SUBJECT: Lack of Adequate Water on Precinct Line Rd.
I would like to discuss this problem at the next pre-council
meeting. I talked to Rex on the phone aboút the Oak Leak
MDbileHome Park requesting that we send a letter that they
can continue to dev~lop this mobile home park. Rex was of
the opinion that if there was any improvement at all on the
undeveloped section that they could go ahead and put in more
pads. The only improvement that was there at the time that
Rex checked this out was gas stub-outs and only a few new drives
had~been cut.
Rex suggested that in pre-council we discuss the possibility
of resolution by the Council that due to the water situation
we cannot let them expand the mobile home park and probably
word it so that if someone on a five acre tract wanted on
the line ~hey could get on but no heavy concentration of
new customers could get on.
~ex would have to word the resolution or ordinance stating
that the mobile home park had the maximum number of mobile
homes that could. be served on that water line.
Rex should be at the pre-council meeting to discuss this
matter and give his advise' on it and also to work the
resolution or ordinance.

Gentlernen:

My client, Don Noblit, who owns Oak Leaf Mobile Home Park, has· recently
been told verbally that he could no longer obtain any permits for the continued
development of his existing ·park. In 1980 a similar problem arose and Mr.
Noblit employed the firm of George Staples to attempt to resolve the matter.
A t that time it was submitted to Rex McEntire and the matter apparently was
resolved by the letter dated September 19, 1980 a copy of which is enclosed.
Subsequent to that Mr. Staples also received a letter dated September 23, 1980
àirectly from the City of North Richland Hills concerning the same matter. A
copy of thô:t letter also is enclosed.
Now Mr. Noblit has the opportunity to sell his mobile home park but he must
furnish assurance to his purchaser that Mr. Noblit and his transferees can
continue to use the property for mobile homes and can continue to develop the
property for mobile homes. Would you please send us a letter assuring us that

This letter is sent as an answer to your letter dated September
9, 1980.
All information regarding this matter was turned over to the
City Attorney, Rex McEntire.
After several days, the material was returned to me with a note
attached from r~r. McEntire saying: "I have checked through the
property and its use-history. It is a non-conforming use which
has never been abandoned. Give him his permits. II

Bob Brady, Real Estate Agent, came
forward to represent Mr. & Mrs. Brown.
He said because of the nature of the
changes in that neighborhood, they
feel the present zoning is not
suitable for Local Retail or
Residential zoning; the traffic which
exists and the existence of the
businesses there, insurance company,
gasoline station, pizza store and
even the city's maintenance and storage
garage.

Mr. Brady' said they were not
requesting this for speculative
zoning, they have specific use for
this land. He said Mr. Brown plans to
use· one of the lots to relocate his
business from his present location on
Flory Street. Mr. Brad~ showed the
site plan and floor elevation for this
lot to the Commission.
Mr. Brady said the other lot is under-
contract, contingent on getting this
rezoning, with Tommy Powell who is
doing busin~ss as Otis Gothard Exxon.
He said Mr. Powell plans to build an
automotive maintenance and service
building on this lot. Mr. Brady
showed the Commission the site plan
and floor elevation for this lot.

Mr. Brady said under the new Proposed
Zoning Ordinance, this area wou¡d be
classed -as "Commercial-2 or ·.C-2'1 .
Mr. Brady said he feels this would be
an asset to the city and the
neighborhood.
Mr. Wood asked how soon they would
start construction.
Mr. Brady said both Mr. Brown and Mr.
Powell should get started by early
June.
The Chairman called for those wishing
to speak in opposition to this request
to please come forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.

Mr. Wood said this area is shown on
the Proposed Zoning Map as Commercial
and he feels this is an appropriate
zoning.

