abstaining since she was not present
at the meeting.

Gary Teague with Teague NaIl and
Perkins Engineers came forward to
represent Mintex. He stated they have
no problems with the City Engineer's
comments. Mr. Teague said item #5
regarding the easements shown on the
replat, they are existing easements on
the original plat so they had to show
them on this replat.

PS 83-60 subjeet to the Engineer's
comments. This motion was seconded by
Mr. Sehwinger and the motion carried

We are in receipt of the City Engineer's comments addressing
the replat of Lots lR, 2 & 3, Block 4, Industrial Park
Addition, dated July 18, 1983 which accompanied your letter of
July 20, 1983.
We are in agreement with the above mentioned comments. In
regards to Comment No.5, the utility easements in question
are existing and are shown as indicated on all previous plats.
We will make all necessary ·corrections and/or additions.
If you have any further questions or comments, please do not
hesitate to call.

We have reviewed the referenced materials for this subdivision and offer the
following comments:
1. A fully executed Owner's Acknowledgement and Dedication Statement along
with Notary Certification should be included on the Plat.
2. The name, address, and phone number of the Owner of the property to be
replatted should be noted on the plat.
3. The Surveyor's address and phone number should be noted on the plat.
4. The Commission and Council endorsement blocks should be affixed to the Plat.
5. Since construction plans have not been submitted to our office for review we
do not know what utilities the proposed 10 and 20 foot utility easements will
contain. Howevert if they are being provided for water and/or sewer lines
then easements dedicated specifically for these City owned utilities should
be so noted as water and/or sewer easements only.
6. The zoning of the platted property (commercial) should be noted on the plat.
7. A small scale vicinity map indicating the general location of the platted
area should be shown on the plat.
8. The acreage of lots l-R, 2 and 3 should be noted on the plat.
9. All utility companies should be advised of this proposed rep1at.

Lot B-R, Block lIt Clearview Addition.
Tom Wilder came forward to represent
Mr. Hamm. He said they had received
the City Engineer's letter and he
would like to comment on it. Mr.
Wilder said in item #2, there is no
existing easement but they have
contacted Arco and have signed an
easement. He said it has not been
recorded, but they will provide the
city with a copy.vhen it is recorded.
Mr. Wilder said they do not expect any
problems with Arco.
Mr. Wilder said item #3 regarding
putting the zoning on the plat, he
doesn't feel they should put the
present zoning on the plat when the
city may adopt a new zoning soon.
Acting Chairman Bowen said the new
proposed Zoning Ordinance has not been
adopted yet and they have to go with
the present elassification.
Mr. Wilder said item #4 regarding
setbacks, under their present site
plan, they plan all their buildings to
front on Grapevine Highway. He said
they can show a 25 foot building line
on the rear, but they need the 10 foot
on the sides. Mr. Wilder showed their
site plan to the Commission.
Couneilman Davis asked if they plan a
eurb cut on Colorado.
Mr. Wilder said if they eannot get two
curb cuts on Grapevine Highway, they
will need one on Colorado.
Mr. Hannon stated the setbacks could
be changed by a replat, and in regards
to the zoning, this Commission ean not
make deeisions on something that may
or may not be adopted.
Couneilman Davis asked if they make a
curb cut on Colorado, would they need
the building line.

Mr. Wilder said they had talked with
the City Staff regarding how they plan
to faee the buildings. He said they
are requesting they be allowed to have
a 25 foot building line on the front
and rear and a 10 foot on one side and
not show any sideyard on the west.
Mr. Wilder said in item #6, they have
problems with requiring the pipeline
to approve their plans. He said they
have talked with Areo_several times
and don't feel they will have any
problems, but they do not feel they
should have to approve our plans.
Mr. Hannon stated that item #6 is not
the city's funetion, it must be worked
out between the pipeline company and
the developer.
Mr. Wilder said where the pipeline is
would only be a parking lot.

PS 83-61 subject to the Engineer's
comments with the exception of items 2
and 6 and with provisions on item 4 be
changed to require a 25 foot building
line on Grapevine Highway and Standley

seeonded by Ms. Nash and the motion
carried 4-0.

