepare our
plat and plans' to reflect same. If, however, the Commission
and Council feel that Quail Ridge Drive and part of Lakeside
Drive need to be 37 feet wide rather than 31 feet as shown,
we request that this be accomplished within the proposed 50-foòt
right-of-way, with additional 5-foot easements being granted on
each side of the proposed right-of-way for utility purposes.
3. Lots crossed by the 3D-foot wide Lone Star Gas easement have in
excess of 2,500 s.f. buildable area on each lot. Lone Star Gas
Company has been consulted about their pipeline location and
depth. We will also give them a copy of the plat for their review.
4. The existing zoning of IF-12 will be shown on the plat prior to
recording, along with any added utility easements requested.
5. The 25-foot building setback lines are as shown on the approved
preliminary plat.
6.
The lot depths are in general conformance with the approved
preliminary plat. Also, these lots are in the court area where
we have had trouble getting the minimum depth but our client
feels that a standard size house meeting the minimum square
footage for IF-12 can be constructed on these lots.

7. The lot widths are in general conformity with the approved
preliminary plat with same being as narrow as 76 feet. All
lots, however, will have a minimum of 9,500 square feet, as
shown on the preliminary plat.
8. The 6-inch water lines, as requested, will be increased to
8-inch in Lakeside Drive (Point 2 to 10), Quail Ridge Drive
(Point 7 to 9) and Pleasant Ridge Drive (Point 1 to 2).
9. Th.e Developer will pay his pro rata share of the existing 8-inch
water main in RufeSnow Drive at the time of development or with
the City-Developer Agreement.
10. After some discussion with Mr. Riddle in your Public Works
Department, we will change the proposed cleanouts to manholes
where he needs them to serve possible future development.

We have reviewed the referenced materials for this subdivision and offer
the following comments:
1. This plat was previously submitted, in 1978, as the "Parkrìdge
Estates" (PS 78-101), and the prel iminary plat was approved by the
courts. Therefore, we would recommend that the final plat also be
designa,ted as the Parkridge Estates to avoid confusion.
2. Please see our comments concerning Riviera Drive in our review
letters dated December 7, 1978, and January 9, 1979. We would note
that the present North Richland Hills Land Use and Thoroughfare
Plan does not show the proposed designation of Riviera Drive west
of Rufe Snow. However, if Quail Ridge Drive is used as a collector
extension of Riviera Drive through this subdivision to Rufe Snow
then we would recommend that the proposed right-af-way width of
Quail Ridge be increased from 50 feet to 60 feet and the street
constructed to collector standards. This right-af-way width in-
crease would require a reduction of 5 feet from the depth of all
lots fronting Quail Ridge Drive from Lakeside Drive to Rufe Snow.
These revised lots would still meet the minimum requirements for
IF-12 zoning.
3. We would suggest that the Developer be required to show that homes
meeting the dimensional requirements of the zoning for this sub-
division can be constructed on the lots which are crossed by the
3D-foot wide Lone Star Gas easement, without ~ncroaching on any
part of the easement area. Also, Lone Star Gas should be consulted
regarding their requirements for ingress-egress to the gas line for
maintenance purposes.

4. The existing zoning for this subdivision, IF-12, or proposed zoning
should be shown on the plat.

5. The building setback lines should be increased from 25 feet to 30
feet for IF-12 zoning.
6. The average lot depth of the following lots do not appear to meet
the minimum lot depth requirement of 110 feet for IF-12 zoning:
a. Block 1, Lot 3
b. Block 1, Lot 5
c. Block 1, Lot 8
d. Block 4, Lot 6
7. The width of the following lots do not meet the minimum requirement
of 80.0 feet for IF-I2 zoning:
a. Block 1, Lots 13 through 17
b. Block 5, Lots 14 through 20
c. Several other "pie-shaped" lots do not meet the minimum width
requirements as measured a16ng the building lot line. Increasing
the building lot line from 25 to 30 feet may bring these lots
into compliance, however.
8. Because of the experienced low water distribution system pressures in
the subdivision area, we would recommend that the following proposed
6-;nch diameter water lines be increased to a-inches:

a. Lakeside Drive (Point 2 to 10)
b. Quail Ridge Drive (Point 7 to 9)
c. Pleasant Ridge Dr;ve (Point 1 to 2)
9. The Developer should be required to pay his pro rata share of the
existing 8-inch water main in Rufe Snow Drive. We would estimate pro
rata at $5.50 per linear foot for a total length of 1,106.25 feet.
10. The Public Works Department has requested that manholes be constructed
in lieu of cleanouts at the following locations:
a. East end of Lakeside·Court.
b. Quail Ridge at Rufe Snow with proposed sanitary sewer line
extended fully to the Rufe Snow right-of-way.
c. Lakeside Drive and Pleasant Ridge Drive.

· During recent deliherations concerning platting of a portion of Snow Heights
f\Jd1t1on, a large nunlber of property owners objected to the extension of
Riviera ~rive i:est to Rufe Snow Drive and the resulting conpletion of that
collector street as designated on the ·'1aster Thoroughfare Plan.
As YOU know, after !nuch discussion, the Council voted to ren'Ove this
porttº-..Fl of Riviera Drive fro!';) the Thoroughfare Plan as a collector street,
anti the street now does not exit onto Rufe Snow as originally planned.
At that ti~ the matter of the "col lector" designation was not addressed
on that portion of Riviera liest of Rufe Snow. Because of this, \'e œde
the cOli1ment relative to Riviera not being shown on the prelininary plan
of the subject subdivision.
We feel that this subject should be addressed by th~ COf:niss1on and the
Council as it relates to the overall City collector needs and this sub-
division in particular as it is -being proposed for developnsnt at this
t 11~e .
Also, please note that Riviera Drive has already baen built to "collector"
speci f1 cations from its \Jest end easterly to Lar; J t Tra i 1.

In response to Knowlton-English-Flowers letter dated February.
16, 1983, we offer the following comments:
.1. The dedicated 15-foot wide water and sewer_easement
located along the west line of 'Block 8-R has been
added to this plat for information purposes.
2. The Lone Star Gas easement which crosses this property
was not shown because it is in the process of being
abandoned.
3. The previously proposed sanitary sewer easements
within this development have been removed from the
plats, and the sewer lines have been designated as
private lines.
4. We are currently working with the City Staff to determine
the meter locations required by the City. The accurate
locations will be shown on the utility layout sheet prior
to construction.
5. The storm drain design calculations are being developed
and will be shown along with all discharge quantities and
calculations. The hydraulic grade lines will be added to

3. The Public Works Department has requested that all sanitary sewer

that each 2-plex apartment group shall be served by a 1~ inch meter.

City Engineer's letter regarding the
reference to using an invalue point of
.010. He said our Subdivision Ordinance
requires the use of .013~ which ;s the
Health Department Standards, unless there
has been a change that he is not aware of.
Mr. Perkins said Mr. Albin was allowing
them the .010 factor because of the
utilization of PVC pipe~ He said he
believes the .013 relates to the clay pipe.
Mr. Hannon asked if it had been approved by
the Health Department and had other cities
approved its use.
Mr. Perkins said he was sure it has been.
He said they had just designed a project
for the City of Hurst and were able to use

Mr. Bowen stated the Commission has a
letter from the Director of Public Works/
Utilities, Gene Riddle, regarding the off-
site easements. Mr. Bowen asked if they
had obtained them.
Mr. Perkins said they have been working
with Mr. Long in getting an approved
alignment through Mr. Barfield's property.
He said the problem they are having is
they have not tied down the exact location
of drainage channels, streets, .etc. within
their subdivision. Mr. Perkins said the
last time he talked with Mr. Long, they had
only drawn up a rough graph of the subdivision.
He said what he plans to get is a 10 foot
utility easement within the proposed street
R.O.W. or a channel easement. Mr. Perkins
said they are aware they can not begin
construction until this is worked out to the
city's 'specifications. He said if they get
approval of'.this plat tonight, they will get
with Mr. Long and try to tie down the align-
ment. He said he feels the alignment would
only vary from one inch to one foot.