AFTER APPROPRIATE NOTICE AND PUBLIC HEARING THE FOLLOWING RECOMMENDATION
IS SUBMITTED TO THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS BY

Chairman Tucker opened the ?ublic
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
Delbert Stembridge came forward to
represent Mr. Waters. He said they
are requesting a rezoning from
Agriculture to IF-9 to allow
development of four lots.
The Chairman called for those wishing
to speak in opposition to this request
to please come forward.
Bruce Auld, Attorney with offices at
669 Airport Freeway, Suite 309, Hurst,
came forward. He said he was
representing Mr. & Mrs. Daniel Curry
who are opposed to this request as
well as other property owners in the
area.

Mr. Auld said he had a petition signed
by 22 property owners in the area: who
are opposed to this request. He said
their objections were that it would
completely break the continuity of the
homes in Stony~rooke. Mr. Auld said .
the homes in the area are 1400 to 1600
square feet, the ones on Hightower are
1500 square feet. He said the lots
look smaller than the other ones
there. He said if this zoning goes~
through, it would allow smaller lots
and smaller houses.
Mr. Auld said he lives in Richland
Hills and is a councilman there, and
he understands they must consider if
this is the highest and best use of
this land, but you can turn this down
tonight and they can go hack to the
drawing board. He said the way it
stands now, it would allow too small
houses and the lots would be onÎr. half
or two thirds as deep as the adjoining
lots. M~. Auld said without doing any
s~udying,- he felt it would place the
houses there adjacent to the front
yard of ~he Curry's as well as
everyone ·-else.
Mr. Auld said you could see on the
petition that the ones who signed it
are not opposed to more development
there, but they are opposed to the
small houses, and they feel they are
trying to squeeze too may houses on
too little land.
Chairman Tucker stated that the
present zoning for Stonybrooke
Addition ~s IF-9 and they are asking
for IF-9. ' He asked Mr. Auld if he was
asking the Commission to deny this
request when it is the same.
Mr. Auld stated he was not aware it
was the same zoning, but he did not
feel they should allow a 1300 square
foot house next to a 1500 square foot
house.

Mr. Wood said the building line would
be the same as required for the
Subdivision, also.
Mr. Auld said they are squeezing too
many in this small area.
Mr. Hannon said their smallest lot
shows to be 11,000 square foot and the
requirement for IF-9 zoning is 9,500
square feet.
Mr. Auld said the house size was the
most important factor.
Chairm~n Tucker said the zoning on
Stonybrooke Addition is IF-9 with the
stipulation that 20%-1600 square feet,
20%-1500 square feet, and 20%-1400
square feet.
Palmer Hoffner, 7300 Stonybrooke, came
forward. He said there were ru~ors
going ro~nd that they were going to
build 1,100 square foot houses. Mr.
Hoffner ~aid he felt 1,300 square foot
homes wo~ld be different. He said he
felt the people would be in favqr of
it if it~were consistent with the ones
there. He said he doesn't think they
are against the development, but if
the Commission approved this request,
it would benefit the developer, not
the people.
Mrs. Waters came forward. She said
they had owned this property for a
long time. She said they are not sure
what size houses they will build here.
Mr. Hannon asked if they would agree
to a minimum of 1500 square feet.
Mrs. Waters said they would.
Mr. Auld said the property owners
would accept that.

APPROVED
Mr. Hannon made the motion to approve
PZ 83-28 with the stipulation that the
houses be a minimum of 1500 square
feet. This motion was seconded by Mr.
Bowen and the motion carried 5-0.

came forward. He said this would be
an additional phase of Foster Village.
He said this property has been zoned
for 10 years, but they are requesting
this change because of demographics
and need to keep the cost of the lots
down, but keep the house size the
same.
Mr. Harris said there is IF-B zoning _
on some property to the south next to
the school and there is also some
duplex zoning to the south. He said
the property to the west is 6,000
square-foot lots. Mr. Harris said
they plan to keep a buffer of IF-9 to
the south, but will develop it at the
same time as this property.
Mr. Wood asked how many additional
lots this change would make.

