We do not have any cases for this Board at the present time but we are beginning to send out notices to people concerning their dangerous structures. We are also in need of two alternates for the Zoning Board of Adjustments. The last meeting of the Zoning Board of Adjustments was postponed because of lack of quorum. Since we have appointed Mr. Koss1er to that Board, we no longer have any alternates. In order to develop what we believe will be a more attractive complex, we would like to request a variance for the parking requirement 9f 2.5 parking spaces per unit tQ. 2.0 parking spaces. This would r~sult in a requirement of 312 spaces rather than 390. '-- We believe that the 312 spaces will be more than adequate and that the increased landscaping area will be of more benefit to the surrounding neighborhood than unneccessary parking lot. In the interest of time, we would request that this be placed on the City Council's agenda for consideration at their July 25 meeting. We will appreciate your efforts in this regard. Some of the cities even passed programs whereby a builder would pay the city a fee of $2,000 to take care of major work that had been done to serve in their subdivision or major work in the future. After reviewing these materials I got to thinking about the situation in North Rich1and Hills and I remembered· that in all cases we have required the developers and the builders to pay the~r share of the water and sewer system either by paying the city pro rata shares or building the system into their subdivision. ( In addition to this we have charged a tap fee. This tap fee was based on the size of the meter that the customer desires to have. For instance a 3/4" tap costs $100 for water and $50 for sewer, a total of $150. A 1" tap costs $150 for water and $50 for sewer, a total of $200, and so on up the line until we reach a 2" meter which costs $450 for water and $50 for sewer, for a total of $500. It becomes obvious that in a single family subdivision we collect about $15.000 for a 100 lot subdivision. This is based on a 3/4" tap, This single tap also applies to two-family subdivisions and we collect accordingly. In the case of multi-family subdivisions they generally use 1~" and 2" meters to serve the 100 or so apartments. In the case of multi-family we collect $450 for a 2" tap plus $50 for a sewer tap. a total of $500. This system hardly seems fair to me and I would make the following recommendation to amend our ordinance to require that apar,tment buildings pay a fee based on the number of units. Page 2 Memo July 20, 1983 ---.- any other tap fee and I would recommend $135 per apartment unit. This is based on the fact that most single family fees total $150 but in the case of apartments since they run an occupancy rate of 90 to 99% this would be allowing them a 10% credit. Some would argue that apartments do not receive as much service as an independent homeowner but I do not believe this to be true because an individual homeowner and people that reside in single family homes tend to take care of their property and also not abuse the water and sewer system. You will find in the case of apartment dwellers that all types of objects are put into the sewer system and more service is given to their sewer system. They also have better water service and fire protection than the single family residences because they have more of the city's water mains lying close to where they live. If this sounds like a reasonable plan or if you have any comments concerning this, I would appreciate the input and we could also prepare an ordinance if the Council is agreeable to "a program like this. Attached is a "- summary prepared by Police Chief McGlasson, giving the results of the Police Department study. Also attached is a listing of businesses which have coin operated amusement machines. TEXAS 76118 /' C --'-.- _. .- ( te.~ ~,..<i(' CITY OF NORTH RICHLAND HILLS COIN OPERATED AMUSEMENT MACHINES, ORDINANCE '-- I \, C· ---- BACKGROUND --In March 1977 the North Richland Hills City Council passed a comprehensive City Ordinance (#658) regulating the operation of pool, billiard, recreation or amusement centers. This ordinance defined what was to be covered, the distance each establishment would be from a church, school or residence, visibility into the establishment, partitions, hours of operation, admittance of minors, gambling and use of liquor and the procedure to .secure such a license. The expiration date for all license was set as December 31 with a fee of $25.00 to operate such an establishment and a fee of $7.50 per table or machine located in that establishment. Places of business with three (3) or less machines were exempted from these fees. In May 1981 the initial ordinance was ammended (#895) to grant an additional exemption. If the establishment in which the games were located derived '60% of its revenue from the sale of food no provision of the ordinance applied to that firm. CURRENT COVERAGE The police department has determined from the City Secretary's records that only five (5) establishments in North Rich1and Hills currently are governed by our statute. These five businesses have, as of 1 June 1983, 85 machines and paid $792.50 in permits and fees;, during calendar year 1982. A complete listing of all machines and their location is contained in Appendix "A". ~\- CURRENT EXEMPTIONS '--': Section "I" of Ordinance #658 exempts those establishments with three (3) or less machines from obtaining a permit. There are currently twenty two (22) establishments exempt under this provision. These 22 businesses have a total of forty eight (48) coin-operated amusement games (see Appendix "A"). Section XX-a (Ordinance #895) provides an exemption for a place of business "is that of a restaurant where at least sixty percent of the total revenue is from food sales". There are currently thirteen (13) businesses that are exempt and have three or more games. These establishments have one