L.._ . MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF NORTH ,RICHLAND HILLS, TEXAS, HELD IN THE CITY HALL, 7301 NORTHEAST LOOP 820, FEBRUARY 28, 1983 - 7:30 P.M. 1 . Mayor Pro Tem Ramsey called the meeting to order February 28, 1983, 7:30 p.m. 2. Present: Jim Ramsey Jim Kenna Richard Davis J .C. Planning & Zoning Member Mid Cities News Mayor Councilman Mayor Faram was absent due to a business meeting out of the City. 3. Councilman Newman was absent due to illness. The invocation was given by Master Shane Hubbard. 4. Councilman Davis moved, seconded by Councilwoman Hinkle, to approve the minutes of the regular meeting February 14, 1983. Motion carried 4-0; Councilman Fisher abstaining due to absence from the meeting. 5. CALL TO ORDER -.. INVOCATION CONSIDERATION OF MINUTES OF THE REGULAR MEETING FEBRUARY 14, 1983 APPROVED CONSIDERATION OF REMOVING ITEM (S) FROM CONSENT AGENDA 6. Councilman Davis moved, seconded by Councilman Kenna, to ~pprove the consent agenda, with the stipulation the State would participate in the extension of Davis Boulevard and the City's estimàted cost would be approximately $72,000. Motion carried 5-0. 7. Mayor Pro Tern Ramsey, on behalf of Mayor Faram, appointed Mr. Vincent H. Darrough to the Library Board to replace Mr. J. Fred Davis. 8. Mayor Pro Tern Ramsey opened the public hearing and called for anyone wishing to speak in favor of this request to please come forward. Mr. Mike McCoy, owner of the property, appeared before the Council. Mr. McCoy stated he had owned the property for several years and wanted to develop the property to correspond with Stoneybrooke Addition. l:: Mayor Pro Tern Ramsey called for anyone wishing~o speak in opposition to the request to please come forward. There being no one else wishing to speak, Mayor Pro Tem Ramsey closed the public hearing. 9. Councilman Kenna moved, seconded by Councilman Davis, to approve PZ 83-1, Ordinance No. 1005. Motion carried 5-0. 10. Mayor Pro Tern Ramsey opened the public hearing and called for anyone wishing to speak in favor of this request to please come forward. Mr. Earnest Hedgcoth, Consulting Engineer, representing the owners, appeared before the Council. Mr. Hedgcoth stated the owner planned to build a Texian Inn on the property. Mr. Hedgcoth stated the property fronted on Airport Freeway and behind Jo Beel's Restaurant. Mr. Hedgcoth stated he did not have a time schedule for the project. Councilman Kenna asked Mr. Hedgcoth if there would be any variances asked for from the City Codes. Mr. Hedgcoth·replied no. Councilman Hubbard asked if the applicant was aware of the Sign Ordinance. There being no one else wishing to speak, Mayor Pro Tem Ramsey closed the public hearing. 11. Councilman Kenna moved, seconded by Councilwoman Hinkle to approve PZ 83-5, Ordinance No. 1006. Motion carried 5-0. 12. Mayor Pro Tern Ramsey advised the Council the applicant and wanted to build five four-plexes with a private drive from Irish Drive and the plan would have a circulation around it in case of fire the fire trucks could go around and turn around in the complex. Mayor Pro Tern Ramsey stated the Planning and Zoning Commission had recommended approval subject to the Engineers' comments. (' -- ¡. ! . t Mr. Delbert Stembridge, Consulting Engineer, appeared ,before the Council. Mr. Stembridge stated that.Mayor Pro Tem Ramsey had explained basically what they planned to do, and he would answer any questions the Council might have. Councilman Hubbard asked how many acres did the property consist of. Mr. Stembridge stated approximate~y 1.288 acres. Mayor Pro Tern Ramsey called for anyone wishing to speak in opposition to the request to please come forward. Councilman Davis stated there was a letter in the packet from Joseph and Erma Raines in opposition to the request. There being no one else wishing to speak, Mayor Pro Tem Ramsey'closed the public hearing. 13. Councilman Hubbard moved, seconded by Councilman Kenna, to approve PZ 83-6, Ordinance No. 1007, subject to the Engineers' comments. . Motion carried 5-0. Mayor Pro Tern Ramsey advised the Council that according to the Sign Ordinance the Council had to approve permits for billboards. Mayor Pro Tern Ramsey stated that the applicant had met all the requirements. Councilman Kenna moved, seconded by Councilman Hubbard, to approve the request of Kem Advertising Incorporated. Mayor Pro Tem Ramsey stated he would depart from the rules and Let Mr. Kerry Moseley speak. Mr. Mosley stated he understood the Ordinance and they would be in strict ·compliance. Mr. Line stated that the Council needed to auehorize the City Manager to execute the agreement with Mobile Pipe Line for the casing extensions. Mr. Line stated the estimated cost would be $10,107. Councilman Davis moved, seconded by Councilman Hubbard, to authorize the City Manager to sign the letter of agreement with Mobile Pipe Line. Councilman Fisher asked if Mobile would be responsible for moving the lines and responsible .for the safety factors. Mr. Line stated Mobile would be responsible. Motion to approve carried 4-0. 