In response to Knowlton-Engll¿~-Flowers letter dated
we offer the following comments:
1. On the preliminary plat the drainage study was done
using the U.S.G.S. mapswitbout regard to the
development of Stonybrooke north of the subject
property. In the process of preparing final plans
for the subject property it was determined that we
are receiving practically no water from the north of
our subject project, and a more detailed drainage
study was prepared with the final plans.
2. We take no exception to item number 2.
3. & 4. The purpose for not extending the sewer line to the
east line of the subject property is that the contours
are such that all the property to the east of the subject
property will have to be served from future sewer extensions
from the east.
We have revised the utility layout and final plat for the
subject property to show construction of a manhole in the
middle of Hightower and extending the proposed swere line
to the north approximately 5 feet north of the south property
line and paralleling the south property lin to the west
property of Lot 29 with a 6" sanitary sewer at 0.50% grade.

We have reviewed the referenced materials for this subdivision and offer the
following comments:
1. See Case No. PS 83-38 for preliminary plans.
2. The proposed fire hydrant located on the proposed 24-inch water line should
be moved to the west side of the gate valve at lot 29.
3. The Subdivision Ordinance requires-that the proposed sanitary sewer main
in Hightower Drive should be extended fully to the east line of lot 29
for possible future extensions. (See Item 4 below).
4. The Texas Department of Healtb Resources Design Criteria Manual for
Sewerage Systems requires that the minimum permissible grade for a
sanitary sewer line is 0.50 percent. The design grade of the proposed
6-inch PVC sanitary sewer line in Hightower is only 0.40%. Also the
depth of cover on the sewer main at the east end is only about 1~ feet.
We note that concrete encasement is proposed for the portion of this
line with cover less than 2~ feet, but this is still a very marginal
design of which we are reluctant to recommend approval since service
to lots 28 and 29 will be difficult. We would suggest that the profile
of Hightower be raised along with the finished floor elevations of lots
28 and 29.
5. We would request that soil samples taken on Hightower Drive to determine
the percent of subgrade stabilization admixture required based on recom-
mendations from an independent testing lab.

BACKGROUND:
This property is located at the southeast corner of Rufe Snow Drive and Lewis
Drive and bounded on the south by TESCO easement.
There was a question regarding the pro rata. They said they were of the opinion that the
pro rata was paid prior to them purchasing the propertYt but if it had not been paid, they
would pay it.
They also want to be allowed to use concrete instead of lime stabilized subgrade.
The Planning and Zoning .Commission recommended approval of this final plat subj ect to the
Engineer's comments with the exception of item #5 and a clarification of item #1.

1) Pro-Rata: It is our understanding that pro-rata issues resolved
at the June 23, 1983 Planning & Zoning Commission meeting.
2) Signatures & Surveyor's Seal: All required signatures will be
affixed to the final plat before sutrnittal to the City of North
Richland Hills Council.
3) Surveyor's Narre, etc.: This will be included on the final plat
before presentation to City Council.
4) \\Tater & Sewer Easements: Ten (10) foot wide easements will be
provided for all water and sewer lines.

1. We would recommend that the name of this development be changed to

2. Before approval of this preliminary plan by the Zoning Commission,
the Developer's Engineer should affix his seal of registration and
certification to the plat.
3. The existing zoning of this development (commercial) should be shown on

5. Utility companies should be consulted regarding any additional easements
which may be required to serve this development.
6. Circles of fire hydrant coverage should be shown on the plan based on