Mr. Harr~ said there would be
approximately 19 additional lots.
Mr. Hannon asked if this property was
platted. E

Mr. Harris said they platted this
property, but'because of a drainage
problem down stream, it was never
recorded. He said they have worked
with the city in getting the needed
easements and believe this problem has
been worked out.

proposed classification of Commercial.
This property is located at the
southeast corner of Grapevine Highway
and Eldorado Drive.
Chairman Tucker .opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
Mr. Van Y cáme forward. He said the
is requesting this zoning change to
allow him to build a shopping center
225 feet long and 50 feet deep with a
warehouse in the back 200 foot-long
and 80 feet deep to house a Baird's
Bakery Disbursement Center and retail
shopping center.

Mr. Hannon asked what he meant by a
disbursement center.
Mr. Van Y said this would be where
their prqducts will be brought ~~om
where they were manufactured and will
be transferred to the trucks which
will take them to the retail units in
the area.
Mr. Hannon asked how large this would
be in regard to square footage.
Mr. Van Y said it would be

Jan Sheppard, 8113 Jerri Jo, came
forward. She said her property joins
this property to the south, and she is
opposed to this zoning request. Ms.
Sheppard said she 'has a note from Mr.
& Mrs. J. Thompson which states they
are also in opposition to this request
until further information is given.

Ms. Sheppard said they received a
letter yesterday from Mr. Van Y
stating what he is proposing there,
and it was the first time there was
any'mention of a shopping center. She
read quotes from his letter which
stated the part of the complex
adjacent to the single family would
have a concrete wall 16 feet high and
200 feet long with no doors or windows
and an 8 foot wood fence would extend-
from the concrete wall along the
property line from the northeast to
the southwest forming a sound barrier
for the property owners convenience.
It also stated trees would be planted
at intervals along the concrete wall
and wood fence to enhance the shopping
center's rear boundary.
Ms. Sheppard said she works in Dallas
and all she sees all day are c~pcrete
and glass buildingst and wi~h tñis,
she woulð go home and all she could
see woulã be a 16 foot high concrete
w{ill. -
Ms. Sheppard said there are lots of
shopping- areas in the mid cities area
and she was concerned with how many
shops would be in there and how many
would stand vacant. She said this
would allow more transients in the
area and her home has already been
broken into twice. Ms. Sheppard said
they have problems with garbage coming
from the Take-it store across the
street and there would be much more
with the Baird's Distribution Center
there.
Ms. Sheppard said she has only lived
there 2~ years, but several of her
neighbors have worked hard to get "No
'Trucks Allowed" signs put up at both
ends of Eldorado. She said they had
got them put on Nevada and Strummer
also.
Ms. Sheppard said the back of a
building is always the first to go to
pot, and she does not want a 16 foot
concrete fence nor the added traffic
this this would create.

not be happy with it, they could live
with it.
Mr. Van Y asked to speak again. He
said he would like to explain this
war~house situation. He said if you
have a strip center with a 12 foot
wall as opposed to the warehouse with
the 16 foot way~ there is just not
that much difference. Mr. Van Y
showed the Commission and homeowners a
prospective site plan for the area.
He said his reason for putting the 200
foot long concrete wall plus the wood
fence with the trees was to try to
create a noise barrier.

Mr.'Wood asked if all the trucks would
access onto Grapevine Highway or would
any of them go on the side street.
Mr. Van Y said probably the delivery
semi trucks would come in off Eldorado
and back in, but the trucks that leave
there will go directly to the highway.
Mr. Hannon asked to see a plot plan of
this property. He asked if all the
loading and unloading would take place
inside the building.
Mr. Van Y said it would.
Mr. Hannon said he was concerned there
might be several semi trucks se~ting
at one time with their dies~l ;

they would have 15 route trucks~which
would come into the entrance of~the
building~and be completely enclosed.
He said all loading and unloading will
be done on the inside and they do not
plan more than 20 vehicles in the
future. Mr. Baird said there would be
two transport trucks that would come
in late in the evening and would leave
out about 6:00 in the morning. Mr.
Baird said it would take about 40
minutes to unload them.
Mr. Hannon asked if they would have
enough off-street parking.
Mr. Baird said they would.
Mr. Hannon said his main concern would
be if they had to let a diesel set
there and idle for an hour or so.
Mr. Baird said they would not do that.
He said they have distribution centers
in all major cities such as Dallas and
Houston and they have one in Watauga.