5. Mayor~ Pro Tem Ramsey adjourned the meeting for the Council to go into executive session. Mayor Pro Tern Ramsey called the meeting back to order. AN ORDINANCE by the City Council of the City of North Richland Hills, Texas, authorizing the issuance of $1,500,000 "CITY OF NORTH RICHLAND HILLS, TEXAS, GENERAL OBLIGATION BONDS, SERIES 198311, dated March 1, 1983; prescribing the form of the bonds and the form of the interest coupons; levying a continuing direct annual ad valorem tax on all taxable property within the limits of said city to pay the interest on said bonds and to create a sinking fund for the redemption thereof and providing for the assessment and collection ~f taxes; enacting provisions incident and related to the subject and purpose of this ordinance; and providing an effective date. SECTION 1: That the bonds of said city, to be known as "CITY OF NORTH RICHLAND HILLS, TEXAS, GENERAL OBLIGATION BONDS, SERIES 1983", be and the same are hereby ordered to be issued in the principal sum of ONE MILLION FIVE HUNDRED THOUSAND DOLLARS ($1,500,000) for the purpose of making permanent public improvements and public purposes, to wit: $1,000,000 for street improvements including drainage incidental thereto and $500,000 for acquiring or improving, or both, land for park purposes, under and by virtue of. the constitution and laws of the state of Texas. Mr. Payne said he has had sewer problems and had won a $10,000 settlement. He said if apartments come~ in there, it would only add to the sewer problems. Mr. Payne said it is residential zoning on all sides of this property and he feels the Multi-Family zoning would create both sewer and traffic problems. He said that Smithfield Elementary School h~s been enlarged to accomodate the number of school children and he doesn1t see how this zoning could be in the best interest of the city or the homeowners. John Larriviere, 6971 Cox Lane, came forward. He said he was not sure if Turner Drive could handle the additional traffic this zoning would generate. Mr. Larriviere said Turner Drive had just been resurfaced. He said it is a very narrow street and he did not feel it could handle the traffic; there would be congestion. Rodger Carson, 7024 Crabtree Lane, came forward. He said he wanted to voice his opposition to this request. He said he is a concerned parent. Mr. Carson said his family had lived about a mile from this store 'since 1970. He said it was previously an old landmark, but is now modernized and fixed up with several video games. Mr. Carson said he has a son 12 years old who spends all his allowance there. He said there are so many kids and bikes there until they had to put up signs about moving their bikes. Mr. ·C-arson said hi-s family uses this store because Smithfield Road is not as congested as some of the other major streets. He said he sends his teenage daughters there for a loaf of bread, etc. Mr. Carson said this store is across the street from the First Baptist Church of Smithfield which he has been a member for eleven years. He said the church is about 308 feet from the front door of this store, directly west is the Church of Christ which is 304 feet away and up the street from this store is the Smithfield Methodist Church and across the street just north of the store is the Little Tyke Day Care Center and Smithfield Elementary school. . Mr. Carson said s;-nce he had lived in this area, there has been three different owners of the store, and he knows the economics would be in their favor if they . could sell beer, but he ;s against beer being sold in this location. He said he purchased this property nine years ago and at that time, it was a jungle and in poor condition. He said they have put the sewer through part of the property and filled it in. He said he feels it would be a disadvantage to have to put single family on it. Mr. Allison gave copies of a preliminary plat of the property and some pictures of the area to the Commission. Mr. Allison said this property is close to the city water tank, and there is no market for 1400 to 1500 sq. ft. homes. Mr. Wood asked how long the storage tank had been there. Mr. Bronstad said ft had been there for many years. Mr. Allison said there would be 4 lots, with 4 duplexes, or 8 units. The Chairman opened the Public