7. Permits should be obtained from TESCO for construction of the proposed

$8.59 per linear foott as established in accordance with the City's

ORDINANCE NO.
Be it ordained by the City Council of the City of North Richland
Hills, Texas, that Ordinance No. 381, "Rules and Regulations for Water and Sewer
System", adopted November 8, 1971, and as heretofore amended, be and the same is
hereby amended at Section IV, paragraphs ld., A-3 and B-2, to read as follows:
ld. An applieant for service from a fire hydrant where water is
placed in a tank truck or other container shall place a meter
deposit with the City of North Richland Hills, the amount to be
specified by the Director of Finance. Fire hydrant meters are
designed for use in construction projects, the exact loeation of
which will be required on the application. tach applicant shall
be required to return the meter to the Billing Department for a
reading each month, before the 30th of said month. Should an
applicant fail to provide a reading, he shall be billed a minimum
of $100.00 per month. The minimum bill for 0-16,000 gallons
shall be $48.00. The rate of water from 16,000 gallons will be
$3.00 per 1,000 gallons. Contracts for fire hydrant meters will
be valid for six (6) months at which time applicant must renew
his contract or forfeit his deposit. Applicant shall hold each
meter as a bailee under contract to return same at the end of
stated period.
The deposit will be refunded, or in event a balance is due, applied
against the final bill for services required upon termination of the contract.
The City will not pay interest on mete! deposit funds.
This poliey, proeedure and specified change shall take effect on
September 1, 1983.
A-3. At locations where only a partial connection has been previously
paid for or installed, including only the tap, service line or
curb stop and setter, the applicant for serviee shall pay (in
addition to the meter deposit) the cost of completing the Serviee
Connection with meter and box, which costs are non-refundable.
For all services 3/4" through 6", an estimate of the eost plus
$50.00 for each living unit for the connection will be provided
by applicant and a deposit of the estimated amount will be
required before work is started on the installation of such
conneetion. Should the final cost of the work exeeed the amount
of the deposit, a statement showing the amount of the excess will
be immediately furnished to the person having made the deposit,
and this amount will be due before water service is aetually
begun. Should the final cost be less than the amount of the
estimate or deposit, a refund of over payment will be immediately
made to the person from whom the deposit was reeeived. THis
refund does not pertain to the living unit cost. The above cost
shall be less 10% for multi-family where the living units exceed
12 units.
B-2. Where the furnishing of sewer service by the City does not
require the extension of Lateral Sewers or other Sewer Mains as
defined under Point of Service to serve a new single eustomer,
the charge for the right to connect to the system shall be Three
Hundred Five Dollars ($305.00) for each living unit. Except in a
developed subdivision where a developer has paid for the
installation of sewer facilities then the charge shall be Fifty
Dollars ($50.00) for each living unit. The above cost shall be
less 10% for multi-family where the living units exeeed 12 units.

On June 27th, 1983, the City Couneil approved a $100,000 Supplemental
BACKGROUND:
Libråry Budget.

At that time the Library Director placed a direct order of
$8,877 for book shelving, one of the items designated within that Budget. An
order for this amount should have been given to the Purchasing Agent for his
action. This was not done. The Library Director has given the following
explana t ion:
When the itemized budget was being constructedt it was obvious that
a large addition of ,books would require ·the support of more equipment. Included
in this support would be the need to upgrade the current shelving and to have
this shelving capable of inter-membering and mª, tching in every way. Therefore,
the Library Director requested that a represenfative of the former vendor (Business
and Institutionallnt~riors" who carry the Lib~ry Bureau line) eome to', the Library

Supplemental Budget Request. This was accomplished and the $8,877 figure was
placed in the Budget. After City Council approval of the total Supplemental
Budget Request, the Library Director then made the inadvertent error of
calling the representative direct, telling him that the City Council had
approved the Budget and he could go ahead with the order. On July 19th the
Library Director realized that she is not empowered to do thi~; that the
.
proeedure for ~n order of this amount must be placed with the Purchasing Agent.
John Whitney has contacted the representative of Business and
Institutional Interiors, Mr. Adrian Alexandert and has been advised that the
order is 60% fabricated and to cancel the order at this time would result
in a charge for the material already fabricated. Mr. Whitney feels it would
not be advantageous to the City to cancel the ordert pay fabrication cost and then
repurchase the equipment from the same vendor or some other vendor on a
competitive bid basis.

I am writing this letter to request a variance be granted to the brick veneer requirement
under the multi-family zoning ordinance for the Hilltop Apartments Project which is being
built on Lot 1 Block 2, Tapp Addition, also known as 6404 Industrial Blvd.
It is my understanding that the eity does not permit stucco to be substituted for briek
veneer in order to fulfill the exterior wall construction requirements. It is further
my understanding that the city requires 75% brick veneer on the the first floor exterior
walls only.
o~ this project, the first and second floor exterior walls will be brick veneer, with the
~ption of the stairwells, patio area, and a section of stucco on the ends of each build-
ing which range in width from 9' to 21' and is on the second floor walls only. The ends
of the building range in width from 37' to 46'.
The purpose of the stucco section on the ends is to provide a visual break and prevent
cracking of the large brick wall. Howevert in order to comply with the zoning ordinanee
requirement the stucco seetion cannot be carried down to the foundation level. The super-
intendant on this project is coneerned that the joining of the stucco section and the brick
below it will result in water leaks during heavy rains. From the appearance standpoint, it
is my opinion that the stueco section for the full height of the wall will be more attrae-
tive.
As you know stuceo construetion exceeds the eity's building code as to fire rating, and is
no less expensive than briek veneer eonstruction.
In summary, my request is for the city to permit the inclusion of the stuceo section des-
cribed above on the first floor exterior walls when ealculating the 75% masonry area. I
am eonvineed that this will allow our project to enhance it's asthetic appeal without eom-
promising the city's standards.