He said they could make them go
through the center of the building and
then they would not have to come on

1. The plans which we submitted provid~d for a 27 inch storm
drain along Lot 9 and South to an e~isting 48 inch storm
drain in Crestwood Estates Block 8. This will be realigned
to parallel the sanitary sewer to Forrest Lane or across
Lot 5, Block 8 Crestwood Estates to Timberidge Drive. When
the final easements are received we will submit the storm
drain plans.
2. The water meter will be relocated.

We have reviewed the referenced materials for this subdivision and offer
the following comments:
1. We understand that the Developer's Engineer is considering various
alternate off-site storm drain routings because of difficulties
encountered in obtaining the required easements. The plans sub-
mitted for our review show only the first off-site drainage plan
considered, whiGh inlcudes an open drainage flume in lieu of the
underground system we requested. Whichever alternate off-site
drainage plan ;s selected we would request that plans showing the
proposed revision be submitted to us for review before approval.
2. The proposed wa ter meter wh ;ch is shown on the wa ter 1 ayout pl an to
serve lot 9 should not be located on the easement between lots 8 and 9.
3. The proposed off-site 10· utility easement should be changed to a
10' sewer easement if the Public Works Department approves the
alternate off-site drainage plan to locate the storm drain parallel
to the off-site sanitary ·sewer line.
4. The Public Works Department has requested that a manhole be con-
structed in lieu of the proposed cleanout on the west end of the
sewer line in Redwood Court.
5. A drop manhole connection should be provided at the north end of
Forest Lane and so noted on the plans.
6. We would request that a lime s~ries test of the street subgrade
be furn; shed our office for revi ew to detennine the quanti ty of
stabilization material required for this subdivision.

was talking about with the problem of

diligently worked with Mr. Adcock and
he has worked with them and now~they
feel they have all the problems worked
out. He~said the City Staff has also
worked with them. '
Mr. Elliott said they have an option
to buy this property subject to-the
approval of the ,zoning and platting.
He said it is not speculative zoning,
they plan to come back before this
Commission shortly with the
preliminary plat of this property.
Mr. Elliott said there was some
multi-family zoned property 'which
adjoins this property and they have
taken a little out of it to make the

Residents of Emerald Oaks Drive have petitioned the City to reconstruct
their street in the same manner as North Hills Drive.
·We estin~te the cost to add Emerald Oaks Drive to .the e~isting contract
to be approxiIMtely $8,000. The contractor is currently behind schedule and thë
inconvenience to the North Hills residents has been barely tolerable the last
several nlonths. We would not reconunerid any chan.ge to the contract to include
En~rald Hills Drive.
The residents can be assured that Emerald Oaks Drive will be repaired
(with ~~cessary storm drain improvements) and over layed by our City crews

First Baptist Church, Haltom City Request to Tie Into Our Sewer Line

BACKGROUND:
I had several conferences with Reverend Mosley concerning this matter
and I told him that if this was approved they would probably have to pay a
linear foot. cost of $5.50 a foot to tie onto this sewer main. ' This ,is our
standard policy for all tracts of land abutting or joining our ~ater and
sewer' lines. I had also told Reverend Mosley that if thelr request is
approved they probably' should be prepared to pay ,a monthly ~charge-.t.hÇl,t
we would be mailing to them for ~his service. In order for us to bill
the Church monthly for sewer we have to contact Haltom City to find out ~h~t
the water consumption was for the month and then bill the sewer 9~~Qxdingly.

This letter is a follow-up of the letter from Haltom City, concerning
sewer service, for First Baptist Church-Haltom· City.
We are requesting permission to tie to your sewer line which runs within
twenty (20) feet of a building we plan to build, South of Shipp Drive,
just off Whittley. If we tied to Haltom City sewer, it would require
the installation of a pumping station.
This arrangement has been discussed and agreed 'upon with Haltom City.