Hearing and c~lled for those wishing to speak in favor of this request to please come forward. There being no one wishing to speak, the Chairman called for those wishing to speak in opposition to this request to please come forward. BilT Rhodes, ;3628-Wendell Drive, came forward. He said he did not want to stand in the way of progress, but he feels this would be a step backward. Mr. Rhodes said he and his wife selected this area for their home and to raise their children here. He said he felt there would not be adequate fire hydrants for this area and the area adjacent to it. Chairman Tucker stated if the zoning is approved, the City Engineer would review their plat and would tell what is needed and if more fire hydrants are needed, they would be required before the plat could be approved. Mr. Rhodes said also erosion has cut a gulley across the property. He asked if there would be a requirement for the developer to take care of the drainage and keep it off of the adjacent property owners and be responsible for where it would go. He said the City Engineer would check the Topo map and it would have to comply before the plat would be approved. Eddie Hinds, 3513 Tourist Drive, came forward. He said this is the fourth or fifth time this property has come'up for rezoning. Mr. Hinds asked how many times can they request a 'zoning change. Mrs. Calvert said every six months. Mr. Hinds said he bought his home six years ago knowing the water tower was there. He said he enjoys sitting on his porch with a glass of tea and looking at the water ) tower. He said his property is next to the water tower. Mr. Hinds said, he is concerned with the . added traffic this project would make, 16 or more vehicles. He said there would be more~hildren to·p.lay in the area. Mr. Hinds said this is at the bottom of a hill and is very dangerous. Mr. Hinds said rental property. is never kept up and he feels if the d~veloper wants to get his money out òf this property, he should put single family hoMes on it. Rick Rhodes, 3612 Wendell Drive, came forward. He said he had lived in this area for seven years. Mr. Rhodes said they already have a traffic problem. He said you can not see traffic, you have to go up the hill. Mr. Rhodes said it is used as a race track now. He said they also have a lighting problem in this area and a water problem. He said he would rather .have single family homes there. Jesse Loudermilk, 6009 Tourist Drive, came forward. He said his property is immediately adjacent to this property. Mr. Loudermilk said he agreed with everything the others have said. He said he does not feél this request would be an improvement over what they already have. Dennis Baker, 6108 Wendell, came forward. He said he would like to dispute the fact that you can not buy a 1500 sq. ft. home for less than $100,000; he said he just bought a 1900 sq. ft. home in this area for $76,000. Mr. Baker said he was moving from Watauga where most of the homes are now rental property and the neighborhood has gone down since that happened. . Mr. Baker said you can not be choosey who you rent to because there is a Federal Housing Act which makes that illegal. r-. \..- John Butler, 3629 Wendell, came forward. He said he has lived there 7~ years. He said he has a. small child and the traffic is so-bad now that-he can not allow the child in the front yard. Mr. Butler said with multiple family development in this area the traffic would increase at twice the rate as if you had single family there. He said he bought here because it had single family all around. Mr. Butler, said Wendell Drive is on the edge of North' Richland Hills and he feels that is why they have not gotten the attention that some of the other streets get in the city. He said this street is in need of repair and with the added traffic this development would bring, it would only exaggerate this cond i tion. . Tim Thomas, 3636 Wendell, came forward. He said with this additional development, it would cause the depreciation of this area; it would worsen the traffic problem they now have. Mr. Thomas said why discourage the park environment they have now. He said Fossil Creek Park is just now being utilized fully 365 days a year; the trees, the squirrels and the rabbits are beautiful. He said he bought his home in 1970 with the idea it would always be singl~ family in this area and he wants to keep it that way. Mr. Parrish said the tra ffi cis a 1 ready 'bad and wi th the addition of apartments, it would be greater. He said it was hard to get up that hill in icy weather. Mr. Parrish said he had rather have single family dwellings the,re. Chairman Tucker said there had been a legal petition submitted