SUBJECT: Ordinance Governing Operation of Amusement Centers

BACKGROUND: The proposed ordinance ~s a rewrite of Ordinanees #658 and 895 to provide the
following improvements:
(1) Eliminate exemptions, as discussed with the City Couneil on July 25th, 1983.
(2) The requirement that the business "be on the ground floor and the machines visible
from the street" has" been eliminated. The Poliee Department,sees no reason to require
that all games be visible' from the street.
(3) The hours of operation (Section,V) have been extended to eoineide with the hours of
operation of those businesses licensed by the Texas AlcQnol Beverage Commission (TABC).
There seems to be no logic to allow beer and liquor sales to extend to midnight, but
requiring game playing t9 stop at 10:00 P.M. The hour of closure was extended two (2)
hours - from 10:00 P.M. to midnight.
(4) SECTION VII. Forbids liquor - unless the site 1S licensed by TABC and zoned for use
by this City.
(5) SECTION VIII. Requires the operator to post a notice of minors being prohibited from

(6) SECTION XVIII. Increases the fees and removes the minimum number of machines
required before a license must be obtained. Those with one game, but less than ten
(10) games will pay $25.00 per year plus $7.50 per maehine. Those with at least
ten (10) games, but less than 25 games will pay $50.00 per year plus $7.50 per
machine. Those with 25 or more games will pay $100.00 plus $7.50 per maehine.
(7) SECTION XX. Requires that the permit be prominently and permanently displayed.
(8) SECTION XXI. Requires that the operator of the establishment be at least
eighteen years of age. (No age minimum was required in the old ordinanee and
difficulties are presently being experienced in maintaining order due to this
defieieney).
(9) SECTION XXII. Raises the max~mum fine to $500.00 as permitted by a recently
passed State Law.

COIN OPERATED AMUSEMENT MACHINES
AN ORDINANCE REGULATING THE-OPERATION OF POOL, BILLIARD, RECREATION,
OR AMUSEMENT CENTERS; DEFINING SAME; PRESCRIBING THE LOCATION
THEREOF, CONSTRUCTION THEREOF, HOURS AND TERMS OF OPERATION THEREOFt
AND PROVIDING FOR INSPECTIONS, LICENSE APPLICATION THEREFOR, INVES-
TIGATION THEREUNDER FEE THEREFOR; PROVIDING FOR APPEALS, FOR REFUSAL
OF LICENSE, PROVIDING FOR LICENSE, AND PRESCRIBING A PENALTY FOR
VIOLATION THEREOF.
SECTION
I. DEFINITIONS
For the purpose of this ordinance, the following words and phrases shall have
the meanings herein ascribed to them:
(a) Pool, Billiard, Recreational, or Amusement Centers. The term "pool,
billiard, reereation, or amusement center" shall mean and include any
buildingt room, plaee or establishment of any nature or kind whatsoever
by whatever name ealled, where billiard tables or any type or eoin-
operated machines used primarily for purposes of amusement or entertain-
ment are operated for profit whether the same be operated in conneetion
with any other lawful business or not, save and except religious, ehari-
table or educational organizations authorized to operate in that capacity
under the laws of the State of Texas.