1. We have received sheets 5 through 7 of the Water, Sewer, and Storm
Drainage Plans showing the proposed off-site sanitary sewer line
as we requested in Item 3 of our letter dated February 16, 1983.
2. A "Point of Service" permit should be obtained from the Trinity
River Authority for connection to the TRA 30" sewer main at Precinct
Line Road.
. 3. A written permit from Texas Power and Light Company should be
obtained for crossing their easement. Copies of all other ease-
ments required for construction and maintenance of the off-site
sewer line should be furnished to the City.
4. We have analyzed the capacity requirements for the off-site sanitary
sewer main in accordance with City criteria, as shown in the attached
calculations, and we would offer the following changes to the developer
proposed pipe sizes:

5. Due to the very deep trench cuts throughout a large part of this
project, we would recommend that ductile iron pipe be substituted
for PVC pipe in areas where the trench cut exceeds 20 feet. Also

This is to request opportunity to appear before the next City
Council Meeting to request a variance from the new ordinance passed
January 24, 1983.
We have expended a great deal of time and effort since November
with Federal Sign COII\Pany who have also expended time and money designing
and planning for our' permanent sign.
We started construction on September 22, 1983, on this 47,000
square foot shopping center. At that time, you had no signage ordinance.
Your new ordinance is very strict and very tight so we would like to
cover all signage matters in this one variance request.

Attached are excerpts from the minutes of two meetings of the Council

in which Bridal Path Trail was discussed. The citizens in the area call frqm time
to time when the barracade is down and remind me that it was agreed that Bridal
Path Trail would be barracaded going into JoBeel's. If the street is opened,
I am sure we will again hear from the people living on Oakridge and }1esa Verde.
The condition of the streets will not stand more traffic. Bridal Path is,
dirt and gravel and has had a small,amount of penetration asphalt in one section
near Oakridge,and it also is in poor condition. If this is vital to the motel owners
they may want to finish these streets.

of Bridal Path Trail
Dear Roger:

This will confirm our discussions of March 4, 1983 concerning our
.request to appear before the Council to discuss the conditions re-
quired to open Bridal Path Trail from Mesa Verde East to the west
line of Jobeel's Restaurant. This will provide access from High-
way 121 to the property north of Jobeel's which is proposed to be
developed by the Texian Inn Corporation. Texian Inn plans to con-
struct a 115 room hotel on the site. Preliminary projections are
that the hotel will produce $1.1 million dollars in revenues during
the first year of operation, with future projections of $1.5 million
in the third year. This would provide the City with additional tax
revenue from the 4% user tax.
We would like to point out the fact that Mesa Verde and Bridal Path
Trail are both legally dedicated public right-of-way by plat of
Richland Oaks Addition, Third Filing, recorded in Volume 388-07, Page
81, and that the current barricade at Bridal Path Trail and Mesa Ver-
de was placed there by the request of surrounding homeowners and is
in violation of the City Subdivision Ordinance in that it denies ac-
cess to Lot 6 & 7, Block C, of Richland Terrace Addition, Third Fil-
ing. The portion of right-of-way from Mesa Verde to the west line
of Jobeel's has never been officially vacated.
We would like to be permitted access to Bridal Path Trail. If you
have any additional questions, please contact me.

Councilman Cavanaugh stated that on the preliminary plat Mr. Long
did not plat Bridal Path~ it shows to be a private road. Councilman
Cavanaugh asked if they had any intentions of opening Bridal Path.
Mr. Long stated there had been a lot of discussion on the opening
of Bridal Path and he would leave it to the' Council's descretion.
Councilman Cato stated he assumed the entire 7 7/8 acres would be
contained in this request and they were not separated into tracts
at this time.
Mr. Hedgcoth, Mr. Long's engineer~ stated that was correct~ however~
in the development plan they are platting only the' first lot, is
about 1.8 acre's.

7 7/8 acres for alcoholic beverages and using only 1.8 acres.
Councilman Cato asked if there was anyway the Council could protect
the city from further sale or further use of the rest of the land
since this request was for the entire 7 7/8 acres.