BACKGROUND: The Civil Service Commission met on May 12 ;:¡nd vot:ed 11n~n;mn11~'Y Tn
recommend that the Building Official position be removed from under Civil Service
and to be. made an appointed position. Their decision was based on the following
information:
The construction activity in the City has iriareased in great 'numbers
when compared to last year. There have been 539 p.ermits issued to date' w.hi,le last
year's total was 437. Total const~uction value to date is'$6l.3 million'compared to
$21 million .last year. Monthly inspections håve reached 3,583 so far this year and
.
will certainly surpass last year's total of 4,292.
The responsibilities of the Building Official along with the knowledge
and ability required to insure that all construction will be in compliance .with the
appropriate laws, ordinances, and codes indicates that this is one of the most
critical positions in the City.
When compared to Hurst, Haltom City, Euless and Bedford we cannot

to the top Civil Service pay grade with a salary range of $17,592 - $24,768.
The other four cities provide the following salary or salary range for this
position:
Hurst: $31,304

Bedford: $27,216
Haltom City: $25,095
4IÞ The Civil Service Commission feels that in order to attract and keep the caliber
of person necessary for this position, the salary range should be higher than
what's available in the Civil Service Pay Plan. They also felt that since the
Building Official is an appointed position in the other four cities, ours should

On Tuesday, May 10th, we had a serious electrical control fire in this
booster pump' station which crippled all six booster pumps. We can only sµecu1ate as t~___
what may have caused the fire but we think that the copper wire was not com?atib1e with
the aluminum bussbar so the new controls that We have ordered are the copper bussbars.
We have had trouble with these controls for several months as they have been ar~;ng
from time to time and we have had Westinghouse take.a look at them hoping that they
might replace them due to faulty materials even though they have been installed for
several years, and are not under warranty. Westinghouse refuse:d to do :this. AfteL..t.he..~ ~--~._-

IRREGULAR PROPOSALS
Proposals ~ill be considered irregular if they show any omissions,
alterations of' form, additions, or conditions not called for, unauthorized
alternate bi~s, or irregularities of any kind. Howeve~, the City of North
Richland Hills reserves the right to waive any irregularities and to make
the award in the best interests of the' City of North Richland Hills.
4. REJECTION OF PROPOSALS
The City of North Richland Hills reserves the right to reject any
or all proposals, and all proposals submitted are subject to this reservation.
Proposals may be rejected, among other ~easons) for any of the following .'
specific reasons:

(b) Proposal containing any irregularities.
(c) Unbalanced value of any items.

DISQUALIFICATION OF BIDDERS
Bidder~ may be disqualified and thei~ proposals not considered,
among other reasons, for any of the following specific reasons:
(a) Reason for believing collusion exist~ among the bidders.
(b) Rea~onable grounds for believing that any bidder is interested in
more than one proposal for the work contemplated.
(c) ~~ere the bidder, any sub-contractor or supplier~ is in litigation
with the City of North Richland Hills, or where such litigation is
contemplated or imminent) in the sole opinion of said City.
(d) The bidder being in arrears on any existing contract or having
defaulted on a previous ~ontract. .
(e) Lack of competency as revealed by a financial statement, experience
and equipment, questionnaire~, etc.
(f) Uncompleted work ~hich in the judgment of th~ City of North Richland
Hills will prevent or hinder the prompt completion of additional ~ork
if awarded.

At,7ARD OF CONTRACT
Award of contractt if it be awarded, will be made by- the City of
North Richland Hills to the lowest responsible bidder meeting the
requirements of the City' of North Richland Hills, and will be made wi~hin
sixty (60) days after the opening of the proposal, but not before'said .
City's next monthly meeting. No award yill be~made until after investigations
are made as to the responsiþilities of the low'bidders.
7.
ASSIG1\TMENT
The successful bidder may not assign his rights and duties ~nder
an award '-Ñi thout the wri,tten consent of the Ci ty 0_£ North Richland Hills
City Manager! Such consent shall not relieve the assignor of liability
in the event of default by his assignee.
8. NOTICE OF DELAYS
~~enever the vendor encounters any difficulty which is delaying
or threatens to delay ~irnely performance (including actual or potential
labor disputes), the vendor shall immediately give notice thereof in
~riting to the Purchasing Agent, stating all relevant information ~ith
respect thereto. Such notice shall not in any way constitute a basis for
an extension of the delivery or performance schedule or be construed as a
waiver by the City of North Richland Hills of any rights or remedies to ~hich
it is entitled by law or pursuant to p~ovisions herein. Failure to give
such notice, however, may be grounds for denial of any request for an
extension of the delivery or performance schedule because of such delay.