(b) Billiard Hall. Any strueture where one (1) or more billiard tables are
operated for profit.
(e) Operator. Any person owning, leasing, managing or controlling in~ny
manner a billiard hall or a skill or coin-operated machine establishment.
(d) Skill or Coin-operated Machine. Any coin-operated machine of any kind or
character whatsoever, when such machines dispense or are used or are
capable of being used or operated for amusement or pleasure or when such
maehines are operated for the purpose of dispensing or affording skill or
pleasure, or for any other purpose other than the dispensing or vending
of merehandise, music or service, as those terms are defined in Title 22A
Taxation, General of the Laws of the State of Texas.
(e) Skill or Coin-operated Machine Establishment. Any structure where one
(1) or more skill or coin-operated maehines are operated for profit.
(f) Skill or Coin-operated Maehine Establishment Lieense. A lieense issued
to operate a skill or coin-operated maehine establishment.
SECTION
II. EXEMPTIONS FROM TAX
(a) No person shall maintain, display for publie patronage, or otherwise keep
for operation by the public, any skill or pleasure coin-operated maehine
without first obtaining a permit issued under the terms and conditions of
this artiele.
(b) No permit is required for an individual to own and operate a skill or
pleasuret coin-operated machine for personal use and amusement in his
private residence.
(c) No permit is required for any person to own, maintain or offer for use to
the public any coin-operated pleasure or amusement machine designed
exclusively for use by children under the age of ten (10) years, sueh as
coin-operated riding machines and other related coin-operated machines.
(d) Gas meters, pay telephones, pay toilets, food vending machines, con-
feetion vending machines merehandise vending machines, beverage vending
machines, and cigarette vending machines whieh are now subject to an
oceupation or gross receipts tax levied by the State of Texas, stamp
vending machines, and service coin-operated machines, as that term is
defined, are expressly exempt from the tax levied herein.
SECTION
III. LOCATION NEAR CHURCH, SCHOOL, OR RESIDENCE
No publie pool, billiard, recreational, or amusement center shall be operated
in the City within two hundred (200) feet of a church, school, hospital, or
within one hundred (100) feet of a private residence. The two hundred (200)
or the one hundred (100) feet shall be made from the closest point of the
sehool, hospital, church, or private residenee building to the closest point
of the building containing such pool, billiard, recreational, or amusement
center.

IV. PARTITIONS

Once a permit has been issued under ~his ordinance, it shall be unlawful for
any person to erect or construct on any premises or to cut the building into
two (2) or more rooms by constructing partitions therein, if such partî~ions
shall obstruct the view of those engaged in playing the maehines in the
establishment from passers by.
SECTION
V. HOURS OF OPERATION
No person shall engage in the operation of any publie pool, billiard, reerea-
tional or amusement center within the eity between 12:00 midnight and 7:00
A.M. Monday through Saturday nights; provided, however, that sueh table or
tables or machines shall not be operated on Sunday, except during the hours
between 1:00 P.M. to 6:00 P.M.
SECTION
VI. GAMBLING; INTOXICATION
It shall be unlawful for any person while in a billiard hall or skill or
coin-operated machine establishment to gamble, make bets, eonsume or have in
his possession any aleoholic beverage, or to be under the influenee of any
alcoholie beverage; provided, however, that terms of this seetion relating to
the possession and eonsumption of any alcoholie beverage shall not be appli- ,
cable to parties on premises that are operating pursuant to a mixed beverage-
permit issued by the Texas Alcoholic Beverage Commission and zoned for sueh
use by the eity.
SECTION
VII. MINORS PROHIBITED DURING SCHOOL HOURS
(a) No person under the age of eighteen (18) years will be permitted to
attand any billiard hall during a time that the public schools in the
city are in session.
(b) No person under the age of eighteen (18) years shall play or be permitted
to play any skill or coin-operated machine during a time that the publie
schools in the city are in session.
SECTION
VIII. NOTICE POSTED
A permittee hereunder shall affix and prominently display on each eoin-
operated machine under his control a sign which shall read "Play by any
elementary or secondary school student during school hours is prohibited.
Violations are'subject to a maximum fine of $500.00".
SECTION
IX. INSPECTIONS
(a) The City Manager shall have authority to appoint or designate a person to
make periodic inspections of premises licensed under this article for the
purpose of determining whether or not such premises are in complianee
with the health, plumbing and sanitary and other ordinances of the city.
(b) Officers of the police department on offieial duty are authorized and
empowered to enter at any time for the purposes of inspection and for the
preservation of law and order, any billiard hall or skill or eoin-
operated machine establishment within the city.