hundred twenty three (123) games that would have been covered by this ordinance were this exemption not operative. One firm (Richland Cinema) has four (4) machines and does not have a video-game permit. This firm is apparently unaware of the requirement that they purchase a permit. If all machines currently exempted from coverage were placed under Ordinance #658 the number of covered machines would be raised by 148-from the current 85 to 233, (this includes the four (4) machines, currently not registered that should be covered under our ordinance). RECOMMENDATION '--- The current revenue of $792.50 could be increased to a projected $2,577.50 (a net gain of $1,785.00) if Ordinance #658 was ammended to remove the "3 game exemptj.on" and Ordinance /1895 were rescinded to remove the "60% food income" exemption. Adoption. of the attached ordinance, designed to totally replace (- \. '-- (~ '~-"" '-- the existing ordinance, and the ammendments, would result in a g~in of $1,980.00 not covered under the existing ordinance that would be covered by the proposed ordinance. This partially as a result of the increase in fees and partially as a result of extending the ordinance to 'all such games in our jurisdiction. If the City Council chooses to adopt the totally revamped ordinance we recommend that the "Change-over" date be set as January 1,1984 so that we may advise our existing operators that they must comply by that date. i ~ APPENDIX A r:. .. He stated they had received the City Engineer's letter and take no exception to it, but would like to ask one question in regard to the pro rata for the 6 inch water and 6 inch sewer lines. Mr. Fluitt said there are existing water and sewer and he believes it is the council's policy that if there are existing water and sewer, no pro rata is required. As I understand it the developer's engineer stated that it has been Council policy in the past not to require pro rata and in these instances I do not know where he gets this information and I disagree with it. Mrs. Byrd said it is not being used for anything now. Mr. Schwinger asked Mrs. Byrd if they plan. to use the lot for a car lot from now on or just until they sell their Hire a Heap cars. Mrs. Byrd said they plan to use it from now on. Mr. Hannon stated it is the coúncil's policy to put a limit of the age; of the cars to not more than two to three years old. He asked Mrs. Byrd if they would agree to that. Mrs. Byrd said they could not because their cars are older that that and they need to get rid of them. Chairman Tucker said Mrs. Byrd stated they would be selling these cars out of their office at Byrd Automotive. but all sales would have to be on this lot. not out of the shop because if is not zoned for it. Mrs. Byrd said they would do the selling on this lot if they needed to. Mr. Bowen asked how old their cars were. Mrs. Byrd said they were 1978 models. Mr. Bowen asked if they plan to sell later model cars also. He said Belknap Street in Fort Worth has lots and lots filled with old used cars and he would not be in favor of having that in our city. Mr. Bowen said he felt they must have a stipulation of . not more than two or three year old cars after they get rid of the old Hire a Heap cars. Mr. Bowen asked if they were completely out of the rental business. . Mrs. Byrd said they were. Chairman Tucker called for anyone wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. Mr. Bowen said he did not see how she could get rid of these old cars. Chairman Tucker said with a Specific Use, they can stipulate such things as giving them 12-14 months to dispose of these cårs and from then on limit the sale to no older than 3-year models. He said this would put a burden on the city to see that the ordinance is carried out. Mr. Wood said he did not see how the city could monitor than; they would have to be going out there all the time to see what year models they were selling. He said he felt they should either be allowed to sell all cars or sell none, and he was in favor of the latter. Mr. Wood made the motion to deny PZ 83-42. This motion died for the lack of a second. Chairman Tucker said that was correct. Mr. Wood asked if they would have to clarify what cars they now have. Chairman Tucker stated that would be left up to the City Staff and City Council. He said this tract has been zoned different ways two or three times in the past. Mr. Long stated Mr. Collins acquired this property and is willing to develop the whole tract and does not wish to wait for the retail development to come in, he wants to make the whole tract a duplex complex. Mr. Sturch said he has talked with the developer and it sounds like it would be a good development. He said he had seen some duplexes he has built and they seem to be of good quality. Mr. Sturch said he believes he had rather have duplexes there than Local Retail. William Gideon, 7717 Chapman Road, came forward. He stated he lives north of this property. Martin Survey, Abstract 1055, from their present classification of 1F-9-1500-0ne Family Dwellings to proposed classifications of 2F-9-Two Family Dwellings and Mu1ti-Fami1y-Quads. This property is located approximately 200 feet east of Crane Road and extends eastward to approximately 200 -feet west of Precinct Line Road. Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Mr. Garrison came forward. He stated they are requesting a portion of their land be rezoned from 1F-9 to 2F-9-Dup1exes and a portion for Specific Use for quadrop1exes. rMr. Garrison showed the Commission and the audience exhibits of the area. He said they have approximately 20:acres which joins Mr. James Rust tract. Mr. Garrison said they plan to leave 4 ~ « lots single family, then have the duplex lots around the perimeter, and the the southeast portion would be for the quadroplexes. Mr. Garrison stated he and Mr. Rust had agreed to develop their-land together and they would hear Mr. Rust's request next. He said Mr. Rust's property is presently zoned Multi-Family, but he would be requesting, if this case goes through, to down-zone his property to Specific Use for quadroplexes. Mr. Garrison said if this case is denied, he and Mr. Rust will go their separate ways on the development of this land. Chairman Tucker asked how many living units he plans for the 20 acres. Mr. Garrison said he thought Mr. Rust's property would fall-under the Grandfather clause. Mr. Hannon asked what did he mean by this, does it vary from our existing Multi-Family zoning requirements, does it have more density. Mr. Bronstad said it had been zoned Multi-Family for several years and it might allow more density, he was not sure. Mr. Hannon asked if they could find out about that tonight. ~ . Mr. Bronstad said they could not. Chairman Tucker stated there were 136 living units not counting Mr. Rust's property. He said Mr. Rust would be cutting his down considerably at the present Multi-Family requirement. Mr. Hannon stated with the present single family zoning, Mr. Garrison would have approximately 70 units instead of 136 units. Chairman Tucker said the total for both projects would be approximately 216 to 220 units. Mr. Garrison showed more details of the plot plan and elevation plans of . the proj ect. '" .' r:¿. ~ Gerald Stewart, 8840 Ma~n S,treet, came forward. He said he was speaking for the homeowners both in North Richland Hills and in Hurst who are opposed to this request. He stated he has a petition with over 200 names who are in opposition to this request. Mr. Stewart read from the City Zoning Ordinance which states Multi~Family zoning shall be located near major thoroughfares and preferably joining business zoning. He stated there is no business zoned property around; it is all single family homes, and the streets are not major thoroughfares. Mr. Stewart stated these people here invested their life savings here to provide a home to raise their families in the peace and quiet of this neighborhood. £ Mr. Stewart said in 2F-9 zoning,- he can build 2~ stories with 1000 square foot flo~r space and 3 stories ~ith 750 square foot floor space in the Multi-Fa~ily zoning. He sa;d t~is is not congenital to the property out there now. Mr. Stewart said the people who live in this area feel that what they have is worth defending. He said with this development, it would mean having lease property and rental property in the area and thèy do not need or want that. Mr. Stewart said they want the same type development as is already there. He said they oppose this pyramid effect and this also applies to Mr. Rust's request. Mr. Stewart said they met with the Planning and Zoning members who asked for a compromise, but the homeowners do not want a compromise. He said he talked with several real estate people who said these 8 single family lots they show will be unsel1ab1e. Mr. Stewart said they are having trouble selling homes in the area now and will have more trouble if duplexes and quadroplexes go in thère. Page 10 P & Z Minutes May 26, 1983 ~. Mr. Stewart said in regard to access to this property, they say Precinct Line Road is scheduled for a 5 lane by 1990, but it is not there now and does not help us now. He said it is a single lane road now and very congested. Mr. Stewart said Crane Road is also a congested county road that can not possibly handle this development. Mr. Stewart said he had rather-have the single family plan that Mr. Garrison submitted previously. Earl Region, 9200 block of Martin Road, came forward. He said he owns property to the south of this r property. He said his property-.is 400 feet wide and 800 feet deep. Mr. Region s~id he was concerned ab~ut the drainage. He said water had already been in ~r. Campbell's house who told him he ~á.w 8 inches of water goIng down Martin last year. Mr. Region said the 40 foot drainage shown goes to his property and does not know how he can do that legally. Chairman Tucker said without easements, he can not. Mr. Region said he does not have an easement to go across his property. Chairman Tucker said this problem would be taken care of in the platting and if Mr. Region did not give the easement, he could not put the drainage there. Cleta Oggier, 6821 Precinct Line Road, came forward. She said their proper~y was to the north of the property in question. Mrs. Oggier said Mr. Garrison stated his reason for requesting this change to Multi-Family was the escalation cost, but she said Page 11 P & Z Minutes May 26, 1983 '-- --- ~ ~::.:,~~ ;~::~:f';~ '" the escalation cost is not as great as he says. She said for the last two years, there has not been a demand for single family lots, but now there is" Mrs. Oggier said,he could sell these lots and still make money. She said she understands the cost of installing utilities, etc. has increased, but the value of the land has increased, also. Mrs. Oggier said the roads are not adequate now and it would be multiplied with this development. Mrs. Oggier said in the summer, they have a shortage of drinking water. Mrs. Oggier said she was requesting this property be left single family. Stanley Tatarevich, 6820 Crane Road, came forward. He said in regard to the str~ets, Hurst has turned down the widening of Precinct Line Road until 1990, and Crane Road, thanks to-· Tarrant County, they put some gravel on it; a~d Martin Lane being only two lanes, there is hardly enough room for two cars.. to pass and it gives v~ry little room for the children to walk to school. Mr. Tatarevich said about the sewer system, there is an 8" line going down Main Street, from Crane Road, down to the creek that joins Smithfield Junior High and at that point we have a 10" and a 12" line that goes South. He said with the increased development, this would be overloaded and Hurst is not going to let them tie onto their's because their's is full. Mr. Tatarevich said they do have a water shortage. He said it is not very good when- you are in the middle of taking a shower, and you find you