Use to the 1.8 acres.
Councilman Cato asked if the Council could restrict the Specific-Use

description of the tract that is going to be built on.

Councilman Cato stated the Council's concern was glVlng a Specific-
Use permit for the 7 7/8 acres when they were going to use only
1.8 acres. Councilman Cato stated the rest of the property
'vlould still carry the same zoning and \'JOuld not be able to be
used for anything unless it \':as rezoned.
. Councilman Cato stated he VJas going to I'ecoffimend that if the Council
passed this request, contingent on Mr. Long getting a description
of the 1.S'acre plat or particle that this zoning could be tied
specifically to and leave the rest un-zoned.

the Council. Mr. Chadwell stated he was not in opposition
to the restaurant. Mr. Chadwell stated he would like consideration
on the opening of Bridal Path. Mr. Chadwell stated he felt like
it would be an overload to a residential area if Bridal Path
was opened. Mr. Chadwell stated he would like to have the
Council's consideration as to not opening Bridal Path.
Councilman Cavanaugh stated he would like to,'~~mind the Council
that they w~re changing zoning on a piece of property that
they had no control over how it would be developed in the future.
Councilman Cav~naugh stated that if the Council was going to stay
~/ithin the guidelines of what they wanted in the city~·they
should not blind zone this property \~ithout saIne kno\vledge
of what was going to be built, at least the section that is not,
going to be used.
Councilman Wood asked City Engineer Perkins i1 the Council zoned
the rear half Local Retail and it was platted) if someone came
in for a construction permit, would the Council have control of what .
was being built on the property.

Councilman Wood moved, seconded by Councilman Cato, to

\ Councilman Cato asked the City Staff if they had looked
at the potential of the extension of Bridal Path Lane, did
they want to to end in the' parkin~ lot or ex~d:;t.
Mr. Anderson stated there was no reason why Bridal Path
could not be extended. The drainage calculations were suitable,
they were handling'the water now. Bridal Path is partially ,i~
now but not paved. The assumption was made that Bridal Path would
'eventually be completed and all the drainage and engineering was
made accordingly.
jCQU. ncilman Cato stated the acceptance of this plat would
cut Bridal Path off, it would no longer go down to Highway
121 Access.'

APPROVAL BY CITY COUNCIL

(a) No billboard may be constructed unless a sign permit therefor h~s been
with the approval of the City Council. '-:=
(b) In making its determination, the City Council shall consider, among
other factors, whether or not the issuance of the permit:
(1)
Will be materially detrirnentai to the public welfare;
(2) Will substantially interfere with the orderly develop-
ment of the City as provided for in the Official Land
Use Plan;
(3) Will be compatible with the development of property
of other persons located in the vicinity thereof;
(4) will comply with the provisions of this Ordinance.
(c) Applications therefor shall be filed and processed as proviàed for
~ Article 3 of this Ordinance.

A billboard may be placed only adjacent to a limited access freeway as
defined in section 2.5, in zoning districts except AG, I-F, 2-F and MF~

SECTION 8.3 MAXIMUM AREA
(a) No singlefaced billboard shall be larger than 700 square feet in
area.
(b) No one face of a double-faced or V-shaped billboard shall exceed 700
square feet in area.
SECTION 8.4
MAXIMUM HEIGHT
The maximum height of billboards shall be fifty (50) feet measured from the
ground to the overall top. Approval fœ: taller billboards may be granted by the City
Council in those cases where it will reduce clutter and fit 'in more compatibly with
the surrounding terrain and structures. No billboard shall be located on the roof
or wall of a building.
SECTION 8.5
BILLBOARD LOCATION AND POSITION
(a) Billboards shall be erected only on private property and shall not pro-
.. ct over any public property or right of way. Billboards shall be located within 100
et of the limited access freeway boundary line.
(b) Billboards ,shall be positioned such that the primary viewing angle is

A minimum distance of 500 feet shall be maintained between any two' (2)
billboards located on the same side of the freeway.