X. PERMIT REQUIRED

It shall be unlawful for any person to operate, for profit or personal gain,
any public pool, billiard, recreational, or amusement center in the eity
without first obtaining a lieense from the City Seeretary for sueh purposes.
SECTION
XI. APPLICATION GENERALLY
(a) Any person desiring a license to operate a pool, billiard, reereational,
or amusement eenter shall file with the City Secretary a written, sworn
application for such license, whieh applieation shall state:
(1) The location, by street and number, of the plaee, space or building
and room or floor, and the size of sueh room or space, which is
proposed to be used for such purpose, and the name and address of
the applicant.
(2) If the applieant is an individual, that he is a law-abiding eitizen
and that he has not been eonvieted of a felony, or of a minor
misdemeanor, if he has, the nature of the offense.
(3) If the applieant is a firm, assoeiation or partnership, all of the
information preseribed in paragraph two (2) of this subsection as to
eaeh individual eomposing the firm, assoeiation or partnership.
(4) If the applieant is a eorporation, that the applicant is organized
and ehartered under the eorporation laws of the state applicable to
sueh eorporation, or, if a foreign eorporation, that sueh corpo-
ration has complied with the laws of the state applieable to sueh
eorporation and the same information with referenee to the operator
or person in eharge of the operation of the public pool, billiard,

recreational, or amusement center to be licensed as is preseribed in
paragraph two (2) of this subsection. In addition thereto, a
statement as to the names of the incorporators or stockholders, and
the amount of interest owned by each.
(5) The previous occupation or employment of the applicant for a period
of five (5) years next preceding the filing of his application.
(b) The information given in such application is for the purpose of determin-
ing whether or not the applieant is a fit and proper person to operate a
public pool, billiard, recreational, or amusement center. It shall be
unlawful to misrepresent the kind and character of pool, billiard,
reereationalt or amusement center to be operated, or any other fact or
statement made in such application, and any misrepresentation of any
person, club or organization for the purpose of avoiding the provisions
of this article shall, in addition to the other penalties preseribed by
lawt be cause for revoeation or non-issuanee of the license.
SECTION
XII. INVESTIGATION AND APPROVAL OF APPLICATION BY CHIEF OF POLICE
No license shall be granted pursuant to this division unless it shall appear,
upon investigation by the Chief of Police or his designee(s) that the premises
to be used for the purpose of operating a public pool, billiard, reereational,
or amusement center comply with the laws of the state and the ordinances of
the city regulating health and sanitation, the fire regulations, the zoning
regulations and the building code.
SECTION
XIII. ISSUANCE OR REFUSAL

In the event the Chief of Police fails to approve the issuance of a license to
any applicant under this division, the action of sueh offieial shall be final,
unless the applieant shall, within ten (10) day~ after the refusal to-gLant
such license, file a written appeal with the City Manager, addressed to the
City Council, requesting a hearing by the Couneil upon the question as to
whether or not his application shall be granted. In the event such appeal is
filed, the Chief of Poliee shall provide the Couneil with a reeord of all
proeeedings with referenee to the application in question, ineluding the
written application, together with the action of the Chief of Poliee and the
reasons for sueh action. The Council shall, within thirty (30) days, grant a
hearing thereon to determine the eorrectness of such action, at which hearing
the Couneil may make sueh investigation as it may see fit, whether or not all
the pertinent faets appear in the application. It shall be diseretionary with
the Council as to whether or not a license shall be granted and such aetion as
the Couneil may take thereon shall be final and conelusive.
SECTION
XIV. DOES NOT CONFER VESTED RIGHTS
The granting of any lieense under the terms of this division shall in no event
be eonstrued as the granting or conferring of any vested rights to the licensee
or operator, but shall be subjeet to revocation, caneellation or suspension as
provided in Seetion XVII.
SECTION XV. REFUNDS OF FEE; ASSIGNABILITY, TRANSFERABILITY OF LICENSE,
REORGANIZATION OF MANAGEMENT.
No refund of any lieense fee paid in accordance with this artiele shall be
made by the city for any eause whatsoever. Licenses issued pursuant to this
article shall be deemed personal to the licensee and shall not be assignable;
nor transferrable from one loeation or plaee of business to another location.
SECTION
XVI. TERMINATION; RENEWAL.
All licenses issued under the provisions of this article shall automatically
terminate on Deeember 31 of the year issued. A party may obtain a renewal
license by filing an application for renewal with the City Secretary. The
application for renewal shall contain the same information and be processed in
the same manner as a new application in accordanee with all of the above
sections. Renewal fees shall be as set out in section XV~II.
SECTION
XVII. REVOCATION; APPEAL