have no water. He said it doesn't happen one time a year, it happens 5,' 6, to 7 times a year without any adequate warning. Mr. Tatarevich said the drainage was bad, it drains down and when it rains you tread water for about 100 yards on Martin. Mr. Tatarevich said the two school systems are already full. He said he called Smithfield Junior High and was told they had 825 students and they could only handle 90 more students within the next 2 years, but said they were experiencing heavy problems in the cafeteria now. He said Porter Elementary is located in Hurst and the Principle said it has 493 students now and they can only take an additional 50 students and their cafeteria-. problems are the same way. So the school system would have to be ~ updated. ~ . Mr. Tatarevich said Multi-Family housing does not pay their share of taxes Mr. Tatarevich said his main reason for not wanting this development is he built out there 16 years ago and they have a nice house with a green area, wild life, and he hates to see all the birds, squirrels, road runners, and rabbits go and get apartments in their place. He said he requests the' Commission take into consideration every property owner in this area and give them a fair shake. Oscar Oggier. 6821 Precinct Line Road, came forward. He said regardless who developed this property or what developed there, he and his wife are· asking for water and sewer for their West 2.5 acres. He said, they want (provided the Commission approves) an 8' fence with 6" posts all along their South property line. Page 13 P & Z Minutes May 26, 1983 '---.- '- r::::::1' ~~~¡ ~ Mr. Oggier said Mr. Garrison is requesting a 81.5% increase in square footage and a 159% increase in living quarters over single family and Mr. Rust is requesting a 20.9 decrease in building square footage and a 33 1/3% decrease in number of living quarters. He said Mr. Rust could be giving up one or two swimming pools, one Manager's apartment, one game room and bar, one full time maintenance man, off-street parking, etc. Let Mr. Rust have his apartments zoned and deny Mr. Garrison everything other than large single family dwellings. He said good city planning, good developers, and builders are an asset to the city. He showed an alternate plan for nice condominiums and single family dwellings, all would be owners, not renters. F Foy E. Moss, 752 Spring Valley;-~urst, came forward. He asked what the city of Hurst_ has to say ab()ut this '::_ project, what were their comments to you. ~ . Chairman Tucker said we have a petition from the citizens of Hurst, nothing from the city of Hurst. Mr. Moss said this plat does not show .an easement for the widening of Precinct Line Road. He said on the Hurst side of Precinct Line, they require an easement for the widening of Precinct Line Road. Mr. Moss stated he felt it would be a mistake to approve this without this easement for future widening of the road. Mr. Wood stated the plat does show a 25 foot R.O.W. easement on the official plat. Tom Butt came forward. He said he lives in Hurst about 100 yards from this project. She said they have children who play on Main Street because they do not have the traffic congestion, but with this project, the traffic would double what they have now; plus they do not have speeders going forty miles an hour down the street, it is a quiet area so lets keep the single family zoning. Chairman Tucker asked for a show of hands of everyone present who are in opposition to this request. Chairman Tucker closed the Public Hearing. Mr. Wood. asked Mr. Garrison aboút the drainage into the lake, had he _ attemptep to get the 40 foot ea~ement. Mr. Garrison said the city of North Richland Hills has acquired that easement and they require us to reimburse them for it. It is owned by the city of North Richland Hills. Chairman Tucker asked Mr. Bronstad about this, how far does it go. Mr. Bronstad said it goes almost to the lake. Chairman Tucker asked where does it go from there. We reside at 8920 and '8912 Martin Lane in North Richland Hills, Texas, and are very interested in the proposed zoning case affecting the property between Crane Road and Precinct Line Road. Martin Lane has become a major traffic artery for traffic out of the Glenan. Addition, thru traffic ·from Davis to Precinct (both ways) and even traffic from some of the new-sub-divisions farther north. EVen now there are three additional sub-divisions being developed between Eden Road and Precinct Line Road. . We both feel it is imperitive that additional streets be developed to Precinct Line Road. Most tracts on Precinct Line Road in that area are small tracts under separate own~rship and will be Véry unlikely to dedicate streets without condemnation preceedures. Therefore we both wo~ld like to go on record as favoring the zoning change to allow the street from Crane to Precinct Line Road. .r~ ~ u......(... Mr. Kimmell stated that this request was for approximately 67 acres on Chapman Drive. Mr. Kimmell stated that immediately east of this tract the property was undeveloped, but was zoned 2F-9; at the southeast corner the property was zoned commercial; the property to the south was zoned industrial, but undeveloped; and the acres to the southwest is North Park Estates, which is zoned 1F-7; the property to the west is Richfield Park with Agricul- tural zoning; the property to the west of Richfield Park was developed and zoned IF-7; the other areas to the west of this property is zoned 1F-12; the properties to the north and northeast are undeveloped and are zoned Agricultural; and the northeast corner is McComas Addition, which is developed and is zoned IF-9. Mr. Kimmell stated their zoning request covers three different levels, on Chapman Road they are asking for IF-9 zoning with 1,500 square foot minimums. Mr. Kimmell stated according to the tax records, 92% of the existing homes in McComas Addition arß under 1,600 square feet. Mr. Kimmell stated they felt the 1F-9 zoning