with 14 of the property owners within 200 feet and also a petition of those not within 200 feet of this property. Chairman Tucker closed the Public Hearing. Mr. Hannon asked Mr. Allison if he was the owner of the entire property shown in this plat. Mr. Allison said he was. Mr. Hannon said there was another way he could lay this area out where the water tank would not be in front view. Chairman Tucker said he drove down the steep hill and found very well kept single family homes. He said to plant a different use in this small area, it would be hard for him to look favorable on it. This plat was previously submitted, in 1978, as the "Parkrìdge Estates" (PS 78-101), and the prel iminary plat was approved by the courts. Therefore, we would recommend that the final plat also be designa,ted as the Parkridge Estates to avoid confusion. 2. Please see our comments concerning Riviera Drive in our review letters dated December 7, 1978, and January 9, 1979. We would note that the present North Richland Hills Land Use and Thoroughfare Plan does not show the proposed designation of Riviera Drive west of Rufe Snow. However, if Quail Ridge Drive is used as a collector extension of Riviera Drive through this subdivision to Rufe Snow then we would recommend that the proposed right-af-way width of Quail Ridge be increased from 50 feet to 60 feet and the street constructed to collector standards. This right-af-way width in- crease would require a reduction of 5 feet from the depth of all lots fronting Quail Ridge Drive from Lakeside Drive to Rufe Snow. These revised lots would still meet the minimum requirements for IF-12 zoning. 3. We would suggest that the Developer be required to show that homes meeting the dimensional requirements of the zoning for this sub- division can be constructed on the lots which are crossed by the 3D-foot wide Lone Star Gas easement, without ~ncroaching on any part of the easement area. Also, Lone Star Gas should be consulted regarding their requirements for ingress-egress to the gas line for maintenance purposes. . 4. The citizens in the area call frqm time to time when the barracade is down and remind me that it was agreed that Bridal Path Trail would be barracaded going into JoBeel's. If the street is opened, I am sure we will again hear from the people living on Oakridge and }1esa Verde. The condition of the streets will not stand more traffic. Bridal Path is, dirt and gravel and has had a small,amount of penetration asphalt in one section near Oakridge,and it also is in poor condition. If this is vital to the motel owners they may want to finish these streets. . This will confirm our discussions of March 4, 1983 concerning our .request to appear before the Council to discuss the conditions re- quired to open Bridal Path Trail from Mesa Verde East to the west line of Jobeel's Restaurant. This will provide access from High- way 121 to the property north of Jobeel's which is proposed to be developed by the Texian Inn Corporation. Texian Inn plans to con- struct a 115 room hotel on the site. Preliminary projections are that the hotel will produce $1.1 million dollars in revenues during the first year of operation, with future projections of $1.5 million in the third year. This would provide the City with additional tax revenue from the 4% user tax. We would like to point out the fact that Mesa Verde and Bridal Path Trail are both legally dedicated public right-of-way by plat of Richland Oaks Addition, Third Filing, recorded in Volume 388-07, Page 81, and that the current barricade at Bridal Path Trail and Mesa Ver- de was placed there by the request of surrounding homeowners and is in violation of the City Subdivision Ordinance in that it denies ac- cess to Lot 6 & 7, Block C, of Richland Terrace Addition, Third Fil- ing. The portion of right-of-way from Mesa Verde to the west line of Jobeel's has never been officially vacated. We would like to be permitted access to Bridal Path Trail. (b) No one face of a double-faced or V-shaped billboard shall exceed 700 square feet in area. SECTION 8.4 MAXIMUM HEIGHT The maximum height of billboards shall be fifty (50) feet measured from the ground to the overall top. Approval fœ: taller billboards may be granted by the City Council in those cases where it will reduce clutter and fit 'in more compatibly with the surrounding terrain and structures. No billboard shall be located on the roof or wall of a building. SECTION 8.5 BILLBOARD LOCATION AND POSITION (a) Billboards shall be erected only on private property and shall not pro- .. ct over any public property or right of way. Billboards shall be located within 100 et of the limited access freeway boundary line.