If a billiard hall or skill or coin-operated establishment licensed hereunder
is not being conducted in accordance with this article, the laws of the state,
or other ordinance of the City, the City Manager's Office may at any time give
notice in writing to the operator, licensee, manager, or other person in
eontrol of the operation and maintenance of such billiard hall or skill or
coin-operated machine establishment that the license issued for the operation
and maintenance of said billiard hall or skill or coin-operated machine
establishment has been revoked and cancelled, which notice of revocation and
cancellation shall become a final revoeation and caneellation after the
expiration of ten (10) days from the date of the service of same upon the
operator, licensee, manager or other person in charge of said billiard hall or
skill or coin-operated machine establishment, unless on or before the expir-
ation of said ten (10) days, the licensee, operãtor, manager, or other-~erson
in eharge of said billiard hall or skill or coin-operated machine establish-
ment shall file with the City Secretary a written appeal addressed to the
governing body of the eity, in which it is requested that the governing body
grant him a hearing upon the question whether or not the license issued by the
eity shall be caneelled and revoked. Such appeal, if made and filed as
prescribed herein, shall operate as a stay or postponement of said revocation
and eancellation until such time as the governing body shall grant a hearing
and make final adjudieation upon the question or not sucb lieense should be
eaneelled, such hearing to be held within thirty (30) days after the date of
the filing of sueh appeal. Such aetion and judgement of the governing body,
after hearing the evidencet shall be final and eonelusive as to all parties.
SECTION
XVIII. FEES
The following fee shall be charged for eaeh separate pool, billiard, reereat-
ional or amusement eenter as defined in Seetion one (1) of this ordinanee.
(a) Those establishments having at least one (1) game, but less than ten (10)
games, the annual fee shall be $25.00.
(b) Those establishments having at least ten (10) games but less than twenty
five (25) games, the annual fee shall be $50.00.
(e) Those establishments having twenty five or more games shall pay an annual
fee of $100.00.

(d) Any person engaged in the business of manufacturing, owning, buying,
selling, renting, leasing, trading, repairing, maintaining, servieing,
transporting or exhibiting any coin-operated machine within the eity who
has been issued a general business license by the Texas Amusement Maehine
Commission shall pay to the City of North Richland Hills an annual
license fee of one-half (~) the license fee paid to the State of Texas.
(e) For each pool, billiard, recreational, or amusement game or table there
shall be an additional fee for $7.50 per table or machine.
SECTION
XIX. NATURE OF PERMIT.
A permit issued under this article:
(a) Is an annual permit which expires December 31st following the date of
issuance,' unless it is suspended or eancelled earlier;
(b) Is effective for a single place of business only;
(c) Vests no property right in the permitee except to maintain, display for
public patronage, and permit the use of skill or pleasure eoin-operated
machines in aecordance with the terms and conditions of this article.
(d) Is nontransferable, nonassignable, and not subject to exeeution.
SECTION
XX. DISPLAY OF PERMIT

A permit issued under this artiele shall be prominently displayed at or near
the entrance of the business premises, and such display shall be permanent and
conspicuous.

XXI.
AGE RESTRICTION
The individual in eharge of the on-site operation of the licensed premises
shall not be less than eighteen (18) years of age on his/her last birthday.
SECTION
XXII.
PENALTY
Any person who violates any portion of this ordinance, shall be deemed guilty
of a misdemeanor, and upon eonvietion thereof, shall be fined in a sum not
less than ten dollars ($10.00) nor more than five hundred ($500.00) dollars;
each day of the violation shall constitute a separate offense.
SECTION
XXIII.
EFFECTIVE DATE
On January 1st, 1984, all establishments and games in this City as defined by
and eovered in this ordinance shall be in full eompliance with sueh ordinanee
under penalty preseribed herein.

XXIV.
SEVERANCE CLAUSE
Should any seetion, article, prov~s~on or part of this Ordinanee be deelared
to be unconstitutional and void by a court of eompetent jurisdiction, sueh