was a good transitional zoning between the development to the north and their proposed development to the south. Mr. Kimmell stated where their property joins North Park Estates they are requesting 1F-8-1400. Mr. Kimmell stated they are requesting a higher zoning than North Park and that the tax rolls show 95% of the homes in North Park are under 1,500 square feet. Page 33 P & Z Minutes May 26, 1983 Mr. Kimmell stated that they were requesting 1F-8 zoning for the balance of their tract, which is equal to or better than all the other residential zonings, as far to the west as Rufe Snow Drive, as far south as Watauga Drive and as far to the east as Smithfield Road. Mr. Kimmell stated they feel they are compatible to the zoning in the area. Mr. Kimmell stated that there had been some discussion of a north-south collector street in this general area. He stated they are proposing to plat Fox Hollow Lane a 60 foot width which could be used as a collector street if the City so desired. Mr. Kimmell stated they could make either Fox Hollow Lane or Little Ranch Road as the collector street on the final plat. , Mr. Kimmell stated that in North Park Estates there was a Y-inlet in which most of this 67 acre tract drains into. Mr. Kimmell stated their drainage and storm sewer plans would divert that run off to a series of sewers existing out of these cul-de-sacs into the creek that is in the park area. Mr. Kimmell stated he had visited with the City Staff and they see no problem with this. He stated this should alleviate the flooding in this area. Mr. Kimmell stated they had only four lots in their proposed development that would continue to drain into that Y-inlet. Mr. Kimmell stated they felt the zoning they were requesting was complimentary to the existing development in the area and requested approval of this request. Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please corne forward. Page 34 P & Z Minutes May 26, 1983 Mr. Owen Long came forward. Mr. Long stated he owned the property to the south of this property, which was presently zoned industrial. Mr. Long stated he planned to come in at a later date and vacate the plat of Fox Hollow Addition. He stated he had no real concern with the proposed development to the north of them. Mr. Long stated he was doing the engineering on this and it would be submitted next month. Mr. Long stated there would be a concrete lined channel thru this property, and it would be on the Planning and Zoning's next agenda. Mr. Long stated they planned to realien and restructure that drainage ditch. Mr. Long stated Fox HolLow Lane could be a collector street, they have had a box culvert at the railroad and had been paid for for eight or nine years, so it would not be hard to made Fox Hollow Lane a collector street. Chairman Tucker called for those wishing to speak in opposition to this request to please come forward. Mr. Ted Gay, 6440 Sudbury Way, came forward. Mr. Gay stated he was not against the development; however, the traffic needs to be addressed. Mr. Gay stated with the construction of Rufe Snow, it mades the traffic more congested and if they had a north south route, they were going to have a lot of traffic down Little Ranch and will cause problems getting on Watauga Road. Mr. Gay stated he would like to request this zoning be denied until a traffic pattern was worked out and try to get this Fox Hollow Lane tied down more. Mr. Tom Ferruggia, 6448 Sudbury Way, came forward. Mr. Ferruggia stated he had had flooding at his house for several years. He stated he had Page 35 P & Z Minutes May 26, 1983 called the City to see if they could do anything about it; the City said they did not own the land and could not do anything about it. Mr. Ferrugigia stated he had had to open his gate in his back yard and let out 3~ feet of water. Mr. Ferruggia stated he was in agreement of the development of this land, but he requested that they insure that the land will drain correctly. Mr. Ferruggia stated his other concern was in regard to square footage. He stated his house was approximately 1,585 square feet and asked what the proposed zoning would be next to him. Chairman Tucker said it would be 1,400 square feet. Mr. Ferruggia said he had his house up for sale earlier this year, but took it off the market. Mr. Ferruggia stated he may try to sell it again and would not want anything to hinder the market value of his property. Mr. Ferruggia stated he would request to increase them a 100 feet or so. Mr. Calvin McKutchin came forward. Mr. McKutchin stated he lived on Sudbury Way. Mr. McKutchin stated he wanted to reiterate what the previous gentlemen had said about the traffic and the flooding problems. He stated he would request they made sure that Fox Hollow Lane is made a collector street and also that the property drains properly. Mr. Dan Patterson, 6445 Sudbury Way, came forward. Mr. Patterson asked what was in the Master Plan in regard to Little Ranch Road or Fox Hollow Lane to alleviate the traffic congestion. Mr. Bronstad stated they have been taling about Conett Blvd. for several years, but don't know when the Council will approve the work on Watauga Road, they have not set a target date yet. Page 36 P & Z Minutes May 26, 1983 Mr. Bronstad stated right now they are working on Phase II of Rufe Snow Drive. Chairman Tucker said there is both an east-west and a north-south thoroughfare in the Master Plan, but that is all the information he has to give; it is up to the Council to put them into the fiscal year's budget and fund those plans. Mr. Patterson said he felt they are getting the cart ahead of the horse, and that we need the streets now before the development. Chairman Tucker said it takes time to build streets. Mr. Kimmell stated their plans now are to develop in four phases. He stated when Little Ranch Road is opened up to Chapman Drive, it would giv~ these people in North Park another outlet. Chairman Tucker asked what his projection of time