Spreader
A. Rescue tool operates at 5000 PSI. Anything over that is
considered extremely dangerous since hydraulic fluid is
compre~:sable over 6,000 PSI and causes a violent explosion
if the hose breaks. High pressure also causes the petroleum
based or mineral based hydraulic fluids to heat up to
temperatures approaching the boiling point, reduces the
life of the pump, and evaporates the fluid. Synthetic
hydraulic fluids are not susceptable to those extremes
and do not need to be replaced for over 6 years.
B. Tool opens to 27 j_nches__ and developes over 10, 000 pounds
of force at the tips in a push-pull operation.
C. Weight is 60 pounds wet.
D. Tool comes complete with chain and shackle package for
pulling steering columns.

$26,809.38,· for materials furnished and work performed on the referenced
project as of May 3, 1983.
The quantities and condition of the job have been verified on-site
by your representative, Floyd Mc.Callum, a"s -indicated by signaturè on
the estimate, and we have checked the item extensions and additions.
In the absence of a~y negative reports by the Ci ty Staff conc~rning
the condition of this project, .we would recexnmend that the above f;nal\,
payment be made to Stolaruk Corporation at P. O. Box 61587, Dallas,
Texas 75261.
This project includes curb. and gutter, paving and storm drainage con-
struction along Jerrie Jo Drive and Eldorado Drive. Existing curb and
gutter and driveways were replaced at locations shown on the plans and
also at additional locations as directed by the City Staff.
In accordance with Section 3.2.11(a) of the Contract, the two (2) year
term of maintenance will begin on this date, and therefore, will terminate
on May 13, 1985.
The total completion time for this project was 90 cal'endar days, for
a scheduled completion date of May 2, 1983. Since work was complete
before, this date liquidated damages were not incurred and therefore
should not be assessed on this proje~t.
Along with the final Contractor's. Estimate tabulation we are enclosing
a "Reconciliation Change Order" for your infonnation which accounts for
differences between the original estimated and actual as-built quantities.

We would note that most of the cost over-runs are attributable to
additional curb and gutter and driveway removal and replacement as
directed by the City Staff. Also additional asphalt pavement replace
ment, which includes a concrete trench cap, was used at the intersection
of Jerrie Jo and Eldorado to provide extra protection against possible
trench settlement along the storm drain pipe at that location.

BACKGROUND:
I think you all know where we stand on this project and the problems

we have had in this area with the contractor. He has the curb in on part of the
streets and has part of the streets stabilized and he is still working on the curbs
on some of the other streets. He is still trying to clear up a few minor water leaks_'--__~
This job is going to have some overruns because of the extra 'french drainage ~yst~m~
we have had to build on this project. We have put !n 1600 ft. of french drains and
the contract called for onl~ 180 ft. This totals $15~194.00 in ov~rr4n. We have also
had a $12,382.60 overrun on 6" water pipe. This iob shows to be approximately 66%
complete and 68' days remaining on the contract.

BACKGROUND: This project is about 30% complete. They are about through with the

utility adjustments on the streets that were originally bid. As you know a change
order was approved in conjunction with this contract to replace. the water line on
Briley and Lariat and they have almost completed that replacement. They should
be ready to patch that street in the near future. The contractor should be abQut
ready to start pulling curb and gutters and do stabilization work on the balan~e
of the streets infuis project. There is about 190 days left for this contractot
to finish.