was. Mr. Kimmell said about two years. A man living at 7235 Sandhurst came forward. He stated he was against Little Ranch Road being made a thoroughfare. He stated unless you releave the traffic problem on Watauga Road and Rufe Snow, you are still going to have a problem. He stated his only concern about this develop- ment was the traffic, getting in and out of the area. Mr. Roy Hodo, 6724 Mabell, came forward. Mr. Hodo asked if the green area shown was for 1,500 square foot homes. Mr. Kimmell stated it was. Mr. Hodo asked where the drive approaches would be. Page 37 P & Z Minutes May 26, 1983 Mr. Kimmell stated they would be off Chapman Road. Mr. Hodo said Chapman Road is unbearable at its best and now this plan is to have cars backing out onto Chapman Road. He stated the street is full of chug holes; when it rains Chapman Road floods, and nothing has been addressed about this problem. Mr. Hodo said when you add this many houses you have not provided any exits to get out of the area; you will just be congesting the area more. Mr. Hodo stated he understands the streets are the City Council's problem, but if the City Council is not meeting the needs of providing entrances and exits of the area. Chairman Tucker said he wanted to explain that in a zoning request, we consider the best use of the land and we get to the next request, the platting, that is when the roads, the drainage, and how the cars drive in and out will be discussed. He stated we can give them the zoning and deny the plat if the roads are not laid out properly or the drainage is not sufficient. Mr. Hodo stated he would wait for the platting request. Mr. Hodo asked if this area was in the flood plane. Chairman Tucker said it was not. Chairman Tucker closed the Public Hearing. Mr. Bowen stated he was concerned about square footage. Mr. Bowen stated he understood the need for smaller lots, but he was concerned about the number of 1,200 square foot homes. Mr. Bowen asked if they would be willing to change their ratio some. The Environmental Protection Agency, Region VI, has agreed that this demonstration can be accomplished through the execution of a contract amendment with the Authority's customer cities. Accordi ngly, we have enclosed a proposed contract amendment (Attachment 1), which incl udes all of the provisions needed for EPA approval of the CRWS pretreatment program. If the proposed contract amendment is sati sfactory, the following steps should be taken to provide the Authority with documentation required for pretreatment program approval by EPA: 1. execute contract amendment; 2. revi se City Ordi nance as needed to carryout provi si ons of the contract amendment; 3. obtain Council resolution endorsing the pretreatment program (see example, Attachment 2); 4. obtain statement from City Attorney indicating that City has adequate legal authority to implement provisions of the contract amendment and identifying how the City plans to enforce compliance; and 5. provide Authority with copies of items 1 thru 4. Some of the CRWS customer cities have indicated that they plan to do all of the things required in the pretreatment program, whereas others have indicated that they prefer for the Authority to perform many of these responsibilities. Preamble WHEREAS, on June 26. 1978, the United States Environmental Protection Agency published a rule (Amended January 28, 1981) which established mech- anisms and procedures for enforcing National Pretreatment Standards con- trolling the introduction of wastes from non-domestic sources into Pub- licly Owned Treatment Works (POTWs); and WHEREAS, this rule, 40 CFR 403, requires that a Pretreatment Program be developed for the Central Regional Wastewater System; and WHEREAS. the Trinity River Authority of Texas, as the owner and operator of a POTW, must comply with rule 40 CFR 403; and WHEREAS, the City, as a contracting party of the Central Regional Wastewater System. has entered into an Amendatory Wastewater Contract with the Trinity River Authority of Texas whereby the City has enacted ordinances that are necessary to implement and enforce the National Pre- treatment Standards; and WHEREAS, 40 CFR 403.9(b) requires a statement or resolution reflecting the endorsement or approval of the local boards or councils responsible for supervising and/or funding the POTW~ NOW. Mayor, City of ATTEST: AMENDATORY WASTEWATER SERVICE CONTRACT STATE OF TEXAS CITY OF NORTH RICHLAND HILLS COUNTY OF TARRANT TRINITY RIVER AUTHORITY OF TEXAS CONTRACT AMENDMENT WHEREAS,- the City of North Richland Hills, Texas, (the "City") has duly executed and entered into a CONTRACT dated as of the 28th day of May, 1975, with the Trinity River Authority of Texas (the "Authority") providing for wastewater servi ce to the Ci ty (the "CONTRACT"), to whi ch CONTRACT reference is hereby made for all purposes; and WHEREAS, on June 26, 1978, the Uni ted States Envi ronmental Protecti on Agency published a rule (Amended January 28, 1981) which established mechanisms and procedures for enforcing National Pretreatment Standards controlling the introduction of wastes from non-domestic sources into Publicly Owned Treatment Works (POTWs); and WHEREAS, thi s rul e, 40 CFR 403, requi res that a Pretreatment Program be developed for the Central Regional Wastewater System; and WHEREAS, the Authority, as the operator of a POTW, must comply with rule 40 CFR 403; and WHEREAS, it is deemed necessary that Sections 1, 4, and 8 of the CONTRACT dated May 28, 1975, be amended. NOW, therefore, in consideration of the mutual covenants and promises contained herein, the City and Authority agree as follows: THAT Section 1.01 of the CONTRACT is hereby amended to include the following definitions: (bb) Industrial User (IU) - Any person, including but not limited to, any individual firm, partnership, corporation, association, municipality, or any other 1 egal enti ty, who di scharges or desi res to di scharge industrial wastes to the Central Regional Wastewater System~ (cc) POTW - Publicly Owned Treatment Works as defined in 40 CFR 403. (dd) Significant Industrial User (SIU) - Any industrial user who is connected or desires to connect to the City's domestic wastewater collection system and meets at least one of the following criteria: (i) Average industri al wastewater di scharge rate greater than 50,000 gpd. (ii) BOD and/or suspended solids concentrations in industrial waste- water greater than 250 mg/l . (iii) Industrial category regulated by National Pretreatment Standards as promulgated by the United States Environmental Protection Agency. (ee) Total Toxic Organics - The sum of all detected concentrations greater than 10 micrograms per 1 iter for all organic compounds classified as priority pollutants by the United States Environmental Protection Agency. THAT Section 4.03(a), of the CONTRACT is deleted and the following 1 anguage substituted therefor: To enabl e the hi ghest degree of treatment in the most economical manner possible, and to comply with Federal and State regulations, certain solids, 1 i qui ds and gases are hereby prohi bi ted from enteri ng Authori ty I s System in excess of standards as set by sai d Federal and State regul ati ons. The prohibitive discharges listed below shall apply at the Points of Entry. Federal and state regulatory agencies periodically modify standards on prohibitive discharges; therefore, revision to, additions to, or deletions from the items listed in this section will become necessary to comply with these latest standards. It is the intention of this CONTRACT that prohibitive discharge requirements be reviewed periodically by Authority and revised 'in accordance with the latest standards of any federal or state agency having regul atory powers. Any requi red revi si ons shall be made and wri tten notice thereof given to the City. City shall be responsible for integrating such changes into the local industrial waste ordinance and notifying all affected users of the change within ninety (90) days following written notice to the City of such change. The effects of certain types of Industri al Waste upon Wastewater and Wastewater treatment processes are such as to requi re that careful consi derati on be made of each i ndustri al connect ion. Thi s is a matter of concern both to Authority and to City. The Ci ty covenants that it wi 11 have in effect and wi 11 enforce an i ndustri al waste ordinance acceptable to Federal and State agencies or departments having 1 awful juri sdi ct i on to set standards ,\or waste di scharges. Thi s ordi nance will include both but not be limited to the following provisions: (a) For each existing and future SIU, the City shall require said user to compl ete and submit a permi t appl i cati on contai ni ng that i nformati on specified in the attached sample application (Exhibit 1). The Authority shall be provided a copy of the permit application within thi rty days after recei pt by City. Authority shall provi de comments on said application within thirty days of receipt and return comments to City. Failure to comment within thirty days of receipt of the application shall be construed as concurrence by Authority. After approval of the permit appl ication by both City and Authority, the Ci ty may issue a permi t to di scharge whi ch shall be as shown on Exhibi t 2. Sai d permit to di scharge shall be requi red of all SIUs before sai d user wi 11 be allowed to di scharge i ndustri a1 wastes into the sewage system. A copy of the permit to discharge shall be forwarded to the Authority. (b) The City shall require SIUs to comply with applicable Federal Categori cal Pretreatment Standards as well as any appl i cab 1 e state and local standards. (c) The City shall maintain certain information contained in permit applications as confidential at SIU's request. (d) The City shall di sall ow dil uti on as a means of reduci ng poll utant concentrations in an SIU's waste stream. (e) The City shall be authorized to enter SIU premises at any time for independent monitoring, inspection, or review of applicable records to determine compl iance. (f) The City shall develop and require adherence to SIU compliance schedules. (g) The City shall require sel f-monitoring and reporting at SlUts expense. (h) The City shall choose or approve laboratory to analyze industrial wastes. (i) The City shall require SIU's to pay applicable fees for: (i) sampling and testing to determine compliance (ii) disconnection/reconnection of service resulting from non- compliance (iii) abnormal strength wastes (iv) additional costs incurred by City or POTW in transporting or treating wastes (v) filing, revision, or renewal of permit application (j) The City shall provide public notification for instances of violation. (k) The City shall deny/revoke permit, di sall oW/di sconnect servi ce, assess civil or criminal penalties, and seek other available legal and equitable remedies against SIU for: (i) discharge to sewerage system resulting in violation of POTW's discharge permit conditions (i i) haza rd to health or 1 He of POTW personnel or users of recei vi ng waters (iii) violation of any applicable ordinance or regulation (iv) false information transmitted to approving authority through permit application, monitoring reports, etc. The Ci ty shall furni sh to the Authori ty all documents and records, in addition to those outlined herein, as necessary to demonstrate compliance by all industries. All provisions contained herein are in addition to those contained in the CONTRACT entered into between the parti es dated May 28, 1975. These Amendments and the original CONTRACT, except those provisions in the original CONTRACT which have been specifically deleted, shall be construed as ~ single agreement. Such 10-year capacity shall extend downstream from the point of discharge or the developer s property line which ever is greater, a distance of at least 100 ft. Typical examples of such "recognized watercourses" are the main channels of Mackey, Calloway, Walker, Big Fossil, Little Bear, and Mesquire Branch Creeks, or those tributary creeks, streams, channels or underground storm drains which meet the hydraulic capacity requirements_öf a "recognized watercourse". The developer is responsible for constructing all off site channelization or underground storm drain with overland relief, required to discharge concentrated stormwater from the low end of his development to the reconginzed watercourse, and also to obtain all necessary easements from intervening land:'owners. It is our hope that the City of North Richland Hills will allocate $ 1,000 for these services (the same level as last year) . It is important to note that while the hours and range of services we are providing your community and your Police Department are steadily increasing, we are not asking your City to increase its financial support for rape crisis intervention and prevention services. Instead, we are asking more communities, especially in the Mid-Cities area,to fund a modest share of the cost of a County-wide comprehensive rape crisis program. This year the Rape Crisis Program has served the best interests of your citizens and your pOlice department well by encouraging and assisting the implementation of rape exams in the Mid-Cities area, a strategy that will directly benefit the Cities of North Richland Hills, Hurst,Euless, Bedford, Richland Hills, Haltom City, Watauga, and Keller. Formerly, police officers in these cities had to accompany sexual assault victims to John Peter Smith Hospital in Fort Worth, typically waiting 4-8 hours for the completion of a rape exam required to preserve evidence and enable prosecution. Now, police in these cities will accompany victims to Northeast Community Hospital, where rape exams should require only about an hour - a clear benefit to Mid-Cities sexual assault victims and their families and a clear savings of police hours and tax dollars for each City. In setting up rape exams and rape crisis intervention services at Northeast Community Hospital, our role included: · Advocacy and collaborative planning wi th local police departments and medical personnel. A IV A United Way Agency · Helping to train the volunteer physicians and the nurses who will conduct rape exams and assist local victims. Further in-service training for medical personnel will be provided at regular intervals. · Recruiting, training, and supervising a cadre of 30 Hid-Cities volunteers who will provide crisis counseling at NEC Hospital and follow up services for Hid-Cities victims and their families. One of the reasons that rape crisis services are so cost effective in your community is that these trained volunteers will donate over $ 10,000 worth of time and travel annually to the Hid-Cities Rape Crisis Project. In addition to these enhanced services, the citizens and police of North Richland Hills will continue to benefit from the services that the Rape Crisis Program of the Women's Center regularly provides in Tarrant County. (Please review the enclosed list of services and the Rape Crisis Program's record of service to the City of North Richland Hills (June 1982 - June 1983). The importance of our program lies not just in the number of your citizens we serve annually, but in the fact that we stand ready 24 hours a day to assist your Police Department and your citizens with sexual assault counseling, professional training and assistance, and crime prevention programs. Other counseing services including telephone and inperson counseling, follow up and accompaniment through investigative and legal processes. d. Support/Recovery groups for sexual assault victims and family members. 3. Recruiting and training of volunteers - an active roster of over 100 persons. 4. Rape prevention/awareness programs designed to reduce the individual risk of sexual assault and raise community awareness of sexual assault issues. 5. A child sexual assault prevention program that targets school age children throughout the County. 6. Technical assistance and training for professionals, including police, medical personnel, counselors, and pastors. FACT ~ RAPE CRISIS INTERVENTION AND PREVENTION SERVICES IN TARRANT COUNTY - 1983 THE CRIME. · In 1983 Tarrant County sexual assault victims ranged in age from 18 months to 94 years. · 20-25J of all local victims are children under 14 years of age. · 50J of Tarrant County victims were assaulted in their own home. · If present levels of rape and sexual assault continue in the United States, 1 out of every 3 females can expect to be sexually assaulted in her lifetimes. · National studies show that 1 out of every 4 children in America is sexually assaulted before the age of 10 - 10J of little boys; 33J of little girls. · The FBI estimates that only 1 out of every 10 sexual assaults is ever reported to police because victims are either too young to report or fear personal and and family stress and additional trauma during the criminal justice process. · Since rapists and sexual offenders repeat their crimes again and again until they are apprehended and imprisoned, encouraging higher levels of reporting and prosecution by providing adequate and widely publicized victim services is a key crime prevention measure. · Most police officers have not received specific training in sexual assault investigation or handling of rape trauma syndrome. · A recent survey designed by UTA Professor Tom Marshall and commissioned by the Coalition of Women's Political Organizations show that citizens in Tarrant County consider rape a more serious crime than armed robbery or selling heroin; 75% favor stiffer penalities for sexual offenders. THE PROGRAM. . To deliver 24-hour rape crisis services throughout Tarrant County, a paid staff of 3 1/2 persons recruits, trains, and supervises 142 volunteers, who donate over $200,000 worth of time and travel to the Rape Crisis Program every year.
